<h2 class="wp-block-heading">Year-End Review of DoPT (Ministry of Personnel, Public Grievances &amp; Pensions)-2022</h2>



<p><strong>Major achievements/ initiatives of DoPT during calendar year 2022</strong></p>



<p class="has-text-align-right">Posted On: 29 DEC 2022</p>



<p>(i) <strong>Rojgar Mela:</strong> Hon’ble Prime Minister launched Rozgar Mela through video conferencing on 22nd October, 2022. Appointment letters to more than 1.46 lakh candidates issued during the two trenches of the recruitment drive ‘Rozgar Mela’ through Video conferencing across the country. Rozgar Mela is a significant step forward towards fulfilling the continuous commitment of the Central Government to provide job opportunities for the youth. The new recruits, selected from across the country, will join various Ministries/ Departments of Government of India. The appointees will join the government at various levels viz. Group – A, Group – B (Gazetted), Group – B (Non-Gazetted) and Group – C. These recruitments are being done in mission mode by Ministries and Departments either by themselves or through recruiting agencies such as UPSC, SSC, Railway Recruitment Board. For expeditious recruitment, selection processes have been simplified and made tech enabled.</p>



<p>(ii) <strong>Karmayogi Prarambh</strong> – To impart online induction training to new recruits, Karmayogi Prarambh has been launched by Hon’ble Prime Minister on 22nd November 2022 for providing behavioral and functional skills such as self-leadership and information technology.</p>



<p>(iii) <strong>Consolidation of OMs</strong> &#8211; As per vision of Hon’ble Prime Minister for transparent and efficient administration, the exercise of consolidation of OMs in digital form was carried out by Department of Personnel &amp; Training. To ease the difficulties being faced by stakeholders, including the General Public, a new Application has, thus, been created under the Heading “OMs”. Eleven major Heads and relevant Sub-Heads have been created to capture the entire journey of Government officials from Recruitment till retirement.</p>



<p>(iv) <strong>Special Maternity Leave</strong> – Taking into consideration the emotional trauma faced by the women in case of death of a child soon after birth/ stillbirth, instructions regarding grant of 60 days special Maternity Leave were issued vide O.M. No. 13018/1/2021-Estt.(L) dated 02.09.2022.</p>



<p>(v) <strong>e-HRMS 2.0</strong> &#8211; Fostering the vision of Hon’ble Prime Minister, Narendra Modi ji, DoPT launched e-HRMS 2.0 with service to its beneficiaries as core of its development. This one stop solution for HR needs will take the vision of Karmayogi forward and shall empower employees in their service to the nation. With whole of Government approach &amp; service first approach as its core, e-HRMS 2.0 will focus on providing value added services to the employees, based on their profiles, experience and needs.</p>



<p>(vi) <strong>iGOT app</strong> &#8211; integrated Government online learning (iGOT) has been launched on android platform to provide government employees any time, any-where learning. It will provide employees access to the courses available on iGOT portal through their mobiles phones.The app and the platform will allow all government employees, at multiple levels, to undergo continuous training, depending on their domain areas. The app and the platform will provide anytime-anywhere-any-device learning to train about 2 crores users which was hitherto not achievable through traditional measures, i.e. computer based training only.</p>



<p>(vii) <strong>Revamping of PROBITY portal</strong> &#8211; PROBITY portal has been revamped to add more functionalities to improve the user experience and optimizing the Portal to collect the data on new data points/ parameters, which will help in generating comprehensive reports on various modules. All the user Departments will undertake to submit updated data on a monthly basis, which would be made available on Probity portal.</p>



<p>(viii) <strong>Large number of promotion in CSS/ CSSS/ CSCS</strong> &#8211; Promotion of 8000+ CSS/CSSS/CSCS Officers: Promotions were held up in the three services [Central Secretariat Service (CSS), Central Secretariat Stenographers Services (CSSS) and Central Secretariat Clerical Service (CSCS)] in all the grades, due to pending litigations in Hon’ble Supreme Court of India on the twin issues of “Reservation in Promotion” in SLP No.31288/2017 – Union of India and “Promotion of SC/ST on own merit” in SLP No.30621/2011 &#8211; Jarnail Singh &amp;Ors. and similar such matters. Based on the Hon’ble Supreme Court Order dated 28.01.2022 &amp; Subsequent direction of Estt. (Res) dated 12.04.2022 promotion exercise was initiated and promotion orders of more than 8,000 officers in different grades of CSS/ CSSS/ CSCS were issued by 30th June, 2022.</p>

<p><strong>Subject: Extension of the LTC block year 2018-21 (extended) for a period of three months &#8211; reg.</strong></p>



<p>The undersigned is directed to refer to the above mentioned subject and to state that as per rule 10 of the CCS(LTC) Rules, 1988, a Government servant who is unable to avail of the LTC within a particular block of two years or four years may avail of the same within the first year of the next block of two years or four years. Accordingly, the block year 2018-21 was deemed extended upto 31st December, 2022 by virtue of rule 10 of the CCS(LTC) Rules, 1988.</p>

<li>In relaxation of Rule 10 of the CCS(LTC) Rules, 1988, exercising the powers conferred under Rule 18 &#8211; ‘Power to relax’, of the CCS(LTC) Rules, 1988, it has now been decided with the approval of competent authority to extend the LTC Block year 2018-2021 (extended) <strong>for a period of three months i.e. upto 31st March, 2023</strong>.</li>

<h3 class="wp-block-heading">Subject:- Nomination of Liaison Officer for SC, ST, OBC, PwD, EWS and Ex-servicemen and setting up of a Reservation Cell in each Ministry/ Department for enforcement of orders of reservations in posts and services of the Central Government.</h3>



<p>The undersigned is directed to say that DoPT, vide its OM&nbsp;<a href="https://documents.doptcirculars.nic.in/D2/D02adm/43011_153_2010-Estt.Res.-04012013.pdf" target="_blank" rel="noreferrer noopener">No. 43011/153/2010-Estt.(Res), dated 4.1.2013</a>, has issued detailed instructions for appointment of Liaison Officer, not below the rank of Deputy Secretary for Scheduled Castes (SCs), Scheduled Tribes (STs) and&nbsp;<strong>Persons with Disabilities (PwDs)</strong>. These instructions also provide for designation of a separate Liaison Officer for Other Backward Classes (OBCs).Further, OM&nbsp;<a href="https://documents.doptcirculars.nic.in/D2/D02adm/ewsf28fT.PDF" target="_blank" rel="noreferrer noopener">No.36039/1/2019-Estt (Res), dated 31.1.2019</a>&nbsp;provides for nomination of Liaison Officer for Economically Weaker Section (EWS) and OM&nbsp;<a href="https://documents.doptcirculars.nic.in/D2/D02est/LiaisonOfficer_exservicemen4K0Pa.pdf" target="_blank" rel="noreferrer noopener">No. 36034/2/2017-Estt (Res.), dated 31.12.2021</a>, provides for nomination of a Liaison Officer for Ex-servicemen. Instructions also provide for creation of Reservation Cell under the direct control of Liaison Officer to assist him in discharge of his duties.</p>



<p>2. During the sitting of the Parliamentary Committee on the Welfare of Other Backward Classes on 3.11.2022, the Hon’ble Members of the Committee directed this Department to reiterate the provision of separate Liaison Officers for OBCs and nomination of Deputy Secretary in-charge of Administration or any other officer at least of the rank of Deputy Secretary as Liaison Officer. Accordingly, the existing instructions in the matter are reiterated as follows:</p>



<p><strong>A.&nbsp;<u>APPOINTMENT OF LIAISON OFFICERS</u></strong></p>



<p>(i) <strong><u>Liaison Officer for SCs, STs and PwDs:</u> </strong>As per DoPT OM <a href="https://documents.doptcirculars.nic.in/D2/D02adm/43011_153_2010-Estt.Res.-04012013.pdf" target="_blank" rel="noreferrer noopener">No. 43011/153/2010 -Estt.(Res.), dated 4.1.2013</a>, in each Ministry/Department/Attached and Subordinate Office, Deputy Secretary in charge of Administration (or any other officer at least of the rank of Deputy Secretary), shall be designated as Liaison Officer in the Ministries/ Departments in respect of matters relating to the representation of the Scheduled Castes, Scheduled Tribes and Persons with Disabilities.</p>



<p>(ii)&nbsp;<strong><u>Liaison Officer for OBCs:</u></strong>&nbsp;Similarly, the aforesaid instructions, dated 4.1.2013 also provide that Ministries/Departments shall designate a separate Liaison Officer at least of the rank of Deputy Secretary to deal with the matters relating to the representation of the Other Backward Classes.</p>



<p>(iii)&nbsp;<strong><u>Liaison Officer for Ex-servicemen:</u>&nbsp;</strong>As per DoPT OM&nbsp;<a href="https://documents.doptcirculars.nic.in/D2/D02est/LiaisonOfficer_exservicemen4K0Pa.pdf" target="_blank" rel="noreferrer noopener">No. 36034/2/2017-Estt.(Res.), dated 31.12.2021</a>, in each Ministry/Department/Attached and Subordinate Office, the Deputy Secretary in charge of administration (or any other officer at least of the rank of Deputy Secretary) should be designated as a Liaison Officer in respect of matters relating to representation of Ex-servicemen, either exclusively or in combination (the Officer already appointed as Liaison Officer for other categories), may be appointed as Liaison Officer for Ex-Servicemen also, depending upon the availability of Officer of the requisite rank. The particulars and contact details of Liaison Officer, so appointed, may be intimated to the Department of Ex-servicemen Welfare.</p>



<p>(iv)&nbsp;<strong><u>Liaison Officer for Economically Weaker Section (EWS):</u>&nbsp;</strong>DoPT OM&nbsp;<a href="https://documents.doptcirculars.nic.in/D2/D02adm/ewsf28fT.PDF" target="_blank" rel="noreferrer noopener">No.36039/1/2019-Estt.(Res), dated 31.1.2019</a>, also provides that the Ministries/Departments/Attached and Subordinate Offices shall appoint Liaison Officer to monitor the implementation of reservation for EWSs.</p>



<p><strong>B.&nbsp;<u>RESPONSIBILITIES OF THE LIAISON OFFICERs:</u></strong>&nbsp;The Liaison Officer is responsible for:</p>



<ol class="wp-block-list" type="i">
<li>Ensuring due compliance by the Ministry/ Department and subordinate appointing authorities with the orders and instructions pertaining to the reservation of vacancies in favour of the category for which, he/she is a liaison officer i.e. Scheduled Castes, Scheduled Tribes, Persons with Disabilities, Other Backward Classes, Economically Weaker Sections and Ex-servicemen. In addition, he/she shall also ensure that other benefit admissible to them.</li>



<li>Ensuring timely submission of reports regarding appointment/representation of SC, ST, OBC, PwD and EWS by each appointing authority in the Ministry/Department concerned. He shall also ensure scrutiny and consolidation of the above reports in respect of all establishments and services in and under the control of the Ministry/Department, and sending the consolidated reports, in the prescribed proformae, to the Department of Personnel &amp; Training. In case of Ex-servicemen, the Liaison Officer concerned shall ensure maintenance of reservation rosters and preparation of reports on appointment/representation of Ex-servicemen, in the formats as prescribed by the Department of Ex-servicemen Welfare, and timely submission of these reports to the Department of Ex-servicemen Welfare.</li>



<li>The Liaison officers, designated for SC/ST/OBC, have to endorse the non-availability of an SC/ST/OBC Officer for being associated in the DPC before the DPC is actually conducted without a SC/ST/OBC Member. Therefore, it will be one of the duties of the Liaison Officers to acquaint themselves well in time about the dates of various DPCs to be held in future. He should maintain with him a ready list of officers of various levels, belonging to SC/ST/OBC of a few sister Departments/Ministries, so that whenever requirement arises, an SC/ST/OBC officer of appropriate level, consistent with the level of the other members of the DPC, and the level of appointment for which a DPC is proposed to be convened, can always be associated as a member. Such a list may be prepared by the Liaison Officers concerned by informally consulting the administrative wing of other Ministries/Departments.</li>



<li>Ensuring that while making a reference to the Department of Personnel and Training and to the National Commission for Scheduled Castes/the National Commission for Scheduled Tribes for de-reservation of reserved vacancies, full details in support of the proposal for de-reservation are given.</li>



<li>Ensuring the extension of necessary assistance to the National Commission for Scheduled Castes, the National Commission for Scheduled Tribes, National Commission for OBC and the Office of the Chief Commissioner for Persons with Disabilities in the investigation of complaints received by them from the officer(s) of respective category with regard to service matters and also in collection of information for their annual reports. In respect of EWS and PwBD, the concerned Liaison Officers shall extend all help to Grievance Redressal Officers appointed in respect of EWS and PwD reservation.</li>



<li>Conducting annual inspection of the reservation registers/rosters maintained in the Ministry/ Department/ Offices under the control of the Ministry/Department with a view to ensuring proper implementation of the reservation orders.</li>



<li>Acting as Liaison Officer between the Ministry/Department and the Department of Personnel &amp; Training (Department of Ex-servicemen Welfare in case of matters relating to Ex-servicemen) for supply of information, answering questions and queries and clearing doubts in respect of matters covered by the reservation orders.</li>
</ol>



<p><strong>C. <span style="text-decoration: underline;">CONSTITUTION<u> OF RESERVATION CELL</u></span></strong>:</p>



<p>Each Ministry/Department is required to set up a Special Reservation Cell within the Ministry/Department under the direct control of the Liaison Officer to assist the Liaison Officer in discharging of his duties effectively.</p>



<p><strong>D.&nbsp;<u>PRIVILEGES OF THE LIAISON OFFICER:</u></strong></p>



<p>Cases of negligence or lapse in the matter of following the reservation and other orders relating to SC, ST, OBCs, PwDs, EWS and Ex-servicemen coming to the light through the inspections carried out by the Liaison Officer, or otherwise shall be reported/submitted by him direct to the Secretary/ Additional Secretary to the Government of India in the respective Ministry/ Department or to the Head of the Department in respect of offices under the Heads of Department, as the case may be. The concerned Secretary/Additional Secretary/Head of the Department shall pass necessary orders on such reports to ensure strict compliance of the reservation orders by the appointing authority concerned.</p>



<p><strong>E.&nbsp;<u>APPOINTMENT OF LIAISON OFFICERS IN ESTABLISHMENTS/ ORGANISATIONS UNDER THE MINISTRY/DEPARTMENT</u></strong></p>



<p>Establishments/Organisations under the Government of India such as Public Sector Undertakings, Statutory and Semi Government Bodies, Autonomous Bodies/ Institutions including Municipal Corporations, Co-operative Institutions, Universities, Voluntary Agencies, receiving grants in aid from the Government, shall also appoint Liaison Officers in the same manner as is existing in the Ministries/Departments.</p>



<p><strong>F.&nbsp;<u>SPECIAL RESPONSIBILITIES OF THE LIAISON OFFICERS OF THE MINISTRIES/DEPARTMENTS TOWARDS IMPLEMENTATION OF RESERVATION POLICIES IN THE ESTABLISHMENTS UNDER THE GOVERNMENT</u></strong>:</p>



<p>The Liaison Officer of a Ministry/Department has to act as Liaison Officer in respect of the matters relating to the representation SCs/STs/PwDs, OBCs, Ex-servicemen and EWS in all establishments and services under the administrative control of the Ministry/Department. The appointment of Liaison Officers separately by the Organisations under the Government of India such as Public Sector Undertakings, Statutory and Semi Government Bodies, Autonomous Bodies/ Institutions, including Municipal Corporations, Co-operative Institutions, Universities, Voluntary Agencies receiving grants in aid from the Government etc. does not, however, dilute or alter or curtail the responsibilities of the Liaison Officers of the administrative Ministry/ Department with regard to implementation of reservation policy in such organisations. Liaison Officers of the Ministries/ Departments have special responsibility to monitor implementation of reservation policies in these organisations. In order to ensure due compliance of the reservation orders of the Government, the Liaison Officers may periodically visit/ inspect the offices/organizations under them. They should ensure that reservation rosters for these categories have been maintained properly without any gap in the entries made in the rosters. Liaison Officers shall carry out their duties in relation to reservation by calling for records from them and convening meetings with the officers of such organizations as are responsible for ensuring reservation policies in their respective organizations. If Liaison Officers of Ministries/Departments notice that reservation instructions are not being followed by any officers or complaint against any officer for harassment or deliberate manipulation of orders/instructions to harm the interests of the above-mentioned categories, are received they should feel free to report such lapses to the Secretary/ Additional Secretary of the Ministry/Department concerned without fear &amp; hesitation of hierarchical disobedience.</p>



<p>3. As the Liaison Officers so nominated keep on changing due to administrative reasons, such as transfer, promotions, retirement etc., it is desirable that necessary details of the Liaison Officers, such as their names, designations, telephone numbers, emails, fax and complete official addresses are posted and updated as and when required on the official website of the concerned Ministry/ Department.</p>



<p>4. All the Ministries/Departments of the Central Government are requested to bring the contents of this O.M. to the notice of all the appointing authorities and also attached and subordinate offices under their control.</p>

<h3 class="wp-block-heading">Subject:- Instruction on Bond</h3>



<p>The instructions issued from time to time by the Government on the subject of Enforcement of Bond in respect of Central Government servants/ employees of public enterprises, who leave service to secure employment elsewhere are consolidated for better understanding and guidance, as under.</p>



<p>2. As per Ministry of Home Affairs O.M. No. 70/10/60-Estt.(A) dated 09.05.60, it was laid down that the terms of the bond (which the Government servants receiving scientific and technical training at Government expense have to execute, undertaking to repay the money in the event of their failure to serve the Government for a specified number of years after completion of their training) should be enforced against those Government servants only, who leave Government service in order to secure private employment. It was further clarified vide the Ministry of Home Affairs O.M. No. F. 5/10/66-Estt(C) dated 15.04.66 that the terms of the bond may not be enforced in the case of Government servants, who leave Government service to secure employment, under a State Government, a public sector undertaking, owned wholly or partly by the Central Government or by a State Government, or a quasi-Government organisation. In such cases, a fresh bond is to be taken from such Government servants to ensure that they serve the new employer for the remaining period of the bond.</p>

<p>3.   Attention is also invited in this connection to the Bureau of Public Enterprises’ Ministry of Finance’ O.M. No. BPE/ GL-017/77/ MIsN/2(11)/75- BPE(GM-I) dated 13.06.77, in which it has been laid down that the terms of bond executed by an employee of a Public Enterprise, who has received scientific/technical training at the cost of the Enterprise, should not be enforced in case he joins the Central Government, a State Government, a quasi-Government orgranisation or another Public Enterprises, subject to the condition that a fresh bond is taken to ensure that the employee serves the new employer for the balance of the original bond period.</p>



<p>4.  Instances have come to the notice of this Department, that the terms of the bond were enforced in the cases of those employees also, who left service to secure employment other than private employment, and they were asked to refund proportionate service bond money, even though such a refund was not warranted in terms of the existing instructions, and all that was execution of a fresh bond by the individual concerned with the new employer, to the effect, that he would serve them for the balance of the original bond period. It may be clarified that for the purpose of these instructions, any employment other than the employment under the Central Govt., a State Government, a Public Enterprise wholly or partly owned by the Central Government or a State Government, or an autonomous body wholly or substantially owned/ financed/ controlled by the Central Government or a State Government, will be treated a private employment.</p>



<p>5.&nbsp; &nbsp;While the instructions referred to in Para 2 and 3 above cover the employees of the Central Government and those of Central Public Enterprises, they do not automatically apply to the employees of autonomous bodies, wholly or substantially owned/ financed/ controlled by the Central Government. It has however, come to the notice of this Department, that though such autonomous bodies generally follow the instructions of the Government of India in regard to service conditions of their employees, these employees are sometimes put the undue hardship in the absence of instructions specifically applicable to them, regarding exemption from enforcement of bond as referred to in Para 2 and 3 above. The matter has been examined in this Department, and it has been decided that the facility of exemption from the enforcement of bond, as it is available to the employees of the Central Government and those of Central Public Enterprises, may also be extended to the employees of the autonomous bodies, wholly or substantially owned/ financed/ controlled by the Central Government, in case they leave the service of the autonomous body in order to secure employment other than private employment as defined in Para 4 above.</p>

<p>6.   To sum up, the terms of the bond (which a Central Government servant, an employee of a Central Public Enterprise or an employee of an autonomous body wholly or substantially owned/ financed/ controlled by the Central Government, receiving scientific and technical training at the expense of the Govt./ enterprise/ autonomous body has to execute, undertaking to repay the money in the event of his failure to serve the Government/ enterprise/ autonomous body for a stipulated period after completion of his training) should not be enforced against an employee, who leaves service of the Government/ enterprise/ autonomous body to secure, with proper permission, employment under the Central Government, a public enterprises wholly/ partially owned by the Central Government, or a State Government, or an autonomous body wholly or substantially owned/financed/controlled by the Central Government. In such a case, a fresh bond should be taken from the person concerned to ensure that he serves the new employer for the balance of the original bond period.</p>



<p>7.&nbsp; &nbsp;A doubt has also been raised whether the word ‘training’ covers apprenticeship and whether exemption from recovery of expenses, as laid down in these instructions, includes payments made to an individual in the shape of training allowance or stipend. It is hereby clarified that these instructions are not restrictive, but cover all aspects of training, including apprenticeship. It is further clarified that exemption from recovery of expenses applies to all types of expenditure-direct or indirect-including payments made as training allowance or stipend.</p>



<p>8.&nbsp; &nbsp;To ensure that the requirement of obtaining a fresh bond from a person, where necessary, is fulfilled, the department/organization etc., with whom the employee has executed the original bond, may, at the time of forwarding of his application (and if it is not possible, before his release) for another post, may write to the department/organization etc., under whom the employee intends to take up another appointment, intimating them about the bond obligation of the individual and clarifying that in the case of his selection for the new post, his release will be subject to the condition that the new department/ organization etc. take from him a fresh bond binding him to serve them for the balance of the original bond period, and in case he fails to serve the new department/organization etc., or leaves it before completion of the original bond period, for a job, where exemption from bond obligation is not available, the proportionate bond money should be realized from the individual and refunded to the first department/organization etc., with whom he originally executed a bond. The Ministry/ Department/ Organisation when the person is newly employed should also duly intimate the original Ministry/Department/Or Organisation, the fact of a fresh bond having been executed with the person concerned.</p>



<p>9.   These instructions will also apply to cases where an employee of the Central Government, a Central Public Enterprise/ an autonomous body, wholly or substantially owned/ financed/ controlled by the Central Government has been selected for a post/service (other than private employment), for which he had applied before joining the department/organization etc., with whom he has executed a bond.</p>

<h3 class="wp-block-heading">Subject: Strengthening of Administration by periodical review under FR 56(j): Statutory Body regarding.</h3>



<p>The undersigned is directed to refer to DOPT’s OM No. 25013/03/2019-Estt.A-IV dated 28.08.2020 regarding Periodic Review of Central Government Employees for strengthening of administration under FR 96(j)/(l) and Rule 42 of CCS Pension Rules 2021 [erstwhile Rule 48 of CCS (Pension) Rules 1972].</p>



<p>2. As regards applicability of provisions of FR-56(j) and composition of Representation Committee in respect of statutory bodies, the following provisions are made for the statutory bodies:</p>



<ol class="wp-block-list">
<li>Where the Statutory Body have adopted the provisions of FR 56(j), Administrative Ministry may ensure that they are strictly followed;</li>



<li>Where the Statutory Body have similar provisions in their rule books, the Administrative Ministry may ensure that they are followed in letter and spirit;</li>



<li>Where no such provisions exist, the Administrative Ministry may ensure that the action is taken to put in place such rules as may be necessary; and</li>



<li>The composition of the Representation Committee in respect of employees of Statutory bodies may be decided with the approval of Minister-in-charge of the Ministry under which the Statutory bodies fall. OC &amp;</li>

<h2 class="wp-block-heading">Technical Resignation and Lien</h2>



<p>This Department has issued various instructions from time to time regarding Technical Resignation and Lien. It is now decided to consolidate these instructions at one place for better understanding and guidance, as under:</p>



<h3 class="wp-block-heading">2.1 Technical Resignation</h3>



<p>2.1.1 As per the Ministry of Finance OM No. 3379-E.III (B)/65 dated the 17th June, 1965, the resignation is treated as a technical formality where a Government servant has applied through proper channel for a post in the same or some other Department, and is on selection, required to resign the previous post for administrative reasons. The resignation will be treated as technical resignation if these conditions are met, even if the Government servant has not mentioned the word “Technical” while submitting his resignation. The benefit of past service, if otherwise admissible under rules, may be given in such cases. Resignation in other cases including where competent authority has not allowed the Government servant to forward the application through proper channel will not be treated as a technical resignation and benefit of past service will not be admissible. Also, no question of benefit of a resignation being treated as a technical resignation arises in case of it being from a post held on ad hoc basis.</p>



<p>2.1.2 This benefit is also admissible to Government servants who have applied before joining the Government service and on that account the application was not routed through proper channel. The benefit of past service is allowed in such cases subject to the fulfillment of the following conditions:</p>



<ul class="wp-block-list">
<li>(i) the Government servant should intimate the details of such application immediately on their joining;</li>



<li>(ii) the Government servant at the time of resignation should specifically make a request, indicating that he is resigning to take up another appointment under the Government for which he applied before joining the Government service;</li>



<li>(iii) the authority accepting the resignation should satisfy itself that had the employee been in service on the date of application for the post mentioned by the employee, his application would have been forwarded through proper channel.</li>
</ul>

<h4 class="wp-block-heading">2.2 Carry forward of Leave benefits</h4>



<p>(i) In terms of Rule 9(2) of the CCS (Leave) Rules, 1972, technical resignation shall not result in the lapse of leave to the credit of the Government servant. The balance of unutilized Child Care Leave(CCL) as well as all other leaves of the kind due &amp; admissible will be carried forward.</p>



<p>(ii) As per rule 39-D of the CCS(Leave) Rules,1972, in case of permanent absorption in PSUs/ Autonomous Bodies/ State Government etc., the Government servant shall be granted cash equivalent of leave salary in respect of EL &amp; HPL at his credit subject to overall limit of 300 days.</p>



<h4 class="wp-block-heading">2.3 Carry forward of LTC</h4>



<p>Entitlement to LTC may be carried forward in case of a Central Government Servant who joins another post after having submitted Technical Resignation. In case of a Government Servant who resigns within 8 years of his appointment and joins another post in the Government after Technical Resignation, the Government Servant will be treated as a fresh recruit for a period of 8 years from the date of his initial appointment under Government. Thus if a Government Servant joins another Department after serving in Government for 4 years, he will be treated as a fresh recruit for 4 years in the new Department.</p>



<h4 class="wp-block-heading">2.4 Pay Protection, eligibility of past service for reckoning of the minimum period for grant of Annual Increment</h4>



<p>In cases of appointment of a Government servant to another post in Government on acceptance of technical resignation, the protection of pay is given in terms of the Ministry of Finance OM No. 3379-E.III (B)/65 dated the 17th June, 1965 read with proviso to FR 22-B. Thus, if the pay fixed in the new post is less than his pay in the post he holds substantively, he will draw the presumptive pay of the pay he holds substantively as define in FR-9(24). Past service rendered by such a Government servant is taken into account for reckoning of the minimum period for grant of annual increment in the new post/ service/ cadre in Government under the provisions of FR 26 read with Rule 10 of CCS (RP) Rules, 2016. In case the Government servant rejoins his earlier posts, he will be entitled to increments for the period of his absence from that post.</p>



<h4 class="wp-block-heading">2.5 GPF transfer</h4>



<p>Transfer of GPF on technical resignation would be governed by Rule 35 of the General Provident Fund (Central Services) Rules, 1960.</p>



<h4 class="wp-block-heading">2.6 Seniority</h4>



<p>On technical resignation, seniority in the post held by the Government servant on substantive basis continues to be protected. However, in case of a Government servant deciding to rejoin his substantive post, the period spent in another department which he had joined after submitting his technical resignation will not count for minimum qualifying service for promotion in the higher post.</p>



<h4 class="wp-block-heading">2.7 Applicability of Pension Scheme</h4>



<p>In cases where Government servants, who had originally joined government service prior to 01.01.2004, apply for posts in the same or other Departments and on selection they are asked to tender technical resignation, the past services are counted towards pension if the new post is in a pensionable establishment terms of Rule 26(2) of CCS (Pension) Rules 1972. They will thus continue to be covered under the CCS(Pension) Rules, 1972 even if they join the new post after 1.1.2004.</p>

<h4 class="wp-block-heading">2.8 New Pension Scheme</h4>



<p>In case of ‘Technical Resignation’ of Government servant covered under National Pension System (NPS), the balance standing to their Personal Retirement Account (PRA) along-with their PRAN will be carried forward to the new office.</p>



<h4 class="wp-block-heading">2.9 Transfer of Service Book from parent Department to present Department.</h4>



<p>As per SR- 198, the Service Book is to be maintained for a Government servant from the date of his/her first appointment to Government service and it must be kept in the custody of the Head of Office in which he is serving and transferred with him from office to office.</p>



<h4 class="wp-block-heading">2.10 Need for Medical examination.</h4>



<p>In cases where a person has already been examined by a Medical Board in respect of his previous appointment and if standard of medical examination prescribed for the new post is the same, then he need not be required to undergo a fresh examination.</p>



<h4 class="wp-block-heading">2.11 Verification of Character &amp; Antecedents</h4>



<p>In the case of a person who was originally employed in an office of the Central Government, if the period intervening between date of discharge from his previous office and the date of securing a new appointment, is less than a year, it would be sufficient if the appointing authority, before making the appointment, satisfies itself by a reference to the office in which the candidate was previously employed that (a) that office have verified his character and antecedents; and (b) his conduct while in the employment in that office did not render him unsuitable for employment under Government. If however, more than a year has lapsed after the discharge of the person from his previous office, verification should be dated carried out in full/afresh, in accordance with O.M. No. 18011/9(s)/78-Estt(B) 2nd July, 1982.</p>



<h3 class="wp-block-heading">3.1 Lien</h3>



<p>3.1.1 Lien is defined in FR 9(13). It represents the right of a Government employee to hold a regular post, whether permanent or temporary, either immediately or on the termination of the period of absence. The benefit of having a lien in a post/service/cadre is enjoyed by all employees who are confirmed in the post/service/cadre of entry or who have been promoted to a higher post, declared as having completed the probation where it is prescribed. It is also available to those who have been promoted on regular basis to a higher post where no probation is prescribed under the rules, as the case may be.</p>



<p>3.1.2 The above right will, however, be subject to the condition that the junior-most person in the cadre will be liable to be reverted to the lower post/ service/ cadre if at any time the number of persons so entitled is more than the posts available in that cadre/service.</p>

<h4 class="wp-block-heading">3.2 Lien on a post</h4>



<p>A Government servant who has acquired a lien on a post retains a lien on that post-</p>



<ul class="wp-block-list">
<li>(a) while performing the duties of that post;</li>



<li>(b) while on foreign service, or holding a temporary post or officiating in another post;</li>



<li>(c) during joining time on transfer to another post; unless is he is transferred substantively to a post on lower pay, in which case his lien is transferred the new post from the date on which he is relieved of his duties in the old post;</li>



<li>(d) while on leave; and</li>



<li>(e) while under suspension.</li>
</ul>



<p>A Government servant on acquiring a lien on a post will cease to hold any lien previously acquired on any other post.</p>



<h4 class="wp-block-heading">3.3 Retention of lien for appointment in another Central Government office/State Government</h4>



<p>(i) A permanent Government servant appointed in another Central Government Department/Office/ State Government, has to resign from his parent department unless he reverts to that department within a period of 2 years, or 3 years in unless he exceptional cases. An undertaking to abide by this condition may be taken from him at the time of forwarding of his application to other departments/offices.</p>



<p>(ii) The exceptional cases may be when the Government servant is not confirmed in the department/office where he has joined within a period of 2 years. In such cases he may be permitted to retain the lien in the parent department/ office for one more year. While granting such permission, a fresh undertaking similar to the one indicated above may be taken from the employee.</p>



<p>(iii) Timely action should be taken to ensure extension/ reversion/ resignation of the employees to their parent cadres on completion of the prescribed period of 2/3 years. In cases, where employees do not respond to instructions, suitable action should be initiated against them for violating the agreement/ undertaking given by them as per (i) and (ii) above and for termination of their lien. Adequate opportunity may, however, be given to the officer prior to such consideration.</p>



<p>(iv) Temporary Government servants will be required to severe connections with the Government in case of their selection for outside posts. No lien will be retained in such cases.</p>

<h4 class="wp-block-heading">3.4 Termination of Lien</h4>



<p>3.4.1 A Government servant’s lien on a post may in no circumstances be terminated even with his consent if the result will be to leave him without a lien upon a permanent post. Unless his lien is transferred, a Government servant holding substantively a permanent post retains lien on that post. It will not be correct to deny a Government servant lien to a post he was holding substantively on the plea that he had not requested for retention of lien while submitting his Technical Resignation, or to relieve such a Government servant with a condition on that no lien will be retained.</p>



<p>3.4.2 A Government employee’s lien on a post shall stand terminated on his acquiring a lien on a permanent post (whether under the Central Government or a State Government) outside the cadre on which he is borne.</p>



<h4 class="wp-block-heading">3.4.3 No lien shall be retained:</h4>



<p>a. where a Government servant has proceeded on immediate absorption basis to a post or service outside his service/ cadre/ post in the Government from the date of absorption; and</p>



<p>b. on foreign service/ deputation beyond the maximum limit admissible under the orders of the Government issued from time to time.</p>

<h4 class="wp-block-heading">3.5 Transfer of Lien</h4>



<p>The lien of a Government servant, who is not performing the duties of the post to which the lien pertains, can be transferred to another post in the same cadre subject to the provisions of Fundamental Rule 15.</p>

<h4 class="wp-block-heading">3.6 Joining Time, Joining Time Pay &amp; Travelling Allowance</h4>



<p>Provisions relating to joining time are as follows:</p>



<p>3.6.1 For appointment to posts under the Central Government on results of a competition and/or interview open to Government servants and others, Central Government employees and permanent/ provisionally permanent State Government employees will be entitled to joining time under the CCS(Joining Time) Rules, 1979. Joining time will be included as qualifying service in the new job.</p>



<p>3.6.2 A Government servant on joining time shall be regarded as on duty during that period and shall be entitled to be paid joining time pay equal to the pay which was drawn before relinquishment of charge in the old post. He will also be entitled to Dearness Allowance, if any, appropriate to the joining time pay. In addition, he can also draw compensatory allowances like House Rent Allowance as applicable to the old station from which he was transferred. He shall not be allowed Conveyance Allowance or permanent Travelling Allowance.</p>



<p>3.6.3 For appointments to posts under the Central Government on the basis of results of a competition and /or interview open to Government servants and others, Central Government employees and permanent/ provisionally permanent State Government employees shall be entitled to Transfer Travelling Allowance(TTA). However, temporary Central Government employees with less than 3 years of regular continuous service would not be entitled for TTA, as they are not entitled for joining time pay under Joining Time Rules.</p>



<p>4. All Ministries/ Departments are requested to bring the instructions/ guidelines to the notice of all concerned.</p>

<h2 class="wp-block-heading">Forwarding of Application</h2>



<p>This Department has issued various instructions from time to time regarding forwarding of applications of Government servants for outside employment. It is now decided to consolidate all such instructions at one place for better understanding and guidance. They are as under:</p>



<h3 class="wp-block-heading">GENERAL GUIDELINES</h3>



<p>These guidelines relate to forwarding of applications of Government servants as direct recruit for posts within the Central Government, State Governments, Autonomous/ Statutory Bodies, CPSEs etc. It may be noted that in a case in which a particular employee cannot be spared without serious detriment to important work in hand, public interest would justify withholding of his application even if otherwise the application would have been forwarded. It may be added for information that where for good and sufficient reasons an application is withheld no infringement of any Constitutional right is involved.</p>

<h3 class="wp-block-heading">2. INTERPRETING THE TERM ‘PUBLIC INTEREST’</h3>



<p>a. The Heads of Departments should interpret the term ‘public interest’ strictly and subject to that consideration, the forwarding of applications should be the rule rather than an exception. Ordinarily, every employee (whether scientific and technical or non-scientific and non-technical personnel) should be permitted to apply for an outside post even though he may be holding a permanent post.</p>



<p>b. No distinction need be made between applications made for posts in a Department under the Central government, Autonomous Bodies or sub-ordinate offices, posts under the State Governments, posts in Public Sector Undertakings owned wholly or partly by the Central Government or a State Government and posts in quasi-Government organizations. They should all be treated alike so far as the forwarding of applications is concerned. <strong>If, however, a Government servant desires to apply for a post in a private concern, he should submit his resignation or notice of retirement, as the case may be, before applying for private employment.</strong></p>



<p>c. For this purpose, “scientific and technical personnel”, may be interpreted to mean persons holding posts or belonging to services which have been declared to be scientific or technical posts or scientific or technical service.</p>

<h3 class="wp-block-heading">3. GENERAL PRINCIPLES FOR DEALING WITH SUCH APPLICATIONS</h3>



<p>The general principles to be observed in dealing with such applications are as under:</p>



<p>a. Applications from purely temporary Government servants – Applications from such Government servants should be readily forwarded unless there are compelling grounds of public interest for withholding them.</p>



<p>b. Applications from permanent Government servants – Both permanent non-scientific and non-technical employees as well as permanent scientific and technical employees could be given four opportunities in a year to apply for outside posts, except where withholding of any application is considered by the competent authority to be justified in the public interest. A permanent Government servant cannot justly complain of hardship or harsh treatment if his application for any other post or employment is withheld.</p>



<p>c. Applications of Government servants who have been given some technical training at Government expenses after commencement of service – Such Government servant cannot justifiably complain of hardship if he is not allowed to capitalize the special qualifications so gained by seeking other better employment. Withholding of application in such a case is therefore justifiable.</p>



<p>d. Applications of Government servants belonging to Scheduled Castes and Scheduled Tribes, other than ‘scientific and technical’ personnel — Applications for employment of temporary or permanent Central Government servants belonging to Scheduled Castes and Scheduled Tribes should be readily forwarded except in very rare cases where there may be compelling grounds of public interest for withholding such application. The withholding of application should be the exception rather than the rule in the case of employees belonging to Scheduled Castes and Scheduled Tribes who should be afforded every facility to improve their prospects.</p>



<p>e. Application of Government servants for employment in private business and industrial firm, etc. – Where a Government servant (including a temporary Government servant) seeks permission, to apply for such employment, he should submit his resignation or notice of retirement, as the case may be, before applying for private employment. He cannot complain of hardship if his application is withheld. While a person remains in Government service, the State can legitimately refuse to surrender its claim on his services in favour of a private employer.</p>

<h3 class="wp-block-heading">4. PROCEDURE TO BE FOLLOWED IN THE CASE OF THOSE WHO APPLY FOR POSTS IN THE SAME/ OTHER CENTRAL GOVERNMENT DEPARTMENTS/ STATE GOVERNMENT/ AUTONOMOUS BODY/ CENTRAL PUBLIC SECTOR ENTERPRISES ETC.</h3>



<p>a. Applications from Government servants for employment elsewhere, submitted otherwise than in response to advertisement or circulars inviting applications, should not be forwarded.</p>

<p>b. The applications may be forwarded in accordance with the general principles given in preceding paragraphs, irrespective of whether the post applied for in the other department/office is permanent or temporary.</p>



<p>c. As for temporary Government servants they should, as a matter of rule, be asked to resign from the parent department/office at the time of release from the parent department/office. An undertaking to the effect that he/she will resign from the parent department/office in the event of his/her selection and appointment to the post applied for may be taken from his/her at the time of forwarding the application. This procedure is to be followed even in case of a temporary Government servant applying as a direct recruit for a post in the same organisation.</p>



<p>d. In the case of permanent Government servants, their lien may be retained in the parent department/office for a period of two years in case of the new post being in the Central/State Government. They should either revert to the parent department/office within that period or resign from the parent department/office at the end of that period. An undertaking to abide by these conditions may be taken from them at the time of forwarding the applications to other departments/office. In exceptional cases where it would take some time for the other department/office to confirm such Government servants due to the delay in converting temporary posts into permanent ones, or due to some other administrative reasons, the permanent Government servants may be permitted to retain their lien in the parent department/office for one more year. While granting such permission, a fresh undertaking similar to the one indicated above may be taken from the permanent Government servants by the parent department.</p>



<p>e. Permanent Government servants on their being selected for appointment in an autonomous Body/ CPSE will have to resign before they are permitted to join the new organization. In their case no lien shall be retained and they will be governed by the orders issued by Department of Pensions &amp; Pensioners’ Welfare regulating mobility of personnel between Central Govt. and Autonomous Bodies/ CPSEs etc.</p>



<p>f. The Terms of the bond need not be enforced in the cases of those who apply for appointment elsewhere, other than private employment, through proper channel. However, the obligations under the bond would be carried forward to the new employment. An undertaking to this effect may be obtained from the Govt. servant before he is relieved.</p>

<h3 class="wp-block-heading">5. POSTS ADVERTISED BY UNION PUBLIC SERVICE COMMISSION (UPSC)/STAFF SELECTION COMMISSION (SSC)</h3>



<p>a. Where Government servants apply directly to UPSC/SSC as in the case of direct recruit, they must immediately inform the head of their Office/Department giving details of the examination/post for which they have applied, requesting him to communicate his permission to the Commission directly. If, however, the Head of the Office/Department considers it necessary to withhold the requisite permission, he should inform the Commission accordingly within thirty days of the date of closing for receipt of applications. In case any situation mentioned in para 6 below is existing, the requisite permission should not be granted and UPSC/SSC should be immediately informed of this fact as also the nature of allegations against the Government servant. It should also be made clear that in the event of actual selection of Government servant, he would not be relieved for taking up the appointment, if the charge-sheet/prosecution sanction is issued or a charge-sheet is filed in a court for criminal prosecution, or if the Government servant is placed under suspension.</p>



<p>b. It may be noted that in case of direct recruitment by selection, i.e., “selection by interview”, it is the responsibility of the requisitioning Ministry/Department to bring to the notice of the Commission any point regarding unsuitability of the candidate (Government servant) from the vigilance angle and that the appropriate stage for doing so would be the consultation at the time of preliminary scrutiny, i.e., when the case is referred by the Commission to the Ministry/Departments for the comments of the Ministry’s representatives on the provisional selection of the candidate for interview by the Commission.</p>

<p>c. When once the Administrative Authority has forwarded an application, it is mandatory that the Government employee concerned should be released to take up the new appointment. However, where subsequent to the forwarding of the application, but before selection if exceptional circumstances arise in which it may not be possible to release the official, the fact should be communicated to the Commission as well as to the official concerned. The decision not to release an official should be taken only where the circumstances referred to above are really exceptional.</p>

<h3 class="wp-block-heading">6. CIRCUMSTANCES IN WHICH APPLICATION SHOULD NOT BE FORWARDED</h3>



<p>Application of a Government servant for appointment, whether by direct recruitment, transfer on deputation or transfer, to any other post should not be considered/ forwarded, if:</p>



<p>(a) (i) he is under suspension; or</p>



<p>(ii) disciplinary proceedings are pending against him and a charge sheet has been issued; or</p>



<p>(iii) sanction for prosecution, where necessary has been accorded by the competent authority; or</p>



<p>(iv) where a prosecution sanction is not necessary, a charge-sheet has been filed in a Court of law against him for criminal prosecution.</p>



<p>(v) where he is undergoing a penalty — no application should be forwarded during the currency of such penalty.</p>



<p>(b) When the conduct of a Government servant is under investigation (by the CBI or by the Controlling Department) but the investigation has not reached the stage of issue of charge-sheet or prosecution sanction or filing of charge-sheet for criminal prosecution in a court, the application of such a Government servant may be forwarded together with brief comments on the nature of allegations and it should also be made clear that in the event of actual selection of the Government servant, he would not be released for taking up the appointment, if by that time any of the situations in (a) above arises.</p>

<h3 class="wp-block-heading">7. FORWARDING OF APPLICATIONS FOR POSTS ADVERTISED BY CENTRAL/ PUBLIC SECTOR UNDERTAKINGS/ CENTRAL AUTONOMOUS BODIES</h3>



<p>Applications of Central Government Servants in response to press advertisement for posts in Central Public Enterprises/Autonomous Bodies may be forwarded with a clear understanding with the employee that in the event of their selection for the post applied for they will sever their connections with the Government before joining the Public Sector Undertakings/ Autonomous Bodies. No lien shall be retained in such cases. The relieving order should indicate the period within which the official should join the Public Sector Undertaking/ Autonomous Body. Normally this period should not be more than 15 days. This period may be extended by the competent authority for reasons beyond the control of the official. Necessary notification/ orders accepting the resignation of the Govt. servant from Govt. service should be issued from the actual date of his/her joining the Public Sector Undertaking/Autonomous Body. The period between the date of relieving and the date of joining Public Sector Undertaking/ Autonomous Body can be regulated as leave of the kind due and admissible and if no leave is due, by grant of extra ordinary leave. In case he/she is not able to join the Public Sector Undertaking/Autonomous Body within the period allowed by the competent authority, he/she should report back to the parent office forthwith.</p>

<p><strong>Instructions on exemption from passing the Typewriting Test in respect of Lower Division Clerk (LDCs) who do not belong to Central Secretariat Clerical Service (CSCS)</strong></p>



<p>Note:-</p>



<p>(i) This document is a compilation of all relevant instructions on the subject of “Exemption from passing the Typewriting Test in respect of LDCs who do not belong to Central Secretariat Clerical Service (CSCS)” and therefore is intended to serve as the guide without the need, for anyone to refer to old OMs issued from time to time. The list of such OMs is given in Appendix to this document. In case any reference to the relevant OM is required, the same may be accessed from Archive Section of DOPT’s Website.</p>



<p>(ii) While due care has been taken to compile this document, however, if any omissions or correction are noticed, the same may be brought to the notice of the Department of Personnel &amp; Training.</p>



<ol class="wp-block-list">
<li>The following paragraphs indicate the criteria for grant of exemption from passing the Typewriting Test in respect of LDCs who do not belong to Central Secretariat Clerical Service (CSCS) under the Central Government: </li>
</ol>



<p><strong>(i) To whom applicable :<br /></strong>Instructions for Exemption from passing the Typewriting Test is applicable to Persons appointed as LDCs to posts which do not belong to CSCS whether such appointment is by promotion from erstwhile Group ‘D’ or by direct recruitment through SSC or other-wise or by any other method including appointment on compassionate grounds or on ad-hoc basis.</p>



<p class="has-text-align-right">[Para 2 (1) of DOPT O.M. No. 14020/2/91-Estt.D dated 29.09.1992]</p>



<p><strong>(ii) when exemption may be allowed<br /></strong>(a) If above 45 years of age on the date of their appointment, such persons may be granted exemption from the date of their appointment.</p>



<p>(b) If between the age of 35 years and 45 years at the time of their appointment, such persons may be granted exemption on attaining the age of 45 years.</p>



<p>(c) If below 35 years of age on the date of appointment, such persons may be given exemption after 10 years of service as LDC provided they have made main two genuine attempts to pass the typing test; otherwise they may be granted exemption after attaining the age of 45 years.</p>



<p>(d) Those LDCE who have made two genuine attempts for passing the typing test prior to the issue of O.M. dated 29.9.1992 but have not completed 8 years service as LDC, may be granted exemption from passing the typing test for completion of 8 years of service or on attaining the of 45 years whichever is earlier.</p>

<p><strong>(iii) Typing Test<br /></strong>(a) The Typing test for the purpose of, these orders will be the typing test conducted by the SSC.</p>



<p>(b) The Certificate in typewriting issued under the Hindi Teaching scheme will be treated as equivalent to the Certificate issued by the SSC for the purpose of those Orders.</p>

<p><strong>(iv) Genuine Attempt<br /></strong>The ‘genuine attempt’ referred to above would be determined by the Head of the Department in consultation with the SSC keeping in view that mere appearance in the test or a perfunctory attempt would not constitute a genuine attempt.</p>

<p><strong>(v) Service as LDC<br /></strong>For the purpose of computing service as LDC</p>



<p>(a) Broken periods of service, if any, as LDC on a regular scale of pay may also be taken into account.</p>



<p>(b) Continuous combatant clerical service will also be reckoned in the case of ex-servicemen appointed as LDC.</p>

<p><strong>(vi) Release of increments<br /></strong>(a) On such exemption being granted, the increments of affected persons may be released from the date from which such exemption is granted to them without any arrears for the period prior to the date of exemption, subject to the retention of normal annual date of increment.</p>



<p>(b) On their passing the typing test, the increments may be released from the date of the test without any arrears for the period prior to the date of the Test subject to retention of the normal annual date of increment.</p>

<p><strong>(vii) Eligibility for regularisation/ confirmation<br /></strong>They would also be eligible for regularisation/ confirmation in LDC Grade from a date not earlier than the date of exemption or the date of the test at which they passed the typing test, as the case may be.</p>

<p><strong>(viii) Physically Handicapped:<br /></strong>(a) Physically handicapped persons (now Persons with Disabilities) who are otherwise qualified to hold clerical post and who are certified as being unable to type by the Medical Board attached to Special Employment Exchanges for the Handicapped (or by a Civil Surgeon where there is no such Board) may be exempted from passing the typing test.</p>



<p>(b) The term physically handicapped persons’ does not cover those who are visually handicapped or who are hearing handicapped but covers only those whose physically disability permanently prevents them from typing.</p>

<p><strong>(ix) Surplus Employees :<br /></strong>In respect of Surplus employees redeployed as LDCs the provision for stoppage of increment for not passing the typing test may be enforced from the date of next but one increment after re-deployment.</p>

<p>(x) It is clarified that persons appointed as LDCs to posts which do not belong to CSCS can be considered for promotion only after they have passed the typing test or they have been exempted in accordance with the prescribed procedure from passing it and any such promotion will have prospective effect. If the Recruitment Rules for the post of UDC do not contain such a provision necessary action may be taken to amend the recruitment Rules to incorporate a suitable provision in this regard.</p>

<p>(xi) It is clarified that the above mentioned criteria for grant of exemption from passing the typing test in respect of such LDCs including Physically Handicapped persons/Persons with Disabilities would also be applicable to the test on computers.</p>

<p>(xii) Above Instructions are also extended to Sportspersons recruited against Sports quota under the Scheme of appointment of meritorious sportspersons.</p>

<h3 class="wp-block-heading">Subject: Payment of leave encashment in respect of AIS officers who were under suspension or disciplinary / criminal proceeding (s) pending against them at the time of retirement / superannuation &#8211; reg.</h3>



<p>Sir/Madam,</p>



<p>I am directed to refer to various references received in the Department seeking clarification on the subject noted above and the scope of applicability of 20A(4)(a) of AIS (Leave) Rules, 1955.</p>



<p>2. In this context, it may be noted that 20A(4)(a) of AIS (Leave) Rules, inter-alia, mentions about payment of cash equivalent of leave salary of the applicable leaves standing at the credit of a member of Service (moS), who has been permitted by the State Government to voluntarily retire from service while under suspension or who is retired by the Central Government in public interest while under suspension.</p>



<p>However, reference are being received in this Department seeking clarifications regarding payment of leave encashment to such members of service who were under suspension or against whom the disciplinary/criminal proceeding (s) were pending at the time of retirement / superannuation.</p>



<p>3. In view of the above, the matter has duly been examined under AIS (Leave) Rules, 1955 and other relevant rule provisions / instructions. Accordingly, it is clarified that “<strong>In case of a moS who is under Suspension or against whom Disciplinary / Criminal Proceedings are pending at the time of his retirement / superannuation, the authority competent to grant leave may withhold whole or a part of leave encashment, if in the view of such authority there is a possibility of some money becoming recoverable from him on conclusion of the proceedings against him. On conclusion of the proceedings, he will become eligible to the amount so withheld after adjustment of Government dues, if any</strong>”.</p>



<p>4, The aforesaid clarification may kindly be brought to the notice of all officials / authorities concerned for necessary action.</p>



<p>5. This issues with the approval of Competent Authority.</p>

<p>The undersigned is directed to state that, as informed by the Election Commission of India, vide their letter No. 78/EPS/2022/23180 dated 25.10.2022, General Election for Legislative Assembly of Himachal Pradesh, scheduled to be held as under:-</p>

<p>2. In this regard, it is stated that the guidelines have been issued by this Department, vide OM No. 12/14/99-JCA, dated 10.10.2001, regarding closure of Central Government Offices and grant of paid holiday to all concerned, including the daily wage/casual workers, on the date of general-election. It is reiterated that all the Central Government Offices and the Central Industrial Establishments, shall remain closed in the notified areas, where general-election to the State Legislative Assembly Constituencies are to be conducted, on the date of Poll. The employees concern shall be granted paid holiday on the date of Poll to enable them to exercise their right to vote.</p>
