<p>1. I am directed to state that in terms of the provisions of Govt of India, Ministry of Defence letter No. 228(04)/2010/ US(WE)D(Res) dated 18 Feb 2011, 228(02)/2013/ US(WE)D(Res) dated 18 Oct 2013, 228(02)/2013/ US(WE)/D(Res) dated 24 Feb 2015 and 228(02)/2020/ WE/D(Res-1) dated 30 Jan 2020, it has now been decided by the 44TH Screening Committee for empanelment of Additional Medical facilities with ECHS in its meeting held on 08 Feb 2023 the chairmanship of MD ECHS to empanel additional facilities of 28 Private Hospitals/Nursing Homes and Diagnostic Laboratories for different specialities and procedures as per the list attached in the Annexure :-</p>

<p>2. All the terms and conditions including fixation of rates payable to empanelled hospitals will be regulated under Govt of India, Ministry of Defence letter No 228(04)/2010/US(WE)/D(Res) dated 18 Feb 2011 and amended from time to time.</p>

<p>3. The rates for ECHS Hospital/Nursing Home, Dental Centres and Diagnostic Centres as approved by the Empowered Committee will be as per CGHS rates and will be notified by the Director, Regional Centre ECHS to all concerned including Polyclinics, SEMOs, CDA/PCDA and Central Organisation ECHS.</p>



<p>4. Empanelement of CGHS empanelled hospital is subject to this hospital providing proof of its being a CGHS empanelled facility as on the date signing of MoA with ECHS.</p>



<p>5. CGHS empanelled medical facilities will be empanelled with ECHS for the period for which the facilities hold valid CGHS. The MoA will be extendable onece CGHS renew the MoA with the medical facilities.</p>



<p>6. NABH accredited medical facilities will be empanelled with ECHS for the period of validity of NABH certificate and the MoA will be renewed once the medical facility is issued revalidation/renewed NABH certificate.</p>

<p><strong>Subject: Grant of pro-rata pensionary benefits to the JCO/ORs of Defence Services on permanent absorption/employment in Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking &#8211; reg.</strong></p>



<p>I am directed to refer to this Ministry’s letter No. 8(3)/85/A/D (Pension/Services) dated 17th March 1986, No. 8(3)/86/A/D(Pension/Services) dated 19th February 1987 and No. 8(1)/86/A/D (Pen/Sers) dated 12% February 1988 under which commissioned officers of the Defence Forces have been granted pro-rata pensionary benefits on their permanent absorption in Central Public Enterprises/ Central Public Sector Undertaking. Further, vide MoD letter No. A/49738/AG/PS-4 (c)/689/A/D (Pens/Sers) dated 21st April 1988, the pro-rata pensionary benefits were extended to the Commissioned Officers of Defence forces on their permanent absorption in Central Autonomous Bodies. MoD vide letter No. B/39029/AG/PS-4(c)/520/A/D (Pens/Sers) dated 10th April 1996 as amended vide MoD letter No. B/39029/AG/PS-4(c)/997/A/D (Pens/Sers) dated 5th July 1996 withdrew facility of receiving capitalized value equivalent to 100% commutation of pension on absorption.</p>



<p>2. Extending the provision of pro-rata pension to JCOs/ORs of the Defence Services who join/joined Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking on permanent absorption/employment was under consideration of this Ministry for some time. Now, the President is pleased to decide that the provision of pro-rata pension of the aforesaid letters will also apply to those JCOs/ORs who:-</p>



<ul class="wp-block-list">
<li>(a) While on deputation to Central Public Enterprises/ Central Autonomous bodies/ Central Public Sector Undertaking exercise an option for permanent absorption and are discharged/permitted to retire prematurely from Defence Services for this purpose, or</li>



<li>(b) are appointed in Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking on the basis of their own application sent through proper channel in response to advertisements and they are permitted to retire prematurely from service in the Defence Services for the purpose of taking the appointment in those Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking.</li>
</ul>



<p>3. The pensionary benefits enumerated in this letter are admissible only to those JCOs/ORs who leave the Defence service with proper permission to secure employment in a Central Public Enterprises/ Central Autonomous Body/ Central Public Sector Undertaking. A case for grant of these benefits will be initiated by the Service Headquarters only after ascertaining from the Central Public Sector Enterprises/ Central Autonomous Body/ Central Public Sector Undertaking concerned that the personnel has actually joined them. All cases for grant of pensionary benefits to JCOs/ORs of Army and their counterparts in Air Force/Navy will be decided by respective Service Headquarters and a separate sanction will be issued in each case.</p>



<p>4. JCOs/ORs having not less than 10 years of qualifying service in Defence Service will be entitled to receive pro-rata pension. The pro-rata pension of JCOs/ORs who get absorbed/appointed in Central Public Enterprises / Central Autonomous Body/ Central Public Sector Undertaking will be calculated as per provisions applicable for calculation of pension of regular JCOs/ORs at the time of absorption. Death-cum-retirement gratuity, based on the length of qualifying service of a JCO/OR till the date of his/her absorption will be admissible, as calculated under the DCRG Rules as applicable before absorption.</p>



<p>5. No Pro-rata pension will be payable to a JCO/OR absorbed in a Central Public Enterprises/Central Autonomous Bodies/ Central Public Sector Undertaking with less than 10 years of qualifying service in Defence Service. Further, condonation of short fall in Service shall not be admissible for grant of pro-rata pension, if JCOs/OR has less than 10 years of qualifying service.</p>



<p>6. A JCO/OR who is absorbed/appointed in Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking on or after issue of this order will be entitled to commutation of a portion of his/her Pro-rata pension as admissible in accordance with the prescribed rules.</p>



<p>7. The family of a JCO/OR absorbee having not less than 10 years of qualifying service in Defence Service who was in receipt of pro-rata pension will be eligible for benefits under the ordinary family pension scheme under Al 2/S/64 read with Al 51/80 as applicable to the Commissioned Officer. In this connection, as per Gol, MoD letter No. 1(7)/2013-D (Pension/Policy) dated 15.05.2015 the simultaneous notification of name of spouse and other eligible member will be carried out during sanction of pro-rata pension for regularization of family pension to eligible members of family after demise of JCOs/ORs. However, this benefit will not be admissible to the family of JCO/OR who is absorbed in a Central Public Enterprises/ Central Autonomous Body/ Central Public Sector Undertaking before completion of 10 years of Service in the Defence Services.</p>



<p>8. Any liberalization of pension /gratuity and other rules as decided upon by the Government of India in respect of JCOs/ORs and applicable from a date after the permanent absorption of JCOs/ORs would not be extended to him/her, after his/her permanent absorption in Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking.</p>



<p>9. The provision of this letter will be applicable to those JCOs/ORs who are absorbed/appointed in Central Public Sector Enterprises/ Central Public Sector Undertaking (on or after 06.03.1985) or Central Autonomous Bodies (on or after 31.03.1987). In such cases there will be a notional fixation of pro-rata pension retrospectively in accordance to the provision of Govt. letters mentioned at para 1 above as applicable to him/her and thereafter Pro-rata pension will be revised up to the date of effect of letter with relevant Govt. orders for revision of pension. However, the financial benefit in past cases that is, cases prior to issue of this order, will be allowed prospectively from the date of issue of this order only and therefore no commutation of pension or DCRG shall be admissible in past cases.</p>



<p>10. The pro-rata pension will not be granted to those JCOs/ORs who have got their Military service counted on absorption/employment in Central Public Enterprises/ Central Autonomous Bodies/ Central Public Sector Undertaking.</p>



<p>11. Pension Regulation for the three services will be amended accordingly in due course.</p>



<p>12. All other terms &amp; conditions mentioned in the MoD letters at Para 1 of this letter will remain unchanged.</p>



<p>13. This issues with the concurrence of Ministry of Defence (Finance/Pension) vide their ID No.17(02)/2020/Fin/ Pen dated 23.10.2020.</p>

<p><strong>2.2.8 WAR INJURY PENSION TO WORLD WAR II RETIREES DISABLED IN WW II:</strong></p>



<p><strong>The Committee notes with concern such discrimination and that too with a class of pensioners/family pensioners who stood against all odds for a war against humanity and that too </strong>at a <strong>time when fighting in foreign lands was taboo and who are now numerically placed on a sharp diminishing scale, It is hence strongly recommended that immediate measures be initiated to release _war injury pension and </strong>liberalized family pension with financial effect from 01-01- 1996 respectively to all those disabled retirees of WWII who <strong>are in receipt of disability pension and widows of personnel deceased in WWII who are in receipt of family pension.</strong></p>



<p><strong>Status:</strong></p>



<p><strong><em>Not Accepted :</em></strong></p>



<p><em>The following facts with regard to the issues for</em>&nbsp;<em>grant of War Injury Pension to World War-II</em>&nbsp;<em>disabled veteran, involved merits considerations:-</em></p>



<p><em>(i} World War-II took place 70 years back, during</em>&nbsp;<em>1939-1945. The number of live pensioners may be</em>&nbsp;<em>very very rare. The retention period of relevant</em>&nbsp;<em>record of the individuals which will require ascertaining the disability assessed during WW-II may be over. There may be a rare chance of retrieving the required information/data for decision of policy,</em></p>



<p><em>(ii} The concept of War Injury Pay has been introduced in 1972 for Defence Forces Personnel. War Injury Pay is known as War Injury Pension from 4th CPC.</em></p>



<p><em>(iii) Opening of the case for examination the proposal is just like opening a Pandora’s box which will lead to open WW-I and other earlier cases which have no merit and factual documentary proof/data.</em></p>



<p><em>The comments of CGDA office were also received&nbsp;on the proposal which are reproduced as under:</em></p>



<p><em>“(a) GoI, MoD vide letter No. 200847/ Pen­ C/71 dated 24th Feb, 1972, introduced liberalized pensionary awards for war widows and war disabled servicemen. These provisions were made available for disablement of personnel on account of injuries sustained or personnel killed in action in operations against Pakistan commencing form 3rd Dec, 1971 besides a few more categories mentioned in the letter.</em></p>



<p><em>(b) It may be seen that casualties of WW-II&nbsp;</em><strong><em>not covered in the above Government letter.&nbsp;</em></strong><em><strong>Further, pension documents of Armed Forces&nbsp;</strong>pensioners were migrated to PCDA (P) Allahabad from CMA (P), Lahore during the year 1947-48.&nbsp;<strong>This office is not in a position to identify’ the cases</strong></em>&nbsp;<em>related to World War</em>–<em>II.</em></p>



<p><em><strong>In a reply to Parliament Question, it was replied that no separate database has been maintained&nbsp;</strong>for WW-II veterans. Hence it would be difficult to&nbsp;<strong>work out any pension for them in absence of data.&nbsp;</strong></em></p>



<p><em>However, taking into the fact that the number of&nbsp;<strong>such veterans will be very small, some other assistance (financial) in addition to the existing one was considered for needy veterans to lead a&nbsp;</strong>decent life which . they deserve. Accordingly, RSBs/ZSBs were requested to ascertain the&nbsp;<strong>same in their area. Once the details are known, further action can be planned.&nbsp;</strong></em></p>



<p><em>KSB vide their letter dated 24.11.2017 has provided the details of disabled pensioners/ family <strong>pensioners retirees from Defence military budget</strong></em> <em><strong>in respect of WW-II veterans as received from </strong>various States/ UTs. It has been observed that many States/UTs have not responded and KSB <strong>have stated that reminders being made to non­ responsive States to forward the detail and same would be forwarded on receipt. However, the details from the non-responsive States/ UTs have </strong>not been provided by KSB sofar. Further, KSB vide their letter dated 5.2.2018 have intimated that the data/details of WW-I/ is not maintained/ available with them.</em></p>



<p><em>DS(Res.11) informed that the WW-II&nbsp;<strong>veterans/ widows are provided financial&nbsp;</strong>assistance by States / UTs. After the direction of the Standing Committee on Defence (16th Lok Sabha), all the States/UTs were requested by the then Secretary (ESW) in March 2015 and Sept 2016 to enhance the amount of financial&nbsp;<strong>assistance given to WW-II veterans.</strong></em><em></em></p>



<p><em>World War-ll veterans are eligible for disability pension/mustering out pension as per the Pension Rules applicable during the&nbsp;</em><em>period. The concept of War Injury Pay was introduced in 1972. The recommendation for grant of War Injury Pension was examined in consultation with CGDA and not found feasible for implementation. Majority of States/UTs have responded positively.</em></p>

<p><strong>Unmarried disabled sons eligible for ECHS facilities even after attaining 25 years</strong></p>



<p>Till now unmarried permanently disabled and financially dependent sons of ECHS beneficiaries after attaining the age of 25 years are not considered dependant and hence are not eligible for availing medical facilities under Ex-servicemen Contributory Health Scheme (ECHS). This is as per the Central Government Health Scheme (<strong><a href="https://centralgovernmentnews.com/category/cghs/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">CGHS</a></strong>) Rules which are followed by ECHS. However, vide their OM No 4-24/96-C&amp;P/ CGHS(P)/EHS dated January 1, 2020, the CGHS has declared such sons of CGHS beneficiaries who have become disabled after attaining the age of 25 years, dependant and hence eligible for availing CGHS benefits subject to fulfilment of conditions laid down in the Ministry of Health and Family Welfare (MoHFW) Office Memorandum (OM) No 4-24/96-C&amp;P/ CGHS(P)/EHS dated May 5, 2018.</p>



<p>It has now been decided by the Ministry of Defence (MoD), Department of Ex-Servicemen Welfare (DESW) to similarly treat unmarried permanently disabled and financially dependent sons of ECHS beneficiaries who have become disabled after attaining the age of 25 years as dependant and hence eligible for availing benefits under ECHS subject to fulfilment of conditions laid down in the MoHFW OM of May 7, 2018.</p>

<h2 class="wp-block-heading" style="text-align:center"><strong>Ex-servicemen Welfare</strong></h2>



<p style="text-align:center"><strong>Tipper Attachment Scheme for Widows and Disabled ESM</strong></p>



<p><strong>Salient Features</strong></p>



<p>This welfare scheme for widows/disabled soldiers is linked with the ESM Coal Loading and Transportation Scheme. Eligible candidates can avail this Scheme for a period of five years and need to deposit an amount of Rs 85,000/- with the affiliated ESM Coal Loading and Transportation Company which pays back a monthly amount of Rs 3,000/ i.e. an annual return of approximately 42 % on the principal amount.. On maturity of the Scheme the Principal Amount is refunded. A legal agreement is signed between the Ex-Servicemen Coal Loading and Transportation Company and the widow/disabled Ex-Servicemen/Dependant. The scheme is for a period of five years and on completion of five year term the principle amount will be refunded by the ESM Coal Company.</p>



<p><strong>Eligibility</strong></p>



<p>The eligibility conditions for Widows / Dependants / ESMs who can take part in Tipper Attachment Scheme are as follows:-</p>



<p><strong>Persons Eligible</strong></p>



<ul class="wp-block-list"><li>Widows (below 65 years of age) and disabled / medically boarded out service personnel in whose case the disability is more than 50% and is attributable to military service.</li><li>Orphan children of Ex-servicemen represented by legal guardians and meeting the condition of being un-employed and under 25 yrs for boys; un-employed and unmarried in case of girls.</li></ul>



<p><strong>Conditions</strong></p>



<ul class="wp-block-list"><li>Should not be presently employed / self-employed.</li><li> Should not have remarried after death of husband in case of widows.</li><li> Should not have availed of any other DGR scheme.</li><li> Benefit of the Scheme should not have been availed by any other family member. Benefit will be extended to only one member of a family for a period of five years only.</li></ul>



<p><strong>Procedure</strong></p>



<p>Desirous widows of defence service personnel, dependants of deceased serving personnel and disabled Ex-servicemen should apply to the Director (Self-Employment) on the prescribed form. The document to be submitted are as follows:-</p>



<ul class="wp-block-list"><li>Copy of Death Certificate / Disability Certificate)</li><li> Affidavit (on Rs. 10/- Non-judicial stamp paper) for giving an undertaking regarding various issues of eligibility duly attested by notary as per format.</li><li> Copy of ESM / Widow/Dependent Identity Card.</li><li> Copy of Pension Payment Order.</li><li> Proof of death / disability attributable to military service.</li><li> Proof of dependency in case of dependants.</li><li> The format of application to be submitted can be downloaded from “DGR forms download window of the DGR website www.dgrindia.com</li></ul>

<p>In supersession of Government of India, Ministry .of Defence letter No. 12-SB(8)/52-2001/958/D(Res) dated 16th Nov.2001, I am directed to convey the sanction of the President to enhance the Special Pension to blinded Ex-Servicemen from Rs. 500/- p.m. to Rs. 4000/-per month with effect from June, 2017. The expenditure will he debited to relevant Head of account of Defence Services Estimates.</p>
<p>2. The sanction is issued with the concurrence of Ministry of Defence (Fin/Pen) vide their ID No 10(12)/2016/FIN/PEN dated 05/06/2017.</p>

<p>GOI has accepted following definition of OROP in the letters dated 26 Feb 14 and MOS statement in Rajya Sabha dated 2 Dec 14.</p>

<p>However in the Press Release dated 5 Sep 14, a phrase has been added at the end of the OROP definition “at periodic intervals”.</p>

<p>Again, another attempt has been made to change/ distort the definition of OROP in GOI notification dated 7 Nov 15. OROP definition given in 7 Nov letter is reproduced below.</p>

<p>I am sure you would notice subtle progressive change in the language of definition of OROP, wherein the line “<span data-blogger-escaped-style="text-decoration: underline;">This implies bridging the gap between the rate of pension of the current pensioners and the past pensioners, and also future enhancements in the rate of pension to be automatically passed on to the past pensioner” has been changed with the line “This implies bridging the gap between the rate of pension of the current pensioners and the past pensioners at periodic intervals</span>”.</p>

<p>It further states as one of the salient features that it has been decided that the gap between rate of pension of current pensioners and past pensioners would be refixed every five years.</p>

<p>This completely changes the definition of OROP and if implemented in its changed form, it will deprive past pensioners of monetary benefits and will completely destroy the definition of OROP and in turn, destroy the very soul of OROP.</p>

<div data-blogger-escaped-style="text-align: justify;">
<p>UFESM (JM) believes that this change in the definition in OROP has been inserted only to justify pension equalisation every five years. Pension equalisation every five years is against the definition of OROP and is a matter of serious concern for all Ex-servicemen. The correct and acceptable situation is that pension equalisation must be done as soon as pension of two soldiers with same rank and same length of service is noticed to be different and it must be equalised immediately. Ex-servicemen are ready to accept pension equalisation every year only to make administration of this concept easily implementable. Incidentally, any computation can be easily achieved on press of a button in today’s computer era – and this needs no emphasis.</p>

<p>However the matter did not end at one instance of change of definition of OROP, it has been once again repeated in GOI letter dated 14 Dec 15 “<i>OROP implies that uniform pension be paid to the Defence Forces Personnel retiring in the same rank with the same length of service, regardless of their date of retirement, which implies that bridging the gap between the rate of pension of current and past pensioners at periodic intervals”.</i></p>

<p>The GOI letter dated 14 Dec 15 is the notification for the formation of one-man judicial committee. It is a matter of great importance that if incorrect definition is given to the Chairman of anomalies committee, he is bound to work within the constraints given by MOD and will thus give his recommendations as per incorrect definition given to him. This will be gross injustice to ex-servicemen. Ex-servicemen might be justified to think that these changes are a planned move for the vexed problem of OROP in view of the past experiences in which meanings of Honorable Supreme Court orders were changed by making subtle changes in the decision of HSC.</p>

<p>We sincerely hope that these changes are probably only clerical errors and not a planned direction change. We therefore sincerely request you to correct these mistakes in definition of OROP and give following definition approved by Parliament to all committees.</p>

<p>Subject: &#8211; <strong>Waiving recovery of excess amount of element of Non-Practising Allowance (NPA) paid to pre-1996 retired Armed Forces Doctors.</strong></p>
<p>Sir,<br />
The undersigned is directed to refer to this Ministry&#8217;s ID No. 113A/D(Pen/Legal) dated 05.12.2008 regarding recovery of excess amount of NPA paid to pre-1996 retired Armed Forces Doctors.</p>
<p>2. On receipt of various representations from Retired Armed Forces Doctors, individually and through Associations, the Government reconsidered the matter on humanitarian grounds. After careful examination of the matter, the Government has now decided to waive recovery of excess amount of element of NPA paid to pre-1996 retired Armed Forces Doctors for the period from 11.09.2001 to 31.03.2008.</p>
<p>3. The amount of excess amount of the element of NPA recovered so far is not to be refunded.</p>
<p>4. This issues with the concurrence of Ministry of Defence (Fin/Pen) vide their U.O. 3501/FIP dated 22.11.2013.</p>

<p><strong style="background: #ffcf79; color: black; padding: 5px 8px; line-height: 2;">Subject : Permission for treatment / investigations in respect of ECHS beneficiaries availing treatment for Diabetes, hypertension &amp; other Cardiac diseases, Dialysis and Cancer.</strong></p>
<p>Sir,<br />
The undersigned is directed to refer to the subject mentioned above and to state that at present the ECHS beneficiaries undergoing treatment for Diabetes, Hypertension &amp; other Cardiac Diseases, Dialysis and Cancer require repeated investigations/treatment procedures over a period of time and as per the existing guidelines they are required to procure permission (referrals letter) every time to get the prescribed treatment/investigations done at ECHS empanelled hospitals/diagnostic centres.</p>
<p>2. With a view to alleviate the inconvenience to ECHS beneficiaries in obtaining the requisite permissions (referral) every time, this Ministry has decided to permit issue of permission (referral) letters by ECHS polyclinics with a validity of six months from the date of issue of the original prescription for undergoing the prescribed investigation/treatment procedures to be conducted at the prescribed intervals over a period of six months as advised by a ECHS/Service/Govt. specialist. The same permission (referral) letter shall be valid for undergoing the prescribed treatment procedures/investigations on multiple times during the six months, at intervals as advised by the ECHS/Service/Govt. Specialist.</p>
<p>3. This issues with concurrence of MoD(Finance) vide their U.O. No.1782/F/Pen dated 5-7-2013.</p>
