<p>Sir/Madam,<br />
I am directed to refer to the subject mentioned above and to state that requirement of vigilance clearance is a pre-requisite for granting permission to the officers/officials on private foreign visit as advised by DOP&amp;T vide O.M. No. 11012/15/2013-Estt.A dated 2nd January, 2014(copy enclosed).</p>
<p>2. It is, therefore, necessary to send application for grant of ex-India leave to the Board at least one month in advance for enabling the Board to complete the requisite formality.</p>
<p>3. This issues with the approval of Member(P&amp;V), CBDT.</p>

<p>Subject: <strong>Requirement of vigilance clearance for officers going abroad on private visit.</strong></p>
<p>The undersigned is directed to refer to Central Board of Direct Taxes, Department of Revenue I.D. No 114847/Ad-VI(A) dated 16.08.2013 and a OM of even no dated 20.09.2013 on the subject mentioned above and to say that as per Rule 17 of the CCS(Leave) Rules, 1972, leave shall not to be granted to a Government Servant whom a competent punishing authority has decided to dismiss, remove or compulsorily retire from service. Leave sanctioning authority shall get prior approval before sanctioning leave for &#8220;going abroad&#8221; as per O.M. No. 11013/7/94-Esn.(A) dated 18.05.1994 and O.M. No.11013/7/2004-Estt.(A) dated 01.09.2008 (copy enclosed).</p>
<p>2. It is also stated that a blanket order exempting requirement of examination from vigilance angle as proposed in DGIT(Vig.) letter dated 13.05.2013 is not advisable.</p>

<p>Subject: <strong>Requirement of taking prior permission by Government servants for leaving station headquarters for going abroad while on leave.</strong></p>
<p>The undersigned is directed to refer to Department of Personnel and Training’s O.M. No. 11013/8/2000-Estt. (A) dated the 7th November, 2000 on the above mentioned subject and to say that in para 2 thereof, it was conveyed that while granting leave the sanctioning authority shall take prior approval , if required, for permitting the officer to go abroad as per the existing instructions.</p>
<p>2. References are being received regarding the competent authority whose permission is to be taken by the leave sanctioning authority before sanctioning leave to a Government servant to go abroad. It is clarified that the competent authority as per the aforesaid Office Memorandum dated the 7th November, 2000 is to the competent authority in terms of the instructions, if any, issued by the Cadre Authority or the administrative Ministries/Departments themselves. Department of Personnel and Training has not issued any instructions in this regard in respect of the Central Government servants. In the absence of any such instructions, the approval of the leave sanctioning authority would imply approval to the visit abroad also. It may be ensured that the leave applications in such cases invariably mention the purpose of going abroad.</p>

<p>Subject : <strong>Comprehensive review of instructions pertaining to vigilance clearance for promotion &#8211; clarifications &#8211; regarding</strong></p>
<p>The undersigned is directed to refer to the Department of Personnel &amp; Training O.M. of even number dated 2.11.2012 on &#8216;Comprehensive review of instructions pertaining to vigilance clearance for promotion&#8217;, wherein, inter alia, it has been laid down in Para 9, as under:</p>
<blockquote><p>
&#8220;For the purpose of vigilance clearance for Review DPC, instructions exist in O.M. No.22011/2/99-Estt(A) dated 21.11.2002 that review DPC will take into consideration the circumstances obtaining at the time of original DPC and any subsequent situation arising thereafter will not stand in the way of vigilance clearance for review DPC. However, before the officer is actually promoted it needs to be ensured that he/she is clear from vigilance angle and the provision of para 7 of O.M. No.22011/4/91- Estt.(A) dated 14.09.1992 are not attracted&#8221;.</p></blockquote>
<p>2. This Department has been receiving references seeking clarification on grant of promotion in case of review DPC with regard to the official who is clear from vigilance angle on the date of promotion of the junior in the original DPC but subsequently attracts the provisions contained in para 2 of DoPT OM dated 14.09.92.</p>
<p>3. The matter has been examined in consultation with the Department of Legal Affairs and it is further clarified that, in the case of a review DPC, where a junior has been promoted on the recommendations of the original DPC, the official would be considered for promotion if he/she is clear from vigilance angle on the date of promotion of the junior, even if the provisions of para 2 of DoPT OM dated 14.9.92 get attracted on the date the actual promotion is considered, as provided in DoPT O.M. No.22011/2/99-Estt (A) dated 21.11.2002.</p>
<p>4. In cases, where the junior is not promoted, it is to be ensured that the provisions of para 7 of OM dated 14.9.1992 are not attracted on the date the official is being actually promoted.</p>

Subject : <strong>Guidelines regarding grant of vigilance clearance to members of the Central Civil Services/Central Civil Posts.</strong></p>
<p>The undersigned is directed to refer to this Department’s O.M. of even number dated 14.12.2007 on the above subject and to say that it has been decided to modify Para 2(c) thereof as under:</p>
<p>(c) <a href="http://centralgovernmentnews.com/?s=vigilance+clearance" target="_blank">Vigilance clearance</a> shall not be withheld unles</p>
<p>&nbsp;</p>
<blockquote>
<blockquote><p>(i) the officer is under suspension</p>
<p>(ii) the officer is on the Agreed List, provided that in all such cases the position shall be mandatorily revisited after a period of one year</p>
<p>(iii) a chargesheet has been issued against the officer in a disciplinary proceeding and the proceeding is pending</p></blockquote>
</blockquote>
<blockquote>
<blockquote><p>(iv) orders for instituting disciplinary proceeding against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of passing such order</p></blockquote>
</blockquote>
<blockquote>
<blockquote><p>(v) chargesheet has been filed in a Court by the Investigating Agency in a criminal case and the case is pending</p></blockquote>
</blockquote>
<blockquote>
<blockquote><p>(vi) orders for instituting a criminal case against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of initiating proceedings</p></blockquote>
</blockquote>
<blockquote>
<blockquote><p>(vii) sanction for investigation or prosecution has been granted by the Competent Authority in a case under the PC Act or any other criminal matter</p>
<p>(viii) an FIR has been filed or a case registered by the concerned Department against the officer provided that the chargesheet is served within three months from the date of filing / registering the FIR / case</p></blockquote>
</blockquote>
<blockquote>
<blockquote><p>(ix) the officer is involved in a trap / raid case on charges of corruption and investigation is pending.</p></blockquote>
