<p>Subject:<strong> Keeping double/additional Transport Allowance out of the 50% /35% ceiling relating to Divyangjan &#8211; reg</strong></p>



<p>The undersigned is directed to refer to the order of the office of Chief Commissioner for Persons with Disabilities under the Ministry of Social, Justice and Empowerment, in the matter of Sh. K. Shiva Reddy &amp; ors., DM finance, a visually impaired employee case No. 11927/1024/2020 dated 12.02.2021 recommending to amend DPE OM no. W-02/0030/2018-DPE (WC) dated 10.07.2018, so as to include Additional Transport Allowance / Double Transport Allowance in the list of perks / allowance / benefits exempted from upper ceiling limit.</p>



<p>2. DPE OM dated 03.08.2017 authorizes to the Board of Director to decide on perks and allowances and states that all allowances are within the ceiling of 35% of Basic Pay except the allowances mentioned therein.</p>



<p>3. The matter has been examined in consultation with the DoE and it has been decided as under:</p>



<ul class="wp-block-list">
<li>1) The PwD employees in terms of DoE OM dated 07.07.2017, may be paid double the transport allowance to facilitate their accessibility to &amp; from the office.</li>



<li>2) Additional amount of Transport allowance payable to PwD employees in terms of DoE OM dated 07.07.2017, is to be kept outside the overall ceiling of cafeteria approach.</li>



<li>4. Accordingly, Para 3(vi) of DPE OMs dated 10.07.2018 and Para 9 of DPE OM dated 03.08.2017 stand amended.</li>



<li>5. CPSEs are advised to fix or review amount of Transport Allowance to be reasonable within set of allowances under the cafeteria approach in consultation with their concerned Administrative Ministry/ Department for the purpose of calculation of double/ additional Transport Allowance admissible as above, keeping in view the terms of DoE OM dated 07.07.2017 and DPE guidelines.</li>



<li>6. All administrative Ministries/Departments of the Government of India are requested to bring the foregoing to the notice of the CPSEs under their administrative control for necessary action at their end.</li>



<li>7 This issues with the approval of competent authority.</li>

<h3 class="wp-block-heading">Subject: Guidelines for conducting written examination for persons with specified disabilities covered under the definition of Section 2(s) of the RPwD Act, 2016 but not covered under the definition of Section 2(r) of the said Act, i.e. persons having less than 40% disability and having difficulty in writing.</h3>



<p>The undersigned is directed to say that this Department has issued guidelines for conducting written examination for persons with benchmark disabilities (i.e. with 40% or more disability, for whom the benefit of reservation in Government posts are allowed) on 29.08.2018 and corrigendum dated 08.02.2019 which inter-alia, provides for grant of scribe and compensatory time. Hon’ble Supreme Court in its order dated 11.02.2021 in the matter of Shri Vikash Kumar Vs UPSC and others has directed this Department to frame proper guidelines which would regulate and facilitate the grant of a facility of a scribe to persons with disability within the meaning of Section 2 (s) of the RPwD Act, 2016, where the nature of disability operates to impose a barrier to the candidate writing an examination. These guidelines should also prescribe appropriate norms to ensure that condition of the candidate is duly certified by such competent medical authority as may be prescribed so as to ensure that only genuine candidates in need of the facility are able to avail it.</p>



<p>2. Keeping in view the above order of the Hon’ble Supreme Court, an Expert Committee was constituted to consider the issue and suggest guidelines accordingly. The Committee noted that there are various types of clinical problems that can affect the writing capacity. After careful consideration of the matter, the Committee recommended that sole criteria for grant of scribe and compensatory time should be based on assessment of the capability of a person to write.</p>



<p>3. The Committee accordingly recommended the following guidelines for conducting written examination for persons with specified disabilities covered under the definition of Section 2(s) of the RPwD Act,2016 but not covered under the definition of Section 2(r) of the said Act, i.e. persons having less than 40% disability and having difficulty in writing: –</p>



<p>(a) These guidelines may be called as Guidelines for conducting written examination for persons with specified disabilities covered under the definition of Section 2(s) of the RPwD Act, 2016 but not covered under the definition of Section 2(r) of the said Act, i.e. persons having less than 40% disability and having difficulty in writing.</p>



<p>(b) The facility of scribe and/or compensatory time shall be granted solely to those having difficulty in writing subject to production of a certificate to the effect that person concerned has limitation to write and that scribe is essential to write examination on his/her behalf from the competent medical authority of a Government healthcare institution as per proforma at&nbsp;<strong>Appendix-I</strong>.</p>



<p>(c) The medical authority for the purpose of certification as mentioned in point (b) above should be a multi-member authority comprising the following:-</p>



<ul class="wp-block-list"><li>i. Chief Medical officer/ Civil Surgeon/ Chief District Medical Officer….. Chairperson</li><li>ii. Orthopaedic/ PMR specialist</li><li>iii. Neurologist, if available*</li><li>iv. Clinical Psychologist/ Rehabilitation Psychologist/ Psychiatrist/ Special Educator</li><li>v. Occupational therapist, if available*</li><li>vi. Any other expert based on the condition of the candidate as may be nominated by the Chairperson.</li></ul>



<p>(* the Chief Medical Officer/ Civil Surgeon/ Chief District Medical Officer may make full efforts for inclusion of neurologists, occupational therapist from the nearest District or the Medical College/ Institute, if the same is not available in the District)”</p>



<p>(d) The candidate should have the discretion of opting for his own scribe or request the Examination Body for the same. The examination body may also identify the scribe to make panels at the District/ Division/ State level as per the requirements of the examination. In later instances the candidates should be allowed to meet the scribe two days before the examination so that the candidates get a chance to check and verify whether the scribe is suitable or not.</p>



<p>(e) In case the examination body provides the scribe, it shall be ensured that qualification of the scribe should not be more than the minimum qualification criteria of the examination. However, the qualification of the scribe should always be matriculate or above.</p>



<p>In case the candidate is allowed to bring his own scribe, the qualification of the scribe should be one step below the qualification of the candidate taking examination. The person opting for own scribe should submit details of the own scribe as per proforma at&nbsp;<strong>Appendix-II</strong>.</p>



<p>(f) There should also be flexibility in accommodating any change in scribe in case of emergency. The candidates should also be allowed to take different scribe for writing different papers especially for languages. However, there can be only one scribe per subject.</p>



<p>(g) The candidate should be allowed to use aids and assistive devices such as prosthetics &amp; orthotics, hearing aid as mentioned in para 2 of the certificate issued by medical authority as per Appendix I.</p>



<p>(h) Compensatory time not less than 20 minutes per hour of the examination should be allowed for persons who are eligible for getting scribe. In case the duration of the examination is less than an hour, then the duration of the compensatory time should be allowed on pro-rata basis. Compensatory time should not be less than 5 minutes and should be in the multiple of 5.</p>



<ul class="wp-block-list"><li>(i) The examination bodies shall modify their application forms to incorporate specific needs of this category of persons. In case, any incident has been reported after filling up the form, the examination bodies shall inform the candidates to obtain medical certificate as per these guidelines for facilitating grant of scribe and/or compensatory time.</li><li>(j) As far as possible the examination for such persons may be held at ground floor. The examination centres should be accessible for persons with disabilities.</li><li>(k) These guidelines are applicable to written examinations conducted by central recruitment agencies as well as academic institutions. The States/UTs may adopt these guidelines or issue similar guidelines to maintain uniformity.</li><li>(l) These guidelines are independent of the Guidelines for conducting written examination for persons with benchmark disabilities issued by the Department of Empowerment of Persons with Disabilities on 29.08.2018.</li><li>(m) The examining bodies shall ensure strict vigilance to check misuse of facility of scribe.</li></ul>



<p>4. All the recruitment agencies, Academics/Examination Bodies etc. under the administrative control of each Ministry/Department may be advised appropriately to ensure compliance of implementing these guidelines.</p>



<p>5. The above guidelines are issued with the approval of Hon’ble Minister (Social Justice &amp; Empowerment).</p>

<h3 class="wp-block-heading" id="subject-keeping-double-additional-transport-allowance-out-of-the-50-35-ceiling-relating-to-divyangjan-reg">Subject: Keeping double/additional Transport Allowance out of the 50% /35% ceiling relating to Divyangjan &#8211; reg</h3>



<p>The undersigned is directed to refer to the order of the office of Chief Commissioner for Persons with Disabilities under the Ministry of Social, Justice and Empowerment, in the matter of Sh. K. Shiva Reddy &amp; ors., DM finance, a visually impaired employee case No. 11927/1024/2020 dated 12.02.2021 recommending to amend DPE OM no. W-02/0030/2018-DPE (WC) dated 10.07.2018, so as to include Additional Transport Allowance / Double Transport Allowance in the list of perks / allowance / benefits exempted from upper ceiling limit.</p>



<p>2. DPE OM dated 03.08.2017 authorizes to the Board of Director to decide on perks and allowances and states that all allowances are within the ceiling of<strong>&nbsp;35%</strong>&nbsp;of Basic Pay except the allowances mentioned therein.</p>



<p>3. The matter has been examined in consultation with the DoE and it has been decided as under:</p>



<p>1) The PwD employees in terms of DoE OM dated 07.07.2017, may be paid double the transport allowance to facilitate their accessibility to &amp; fro the office.</p>



<p>2) Additional amount of Transport allowance payable to PwD employees in terms of DoE OM dated 07.07.2017, is to be kept outside the overall ceiling of cafeteria approach.</p>



<p>4. Accordingly, Para 3(vi) of DPE OMs dated 10.07.2018 and Para 9 of DPE OM dated 03.08.2017 stand amended.</p>



<p>5. CPSEs are advised to fix or review amount of Transport Allowance to be reasonable within set of allowances under the cafeteria approach in consultation with their concerned Administrative Ministry/ Department for the purpose of calculation of double/ additional Transport Allowance admissible as above, keeping in view the terms of DoE OM dated 07.07.2017 and DPE guidelines.</p>



<p>6. All administrative Ministries/Departments of the Government of India are requested to bring the foregoing to the notice of the CPSEs under their administrative control for necessary action at their end.</p>



<p>7. This issues with the approval of competent authority.</p>

<p><strong>No. 38-16/2020-DD-III.</strong>&#8211; Whereas Section 33 of the repealed Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (hereinafter, after referred to as repealed Act) provided for reservation of not less than 3% for persons with disabilities in the three categories namely, (i) locomotor disability including cerebral palsy, (ii) visual impairment (low vision &amp; blindness) and (iii) hearing impairment.</p>



<p>2. And whereas, section 32 of the repealed Act mandated the appropriate Government to identify posts to be reserved for persons with disabilities and review such list at periodic interval not exceeding three years.</p>



<p>3. And whereas, in pursuance of the above provisions of the repealed Act, the Central Government last notified the list of posts suitable for persons with disabilities through notification No. 16-15/2010-DD-III dated 29th July, 2013.</p>



<p>4. And whereas, the Ministry of Social Justice and Empowerment, Government of India, in pursuance of the provisions of sections 32 and 33 of the repealed Act (since repealed on 15.06.2017) had constituted an Expert Committee on the 19th November, 2015 under the chairpersonship of the Secretary, Department of Empowerment of Persons with Disabilities to review the list of Central Government posts identified suitable for Persons with Disabilities. Copy of the said order is at Annexure-A.</p>



<p>5. And whereas, the Expert Committee met on the 9th December, 2015 and decided that one Sub-Committee should be constituted for each of the category of disabilities which are provided reservation under section 33 of the said repealed Act and accordingly, following three Sub-Committees were constituted, namely:</p>



<p><strong>i. Sub-Committee for locomotor disability<br />ii. Sub-Committee for hearing impaired<br />iii. Sub-Committee for visually impaired</strong></p>



<p>6. And whereas, the Central Government notified the Rights of Persons with Disabilities Act, 2016 (hereinafter referred as “the Act”) which inter-alia under sub-section (1) of section 34 extended the benefit of reservation to persons with benchmark disabilities in th new category of (i) autism, specific learning disability, mental illness and intellectual disabilities and (ii) multiple disabilities amongst the various categories mentioned in the said section of the Act.</p>



<p>7. And whereas, Section 33 of the said Act mandates the appropriate Government to constitute expert committee for identification of posts suitable for persons with benchmark disabilities and accordingly, following two sub-committees were further constituted to take care of identification of posts suitable for new categories included under the Act, namely; (i) Sub-Committee for autism, intellectual disabilities, specific learning disability and mental illness, and (ii) Sub-Committee for multiple disabilities.</p>



<p>8. And whereas, all the Sub-Committees reviewed the posts notified through notification No.16-15/2010-DD-III dated the 29th July 2013, and submitted their reports and the Expert Committee considered the reports of the Sub-Committees in its meeting held on 19th November 2019, finalized its recommendations and submitted its report to the Central Government for consideration.</p>



<p>9. Now, therefore, in exercise of powers conferred upon section 33 of the said Act and based on the recommendations of the Expert Committee, the Central Government hereby notifies the gist of the report, which is at Annexure-B and the list of Central Government posts in Group A, B, C and D identified suitable for persons with benchmark disabilities which is at Annexure-C for information and further necessary action by all cadre controlling authorities in the Central Government.</p>



<p>10. The said list supersedes the list of posts for Groups ‘A’, ‘B’, ‘C’ and ‘D’ notified through notification No. 16-15/2010-DD-III dated 29th July, 2013.</p>



<p><strong><a href="https://centralgovernmentnews.com/list-of-posts-identified-suitable-for-persons-with-benchmark-disabilities-pib/" target="_blank" rel="noreferrer noopener">List of Posts Identified Suitable for Persons with Benchmark Disabilities – PIB</a></strong></p>



<p>Note 1: Persons with benchmark disabilities require aids and assistive devices to overcome their difficulties. The aids and assistive devices may be provided to persons with benchmark disabilities on their appointment keeping in view their requirement as per the instructions of DoPT issued from time to time.</p>



<p>Note 2: The list of posts being notified is only indicative and not an exhaustive list. If a post is not mentioned in the list, it is not to be construed that it has been exempted. Central Ministries, Departments, Autonomous Bodies, Public Sector Undertakings may further supplement the list by adding to the list of posts identified for respective category of disability.</p>



<p>Note 3: If a post is already held by a person with benchmark disability, it shall be deemed to have been identified for that category of benchmark disability.</p>



<p>Note 4: If a post is identified in the feeder grade, all the posts in the promotional grade should also stand identified.</p>



<p>Note 5: If a post having identical nature and place of job with respect to any identified post, the post should be construed to be identified even if the post has a different nomenclature and/or is placed in a different group.</p>



<p>Note 6: This list will be the principal list in respect of the posts identified suitable for persons with benchmark disabilities. However, in case a list of post is separately identified by any Central Government establishment, the list having wider range of identified categories (i.e. having more sub-categories under each category) would prevail.</p>



<p>Note 7: In case a post is identified suitable for more than one sub-category under a broad category, individual Central Ministries or Departments or Public Sector Undertakings or Autonomous Bodies should conduct recruitment for all the sub-categories and cannot suo-moto choose one particular sub-category for appointment.</p>



<p>Note 8: It is for the Central Ministries or Departments or Public Sector Undertakings or Autonomous Bodies to verify the authenticity of the certificate of disability and examine suitability of the candidate in terms of functional requirements before appointment against any identified post.</p>



<p>Note 9: In the event of discrepancies in the English and Hindi versions of this Notification, English version shall prevail over the Hindi version.</p>
