Subject:- Implementation of the recommendations of the 7th Central Pay Commission – Dress Allowance – Modification in the guidelines regarding

The undersigned is directed to refer to this Department’s O.M. No. 19050/1/2017-E.IV dated 02.08.2017 regarding admissibility of Dress Allowance to various categories of Central Government employees.

2. Several references are being received in this Department seeking clarification relating to para “4” of the said OM which provides that the amount of Dress Allowance shall be credited to the salary of employees directly once a year in the month of July.

3. The matter has been considered in this Department and in partial modification of the said OM dated 02.08.2017, the following is clarified:-

i. If a Central Govt. employee has joined service after Dress Allowance is paid in the month of July as per the instructions mentioned in para 4 of the said OM dated 02.08.2017, Dress Allowance would be given on proportionate basis.

ii. Proportionate payment of Dress Allowance would be given by using the following formula:-

= Amount + 12 x No. of months (from the month of joining government service to the month Of june of the following year)

4. Other terms & conditions governing grant of Dress Allowance would be the same as prescribed in the said OM dated 02.08.2017.

5. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India, as mandated under Article 148(5) of the Constitution of India.

6. This is issued with the approval of the Secretary (Expenditure).

Subject: Regulation of payment of Dress Allowance to the Armed Forces personnel joining service after 1st July of a year – regarding.

1. In continuation of this Ministry’s letter no. 1(4)/2019-D (Pay/Services) dated 01.09.2022 on  he above subject, the Govt has decided that the rate of Dress allowance in respect of Armed Forces personnel joining service after 1st July of a year, shall be as follows:

(b) The amount of Dress Allowance shall be credited to Armed Forces personnel’s account directly in the month of July. The disbursement of the payment of Dress Allowance has been explained below with an example:

* Formula for proportionate payment of Dress Allowance is:-

(Amount/12) x No. of months (Date of commission in case of Officer/ MNS Officers Or from date of reporting to Units in case of JCOs/OR till month of June of the following year)

2. These orders shall be effective from date of issue of this letter.

3. This issues with the concurrence of Finance Division of this Ministry vide their 1.D. No. 110/ AG/ PD/ 2023 dated 22/05/2023 of RF No. 2(7)/2017-AG/PD.

The undersigned is directed to refer to Ministry of Finance (DoE) OM No.19051/1/2017/E-IV dated 02.08.2017 and this Ministry’s OM of even number dated 17.08.2017, regarding grant of Dress Allowance @ Rs.20,000/- per annum for Officers and Rs.10,000/- per annum for Personnel Below Officer Rank (PBORs) to be credited to the salary of the employee directly once in a year in the month of July.

2. A proposal regarding regulation of payment of Dress Allowance in respect of CAPFs personnel, who joins service after 1st July, has been examined in consultation with the Integrated Finance Division of this Ministry, and it is clarified that:-

“the personnel of CAPFs & AR, who join service in any of the month of a calendar year, shall be paid Dress Allowance @ Rs.10,000/- for PBOR and @ Rs.20,000/- for officer in the month of joining service on first appointment.

and

Regular Dress Allowance, as applicable, shall be admissible to the personnel of CAPFs & AR in the month of July of the next calendar year only.”

Subject : Recovery of Dress allowance from leave encashment in r/o retiring Industrial employees of MES.

Ref. :- This office letter no. PT/3088/CGDA/ Vol-IX dated 07/12/2020.

It was advised vide the letter quoted under above reference that “Recovery amount may only be kept reserve from leave encashment and rest of the benefit be released in r/o the employees who retire and leave encashment claims being received.”

2. The above decision of the competent authority at this end was also conveyed to Hqrs office, vide its letter AT/Army-BR/ A/Civ/2366/Dress Allow/ Vol-II dated 05/01/2021 have intimated that the recovery from leave encashment of retiring employee may lead to contempt of court.

3. In view of the above, it is advised not to effect recovery of the dress allowance from leave encasement of retiring industrial employees of MES and the recovery if effected in any case may be refunded to comply with the stay on recovery of dress allowance amount already paid to Industrial employees of MES as directed by hon’ble CAT, Lucknow.

Of late several references has been received regarding Payment/ Refund of Dress allowance with reference to Hon’ble CAT Chandigarh has passed order in favor of applicants vide order dated 05.06.2020 and stated that the applicants of thirteen similar OAs are held entitled to grant of Dress Allowance and if any recovery has been made, the same may be refunded to the relevant individuals involved in these cases.

The responsibility to implement Hon’ble CAT Chandigarh order is of concerned administrative Ministry /Department /Organization where the Govt. servant/servants is serving or served last, after getting legal opinion of Govt. Counsel. On the basis of legal opinion obtained from Govt. counsel the concerned administrative Ministry /Department/ Organization will decide that the judgment of Hon’ble Court is to be implemented or to be challenged in higher court.

It is, therefore, requested not to admit any claim on account of Payment /Refund of Dress allowance with reference to Honble CAT Chandigarh order dated 05,06.2020 till receipt of implementation order of competent authority regarding implementation of Hon’ble CAT Chandigarh order dated 05.06.2020

Sub: Dress Allowance to Nursing Personnel- clarification regarding.

The recommendations of 7th CPC on Dress Allowance, as accepted by Government of India, were adopted in Ministry of Railways vide RBE No. 141/2017 dated 03.10.2017, followed by a clarification issued vide Letter No. PC-VII/2018/I/7/5/1 dated 20.06.2019. Vide the said order dated 03.10.2017, Nurses were granted Dress Allowance @ & 1800 per month w.e.f. 01.07.2017.

2. Consequent to implementation of RBE 141/2017, clarifications have been sought by Railways on whether Assistant Nursing Officers are eligible for grant of Dress Allowance of Rs.1800 per month.

7th CPC Dress Allowance to Nursing Staff: Clarification

In this context, it is stated that as per the Office Memorandum No. Z.28015/50/2017-N dated 31.08.2017 issued by Ministry of Health & Family Welfare Finance (Nursing section), Dress Allowance at the rate of Rs. 1800 per month shall be paid to the Nursing Personnel of all categories at all levels working in Central Government/UT Hospitals/ Institutions and Centrally funded autonomous bodies. In view of the same, it is clarified that Nursing Personnel of all categories at all levels working in Railway Hospitals are eligible for grant of Dress Allowance @ Rs. 1800 per month. Accordingly, Assistant Nursing Officers are eligible for grant of Dress Allowance of Rs. 1800 per month if they had been receiving uniform material and associated allowances like Uniform Allowance, Washing Allowance etc. prior to 1st July, 2017 i.e. date of admissibility of Dress Allowance.

Sir/Madam,

This is regarding issues raised by the units for the payment of Dress Allowances to the fresh recruits and the persons retiring and have less than one years service.

2. The issue was examined by the committee constituted for the purpose and following recommendations were made for payment of dress allowance on the issue of admissibility of full / part dress allowance on non completion of full year:

7th CPC Dress Allowance of Postal Employees

(1) On the issue of admissibility of full / part Dress Allowance on non-completion of full one year, the Committee recommends the following stipulations that the Dress Allowance shall be paid in the month of July only:-

(i) (In case of Persons Retiring)

Person retiring after December of the calendar year shall be eligible for full Dress Allowance. Those retiring by December in the calendar year shall be eligible for half of the Dress Allowance.

(ii) (In cases of Persons newly joining the Department)

For person joining service during July to December of the previous calendar year shall get full Dress Allowance in next calendar year. Those who join after December will be entitled to half of the Dress Allowance in July of the year.

3. The above recommendation of committee has been accepted by the competent authorized with retrospective effect from 01.07.2017.

4. It is requested to take necessary action as per the above recommendations and in any case of deviation from the above, the advice of the Directorate may be sought for.

Sub – Enhancement of Dress Allowance – regarding.

A Committee, under the Chairmanship of Shri V.P.Singh,CPMG, Uttar Pradesh Circle, had been constituted to examine the requests of Unions to enhance the Dress Allowance of Postal employees. The Dress Allowance Committee submitted its report vide OM No. 23-01/2015-UPE dated 28th June, 2019.

The recommendations of the committee was forwarded to Ministry of Finance, Department of Expenditure, being the competent authority, for approval. Department of Expenditure, vide ID No. A-27023152017/E.II B (7th CPC) dated 3rd October, 2019, has, however, not agreed to the proposal of the Department to enhance the Dress Allowance to eligible staff.

As per the orders issued by the Railway Board, Dress Allowance to the personnel previously being granted Uniforms and certain associated allowances like Uniform Allowance, Washing Allowance, Shoe Allowance, Kit Maintenance Allowance etc., to certain categories of employees working in Indian Railways.

Eligibility criteria to receive Dress Allowance as recommended by 7th Pay Commission:

The personnel of the said category should be required to wear a specific uniform daily (excluding any special clothing) as a part of their duty as specified by the Dress Regulations of Ministry of Railways.

The personnel of the said category should have had been receiving uniform material and associated Allowances like Uniform Allowance, Washing Allowance, Kit Maintenance Allowance, Shoe Allowance etc. prior to 1st July, 2017 i.e. date of admissibility of Dress Allowance.

The personnel of the said category should have ceased to be granted the uniform materials and associated allowances w.e.f. the date of issue of RBE 141/2017.
