Subject: Retention of GPRA through Inter-pool Exchange – clarification

In view of the latest development in the rule of retaining Government Accommodation by officials posted at North Eastern Region, all probability of undue retention of GPRA through various means is being looked into. It has been noticed that many allottee availing themselves of GPRA in Delhi through inter-pool exchange, in spite of their transfer to outstations, are trying to retain their Government Accommodation in Delhi in contrary to the existing provisions.

2. In view of the above, it is hereby clarified in respect of accommodation availed through inter-pool exchange that the maximum retention period in Delhi admissible to an officer transferred out of Delhi is strictly 8 months (2+6) or 3 years (as the case may be under Rule 40, 41 or 43 of CGGPRA Rules-2017) following the effective date of the transfer. In order to avoid any confusion in this matter, it is hereby reiterated/ further clarified that the inter-pool exchange of an accommodation Is valid only for the period the officers continue to be posted in Delhi.

3. This issues with the approval of the Competent Authority.

Subject: Issues related to delay in handing over physical possession of GPRA – reg.

The undersigned is directed to refer to the Observations/ Recommendations contained in the Forty-First Report of the Public Accounts Committee (17th Lok Sabha) on “Functioning of Directorate of Estates” regarding delay in handing over physical possession of GPRA and to say that many cases have been reported to this Directorate wherein CPWD has not handed over the physical possession of the accommodation to allottee even after 8-10 months of allotment. In order to address the issue and keeping in view of the observations/ recommendations of Public Account Committee (PAC), the following actions shall be taken by CPWD/ NBCC with immediate effect:

• (i) Once a house is vacated, CPWD/NBCC may immediately assess its habitability and the house may be reflected as vacancy in e-Sampada immediately on vacation for allotment by DoE. CPWD/NBCC shall take necessary action to make it habitable at the earliest. Under no circumstances, it shall be taken for more than 75 days for making it habitable.
• (ii) CPWD/NBCC may adhere to the timeline strictly in letter and spirit as mentioned above to handover the houses.
• (iii) Once the house is made habitable for Physical Occupation, CPWD/NBCC shall generate Habitability Certificate and communicate the same to DoE on e-Sampada portal and to the allottee directly. If allottee fails to take Physical Occupation of the house within 5 working days from the date of issue of Habitability Certificate, the allotment shall be cancelled automatically and the allottee shall be debarred as per Rule 17 of CGGPRA Rules, 2017.
• (iv) In case CPWD fails to make the house habitable for Physical Occupation within 73 days from the date of Technical Occupation, CPWD may take action as per their OM No. 7/13/2015-WIl/DG/695 dated 25.07.2015. NBCC may develop similar mechanism to fix responsibility by issuing an OM in case of delay in handling over of houses for more than 75 days.
• (v) In such cases i.e. para (4) above, allottee will be offered option either to continue or cancel the Technical Occupation in e-Sampada. If the allottee opted for cancellation, he will not be debarred but will be allowed to apply in the next bidding cycle. NIC, DoE will carry out necessary changes in e-Sampada portal, accordingly.
• (vi) Once a house is declared unsafe /dangerous/ uninhabitable, necessary action shall be taken at the earliest to vacate the allottee and the house be repaired/ renovated.

If an allottee fails to accept a change of accommodation offered to him within eight days of the date of the offer or allotment, he will not be eligible for a change of accommodation for one year from the date of non-acceptance.

G.S.R. 114(E). – In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following further amendments to the Central Government General Pool Residential Accommodation Rules, 2017, namely:-

1. (1) These rules may be called the Central Government General Pool Residential Accommodation (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Government General Pool Residential Accommodation Rules, 2017, in rule 44, in clause (6), the following clause shall be substituted, namely:-

“if an allottee fails to accept a change of accommodation offered to him within eight days of issue of such offer or allotment, he shall not be considered again for a change of accommodation for one year from the date of non-acceptance for that type of accommodation”.

1. (1) These rules may be called the Central Government General Pool Residential Accommodation (Amendment) Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Government General Pool Residential Accommodation Rules, 2017, in rule 33, in clause

(b), for the first proviso, the following proviso shall be substituted, namely:-

“Provided that grant of one change to the allottee under this rule, of the same type or higher type of accommodation on functional ground shall not be treated as fresh out of turn allotment, if the allotment made is within the limits of quota of units prescribed for the dignitaries under this rules.”

1. (1) These rules may be called the Central Government General Pool Residential Accommodation (Amendment) Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Government General Pool Residential Accommodation Rules, 2017, in rule 33, –

(i) in clause (a), in sub-clause (i), for the word “four”, the word “seven” shall be substituted;
(ii) in the second proviso, for the word “eleven”, the word “eight” shall be substituted.

Subject: One-time relaxation to the allottees of General Pool Residential Accommodation (GPRA) in view of Novel Coronavirus (COVID-19) – extension of retention period.

In continuation of the OM of even number dated 25-3-2020 on the above subject, it has been decided by the competent authority that suo-moto extension of retention of quarters granted to the allottees vide OM dated 25.3.2020 for the period from 17.3.2020 to 31.5.2020 shall remain extended upto 30-6-2020.

2. The other terms and condition of the OM dated 25-3-2020 will remain the same.

Sub: One-time relaxation to the allottees of General Pool Residential Accommodation (GPRA) in view of Novel Coronavirus (COVID-19).

Ministry has been receiving calls from various allottees of Government accommodations, who were / are due to vacate their flats / houses and are not able to do so in the light of the advisories regarding social distancing issued by Ministry of Health and Family Welfare (MoH&FW) under the current global Coronavirus Pandemic (COVID-19). Further, Department of Personnel & Training (DoPT) has issued Guidelines with do’s & don’ts for government personnel vide their O.M. dated 17.03.2020 to contain the spread of this virus. Ministry of Home Affairs (MHA) vide its Order dated 24.03.2020 has issued directions for nation-wide complete lockdown to contain the fast spreading infection.

This extraordinary situation has been considered by the Ministry and it has been decided by the Competent Authority to allow suo-moto retention for the period from 17.03.2020 to 31.05.2020 for all such allottees under the Central Government General Pool Residential Accommodation (CGGPRA) Rules, 2017. This relaxation will be applicable to the following categories:

• Rule 24(2) – where two allottees, who are in occupation of separate accommodation allotted under these rules marry each other, and are directed to surrender one of the accommodation within one month of their marriage;
• Rule 40 – which provides for concessional period of retention of GPRA under different cases; and
• Rule 44 (7 & 8) – which provides for change of accommodation.

2. The suo-moto retention period will be on the payment of licence fees as applicable to the allottee under these rules. No damage will be charged for this period.

3. These relaxations will be given to such allottees also where she/he has become unauthorized occupant of government accommodation before 17.03.2020. However, in such cases, after the retention period of 75 days i.e. upto 31.05.2020, the damage charges at telescopic rates, as was continuing prior to this period, will be resumed.

Subject: Clarification regarding the term ‘Non-Family Station’ in respect of concessional retention given under Rule 43 of CGGPRA Rules, 2017.

In continuation to the OM. of even Number dated 10.4.2018 vide which the concessional retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees, Centrally Armed Paramilitary Forces employees and officers of All India Services on their posting to a Non-family stations was extended up to 30.06.2021 on payment of normal rate of licence fee, it is further clarified that the term ‘Non Family station’ includes:

(i) North Eastern Region, Sikkim, Andaman & Nicobar Islands and Lakshadweep, State of Jammu & Kashmir

(ii) Left Wing Extremist (LWE) areas, as declared by Ministry of Home Affairs from time to time.

2. All the other terms and conditions of OM dated 10.4.2018 will remain unchanged.

Transformation Cell in Board’s office vide their letter No.2018/TransCell/ Process Reforms/Estt dated 05.04.2018 on the subject “Process Reform- Comprehensive Housing Policy” referring to ‘Conclave Sampark, Samanvay, Samvad held on December 16, 2017’, has directed all GMs/CAOs/DGs that full Board in its meeting held on 4th April, 2018 considered the issue of improvement in housing policy and approved among other items, implementation of telescopic penal charges in case of unauthorized retention of railway quarters in the line of GPRA (MoUD). Accordingly, it has further been advised that GMs/CAOs/DGs may evolve their comprehensive guidelines for uniform implementation at their end.

2. The flat rates of licence fee (Standard Rent) for residential accommodation over the Indian Railways were last revised w.e.f. 01.07.2010, 01.07.2013 and 01.07.2016 vide Board’s letter No.F(X)I-2002/11/2 dated 26.12.2017 circulated to all Zonal Railways, Production Units etc .

3. All Zonal Railways and Production Units etc. may take necessary action accordingly.

Subject: Revision of flat rate of licence fee for General Pool Residential Accommodation (GPRA) throughout the country.

In terms of the provisions of the Rule 74 of the “Central Government General Pool Residential Accommodation Rules. 2017, the Government has decided to revise the flat rates of licence fee recoverable for the residential accommodation available in General Pool and also in Departmental Pools of Ministries/Departments of the Government of India throughout the Country (except in respect of substandard/unclassified accommodation of Ministry of Defence, accommodation for service personnel of the Ministry of Defence and accommodation under the control of Ministry of Railways), as shown in the Annexure.

2 The revised rates of licence fee would be effective from 1st July, 2017. All Ministries/Departments are requested to take action to recover the revised licence fee in accordance with these orders in respect of accommodation under their control all over the country.

3 This issues with the concurrence of Integrated Finance Wing of the Ministry of Urban Development vide Note dated 6/7/2017.
