Subject: Frequently Asked Questions (FAQS) on reservation to Economically Weaker Sections (EWSs) in posts/services under Central Government – reg.

Madam/Sir,
This Department issued O.M. No.36039/1/2019 -Estt(Res) on 31.01.2019 providing for 10% reservation to Economically Weaker Sections (EWSs), who are not covered under the reservation scheme for SCs/ STs/ OBCs in respect of direct recruitment in civil posts and services in Central Government. In this regard, it is stated that it receives a number of references from various Ministries/ Departments/ individuals for clarification of certain issues. The Central Information Commission in a hearing held on 27.04.2022, directed to take necessary action to place in the public domain FAQs on EWS reservation to assist the information seekers in future. Accordingly, the undersigned is directed to inform that a set of FAQs on the subject has been prepared, as under, which may be of use while issuing Income & Asset Certificate to the candidates by the concerned authorities.

FAQs on Property

No. Para 4.2 and 4.3 of said O.M. dated 31.01.2019 provides that the property held by a “Family” in different locations or different places/cities would be clubbed while applying the land or
property holding test to determine EWS status and the term ‘Family’ for this purpose will include the person who seeks benefit of reservation, his/her parents and siblings below the age of 18 years as also his/her spouse and children below the age of 18 years. Property beyond threshold limit tantamount to disqualification for applying to Income and Asset Certificate in respect of any of the children.

Yes. Para 4.2 of said O.M. dated 31.01.2019 provides that, the property held by a “Family” in different locations or different places/cities would be clubbed while applying the land or property holding test to determine EWS status. Person can apply for Income and Asset Certificate in the district of his permanent address.

Para 4.1 of the OM, dated 31.1.2019, speaks of residential property. However, exclusion of commercial property will result in injustice. Hence, the definition of residential flat/plot in the OM also includes the commercial property.

No. Grandparent is not a part of a family under para 4.3 of OM dated 31.1.2019.

It will be 90 square yards in urban area and remaining 90 square yards in rural area. Hence, as laid down in Para 4.1 of OM dated 31.1.2019, it is neither 100 square yards in notified municipalities nor 200 square yards in other than notified municipalities. As such, eligibility will remain for EWS certificate.

If it is a fiat, the criteria of Income & Assets applicable for residential flat of 1000 square feet and above as provided in para 4.lOi) of the O.M. dated 31.1.2019, will apply. If it is a plot, again, the criteria of notified municipality or the area other than the notified municipality will apply as provided in Para 4.1 (iii) and (iv) of the O.M., dated 31.1.2019.

Residential plot means a plot for the purpose of construction of residential house irrespective of the fact whether the house has been constructed or not. The entire area of the plot will be taken into account while assessing the eligibility of a candidate to get an Income & Asset Certificate. In this regard, rules/ regulations framed by the respective Municipality/ Panchayat shall be taken into account.

For the purpose of reservation in the category of EWS, the term ‘Plot’ connotes an independent identity, whereas the term ‘flat’ connotes a number of residential units/dwelling units built on the same plot.

Built up area of the fiat and the covered area plus the area left uncovered of the plot (as per rules of Municipality/ panchayats) will be treated as residential area and additional land beyond residential flat / plot being used for agricultural purpose, may be treated as agricultural land. This will be specifically for the purpose of determination of EWS status and not for any other purpose.

Total built up area of the residential unit/flat, including brick/pillar area (excluding staircase area and common area), is to be taken into account for computation of measurement of the flat.

FAQs on Category of Applicant

Question-11. Migrants belonging to Scheduled Castes (SCs), Scheduled Tribe(STs), Other Backward Castes(OBCs) in other State where they do not belong to SC, ST and OBC, then in that case, can they apply for EWS reservation?
Answer: As per Para 2 of DoPT O.M. No. 3603911/2019 -Estt.(Res.), dated 31 .01 .2019, the persons belonging to EWSs who, are not covered under the scheme of reservation for SCs, STs and OBCs shall
get 10% reservation in direct recruitment in civil posts and services in the Government of India. Applicants belonging to SC, ST or OBC included in the Central List residing in any of the states/UTs are not eligible for EWS reservation in respect of posts/services of the Government of India.

Question-12. If a person belongs to Other Backward Classes (OBCs) in a State list but not in Central List, can he apply for Income and Asset Certificate?
Answer: Para 2 of annexure-1 to O.M., dated 31.01 .2019, regarding Income & Asset Certificate reads as under:

“Shri/ Smt./ Kumari … belongs to the … caste which is not recognized as a Scheduled Caste, Scheduled Tribe and Other Backward Classes (Central List) …. “

Therefore, if a person belongs to OBC in a State list but not in Central List, he/she can apply for Income and Asset Certificate for applying to posts and services of the Government of India to avail of EWS reservation subject to fulfilling other conditions, as mentioned in said OM, dated 31.1.2019.

FAQs on vacancies

Question-13. How can the unfilled vacancies of EWS be filled in a recruitment year in case of nonavailability of suitable candidates belonging to EWS?
Answer: As per Pare 6.3 of DoPT OM No. 36039/ 112019 -Estt.(Res.), dated 31.3.2019, where in any recruitment year any vacancy earmarked for EWS cannot be filled up due to non availability of a suitable candidate belonging to EWS, such vacancies for that particular recruitment year shall not be carried forward to the next recruitment year as backlog. A further attempt in the same recruitment year to fill the EWS vacancy is desirable. Thereafter, the unfilled vacancies may be filled up, treating them as unreserved provided it does not result in excess representation in general category beyond the number added on account of non-availability of EWS candidate. If it results in excess representations, it may be diverted to the category in which shortfall exists.

Question-14. Whether EWS reservation is to be calculated on total number of vacancies of cadre strength or current year vacancies.
Answer: EWS reservation should be calculated in accordance with reservation roster as provided in Annexure – II to V of DoPT OM, dated 31.1.2019. EWS reservation is effective in respect of all direct recruitment vacancies to be notified on or after 01.02.2019. Every Government establishment shall recast group-wise post-based reservation roster register for direct recruitment, in accordance with format given in Annexure II, III, IV and V of DoPT OM, dated 31.1.2019, as the case may be, for effecting 10% reservation for EWSs interpolating them with the SCs, STs and OBCs. Thereafter, they can see the point which was vacated in the Post Based Roster. The vacancies will, accordingly, go to respective categories. Current vacancies are to be taken into account to distribute vacancies amongst different categories.

FAQs on Income.

Question-15. Whether money earned through Provided Fund, Gratuity or other pensionary benefits in a particular financial year at the time of retirement will be counted as family income?
Answer: As per Para 4.1 of DoPT O.M. No. 36039/ 1/2019-Estt.(Res.), dated 31.01.2019, apart from asset holding test, persons whose family has gross annual income below Rs 8.00 Iakh (Rupees eight lakh only) are to be identified as EWSs for benefit of reservation. Income for the purpose shall include income from all sources i.e. salary, agriculture, business, profession, etc. for the financial year prior to the year of application. The income for this purpose will be. gross income taken into account for the purpose of
Income Tax.

Question-16. Will monthly pension/family pension be counted for family income?
Answer: Yes.

Question-17. Gross salary is Rs.1O Lakh but as per income tax return total income comes out to Rs.6 Lakh. In that case, can a candidate apply for Income and Asset certificate?
Answer: It is always gross salary/gross income.

FAQs on Competent Authorities for issuance of Income & Asset Certificate

Question-18. Can Competent Authorities of different States and Union Territories issue Income and Asset Certificate in different formats?
Answer: No. Prescribed format for Income & Asset Certificate for applying to posts and services under the Government of India has been prescribed vide Annexure-I of DoPT O.M. No. 36039/1/2019-
Estt.(Res.-lI),dated 31.01.2019. Hence, it cannot be different for different States/UTs for the purpose of employment under the Central Government.

Question-19. Whether Anchal Adhikari or Naib-Tehsildar is a competent Authority to issue a EWS certificate?
Answer: Anchal Adhikari of any State/UT can issue Income and Asset Certificate, if he/she is not below the rank of lehsildar or any other equivalent officer(s) as mentioned in Para 5.1 of DaFT OM, dated 31.1.2019, and as notified by the respective State/UT. If the Anchal Adhikari/Naib Tehsildar is below the rank of Tehsildar, they shall not issue Income & Asset Certificate.

FAQs reqardinq Income & Asset Certificate

Question-20. In case Income and Asset certificate comes out to be a fake/false at a later stage, what will be the next course of action to be followed by the Appointing Authority?
Answer: Para 5.4 DoPT OM, dated 31 .01.2019 provides that the appointing authorities should, in the offer of appointment to the candidates, claiming to be belonging to EWS, include the following clause

“The appointment is provisional and is subject to the Income and asset certificate being verified through the proper channels and if the verification reveals that the claim to belong to EWS is fake/ false the senrvices will be terminated forthwith without assigning any further reasons and without prejudice to such further action as may be taken under the provisions of the Indian Penal Code for production of fake/false certificate. The appointing authority should verify the veracity of the Income and asset certificate submitted by the candidate through the certificate issuing authority.”

If the Income & Asset Certificate is found to be fake, the services of the temporarily appointed person shall be done away with.

Question-21. Crucial date for Income & Asset certificate?
Answer: Para 5.3 DoPT OM, dated 31.01.2019, provides that the crucial date for submitting income and asset certificate by the candidate may be treated as the closing date for receipt of application for the post, except in cases where crucial date is fixed otherwise. The crucial date for submission of Income & Asset Certificate (Cutoff date) shall be clearly mentioned in the advertisement published by the recruiting agencies. Income & Asset Certificates issued subsequent to the crucial date and for the later Financial Year shall be treated as major discrepancies. In this regard, the order, dated 18.05.2020 passed by the Hon’ble Supreme Court in SLP(C) No. 426/2021 titled UPSC vs Gaurav Singh & Ors, may be referred to.

Question-22. Requirement of seal/stamp of name and designation of Income & Asset certificate issuing authority of State/UT.
Answer: The authorized certificate issuing authorities in the States/UTs should invariably affix the seal/stamp properly displaying their name and designation on the space earmarked for the purpose in the Income and Asset Certificate (Annexure-I of DoPT aM, dated 31.01.2019).

Question-23. What if the earmarked space of “Valid for the year … ” below the certificate no. and date is left blank?
Answer: As per Para 4.1 of DoPT OM No. 36039/1/2019 -Estt.(Res.), dated 31 .01.2019, Family Gross Annual Income shall be computed for the financial year prior to the year of application. Therefore, if the closing date for receipt of application for a post is 1st August, 2022, the financial year for computing gross annual income of the family shall be 2021-2022 and the certificate shall be valid for 2022-2023. If it is left blank but the income and assets have been calculated for the correct financial year and also indicated in the body of the Income & Asset Certificate, it may be referred back to the certificate issuing authority for confirmation and filling up the validity year in the space earmarked for it. However, neither financial year nor validity year is mentioned in the certificate, it will be treated as a major discrepancies and may invite rejection.

Miscellaneous FAQs

Question-24. What are notified municipalities” and areas falling in ‘other than the notified municipalities’?
Answer: Notified Municipalities means the area under the respective Municipalities, as notified by the respective States/UTs. If any area has not been notified, it will come under the category of the area ‘other than the notified municipalities’.

Question-25. Whether in case of applicants(s) not living with parents or separated by parents, property or income of parents shall be taken into account for computation of family income?
Answer: As per Para 4.3 of DoPT O.M. No. 3603911/ 2019-Estt.(Res.), dated 31.01.2019, The term “Family” for this purpose will include the person who seeks benefit of reservation, his/her parents and
siblings below the age of 18 years as also his/her spouse and children below the age of 18 years. Therefore, no other definition of Family will be allowed. To make it clear, it is stated that whether the children are not living with parents or separated from parents, property/income of parents shall be taken into account for computation of family income.

Question-26. Whether siblings/children of 18 years or above will be counted under the definition of family for EWS reservation?
Answer: No. As per the Para 4.3 of O.M. of DoPT, dated 31 .01.2019, the term “Family” will include the person who seeks benefit of reservation, his/her parents and siblings below the age of 18 years, as also his/her spouse and children below the age of 18 years. Therefore, siblings/children of 18 years and above will not be counted under the definition of “Family” for applying to Income and Asset Certificate.

Question-27. What is the maximum time limit to issue the Asset and Income Certificate for EWS after submitting the application?
Answer: The Officer who issues the certificate would do the same after carefully verifying all relevant documents following due process, as prescribed by the respective State/UT and, accordingly, time limit for issuing Income and Asset Certificate is to be decided by the respective State/UT. However, the time limit should be fixed in such a way that it does not harm the interest of the applicants.

Question-28. Whether the benefit of age relaxation and relaxation in number of attempts available to EWS candidates?
Answer: No. The conditions prescribed for General category candidates in matters of Age and Number of attempts, would also apply to EWS candidates.

2. In case any reply, as contained in this FAQ, contradicts any of the provisions made in DoPT OM, dated 31.1.2019, the provisions made in DoPT OM, dated 31.1.2019, shall prevail. The clarification
   contained in this FAQs shall be effective from the date of issue of this OM and it will not be applicable to the cases settled before the date of issue of this O.M. Further the clarifications are subject to outcome of different cases pending before various Courts on the subject.
3. This FAQs is being issued after having consultation with the Department of Social Justice and Empowerment and the Department of Legal Affairs.

Giving a major push to the reforms in Education sector, making it inclusive and keeping in mind the aspirations of the people from different categories, the Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has approved theintroduction of a Bill namely “The Central Educational Institutions (Reservation in Teachers’ Cadre) Bill, 2019”.

The Cabinet decision will address the long standing demands of persons belonging to SCs/STs/SEBCs and ensure their rights envisaged under the Constitution. It will also ensure providing of 10% reservation to EWS.

Impact:

This decision will:

• Allow filling up of more than 7000 existing vacancies by direct recruitment in Teachers’ Cadre with 200 point roster. Ensure compliance of the Constitutional Provisions of Articles 14, 16 and 21.
• Ensure full representation of Scheduled Castes/ Scheduled Tribes Socially and Educationally Backward Classes and Economically Weaker Sections in direct recruitment in teachers’ cadres.
• Expected to improve the teaching standards in the higher educational institutions by attracting all eligible talented candidates belonging to SCs/ STs/ SEBCs/ EWS.
• Implications:

The Bill will replace “The Central Educational Institutions (Reservation in Teachers’ Cadre) Ordinance, 2019”. And will be introduced in the forthcoming session of the Parliament.

Implementation:

It will consider the University/ College as one unit restoring earlier reservation system based on 200 point roster. No longer will ‘Department / Subject’ be treated as one unit.

The unit for reservation of posts in direct recruitment in teachers’ cadre will be the University/ Educational Institutions and not the Department.

The Cabinet decision will address the long standing demands of persons belonging to SCs/ STs/ SEBCs and ensure their rights envisaged under the Constitution. It will also ensure providing of 10% reservation to EWS.

Subject:- Reservation for Economically Weaker Sections (EWSs) in Direct Recruitment of Gramin Dak Sevaks.

As per Directorate letter no. 19-11/97-ED & TRG Dated 27.11.1997, instructions were issued to all Circles for reservation for SC/ST/OBC in engagement of Gramin Dak Sevaks(GDS).

Recently, DOPT OM no. 36039/1/2019-Estt(Res) dated 31st January 2019 has been circulated vide Directorate Memo No.3-1/2019-SCT dated 08.02.2019 regarding reservation for EWSs in making direct recruitment to posts of regular establishment of the Central Government. On the basis of these guidelines, it has been decided that, the persons belonging to EWSs who are not covered under the scheme of reservation for SCs, STs and OBCs shall get 1070 reservation in direct recruitment in all categories of GDS posts in Department of Posts.

Persons who are not covered under the scheme of reservation for SCs, STs and OBCs and whose family has gross annual income below Rs.8.00 lakh (Rupees eight lakh only) are to be identified as EWSs for benefit of reservation. Income shall also include income from a1l sources i.e. salary, agriculture, business, profession, etc. for the financial year prior to the year of application.

Also persons whose family owns or possesses any of the following assets shall be excluded from being identified as EWS, irrespective of the family income:-

i. 5 acres of agricultural land and above;
ii. Residential flat of 1000 sq.ft. and above;
iii. Residential plot of 100 sq.yards and above in notified municipalities;
iv. Residential plot of 200 sq.yards and above in areas other than the notified municipalities

4.1 The property held by a “Family” in different locations or different places/cities would be clubbed while applying the land or property holding test to determine EWS status.

4.2 The term “Family” means for this purpose will include the person who seeks benefit of reservation, his/her parents and siblings below the age of 18 years as also his/her spouse and children below the age of 18 years.

INCOME AND ASSET CERTIFICATE ISSUING AUTHORITY AND VERIFICATION OF CERTIFICATE

5.1 The benefit of reservation under EWS can be availed upon production of an Income and Asset Certificate issued by a Competent Authority. The Income and Asset Certificate issued by any one of the following authorities in the prescribed format as given in Annexure-I shall only be accepted as proof of candidate’s claim as belonging to EWS :-

(i) District Magistrate/Additional District Magistrate /Collector/ Deputy Commissioner/Additional Deputy Commissioner/ 1″t Class Stipendiary Magistrate / Sub-Divisional Magistrates Taluka Magistrate / Executive Magistrate / Extra Assistant Commissioner.

(ii) Chief Presidency Magistrate /Additional Chief Presidency Magistrate / Presidency Magistrate

(iii) Revenue Officer not below the rank of Tehsildar and

(iv) Sub-Divisional Officer of the area where the candidate and/ or his family normally resides.

5.2 The officer who issues the certificate would do the same after carefully verifying all relevant documents following due process as prescribed by the respective State / UT.

5.3 The crucial date for submitting Income and Asset certificate by the candidate may be treated as the closing date for receipt of application for the post, except in cases where crucial date is fixed otherwise.

5.4 The engaging authorities should in the offer of engagement to the candidates claiming to be belonging to EWS, include the following clause :-

“The engagement is provisional and is subject to the Income and Asset certificate being verified through the proper channels and if the verification reveals that the claim to belong to EWS is fake/false the services will be terminated forthwith without assigning any further reasons and without prejudice to such further action as may be taken under the provisions of the Indian Penal Code for production of fake/false certificate.”

The engaging authority should verify the veracity of the Income and Asset certificate submitted by the candidate through the certificate issuing authority.

5.5 Instructions referred to above should be strictly followed so that it may not be possible for an unscrupulous person to secure employment on the basis of a false claim and if any person gets an engagement on the basis of such false claim, her/his engagement shall be terminated invoking the conditions contained in the offer of engagement

6. EFFECTING RESERVATION – MAINTENANCE OF REGISTERS :

6.1 Directorate vide letter no.19-11/97-ED & TRG dated 27.11.1997 had issued instructions regarding implementation of post based reservation. The general principles for making and operating post based reservation would be as per the principles laid down in the said letter.

6.2 Every Division/Sub Division/ Other Sub Appointing Authorities shall now effect 10% reservation for EWS interpolating them with the SCs, STs and OBCs.

6.3 Where in any recruitment year any vacancy earmarked for EWS cannot be filled up due to non-availability of a suitable candidate belonging to EWS, such vacancies for that particular recruitment year shall not be carried forward to the next recruitment year as backlog.

6.4 Persons belonging to EWS selected against the quota for persons with benchmark disabilities shall be placed against the post earmarked for EWS

ADJUSTMENT AGAINST UNRESERVED VACANCIES :

A person belonging to EWS cannot be denied the right to compete for appointment against an unreserved vacancy. Persons belonging to EWS who are selected on the basis of merit and not on account of reservation are not to be counted towards the quota meant for reservation.

9. MAINTENANCE OF REGISTER OF COMPLAINTS BY THE CIRCLE :

9.1 Every Circle shall appoint a DPS (HQ) of the Circle as the Grievance Redressal Officer and Liaison Officer to monitor the implementation of reservation for EWSs.

9.2. Any person aggrieved with any matter relating to discrimination in employment against any EWS may file a complaint with the Grievance Redressal Officer of the respective Circle. The name, designation and contact details of the Grievance Redressal Officer may be displayed prominently on the website and in the office of the Chief PMG.

10. The above scheme of reservation will be effective in respect of all categories of GDS for direct recruitment vacancies to be notified on or after 07.02.2019.

11. Circle may follow these guidelines for filling up of all GDS vacancies on or after 01.02.2019

Madurai (TN), Jan 27 (PTI) Virtually sounding the Lok Sabha poll bugle in Tamil Nadu, Prime Minister Narendra Modi Sunday hit out at critics of the 10 per cent quota for the economically weaker sections.

A few in the state were creating an “atmosphere of suspicion and mistrust” for ‘selfish’ interests, he said addressing a well-attended BJP rally here.

He took a swipe at the proposed grand alliance of opposition parties, saying they had set aside their ‘differences’ to “remove this watchman” in the forthcoming Parliamentary elections.

The government was taking effective steps to rid the country of corruption and nepotism, he said, while assuring firm action against economic offenders, even if put up abroad.

The Centre’s 10 per cent quota for the Economically Weaker Sections (EWS) in the general category in education and government jobs will not impact the existing reservation benefits for Dalits, Tribals and OBCs, Modi said.

The EWS quota had been earmarked with the ‘spirit’ of providing opportunities to all in education and employment.

“This decision has been taken in such a way that it doesn’t impact Dalits, tribals and OBCs who are already availing the benefits of reservation,” he added.

“It is unfortunate that an atmosphere of suspicion and mistrust is being created by a few people in Tamil Nadu to serve their own selfish interest. I urge all of you to be vigilant and against such negativity,” he said.

Opposition DMK and some other parties in the state have opposed the 10 per cent quota, saying social backwardness alone should be the criterion for reservation.

The DMK has moved the Madras High Court challenging the Constitution amendment providing for the EWS quota.

Modi further said any political thought which opposes the poor cannot benefit anyone, adding opportunities for all cannot be guaranteed as long as there were artificial concepts of high and low or ours and theirs.

Further, the union government was taking effective steps to rid the country of corruption and nepotism, he said.

“Any person who has cheated or looted the country shall be brought to justice. This is regardless of whether he is in India or abroad,” he said, in an apparent reference to economic offenders Vijay Mallya, Nirav Modi and Mehul Choksi, all of whom are staying abroad.

Modi said the Centre’s effort against corruption has created a “stir from Chennai to Delhi,” and that all those who were “used to making bills in government contracts, “different bills, and welfare schemes, are now facing the music.”

That was why they were all coming together, he said in an apparent reference to a proposed grand alliance of major opposition parties, including the Congress and DMK.

“They say that keeping aside all other considerations they must unite to remove this watchman. However big a group they form, out of fear and negativity, Narendra Modi will stand firmly with the poor,” he said.

“And I call upon the people of Madurai and the youth of Tamil Nadu to reject these forces of negativity,” he said.

Modi, who started his address by extending salutations in Tamil, hailed Madurai for being a seat of the ancient Tamil Sangam, and a pilgrimage city. He also paid tributes to the late Chief Minister J Jayalalithaa on the occasion.

Modi, who earlier laid the foundation stone for the All India Institute of Medical Sciences at nearby Thoppur, said it the hospital would be “ready soon.”

Work was on to establish one medical college in every three Lok Sabha constituencies which was being done with the objectives of improving medical services and providing avenues of education and employment to the youth, he said.

Besides direct intervention in health care, the Centre was also focused on preventive health care and the Swachh Bharat initiative has become a people’s movement with marked increase in rural sanitation, he said.

Nine crore toilets have been built in the last four years, with 47 lakh of them in Tamil Nadu, he said.

The government was working to improve the ease of living for the poor and middle class, Modi said while highlighting the increased focus on connectivity including highways and airways.

The speed of building highways and laying railway lines has doubled, he said, adding projects pending for years have been expedited.

The government has started work on a Rs 2,100 crore project to link the holy island of Rameswaram and Pamban in the state, while a new a Pamban bridge is being constructed to facilitate people in the region, he informed.

Madurai and Chennai will be now connected through the ‘ultramodern’ Tejas train while the country’s fastest Train 18 will in times to come provide high speed connectivity across the country, he said.

Developed at the Chennai-based Integral Coach Factory (ICF), Train 18’s largescale production will create jobs for Tamil Nadu youth, the Prime Minister said, adding several other countries have also evinced interest in it.

On the Devendra Kula Velalar community’s demand to be scrapped from the Scheduled Castes list, Modi said he was “fully sensitive” about it.

A ‘significant’ progress has been made on the matter, he said and assured ‘justice’ to the community, which wants to be included in the OBC list.

First major recruitment with the benefit of 10% reservations for EWS after the 103rd Constitutional Amendment recently passed by Parliament

Recruitment drive will result in massive employment generation with 2,30,000 direct jobs

Recruitment shall be conducted in two-phases duly observing the laid down criteria of reservation in Government of India

Phase-I (starting February-March, 2019 and completed by April-May, 2020) will comprise of 1,31,428 posts

Phase II (starting May-June 2020 and completed by July-August, 2021) will comprise of 99,000 posts

About 34,000, 17,000 and 62,000 posts reserved for SC, ST and OBC candidates respectively. Further, as per 103rd Constitutional Amendment, 10% of these vacancies, i.e. around 23,000 shall be reserved for candidates from Economically Weaker Sections (EWS)

In line with the mega recruitment process for recruitment of 1,51,548 employees initiated 14 months ago, Indian Railways will initiate fresh recruitment of ~2,30,000 more employees under various cadres of Indian Railways, which will be recruited over the next two years in two phases.

In line with the vision of Hon’ble Prime Minister, Shri Narendra Modi, Indian Railways is consistently expanding its workforce to match the manpower requirements of new projects and increase the overall efficiency of the entire railway network. These recruitment drives will fix long-standing issues of overtime work, delay in project implementation, low efficiency, and constraints on upgradation. With the increase in investment in Railways being threefold since 2014, recruitment needs have also increased, which will lead to job-led growth and expansion of Indian Railways.

Presently, Indian Railways has a sanctioned strength of 15,06,598 employees. Out of these, 12,23,622 personnel are on roll. The remaining 2,82,976 are vacant posts. Recruitment for 1,51,548 posts is going on, leaving 1,31,428 posts still vacant. Further, it may also be noted that approximately 53,000 and 46,000 railway employees shall retire in 2019-20 and 2020-21 respectively, causing an additional vacancy of approximately 99,000 employees. Thus, after accounting for the current recruitment’s in progress, there will be total net vacancies of 1,31,428 and approximately 99,000 i.e. approximately 2,30,000 employees in the railways over next two years.

These are proposed to be recruited over the next two years in two phases. The first phase of fresh recruitment of 1,31,328 posts shall be initiated in the month of February-March, 2019. As per reservation policy of the Government, around 19,715, 9,857 and 35,485 number of vacancies shall be reserved for SC, ST and OBC candidates respectively. Further, as per 103rd Constitutional Amendment recently passed by the Parliament, 10% of these vacancies i.e. around 13,100 shall be filled in from Economically Weaker Sections (EWS). This cycle shall be completed by April-May, 2020.

After the first phase of fresh recruitment of 1,31,328 personnel is completed, the second phase of recruitment of approximately 99,000 personnel against the vacancies arising out of retirements shall be initiated. As per the reservation policy of the Government, approximately 15,000, 7,500, 27,000 and 10,000 posts shall be reserved for SC, ST, OBC and EWS candidates respectively.

Recruitment shall be for various cadres and minimum eligibility criteria shall vary from certification from Industrial Training Institutes or Diploma/above in Engineering or Graduation in any discipline, depending on the post for which the candidate is applying.

These recruitment cycles will result in massive direct and indirect employment generation. Recruitment of 1,31,328 persons in first phase followed by recruitment of 99,000 persons shall create around 2,30,000 direct jobs. The resulting increase in efficiency and investment will boost the regional economies, while boost in connectivity through the Railways will integrate the economic potential of regions and give further rise to job opportunities for the youth of the nation.

Subject: Reservation for Economically Weaker Sections (EWSs) in civil posts and services in the Government of India

Reference is invited to Ministry of Social Justice and Empowerment O.M. No.F.No.20013/01/2018-BC-1I dated 17.1.2019 on the above mentioned subject, which, inter-alia, reads as under:-

“1 . In pursuance of insertion of clauses 15(6) and 16(6) in the Constitution vide the Constitution (One Hundred and Third Amendment) Act, 2019 and in order to enable the Economically Weaker Sections (EWSs) who are not covered under the existing scheme of reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and Educationally Backward Classes, to receive the benefits of reservation on a preferential basis in civil posts and services in the Government of India and admission in Educational Institutions, it has been decided by the Government to provide 10% reservation to EWSs in civil posts and services in Government of India and admission in
Educational Institutions.

2. Persons who are not covered under the existing scheme of reservations for the Scheduled Castes, the Scheduled Tribes and the Socially and Educationally Backward Classes and whose family has gross annual income below Rs. 8.00 lakh are to be identified as EWSs for the benefit of reservation. Family for this purpose will include the person who seeks benefit of reservation, his/her parents and siblings below the age of 18 years as also his/her spouse and children below the age of 18 years. The income shall include income from all sources I.e. salary, agriculture, business, profession etc. and it will be income for the financial year prior to the year of application. Also persons whose family owns or possesses any of the following assets shall be excluded from being identified as EWSs, irrespective of the family income:

i. 5 acres of Agricultural Land and above;
ii. Residential flat of 1000 sq. ft. and above;
iii. Residential plot of 100 sq. yards and above in notified municipalities;
iv. Residential plot of 200 sq. yards and above in areas other than the notified municipalities.

3. The income and assets of the families as mentioned in para 2 would be required 10 be certified by an officer not below the rank of Tehsildar in the States/UTs. The officer who issues the certificate would do the same after carefully verifying all relevant documents following due process as prescribed by the respective State/ UT.

5. Instructions regarding reservation in employment and admission to educational institutions will be issued by DOPT and Ministry of HRD respectively. “

2. In pursuance of the above Office Memorandum, it is hereby notified that 10% reservation would be provided for Economically Weaker Sections (EWSs) in central government posts and services and would be effective in respect of all Direct Recruitment vacancies to be notified on or after 01 .02.2019.

3. Detailed Instructions regarding operation of roster and procedure for implementation of EWS reservation will be issued separately.
