<p>Subject:- <strong>Regularisation of allotment on re-transfer to the last place of posting.</strong><br />
It has come to the notice of this Directorate that some allottees of General Pool Residential Accommodation (GPRA) have retained their accommodation at their last place of posting in contravention of the extant guidelines and instructions on the subject. In this regard, reference is invited to the Rule 54 of Central Government General Pool Residential Accommodation Rules, 2017(CGGPRA Rules, 2017) and it is reiterated that the allottees who have retained General Pool Residential Accommodation (GPRA) at their last place of posting due to their transfer/ posting at non-family stations in violation of the provision of the CGGPRA Rules, 2017 or the extant guidelines, shall not be considered for regularisation of GPRA at their last place of posting.</p>

<p>The undersigned is directed to refer to this Directorate’s OM No. 12035/11/99-Pol.II, dated 24.7.2003 (copy enclosed) on the above mentioned subject and to say that as per the provisions of SR – 317-B-3(2) of the Allotment of Government Residences (General Pool in Delhi) Rules, 1963, an allottee, owning a house at the time of allotment either in his own name or in the name of any members of his family at the place of posting or in an adjoining municipality, shall notify the fact to the Directorate of Estates within a period of one month from the date of the house is let out. As per the provisions of SR-317-B-3(3) ibid, when after a Govt. accommodation has been allotted, the allottee or any member of his family become owner of a house at the place of his duty or in an adjoining municipality, shall notify the fact to the Directorate of Estates within a period of one month from the date of house is let out.</p>

<p>2. However, it is noticed from the records received from concerned administrative divisions of Ministries/Departments that declaration of house owning is received only at the time of application for allotment of accommodation, whereas, the same under the provisions SR-317-B-3(3) received is very negligible as compared to allotment made. In order to streamline the already laid down procedure, it is requested that the administrative authority of the concerned Ministries/Departments, etc. to ensure that the provisions Sr-317-B-3(2) as well as 3(3) are followed strictly. In this regard, it is pertinent to mention here that from 1.3.2015 onwards, concerned Ministries/Departments of the applicant for GPRA are advised to ensure that the particulars/details furnished by the applicant in the online DE-2 Form and the Acceptance Form are true and correct. It is thus requested now that the administrative authority of the concerned Ministries/Departments should ensure that the entries made by the applicant in DE-2 Form as well as the Acceptance Form with regard to owning of house, at the time of forwarding the same to this Directorate is as per the latest Immovable Property Return (IPR) filed by the applicant.</p>

<p>3. Further, they should also instruct all allottees in their Ministry/Department to intimate the Directorate of Estates regarding rental income, if any, from the house owned at the time of allotment/acquired after the allotment of Govt. accommodation either in his own name or in the name of any members of his family at the place of posting or in an adjoining municipality, and whenever any change in rental income, which affect the rate of prescribed licence fee as per OM No. 12035/11/99-Pol.II, dated 24.7.2003, so as to levy the prescribed rate of licence fee in this regard, to avoid any loss to Govt. exchequer. In case the details of rental income furnished by any allottee is found false at any later stage, the licence fee of the particular accommodation will be enhanced to the maximum as per OM dated 24.7.2003 w.e.f the date of increase, by the Directorate of Estates suo motu.</p>

<p>Transfer Guidelines for Lower Divisional Clerks posted in Regional Offices under the administrative control of <strong>Directorate of Estates</strong>.</p>

<p>Directorate of Estates issued orders to frame transfer guidelines for LDCs from one regional office to another regional office. Directorate of Estates under the Ministry of Urban Development has eight regional offices located in different places all over in Inida. The eight regional offices are Kolkata, Shimla, Chandigarh, Faridabad, Ghazidabad, Mumbai, Nagpur and Chennai.</p>

<p>Normally LDCs are not transferred from one to another office, however requests from LDCs for transfer on different gournds. So far there is no guidelines in the regard. The matter has been considered by the Ministry and decided to frame transfer guidelines for LDCs as under…</p>

<p>Sub : <strong>Review of Automated System of Allotment [ASA] – cancellation of enblock change waiting list placed above the unified waiting lists in Types I to IV General Pool Residential Accommodation</strong></p>
<p>The undersigned is directed to refer to the Directorate of Estates O.M. of even number dated 22.12.2010 and 18.11.2011 vide which the then change waiting list [which was based on first-come-first-serve principle] of allottees, who technically accepted the allotted accommodation, for Type I to IV general pool residential accommodation were frozen and placed en block senior to the unified waiting lists prepared as per the new guidelines for Automated System of Allotment [ASA] for change allotments in Type I to IV accommodations.</p>
<p>2. The matter has been reviewed and it has been decided with the approval of the competent authority that the enblock change waiting lists for Type I to IV accommodation placed above the unified waiting lists shall be cancelled immediately. Change as well as initial allotments in Type I to IV accommodation shall be made from the unified waiting lists prepared for the purpose as per the extant rules and guidelines with effect from January, 2015. The existing allottees who had earlier applied for change after furnishing technical acceptance of allotment before introduction of Automated System of Allotment and who were placed enblock above the unified waiting lists, shall now have to apply afresh for change of allotment in respect of Type I to IV general pool residential accommodation.</p>

<p>Sub: <strong>Request to all existing allottees and new applicants for General Pool Residential Accommodation for providing Aadhar [UID] numbers in e-Awas (Automated System of Allotment) of the Directorate of Estates.</strong></p>
<p style="text-align: center;">******</p>
<p>The undersigned is directed to say that the Government has decided to link Aadhar [UID] numbers of Government servants who are occupying General Pool residential accommodation (GPRA) all over the country. Accordingly, all the existing allottees of General Pool residential accommodation shall enter their Aadhar [UID] numbers in their accounts in e-Awas at the earliest. New applicants for General Pool residential accommodation shall enter their Aadhar [UID] numbers in online forms while applying for residential accommodation.</p>
<p>2. All Ministries / Departments of the Government of India are requested to give wide circulation of these instructions among its employees for their compliance.</p>

<p>The undersigned is directed to say that the matter of retention of Govt. accommodation in case of death by the allottees, who are not regular Govt. Servants viz consultant / Contractual appointee coterminous staff etc. has been considered by the competent authority and it has been decided that in case of death of the consultants / contractual appointees, co-terminus appointees in the personal staff of Ministers/other dignitaries etc. who are not regular government servants, six months retention will be allowed for the existing accommodation by the family of deceased allottee on payment of normal licence fee.</p>

<p>Subject: <em>Review of guidelines on regularization / allotment of alternate accommodation in the name of the eligible spouse / ward of the allottee in the event of death /retirement / transfer of the allottee.</em></p>
<p>Several instructions have been issued from time to time by this Directorate regarding regularization / allotment of alternate accommodation in the name of eligible spouse / ward of an allottee in the event of death / retirement / transfer of the allottee. It has been observed that some of the provisions contained in these instructions are inconsistent. Further, the rationale behind providing the facility of regularization / allotment of alternate accommodation in the name of the spouse/ward of the deceased/retired/transferred allottee is to avoid dislocation and hardships to the family of the alottee due to such an event. It is, however, felt that imposition of conditions like date of priority should be covered for providing such a facility undermines the very motive behind such a provision and causes undue hardships to the family of the allottee.</p>
<p>2 In view of above, the matter has been reviewed and, in supersession of all previous Orders/OMs issued by this Directorate in the subject. it has now been decided with the approval of the competent authority to consolidate the several instructions issued from time to time in this regard by harmonizing and modifying them as under</p>
<p>(I) In the event of death of the allottee, the same accommodation may be regularized in the name of the eligible spouse/ward of the deceased allottee if he/She is entitled for it and, if not, an alternate accommodation of entitled lower type may be allotted to him/her on payment of normal licence fee irrespective of the fact whether the eligible spouse/ward had been residing with the allotte prior to the death of the allottee, subject to fulfillment of the following conditions :-</p>
<p>a) In case the spouse/ward had been residing with the deceased allottee prior to the death of the allottee, he/she has not drawn house rent allowance for this period:</p>
<p>b) Request for regularization/allotment of alternate accommodation may be considered in case the spouse/ward gets employment in an eligible office even after the death of the allottee, provided the appointment is secured within a period of two years after the death of the an allottee and the accommodation in occupation has not been vacated;</p>
<p>c) In case of compassionate appointment, were appointment has been approved by the concerned Department and the name of spouse/ward has been under consideration for three years for offering appointment due to non-availability of a clear vacancy and the prescribed Committee has reviewed and certified his/her penurious condition at the end of the first and the second year, the accommodation may be<br />
regularized/allotted in the name of such a spouse/ward provided the appointment is secured within a period of three years after the death of the allottee and the accommodation in occupation has not been vacated, and</p>
<p>d) A daughter-in-law, working in an eligible office, will also be eligible for regularization/allotment of alternate accommodation.</p>
<p>(ii) In the event of retirement of the allottee, the same accommodation may be regularized in the name of the eligible spouse/ward of the retiring allottee if he/she is entitled for it and, if not, an alternate accommodation of entitled lower type may be allotted to him/her on payment of normal licence fee irrespective of the fact whether the eligible spouse/ward had been residing with the allottee prior to the retirement of the allottee, subject to fulfillment of the following conditions:</p>
<p>a) In case the spouse/ward has been residing continuously with the retiring allottee, he/she has not drawn house rent allowance for this period,</p>
<p>b) Request for regularizatio/allotment of alternate accommodation may be considered in case the spouse/ward of the retiring alottee joins the Government service an an eligible office even after the date of retirement of the allotee, provided he/she joins the Government service within the permissible period of retention and the accommodation in occupation has not been vacated.</p>
<p>c) A married daughter, working in an eligible office, will be eligible for regularization/allotment of alternate accommodation irrespective of the fact that the retiring official is having a son and he is in a position to maintain the parents,</p>
<p>d) A daughter-in-law, working in an eligible office, will also be eligible, for regularization/allotment of alternate accommodation: and</p>
<p>e) In case of more than one eligible ward, the retiring official will have option to exercise his/her choice an favour of his/her wards.</p>
<p>(iii) In the event of transfer of the allottee to another station, the same accommodation may be regularized in the name of the eligible spouse, of the transferred allottee if he/she is entitled for it and. if not, an alternate accommodation of entitled tower type may be allotted to him/her on payment of normal licence fee,</p>
<p>(iv) Regularization/allotment of alternate accommodation in the event of death/retirement/transfer of the allottee shall also be subject to the following conditions</p>
<p>a) The facility of regularization/allotment of alternate accommodation shall be admissible in all the aforesaid cases irrespective of the facts whether the date of priority of the spouse/ward is covered on the date of death/retirement/transfer of the allottee.</p>
<p>b) The application for regularization/allotment should be submitted within the permissible period of retention after the date of death retirement/transfer of the allottee or, in case of death / retirement of the allottee, from the date of appointment of the spouse/ward in Government service, whichever is later:</p>
<p>c) All the dues outstanding in respect of the accommodation occupied by the deceased/retired/transferred allottee must be cleared before submission of the application for regularization / alternate allotment.</p>
<p>d) The grade pay drawn by the spouse/ward on the date of death/retirement/transfer of the allottee will be taken into account for determining the entitled type of accommodation</p>
<p>e) In all the aforesaid cases, the regularization/alternate allotment In the name of the spouse/ward will be made, to the extent possible, in the same area, failing which in a nearby area: and</p>
<p>f) The facility of regularization/allotment of alternate accommodation will not be admissible in following cases</p>
<p>(i) where the allottee or any member of his/her family owns a house at the place of posting where regularization is being sought: and</p>
<p>(ii) where the allottee has become ineligible for allotment of General Pool residential accommodation, due to any reason, on or before the date of his/her death / retirement / transfer.</p>
<p>3. This OM is applicable from the date of issue. The cases which have already been decided will not be reopened under any circumstances.</p>

<p>Reference Directorate of Estates vide O.M. of even No. dated 6th June, 2013. Room No. 301, 302, 303, 304, 305 &amp; 306 of Holiday Home at Port Blair kept for repairs &amp; maintenance would be ready for occupation w.e.f. November, 2013 and accordingly, it has been decided to re-commence the booking of above rooms in Holiday Home at Port Blair with effect from 1st November, 2013.</p>
<p>NIC, Nirman Bhawan, New Delhi is requested that online booking of above rooms may be re-activated with immediate effect.  However, it may be ensured that applicants can apply for booking only for period with effect from 1.11.2013.</p>
