<h4 class="wp-block-heading">5.15 Item No.NC-48/9/21: Grant of Compassionate Allowance to the widows of Employees dismissed/removed from service. (D/ o P&amp;PW).</h4>



<p>Explaining the issue, Secretary, D/ o P&amp;PW, explained that the CCS(Pension) Rules, 1972 provide for payment of Compassionate Allowance to employees dismissed or removed, if the case deserves special consideration. Cases in which the widows of employees, dismissed and removed, have applied for Compassionate Allowance which has not been considered on the ground that there is no such provision in Rule 41 of CCS(Pension) Rules, 1972. Compassionate Allowance may be sanctioned to widows of the dismissed and removed employees on humanitarian grounds, in cases where such an employee has rendered more than 10 years qualifying service before dismissal/ removal. He also stated that an amendment in CCS (Pension) Rules is under consideration, wherein it is proposed that Disciplinary Authority may examine every case, and make a decision regarding grant of Compassionate Allowance, within three months after the date of issue of the order imposing the penalty of dismissal or removal from service. A provision in the Rules to also consider past cases (which were not considered earlier) within a period of 3 months from the date of notification of the revised Rules is also under consideration.</p>



<p>Shri C. Sri Kumar, member, Staff Side, specifically mentioned the cases of those deceased employees, whose applications remain undecided, and whose widows may be considered for a grant of Family Pension.</p>



<p><strong>Decision: The chairman directed D/ o P&amp;PW to take a decision in the matter at the earliest, and then the item may be treated as closed.</strong></p>





<p>(i) A Government servant who is dismissed or removed from service shall forfeit his pension and gratuity:</p>



<p>Provided that the authority competent to dismiss or remove him from service may, if the case is deserving of special consideration, sanction a compassionate allowance not exceeding two-thirds of pension or gratuity or both which would have been admissible to him if he had retired on compensation pension.</p>



<p>(ii) A compassionate allowance sanctioned under the proviso to sub-rule (i) shall not be less than Rs. 9,000/- p.m.</p>

<p>Subject- <strong>Treatment/ regularization of hospitalization/quarantine period during COVID-19 Pandemic &#8211; regarding.</strong></p>



<p>This Department has been receiving several references/queries requesting clarification relating to the treatment of the hospitalization/ quarantine period during the COVID-19 pandemic. The matter has been considered and keeping in view the hardships faced by the Government servants, it has been decided to treat the period of absence, in relaxation of CCS (Leave) Rules, 1972, as under:-</p>

No.</strong></th><th><strong>Situation</strong></th><th><strong>Treatment of period of absence</strong></th></tr></thead><tbody><tr><td></td><td></td><td></td></tr><tr><td>(1)</td><td>When the Government servant himself is COVID Positive and 1s m home isolation/quarantine</td><td>(i) Shall be granted Commuted Leave up to 20 days, if due and admissible, without Medical Certificate, on mere production of his COVID positive report.(ii) If Commuted Leave is not available, he shall be granted Special Casual Leave (SCL) for 15 days, followed by Earned Leave (EL) or Half Pay Leave (HPL) of 5 days and, in case of EL/HPL is also not available, he shall be given Extra Ordinary Leave (EOL) without insisting on production of Medical Certificate, and the period shall also be counted for qualifying service.</td></tr><tr><td>(2)</td><td>When the Government servant himself is COVID positive, and is in home isolation and has also been hospitalized.</td><td>(i) Shall be granted Commuted Leave/SCL/EL for a period up to 20 days starting from the time having tested COVID positive, if the period of home quarantine/ discharge from hospital falls within 20 days, as per SI.No. 1 above.(ii) In case of hospitalization beyond the 20th day from his testing COVID positive, he shall be granted Commuted leave, on the production of documentary proof of hospitalization.(iii) If, however, after discharge from the hospital, the Government servant is required to remain at home for post-COVID recovery, he may be granted leave of any kind due and admissible to him, with the approval of the concerned Competent Authority. as per the CCS (Leave) Rules, 1972. It is only when the Commuted Leave is not available to the credit of the Government servant that SCL of 15 days or EL or EOL shall be considered.</td></tr><tr><td>(3)</td><td>When a dependent family member of Government servant is COVID positive or parents whether dependent or not, living with him are COVID positive.</td><td>(i) Shall be granted SCL of 15 days on production of COVID- positive report of dependent family member/parents. (ii) In case of active hospitalization of any of the family member/ parents even after 15 days of the expiry of SCL, the Government Servant may be granted leave of any kind due and admissible beyond 15 days of SCL till their discharge from hospital. After discharge from the hospital of dependent family member/parents, if the Government servant wishes to avail further leave, he shall be considered for the leave due and admissible as per the CCS (Leave) Rules, 1972, subject to functional requirements and sanction of leave by the Competent Authority. The Competent Authority is advised to take a liberal view in such cases and its decision in the matter shall be final.</td></tr><tr><td>(4)</td><td>When the Government Servant comes into direct contact with a COVID-positive person and remains in Home Quarantine.</td><td>He shall be treated as on duty/ Work from Home for a period of seven days. For any period beyond that, his attendance shall be regulated as per the instructions given by the Ministry/ Department/ Office concerned , where he is working.</td></tr><tr><td>(5)</td><td>The period of Quarantine spent by Government servant, as a precautionary measure, residing in the Containment Zone.</td><td>He shall be treated as on-duty / Work from Home till the Containment Zone is de-notified</td></tr></tbody></table></figure>



<p>2. These orders shall be applicable w.e.f. 25.03.2020 and shall continue until further orders. The past cases, wherever settled, shall be re-opened if the same is beneficial to the Government servant, and where he makes a request in writing for review.</p>

<h3 class="wp-block-heading">Subject: Order of Hon&#8217;ble Supreme Court of India dated 05.03.2020 in SLP (C) No.21803/2014 Uol Vs. M.V. Mohanan Nair &amp; Ors. regarding benefits in the promotional hierarchy under MACP Scheme &#8211; other issues arising out of Order dated 05.03.2020 &#8211; regarding.</h3>



<p>The undersigned is directed to refer to this Department’s O.M. of even number dated 23.03.2020, which was issued as per Order dated 05.03.2020 of the Hon’ble Supreme Court of India in SLP (C) No.21803/2014, UoI Vs. M.V. Mohanan Nair &amp; Others wherein the Hon’ble Apex Court had held that benefits under the Modified Assured Career Progression Scheme (MACPS)&nbsp;<strong>cannot</strong>&nbsp;be granted in the promotional hierarchy and that it would be in the standard hierarchy of Grade Pay/Pay Levels in the Pay Matrix as per the existing MACP guidelines.</p>



<p class="has-text-align-center"><strong><a href="https://centralgovernmentnews.com/macp-on-promotional-hierarchy-macp-supreme-court-order-heard-reserved-ord-dates-23-jan-2020/" target="_blank" rel="noreferrer noopener">MACP ON PROMOTIONAL HIERARCHY &#8211; MACP Supreme Court Order &#8211; Heard &amp; Reserved &#8211; Order dated 23 Jan 2020</a></strong></p>



<p><strong>2. The Hon’ble Apex Court, in para 53 of aforementioned Order dated 05.03.2020, further directed that some anomalies, which were brought before the Joint Committee, constituted in the Department of Personnel &amp; Training (DoP&amp;T) to examine the MACPS, as indicated in paras 47 to SO of the Order dated 05.03.2020, be considered as deemed appropriate, and a decision was taken in accordance with the law.</strong></p>



<p>3. Accordingly, in compliance with the directions of Hon’ble Apex Court, as indicated in paras 47 to 50 of the Order dated 05.03.2020, the issues arising out of deliberations of the Joint Committee constituted to examine the MACP Scheme, and which were not finally disposed of, have been examined in consultation with Department of Expenditure. It is also to be noted that revised guidelines on MACPS, as per recommendations of the <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/">7th</a><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener"> </a><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/">CPC</a></strong>, have been issued vide&nbsp;DoP&amp;T’s OM No.35034/3/2015-Estt.(D) dated 22.10.2019.</p>



<p>4. The decisions taken on these issues, item-wise, are as follows:</p>



<p><strong>Item No. 1:</strong>&nbsp;To provide Grade Pay of the next promotional post under the MACPS (Item No.1 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Item No. 2:</strong>&nbsp;Anomaly on the introduction of the MACPS &#8211; Option may be given to the employees to continue in the old ACP Scheme even after 01.09.2008 (Item No. 8 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Item No. 3:</strong>&nbsp;Continuation of the ACP Scheme beyond 31.08.2008 by giving an option to choose either benefit under the ACPS or the MACPS, whichever is more beneficial (Item No.3 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Decision:</strong>&nbsp;The issue of grant of benefits in the standard hierarchy of Grade Pays/Pay Levels as per the MACPS guidelines has already been settled by the Hon’ble Apex Court in its Order dated 05.03.2020. Moreover, the matter of replacement of the ACPS with MACPS has also been settled by the Apex Court. As such, as clarified to the staff side vide letter dated 4.11.2013, the solution lies in cadre review to address issues relating to stagnation. Therefore, the demands of the Staff Side for grant of benefits in the promotional hierarchy or continuation of the ACPS beyond 31.08.2008 by giving the option to either choose between ACPS or MACPS, whichever is more beneficial;&nbsp;<strong>cannot</strong>&nbsp;be agreed to. Hence, action on these items is treated as&nbsp;<strong>closed</strong>.</p>



<p><strong>Item No. 4:</strong>&nbsp;Revision of date of introduction of the MACPS (Date of Effect) &#8211; Date of effect of the MACPS to be made as 01.01.2006, instead of 01.09.2008 as provided in the scheme (Item No.2 of Minutes of the meeting of Joint Committee held on 27.07.2012).</p>



<p><strong>Decision:</strong>&nbsp;The issue is presently sub-judice before the Hon’ble Apex Court in SLP Nos. 10811- 10813/2018 in the matter of Uol Vs. Ranjit Samuel. Hence, no decision can be taken at this stage. As and when the main and tagged cases are disposed of by the Hon’ble Apex Court, the decision would be communicated to all Ministries/ Departments.</p>



<p><strong>Item No. 5</strong>: Applicability of the MACPS to Group ‘D’ employees who have been placed in the Grade Pay of Rs.1800/- in PB-I (Item No.4 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Decision</strong>: It has been clarified in DoP&amp;T’s O.M. No.35034/3/2008-Estt.(D) dated 16.11.2009 that promotions earned or upgradations granted under the ACP Scheme of August 1999, in the past to four pay scales (S-1, S-2, S-2A, and S-3), which now carry the grade pay of Rs.1800/-, shall be ignored for the purpose of the MACPS. Therefore, no further action is required. Hence, the item is treated as&nbsp;<strong>closed</strong>.</p>



<p><strong>Item No. 6:</strong> Counting of 50% of service rendered by casual labor who attained a temporary status for reckoning the 10, 20, and 30 years of service under the MACPS (Item No.5 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Decision</strong>: As per para 5(v) of the Appendix pertaining to the Casual Labourers (Grant of Temporary Status and Regularization) Scheme, 50% of the service rendered under temporary status is to be counted only for the purpose of retirement benefits after their regularization. The temporary service rendered does not count for any other purposes. Moreover, under the ACPS also, no provision was made for counting of temporary service as 1st and 2nd financial upgradation was being granted to an employee on completion of 12/24 years of regular service. Therefore, the proposal cannot be agreed to. Thus, action on this item is treated as&nbsp;<strong>closed</strong>.</p>



<p><strong>Item No. 7</strong>: Supervised staff placed in higher Grade Pay than that of the Supervisor &#8211; The stepping up of pay of seniors with that of juniors getting higher pay in different cadres and introduction of Grade Pay of Rs.5400 on completion of 4 years of service in the pre-revised pay scale of Rs.6500-10500 (Item No.6 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Decision</strong>: As per the fundamental principles of the Scheme, financial upgradation granted under the MACPS is purely personal to the employees, and has no relevance to his seniority position. It has already been provided in the Scheme itself that there shall be no additional financial upgradation to the senior employee solely on the ground that his/her junior in the grade has been granted higher pay or grade pay under the Scheme. This has been reiterated in the instructions issued by this Department from time to time, including OM No. 35034/1/97-Estt. (D) dated 04.10.2012 and No. 35034/3/2015-Estt.(D) dated 22.10.2019. Therefore, the proposal cannot be agreed to. Thus, action on the item is treated as&nbsp;<strong>closed</strong>.</p>



<p><strong>Item No. 8</strong>: Option for pay fixation on grant of financial upgradation under the MACPS between 01.01.2006 and 31.08.2008 (Item No.7 of Minutes of the meeting of Joint Committee held on 15.09.2010).</p>



<p><strong>Decision</strong>: In terms of para 9 of the MACPS guidelines (DoP&amp;T’s OM dated 19.05.2009), the benefits of the ACP Scheme of August 1999 would be continued I applicable till 31.08.2008. If the Government employees, who have opted for fixation of their pay in the revised pay structure w.e.f. 01.01.2006 under the CCS (RP) Rules, 2008, then no arrears of pay would be granted. However, if he has opted for pay fixation from the date of financial upgradation under the ACP with reference to the pre-revised pay scale, then arrears of pay would be granted from the date of his option, i.e., the date of financial upgradation under the ACPS. Para 6 of Annexure-I to DoP&amp;T’s OM dated 19.05.2009 already provides for this benefit. Hence, there is no requirement for the issue of any further instructions on the said issue. Thus, the item is treated as<strong>&nbsp;closed</strong>.</p>



<p><strong>Item No. 9</strong>: Employees who got one promotion or l51 ACP prior to 01.09.2008 and have completed over two decades of service without the benefit of promotion may be granted the third up-gradation under the MACPS on 1.9.2008 (Para 12 of Minutes of the meeting of Joint Committee held on 27.07.2012).</p>



<p><strong>Decision</strong>: As per the MACPS guidelines, there shall be three financial upgradations under the MACPS, counted from the direct entry grade on completion of I 0, 20, and 30 years of service respectively, or after 10 years of continuous service in the same Grade Pay or Pay Level in Pay Matrix, whichever is earlier. Thus, those employees who got either one promotion or 1st ACP before 1.1.2006 and who did not earn any promotion or 2nd ACP during 1.1.2006 to 31.8.2008, are eligible for 2nd MACP on or after 1.9.2008 (i.e. due on completion of 20 Years) and 3rd MACP after 30 years of service or 10 years in the same Grade Pay/Pay Level, as the case may be if found otherwise eligible. Hence, there is no ground for the grant of the 3rd MACP straight away on 1.9.2008, without the employee earning the 2nd MACP, as per the provisions of the MACPS. Therefore, the request of the Staff Side cannot be acceded to and the item is treated as&nbsp;<strong>closed.</strong></p>



<p>7. All Ministries/Departments are advised to dispose of all pending representations /references from Staff Associations etc. seeking revision in the instructions/guidelines on the MACPS relating to the above items and also defend the various pending Court Cases or to take immediate suitable action for appealing against such judgments which are contrary to the existing policy, as upheld by the Hon’ble Apex Court in the instant case.</p>

<h4 class="wp-block-heading">Subject: Cadre review of &#8216;B&#8217;, &#8216;C&#8217; and erstwhile &#8216;D&#8217; Groups &#8211; regarding.</h4>



<p>Department of Personnel &amp; Training is the nodal department for personnel policies. While the responsibility for laying down standards in Cadre Management along with cordinations, rests with this Department, it is primarily the responsibility of the Cadre Controlling Authority (CCA) to undertake the Cadre Management of the Services/cadres under their control.</p>



<p>2. One of the important functions of&nbsp;DoPT&nbsp;is the periodic review of the cadre structure of Group ‘A’ Central Services. The ideal periodicity of cadre review is 5 years. However, the function of the review of the Group ‘B’/‘C’ and erstwhile ‘D’ was delegated by DoPT vide OM No. 2/1/1987 dated 23.11.1987 to the respective CCA with prescribed guidelines (copy enclosed).</p>



<p>3. In order to streamline the cadre review within the stipulated period, and for facilitating the pending cadre reviews, a Calendar for cadre review of Central Group ‘A’ Services was issued on 12.02.2021. Besides adhering to the prescribed timeline for Group ‘A’ Central Services, CCAs are also requested to undertake timely cadre review of Group “B’ and ‘C” cadres, wherever due, as per the existing guidelines, in consultation with Department of Expenditure.</p>



<p>4. An action taken report/status report of the cadre review(s) under the Ministry/Department may kindly be forwarded to this Department by 30.04.2021.</p>

<h3 class="wp-block-heading">Subject: Amendment of Para 5 of consolidated guidelines on deputation issued vide OM No.6/8/2009-Estt.(Pay-II) dated 17.06.2010 according to 7th CPC pay structure &#8211; regarding.</h3>



<p>Department of Personnel and Training’s OM No.6/8/2009-Estt. (Pay-II) dated 17th June 2010 regulates the Pay, Deputation (Duty) Allowance, Tenure of Deputation/Foreign Service and other terms and conditions of deputation/foreign service of Central Government Employees to ex-cadre posts under the Central Government, State Governments, Public Sector Undertakings, Autonomous Bodies, Universities, Union Territories Administration, Local Bodies, etc. and vice-versa. Subject to its applicability as provided in para 2 of the OM, these instructions cover cases of deputation/foreign service where Central Government is an either lending authority or borrowing authority, or both.</p>



<p>2. Para 5 of aforesaid OM dated 17th June 2010 provides the method of pay fixation on deputation from Central Government to Central Government, in foreign service/ Reverse Foreign service.</p>



<p>3, Consequent to the implementation of the recommendations of the <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th Central Pay Commission</a></strong>, it has been decided to amend the provisions of Para 5 of this Department’s OM No.6/8/2009-Estt. (Pay-II) dated 17th June 2010 with following paras:-</p>



<h3 class="wp-block-heading">7th CPC Pay Fixation on Deputation: DoP&amp;T OM dated 02.03.2021</h3>



<p><strong>“5. Pay fixation</strong></p>



<p><em>5.1 When an employee on deputation/ Foreign Service elects to draw pay in the Level (in Pay Matrix) attached to the ex-cadre post, his/her pay may be fixed as under: &#8211;</em></p>



<p><strong><em>(i)&nbsp;Deputation from Central Government to Central Government</em></strong></p>



<p><em>If the Level (in Pay Matrix) of the ex-cadre post is higher than that of the parent cadre&nbsp;</em><em>post, an increment shall be given in the Level (in Pay Matrix) of parent cadre post and&nbsp;</em><em>he/she shall be placed at a Cell equal to the figure so arrived at in the Level (in Pay&nbsp;</em><em>Matrix) of the ex- cadre post; and ifno such Cell is available in the Level (in Pay Matrix)&nbsp;</em><em>of the ex-cadre post, he/she shall be placed at the next higher cell in that Level.</em></p>



<p><em>In case Levels (in Pay matrix) of the ex-cadre post and the parent cadre post of the&nbsp;</em><em>employee are identical, the employee would continue to draw his/her basic pay.</em></p>



<p><em>The basic pay from time to time after pay fixation should not exceed the maximum&nbsp;</em><em>of the pay in the level of the ex-cadre post.</em></p>



<p><strong><em>(ii) In foreign service/ Reverse Foreign Service</em></strong></p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><em>(a) When the Level (in Pay Matrix)/ Pay Scale of the post in the parent cadre and that attached to the </em>ex-cadre post are based on the same index level and the DA pattern is also the same, the pay may be fixed as under (i) above.</p><p>(b) If the appointment is made to a post whose pay structure and/ or Dearness Allowance (DA) pattern is dissimilar to that in the parent organisation, pay may be fixed by adding one increment to the basic pay of the substantive post in the parent cadre, (and if he/she was drawing pay at the maximum of the scale, by the increment last drawn) and equating the pay so raised plus dearness allowance (and additional or ad-hoc dearness allowance, Interim relief, etc., if any) with emoluments comprising of basic pay plus DA, ADA, Interim Relief,<em> etc., if any, admissible, in the borrowing organisation and the pay may be fixed at the stage in the Pay Scale/ Level (in Pay Matrix) of the ex-cadre post at which total emoluments admissible in the ex-cadre post as above equal the emoluments drawn in the cadre and if there is no such stage, pay may be fixed at the next higher stage.</em></p></blockquote>



<p><em>In case of reverse foreign service if the appointment is made to post whose pay structure&nbsp;</em><em>and/or DA pattern is dissimilar to that in the parent organization, the option for electing&nbsp;</em><em>to draw the basic pay in the parent cadre [along with the Deputation (Duty) Allowance&nbsp;</em><em>thereon and the personal pay, if any] will not be available to such employee. It is also&nbsp;</em><em>clarified that Terms and Conditions in case of appointment on deputation made prior&nbsp;</em><em>to 1.7.2017 shall be continued as per the mutually agreed terms and conditions already&nbsp;</em><em>set.</em></p>



<p><em>(c) The basic pay from time to time after pay fixation should not exceed the&nbsp;</em><em>maximum of the pay in the level of the ex-cadre post.</em></p>



<p><em>5.2 Incases of appointment from one ex-cadre post to another ex-cadre post where the employee opts to draw pay in the Level (in Pay Matrix)/ Pay Scale of the ex-cadre post, the pay in the second or subsequent ex-cadre post should be fixed under the normal rules with reference to the pay in the cadre post only. However, in respect of appointments to ex-cadre posts carrying Level (in Pay Matrix)/Pay Scale identical to that of the ex-cadre post(s) held on an earlier occasion(s), it may be ensured that the pay drawn in subsequent appointment should not be less than the pay drawn earlier.</em></p>



<p><em>5.3 Incases of appointments to a second or subsequent ex-cadre post(s) in a higher Level (in Pay Matrix)/Pay Scale than that of the previous ex-cadre post, the pay may be fixed with reference to the pay drawn in the cadre post and if the pay so fixed happens to be less than the pay drawn in the previous ex-cadre post, the difference may be allowed as personal pay to be absorbed in future increases in pay. This is subject to the condition that on both the occasions, the employee should have opted to draw pay in the Level (in Pay Matrix)/Pay Scale attached to the ex-cadre posts.”</em></p>



<p>4. These orders will take effect from 1.1.2016 and shall be applicable to all officers who were on deputation on 1.1.2016 or appointed thereafter except for the revised rates of Deputation (Duty) Allowance which shall be applicable from 01.07.2017.</p>



<p>5. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders will apply for deputation outside Indian Audit and Accounts Department as concurred in by the Comptroller and Auditor General of India.</p>

<p>Subject:- <strong>Clarification on regularization of absence during COVID-19 pandemic lockdown period &#8211; regarding.</strong></p>



<p>This Department has been receiving several references requesting for clarification relating to the regularization of absence during the COVID-19 epidemic lockdown period.</p>



<ol class="wp-block-list" start="2"><li>In this regard, it is stated that this Department has already issued a clarification on regularization of absence during <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19 </a></strong>lockdown period vide DoPT&#8217;s OM no. 14029/5/2020-Estt.(L)(pt.) dated 28.07.2020 (copy enclosed).</li><li>It is further clarified that this Department&#8217;s OM dated 28.07.2020 has been issued in view of the circumstances that the country is going through due to COVID-19 situations and the unavoidable problems faced by the Government employees in different sectors under the Government of India. A general terminology has been adopted to cover all kinds of problems faced by the employees due to the COVID-19 situation. The said OM may not touch all specific circumstantial problems faced by all employees under the Government of India; however, an interpretation of such circumstances in congruence with the clarification made in the above OM is adaptable.</li><li>Therefore, all Ministries / Departments may examine cases relating to regularization of absence during the COVID-19 lockdown period in the light of this Department&#8217;s <strong><a href="https://centralgovernmentnews.com/regularization-of-absence-during-covid-19-epidemic-lockdown-period-latest-dopt-order/" target="_blank" rel="noreferrer noopener">OM dated 28.07.2020</a></strong> referred to above and the guidelines issued by the Ministry of Health and Family Welfare and Ministry of Home Affairs from time to time.</li></ol>

<h3 class="wp-block-heading">Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 Fulfillment of procedural requirements clarification reg.</h3>



<p>The undersigned is directed to refer to para (c) of this Department’s O.M. of even number dated 09.02.2017 on the subject noted above regarding reimbursement in cases where a Government servant travels on <a href="https://centralgovernmentnews.com/category/ltc/" target="_blank" rel="noreferrer noopener">LTC</a> up to the nearest airport/ railway station/ bus terminal by authorized mode of transport and undertakes rest of the journey to the declared place of visit by private transport/ own arrangement (such as a personal vehicle or private taxi etc.).</p>



<p><strong>2. Para (c) of the aforesaid O.M. provides as under:</strong></p>



<p>“(c) In case, there is no public transport available in a particular stretch of journey, the Government servant may be reimbursed as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/ personal transport based on a self-certification from the Government servant. Beyond this, the expenditure shall be borne by the Government servant”.</p>



<p>3. With regard to the above provision, many references are received in this Department seeking following clarifications:-</p>



<p><a href="https://centralgovernmentnews.com/special-cash-package-equivalent-in-lieu-of-ltc-fare-for-central-government-employees-during-the-block-2018-2021/"><strong>Special cash package equivalent in lieu of LTC fare for central government employees during the Block 2018-2021</strong></a></p>



<p>(i) Whether the 100 Kms limit specified in DoPT’s O.M. No. 31011/3/ 2015-Estt.A-IV dated 09.02.2017 is for the whole journey (i.e. to and fro combined) or separately for onward and return journey, i.e. 100 Kms for onward and 100 Kms for return journey?</p>



<p>(ii) How assistance shall be provided in cases where various members of a family avail LTC separately and thus avail the facility of private taxi/ transport separately? Whether in such cases also reimbursement as above shall be provided individually to each family member?</p>



<p>4. The matter has been considered in this Department and it is clarified that the 100 Kms limit as prescribed in DoPT’s O.M. No. 31011/3/ 2015-Estt.A-IV dated 09.02.2017 is to be seen from one side. Hence, for the to and fro journey, the fare reimbursement shall be provided for a total of 200 Kms (100 Kms each side).</p>



<p>5. As regards the second situation described in para 3(ii) above, it is stated that in cases where members of the family avail LTC separately, they shall also be eligible for reimbursement of taxi fare/ private transport separately as per DoPT’s O.M. No. 31011/ 3/ 2015-Estt.A-IV dated 09.02.2017.</p>

<p><strong>Subject: Digitalisation of APARs in respect of CSS officers.</strong></p>



<p>e-HRMS, an online platform was launched for central government employees as part of good governance, to furnish a comprehensive view of the human resource deployed by the Government, so that all processes of personnel management from hiring to retiring will be on digital platform and manual system of handling personnel matters will be dispensed with.</p>



<p>2. In order to fulfil the objectives of the e-HRMS, a total of 20 modules have been developed so far for various service related activities. SPARROW (Smart Performance Appraisal Report Recording Online Window) is one of the applications, which will be merged in the eHRMS.</p>



<p><strong><a href="https://centralgovernmentnews.com/reviewing-annual-performance-assessment-report-apar-of-group-a-b-and-c-officer-of-central-civil-services-during-the-current-the-year-2020-21-by-officers-retiring-from-30-06-2020-to-31-10-2020/" target="_blank" rel="noreferrer noopener">Reviewing Annual Performance Assessment Report APAR of Group A, B and C officer of Central Civil Services during the current the year 2020-21, by officers retiring from 30.06.2020 to 31.10.2020</a></strong></p>



<p>3. In order to bring all the physical <strong><a href="https://centralgovernmentnews.com/tag/apars/" target="_blank" rel="noreferrer noopener">APARs</a></strong> of CSS officers into the online SPARROW system, it has been decided to digitalize the APARs of CSS officers and migrate them into <a href="https://centralgovernmentnews.com/tag/sparrow/" target="_blank" rel="noreferrer noopener">SPARROW</a> portal in a phased manner. The APARs of US and above are already available in CS-I Division, whereas the APAR dossiers of ASO and SOs are maintained in respective cadre units.</p>



<p>4. The legacy APARs of US and above officers are already being digitized. In the next stage, APARs of SOs will be taken up for digitization. As a part of this activity, in the first instant APARs of the senior most SOs belonging to Select List 2011 and 2012 and earlier SLs will be taken up.</p>



<p>5. Hence, all the cadre units are requested to send the APAR dossiers of the SOs of SL 2011 and 2012 &amp; earlier SLs, if any, within 5 working days from the issue of this O.M. to CS-I Division to enable the digitization of their APARs.</p>

<p>An appeal issued by Department of Ex-Servicemen Welfare, Ministry of Defence for contributions to AFFDF is forwarded. The Armed Forces Flag Day is observed on 7th December every year to honour martyrs and men in uniform who fought bravely not only to protect the borders of our nation but also fight terrorism and insurgency. On this day, donations are collected from the general public for AFFDF which are used for the welfare and rehabilitation of war widows, dependents of the martyrs and ESM including the disabled.</p>

<p>The Department of Ex-Servicemen Welfare, Ministry of Defence has been working for the welfare and rehabilitation of war widows, wards of martyred soldiers and ESM including disabled by providing financial assistance for their identified personal needs such as penury grant, children’s education grant, funeral grant, medical grant and orphan /disabled children grant. This financial assistance is provided out of the Armed Forces Flag Day Fund (<strong>AFFDF</strong>) which contributions are received from the general public on the Armed Forces Flag Day (<strong>AFFD</strong>) which is celebrated on 7th December every year. Efforts are required to increase the contribution to the Armed Forces Flag Day Fund to meet the increasing requirement of financial assistance for our ex-servicemen, their wards and war-widows.</p>
