Office Memorandum

Subject: Risk Allowance to Central Government employees – clarification reg.

Reference in invited to this Department’s O.M. No.21012/01/2008-Estt.(Allowance) dated 18th June, 2012 wherein the grant of Risk Allowance was extended at the then existing rates beyond 30.06.2012 and upto 31.12.2012. Subsequently, vide this Department’s OM. No.21012/01/2010-Estt. (Allowance) dated October 18, 2012 the rates of Risk Allowance were revised with effect from 1st September, 2008, implying that grant of Risk Allowance would be at revised rates w.e.f. 1st September, 2008 onwards. Hence, there is no need for issuing separate instructions continuing payment of Risk Allowance beyond 31.12.2012.

This issues with the approval of Joint Secretary (Establishment).

Subject : Advance Increments granted to Stenographers of Subordinate Offices on qualifying speed test in shorthand at 100/120 w.p.m. regarding.

The undersigned is directed to refer to this Department’s 0M No.18/44/88-Pay-I dated 07.12.2009 on the above subject which provides that the Advance Increments granted to Stenographers of Subordinate Offices on qualifying speed test in shorthand at 100/120 w.p.m. are treated as pay for all purposes.

2. Consequent upon implementation of CCS (RP) Rules 2008, the concept of Pay Band& Grade Pay has been introduced. Since there are no fixed rates of increments now, the manner in which advance increment(s) are to be computed has been considered in consultation with the Department of Expenditure. The grant of advance increments to Stenographers of Subordinate Offices on qualifying the speed test in shorthand at 100/120 w.p.m. after 1.1.2006 may be regulated as under:-

a) In terms of the instructions contained in this Department’s 0M No.18/44/89-Estt (Pay I) dated 07.12.2009, the advance increments granted to Stenographers of Subordinate Offices on qualifying Speed Test in Shorthand at 100/120 w.p.m. in terms of Department of Expenditure OM dated 04.10.1975 are to be treated as pay for all purposes and the past cases are also to be regulated accordingly. These advance increments were therefore to be taken into account for fixation ¡n the Revised Pay for those officials who were in receipt of such increments in the pre revised pay. In such cases, the advance increments will no longer continue as a separate element.

b) In respect of persons who become eligible for grant of advance increments consequent upon implementation of CCS (RP) Rules, 2008, the advance increment may be calculated by granting increment @ 3% of the Basic Pay on the date of passing of the test. Two advance increments may be calculated by granting two increments @ 3% of the Basic Pay on the date of passing the test. The amount of this increment may be treated as a separate element in addition to the Basic Pay (Pay in the Pay Band + Grade Pay), till such advance increments are taken into account as per (c).

c) Once the advance increments are taken into account for the purpose of pay fixation on promotion or being placed in a higher scale on grant of ACP/MACP or fixation of pay due to revision of pay scale etc., the advance increments will no longer be continued as a separate element as it will be merged with the basic pay.

3. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders will be issued after consultation with the Comptroller and Auditor General of India.

Subject:- Grant of advance increments to IAS officers — reg.

Sir,

I am directed to say that after the issue of IAS (Pay) 2nd Amendment Rules, 2008 regarding implementation of the recommendations of the 6 CPC, the provisions contained in rule 7 for grant of advance increments to direct recruit IAS officers have been engaging attention of this Department. The amended provisions of rule 7 are as follows:

7. Grant of Advance increments: “Notwithstanding anything contained in rule 13 of the IAS (Probation) Rules, 1954, the State Government shall sanction the 2nd and 3rd increments due to a direct recruit with effect from the prescribed date of increment after he passes the prescribed departmental examination or examinations irrespective of the length of service, after which he shall be entitled to draw pay at the rate corresponding to this position in the pay band.

Provided that the 3rd increment under this rule shall be granted retrospectively from the prescribed date of increment after passing the prescribed departmental examination, or the last of the prescribed departmental examinations, as the case may be, on the successful completion of the probation and confirmation.

2. It is observed that under the above rule, second and third increments can be sanctioned together from the same date of increment i.e.1st July of the particular year after the passing of departmental examination or examinations by the direct recruit IAS officers, However, as per further provisions of 1st Proviso to rule 7, the third increment shall be sanctioned from the said date of increment retrospectively after completion of probation and confirmation.

3. Any earlier clarification with regard to grant of 2nd and 3rd increment, issued by this Department may be treated as modified to the extent of this clarification.

Subject: Nomination of Area Welfare Officers for the calendar years 2013 and 2014 regarding.

The Department of Personnel & Training nominates Gazetted Officers as Area Welfare Officers (AWOs) for residential colonies to look after the welfare of Central Govt. employees and their families Area Welfare Officer is only a functional arrangement to provide a link between the Central Government employees residing in various colonies and the concerned civic and other agencies providing service to them. A list of functions of Area Welfare Officer is enclosed. The functions of AWOs are official in nature and are performed by them on honorary and voluntary basis. Only those officers who are willing to function as Area Welfare Officer and can spare time for welfare work will be considered for nomination. The Area Welfare Officers serve as a vital link between the Government and residents in various matters relating to the welfare of Government employees residing in various colonies.

2. The tenure of the Area Welfare Officers shall be for a period of two years (commencing from 1.1.2013) or till the services are required by the Govt. whichever is earlier. The Area Welfare Officers are entitled to use office stationery and service postage stamps etc. for discharging their duties as AWO. They are allowed to leave office, with prior permission, for meeting the civic/policy authorities for solving the problems of the residents of their localities.

3. The applicant should not be an office bearer of Central Government employees or any other Residents Welfare Association. Further, officers seeking appointment as AWO should preferably have a residential telephone. No telephone / reimbursement of Telephone rent, facility will be available to AWO nominated by DOPT.

4. Applications from those officers, who are willing to work in honorary and voluntary capacity, as Area Welfare Officers duly recommended by the Department/administrative authority concerned may be forwarded and must reach the undersigned within 45 daysfrom the date of issue of this O.M.A. Format for application is also enclosed.

ANNEXURE-I

FUNCTIONS OF AREA WELFARE OFFICER

1. To function as coordinating officer between the CGHS Dispensary and its beneficiaries regarding complaints from either side.

2. To attend to all emergency hospital work like help in expeditious hospitalisation of serious cases, attending to complaints regarding hospital care, etc,

3. To serve on the CGHS Area Advisory Committee for considering suggestions for the improvement of service and facilities.

4. To act as liaison officer for Community Hall and look to its proper functioning and improvement.

5. To act as liaison officer between the Ministry of Personnel., PG and Pensions and the local Association in all matters and disputes and to mediate in election disputes at the request of the parties.

6. To investigate all cases of neighbourly disputes referred to him by the Depit of Personnel and furnish report on the basis of which action- can be taken by the Directorate of Estates for shifting the erring party to another locality.

7. To act as liaison officer between the Associations and Municipal authorities in all Companies regarding civic services, water electricity, Street lighting, drainage, bus service, sanitary service and vaccination and inoculation services.

8. To act as liaison officer with local police authorities regarding any incident in the locality involving law and order.

9. To act as liaison officer with the Education Directorate regarding complaints about school timing, admission, etc.

10. To act as liaison officer between the Co-operative consumer store and the beneficiaries in the area.

11, To act as liaison officer between CPWD authorities and the allottees regarding Complaints lodged with the CPWD Enquiry office for their speedy disposal.

12. To keep in touch with all the social and cultural bodies in the area.

13. To act as liaison officer with all activities of Grih Kalyan Kendra in the area including ‘Creche’.

14. To act as liaison officer between the colony and the Central Secretariat Spoils Control Board in all activities of the Board.

15. To mediate in family dispute to bring about harmony in the home life in the Context of Home Ministry circular for maintaining the wife in a reasonable comfort and matter relating to notation of monograncy.

16. To assist and cooperate in campaigns and measures such as vaccination in Oculation blood donation family planning etc., launched by the Ministry of Health and Family Planning.

Note: The above list is only illustrative and not exhaustive.

ANNEXURE-III

GUIDELINES / CRITERIA FOR SELECTION 0F AREA WELFARE OFFICERS

1. The tenure of Area Welfare Officers shall be for Iwo years from the date of appointment or till their services ere required by the Government whichever is earlier. However, if there is no other candidate for the area, the old AWO, if he has applied afresh, should be allowed to continue for anothher term.

2. He should be a gazetted officer.

3. The Residents Welfare Association should not be allowed lo nominate any name for AWOs.

4 He must be a resident of the area for which he is the applicant and the area (including the adjacent areas) should have at least 300 Govt. employees residing in that area(s).

5. The officer applying should not be an office bearer of Central Government employee or any other Residents Welfare Association.

6. He should not be retiring within 2 years of his appointment as AWO i.e. he should serve for full term of two years as AWO.

7. He should possess sound health to undertake the job in question.

8. Preference should be given to those, who have telephones at their residences.

9. He should not be a controversial person.

DIVISION FREQUENTLY ASKED QUESTIONS ON NON-FUNCTIONAL UPGRADATION (NFU)

1	What are the recommendations of 6th CPC for grant of Non-Functional Upgradation to for Officers of Organized Group A’ Services?	The Government should, consider batch-wise parity while empanelling and /or posting at Centre between respective batches of IAS and other organized Group A services with the gap being restricted to two years. Whenever any IAS officer of a particular batch is posted in the Centre to a particular grade carrying a specific grade pay in pay bands PB-3 or PB-4. grant of higher pay scale on non-functional basis to the officers beloAnging to batches of organized Group A services that are senior by two years or more should be given by the Government.
2	Whether the recommendations of 6th CPC have been accepted by the Government?	Yes. This will also be applicable to the Indian Police Service and the Indian Forest Service in their respective State Cadres for which the relevant cadre controlling authorities will issue the orders, (Ministry of Finance, Department of Expenditure Notification dated 29rd August, 2008 refers)
3	When were the guidelines on NFU issued by DOPT?	DOPT have issued instructions on grant of officers of Organized Services in OM No. 14017/64/2008-Estt.(RR) dated 24th April, 2009.
4	To whom the instructions are applicable?	NFU is applicable to the officers of Organized Group A services in PB-3, PB-4 and in HAG scale also where there is such a Grade in the Service
5	From which date the grant of NFU to officers of Organized group A services is to be made?	The benefit is based on the recommendations of 6th CPC and will be available w.e.f the date of posting of IAS officers in various grades on/after 01.01. 2006.
6	What are the eligibility conditions to be met for grant of NFU?	The terms and conditions for grant of NFU are prescribed in the Annexure to the OM dated 24.4.2009. As per the same all the eligibility criteria and promotional norms including ‘benchmark’ for upgradation to a particular grade pay would have to be met at the time of screening for grant of higher pay scale under these orders.
7	What is the definition of the term ‘Batch’?	For the purpose of grant of NFU the ‘Batch’ for direct recruit officers in the induction grade shall be the year following the year in which competitive exam was held. In subsequent grades the ‘Batch’ would remain the same provided the officer is not superseded due to any reason. In case an officer is superseded the officer would be considered along with the ‘Batch’ with which his seniority is fixed.
8	Where the entry of officers in Organized Group A Service by DR is at STS, JAG level, how the ‘Batch’ shall be reckoned?	In respect of officers entering Organized Group A service by DR at STS, JAG level, they shall be assigned the benefit of ‘Batch’ corresponding to the ‘Batch’ of the officers with whom the seniority is clubbed.
9	Whether the benefit is available to Group B officers inducted into the Organized Group A service?	Yes. Such officers shall b assigned the benefit of ‘Batch’ corresponding to the batch of the ‘direct recruit’ officers with whom their seniority is clubbed.
10	Whether the officers can exercise option regarding date of fixation in the higher scale as provided in CCS(RP) Rules?	Provisions of CCS(RP) Rules, 2008 will apply.
11	Whether retired employees are eligible for the benefit of NFU?	Retired officers who are other wise eligible as on due date shall be considered for the benefit of pay upgradation.
12	Whether the scheme is applicable to Scientists, Doctors, etc. who are covered by their own in-situ promotion schemes?	Non-Functional Upgradation and other in situ promotion schemes are separate schemes and it would not be desirable to mix one with the other. The benefit of NFU to Organized Group A Services shall not be applicable to the officers in those Organized Services where FCS and DACP Schemes are already operating and where officers are already separately covered by their own in-situ Career Progression Schemes.
13	Whether DOPT OM dated 13.4.2010 on communication of ACR prior to 2008-09 is applicable while considering cases for NFU?	The instructions issued in this Department’s OM dated 13.4.2010 on communication of ACRs prior to 2008- 09 shall be applicable for considering cases of NFU also.
14	What is the due date of upgradation if found unfit on the date assigned to a batch?	If an officer is not found eligible during a vacancy year and is found fit in the next vacancy year, NFU may be granted from the 1st April. i.e. the 1st day of the next vacancy year.
15	How to consider cases where the officers do not meet the qualifying service in the vacancy year in which the batch is covered for non functional up gradation?	If an officer does not meet the eligibility requirement as on the 1st January of the corresponding vacancy year then such officer is to be considered for grant of NFU in subsequent vacancy year on completion of qualifying service w.e,f. 1st April, i.e. 1st day of the next vacancy year .
16	How the NFU shall be given in respect of officers given penalty?	The NFU becoming due after the expiry of the penalty period may be granted w.e.f. the due date as per DOPT instructions. In respect of officers for whom NFU becomes due before the expiry of the penalty period, the same may be granted from the day next to the date on which penalty gets over.
17	Whether the instructions regarding counting of past Group A service at the time of lalteral entry on DR basis to higher grades as per DOPT OM dated 1.9.98 shall be applicable for grant of NFU also?	In view of the provisions on meeting the prescribed eligibility criteria and promotional norms in DOPT OM dated 24.4.09. these instructions shall be applicable for the purpose of grant of NFU also.

Subject : Sanctioned Strength, incumbency, vacancy in the grade of UDCs of CSCS — reg.

Central Secretariat Clerical service consists of the grades of Upper Division Clerks (UDCs) and Lower Division Clerks (LDCs). Overall sanctioned strength of UDCs and LDCs is 3681 and 2252 respectively. Both the grades are, however, decentralized.

2. In pursuance to the recommendation of the Cadre Restructuring Committee of CSS, it was decided by the Cabinet in 2003 to discontinue direct recruitment of LDCs. The necessary order in this regard was issued on 20.4.2005 through which direct recruitment to the post of LDCs in CSCS was discontinued. All the Cadre Units of CSCS were requested to issue the necessary orders for abolition of all the vacant posts in the LDC grade of CSCS as on 3.10.2003, falling under direct recruitment quota (80% on the basis of competitive examination held by the SSC and 5% on the basis of selection made by the SSC from amongst outstanding sportsmen). As regards, the posts falling vacant on and after 3.102003, 85% of all such vacant posts were to be abolished in each select list year.

3. Though the cadres of UDCs and LDCs are decentralized, the overall control of the cadre lies with this department. However, the updated data about the sanctioned strength, incumbency position, vacancy etc. are not readily available with the department. It need not be emphasized that the said data is of utmost importance for formulation and implementation of any policy or plan with respect to the cadres.

4 In view of the above, the Cadre Units are requested to furnish the necessary details about the sanctioned strength, incumbency position, vacancy in the grade of UDCs as on 1.7.2012 as under :-

The Parliamentary Committees on “Welfare of Scheduled castes, Scheduled Tribes” and “Welfare of Other Backward Classes” are deliberating on the issue of representation of SCs, STs and OBCs at higher positions in the Central Government. The Committees have asked DOPT to furnish details of officers holding senior positions in the Central Government. Such type of information as well as information about Persons with Disabilities (PWD) and persons belonging to minority community is also sought for through variousParliament Questions.

2. In view of the above, it has been decided to collect the said information in the Central Government All Ministries / Departments are, therefore, requested to furnish the detail of officers at higher positions in the enclosed prescribed proforma to this Department latest by 31st July, 2012.
