										<content:encoded><![CDATA[<div dir="ltr" style="text-align: left;"><b>Don’t lay off or demote employees for disability: Centre</b>New Delhi: No government office should dispense with or reduce in rank an employee who acquires any disability during his service, the Centre has said.</p>
<p>The Department of Personnel and Training (DoPT) has amended Central Civil Services (Pension) Rules, 1972, to make it easier for such employees to continue in service or to get invalid pension — which is granted if a government servant retires from the service on account of any bodily or mental infirmity which permanently incapacitates him for the service.</p>
<p>“The case of a government servant acquiring a disability, where the provisions of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (1 of 1996) are applicable, shall be governed by the provisions of the said section,” says the recently amended Pension rules.</p>
<p>The Section 47 of the Act mandates “no establishment shall dispense with or reduce in rank, an employee who acquires a disability during his service”.</p>
<p>It also makes it mandatory for the government departments not to deny promotion to “a person merely on the ground of his disability”.</p>
<p>If a government servant, in a case where the provisions of the Section 47 of the Act are not applicable, retires from the service on account of any bodily or mental infirmity which permanently incapacitates him for the service he may be granted invalid pension or service gratuity depending upon the length of his qualifying service on the date of retirement, the new rules said.</p>
<p>In case a government servant applies for an invalid pension, he shall be required to submit a medical certificate of incapacity from a medical board.</p>

<div dir="ltr" style="text-align: left;">The Department of Personnel and Training (DoPT) has started a scheme for providing facilities to the employees with disabilities. However, the scheme is initially being started for those working in the DoPT.The objective of the scheme is to enable and empower persons with<br />
disabilities of the department by providing certain additional<br />
facilities to help them discharge their duties more conveniently and<br />
effectively, DoPT’s Circular <strong>No.B-11011/1/2016-Ad-III</strong> dated March 11, said.</p>
<p>As per the scheme, which will come into force from next month,<br />
persons with disabilities will get wheelchairs (motorised), special<br />
furniture, hearing aids with battery, low vision aids, smart cane and<br />
special software or computer.</p>
<p>Besides, there will be braille signage near lift area, toilets and<br />
canteens, and provision of beep sound in biometric attendance system, it said.</p>
<p>Employees with disability would be given option to apply for the<br />
assisting aids through proper channel, which will be examined on case to case basis and decided with the approval of competent authority, the DoPT said.</p>
<p>“After successful implementation of the scheme in DoPT, other<br />
government departments will also be asked to follow it,” a senior<br />
official said.</p>

To provide facilities to the Employees with Disabilities working in Department of Personnel and Training, for ease of doing their day to day office work. The Scheme will come into effect from next financial year i.e. from April, 2016. </b></p>
<p><i><span style="color: #990000;"><strong>Objective of the Scheme:- </strong> </span></i><br />
The objective of the Scheme is to enable and empower Persons with Disabilities (PwDs) of this Department by providing certain additional facilities to help them discharge their duties more conveniently and effectively.</p>

Employees with disability would be given option to apply for the items mentioned above to the Administration Division through proper channel, which will be examined on case to case basis and decided with the approval of competent authority.</p>

<p>New Delhi: Central government has decided not to accept voluntary retirement (VRS) notice of its disabled employees in reference to Supreme Court order in the case Bhagwan Dass &amp; Anr Vs Punjab State Electricity Board.</p>
<p>The Persons with Disabilities (PWD) Act, 1995, states that no establishment shall dispense with the services of a disabled employee.</p>
<p>“It has been decided that whenever a government servant seeks voluntary retirement citing medical grounds or due to disability, administrative authorities shall advise him or her about the option of continuing in service with the same pay scale and service benefits,” said Office Memorandum <a href="http://www.tkbsen.in/wp-content/uploads/2015/06/Disabled-Resignation.pdf" target="_blank">F.No.25012/1/2015-Estt (A-IV) </a>dated May 19 issued by Department of Personnel and Training (DoPT).</p>
<p>“If however, despite being so advised, such government servant still wishes to take voluntary retirement, the request may be processed,” it added.</p>
<p>The DoPT said in this order that no establishment shall dispense with or reduce in rank an employee who acquires a disability during service.</p>
<p>“No promotion shall be denied to a person merely on the grounds of disability,” Office Memorandum says.</p>
<p>“It has been noticed that in many instances, persons suffering from physical or mental disability seek voluntary retirement owing to inability to attend to duty and not being aware of the protection afforded to them by the PWD Act” the Office Memorandum added.</p>
<p>According to the Office Memorandum, all the ministries, departments, subordinate offices, central public sector undertakings and autonomous bodies are requested to inform disabled employees about the protection available to them under the PWD Act and must be encouraged them to continue work instead of taking VRS.<br />
