<p>Subject: <strong>Cash Management System in Central Government &#8211; Guidelines for expenditure control in Q3 (October, 2020 to December, 2020).</strong></p>



<p>Attention of Ministries/ Departments is drawn to this Ministry’s O.Ms. of even number dated 8.4.2020 and 23.6.2020 regarding modified exchequer control based expenditure management under Cash Management system in Central Government.</p>



<p>2. With a view to manage the cash flows of the Government, it has been decided to retain and continue with the same expenditure management measures, stipulated for Q1 and Q2, for Q3 (October, 2020 to December, 2020) of FY 2020-21.</p>



<p>3. However, during Quarter 3, Demand No.6 &#8211; Department of Fertilizers, Demand No.19 &#8211; Defence Services (Revenue) and Demand No.20 -Capital Outlay on Defence Services are re-classified as Category ‘A’.</p>



<p>4, Other conditions stipulated in this Ministry’s O.Ms. dated 8.4.2020 and 23.6.2020, the details of which are given below, will continue to be followed:</p>



<ul class="wp-block-list"><li>Monthly Expenditure Plan (MEP) for October, November and December will mirror the MEP stipulation that were spelt out for April, May and June 2020;</li><li>Expenditure on ‘salaries’ and ‘pensions’ will be as per actual requirement and shall be within the overall limits prescribed under cash management guidelines;</li><li>The amounts that remain unspent in a month will not be available for automatic carry-forward into the next month. The amounts that remained unspent in a Quarter will not be available for automatic carry-forward into the next Quarter. Specific approvals of Secretary, Department of Expenditure shall be<br />obtained by the Ministries/ Departments for utilising these unspent amounts;</li><li>Ministries /Departments while utilising their allocations shall take utmost care not to bunch up expenditures/ releases in a bid to improve their pace of expenditure leading to parking of funds. In this time of acute cash stress, utmost care may be taken to avoid releases that can contribute to idle parking of funds, and</li><li>Items of large expenditure would continue to be governed by the guidelines issued in this Ministry’s O.M. F.No.12(13)-B(R)/2016 dated 21.8.2017.</li></ul>

<p><strong>Ministries /Departments /PSUs /PSBs and all other organs of the government to adopt innovative means to use digital or online methods</strong></p>



<p>Given the prevailing circumstances in which the world is increasingly moving towards adopting digital force-multipliers for productivity, the Government of India has decided to follow this best practice.</p>



<p>There is to be no activity towards printing wall calendars, desktop calendars, diaries and other such material for use in the coming year by any Ministries/Departments/PSUs/PSBs and all other organs of the government.</p>



<p>All such activity shall go digital and online.</p>



<p>There is to be a concerted effort towards incorporating innovative methods in such matters. Using technological innovations for planning, scheduling and forecasting is well known to be economical, efficient and effective.</p>



<p>Prime Minister Shri Narendra Modi and his governance model have always seen technology as an enabler. Integrating technology into our work is in line with his vision.</p>



<p>Therefore all calendars, diaries, schedulers and similar other materials, which were earlier printed in physical format, will now be done digitally. Publication of Coffee Table books will also be stopped and appropriate use of E-Books is encouraged. All Ministries / Departments / PSUs / PSBs and all other organs of the government are to adopt innovative means to use digital or online methods for the same. Innovative digital and online solutions which will achieve the same result as physical calendars or diaries are to be prioritized and to be put into practice.</p>

<p>Subject :  <strong>Economy Instructions &#8211; Printing activities</strong></p>



<p>As the world is increasingly moving towards adopting digital force multipliers for productivity and given the fact that using technological innovations for planning, scheduling and forecasting is known to be economical, efficient and effective, the Government of India has decided that there will be no further activities towards printing wall calendars, desktop calendars, diaries, festival greeting cards and similar materials by all Ministries / Departments / Autonomous Bodies and other organs of the Government. All such activities including materials which were earlier printed in physical format shall be done digitally online. The printing of Coffee Table books is also banned and appropriate use of E-Books is encouraged. Therefore, all concerned are directed to make efforts to adopt innovative means to use digital or online method for the above activities.</p>



<p>2. This issues with the approval of Secretary (Expenditure) and will come into force with immediate effect.</p>

<p>2. It has been felt that there is a need to have uniformity to regulate salary of such contractual appointment of retired Central Government employees. The issue is under examination in Department of Expenditure. Accordingly a DRAFT O.M prescribing guidelines for regulation of pay of such contractual appointees has been prepared and enclosed herewith. All the Ministries and Departments of Government of India are requested to submit their views/comments, if any, on this issue. <p>Subject: <strong>Regulation of remuneration in case of contract appointment of retired Central Government employees.</strong></p>



<p>The undersigned is directed to say that Ministries/Departments appoint retired Central Government employees on contract basis, including as Consultants on contract basis. However, at present there are no uniform guidelines for regulation of salary in such cases.</p>



<p><a href="https://centralgovernmentnews.com/protection-of-pay-in-respect-of-candidates-from-psus-on-their-appointment-to-central-government-posts-on-direct-recruitment-basis/">Protection of pay in respect of candidates from PSUs on their appointment to Central Government posts on Direct Recruitment basis</a></p>



<p>2. The existing instructions of Department of Personnel and Training, as contained in their Central Civil Services (Fixation of Salary of employed Pensioners) Orders, 1986, as amended from time to time, provide for regulation of salary in case of re-employment . However, the instructions of Department of Personnel &amp; Training as contained in their OM No. 26012/6/2002- Estt (A) dated 9.12.2002 provides that re-employment beyond the age of superannuation of 60 years shall not be permissible. Also, as per their OM No. 3(3)/ 2016-Estt (Pay II) dt. 1.5.2017, the pay plus gross pension on re-employment is not to exceed Rs.2,25,000/-, i .e., Pay Level 17 as applicable to an of f ice of the level of Secretary to the Government of India.</p>



<p>3. Department of Personnel &amp; Training has also informed that the instructions on pay fixation in case of re-employment apply only to persons appointed on re-employment, other than those employed on contract basis, except where the contract provides otherwise. Accordingly, in cases of appointment of retired Central Government employees after the age of superannuation  at 60 years on contact basis, the instructions on pay fixation on re-employment will not directly apply.</p>



<p>4. In view of this, there is a need to regulate salary in such cases of contract appointment of retired Central Government employees on an uniform basis. The matter has, therefore, been considered and it has been decided that regulation of salary in case of appointment of retired Central Government employees on contract basis, including as consultants, shall be regulated as provided hereinafter.</p>



<h3 class="wp-block-heading"><strong>(A)&nbsp;Cases where contract appointment is made on nomination basis</strong></h3>



<p>5. Such cases will cover appointment of a retired Central Government employee on contract basis, including as Consultants , by way of nomination based on the credentials of the past service and not through open market advertisement .</p>



<p>6. A t the outset , such appointments shall be not be made as a matter of practice and must be kept at a bare minimum. Such appointments may be made only in the justified exigencies of the official work where public interest is served by the appointment of the retired employee. While making such appointments, adequate functional necessity with clear grounds must be placed before the appointing authority.</p>



<h4 class="wp-block-heading"><strong>A . Salary</strong></h4>



<p>7.1 A fixed monthly amount shall be admissible, arrived at by deducting the basic pension from the salary drawn at the time of retirement. It shall be termed as “salary”. The amount of salary so fixed shall remain unchanged for the term of the contract.</p>



<p><strong>Example</strong></p>



<p>An employee retired in the Pay Level 13 and the pay at the time of retirement was Rs. 1,55,900. Thus, the basic pension will be Rs. 77,950. f the employee is appointed on contract basis, including as Consultant, the “salary” shall be fixed at Rs.77, 950 ( 1,55,900-77950).</p>



<p>7.2 The basic pension to be deducted from the last salary drawn shall be the pension as fixed at the time of retirement and as such, if the employee has availed of the commutation of pension, the commuted portion of pension shall also be included in the portion of pension to be deducted. Thus, in the above example, if 40% of pension was commuted, the commuted portion shall be Rs. 31,180 ( 40% of 77,950) and the pension actually drawn shall be Rs. 46,770. However , the amount of pension to be deduced from the last salary shall be Rs. 77,950.</p>



<p>7.3 No increment and Dearness Allowance shall be allowed during the term of the contract.</p>



<h4 class="wp-block-heading"><strong>B. House Rent Allowance</strong></h4>



<p>7.4 No HRA shall ordinarily be admissible, except in those case where special dispensation is allowed by the Appointments Committee of the Cabinet . Further, no HRA shall be admissible in case the appointee has a house either in self name or the name of spouse at the place of appointment. Also, if the retired employee is retaining the Government accommodation after retirement as per the Rules of Directorate of Estate, the HRA shall be admissible only from the date of vacation of the Government accommodation.</p>



<h4 class="wp-block-heading"><strong>C. Transport Allowance</strong></h4>



<p>7.5 An appropriate and fixed amount as Transport Allowance for the purpose of commuting between the residence and the place of work shall be allowed not exceeding the rate applicable to the appointee at the time of retirement . The amount so f ixed shall remain unchanged during the term of appointment .</p>



<h4 class="wp-block-heading"><strong>D. Leave of absence</strong></h4>



<p>7.6 Paid leave of absence may be allowed at the rate of 1.5 days for each completed month of service.</p>



<h4 class="wp-block-heading">E. Term of Appointment</h4>



<p>7.7 The term of appointment shall ordinarily be for an initial period not exceeding one year. It may be extendable up to an age two years more than the age of superannuation of the concerned employee. Beyond two years after the age of superannuation where adequate justification exists, the term may be extended based on a review of the task and the performance of the contract appointee, provided in no case shall i t be extended beyond the age 5 years more than the age of superannuation.</p>



<h3 class="wp-block-heading"><strong>(B) Cases where contract appointment is made on open market basis</strong></h3>



<p>8. In cases where the appointment of retired employees is made from open market under GFR 179 to 196, then the remuneration may be regulated as per the terms and conditions of the contract and in such cases there will be no need to deduct pension . The terms of the appointment and the age up to which the appointment can be made shall also be as per the terms of the contract, provided the term of appointment shall not ordinarily go beyond 5 years after the age of superannuation of the appointee.</p>



<p>9. These orders shall apply to appointments made in the Central Government and shall be effective from the date of issue of the orders. The past cases shall not be reopened in the light of these orders until the normal term of those past cases.</p>



<p>10. The terms of appointment provided for in these in orders shall not apply to cases and to the extent where the Appointments Committee of allows special terms or where special provisions have been allowed with the approval of the Department of Personnel &amp; Training and this Ministry.</p>



<p>11. In their application to appointments in the office of Comptroller &amp; Auditor General of India, these orders issue after consultation with C&amp;AG.</p>

<p>Subject: <strong>Rush of Expenditure in the last quarter of Financial Year 2019-2020</strong></p>



<p>According to Rule 62(3) of General Financial Rules 2017, rush of expenditure particularly in the closing months of financial year, shall be regarded as breach of financial propriety and shall be avoided. It is further mentioned that Finance Ministry had already sensitized all administrative heads that rush of expenditure in the year end must be strictly avoided. As per extent guidelines, the last quarter expenditure must be limited to actual procurement of goods &amp; services and reimbursement of expenditure already occurred. Budget Division of Ministry of Finance vide its O.M No. F. No. 12(15)-B(W&amp;M)/2019 dated 27.12.2019 has revised the limits of expenditure in last quarter of previous year from 33% to 25% and in the last one i.e. month of March from 15% to 10% (copy of the O.M enclosed).</p>



<p>2. In view of the above, the process of obtaining financial concurrence of Ministry of Finance and IFDs of the respective Ministries/Departments must, therefore, be completed by 9th March 2020 and regular Sanctions and Bills must be preferred on PFMS Portal by 15th March. The sanctions, bills pertaining to the last Supplementary Demands for Grants only or any exceptional cases with the approval of Financial Adviser of the Ministry/Department may be processed thereafter.</p>



<p>3. It is requested that necessary instructions in this regard may please be issued to all Heads of Departments and Head-offices / sections of main Ministries / Departments so that there is no breach of financial propriety.</p>

<p>In  continuation  of  this office  OM  No.  G-25014/13/20 I 5- I 6/M F.CGA/IAD/250-288  dated 08.07.2015 regarding revised proforma and terms and conditions for the enrolment of retired Govt. officers willing to work as consultant, the following term s and condition may be read as</p>



<p><strong>i. Serial Number 2:</strong></p>



<p>“A retired official  will  be eligible for enrolment  as consultant  within one year from the date of retirement” and</p>

<p><strong>ii. Serial No. 14(a)</strong></p>



<p>“The consultant must not assign or sub-contract any part of the services”.</p>



<p>As such the retired Govt. servant has to apply for enrolment or his name as consultant within one year of his retirement failing which his request will not be considered for enrolment. However prescribed proforma and other terms &amp; conditions envisaged in the above OM dated 08.07.2015 will remain same.</p>



<p>This issues with the approval of the Controller General of Accounts.</p>

<p>Subject: <strong>Lifting of the ban on purchase of new vehicles by Ministries / Departments</strong></p>

<p>Reference is invited to Para 2.3 of this Department&#8217;s OM No. 7(1 ) /E.Coord&#8217;/ 2014 dated 29.10.2014 pertaining to economy measures and rationalization of expenditure wherein it stated that &#8220;Purchase of new vehicles to meet the operational requirement of Defence Forces, Central Paramilitary Forces &amp; security related organizations are permitted. Ban on purchase of other vehicles (including staff cars) will continue except against condemnation&#8221;. Consequent to the aforesaid condition, all proposals relating to purchase of vehicles by Ministries/Departments other than those against condemnation were being made with the concurrence of the Department of Expenditure. </p>



<p>(2) The matter regarding ban on purchase of vehicles (including staff cars) except against condemnation has been reassessed and examined by this Department.</p>



<p>(3) I am directed to state that the ban on purchase of other vehicles (including staff cars) except against condemnation stands withdrawn with immediate effect. The purchase of new staff cars on requirement basis including against condemnation will continue to be regulated within the ceiling fixed by the Department of Expenditure from time to time. Purchase of vehicles other than staff cars for operational need is also allowed. Ministries/Departments in consultation with their Financial Advisers shall ensure that all purchases of vehicles are made judiciously keeping in mind the principle of &#8216;need&#8217; and &#8216;want&#8217; and GFR 2017 provisions on procurement are adhered to strictly.</p>

<p>Sub: <strong>Central Government Employees Group Insurance Scheme 1980 &#8211; Tables of Benefits for the savings fund for the period from 1.1.2019 to 31.03.2019</strong></p>



<p>The Tables of Benefits for Savings fund to the beneficia ries under the Central Government Employees Group Insurance Scheme-1980, which are being issued on a quarterly basis from 01.01.2017 onwards, as brought out in<br />
this Ministry&#8217;s OM of even number dated 17.03.2017, for the quarter from 01.01.2019 to 31.03.2019, as worked out by IRDA based on the interest rate of 8% per annum (compounded quarterly) as notified by the Department of<br />
Economic Affairs as per their Resolution No. 5(1) -B(PD) / 2018 dated 03.01.2019, are enclosed.</p>



<p>The Tables enclosed are of two categories as per the existing practice. As hitherto, the first Table of Benefits for the savings fund of the scheme is based on the subscription of Rs.10 p.m. from 1.1.1982 to 31.12.1989 and RS.15  p.m. w.e.f. 1.1.1990 onwards. The second Table of Benefits for savings fund is based on a subscription of Rs.10 p.m. for those employees who had opted out of the revised rate of subscription w.e.f. 1.1.1990.</p>



<p>3 . In their application to the employees of Indian Audit and Accounts Department, these orders are issued after consultation with the Comptroller &amp; Auditor General of India.</p>

<p>Sub: <strong>Manual for procurement of Goods, 2017 and Manual for Procurement of Consultancy &amp; other Services, 2017.</strong></p>
<p>It may be recalled that the Department of Expenditure in 2017 had issued a set of two Manuals on &#8216;Policies and Procedures for Procurement of Goods&#8217; and &#8216;Procurement of Consulting &amp; Non- Consulting Services&#8217;, in conformity with the General Financial Rules (GFR), 2017. These Manuals have been prepared in consonance with the fundamental principles of transparency, fairness, competition, economy, efficiency and accountability. Efforts have been made to cover all major aspects of procurement in these Manuals in a user-friendly manner. The manuals are the outcome of extensive consultations in two stages with Ministries/Departments and other organizations. These manuals are available on the website of Department of Expenditure.</p>
<p>2. These Manuals provide generic guidelines which would be useful for the procuring officials working in various Ministries! Departments as operating instructions and would bring about greater transparency and predictability in Government procurement procedures and help in improving the ease of doing Business with Government. Ministries! Departments are advised to supplement these manuals to suit their local/specialized needs, by issuing their own detailed manuals (including customized formats); Standard Bidding Documents and Schedule of Procurement Powers to serve as detailed instructions for their own procuring officers.</p>
<p>3. The above referred Manuals may be brought to the notice of all concerned officers under your Ministry! Department, Attached! Subordinate offices and Autonomous Bodies engaged in the work of procurement directly or indirectly. Such officers may also be encouraged to attend one week residential free procurement training at National Institute of Financial Management (NIFM). The calendar of training is available on the website of this Department as well as NIFM.</p>

<p>Sub: <strong>Central Government Employees Group Insurance Scheme-1980 &#8211; Table of Benefits for the savings fund for the period from 01.10.2018 to 31.12.2018.</strong><br />
The Tables of Benefits for Savings Fund to the beneficiaries under the Central Government Employees Group Insurance Scheme-1980, which are being issued on a quarterly basis from 01.01.2017 onwards, as brought out in this Ministry&#8217;s OM of even number dated 17.03.2017, for the quarter from 01.10.2018 to 31.12.2018, as worked out by IRDA based on the interest rate or 8% per annum (compounded quarterly) as notified by the Department or Economic Affairs as per their Resolution No. 5(1)-B(PD)/2018 dated 04.10.2018, are enclosed.</p>
<p>2. The Tables enclosed are of two categories as per the existing practice. As hitherto the first Table of Benefits for the saving fund of the scheme is based on the subscription or Rs.10 p.m. from 1.1.1982 to 31.12.1989 and Rs 15 p.m. w.e.f.. 1.1.1990 onwards. The second Table or Benefits for savings fund is based on a subscription of Rs.10 p.m. for those employees who hod opted out or the revised rate or subscription w.e.f. 1.1.1990.</p>
<p>3. While these orders are in respect of Table or Benefits for the period from 01.10.2018 to 31.12.2018, the Tables already issued for the first quarter, second quarter and third quarter i.e. for the period 01.01.2018 to 30.09.2018 are also reproduced for the sake convenience and consolidation.</p>
<p>4 In their application to the employees of Indian Audit and Accounts Department , these orders are issued after consultation with the Comptroller &amp; Auditor General of India.</p>

<p>Sub: <strong>Re-imbursement of Mobile charges to non-entitled officers (Sr.AOs/AOs/AAOs posted in SPMUs.</strong></p>
<p>The undersigned is directed to convey the approval of Controller General of Accounts vide diary no. 230 dated 23.05.2018 and Secretary(Expenditure), M/o Finance vide diary no. 716366 dated 13.11.2018 for re-imbursement of mobile phone charges to the non-entitled officers (Sr.AOs/AOs/AAOs) posted at various State Project Management Units(SPMUs) of PFMS across the country.</p>
<p>2. Mobile Phone expenses shall be reimbursed up to a maximum of Rs. 500/-plus taxes per person/month which is subject to the actual uses and the production of original receipt.</p>
<p>3. These instructions will be effective from 01.12.2018.</p>
<p>4. All such claims shall be paid from the budget of PFMS under Head &#8220;Office Expenses&#8221;.</p>
<p>5. The approval of the aforementioned is for one year subject to the condition that the facility must be reviewed after one year based on infrastructure condition of the SPMUs.</p>
