Sub: General Clarification regarding counting of broken spells of ad-hoc promotion for increment – reg.

The undersigned is directed to say that this Department has received references from Ministries / Departments regarding counting of broken spells of ad-hoc promotion for the purpose of increment.

2. The matter has been considered in consultation with Department of Expenditure and it is clarified that the provisions of FR 26 which provide for counting of broken spells in officiation in the higher post for increment, continue to apply for increment under Rule 10 of CCS (RP) Rules. 2008.

3. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

Sub: Guidelines on implementation of suo-motu disclosure under Section 4 of RT1 Act, 2005 — Compliance of.

Attention is invited to this Departments O.M. of even no. dated 15.4.2013 on the subject mentioned above.

2. In that O.M., it was mentioned that each Ministry/Public Authority shall ensure that the guidelines for suo motu disclosure under RTI are fully operationalised within a period of 6 months from the date of their issuance i.e. 15.04.2013. It was also requested that the Action Taken Report on the compliance of guidelines should be sent, alongwith the URL link, to the DoPT and the Central Information Commission soon after the expiry of the initial period of the 6 months. It has been noticed that most of the Ministries/Departments/Public Authorities have not sent the compliance report/Action Taken Report to this Department and Central Information Commission.

3. It is once again requested that the guidelines mentioned in O.M. dated 15.4.2013 be complied with at the earliest and compliance report sent to this Department and Central Information Commission, immediately.

Sub: Notification for amendment of clause (2) of FR 29

The undersigned is directed to say that the FR 29(2) provided that if a Government servant is reduced as a measure of penalty to a lower service, grade or post or to a lower time scale, the authority ordering the reduction may or may not specify, the period for which the reduction shall be effective. The Rule 11(vi) of the CCS (CCA) Rules, 1965 relating to this penalty was earlier amended vide the Notification No. F.11012/2/2005-Estt (A) dated the 2nd February, 2010. Vide the Notification No.G.S.R. 263 dated 27th October, 2013 published in the Gazette of India the FR 29(2) has now been amended, in line with the amended CCS (CCA) Rules, 1965, as follows:

“(2) If a Government servant is reduced as a measure of penalty to a lower service, grade or post or to a lower scale, the authority ordering the reduction shall specify —

(a) the period for which the reduction shall be effective; and

(b) whether, on restoration, the period of reduction shall operate to postpone future increments and, if so, to what extent.

(3) The Government servant shall regain his original seniority in the higher service, grade or post on his restoration to the service, grade or post from which he was reduced”.

2. All the Ministries / Departments are requested to bring the contents of the afore mentioned amendment to the notice of all concerned for information and compliance.

3. Any existing provisions in Disciplinary Rules not in consonance with the above may be amended so that they are not in conflict with the Fundamental Rules.

Subject: Guide on the Right to Information Act, 2005 – updated Version.

Section 26 of the RTI Act requires the Government to compile a guide containing such information, in an easily comprehensible form and manner, as may reasonably be required by a person who wishes to exercise any right specified in the Act. Further, it requires the Government to update the guide at regular intervals.

Accordingly an updated Guide on the Act is hereby published online which would help all the stake-holders viz. information seekers in getting information, public information officers in dealing with the RTI applications, first appellate authorities in taking cogent decisions on appeals and the public authorities in implementing various provisions of the Act in right earnest.

Subject: Grant of incentive for acquiring higher qualifications – Inclusion of additional qualifications / Review of the qualifications listed in the Annexure to this Department’s OM No 1/2/89-Estt.(Pay-I) dated 9/4/1999 -reg.

The undersigned is directed to refer this Department’s OM of even number dated 28.4.2009 and subsequent reminders of even number dated 17.6.2009, 20.8.2009, 30.10.2009, 7.1.2010 and 23.3.2010 calling for suggestions regarding addition / deletion of qualifications listed in the Annexure to this Department’s OM dated 9.4.1999.

2. Even after lapse of considerable time, no inputs in this regard have been received from Ministries / Departments, except Department of Revenue, Ministry of Finance.

3. All the Ministries / Departments are, therefore, requested to furnish their suggestions in this regard to this Department within 30 days from the date of issuance of this OM, before a final decision is taken in the matter. This OM may please be given wide publicity.

The undersigned is directed to refer lo DoPT’s O.M of even number dated 18.10.2013 and subsequent reminder dated 01.11.2013 on the subject mentioned above (available in the web site of this Department at persmin.nic.in -> DoPT -> central secretariat ->CSS -> promotion -> regular -> SO to US) and to say that fresh vigilance status of officers whose names figure in Annexure have not yet been received Out of 406 officers in the zone of consideration, fresh vigilance status has been received only in respect of 158 officers. For want of vigilance status forwarding of proposal to UPSC is getting delayed.

2. Ministries/ Departments concerned are, therefore, once again requested to furnish vigilance status of the officers indicated in Annexure to this OM afresh so that the proposal for preparation cl USSL 2012 may be sent to UPSC at the earliest. The information should reach this Department by 22.11.2013. Vigilance status in respect of retired officers and who are in the zone of promotion is also required to be furnished.

3. All Officers concerned, in their own interest are also requested to pursue with the Administration Division concerned to ensure that the said documents/information in their respect are furnished to this Department urgently.

Sub:- Extension in deputation tenure beyond the prescribed limit of seven years/premature repatriation from a Non – Central Staffing Scheme post – reg

As per the ACC directions, an officer working on a Central Staffing Scheme (CSS) post is allowed an additional tenure of two years on his shift to a Non-Central Staffing Scheme post and vice-versa, subject to cadre clearance and further subject to the maximum limit of seven years outside the cadre at a stretch. While allowing the shift, the tenure of the officers is specified/fixed. Similarly as per extant policy, officers working on a CSS post on their premature repatriation on grounds other than promotion are required to undergo extended cooling off.

2. However, it has come to notice that officers have continued to stay beyond the stipulated tenure without the approval of the competent authority, sometimes even beyond the maximum stipulated limit of seven years outside the cadre. It has also come to notice that some of the officers who after their stint under the CSS had shifted to Non-CSS posts were allowed to go prematurely to their cadre without seeking the approval of the ACC.

3. The undersigned is directed to convey that any proposal for premature repatriation and extension in tenure beyond the approved tenure in respect of officers who have shifted from a CSS post and are now working on a Non-CSS post should be referred to DoP&T for approval/orders of the competent authority.

4. All the Ministries/Departments are requested to ensure compliance of the above direction in future.
