<h3 class="wp-block-heading">Subject: Proposed nationwide protest by Confederation of Central Government Employees &amp; Workers on November 26th 2020 &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</h3>



<p>It has been brought to the notice of the Government that Confederation of Central Government Employees &amp; Workers has decided to observe&nbsp;<strong>nationwide strike on 26th November, 2020&nbsp;</strong>in order to demand related to pay, pension and service matters.</p>



<p>2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow or&nbsp; any action that abet any form &nbsp;of strike/ protest in violation of Rule 7 of the <strong><a href="https://centralgovernmentnews.com/category/ccs/" target="_blank" rel="noreferrer noopener">CCS</a></strong> (Conduct) Rules, 1964. Besides, in accordance with the&nbsp; proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed &nbsp;right to strike/ protest. &nbsp;There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which, &nbsp;besides deduction of wages, may also include appropriate disciplinary action. Kind attention &nbsp;of all employees of this Department &nbsp;is also drawn to this Department’s O.M. No. 33012 / 1/(s) / 2008-Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure -A) .</p>



<p>3. All officers are requested that the above instructions may be brought to the notice of the employees working under their All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed strike, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>

<p>Format for giving information to the applicants under RTI Act- issue of guidelines regarding.</p>

<p>Subject: <strong>Format for giving information to the applicants under RTI Act- issue of guidelines regarding.</strong></p>
<p>It has been observed that different public authorities provide information to RTI applicants in different formats. Though there cannot be a standard format for providing information, the reply should however essentially contain the following information:</p>
<blockquote><p>(i) RTI application number, date and date of its receipt in the public authority.</p>
<p>(ii) The name, designation, official telephone number and email ID of the CPIO.</p>
<p>(iii) In case the information requested for is denied, detailed reasons for denial quoting the relevant sections of the RTI Act should be clearly mentioned.</p>
<p>(iv) In case the information pertains to other public authority and the application is transferred under section 6(3) of the RTI Act, details of the public authority to whom the application is transferred should be given.</p>
<p>(v) In the concluding para of the reply, it should be clearly mentioned that the First Appeal, if any, against the reply of the CPIO may be made to the First Appellate Authority within 30 days of receipt of reply of CPIO.</p>
<p>(vi) The name, designation, address, official telephone number and e-mail ID of the First Appellate Authority should also be clearly mentioned.</p></blockquote>
<p>2. In addition, wherever the applicant has requested for ‘certified copies’ of the documents or records, the CPIO should endorse on the document “True copy of the document/record supplied under RTI Act”, sign the document with .date, above a seal containing name of the officer, CPIO and name of public authority; as enumerated below:</p>

<p><strong>Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh has said that the Union Government is in favour of doing away with the practice of holding interviews for appointment to junior level posts.</strong></p>
<p>&nbsp;</p>
<p>Presiding over a meeting of Principal Secretaries of General Administration Department (GAD)/Personnel from different States and Union Territories here today, Dr Jitendra Singh said that the Department of Personnel &amp; Training (DoPT) has initiated a serious exercise for identifying the posts for which interview for selection can be discontinued and a communique in this regard has been sent to various State Governments, State Public Service Commissions and Staff Selection Commission. He said that this follows the suggestion put forward by the Prime Minister Shri Narendra Modi during his Independence Day address to the nation from the ramparts of the Red Fort.</p>
<p>&nbsp;</p>
<p>Dr Jitendra Singh said that the government will soon identify all those posts, particularly at junior level like Group III &amp; IV, where an interview is avoidable and will stop this practice. He said, for a post for which an interview is not necessary to determine the capability of a candidate, the provision of interview sometimes leads to scope for manipulation, manoeuvrability and corruption. Therefore, barring such posts where an interview would help in testing special capabilities for a particular assignment, abolition of the provision of interview will not only be in larger public interest but would also offer a level playing field for even those of the candidates who lack resources and come from lower socio-economic strata, he added.</p>
<p>&nbsp;</p>
<p>Referring to some of the revolutionary decisions taken by the DoPT during the last 15 months of the present government, Dr Jitendra Singh made a special mention of the introduction of self-attestation of certificates. This, he said, not only eliminated inconvenience caused to the youth for going around to seek attestation of certificates from gazetted officers, etc., but also sent out a reassuring message that the present government has the capacity to trust the youth of this country. Similarly, he also referred to the Pension Department’s plans to finalise Pension Portal which would help in ending the practice of producing life certificates by a pensioner.</p>
<p>&nbsp;</p>
<p>Dr Jitendra Singh also informed that a pilot exercise undertaken for three States of Jammu &amp; Kashmir, Maharashtra and Tamil Nadu had proved successful wherein, for the first time, an Induction training programme was introduced for the newly inducted State-level functionaries and the same practice is now being extended to other States as well. He also referred to a landmark decision by the DoPT to revise and revisit the pattern and syllabus of IAS and other Civil Services Exam to offer a level playing opportunity for aspirants from different streams.</p>

<p>Subject: <strong>Revised Bio-data / Curriculum Vitae (CV) proforma for submission by the candidate for appointment by deputation — issue of instructions — regarding.</strong></p>
<p>The consolidated instructions on the procedure to be followed in cases where appointment is to be made by transfer on deputation / transfer basis (now termed as deputation / absorption) issued by this Department vide OM No. AB-14017/71/89 — Estt. (RR) dated 3.10.89. In terms of para 4.8 of the instruction, while calling for application for appointment on deputation/absorption basis, Ministries/ Departments are required to call for Bio-data / Curriculum Vitae (CV) of the candidates in the proforma at Annexure A of the OM dated 3.10.89.</p>
<p>2. The revised Bio-data / Curriculum Vitae (CV) proforma was issued by this Department vide OM No. AB-14017/10/2000 — Estt. (RR) dated 29.8.2005. The proforma has been reviewed by UPSC, keeping in view the changes took place due to implementation of 6th Pay Commission recommendation and with the objective to reflect the complete profile of the candidate. The revised proforma suggested by the Commission is at Annexure-I.</p>
<p>3. The modified Bio-data / Curriculum Vitae (CV) proforma is enclosed with the request that this modified proforma may be utilized while calling for applications for appointment on deputation / absorption basis. The administrative Ministries / Departments are also advised to pay attention towards the points indicated in Annexure-II at the time of inviting application and preparation of the deputation proposal before sending the same for the consideration of the Commission.</p>
<p>4. It is requested that these instructions may be circulated to all the subordinate formations of the Ministries / Departments.</p>

<p>The undersigned is directed to refer to DOPTs OM of even number dated 26th July, 2013 vide which preferences of postings were sought from cadre units in respect of successful candidates of LDCE 2009, 2010 and 2011.</p>
<p>2. Out of 874 qualified candidates for LDCE 2009, 2010 and 2011, 111 are Personal Assistants of CSSS Cadre. It has come to the notice of this Department that many of these officers have already been included in the Select List of Private Secretary for the year 2010 against Seniority Quota and many are likely to be included in the Select List of Private Secretary for the year 2011 against Seniority Quota. There is a likelihood that many of these officers may refuse promotion in the grade of Section Officer.</p>
<p>3. All the Personal Assistants (as per list enclosed as Annexure-I) are therefore requested to furnish their acceptance or otherwise ( as per Anneure-II) to join the post of Section Officer on the basis of LDCE 2009, 2010 and 2011 to Department of Personnel and Training directly on fax numbers 24629413 and 24629414 by 5.30 PM today.</p>
<p>4. In case option is not received in respect of an officer, it may be treated as refusal to join the post of Section Officer on the basis of LDCE 2009, 2010 and 2011.</p>

<p style="text-align: left;">Subject: <strong>Filling up backlog vacancies reserved for Scheduled Castes (SCs)/Scheduled Tribes (STs)/Other Backward Classes (OBCs).</strong></p>
<p>A Special Recruitment Drive for filling up of the backlog vacancies reserved for SCs/STs/OBCs had been launched in November, 2008 and was concluded on 31st March, 2012.</p>
<p>2. Achievement of the Drive as reported by various Ministries / Departments on its conclusion revealed that out of total 75,522 identified backlog vacancies , there were 64,175 backlog vacancies which could be filled up and of these, 48,035 vacancies were filled up. Overall success rate of the Drive was 74.85%. Reasons for non-filling up of reserved vacancies may be attributed to the lack of finishing skills like English fluency or interview skills, non availability of qualified reserved category candidates for posts requiring professional qualification especially in ST category, scarcity of qualified reserved category persons results in job switch over or not joining after selection as they get better jobs and in some cases selection is done on all India basis whereas allocation is made zone/State wise.</p>
<p>3. The Government considered the status of filling up of backlog vacancies reserved for SCs/STs/OBCs and desired that concerted efforts be made to fill up the backlog vacancies at the earliest and the status of action taken in this regard be monitored at the highest level. Besides, actions on the following measures are to be taken at the earliest to enhance the employability of reserved category candidates:</p>
<p>(i) In order to fill up the vacancies in the posts requiring professional qualifications, the concerned Ministries/Departments may take a decision within a period of six months on launching of a Special Recruitment Drive providing certain relaxations so that the vacancies may be filled up;</p>
<p>(ii) Finishing training should be imparted to the reserved category candidates once they complete technical/professional qualification. Ministry of Social Justice and Empowerment and Ministry of Tribal Affairs would devise such programmes. Such programmes should be implemented with involvement of State and State Administrative Training Institutes.</p>
<p>(iii) Training programmes for interview skills and English proficiency may also be devised for reserved category persons for posts requiring non-professional qualifications;</p>
<p>(iv) The issue of providing reserve list/wail list of successful reserved category candidates would be taken up with the Recruitment Agencies so that in a situation when reserved category candidates with higher merit do no join the post, the post may be filled up from the candidates available in the reserved list;</p>
<p>(v) The issue of less employability of SCs/STs/OBCs and Persons with Disabilities for Government sector may require in-depth analysis of the causes and to suggest remedial measures. It would be appropriate to constitute a Committee with representations from Ministry of Social Justice and Empowerment, Ministry of Tribal Affairs, Department of Personnel and Training, major Ministries /Departments like Ministry of Home Affairs, Ministry of Railways and government recruitment agencies.</p>
<p>The committee should find out specific reasons for backlog in filling up of vacancies and suggest measures to enhance the employability of reserved category candidates.</p>
<p>(vi) More and more posts may be identified for the persons with disabilities. Micro specifications may be made liberal by providing reasonable accommodation/technological help.</p>
<p>(vii) Schemes may be launched for establishment of inclusive schools/colleges where even persons with disabilities may be able to get education so that the dearth of qualified persons especially in Hearing Impaired category may be taken care of.</p>
<p>(viii) As regards awareness of opportunity for the Persons with Disabilities, the Non- Government Organisations (NGOs) working in the concerned area may be roped in by the Department of Disability Affairs for dissemination of information about schemes/programmes/job opportunities.</p>
<p>4. All the Ministries /Departments are requested to take follow up action on the decision taken by the Government. Quarterly reports be sent to this Department for monitoring the progress of implementation of these directions.</p>

Subject: <strong>Promotion of Section Officers of the CSS to Grade I (Under Secretary) of the CSS on ad hoc basis.</strong></p>
<p>The undersigned is directed to say that this Department is in the process of bringing out upto date Select Lists in the grade of Under Secretary in consultation with UPSC. As this process will take some time, and in the meanwhile in order to meet the immediate requirement of officers at the level of Under Secretary it is proposed to promote officers on adhoc basis.</p>
<p>2. Section Officers upto SOSL-2003 and who have not yet been promoted to the grade of US on adhoc basis will be considered for promotion against the existing vacancies. The list of such officers is enclosed at Annexure-l to this O.M.</p>
<p>3. Further there are twenty three officers who were earlier promoted on adhoc basis but did not avail promotion on account of various reasons leading to cancellation of the promotion orders in their respect. The list of such officers is enclosed at Annexure-II to this OM. These officers may also be considered for adhoc promotion in case they express their willingness. However, their cases will be considered only on case to case basis taking into account reasons on which they earlier declined adhoc promotion.</p>
<p><strong>4. Vigilance status</strong>:- Accordingly, Ministries/ Departments concerned where the officers are currently posted are requested to inform the vigilance status of these officers (in respect of officers both in Annexure-I and Annexure-II) for further action by this Department.</p>
<p>The vigilance status of these officers should reach this Department latest by 10th May 2013, failing which the cases of officers concerned will not be considered for adhoc promotion.</p>
<p><strong>5. Personal information:-</strong> Officers concerned are also advised to furnish their personal particulars in the format at Annexure-III. Information in respect of these officers should also be complete in all respects in the web based cadre management software uploaded at http://10.21.145.125/ It should be noted that if the information of any officer in the web based software is not complete such officer will not be considered for adhoc promotion.</p>
<p><strong>6. Vacancy position</strong>:- The incumbency and vacancy position in the grade of Under Secretary should also tally with the information as available in the web based cadre management software. It should be noted that posting of officers will be made only on the basis of information available in the web based system.</p>

										<content:encoded><![CDATA[<p><strong>Implementation of SC decision for amending Rules of Promotion &#8211; Copy of OM No.1/9/69-Estt.(SCT) Dated 26th March, 1970</strong></p>
<div>The below information was given by the Minister of State for Personnel, Public Grievacnes and Pensions Shri.V.Narayanasamy in a written reply to a question in Rajya Sabha on 21st March, 2013 regarding the matter of the implementation of SC decision for amending Rules of Promotion. The important office memorandum, which was published by the Home Affairs on 26.3.1970 is reproduced and given for your ready reference&#8230;</div>

<div>The Supreme Court in the matter of National Federation of SBI &amp; Ors. V/s. Union of India (1995 AIR 1457) considered the issue whether concession as per O.M. No. 1/9/69-Estt (SCT) dated 26.3.1970 tantamounts to reservation and has held that in the matter of promotion by selection to the posts within Class I, which carry an ultimate salary of Rs. 2250 (Pre-revised), there is no reservation in favour of Scheduled Castes(SCs) / Scheduled Tribes (STs) but they are entitled to the concession contained in para 2 of the OM dated 26.3.1970 issued by the Ministry of Home Affairs. The concession is that those SC/ST officers who are senior enough in the zone of consideration for promotion so as to be within the number of vacancies for which the select list is being drawn up will be included in the select list provided they are not considered unfit for promotion.</div>

<div>The Supreme Court has further held that the said candidates would not be entitled, for the purpose of selection one grading higher than the grading otherwise assigned to them on the basis of their record of service. The O.M. dated 26.3.1970 also contains the same instructions that they would not be given, for this purpose, one grading higher than the grading otherwise assigned to them as per their record of service.</div>

<div>The extant guidelines on Departmental Promotion Committee provide that the Departmental Promotion Committees (DPCs) enjoy full discretion to devise their own methods of procedures for objective assessment of the suitability of candidates who are to be considered by them. The DPCs should make their own assessment on the basis of the entries in the Confidential Reports(CRs) now Annual Performance Appraisal Reports(APARs) because sometimes the overall gradings in a Confidential Report may be inconsistent with the grading under various parameters or attributes. The DPC is required to make an overall assessment of the performance of each candidate separately but by adopting some stands/yardstick/norms. The procedure should not be vitiated on grounds of bias, mala-fide or arbitrariness. As per latest instructions, the DPC is required to grade the officers as ‘fit’ or ‘unfit’ only, after determining the merit of those being assessed for promotion.</div>

<div>The instructions issued by the Department of Personnel and Training on the subject have been extended to all Central Public Sector Undertakings (CPSUs) by the Department of Public Enterprises vide their O.M. dated 27th September, 1978.</div>

<div>The Supreme Court in K. A. Nagamani V/s. Indian Airlines and others (CA 5314/2007) has held that the Recruitment Rules of the Indian Airlines framed by the Corporation were not framed under any statute and therefore are not statutory rules. The Recruitment Rules for the posts and services under the Central Government are delegated legislations and therefore are statutory in nature. Such Rules after notification are laid before the Parliament.</div>

<div>Subject :- <strong>Concessions to Scheduled Castes and Scheduled Tribes in posts filled by promotion &#8211; Class I Services / posts.</strong></div>

<div>The question of increasing the representation of Scheduled Castes and Scheduled Tribes employees in</div>
<div>Class I Services/posts under the Government of India has been under the consideration for some time past. In this Ministry&#8217;s O.M. No.1/12/67-Estt. (C), dated 11th July, 1968, certain concession have been provided to Scheduled Castes and Scheduled Tribes, inter alia, in the matter of promotion by selection to the lowest rung or Category in Class I. It has now been decided that the following concessions and facilities will be provided to Scheduled Castes and Scheduled Tribes officers for their promotions within Class I also.</div>

<div>2. In promotions by selection to posts within Class I, which carry an ultimate salary of Rs. 2,000 per month, or less the Scheduled Castes/Scheduled Tribes officers, who are senior enough in the zone of consideration for promotion so as to be within the number of vacancies for which the Select list has to be drawn up, would be included in that list provided they are not considered unfit for promotion: Their position in the Select list would, however, be the same as assigned to them by the Departmental Promotion Committee on the basis of their record or service: They would not be given, for this purpose, one grading higher than the grading otherwise assignable to them on the basis of their record of service.</div>

<div>3. In order to improve the chances of Scheduled Castes/Scheduled Tribes officers for selection to the higher categories of posts in Class I, it has further been decided that:</div>
<div></div>
<div>(i) Scheduled Castes/Scheduled Tribes officers in Class I Services/posts should be provided with more opportunities for institutional training and for attending seminars/Symposia/conferences. Advantage</div>
<div>could in this connection be taken of the training facilities available at the National Academy of Administration Mussoorie, National Police Academy, Mount Abu, Indian Institute of Public</div>
<div>Administration, New Delhi, the Administrative Staff College, Hyderabad, etc.; and</div>
<div></div>
<div>(ii) It should be the special responsibility of the immediate superior officers of the Scheduled Castes/Scheduled Tribes officers in Class I to give advice and guidance to the latter to improve the quality of their work.</div>
<div></div>
<div>Ministries/Departments under whom Scheduled Castes/Scheduled Tribes Class I officers might be serving should ensure that these decisions are implemented with expedition, Ministries/Departments (or the Heads of Departments) under whom such officers might be serving may specially watch the progress of these officers so that all appropriate steps are taken, wherever necessary, to improve the efficiency of these officers for the purpose of their selection to higher posts.</div>

<div>4. The orders contained in paragraph 2 above take effect from the date of issue except in respect of selections already made prior to the issue of these orders.</div>

<div>5. Ministry of Finance etc., are requested to bring the above decisions to the notice of all concerned.</div>

<div>6. In so far as persons serving in offices under the Comptroller and Auditor General of India are concerned, separate orders will issue in due course.</div>

<div>The undersigned is directed to refer to this Department’s OM of even number dated 23.11.2012 and subsequent reminder dated 07.02.2013 on the above mentioned subject and to say that cadre units were requested to furnish the recommendations of the DPC, along with vigilance clearance of all the eligible PAs of Select list year 2003 to 2005 belonging to SC category, in the prescribed proforma. However, despite a lapse of considerable time, the DPC recommendations in respect of some of the officers (list enclosed) are yet to be furnished by the cadre units.</div>

<div>The defaulting cadre units are, therefore, requested to expedite the requisite information to enable this Department to finalize the central panel of eligible officers for appointment/promotion to PS of CSSS for the select list year 2010 (extended).</div>
