<p>Subject: <strong>Amendment in the Recruitment Rules for the post of Joint Director (Management Services) in the Institute of Secretariat Training &amp; Management -regarding.</strong></p>
<p>The undersigned is directed to say that as per DoPT&#8217;s O.M. No. AB-14017/61/2008-Estt(RR) dated 13.10.2015 the proposal for framing /amendment of Recruitment Rules are to be uploaded on the website of respective Ministries/Departments for 30 days for inviting comments from the stakeholders.</p>
<p>2. Therefore, the draft Recruitment Rules to the post of Joint Director (Management Services), Institute of Secretariat Training &amp; Management, New Delhi are uploaded on the DoPT&#8217;s website for information of stakeholders. All stakeholders are requested to go through the draft Recruitment Rules and furnish their comments,if any, to the undersigned within a period of one month i.e. date of its uploading in the website. In case,no comments received as on date, the Department will proceed further for taking necessary action for amendment of aforementioned draft Recruitment Rules.</p>

<p>G.S.R&#8230; &#8211; In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in upersession of the Institute of Secretariat Training and Management Joint Director (Management Services) Recruitment Rules, 2014, except as respects things done or omitted to have been done, before such supersession the President hereby makes the following rules regulating the method of recruitment to the post of Joint Director (Management Services) in the Institute of Secretariat Training and Management, Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training namely:-</p>
<p>I. <strong>Short title and commencement</strong>.-</p>
<blockquote><p>(1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Institute of Secretariat Training and Management Joint Director (Management Services) Recruitment Rules, 2017.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p></blockquote>
<p>2. <strong>Number of post, classification and Level in the pay matrix</strong>. &#8211; The number of the said post, its classification and Level in the pay matrix shall be as specified in columns (2) to (4) of the schedule annexed to these rules.</p>
<p>3. <strong>Method of recruitment, age limit and qualification, etc</strong>.- The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.</p>
<p>4. <strong>Disqualification</strong>. &#8211; No person, &#8211;</p>
<p>(a) who has entered into or contracted a marriage with a person having a spouse living, or</p>
<p>(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:</p>
<blockquote><p>Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.</p></blockquote>
<p>5. <strong>Power to relax</strong>. &#8211; Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.</p>
<p>6. <strong>Saving</strong>. &#8211; Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex- servicemen and other special category of persons in accordance with the orders issued by the Central Government from time to time in this regard.</p>

<p>2. In some Ministries/ Departments, posts may exist which are not classified as per the norms laid down by this Department. If, for any specific reason, a Ministry/ Department proposes to classify the posts differently, it would be necessary for that Department to send a specific proposal to Department of Personnel and Training giving full justification in support of the proposal within three months of this O.M. so that the exception to the norms of classification laid down in 8.0. 3578 (E) dated 9.11.2017 (copy enclosed) can be notified.</p>

<p>Subject: <strong>Frequently Asked Questions on timeline for completing Disciplinary proceeding in time bound manner under CCS (CCA) Rules, 1965.</strong></p>
<p>Instructions have been issued in the past for expeditious disposal of disciplinary proceeding cases.  Further, Central Civil Services (Classification, Control &amp; Appeal) Rules, 1965 have also been notified vide Gazette Notification No. 548(E) dated 2.06.2017 (copy enclosed) for introducing stringent timeline for  completing disciplinary proceeding in a time bound manner. Based on the same, a set of frequently asked questions is attached for necessary information.</p>

<p>Subject:- <strong>Implementation of the recommendations of 7th Central Pay Commission: Discontinuation of Central Secretariat (Deputation on Tenure) Allowance to officers of Organized Group &#8216;A&#8217; Services on their appointment as Under Secretary, Deputy Secretary and Director in the Central Secretariat under the Central Staffing Scheme.</strong></p>
<p>This Department&#8217;s OM No. 2/22(A)/2008-Estt(Pay-II) dated 3rd September 2008 provided for rates of Central Secretariat (Deputation on Tenure) Allowance to officers of Organized Group &#8216;A&#8217; Services on their appointment as Under Secretary, Deputy Secretary and Director in the Central Secretariat under the Central Staffing Scheme.</p>
<p>2. As provided in para 7 of Ministry of Finance (Department of Expenditure)&#8217;s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission (CPC) was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances have been paid at the existing rates in the existing pay structure .</p>
<p>3. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary, has since been issued as per the Resolution No.11-1/2016-IC dated 6th July 2017 of Department of Expenditure.</p>
<p>4. D/o Expenditure&#8217;s OM No.29/ 1/2017-E.II(B) dated 11.07.2017 also provided that disbursement of all existing allowances which have not been specifically recommended for continuation in terms of the Resolution dated 6th July,2017 shall be discontinued from the salary of the month of Jul,2017.</p>
<p>5. In view of D/o Expenditure&#8217;s OM No.29/1/2017-E.II(B) dated 11.07.2017, Central Secretariat (Deputation on Tenure) Allowance can not be paid without issue of a fresh O.M. All Ministries/ Departments may please take note for strict compliance.</p>

<p>Subject:-<b> Grant of Deputation (Duty) Allowance &#8211; Recommendations of the Seventh Central Pay Commission</b> &#8211; Regarding.</p>
<p>This Department’s OM No. 6/8/2009-Estt.(Pay-II) dated 17.6.2010 inter-alia provides for rates of Deputation (Duty) Allowance admissible to Central Government employees.</p>
<p>2. As provided in para 7 of Ministry of Finance, Department of Expenditure’s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission (CPC) was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all Allowances have been paid at the existing rates in the existing pay structure.</p>
<p>3. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary has since been issued as per the Resolution No.11-1/2016-IC dated 6th July 2017 of Department of Expenditure.</p>
<p>4. As mentioned at Sl.No.46 of the Appendix-II of the said Resolution dated 6th July 2017, the recommendation of the 7th CPC for enhancement of ceiling of Deputation (Duty) Allowance for civilians by 2.25 times has been accepted and this decision is effective from 1st July, 2017. Accordingly, the President is pleased to decide that the rates of Deputation (Duty) Allowance and certain other conditions relating to grant of Deputation (Duty) Allowance shall be as under:-</p>
<p>The Deputation (Duty) Allowance admissible shall be at the following rates:</p>
<p>(a) In case of deputation within the same station the Deputation (Duty) Allowance will be payable at the rate of 5% of basic pay subject to a maximum of Rs.4500 p.m.</p>
<p>(b) In case of deputation involving change of station, the Deputation (Duty) Allowance will be payable at the rate of 10% of the basic pay subject to a maximum of Rs.9000 p.m.</p>
<p>(c) The ceilings will further rise by 25 percent each time Dearness Allowance increases by 50 percent.</p>
<p>(d) Basic Pay, from time to time, plus Deputation (Duty) Allowance shall not exceed the basic pay in the apex level i.e. Rs. 2,25,000/-. In the case of Government servants receiving Non Practising Allowance, their basic pay plus Non-Practising Allowance plus Deputation (Duty) Allowance shall not exceed the average of basic pay of the revised scale applicable to the Apex Level and the Level of the Cabinet Secretary i.e. Rs.2,37,500/-.</p>
<p>Note: 1 ‘Basic pay’ in the revised pay structure (the pay structure based on 7th Central Pay Commission recommendations) means the pay drawn by the deputationist, from time to time, in the prescribed Level, in Pay Matrix, of the post held by him substantively in the parent cadre, but does not include any other type of pay like personal pay, etc.</p>
<p>Note: 2 In cases where the basic pay in parent cadre has been upgraded on account of non-functional upgradation (NFU), Modified Assured Career Progression Scheme (MACP), Non Functional Selection Grade (NFSG), etc., the upgraded basic pay under such upgradations shall not be taken into account for the purpose of Deputation (Duty) Allowance.</p>
<p>Note 3 In the case of a Proforma Promotion under Next Below Rule (NBR): If such a Proforma Promotion is in a Level of the Pay Matrix which is higher than that of the ex-cadre post, the basic pay under such Proforma Promotion shall not be taken into account for the purpose of Deputation (Duty) Allowance. However, if such a Proforma Promotion under NBR is in a Level of the pay matrix which is equal to or below that of the ex-cadre post, Deputation (Duty) Allowance shall be admissible on the basic pay of the parent cadre post allowed under the proforma promotion, if opted by the deputationist.</p>
<p>Note 4 In case of Reverse Foreign Service, if the appointment is made to post whose pay structure and/ or Dearness Allowance (DA) pattern is dissimilar to that in the parent organisation, the option for electing to draw the basic pay in the parent cadre [alongwith the Deputation (Duty) Allowance thereon and the personal pay, if any] will not be available to such employee.</p>
<p>Note: 5 The term ‘same station’ for the purpose will be determined with reference to the station where the person was on duty before proceeding on deputation.</p>
<p>Note: 6 Where there is no change in the headquarters with reference to the last post held, the transfer should be treated as within the same station and when there is change in headquarters it would be treated as not in the same station. So far as places falling within the same urban agglomeration of the old headquarters are concerned, they would be treated as transfer within the same station.</p>
<p>5. Para 6.1 of this Department’s OM No.6/8/2009-Estt(Pay-II) dated 17.6.2010 stands amended to the above effect.</p>
<p>6. In so far as persons serving in the Indian Audit &amp; Accounts Department are concerned, these orders issue after consultation with the Comptroller &amp; Auditor General of India.</p>
<p>7. These orders shall take effect from 1st July, 2017</p>

<strong>It IS proposed to fill up the post of Director (Finance) (JS level) in Handicrafts &amp; Handlooms Exports Corporation of India Ltd. (HHEC), Noida under Ministry of Textiles with pay at Level 14 (Rs 1,44,200-2,18,200/-)of the Pay Matrix on deputation basis</strong></p>
<p>2. Names of willing and eligible officers, who have been empanelled to hold Joint Secretary or equivalent posts at the Centre under the Central Staffing Scheme, may be recommended to this office along with cadre clearance, vigilance clearance, detailed bio-data, viz. name, date of birth, service, batch, contact telephone number, email address, educational qualifications, complete experience/posting details etc. CR dossiers/certified ACRs for the last five years and details of debarment &amp; cooling off in respect of past central deputation, In case the officers are currently on Central deputation, the nomination may be forwarded with the approval of the Minister-in-charge concerned.</p>
<p>3. The post is a Non-Central Staffing Scheme post to be filled up through the Civil Services Board (CSB) procedure. It may be noted that no &#8216;Mandatory Posting Certificate&#8217; for allotment/retention of Government accommodation would be issued by this office to the officer appointed on the above referred post However, those officers who have served and are currently serving on Central Staffing Scheme post in Delhi for at least four years and require to retain Government accommodation, would be issued a certificate to the effect that the officer concerned has served for at least four years in CSS post and he/she needs to retain Government accommodation for his/her tenure on non-CSS post.</p>

<p>Subject: <strong>Inviting comments on the definition of &#8220;Operational Staff&#8221; which would be eligible for Overtime Allowance</strong></p>
<p>As per the Dept. of Expenditure&#8217;s Resolution No. 11-1/2016-IC dated 06.07.2017, following is the decision of Government on Overtime Allowance (OTA): &#8220;Ministries/Departments to prepare a list of those staff coming under the category of &#8216;Operational Staff&#8217;. Rates of Overtime Allowance not be revised upwards&#8221;. Further it has been clarified by the Dept. of Expenditure that the Government has decided that given the rise in the pay over the years, the recommendations of the 7th CPC to discontinue OTA for categories other than Operational Staff and industrial employees who are governed by statutory provisions may be accepted.</p>
<p>2. Accordingly, it has been decided to implement the aforesaid decision of the Government on Overtime Allowance across all the Ministries/Departments and attached and subordinate office of the Government of India.</p>
<p>3. However, this Department has been receiving queries from various Deptts. as<br />
to which staff would be covered under the term &#8220;<strong>Operational</strong>&#8220;. Thus it appears that there is a lack of clarity as to what constitutes Operational Staff. In pursuance of decision taken on the recommendations of the 7th CPC relating to OTA, a broad definition has been attempted in order to assist in identification of operational Staff.</p>
<p><strong>Definition: </strong>&#8220;All non-ministerial non-gazetted staff directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.&#8221;</p>
<p>4. Inputs and suggestions are requested from all Ministries/Departments taking into account the specific peculiar requirements of staff under each of them keeping in view the content of work being performed by them. OFFICE MEMORANDUM</p>
<p>Subject: <b>Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers Grade than their juniors -regarding.</b></p>
<p>Ref: OM No.18/2/2007-CS-l dated 20.05.2014 &amp; 08.07.2014 and OM No.18/212014-CS.l(S) dated 27.12.20216.</p>
<p>Representations have been received from some CSS officers in whose case re-fixation and recovery orders have been issued by concerned Ministries/Departments in pursuance to DOPT OM dated 20.05.2014, requesting withdrawal of the OMs referred above.</p>
<p>2. It is once again clarified that OM No.5/16/80-CS.I dated 13.4.1988 was issued on acceptance of award by Board of Arbitration in CA Reference No.7 of 1984 which allowed stepping up of pay of an Assistant of CSS, who is senior by virtue of having been recruited through an earlier examination but is drawing less pay on promotion in the Grade of Section Officer than his junior recruited through a later examination, up to a level equal to the pay of such junior Section Officer in the same cadre i.e. senior DR Assistant to junior DR Assistant of later exam on their promotion as Section Officer. Vide OM No.5/21/92-CS.I dated 23.2.1994 this benefit of stepping up was extended to Section Officers appointed through Limited Departmental Competitive Examination (LDCE) (again applicable to DR Assistants only). OM No.5/1/96-CS.I dated 8.10.1996 further extended this benefit in case of promotee Assistants and also to the cases where both junior and senior have been recruited on the basis of the same Select List Assistants Grade Examination, as the case may be in accordance with judgements of CAT in OA No. 365/90 (Shri K.C. Sehgal VS UOI and CA No. 869/91 (Shri L.K. Chawla VS UOI), which were upheld by the Hon’ble Supreme Court.</p>
<p>3. That there are general guidelines of stepping up of pay issued by the Ministry of Finance vide OM No.F.2(78)-E.III(A) dated 0 .02.1966 and this Department vide OM dated 04.11.1993. One of the conditions of the general guidelines for allowing stepping up of pay to a senior govt. servant with reference to a junior is that the senior should have drawn more pay than the junior in the lower grade also.</p>
<p>4. However, certain clarifications were issued by CS-I Division, DoPT in 2007 and 2008 to individual Ministries/Departments, on references received from them, which were at variance with the general conditions of stepping up of pay i.e. stepping up of pay was allowed even if junior was drawing more pay than the senior in the lower grade i.e. in Assistant/Grade. Therefore, vide OM dated 29.5.2009, the clarification issued in 2007 &amp; 2008 were withdrawn and Ministries/Departments were advised to strictly allow stepping up enforcing conditions laid down in OM dated 8.10.1996. Departments were also informed vide OM dated 21.05.2010 that as the matter was still under consideration, status-quo, as on date, might be maintained in the matter of stepping up of pay of Section Officers of CSS till the matter attains finality. Eventually, the matter attained finality and a consolidated OM as vetted by the Estt..(Pay) Division of this Department and Department of Expenditure was issued on 20.05.2014.</p>
<p>5. The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04.1988, 23.02.1994 and 08.10.1996 and general conditions as laid down in OM dated 04.11.193, should be reviewed and pay re-fixed accordingly. That excess payments made to the employees in the cases of wrong stepping up of pay should be recovered in terms of DOP&amp;T’s OM No.18/26/2011-Estt(Pay-l) dated 06.02.2014 and a compliance report in this regard furnished to this Department. It was further clarified vide OM dated 08.7.2014 that all the three OMs and general conditions of stepping up of pay are not exclusive of each other and the three OMs are to be read with and subject to the general conditions reiterated vide OM dated 4.11.1993, therefore, stepping up of pay is not to be allowed where junior was drawing more pay than the senior in the lower grade.</p>
<p>6. As regards, OA No.2884/2015 and similar OAs filed in this regard, it is observed that only applicants in these cases have been granted interim stay by the Learned CAT. That the said OAs have been filed by the applicants in the individual capacity. Thus in all those cases where stepping up of pay has been allowed, but where the benefited individuals were not covered by the OMs dated 13.4.88, 23.2.94 and 8.10.96 and the general conditions of stepping up of pay as laid down in the DOP&amp;T&#8217;s OM No. 4/7/92-Estt(Pay-1) dated 04.11.93, pay will have to be re-fixed and recovery of excess payment, if any, is to be made.</p>
<p>7. Therefore, vide reminder OM dated 27.12.16, the Ministries/Departments were requested to expedite the compliance reports as requested vide OM dated 20.05.2014 except in those cases where matter of recovery is subjudice/stayed by order of any competent court.</p>
<p>8. It may be mentioned that one of the similarly placed officers, in whose case orders for stepping up of pay with reference to a promotee assistant was issued but not implemented, had approached CA (PB) through OA No.1199/2014(H.C. Rai vs. UOI). The CAT vide its order dated 28.03.17 while dismissing the OA had categorically ruled that the stepping up of his pay was not in consonance with the provisions of OM dated 20.05.2014 i.e. OMs dated 13.4.88, 23.2.94 and 8.10.96.</p>
<p>9. With regards difficulty being faced by some Ministries/Departments in establishing links/chain of officers in refixation/recovery matters, it is hereby mentioned that many Ministries/Departments have already issued re-fixation orders establishing links by themselves as per the instructions issued by this Department.</p>
<p>10. All the Ministries/Departments are thus again requested to furnish the compliance reports in the prescribed proforma, latest by 15th November 2017.</p>
<p>11. In view of above, the representations/OMS of following have no merit and are accordingly disposed off:</p>
