<p>The Rights of Persons with Disabilities Act, 2016, inter-alia, provides reservation for Persons with Disabilities. Four per cent of the total number of vacancies to be filled up by direct recruitment, in the cadre strength, in each group of posts, i.e. Groups A, B, and C, are reserved for such persons in the following manner </p>

<p><strong>Protection of pay to the Central Government Servant consequent to appointment to a new post in different service or cadre in Central Government, through direct recruitment where either higher duties and responsibilities are involved or not, as the case may be, under FR 22- B(1) (Rule 1315 of IREC Vol.II), in the 7th CPC Scenario &#8211; regarding.</strong></p>



<p><strong>DOP&amp;T vide their O.M.No.12/02/2017- Estt (Pay-I), dated 5th August, 2020</strong> have issued certain guidelines on Protection of pay to the <a href="https://centralgovernmentnews.com/" target="_blank" rel="noreferrer noopener">Central Government Servant</a> consequent to appointment to a new post in different service or cadre in Central Government, through direct recruitment where either higher duties and responsibilities are involved or not, as the case may be, under FR 22- B(1) (Rule 1315 of IREC Vol.II), in the 7th CPC Scenario. A copy of the same is sent herewith for information/guidance. These orders will apply <a href="https://centralgovernmentnews.com/tag/mutatis-mutandis/" target="_blank" rel="noreferrer noopener">mutatis-mutandis</a> to Railway employees also.</p>

<p>As per extant instructions, reservation is provided to Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs) at the rate of 15%, 7.5% and 27% respectively in case of direct recruitment on all India basis by open competition. In case of direct recruitment on all India basis otherwise than by open competition, the percentage fixed is 16.66% for SCs, 7.5% for STs and 25.84% for OBCs.</p>



<p>In case of direct recruitment to Group C posts normally attracting candidates from a locality or a region, the percentage of reservation for SC / ST / OBC is generally fixed on the basis of proportion of their population in the respective States / Union Territories.</p>



<p>With the enactment of &#8216;The Rights of Persons with Disabilities Act, 2016&#8217;, reservation is also provided to Persons with Benchmark Disabilities against the posts and services of the Central Government at 4% of the total number of vacancies to be filled up by direct recruitment in the cadre strength in each group of posts i.e. Group A, B and C.</p>



<p>As per Ex-servicemen (Re-employment in Central Services and Posts) Rules, 1979, as amended from time to time, 10% of the vacancies in the posts upto of the level of the Assistant Commandant in all para-military forces; (ii) 10% of the vacancies in Group C posts; and (iii) 20% of the vacancies in Group D posts, to be filled by direct recruitment shall be reserved for ex-servicemen.</p>



<p>The persons belonging to Economically Weaker Sections (EWSs) who are not covered under the scheme of reservation for SCs, STs and OBCs shall get 10% reservation in direct recruitment in civil posts and services in the Government of India.</p>

<p>Sub:-<strong> Discontinuation of Direct Recruitment to the posts of Senior Section Engineers (SSEs).</strong></p>
<p>Attention is invited to Board&#8217;s letter No. E(NG)I/2008/PM1/15 dated 03.09.2009 which inter alia lays down that 20% of the vacancies in Group &#8216;C&#8217; posts of Senior Section Engineer(SSE) in Civil Engineering, Electrical, Mechanical, Signal &amp; Telecom and Track Machine Organization (TMO) Departments will be filled by direct recruitment.</p>
<p>This provision of direct recruitment in the post of SSEs has since been reviewed by Board. It has been decided to provisionally discontinue direct recruitment in the post of SSEs. This decision will be reviewed after one year. Therefore, all direct recruitment in all technical supervisory categories for the present be only in the post of Junior Engineers (JEs). Vacancies of SSEs may accordingly be added to those of Junior Engineers (JEs) for the purpose of direct recruitment.</p>

<p>Reference has been received from one of the zonal railways, seeking clarification, whether Board&#8217;s instructions contained in the letter of even number dated 21.02.2018 (RBE No.25/2018), regarding relaxation of upper age limit are applicable in the case of engagement of substitutes or otherwise.</p>
<p>The matter has been looked into and it is clarified that relaxation in upper age limit provided vide RBE No.25/2018 are also applicable in the case of engagement of substitutes.</p>

<blockquote><p>&#8220;In case of direct recruitment to Group C posts normally attracting candidates from a locality or a region, the percentage of reservation is generally fixed on the basis of proportion of their population in the respective States/Union Territories&#8221;</p></blockquote>
<p><strong>Reserve category representation</strong></p>
<p>Article 16(4) of the Constitution enables provision of reservation to backward class of citizens, who are not adequately represented in the services under the State.</p>
<p>As per extant instructions, reservation is provided to Scheduled Castes, Scheduled Tribes and Other Backward Classes at the rate of 15%, 7.5% and 27% respectively in case of direct recruitment on all India basis by open competition. In case of direct recruitment on all India basis otherwise than by open competition, the percentage fixed is 16.66% for Scheduled Castes, 7.5% for Scheduled Tribes and 25.84% for Other Backward Classes.</p>
<p>In case of direct recruitment to Group C posts normally attracting candidates from a locality or a region, the percentage of reservation is generally fixed on the basis of proportion of their population in the respective States/Union Territories.</p>
<p>The services under the State come under the List II of the Seventh Schedule i.e. State List of the Constitution. The information on the state-wise provisions for reservation is not centrally maintained.</p>
<p>As per the 9 Judge Bench Constitutional judgment of the Supreme Court in Indira Sawhney case, total reservation cannot exceed the limit of 50%. In the same judgment, the Supreme Court has also observed that clause (4) of Article 16 of Constitution speaks of adequate representation and not proportionate representation.</p>
<p>This was stated by the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh in a written reply to question in the Lok Sabha today.</p>

<p>Subject: <strong>Reservation for Ex-servicemen in direct recruitment Group &#8216;C&#8217; posts &#8211; Regarding</strong></p>
<p>Reference is invited to the reservation, concessions and relaxations applicable for ex-Servicemen in Central Government Services (Group &#8216;C&#8217; posts). The Government of India has been issuing instructions from time to time for filling up of vacancies under prescribed quota reserved for ex-servicemen category. In this regard the DoPT has issued compendium of instruction on reservations for Ex-servicemen &#8211; consolidation of instructions vide OM. No.3603/4/3/2013-Estt.(Res.) dated 25th February, 2014.</p>
<p>All Pr.CCA.s/CCAs/CAs (with independent charge) are therefore requested to ensure that the provisions/ rules for Ex-servicemen notified under Ex-servicemen (Re-employment in Central Services and Posts) Rules. 1979. as amended from time to time are being properly followed up/implemented while forwarding of vacancies or direct recruitment posts to this office for consolidation. The non-implementation of reservations prescribed for ex-servicemen shall be treated as violation of Govt. of India&#8217;s instructions on the subject.</p>

<p>As per the data received from 79 Ministries/Departments for the year 2014-2015, 18822 employees (8.56%) were recruited from Minority Communities in Government services and PSUs.</p>
<p>As per the data received from 44 Ministries/Departments for the year 2015-2016, 2851 employees (7.5%) were recruited from Minority Communities in Government services and PSUs.</p>

<p>The posts sanctioned in Government Ministries/ Departments are required to be filled as per the Recruitment Rules as and when vacancies arise. The filling up of posts is a continuous process depending on the vacancies arising across Ministries/Departments during the years and action calendars of the recruitment agencies. In this regards all Ministries/Departments have been requested to take advance action for reporting vacancy position with respect to Direct Recruitment Posts to recruitment agencies such as Union Public Service Commission (UPSC) and Staff Selection Commission (SSC) etc. Further all Ministries/ Department have also been requested for timely convening of the Departmental Promotion Committee meeting for filling up of promotional posts.</p>
<p>This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Nalin Kumar Kateel in the Lok Sabha today.</p>

<p>2. It has been observed that, so far, the necessary action for abolition of 85% posts of JSA falling vacant has not been complied with.</p>
<p>3. The concerned Ministries/Departments are requested to take necessary action to abolish the remaining posts immediately and furnish a compliance report to this Department along-with a copy of the Office Order of the number of posts abolished.</p>
