<p>Subject:- Discontinuation of Interview at Junior Level Posts in the Government of India- recommendation of Committee of Secretaries.</p>
<p>The undersigned is directed to refer to this Department’s D.O. of even number dated 04.09.2015 and subsequent OM’s dated 09th October, 2015, 09th November, 2015 on the above subject seeking detailed information on the progress made/action taken in the matter.</p>
<p>2. It is informed that Secretary (Personnel) had convened meetings on 14th December, 2015 and 17th December, 2015 to review the progress of implementation of the “No Interview Requirement Proposal” and to get the updated status on the decision/progress made by the various Ministries/Departments. Keeping in view the queries raised by the representative of various Ministries/Departments the following is once again clarified:-</p>
<p>(a) The decision to discontinue interview for recruitments is for all Group ‘C’, Group (which are now reclassified as Group ‘C’) Posts and for nongazetted posts of Group ‘B’ Category and all such equivalent posts.</p>
<p>(b) The ‘No Interview Requirement” proposal has to be implemented for all the junior level posts in Government of India Ministries/Departments/attached Office/Subordinate Office/Autonomous Bodies/Public Sector Undertakings.</p>
<p>(c) Instructions issued by the Department of Public Enterprises on 14 th December, 2015 vide OM No. DPE-GM to all Administrative Ministries concerned with CPSES under them with advice to dispense with the practice of interview (copy enclosed).</p>
<p>&nbsp;</p>
<p>(d) The timelines set regarding completing the process of the discontinuation of interview by 31.12.2015 has to be adhered to strictly. From 01 st January, 2016 there will be no recruitment with interview at the junior level posts as mentioned at 2(a) above, in Government of India Ministries / Departments / attached Office / Subordinate Office / Autonomous Bodies / Public Sector Undertakings. All the advertisement for future vacancies will be without the Interview as part of the recruitment process.</p>
<p>(e) The interviews will be done away even in cases where in the past the selections used to be made purely on the basis of performance in the interview. The Ministries/Departments/Organizations’ will consider revising the scheme for selection for such cases.</p>
<p>(f) It is also clarified that as Skill Test or Physical Test is different from Interview, and they may continue. However, these tests will only be of qualifying nature. Assessment will not be done on the basis of marks for such tests.</p>
<p>(g) In case of specific posts where the :Ministry/Departments wants to continue undertaking Interview as a process of recruitment, a detailed proposal seeking exemption will have to be sent to the DoPT with the approval of the Minister/Minister In-Charge.</p>
<p>3. All the Oentral Ministries/Departments are therefore requested to ensure that necessary action in respect of their Ministry/Department/Organizations are completed within the stipulated time.</p>
<p>A consolidated report with the details of the decision taken/progress made in this regard should also be furnished to this Department at the earliest and not later than 7th January, 2016. Report so to be furnished with the approval of the Minister/Minister In-Charge shall include the details of the name and number of posts where the interview is discontinued and posts for which the exemption has been sought within the purview of the administrative Ministries/Departments.</p>

<p>2. HoD and HoD of the Ministries/Departments concerned are requested to kindly scrutinize the pending write-ups for acceptance/publication at the earliest.<br />
3. All Ministries/Department are also requested to impress upon CSS/CSSS officers retiring within a period of six months to submit a write-up providing details of their work that has contributed to the efficiency, economy and effectiveness of Government functioning or/and any innovation which led to improved work culture or any other contribution considered significant. <p>Subject: <strong>Deputation of Central Government servants to posts in Central Autonomous Bodies</strong><br />
The undersigned is directed to say that in terms of revised instructions issued by Department of Pension and Pensioners Welfare vide their O.M No. 4/78/2008-P&amp;PW(D) dated 12.10.2015, appointment of Central Govt. employees to posts in Central Autonomous Bodies on deputation basis is allowed without seeking exemption from the Rule of immediate absorption, if the Recruitment Rules for the posts specifically provide for the appointment of Central Government employee on deputation.</p>
<p>2. Accordingly, henceforth, CS.I Division being the cadre controlling<br />
authority for CSS Officers will provide cadre clearance to CSS Officers for deputation to Central Autonomous Bodies. However, the Autonomous Bodies and their nodal Ministries concerned should ensure that the provisions of D/o. P &amp; PW&#8217;s O.M. dated 12.10.2015 are fulfilled while appointing Government servants on deputation basis.</p>

<p>Subject: <b>Processing of files referred to DOP&amp;T for advice/clarification-procedure to be followed</b></p>
<p>This Department has from time to time issued instructions prescribing the procedure to be followed for making references to this Department for advice/clarification. In this regard, O.M.No.20034/2/2010-Estt(D) dated 13th August, 2010, O.M.No.20034/2/2010-Estt(D) dated 30th November, 2011 and OM of even number dated 13.02.2015 refers.</p>
<p>2. Inspite of these instructions, some Ministries/ Departments continue to refer the files to this Department without following the procedure enunciated in the above mentioned OMS, resulting in avoidable procedural delays, grievances and unwanted litigation.</p>
<p>3. In this background While reiterating instructions mentioned in the above three OMs, the following procedure for referring the proposals including court cases to this Department, may be followed:-</p>
<p>i. Administrative Departments shall refer cases to the DoPT only where there is a specific point which is either not covered by prevailing policies/ guidelines/ rules /regulations or interpretation of a specific clauses/provisions in the said policies/ guidelines/rules/regulations is involved for a particular case.</p>
<p>ii. When such a reference is made, all facts pertaining to the case may be incorporated in the Self Contained Note.</p>
<p>iii. All the references should be made to DOP&amp;T with the approval of the Secretary of the Administrative Ministry/ Department. These references should be sent atleast two weeks in advance so that it can be properly examined in DoP&amp;T.</p>
<p>iv. The concerned Ministry/ Department, which sends the proposal should indicate the Division within DoPT where it has to be dealt with and also to the concerned Joint Secretary/ Director so that there is no delay in processing within DoPT.</p>
<p>v. While sending the proposal, the name, designation of i the Joint Secretary/ Director (Phone number and e-majl id) who can be contacted for further correspondence may also be indicated.</p>
<p>4. The content of this O.M. may be given wide publicity and brought to the notice of all concerned and will be applicable from 1st November, 2015.</p>

<p>Subject: <strong>Review of Promotion Guidelines for promotion of IAS Officers – clarifications – </strong><b>regarding</b></p>
<p>I am directed to refer to this department’s letter No.20011/4/92-AIS(II) dated the 28th March, 2000 issuing guidelines for promotion of member of the Indian Administrative Service and to say that this department has been receiving references seeking clarification on grant of promotion in case of review DPC with regard to the official who is clear from vigilance angle on the date of promotion of the junior in the original DPC but subsequently attracts the provision contained in para 11.1 of the promotion guidelines for IAS dated 28.03.2000 which provides that “at the time of consideration of the cases of Government servants for promotion, details of Government servants in the consideration zone for promotion falling under the following categories should be specifically brought to the notice of the Departmental Promotion Committee:-</p>
<blockquote><p>(i) Government servants under suspension;</p>
<p>(ii) Government servants in respect of whom a charge sheet has been issued and the disciplinary proceedings are pending; and</p>
<p>(iii) Government servants in respect of whom prosecution for a criminal charge is pending.”</p></blockquote>
<p>2. The matter has been examined in consultation with the Department of Legal Affairs and it is clarified that in the case of review DPC, where a junior has been promoted on the recommendations of the original DPC, the official would be considered for promotion if he/she is clear from vigilance angle on the date of promotion of junior, even if the provisions of para 11.1 of Promotion Guidelines dated 28.03.2000 gets attracted on the date of actual promotion, is considered.</p>
<p>3. This issues with the approval of the competent authority.</p>

<p>Format for giving information to the applicants under RTI Act- issue of guidelines regarding.</p>

<p>Subject: <strong>Format for giving information to the applicants under RTI Act- issue of guidelines regarding.</strong></p>
<p>It has been observed that different public authorities provide information to RTI applicants in different formats. Though there cannot be a standard format for providing information, the reply should however essentially contain the following information:</p>
<blockquote><p>(i) RTI application number, date and date of its receipt in the public authority.</p>
<p>(ii) The name, designation, official telephone number and email ID of the CPIO.</p>
<p>(iii) In case the information requested for is denied, detailed reasons for denial quoting the relevant sections of the RTI Act should be clearly mentioned.</p>
<p>(iv) In case the information pertains to other public authority and the application is transferred under section 6(3) of the RTI Act, details of the public authority to whom the application is transferred should be given.</p>
<p>(v) In the concluding para of the reply, it should be clearly mentioned that the First Appeal, if any, against the reply of the CPIO may be made to the First Appellate Authority within 30 days of receipt of reply of CPIO.</p>
<p>(vi) The name, designation, address, official telephone number and e-mail ID of the First Appellate Authority should also be clearly mentioned.</p></blockquote>
<p>2. In addition, wherever the applicant has requested for ‘certified copies’ of the documents or records, the CPIO should endorse on the document “True copy of the document/record supplied under RTI Act”, sign the document with .date, above a seal containing name of the officer, CPIO and name of public authority; as enumerated below:</p>

<p>The undersigned is directed to refer to this Department’s office memorandum of even number dated 8th October, 2015 laying down the procedure for empanelment and appointment of retired officers as the Inquiry Officers for conducting Departmental Inquiries by the cadre controlling authorities. The services of the Inquiry Officers would be utilized by the Ministries/Departments under Government of India, State Government and PSUs for conducting Departmental Inquiries against the delinquent officials.</p>
<p>2. Comments/views of Ministries/Departments and State Governments are invited on the procedure laid down in the office memorandum under reference within three weeks from the posting of this office memorandum on the website of this Department(persmin.gov.in).</p>

<p>Subject: <strong>Simplification of procedure for verification of service- adherence to the revised format – regarding.</strong></p>
<p>The undersigned is directed to refer to this Department’s OM of even number dated 23 rd October, 2013 for simplification of procedure for verification of service and adherence of the revised format of the Service Book prescribed by this Department’s OM No, 17011/1/99-Estt. (L) dated 11.03.2008 whereby the revised format of the Service Book was circulated for being adopted. The said revised format also includes Part V where under the record of verification of service is to be maintained.</p>
<p>2. It has been brought to the notice of this Department that the aforesaid provisions of the OM dated 23rd October, 2013 and Supplementary Rules as also the provisions of the CCS(Pension) Rules, 1972 as referred to in that OM are not being followed. Consequently, the gaps in service verification, get detected at a very late stage when the concerned Government servant is due to retire on attaining the age of superannuation.</p>
<p>3. In view of this and with the objective of eliminating delays in processing of cases of retiring Government Servants, the aforementioned rules and the instructions of this Department are reiterated and it is stated that it may be ensured that the following are strictly adhered to:</p>
<blockquote><p>(i) The record of verification of service may henceforth be maintained only in Part V of the revised format of the Service Book as per the new format prescribed by this Departments aforesaid OM of 11-03-2008.</p>
<p>(ii) The exercise for ensuring completion of the entries of service verification in the Part V of the new format, in respect of employees who are retiring within five years, may be undertaken immediately, by the concerned administrative authorities and concluded within a defined time frame, as may be worked out by such authority.</p>
<p>(iii) Any gap in the verification of service may be intimated to the employee concerned, and simultaneously appropriate action for ensuring verification of missing spells may be taken by the Head of Office.</p>
<p>(iv) The concerned Government servant may also be informed of deficiencies and gaps as regards missing entries relating to verification of service and the period thereof.</p></blockquote>
<p>4. The Department of Pensions and Pensioners’ Welfare have also suggested that the administrative authorities, to preclude and to cut down on delays in payment of retiring benefits to Government servants retiring of superannuation, may consider adoption of the following mechanisms and processes:</p>
<blockquote><p>(i) Annual service verification and intimation to every officer regarding Service Verification Status so that any lapse is timely ascertained and corrective action taken.</p>
<p>(ii) The exercise of Annual verification be monitored by every Ministry/ Department/Cadre Controlling Authority on a quarterly basis.</p></blockquote>
<p>5. All Ministries/ Departments are accordingly requested to issue suitable instructions to all Heads of Offices/Pay &amp; Accounts Offices for strict compliance of the above instructions so as to preclude any delays in disbursement of retiral benefits of Government servants.</p>
