<p><strong>Facility of Life Certificate by banks from the doorstep of the pensioners</strong></p>

<p>The Ministry of Personnel, Public Grievances &amp; Pensions, Department of Pension and Pensioners’ Welfare (DoPPW), has taken a landmark step to make life easier for senior citizens to submit their Annual Life Certificate for continued pension. The Department vide its circular no. 12/4/2020-P&amp;PW(C)- 6300, dated 17.01.2020 has issued directions to all the Pension Disbursing Banks to send SMSs/Emails to all their pensioners on 24th October, 1st November, 15th November and 25th November every year reminding them to submit their Annual Life Certificates by 30th November.</p>



<p>The Department for stricter monitoring in order to ensure that no pensioners are left out, directed all Pension Disbursing Banks to make an exception list as on 1st December every year of those pensioners who fail to submit their Life Certificate and issue another SMS/Email to them for submitting the Life Certificate. The bank in addition will also ask such pensioners through SMS/Email as to whether they are interested in submission of Life Certificate through a chargeable doorstep service, the charge not exceeding Rs.60/-.</p>



<p>The Central Pension Processing Cells (CPPC) of the <a rel="noreferrer noopener" aria-label="Pension (opens in a new tab)" href="https://centralgovernmentnews.com/category/pension/" target="_blank">Pension</a> Disbursing Banks shall now be duty bound to submit a report to DoPPW in the month of January, February &amp; March respectively, indicating the total number of pensioners who have not given their Life Certificate along with a breakup of the Certificates submitted physically and through Digital means.</p>

<p>The above is a landmark step from the side of the Central Government showing due care for pensioners. This step is in addition to the order issued recently dated 18.07.2019 vide which all pensioners age 80 years and above have been given an exclusive window to submit their Life Certificate w.e.f. 1st October every year instead of 1st November every year.</p>

<p>Subject:- <strong>Submission of Life Certificate.</strong></p>



<p>It has been the experience of this Department that the Senior Pensioners i.e. the pensioners 80 years and above are facing a lot of difficulties standing in queues while giving the Life Certificates in November. It has been under the consideration of the Government to provide some relief to such pensioners.</p>



<p>2. It has therefore, been decided by the Government, that Senior Pensioners aged 80 years and above be allowed to give their Life Certificate w.e.f 1st October every year instead of November which would be valid till 30th November of the subsequent year.</p>



<p>3. The remaining pensioners below the age of 80 years may continue to give their Life Certificate in November as per existing provisions of CPAO Scheme booklet.</p>

<p>Sub :- <strong>Revision of pension w.e.f. 1.1.2006 of Pre-2006 pensioners who retired from the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.</strong></p>



<p>Instructions have been issued vide this Department’s OM of even number dated 4.1.2019 that for the purpose of revision of pension/family pension w.e.f. 1.1.2006 under para 4.2 of the O.M. dated 1.9.2008, the Grade Pay of Rs. 4600/- may be considered as the corresponding Grade pay in the case of pre-2006 pensioners who retired/died in the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.</p>



<p>It was also provided that the revised pension w.c.f. 1,1.2006 in terms of para 4.2 of OM dated 1.9.2008, for the pre-2006 pensioners who retired from the pay scale of Rs, 6500-10500/- in the 5 th CPC or equivalent pay scales in the earlier Pay Commissions would be Rs. 8345/-.</p>



<p>The entries at serial number 13 in the annexure of this Department’s OM No. 38/37/08- P&amp;PW(A) dated 28.1.2013 were also revised accordingly.</p>



<p>2. This Department has issued concordance tables for revision of pension, w.e.f. 1.1.2016, of pre-2016 pensioners by notional fixation of pay in the 7th CPC vide this Departments OM dated 6.7.2017, Tables No.24 &amp; 25 in these concordance tables indicated the revised pension/family pension based on the corresponding 6th CPC grade pay of Rs. 4200/- in respect of pre-2006 pensioners/family pensioners who retired/died in the 5th CPC scale of 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.  Consequent on the decision to consider the Grade Pay of Rs. 4600/- as the corresponding Grade pay in the case of pre-2006 pensioners who retired/died in the 5th CPC scale of<strong> Rs. 6500-10500/-</strong> or equivalent pay scale in the earlier Pay Commission periods and based on the fitment tables provided by Ministry of Finance (Department of Expenditure), Tables No.24 &amp; 25 have been revised. Accordingly, revised concordance Tables No.24 &amp; 25 arc enclosed herewith.</p>



<p>3. All the Ministries/Departments are requested to revise pension/family pension w.e.f. 1.1.2016 in respect of pre-2006 pensioner family pensioners who retired/died in the 5th CPC scale of <strong>Rs. 6500-10500/- </strong>or equivalent pay scale in the earlier Pay Commission periods using the concordance tables enclosed herewith. The other provisions / instructions for revision of pension of pre-2016 pensioners, as contained in this Department’s OM of even number dated 12.5.2017 and 6.7.2017 will remain unchanged.</p>



<p>4. This issues with the approval of Ministry of Finance (Department of Expenditure) vide their OM No. 30-1/33(c)/ 2016-1.C./E.III,A dated 28.6.2019</p>

<p>Sub :- <strong>Grant of Invalid Pension under Rule 38 of the Central Civil Services (Pension) Rules, 1972 &#8211; Clarification regarding</strong></p>



<p>The undersigned is directed to say that Rule 38 and Rule 49 of the Central Civil Services (Pension) Rules, 1972 have been amended vide Notification No. 21/1/2016-P&amp;PW(F) dated 4th January, 2019 (copy enclosed). The proviso to the amended Rule 38 of the CCS(Pension) Rules provides that a Government servant_ who retires from service on account of any bodily or mental infirmity which permanently incapacitates him for the service before completing qualifying service of ten years, may also be granted invalid pension in accordance with sub-rule (2) of rule 49, subject to the conditions that the Government servant:</p>



<ul class="wp-block-list"><li>(a) was examined by the appropriate medical authority either before his appointment or after his appointment to the service or post and was declared fit by that authority for Government sell/ice, and</li><li>(b) fulfils all other conditions mentioned in this rule for grant of invalid pension.</li></ul>



<p>In this connection, it is clarified that the condition of qualifying service of ten years for grant of pension under Rule 49(2) of the CCS (Pension) Rules, 1972 shall not be applicable in the case of a Government servant retiring on Invalid Pension on account of any bodily or mental infirmity, under Rule -A. Accordingly, Invalid Pension at the rate of 50% of emoluments or average emoluments, whichever is more beneficial, subject to a minimum of nine thousand rupees per mensem and maximum of one lakh twenty five thousand rupees per mensem, shall be payable to a Government servant who retires under Rule 38 of CCS (Pension) Rules, 1972 even before completing a qualifying service of ten years.</p>



<p>All Ministries/Departments are requested that the above clarification ma) be brought to the notice of Fiends of Department, Attached and Subordinate Offices, Controllers of Accounts. Pay &amp; Accounts Offices. etc, under them.</p>

<p>Subject: <strong>Revision of disability pension and family pension under CCS (EOP) Rules to pre 1996 and pre-2006 disability pensioners and family pension under CCS(EOP)Rules &#8211; inclusion of Non-practicing Allowance (NPA) for revision or disability pension and family pension covered under CCS(FOP) Rules to retired medical Officers &#8211; regarding</strong></p>
<p>The undersigned is directed to say that orders were issued vide this Department’s OM No 45122/1997-P&amp;PW (C) dated 11.9.2001 for revision of disability pension/Family pension under CCS(E0P)Rules in respect of Pre-1996 pensioners. These orders inter-alia provided for revision of Pension of Pre-1996 Disability Pensioners and family pensioners under EO.P Rules on the basis of the minimum basic pay in the revised pay scale applicable w.e.f 1 1.1996.</p>
<p>2. Vide this Department&#8217;s OM No. 45/3/2008-P&amp;PW(F) dated 30.9.2010, as amended vide OMs dated 20.11.2014, 29 4.2016 and 8.8.2016, orders were issued for revision of pre-2006 Disability Pensioners and family pensioners under EOP Rules on the basis of the minimum of the pay in the pay band plus grade pay or minimum of pay in the revised scare of pay applicable from 1.1.1996 corresponding to the pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No. 1/1/2008-IC dated 30/8/2008.Revision of disability pension and family pension under CCS(EOP)Rules &#8211; inclusion of NPA</p>
<p>3, In implementation of the judgment dated 27.11.2013 of Hon&#8217;ble Supreme Court in CA No. 10640-36 of 2013 and other connected matters, orders were issued. vide this Department&#8217;s OM No. 38/31/2011-P&amp;PW (A) (Vol.IV) dated 14.10.2014 that in the case of Pre-1996 retired Medical Officers, NPA at the rate of 25% shall be added to the minimum of the revised scale of pay as on 1.1.1996 corresponding to pre-1996 pay scales from which the pensioner has retired in cases where consolidated pension/family pension was to stepped up based on minimum of revised pay scales.</p>
<p>4. Similarly, orders were issued vide OM NO.38/31/2011-P&amp;PW(A) (Vol-IV) dated the 18th February, 2015 that in the case of pre-2006 retired Medical Officers, NPA @ 25% would be added to the minimum of the pay in the revised pay band plus grade pay (or minimum of pay in the revised pay scale in the case of HAG and above ) as on 01.01.2006 corresponding to the pre-revised pay scales from which they retired in case where pension / family pension is to be stepped up to 50% / 30% of the minimum pay respectively</p>
<p>5. It is hereby clarified that for the purpose of revision of Disability Pension/family pension of the pre 1996 pensioners under CCS(EOP) Rules also, NPA at the rate of 25% shall be added .to the minimum of the pay in the revised scale of pay on 01,01.1996 corresponding to the Pre 1996 pay scales in respect of the retired Medical Officers. Similarly, for the purpose of revision of Disability pension/Family pension of pre-2006 pensioners under CCS(EOP)Rules, NPA @25% shall be added to the minimum of the pay in the pay band plus Grade pay or minimum of the pay in the revised pay scale applicable from 01.01.2006 corresponding to the pay scale from which the pensioner retired.</p>
<p>6. The emoluments (minimum pay + NPA) to be reckoned for calculation of the Disability Pension/Family pension in terms of the above provisions would not exceed Rs. 30,000/- w.e.f 1.1,1996 and Rs.85,000 w.e.f 1.1.2006.</p>
<p>7. The other terms and conditions stipulated in this Department’s OM No. OM No. 45/22/1997-P&amp;PW (C) dated 11.9.2001 and OM No 45/3/2008-P&amp;PW(F) dated 30,9.2010, 20.11.2014, 29.4.2016 and 8.8.2016 shall remain unchanged.</p>
<p>8. This issues with the approval of Ministry of Finance, Department of Expenditure vide their ID No.1(3)/E-V/2018 dated 08.08.2018</p>

<p><strong><span style="text-decoration: underline;">Inviting bids for selection of an Agency for print creative work of Advertisement on All India Pension Adalat </span></strong></p>
<ol>
<li>A quarter page Advertisement containing major pension reforms and holding of all India Pension Adalat is to be published in leading newspapers. The Advertisement will contain graphics, photographs, reforms, etc. The content of Advertisement will be provided to the selected agency by this Ministry. The Advertisement is to be published within 7 days from the work order.</li>
</ol>
<ol start="2">
<li>Bids are invited from the agencies empanelled with Bureau of Outreach &amp; Communication (BoC) &#8211; (erstwhile known as DAVP- Directorate of Advertising and Visual publicity) for executing the work of print creative, designing etc. of the Advertisement. The empanelment would be considered on the basis of the list of agencies as available on BoC website on last date of acceptance of application by DOPPW i.e. 4.9.2018. It may be noted that this is not a bid seeking the price quote. The agencies will be required to execute the work as per the BoC rates and BoC guidelines.</li>
</ol>

<li>Interested agencies may submit a concept paper containing the design of the advertisement to this latest by <strong>12 Noon on 04.09.2018 </strong>in closed envelop to the Manoj Kumar, Under Secretary DOPPW H-9, 3rd floor, Lok Nayak Bhawan, New Delhi. Offers received after the said date time would not be considered</li>
</ol>

<li>Selection of an agency will be made on the basis of their experience in this regard, quality of concept paper etc.</li>
<li>The concept paper is only to assess the capabilities of the agency/vendor. Further, DOPPW reserves the right not to consider any agency without assigning any reason.</li>

<p>Reference:- i) Resolution of GOI No. 38/37/08-P&amp;PW (A) dated 29-8-08 &amp; OM Dated 1-9-08,<br />
ii) Para 5 of DOP&amp;PW O.M. F.No. 38/37/08-P&amp;PW (A) dated 11-2-2009 &#8211; (which has been quashed by various Courts but not withdrawn by the DOP&amp;PW)<br />
iii) DOP&amp;PW O.M. F.No. 38/37/08-P&amp;PW (A) dated 30-7-2015</p>
<p>Dear Sir,<br />
We seek your benign intervention in the following matter of serious injustice with a section of Pre-2006 Central Government Pensioners:</p>
<p>1. Sixth Pay Commission had Merged and upgraded some posts keeping in view their duties &amp; responsibilities. The recommendations of the Sixth CPC were accepted by the Government vide Resolution of the Government Notified on 29-8-2008 and orders were issued thereon vide DOPT &amp; DOPPW vide OMs dated 1-9-2008.</p>
<p>2. DOP&amp;PW subsequently modified these orders vide O.M. File No. 38/37/08-P&amp;PW (A) dated 11-2-2009 and ordered that the benefit of upgrading of posts by Sixth Pay Commission shall not be given for the fixation of Revised Pension of Pre-2006 Pensioners.</p>
<p>3. Above cited orders of DOP&amp;PW (dated 11-2-2009) had been quashed by the various Courts including the Apex Court, which inter-alia directed that &#8220;The fixation (of Pension) … will be subject to the provision that the revised pension, in no case, shall be lower than 50% of the sum of the minimum of the pay in the pay band and the grade pay thereon corresponding to the pre-revised pay scale from which the pensioner had retired.&#8221; DOP&amp;PW issued the orders thereon vide OM dated 1-9-2008.</p>
<p>4. DOP&amp;PW vide OM No.38/37/08-P&amp;PW(A) Dated 30th July, 2015, in compliance with the judicial pronouncements, had decided that the pension/family pension of all pre-2006 pensioners/family pensioners may be revised in accordance with this Department’s OM No.38/37/08-P&amp;PW(A) dated 28.1.2013 with effect from 1.1.2006.</p>
<p>5. Para 5 of DOPPW OM dated 11-2-2009 had specifically been quashed by various Courts &#8211; including the High Court of New Delhi in WP(C) 3035/2016 dated 3-8-2016 in Ram Phal-vs-Union of India &amp; Ors and CAT Bangalore in CP 237/2015 in OA 231/2013 (Parthasarthy-Vs-Union of India).</p>
<p>6. High Court of Kerala at Ernakulam had held as under in OP (CAT).No. 169 of 2015 (Z) in its judgment dated 18th January, 2016 UNION OF INDIA vs N.R.PURUSHOTHAMAN PILLAI:<br />
&#8220;The resultant position that emerges from the pronouncement of the Central Administrative Tribunal as well as the different High Courts and the Apex Court is that, computation of pension in the matter of implementation of the 6th Pay Commission Report has to be at 50% of the pay scale with respect to the scale of pay applicable to the post in question and not to the corresponding scale of pay to the one at which the incumbent has retired.&#8221;</p>
<p>7. Regrettably the benefit of upgrading of posts was still not given to the Pre-2006 Pensioners in spite of the above cited judgments of various Courts. The benefit of the Court judgments on this had been restricted only to the Petitioners and not to other similarly placed Pre-2006 Pensioners.</p>
<p>8. This is totally discriminatory and violates Article 14 of the Constitution as well as under the settled law that the decisions taken in one specific case either by the Judiciary or the Govt. should be applied to all other similar cases without forcing the other employees or pensioners to approach the court of law for an identical remedy or relief.</p>
<p>9. Delhi High Court in W.P.(C) 8012/2013 had held that &#8220;policy decision of the Government in the OM dated September 01, 2008 to fix pension for all categories of pensioners did not classify post of pre January 01, 2006 retirees and all were entitled to pension as per a common formula&#8221;</p>
<p>10. It is, therefore, requested that Pre-2006 Pensioners be given the benefit of upgraded Pay Band and Grade Pay of the post from which they retired so that minimum pension be not lower than 50% of the pay in the revised pay band plus the grade pay corresponding to the post from which the pensioner retired – as per DOPPW OM dated 30-7-2015.</p>

<p>Item no. 15,16,17&amp;21:- Parity/ Modified Parity in pension/revised pension/family pension of all pre-1996 retirees with those who retired on or after 01.01.2006 .</p>
<p>In accordance with an Office Memorandum dated 01.09.2008, for revision of the pension of the pre-2006 pensioners, the pension/family pension of existing pre-2006 pensioners/family pensioners was to be consolidated with effect from 01.01.2006 by adding together (i) The existing pension/family pension (ii) Dearness Pension, where applicable (iii) Dearness relief upto AICPI (IW) average index 536 (Base year 19823100) i.e. @ 24% of Basic Pension/Basic family pension plus dearness pension as admissible and (iv) fitment weightage @ 40% of the existing pension/family pension. Para 4.2 of the Office Memorandum dated 01.09.2008 provided that the fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than fifty per cent of the minimum of the pay in the Pay Band plus the Grade Pay corresponding to the pre-revised Pay Scale from which the pensioner had retired and in the case of HAG+ and above scales, this will be fifty per cent of the minimum of the revised Pay Scale.</p>
<p>2. Clarification on various provisions of the OM dated 1.9.2008 were issued vide Department of Pension and PW OM No.38/37/08-P&amp;PW(A) pt. 1 dated 3.10.2008. In regard to Para 4.2 of the OM dated 1.9.2008 the following clarification was issued:-</p>
<p>&#8220;The pension calculated at 50% of the minimum of pay in the pay band plus grade pay would be calculated at the minimum of the pay in the pay band (irrespective of the pre-revised scale of pay) plus the grade pay corresponding to the pre-revised pay scale. For example, if a pensioner had retired in the pro-revised scale of pay of Rs.18400-22400, the corresponding pay band being Rs. 37400-67000 and the corresponding grade pay being Rs. 10,000/- p.m., his minimum guaranteed pension would be 50% of Rs. 37,4001 Rs. 10,000 (i.e. Rs. 23,700).</p>
<p>The pension will be reduced pro-rata, where the pensioner had less than the required service for full pension as per rule 49 of the CCS(Pension) Rules, 1972 as applicable on 01.01.2006 and in no case it will be less than Rs. 3500/- p.m.</p>
<p>In case the pension consolidated as per para 4.1 of OM.No.38/37/08-P&amp;PW(A) dated 1.9.2008 is higher than the pension calculated in the manner indicated above, the same (higher consolidated pension) will be treated as Basic Pension.&#8221;</p>
<p>3. In the Agenda item, the JCM (Staff side) claimed that the revised pension/family pension of all pic-2006 pensioners/family pensioners would not be less than 50% of the minimum of the pay band l grade pay, corresponding to the pre-revised pay scale from which pensioner had retired, as arrived at with reference to the fitment tables annexed to Ministry of Finance, Department of Expenditure&#8217;s O.M. No. l/l/2008-IC dated 30.8.2008.</p>
<p>4. In the last meeting of the Anomaly Committee the staff side argued that a reading of the recommendation of the Sixth Pay Commission on the matter indicated that the intent of the Pay Commission was to grant modified parity to pro-01.01.2006 pensioners by allowing the same fitment benefit as is being recommended to the existing Government employees subject to the provision that revised pension shall not be lower than 50% of the minimum of the pay in the pay band prescribed for the grade pay and the sum of the grade pay with reference to the minimum of the pay band plus the grade pay which is not consistent with the recommendation of the Sixth CPC. Officer of Department of Expenditure stated that this was not the intent of me recommendation of the Pay Commission. After some discussion, the Staff Side request the Official Side to examine the matter once again.</p>
<p>5. After the above meeting of the Anomaly Committee, the following decisions have been taken by the Government:</p>
<blockquote><p>(i) Orders were issued vide this Department&#8217;s OM of even number dated 28.1.2013 for stepping up of pension of pre-2006 pensioners w.e.f. 24.9.2012 to 50% of the minimum of pay in the pay band and grade pay corresponding to pre-revised pay scale from which the pensioner retired. Para 5 of this OM provides that in case the consolidated pension/family pension calculated as per para 4.1 of OM. No.38/37/08-P&amp;PW (A) dated 192008 is higher than the pension/family pension calculated in the manner indicated in the OM. dated 28.1.2013, the same (higher consolidated pension/family pension) will continue to be treated as basic pension/family pension.</p>
<p>(ii) Subsequently, in compliance of an order dated 1.11.2oll of the Hon&#8217;ble CAT, Principal Bench in OA No. 655/2010, order dated 29.4.2013 of Hon&#8217;ble, High Court of Delhi in WP (C) No. 1535/2012 and order dated 17.3.2015 of Hon&#8217;ble Supreme Court in SLP (C) No. 36148/2013, order were issued vide this Department&#8217;s 4 O.M. No.38/37/O8-P&amp;PW(A) dated 30.7.2015 that the pension/family pension of all pre ~ 2006 pensioners/family pensioners may be revised in accordance with this Department&#8217;s O.M. No.38/3 7/08-P&amp;PW(A) dated 28.1.2013 with effect from 1.1.2006 instead of24.9.2012.</p>
<p>(iii) Vide OM. No.38/37/08-P&amp;PW(A) dated 6.4.2016, it was decided that the revised consolidated pension of pre-2006 pensioners shall not be lower than 50% of the minimum of the pay in the Pay Band and the grade pay (wherever applicable) corresponding to the pre-revised pay scale as per fitment table without pro-rata reduction of pension even if they had qualifying service of less than 33 years at the time of retirement.</p></blockquote>
<p>6. With the issue of the aforesaid orders, the demand of the staff side in regard to modified parity to pre-2006 pensioners has been accepted and implemented.</p>

<p>Central Government Employees will be engaged as Inspecting Officers and of the Flying Squad for conducting/ supervising of examinations of Staff Selection Commission at various Centres Places. The retired officials will also be paid honorarium. DoPPW has issued a Notice to all Retired Central Staffs and requested them to register in SANKALP</p>
<p>Department of Pension &amp; Pensioners Welfare i.e DoPPW has been requested by Staff Selection Commission (HQ), New Delhi for a list of central government pensioners for engaging them as Inspecting Officers and of the Flying Squad for conducting/supervising of examinations of Staff Selection Commission at various Centres/places. The retired officials will also be paid honorarium.</p>
<p>2. DoPPW has launched the intiative &#8220;SANKALP&#8221; for retired central government civil pensioners/retiring employees for voluntary activities for useful intervention in society so that their skill, expertise and knowledge can be used.</p>
<p>3. Al the employees retiring from the BHAVISHYA system hereby requested to register themselves on &#8220;SANKALP&#8221;. For this. they can visit our website i.e www.persmin.gov.in/pension.asp and www.pensionersportal.gov.in</p>
