Sub: Clarification on “Regular Employees” for appearing GDCE – prescribing minimum service conditions for serving Railway employee.

Ref: i) East Coast Railway’s letter No. ECoR-HQ/PER dated 20.09.2023.
ii) East Coast Railway’s letter No. ECor-HQ/PERS (R) /16/2021(28/20230 dated 03.10.2023.
iii) Railway Board’s letter No. E(NG)I/92/ PM2/16 dated 20.08.93(RBE No. 129/93).

Attention is invited to Board’s letter No. Railway Board’s letter No. E(NG)I/PM1/12 dated 20.06.2023 (RBE No. 80/2023) wherein instructions were issued for conducting General Departmental Competitive Examination(GDCE) for filling up of 25% of the Direct Recruitment Quota Vacancies.

One of the Zonal Railways has raised a doubt as to whether 02 years’ minimum service condition is required for serving Railway employees for appearing in GDCE Examination. It has also been observed that different Railways are following different minimum service condition in this round of GDCE.

The issue of prescribing any minimum residency period to become eligible for future GDCEs is still under deliberation in this office. However, on the basis of precedence and practice followed all along by most Railways in terms of the instructions of RBE 129/93, it is clarified that while reiterating that regular employees are eligible, no minimum service condition has now been prescribed for appearing in this round of GDCE examination. Zonal Railways who have already advertised the 02 years service to be eligible for GDCE, are also advised to issue corrigendums to remove the 2 year restriction and re-invite applications giving a reasonable time to the employees who may have been excluded earlier on this account to apply and then scrutinize the same and finalize their list of eligibles.

Zonal Railways may please ensure that this fresh process should be completed in a time bound manner of not later than one month.

Sub: Age relaxation to serving SC & ST categories employees in Level-1 (erstwhile Group ‘D’) for filling up 40% induction quota in Mechanical Workshops.

As the Railways are aware, in terms of extant rules/instructions, 40% of the vacancies in Pay Level-1 (erstwhile Group ‘D’) in Mechnical Whorkshops should be filled from amongst volunteers from other departments who may like to come over to the workshop cadre on bottom seniority. The staff of other departments who are inducted in workshops should not be more than 33 years of age.

A proposal for relaxation of 5 years in upper age limit to SC/ST employees in Level-1 for induction inside the workshops against 40% quota was under consideration. Matter has been examined in consultation with concerned Directorates. Competent authority has decided that relaxation of 5 years in upper age to SC/ST serving employees may be granted for filling up the 40% induction quota in Workshops.

Replying to a reference from SECR/Bilaspur, Railway Board vide its letter under reference has clarified as under:

MACP for the Central Government Employees

1. (a) The illustration No. 1, under annexure attached to RBE 81/2020 is a mere coincidence and the letter dated 18.09.2020 is in concurrence with extant policy instructions on MACPS and also Board’s letter dated 25.02.2020 (RBE-26/2020) and dated 24.11.2020 (RBE No-99/2020).(b) Further, it is stated that based on 7th CPC recommendation, the post of ASM (GP 2800) has been merged and upgraded with the post of SM (GP-4200) and implemented vide Board’s letter dated 02.08.2016 (RBE-93/2016). This merger/upgradation has to be ignored for the purpose of grant of financial upgradation under MACPS in terms of Board’s letter dated-25.02.2020 (RBE-26/2020) and 24.11.2020 (RBE-99/2020 circulated vide ECoR’s Estt. Srl. No. 182/2020).
2. (a) Thus. the promotion from ASM to SM will continue to be ignored for the purpose of reckoning it awards Non Functional Upgradation (NFU) under MACPS, in terms of RBE-26/2020 i.e. it is not superseded by RBE- 81/2020 as far as promotion from ASM to SM its concerned.(b) However. it is also confirmed by Railway Board that ASM absorbed in other cadres before promotion to SM are not eligible for the benefit granted under Board’s Lr. Dated 25.02.2020 (RBE-26/2020) & dated 24.11.2020 (RBE-99/2020).

Sub: Financial up-gradation by ignoring the promotion from the post of Assistant Station Master (ASM) to Station Master (SM) for own-request transferred Section Controllers.

Some doubts/clarification has been raised by Divisions regarding granting of financial up-gradation under MACPs to the category of Section Controllers who have been transferred on own request from other Railway/ Division/ Units with pay protection.

Illustration cited by the division is as under:

In this situation, promotion to SM from ASM to be ignored because of amendment in Recruitment Rules in SM category circulated vide RBE-26/2020. Again, in terms of RBE-96/2018 Appointment to the post of Section Controller (GP-4200/-) (RS-5500-9000 5th CPC) from the post of Station Master (GP-4200/-) (Rs-5000-8000 5th CPC) is to be treated as lateral shift instead of a promotion.

Therefore, the employee is eligible for 3rd financial up-gradation in GP-4800/-, Level-8 after completion of the 10 years from the re-promotion or 30 years from the date of direct entry grade whichever is earlier. if the concerned employee is still working after 16.02.2018.

With reference to the above, it is stated that Para 9 of Annexure to Board’s letter dated 10.06.2009 (RBE No. 101/2009) explicitly mentions that … “Regular service for the purpose of the MACPS shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption re-employment basis. Service rendered on ad-hoc contract basis before regular appointment on pre-appointment training shall not be taken into reckoning… “. As such. ad-hoc service is not to be counted for the purpose of MACPS and, therefore. the concerned employee is entitled for 3rd financial upgradation under MACPS wef 11.10.2012 subject to fulfillment of other terms and condition as contained in Board’: letter dated 10-06-09 (RBE No. 101/2009).

ECoR, vide their letter dtd. 22.10.2020 under reference, has sought clarification regarding treatment of 10-week Combined Services Foundation Program (CSFC) period for CSE probationers in their overall probation period.

In terms of Board’s letter dated 15.09.1992, the total probation period for IRTS probationers is 03 years which includes 1.5 years Institutional training period and 1.5 years training against working post.

As the probationary training at CTIs is fixed for 1.5 years and CSFC is also a part of the total probation period, the 10-week CSFC period shall be adjusted against probation period on working post in r/o CSE probationers.

7th Pay Commission Clarification regarding prescribed Benchmark while considering MACPs to Non-Gazetted Staff

Sub: Clarification regarding prescribed Benchmark while considering MACPs to Non-Gazetted Staff.

Reff: RBE No. 155/2016 and RBE-16/2020.

The comprehensive MACP Scheme on acceptance of Seventh Central Pay Commission recommendations has been issued vide RBE No-16/2020. In the light of the recommendations of the 7th CPC, the Modified Assured Carrier Progression Scheme (MACPs) will continue to be administered at 10, 20 and 30 years as before. In order to implement a uniform policy all over ECoR, the following staff.

1. In terms of RBE No.-155/2016 for grant of financial up gradation under the MACPs the prescribed Benchmark has been revised for all level to “Very Good” w.e.f 25th July, 2016.
2. In compliance to RBE No-16/2020, enclosing DOPT’s O.M. No-35034/3/2015-Estt. (D) dated-22.10.2019, Para-17, (i) the revised benchmark of APARs i.e. “Very Good” shall be applicable for the year 2016-17 and subsequent years.
3. White assessing the suitability of and employee for grant of MACP, the DSC (Departmental Screening Committee) shall assess the APARs in the reckoning period, the benchmark for the APARs for the years 2016-2017 and thereafter shall be “Very Good”.
4. For Example, if a particular MACP falls due on or after 25.07.2016, the following benchmark for APARs are applicable for Level 11 and below:

Earlier, it was decided vide this office letter No ECoR/ Pers/R/7 /Transfer dated. 22.11.2019 that the TADKs posted on regular measure in other Departments/ Divisions/ HQ/ Units over ECoR, shall not be allowed to seek Inter Division Own Request/Mutual transfer to CRW /MCS without rendering 05 years regular service in their respective Department/ Division/ HQs after regularization.

2. Now, it has been decided to streamline the transfer policy of TADKs over ECoR. In addition to above, the following guidelines shall also be adopted while processing the Inter Railway / Inter Division/Intra Division Own or Mutual Transfer of TADKs

Also check: Grant of annual increment due on 1st July to the employees retiring on 30th June of the year

• IROT/ IRMT Request applications of erstwhile TADKs. of other Railways/PUs shall be considered for CRWI/ MGS only after 05 years of their regularization, at par with similar restrictions on their counterpart on ECoR.
• The request for Change of Department/ Category to the department where TADK was originally attached as Substitute TADK shall be considered only after completion of 05 years of regular service (i.e. from the date of regularization).

Sub: Regularization of absence period of officers / staff due to lockdown w.e.f. 25.03.2020.

In view of complete lockdown of 21 days announced by Govt. of India, effective all over India w.e.f. 25.03.2020 on account of spread of pandemic COVID-19, a number of officers / staff of this Railway who proceeded on sanctioned leave/ HQ leave/ Duty may not have been able to return to their respective place of duty owing to interruption of train service and road communication etc.

1. Therefore. in terms of Para 7.9 of Master Circular No. 10 of Railway Board, following instructions are issued for guidance:

TYPES OF LEAVE ADMISSIBLE: Leave Rules – CCS (Leave) Rules, 1972

• Officers staff who could not assume duty after completion of sanctioned leave period, due to suspension of Train Road Communication during the lockdown period, their over-stay is to be treated as Special Casual Leave. Similarly,in case of staff who were on HQ Leave permission as on 25.03.2020, their absence from HQ during lockdown period may be treated as Special Casual Leave.
• Staff who proceeded on duty prior ta 25.3.2020 bur could not return to their respective HQs, due to suspension of Train Road communication during the lockdown period, such forced halts period to be treated as on-duty.

2. Officer Staff who arc above 50 years of age and having underlying conditions i.e. Diabetes, Respiratory problem, Renal Diseases and other life-threatening illness may be granted Commuted leave without insisting on RMC for a period up to 4th April vide Railway Board’s Lr.No. E(P&ADI- 2020 /CPC/LE-3 dated 23.03.2020.

3. Officer staff who have been advised for quarantine by the competent authority, their salary may be drawn for the period. However, regularization of the said period will be decided later in due course.

4. Keeping in view the present scenario, the following guidelines / instructions are to be followed by all Bill compiling officers / staff of this Railway :

• Salary / Stipend for April. 2020 may be drawn for off existing regular Employees / Apprentices Trainees irrespective of their presence / absence on duty during the lockdown period, except those who are unouthorisedly absent from their duties since long (unauthorized absence prior to 25.03.2020). Over-payment found, if any, will be adjusted in the regular salary of May. 2020 or later.
• List of such employees who were on sanctioned leaves/ on duty/ home quarantined / under Quarantine should be prepared by respective Bill sections Unit in charges and should be sent through the Master Roll and also brought to the notice of respective controlling officers.

This order is provisional and subject to further order guidelines of Railway Board that may be issued in this regard.
