<p><span style="text-decoration: underline;"><strong>NOTIFICATION</strong></span></p>
<p style="text-align: right;">New Delhi, the 10th October, 2013</p>
<p>G.S.R… (E) – In exercise of the powers conferred by the proviso to clause (3) of article 320 of the Constitution, the President hereby, makes the following regulations further to amend the Union Public Service Commission (Exemption from Consultation) Regulations, 1958, namely:-</p>
<p>1. (i) These regulations may be called the Union Public Service Commission (Exemption from Consultation) Second Amendment Regulations, 2013.</p>
<p>(ii) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Union Public Service Commission (Exemption from Consultation) Regulation, 1958, in the Schedule-II, after item 7 and the entries relating thereto, the following shall be added, namely:-</p>
<p>8. “Recruitment as may be made at any time within a period of three years to the post of Deputy Superintendent of Police in the Central Bureau of Investigation under the Ministry of Personnel, public Grievances and Pensions, the Department of Personnel and Training”.</p>

<p>The undersigned is directed to refer to DOPTs OM of even number dated 26th July, 2013 vide which preferences of postings were sought from cadre units in respect of successful candidates of LDCE 2009, 2010 and 2011.</p>
<p>2. Out of 874 qualified candidates for LDCE 2009, 2010 and 2011, 111 are Personal Assistants of CSSS Cadre. It has come to the notice of this Department that many of these officers have already been included in the Select List of Private Secretary for the year 2010 against Seniority Quota and many are likely to be included in the Select List of Private Secretary for the year 2011 against Seniority Quota. There is a likelihood that many of these officers may refuse promotion in the grade of Section Officer.</p>
<p>3. Subject: <strong>Children Education Allowance &#8211; Reimbursement of Examination Fee</strong></p>
<p>Subsequent to issue of Department of Personnel &amp; Training’s O.M.No.12011/03/2O08-Estt.(Allowance) dated 2nd September, 2008, and subsequent clarifications issued from time to time on the subject cited above, a number of references have been received on reimbursement of &#8216;examination fee&#8217;. After due consideration of the references, in consultation with the Ministry of Finance, Department of Expenditure, it has been agreed to allow reimbursement of &#8216;examination fee&#8217; as part of reimbursable items as indicated in para 1(e) of O.M. dated 2nd September, 2008, with effect from the current academic year, subject to the fulfillment of other existing conditions.</p>
<p>2. In so far as persons working n the Indian Accounts and Audit Departments are concerned, these orders issue in consultation with Comptroller and Auditor General of India.</p>

<p>The undersigned is directed to refer to this Department’s O.M. No.32/1/2012-Welfare dated 31.1.2013 on subject noted above. In view of the several complaints being received from altottee residents of Panchkuian Road regarding non-enrollment of his/her names as Members of RWA. directions were issued to Shri Roop Lal in the meetings held by JS&amp;CWO to resolve the matter. However, he has failed to comply with the instructions of this Department and has not offered convincing explanation for denial of membership to some of the complainants who are said to have approached Shri Roop Lal for granting Membership in the RWA. The dissatisfied allottee residents have approached senior officers to obtain redressal.</p>
<p>2. In view of the position explained above, it has been decided by the competent authority to terminate the services of Shri Roop LaI as Area Welfare Officer for Panchkuian Road and to assign the area of Panchkuian Road to Shri Tushar Kanti Pal, Area Welfare Officer in addition to the area already assigned to him, till nomination of a regular Area Welfare Officer.</p>

Subject: <strong>Delegation of power to relax the educational qualification for appointment in the personal staff of Union Ministers — regarding</strong></p>
<p>The undersigned is directed to refer to this Deptt’s O.M.No.8/5/98-CS.II dated 23.10.2001 wherein it is clarified that ‘the educational/skill qualification for personal staff of Ministers should be similar to the corresponding/comparable posts in the Government and as per the directions of Hon&#8217;ble Prime Minister, there will be no relaxation in the educational and skill qualification for the personal staff of Ministers.</p>
<p>2. This Department had been receiving many references from various Ministries/Departments for appointment of officials in the personal staff of Ministers in relaxation of prescribed educational qualification. In order to curb the delay in appointment of persons in the personal staff of Ministers seeking relaxation of educational qualification, the matter has been re-examined and it has been decided with the approval of Hon&#8217;ble Prime Minister to delegate the power for relaxation of educational qualification for appointment of officials in personal staff of Union Ministers as under:</p>
<p>(i) The power to relax the educational qualification for appointment as Peon in the personal staff of Union Minister is delegated to the respective Ministry.</p>
<p>(ii) The power to relax the educational qualification for appointment to posts other than Peon in the personal staff of Union Ministers has been delegated to Cabinet Secretary.</p>
<p>3. As regards para 2(ii) above, it is clarified that the Ministries/Departments are required to submit the proposal to this Department (CS-II Division) for seeking relaxation of educational qualification for appointment of officials to posts other than the post of Peon in the personal staff of Union Ministers for obtaining concurrence of Cabinet Secretary.</p>
<p>4. All the Ministries/Departments are requested to take the above mentioned guidelines into consideration before forwarding any proposal for appointment of officials in the personal staff of Ministers.</p>

<p>Reference is invited to this Department’s O.M. of even number dated 09.01.2013 and subsequent reminder dated 23rd May, 2013 on the subject mentioned above.</p>
<p>2. Ministries / Departments are well aware that the Immovable Property Returns (IPR) in respect of <a href="http://centralgovernmentnews.com/category/css/" target="_blank">CSS </a>Officers (Under Secretary and above level) are required to be furnished to this Division by 31st of January every year. However, the IPR for the year 2012 (as on 31.12.2012) in respect of several officers (annexure attached) has not yet been received by this Department.</p>
<p>3 Ministries / Departments are, therefore, requested to obtain the lPRs from the defaulting officers and forward the same to this Department immediately. Attention of defaulting officers may also be invited to this Department’s O.M. No.11012/11/2007-Estt.A dated 14.12.2007 read with 0.M. of even number dated 27.09.2011 stipulating that Group ‘A’ officers, who do not submit the property return by the prescribed time would be denied vigilance clearance for (a) empanelment (b) deputation and (c) training programmes (except mandatory training).</p>
<p>4. Submission of the IPR online. As Ministries / Departments are aware, this Department has launched the Web Based Cadre Management System for CSS Officers which is presently hosted at http://10,21.145.125 One of the modules of the system is submission of lPRs online. All CSS Officers including those who have already submitted IPR manually are once again requested to submit the complote details of Immovable Property held by them in the on line system also as requested vide O.M. dated 23.05.2013.</p>
<p>5. All Ministries / Departments are requested to bring this G.M. to knowledge of all CSS Officers under their control.</p>

Subject: <strong>Nomination of direct recruit Assistants &#8211; vacancies in Assistants’ Grade in cadre units of CSS.<br />

Nomination of successful candidates to the Assistants&#8217; Grade of Central Secretariat Service (CSS), on the basis of results of Combined Graduate Level Examination 2012 is expected very shortly, from Staff Selection Commission. These candidates will be allocated to the cadre units of <a href="http://centralgovernmentnews.com/category/css/">CSS</a> keeping in view the existing vacancies and other relevant factors. The participating Ministries and Departments are, therefore, requested to furnish the following information in respect of Assistants Grade to enable this Department to decide the allocations:-</p>
