<p>Subject: <strong>Timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar &#8211; regarding</strong>.</p>



<p>The undersigned is directed to state that with a view to having the approved select panels for promotion ready in advance in a time-bound manner, this Department has been impressing upon adherence of time schedule for convening meetings of DPCs. The Cadre Controlling Authorities are accordingly required to follow the Model Calendars for DPC issued in OM No. 22011/4/2013-Estt.(D) dated 08.05.2017, so as to ensure that the panel is ready in time, and is utilized, as and when the vacancies arise during the course of the vacancy year.</p>



<ol class="wp-block-list" start="2"><li>Cabinet Secretariat has drawn attention to the observations of the Department related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice, that there has been an inordinate delay in the constitution of the DPC and that delay in holding of DPCs results in deprivation of timely promotion to the eligible candidates. It has also been brought to the notice that Ministries/Departments were not submitting DPC proposals to UPSC on time, causing delay in timely convening of DPCs meetings.</li><li>The objective of timely promotions of officers can be achieved through strict adherence to the timelines prescribed in the Model Calendar for submission of DPC proposals.</li><li>Accordingly, all the Ministries/Departments are, therefore, once again requested to ensure strict compliance of instructions in order to achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame.</li></ol>

Subject:-Procedure to be followed for promotion by Departmental Promotion Committee to implement Cadre Restructuring of General Line Cadre Posts.</li></ol>



<p>Sir/Madam,</p>



<p>Orders relating to Cadre Restructuring of General Line Cadre Posts of Post Offices were issued vide letter No. 25-04/2012-P.E. -I dated 27.05.2016 . Cadre Restructuring resulted in substantial increase in the number of posts in Lower Selection Grade (LSG), Higher Selection Grade-II (HSG-II) and Higher Selection Grade-I (HSG-I), and creation of a new grade, namely HSG-I (NFG). Additional posts in the said grades are to be filled up as per the relevant Recruitment Rules. In other words, an official in a lower grade will not be placed in higher grade automatically. Therefore, as provided in RRs of said posts, additional posts would be filled up only after recommendation of Departmental Promotion Committee (DPC).</p>



<p>2. Aforesaid letter dated 27.05.2016, para 2 ibid, stipulated that instructions issued therein would be effective from the date of issue of the orders, i.e. 27.05.2016. The actual benefit would, however, be admissible to the eligible officials from the date of actual promotion.</p>



<p>3. Subsequently, on representation of various Staff Union/ Association, a Committee was constituted to look into issues arising out of cadre restructuring. Recommendations of the Committee accepted by the competent authority was conveyed to all concerned vide letter no. 25-04/2012-PE-I (Vol. II) dated 10.11.2017. Para 4.5 of the said letter 10.11.2017 provides as under:- </p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>&#8220;4.5 Date of Effect of the Orders and completion of restructuring: &#8211; For the sake of uniformity, the promotion will be effective from the date of issue of the original order dated 27.05.2016 as per existing instructions on the subject. It will be applicable to all eligible officials including those who were in service but now retired&#8221;</p></blockquote>



<p>4. Subsequently, vide letter No. 25-04/2012-P.E.-I (Vol-III) dated 05.12.2018, following clarification was issued:- &#8220;3. …. these LSG, HSG-II, HSG-I and HSG-I (NFG)posts will be deemed to have been upgraded to these grades only w.e.f the dates they are filled up, i.e. from the date the promoted official assumes the charge. Otherwise, the post will remain in the lower grade. &#8220;</p>



<p>5. It is pertinent to mention that at present the posts of LSG, HSG-II and HSG-I are being filled up by 100% promotion from respective feeder grade. The instructions/guidelines issued by Department of Personnel &amp; Training (DOP&amp;T) on the subject of DPCs are followed by Department of Posts. As per DOP&amp;T&#8217;s OM No. 22011/3/91-Estt (D) dated 13.05.1991, the number of vacancies in respect of which a panel is to be prepared by DPC should be estimated as accurately as possible. For this purpose, the vacancies to be taken into account should be the clear vacancies arising in a post/grade/service due to death, retirement, resignation, regular promotion, deputation and creation of additional posts.</p>



<p>6. As per consolidated instructions on DPC, issued by DOPT vide OM No. 22011/5/86-Estt(D) dated 10.04.1989 as amended vide OM No. 22011/5/91- Estt(D) 27.03.1997, date of commencement of validity of a panel recommended for promotion shall be the date on which DPC meets and in case the DPC meets on more than one day then the last day of the meeting. Subsequently, it has also been stipulated that <strong>date of regular promotion of an officer included in a panel would be the date of validity of the panel or the date of actual promotion whichever is later.</strong></p>



<p><strong><span style="text-decoration: underline;">7. In view of the above provisions. any order issued by Circles giving retrospective promotion w.e.f. 27.05.2016. in accordance with Directorate letter of 10.11.2017, need to be modified. The effective date of promotion in all cases shall be from the date of actual promotion and seniority of an official shall be counted from the date of actual promotion on regular basis subject to stipulation of inter se seniority as per the mode of recruitment.</span></strong></p>



<p>8. OM No. 22011/4/1998-Estt.(D) dated 12.10.1998 of DOPT may be perused, which provides as under:- </p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>&#8221;……. it would not be in order, if eligible employees, who were within the zone of consideration for the relevant years but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration/panel and consequently, their jun iors are considered (in their places) who would not have been in the zone of consideration, if the DPC(s) had been held in time. This is considered imperative to identify the current zone of consideration f or relevant year(s). Names of the retired officials may also be included in the panel(s). Such retired official would however. have no right for actual promotion. &#8220;</p></blockquote>



<p>9. As has been clarified in aforesaid letter dated 27.05.2016 of Establishment Division, Point 1 (e) ibid, if the revised number of posts in a particular grade is in excess of the strength existing prior to cadre restructuring, difference in number of posts would be deemed as newly created posts. Subsequently, vide aforesaid communication of 05.12.2018, it has been clarified that a post will be deemed to be in the higher grade from the date the promoted officials actually assume charge of that post.</p>



<p>10. Accordingly, if a Circle had held DPC meeting during 2016-17 recruitment year for promotion to the additional posts due to cadre restructuring, the vacancies would be deemed to be created in the recruitment year 2016•17 (01.04.2016-31.03.2017). Similarly, if the DPC was held in subsequent recruitment years [ 2017(01.04.2017-31.03.2018), 2018 (01.04.2018-31.12.2018) and 2019 (01.01.2019-31.12.2019)] vacancies would be deemed to be created in that recruitment year.</p>



<p>11. As per prevailing instructions, DPC should be held well in advance so that a panel is approved by the time vacancy actually arises. Therefore, following this spirit of convening DPC, while considering vacancy of recruitment year 2016-17, all those officials who were in service on the commencement of the recruitment year 2016-17 (i.e.01.04.2016) should be considered by the DPC, even if the DPC is held at a later date, as explained at para 8 above. However, since actual promotion will be given only to those who are in service to assume the charge of promotional post, the DPC would also recommend an extended panel to cover the persons already retired before the date of DPC as well as the subsequent vacancies to occur in that recruitment year due to some more retirement, in accordance with DOP&amp;T&#8217;s OM No. 22011/18/97-Estt(D) dated 9.04.1996. <strong>A copy of model DPC meeting minutes is enclosed for ease of reference which may be appropriately modified as and when required.</strong></p>



<p>The Circles are hereby directed . to take note of the above provision/ instructions for appropriate action including revision of orders issued for giving promotion to additional posts due to implementation of cadre restructuring.</p>

<p>Sub: <strong>Promotion of Government servants found fit by review DPC after retirement &#8211; procedure and guidelines to be followed</strong></p>
<p>The undersigned is directed to invite reference to this Department&#8217;s OM of even number dated 25.1.2016 which deals with the grant of notional promotion to a Government servant exonerated in a disciplinary proceedings after retirement. However, the cases of Government servants who are found fit by review DPC after their retirement on account of revision of seniority list of the feeder cadre, upgradation of below benchmark APARs etc. are not covered under the said OM. These cases have now been examined and it has been decided to lay down procedure as narrated in subsequent paragraphs for dealing with such cases.</p>
<p>2. A Government servant who is not recommended in the panel by the original / supplementary DPC but later on is recommended in the panel by a review DPC but has since retired may be given the benefit of notional promotion w.e. f. the date of promotion of his immediate junior in the reviewed panel and fixation of notional pay subject to the fulfillment of the following conditions:</p>
<blockquote><p>(i) That the officer who is immediate junior to the retired Government servant assumed charge of the higher post on or before the date of superannuation of the retired Government servant.<br />
(ii) That the said retired Government servant was clear from vigilance angle on the date of promotion of his immediate junior.<br />
(iii) A retired Government servant who is considered for notional promotion from the date of promotion of his immediate junior on the recommendation of a review DPC would also be entitled to fixation of pension on the basis of such notional pay.<br />
(iv) The notional promotion, notional pay fixation and revision of pension shall be further subject to extant rules on promotion, pay fixation and CCS (Pension) Rules, 1972, Actual increase in pension shall be given only from the date of approval of reviewed panel by the competent authority. No arrears shall be paid.</p></blockquote>
<p>3. The provisions contained in this Office Memorandum shall become operational from the date of issue of this Office Memorandum. Past cases settled in accordance with the earlier provision shall not be reopened.</p>
<p>4. In so far as persons serving in the Indian Audit &amp; Accounts Department are concerned, these orders issue after consultation with the Comptroller &amp; Auditor General of India.</p>

<p>New Delhi: All central government departments have been asked to conduct meetings of Departmental Promotion Committee (DPC) in time to check “abnormal delay” in giving career benefits to employees.</p>
<p>The move comes after noticing cases of delay in holding the meeting of DPC -which decides on employees’ promotions.</p>
<p>The Department of Personnel and Training (DoPT) has issued instructions to all the departments asking them to ensure timely promotions to the employees by conducting meetings of DPC in time.</p>
<p>A model calender has also been issued by the DoPT in this regard.</p>
<p>It has been brought to the notice of the government that many promotion posts are lying vacant due to abnormal delay in convening DPCs.</p>
<p>“The objective of timely promotions of employees in various ministries and departments can be achieved only by holding DPC meetings.</p>
<p>“In view of above, all ministries and departments are again advised to ensure strict compliance of instructions in order achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame,” the DoPT said in an order.</p>
<p>There are about 50.68 lakh central government employees.</p>

<p>Subject: <strong>Timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar &#8211; regarding.</strong></p>
<p>The undersigned is directed to state that with a view to having the approved select panels for promotion ready in advance in a time-bound manner, this Department has issued a Model Calendar for DPCs vide OM No. 22011/9/98-Estt. (D) dated 8 th September, 1998 as modified vide OM No. 22011/4/2013-Estt.(D) dated 28.01.2015. An indicative pattern has been provided in the Model Calendar for various events involved in the pre/ post DPC related actions. All the Ministries/Departments have been impressed upon from time to time by this Department to adhere to the prescribed time-line so as to ensure that the panel is ready in time and is utilised as and when the vacancies arise during the course of the vacancy year.</p>
<p>2. It has been brought to the notice that many promotion posts are lying vacant due to abnormal delay in convening DPCs. The objective of timely promotions of employees in various Ministries/Departments can be achieved only by holding DPC meetings.</p>
<p>3. In view of above, all Ministries/Departments are again advised to ensure strict compliance of instructions in order to achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame.</p>

<p>The undersigned is directed to say that pursuant to issue of OM No. 5/4/2005 CS I(S) dated 21.04.2014 by this Department on the subject mentioned above, doubts have been raised by some Ministries/Departments regarding procedure to be followed for grant of NFS to Section Officers of CSS.</p>
<p>2. In this connection, it is reiterated that regular Section Officers of CSS with 4 years of approved service would be considered for grant of NFS subject to vigilance clearance only in terms of this Department&#8217;s OM No. 21/36/03 CS I dated 13.11.2003 and 5/4/2005-CS.I dated 25.01.2006. The word <b>DPC</b> wherever appearing in OM dated 21.04.2014 may be ignored.</p>

<p>DoPT issued an office memorandum regarding the functioning of Departmental Councils and it mentioned that the meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.</p>

<p><strong>Subject- Functioning of Departmental Councils – regarding</strong></p>
<p>The undersigned is directed to refer to this Departments D.O. letter of even number dated 23.07.2012 (copy enclosed) regarding holding of meetings of Departmental Councils regularly with a view to make effective use of Joint Consultative Machinery (JCM) Scheme. Secretary, DoPT, had also vide his DO letters of even number dated 03.12.2012, 26.07.2013 and 17.02.2015 requested to promote this interaction more proactively through regular meetings of Departmental/Office Councils under the Ministry/Department.</p>
<p>The JCM Scheme provides for Departmental Councils at the level of individual Ministries/ Departments, including their attached and subordinate offices. The Staff Side of JCM, however, has been remonstrating that regular dialogue with the Staff Side through the mechanism of Departmental Councils at Ministry/Department level is not happening. Meetings of Departmental Council are essential as they help in resolving differences between Government and the Staff Side.</p>
<p>It is requested that suitable instructions may please be issued to hold meetings of Departmental Councils on regular basis.</p>

<p>Raipur: Chhattisgarh government employees will now have to furnish their Annual Information Report (AIR) carrying five year’s description of their immovable assets for seeking departmental promotion.</p>

<p>A decision in this regard was taken in a Cabinet meeting chaired by Chief Minister Raman Singh last evening at his official residence, an official spokesperson said here today.</p>
<p>As per directives issued by General Administration Department (GAD) in 2012, employees had to submit their annual report of immovable property during their departmental promotion but now the cabinet has decided that officials now have to furnish their five year’s description of immovable property to Departmental Promotion Committee (DPC), he said.</p>
<p>The cabinet also took the decision to relax the ceiling of 10 per cent on compassionate appointment in Grade-3 posts for a year, the spokesperson said.</p>
<p>The officials in the meeting informed that a similar decision to exempt ceiling of 10 per on compassionate appointment in Grade-3 posts was taken on June 16, 2013 whose limit expired on June 13, 2014, resulting in pending cases piling up pertaining to compassionate appointment.</p>
<p>Therefore, the same decision has been taken again, he added.</p>
<p>The Cabinet on the occasion also expressed pleasure over the state’s performance in implementing the Pradhan Mantri Mudra Yojana.</p>
<p>Under the scheme, a special drive was conducted from September 25-October 2, during which about 54,109 beneficiaries were sanctioned loan to the tune of Rs 251 crore against the target of 54,000 beneficiaries, he said.</p>
<p>Around 38,000 beneficiaries have been disbursed loan of Rs 168 crore.</p>
<p>Measures taken for the relief of farmers in drought-hit areas of the state were also discussed in the meeting.</p>

The learned counsel for applicant submitted that at the time of retirement, applicant was holding the post of Deputy Post Master, Khandwa Head Office in the Pay Band of Rs.9300-34800/- + Grade Pay of Rs.4600/- and his basic pay was Rs.20,410/-. However, while paying him retiral dues, the basic pay has been reduced from 20,410/- to 19,960/-. Further, Rs.43,790/- has been deducted from his DCRG, without assigning any reason. The applicant was inducted in the cadre of HSG (II) in the pay scale of Rs.5000-8000 and posted as Deputy Post Master at Itarsi Head Office. Thereafter, vide the order dated 12.1.2005, the applicant was sent on deputation to work as Sub Post Master, Harda in the cadre of HSG (I) and he was given the pay scale of Rs.6500-10500/-. Appointment of applicant in the cadre of HSG (I) was approved by the Departmental Promotion Committee (DPC) and orders were issued on 18.8.2005 (Annexure A-3). Thus, there is no justification for reduction of pay of the applicant for retiral benefits and deduction of Rs.43,790/- from DCRG.</p>

The respondents, in their reply, have submitted that the applicant was promoted to HSG (I) grade vide the order dated 18.8.2005, Before that, vide the order dated 12.1.2005, he was posted on HSG (I) grade post of Sub Post Master, Harda Head Post Office by Senior Superintendent of Post Offices, Hoshangabad. Since the applicant was working at that time with the office of Sr. Superintendent Post Offices, Hoshangabad, there was no ground for posting him on deputation basis in one of its offices. Thus, applicant was not entitled to the pay of HSG (I) grade on this posting at Harda as he was still in HSG (II) grade. In any case, applicant was promoted to HSG (II) grade on 29.10.2004 and had qualifying service of only two months as on 1.1.2005 in that grade, he could not have been promoted to HSG (I) grade so early as the qualifying service of three years was required for such promotion. Therefore, when his pension case was prepared, there was objection in regard to his pay fixation on 17.1.2005 in HSG (I) grade when he joined at Harda in compliance of order dated 12.1.2005 of SSPO Hoshangabad. Therefore, applicant’s pay was accordingly refixed and he was grated HSG(I) grade w.e.f. 23.08.2005 when he was actually promoted to that grade. Thus, due to correction of his pay fixation w.e.f 17.1.2005, his basic pay at the time of retirement was changed and applicant has been paid retiral benefits accordingly. Further, excess salary paid to him during this period has been recovered from the DCRG. Thus, the OA, being without any merit, deserves to be dismissed.</p>

<p>4. Heard the learned counsel for the parties and perused the pleadings of the respective parties and documents annexed therewith. I have also gone throught the writtern arguments filled by learned counsel for the respondents.</p>

<p>5. It is undisputed that the applicant was promoted to HSG (I) grade vide the order dated 18.8.2005 (Annexure A-3). Before that, he claims to be posted on deputation basis on a post of HSG (I) grade. However, the order dated 12.1.2005 (Annexure R-1) by which he was posted as Sub Post Master, Harda was issued by Sr. Superintendent of Post Offices, Hoshangabad and since the applicant was already working in his jurisdiction, this posting could not be considered as on deputation. In-fact, this is simply a posting order on vacant post of Sub Post Master, Harda on which the applicant was posted on his own cost for which he may have requested at that time. Thus, applicant was not entitled to get the pay scale of HSG (I) grade w.e.f. 17.1.2005 on the basis of order dated 12.01.2005 (Annexure R-1). Therefore, respondents are not at fault in re-fixing his pay, by treating him promoted to HSG (I) grade w.e.f. 23.08.2005. In view of this correction, basic pay of applicant has been revised and applicant has been paid all the retiral benefits based on this pay. Thus, the respondents cannot be faulted in granting retiral benefits to the applicant based on his revised basic pay of Rs.19,960/- in place of Rs.20,410/-, and no interference with the orders of respondents in this matter, is justified, Therefore, the prayer of the applicant in this regard is rejected.</p>

<p>6. So far as deduction of Rs.43,790/- from the DCRG of the applicant is concerned, this amount has been deducted without issuance of any show-cause notice to the applicant. Relying on the judgment of Hon’ble Supreme Court in the matters of State of Punjab and others etc v. Rafiq Masih (White Washer) etc., Civil Appeal No. 11527 of 2014, learned counsel for the applicant submitted that in view of the law laid down by the Hon’ble Supreme Court in that order, no recovery of excess payment can be made from retired employees or employee who are due to retire within one year of the order of recovery. Since recovery of excess salary has been done after retirement of applicant, such recovery is not in accordance with law. Therefore, the respondents are directed to refund Rs.43,790/- deducted from DCRG of the applicant, within a period of 60 days from the date of communication of this order. However, no interest shall be payable on that amount.</p>

<p>7. Thus, the O.A is partly allowed. No order on costs.</p>

<blockquote class="tr_bq"><p><b>Subject:Timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar-regarding.</b></p></blockquote>
<p>The undersigned is directed to state that with a view to having the approved select panels for promotion ready in advance in a time-bound manner, this Department has issued a Model Calendar for DPCs vide OM No.22011/9/98-Estt.(D) dated 8th September, 1998 as modified vide OM No. 22011/4/2013-Estt.(D) dated 28.01.2015. An indicative pattern has been provided in the Model Calendar for various events involved in the pre/post DPC related actions.All the Ministries/Departments have been impressed upon from time to time by the Department to adhere to the prescribed time-line so as to ensure that the panel is ready in time and is utilised as and when the vacancies arise during the course of the vacancy year.</p>
<div>2. Appointment Committee of Cabinet has viewed it seriously that the DPCs are not being convened in time. Delay in promotion effects the manpower planning and impedes the career progression of the employees. The delays in conduct of DPC negate the very purpose of the Model Calendar for DPCs issued vide Office Memorandum No.22011/9/98-Estt.(D) dated 8th September, 1998 as modified vide OM No.22011/4/2013-Estt.(D) dated 28/01/2015.</div>

<div>4.The objective of timely promotions of employees in various Ministries/Departments can be achieved only by granting the promotion in time.</div>
<div></div>
<div>5.All the Ministries/Departments are, therefore, once again advised to ensure strict compliance of instructions in order to achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame.</div>
