<h3 class="wp-block-heading">Sub: Booking of Air/Train tickets on Tour/LTC for D.A.D officials through D.T.S. (Defence Travel System) Platform.</h3>



<p>Please refer to main office circular no. AN/ Pay/ T/ 351/ TA/ DA/ LTC dated: 13.06.2022 and circular of even number dated: 25.08.2023 (copy enclosed), wherein this office has advised DAD Officials to book their Air tickets/Train tickets on Tour/ LTC purpose through D.T.S. (Defence Travel System, E- ticketing project) platform.</p>



<p>2. Off late, it is observed that booking of Air ticket/ Train tickets on Tour/LTC purpose by DAD officials through D.T.S. is very low in percentage with respect of overall claim passed in Tour/LTC, which has been viewed very seriously by competent authority. Further competent authority has also directed all DAD officials to book their ticket on above purpose through D.T.S. platform.</p>



<p>3. In this regard all officers-in-charge are requested once again to provide the data in respect of officers/staff of their office. who have not yet enrolled on D.T.S. till date as per prescribed format (copy enclosed).</p>



<p>4. Further, all the officers and staff are advised to utilize Defence Travel System (D.T.S) of the department for booking of their ticket for their authorized and approved tours.</p>



<p>This issues with the approval of CDA.</p>

<p>It 1s therefore requested that practice followed/ adopted as regards payment of Night Duty Allowance to Station Officers (erstwhile FED ‘B’) may be intimated at the earliest for onward submission of the same to PCDA(WC) Chandigarh.</p>



<p>Further, a list of designation/category/level of employees, who were made eligible by the MoD for receipt of Night Duty Allowance under your audit jurisdiction, may be obtained and provided to this office for further necessary action please.</p>

<h3 class="wp-block-heading">Subject : Clarification regarding admissibility of Night Duty Allowance to FED re-designated to Station Officer.</h3>



<p>Night Duty Allowance was admissible to the Fire Fighting staff as per list of categories identified for grant of NDA in accordance to the MoD OM dated 15.03.1990 (copy enclosed). It is pertinent to mention here that among the list of staff identified FED ‘B’ Fire Supervisors have been re-designated to the post of Station Officer with a revised pay level Gand GP 2800 / –</p>



<p>Further, as per DoPT OM No. A-27016/02/ 2017-Estt (AL) dated 13.07.2020. the ceiling of Basic Pay for entitlement of NDA has been upgraded to Rs.43600/- per month.</p>



<p>Since, the list of categories has not been revised w.r.t admissibility of NDA to the Fire Fighting Staff who have been re-designated to the post of Station Officer, it is difficult to conclude whether Station Officer is eligible to get NDA or not.</p>



<p>In view of the above, your views and practice followed in r/o grant of Night Duty Allowance to fire fighting staff ( FED ‘B’) re-designated to Station Officer may please be furnished to this office within 15 days for our better appreciation and enabling this office for further necessary action on the subject matter.</p>

<p>Of late, It has been observed that the biodata sheet of service book has either not been filled or partially filled causing problem at the time of promotion/ confirmation/ Pay fixation etc.</p>



<p>In case of new recruits. Part-I of service book along with bio data sheet duly filled by the Govt servant and attested by competent authority may please be forwarded to AN V section for verification within one months of joining the office so that the prepration of service book can be completed at the earliest.</p>



<p>To update bio data, a blank form is uploaded herewith for filling the same by all officers/ staffs and forward to this office duly attested by the competent authority at the earliest.</p>



<p>In addition to above, it has also been observed that some officers/staffs who come under NPS, have not submitted option Form-I (Copy enclosed) to avail benefits in case of death or discharge on invalidation or disability of Government servant/ subscriber during service. It is requested to submit the same at the earliest for updation in service book.</p>

<p>470. Shri Asaduddin Owaisi<br />Will the Minister of Finance be pleased to state:</p>



<p>(a) whether armed forces were marked as exception to New Pension Scheme (NPS) and if so, the details thereof;</p>



<p>(b) whether Article 246 of the Schedule VII of the Constitution says armed forces of the Union of India include Naval, Military and Air Force and any other armed forces of the Union;</p>



<p>(c) if so, whether Hon. High Court of Delhi has asked the Union Government to issue orders for Old Pension Scheme to Central Armed Police Forces like CRPF, ITBP, CISF etc.;</p>



<p>(d) if so, whether the Government has since issued orders in this regard; and</p>



<p>(e) if so, the details thereof and if not, the reasons therefor?</p>



<h3 class="wp-block-heading">ANSWER</h3>



<p>THE MINISTER OF STATE IN THE MINISTRY OF FINANCE<br />(DR. BHAGWAT KARAD)</p>



<p>(a) to (e) As per Gazette Notification No. 5/7/2003-ECB &amp; PR dated 22.12.2003 issued by Department of Economic Affairs, Ministry of Finance, the Government introduced a new restructured defined contribution pension scheme for new entrants to Central Government service, except the armed forces, in the first stage, replacing the existing system of defined benefit pension system. The system is mandatory for all new recruits to the Central Government service from 01.01.2004.</p>



<p>The Hon’ble High Court of Delhi vide order dated 11.01.2023 in WP (C) No. 12712/2021 titled Pawan Kumar &amp; Ors of CRPF Vs Uol &amp; Ors and other connected matters, has directed for grant of Old Pension Scheme to the personnel of para-military forces. This is a policy matter under the domain of Ministry of Home Affairs.</p>

<h2 class="wp-block-heading"><strong>Subject: One Rank One Pension to the Defence Forces Pensioners.</strong></h2>



<p>The undersigned is directed to refer to this Ministry’s letter No. 1(1)/2019/D(Pen/Pol) dated 04.01.2023 notifying revision of pension under One Rank One Pension Scheme (OROP) with effect from 01.07.2019 to all Pre 01.07.2019 Defence Forces Pensioners/Family Pensioners. Para 3 of the letter provides that detailed instructions relating to implementation of OROP along with tables indicating revised pension for each rank and each category shall be issued separately.</p>



<p>2. The undersigned is now directed to say that in order to quicken the process of revision of pension/family pension,<strong> total 121 tables indicating rates of pension/family pension under OROP scheme are appended to this order</strong>. The appended tables indicate revised rates of Retiring/ Service/ Special/ Disability/ Invalid/ Liberalized Disability/ War Injury Pension including Disability/ War Injury Element and Ordinary/ Special / Liberalized Family Pension of Commissioned Officers, Honorary Commissioned Officers, JCOs/ORs and Non-Combatants (Enrolled) of Army, Navy, Air Force, Defence Speciality Corps &amp;amp; Territorial Army Retired / Discharged / Invalided. Out from Service/died in service or after retirement. The existing pension of all Pre- 01 .07.2019 (except pensioners entered on or after 01 .07.2014 pre-matrix retirement/own request as provided in para 4 of MoD letter No. 1 2(1)/2014/D (Pen/Pol)Part.II dated 07.11.2015 as amended vide Ministry of Defence, Department of Ex-Servicemen letter No. 12(1)/2014/D (Pen/Pol) Pan-II dated 06.06.2017) pensioners/ family pensioners shall be enhanced with reference to applicable table for the rank (and group in case of JCOs/ORs) in which pensioned with reference to the actual qualifying service as shown in Column-1 of the tables subject to maximum term of engagement front time to time. The rate of pension of pensioners/ family pensioners drawing more than the revised rate of pension/ family pension indicated in annexed tables, shall remain unchanged.</p>



<h3 class="wp-block-heading"><strong>APPLICABILITY</strong></h3>



<p>3. The provisions of this letter shall be applicable to all pensioners/ family pensioners who had been retired/ discharged/ invalided out from service/ died in service or after retirement in the rank of Commissioned Officers, Honorary Commissioned Officers, JCOs/ORs and Non- Combatants (Enrolled) of Army, Navy, Air Force, Defence Security Corps, Teritorial Army &amp;amp; Ex-State Forces and are in receipt of pension/ family pension as on 01.07.2019 (except pensioners retired after previous OROP revision on pre mature retirement/own request).</p>



<p>3.1 The provisions of this letter, however, do not apply to UK/ HKSRA/ KCIO pensioners, Pakistan &amp;amp; Burma Army pensioners, Reservist pensioners and pensioners in receipt of Ex-gratia payments and pensioners retired after previous OROP revision on pre-mature retirement/own request (as provided in para 4 of MoD letter dated 07.11.2015).</p>



<h3 class="wp-block-heading"><strong>METHODOLOGY FOR IMPLEMENTATION</strong></h3>



<p>4. It is provided in para-2.6 of MoD letter dated 04.01.2023 that the pensioners retired on or after 01.07.2014 on premature retirement/own request are not eligible for benefits of OROP. The information regarding premature retirement/own request is not available in the Pension Payment Order (PPO). Hence, table-based revision by PDA in such cases is not feasible.</p>



<p>4.1 Therefore, it is decided that the pension of all pensioners retired/discharged on or after 01.07.2014 and before 01.0.7.2019) will be 7fy/6f/fC/f/6 High corrigendum PPO. Since most of the data of pensioners/family pensioners have been migrated in SPARSH application, therefore, revision of pension of migrated pensioners/family pensioners wil1 be done through SPARSH application only. The corrigendum PPO in the case of remaining pensioners retired/discharged on or after 01.07.2014 and before 01.07.2019 will be issued by Pension Sanctioning Authorities in affected cases, so-moto (where rates of pension under these orders are beneficial than the rates of their pension as on 01.07.2019).</p>



<p>4.2 In all other cases i.e pensioners retired/discharged rip to 10.06.2014, invalided out prior to 01.07.2019 and family pensioners, this revision will be implemented based on the pension tables as appended with this order. All Pension Disbursing Agencies (PDAs) hand high disbursement of pension to Defence pensioners are hereby authorized to carry out revision of Retiring/ Service/ Special/ Disability/ invalid/ Liberalized Disability/ War Injury Pension including Disability/ War Injury Element and Ordinary/ Special/ Liberalized Family Pension of all, such pre-01.07.2019 pensioners/family pensioners drawing pension as on 01.07.2019 in terms of this order with applicable rates of dearness relief without calling for any applications from the pensioners and without any further authorization from the Pension Sanctioning Authorities concerned.</p>



<p>4.3 The revised rates of pension under this letter are average of in minimum &amp; maximum rate of pension for a rank and a qualifying service of live data of 2018 retirees. Wherever, the rates of higher qualifying service of a rank are lower than rates of lower qualifying service in sane rank or data is/are blank for higher qualifying service then the same have been protected by higher rate of lower qualifying service, due to this, many rates in same column appears equal. Similarly, wherever the revised rate of pension under this order are lower in higher rank than rate in lower rank in same qualifying service then the same have been protected with higher rates of pension in lower rank in same qualifying service resulting similar rate in some qualifying service in two adjacent columns.</p>



<p>5. Where the revised pension as on 01.07.2019 worked out in terms of this letter, happens to be less than the existing pension/ family pension as on 01.07.2019, the pension shall not be revised to the disadvantage of the pensioner/ family pensioner.</p>



<p>6. Arrears on account of revision of pension front 01.07.2019 till date of its implementation shall be paid by the Pension Disbursing Agencies in four half yearly installments. However, all the family pensioners including those in receipt of Special/Liberalized family pension and all Gallantry award winners shall be paid arrears in one installment.</p>



<p>7. The initial Pension Payment Order (PPO) or its Corrigendum PPO (Corr PPO) indicates rank, group and qualifying service for which the individual has been pensioned. This information is available with Pension Disbursing Agencies as they have revised pension of all such pensioners in the recent past in terms of Government orders issued for implementation of recommendations of 7th CPC. Hence, however, any information regarding qualifying service, rank, group etc., is not available with Pension Disbursing Agencies, such cases may be referred to Pension Sanctioning Authority concerned on the Piofollra enclosed as Annexure A. The Pension Sanctioning Authorities concerned will provide the requisite information from the available records within 15 days of the receipt of request from the Pension Disbursing Agencies.</p>



<p>8. In case of any doubt relating to revision of pension in terms of this letter, Pension Disbursing Agencies way immediately take tip the matter with Nodal Officers of respective PSAs, details of which shall be notified by Pr. CDA (P), Prayagraj in their implementation instructions.</p>



<p>9. The revised rates of pension under this letter shall be basic pension from 01.07.2019 and therefore, additional pension as applicable to the old age pensioners/family pensioners on attaining the relevant age (80 years and above) shall also be enhanced by the PDAs from 01.07.2019 or the date from which the pensioner attains the age of 80 years or more, whichever is later.</p>



<h3 class="wp-block-heading"><strong>PAYMENT OF LIFE TIME ARREARS (LTA)</strong></h3>



<p>10. If a pensioner to whom the benefit accrues under the provisions of this letter has died/dies before receiving the payment of arrears, the Life Time Arrears of pension (LTA) shall be paid in the following manner .-</p>



<ul class="wp-block-list">
<li>a) If the claimant is already in receipt of Family Pension or happens to be the pensioner in whose favour Family Pension already stands notified and the awardees has hot become ineligible for any reason, the LTA under the provisions of this letter should be paid to such a claimant by the PDA on their own.</li>



<li>b) If the claimant has already received LTA in the past in respect of the deceased to whom the benefit would have accrued, the LTA under the provisions of this letter should also be paid to such a claimant by the PDA on their own.</li>



<li>c) If the claimant is a person other than the one mentioned at 10(a) &amp; 10(b) above, payment of LTA shall be made to the legal his /hers as per extant Government orders.</li>
</ul>



<p>11. The following elements shall continue to be paid as separate elements in addition to the pension revised under this order .-</p>



<ul class="wp-block-list">
<li>i) Monetary allowance attached to gallantry awards viz. Param Vir Chakra, Ashok Chakra etc.</li>



<li>ii) Constant Attendance Allowance, where admissible.</li>



<li>iii) Dearness relief as sanctioned by the Government from time to time.</li>
</ul>



<h3 class="wp-block-heading"><strong>MISCELLANEOUS INSTRUCTIONS</strong></h3>



<p>12. No arrears on account of revision of pension/family pension shall be admissible for the period prior to 01.07.2019.</p>



<p>13. No commutation of pension Small be admissible on revised/additional amount of pension accruing as a result of revision of pension under this letter. However, the existing amount of pension, if any, that has been commuted will continue to be deducted from the revised pension.</p>



<p>14. As a result of this letter, there will be no change in the amount of gratuity already determined and paid with reference to the rules in force at the time of retire/discharge/invalidment/death.</p>



<p>15. Any overpayment of pension coming to the notice or under process of recovery shall be adjusted in full by the Pension Disbursing Agencies against arrears becoming due on revision of pension on the basis of this order.</p>



<h3 class="wp-block-heading"><strong>METHODOLOGY FOR REPORTING</strong></h3>



<p>16. An intimation regarding disbursement of revised pension shall be furnished by the Pension Disbursing Agencies to the office of the Pr. CDA(P), Prayagraj in the format prescribed as Annexure-B to this letter in the following month in which revision takes place. PDAs shall also ensure that an intimation regarding revision of pension is invariably conveyed to the pensioners concerned for their information ii respective of the fact that the same is beneficial to them or not. The Public Sector Banks disbursing defence pensions through Central Pension Processing Centers (CPPC), the progress report shall be furnished by the CPPC of the bank directly to the office of Pr. CDA (Pensions) Prayagraj through electronic sections.</p>



<p>17. All other terms and conditions which are not affected by this order shall remain unchanged.</p>



<p>18. This issues with concurrence of Finance Division of this Ministry vide their ID No10(01)/2019/Fin/Pen dated 16.01.2023</p>

<p>Please find enclosed copies of the GOI MH&amp;FW OM No Z.15025/117/2017/DIR/ CGHS/ESH_ dated 15/01/2018 as amended by OM no Z 15025/64/2018/DIR/CGHS dated 31/07/2018 and Z.15025/117/2017/DIR/ CGHS/EHS dated 10/12/2018 for information and strict compliance please.</p>



<p>In this connection, it is noted that while availing CGHS facilities by the beneficiaries, the standard guidelines and instruction on the subject are not being followed.</p>



<h2 class="has-text-align-center wp-block-heading"><a href="https://centralgovernmentnews.com/cghs-price-list-cghs-treatment-procedure/" target="_blank" rel="noreferrer noopener">CGHS Price List &#8211; CGHS TREATMENT PROCEDURE</a></h2>



<p>As per Para (i) of MH&amp;FWO dated 15/014/2018which states that “ All CGHS  beneficiaries (in all CGHS Cities) shall be permitted for seeking OPS consultation from Specialist at private hospitals empanelled under CGHS after being referred by any Medical Officer /CMO of CGHS wellness Centre the referral may be mentioned on computer generated Prescription Slip . After consultation at empanelled hospitals beneficiaries shall report back to concerned wellness centre, where MO/CMO would endorse listed investigation/ listed treatment procedures and issue medicine as per guidelines mentioned below. For unlisted investigation/ treatment procedure CMO in charge shall submit the prescription to competent authority for consideration in case of pension beneficiaries. Serving employees shall seek permission for unlisted investigation/ treatment procedure from their department as per prevailing guidelines.</p>



<p>In view of the above it is stated that while submitting CGHS reimbursement claim due procedure shall be followed by the beneficiaries so that claim can be processed without returning to the beneficiaries.</p>

<p>(a) whether Government is aware that unscrupulous elements were found with copies of identity (ID) proofs of army men for duping people;</p>



<p>(b) whether it is also a fact that cyber cheats secure data of army personnel, including taking their identity proofs in different ways, like offering cheap mobile SIM; and</p>



<p>(c) the steps being taken to create awareness among army personnel to ensure that these identity proofs are not used to dupe common people on online selling sites?</p>

<p>(a): Yes, Sir.</p>



<p>(b): Yes, Sir. The likely sources of leakage of ID Proofs are at securing bank loans, new SIMs (Employment Proofs).</p>



<p>(c): (i) Army Personnel are regularly sensitized by concerned higher authorities and through Sainik Sammelan / Briefings/ Interaction to cautiously use their ID proofs, so that the same does not get misused;</p>



<p>(ii) The Canteen Stores Department Cards which are reportedly misused are blocked;</p>



<p>(iii) Action is taken against complaints and disciplinary action is initiated against defaulters for sharing ID card on online platforms.</p>

<h2 class="wp-block-heading">Subject: Payment of Ex-gratia in case of death of Agniveers enrolled under the Agnipath Scheme, 2022.</h2>



<p>I am directed to refer to Ministry of Defence létter no. DMA/JS (N&amp;DS)/2021/ Agnipath-01 dated 15.06.2022 on the above subject and to state that in pursuance of the Government’s decision to implement the Agnipath Scheme, 2022, the death of an Agniveer has been categorized and accordingly Ex-gratia will be granted to the Next of Kin of the Agniveer. The details of categorization of death and payment on death are as follows:</p>

<p>2. The provision of grant of ex-gratia takes into account the hardships and risks involved in certain assignments, the intensity and magnitude of the tragedy and deprivation that families of government servants experience on the demise of the breadwinner in different circumstances, the expectation of the employer from the employees to function in extreme circumstances, etc.&nbsp;The compensation is intended to provide security to employees who are required to function under trying circumstances and are exposed to different kinds of risks in the performance of their duties.</p>



<p>3. The Powers to Sanction ex-gratia payment under this order is with AG/CoP/AOP in case of Army, Navy and Air Force respectively, in consultation with PIFA (Principle Integrated Financial Advisor). Thereafter payment will be released to NoK by CPAO (New Delhi), NPO and AFCAO in respect of Army, Navy and Indian Air Force. Agniveers. Further, in case of any disagreement, regarding grant of Ex-gratia to Nok of Agniveer, the matter will tie decided by Department of Military Affairs, not below the rank of Additional Secretary.</p>



<p>4. The conditions and guidelines to be observed for grant of ex-gratia in terms of these orders are indicated in the&nbsp;<strong>Annexure-I</strong>.</p>



<p>5. The definition of the Bonafide official duty is annexed at&nbsp;<strong>Annexure-2</strong>.</p>



<p>6. This issues with the concurrence of Finance Division of this Ministry vide their I.D. No 372/2022-AG/PD of R.F. 2(8)/2022-AG/PD dated 02.12.2022.</p>

<h3 class="wp-block-heading"><strong>Conditions governing the payment of ex-gratia and guidelines to be observed:</strong></h3>



<p>The main condition to be satisfied for the payment of the ex-gratia in the specified circumstances is that the death of the Agniveer concerned should have occurred in the actual performance of Bonafide official duties. In other words, a causal connection should be established between the occurrence of death and government service.</p>



<p>2 Powers having been delegated to the AGICOP/AOP in case of Army, Navy and Air Force, respectively, to sanction ex gratia payments under these orders, it shall be their responsibility as well as that of the Principal Integrated Financial Advisers (P/FAs) to satisfy themselves that the death of an Agniveer to be compensated by the payment of the ex gratia to the family in fact occurred in the actual performance of Bonafide official duties and to establish its causal connection and nexus with government service. This could be done on the basis of medical and other documents relating to the case.</p>



<p>3 Even if an Agniveer had died in such circumstances that a medical report could not be secured, the nexus and causal connection with government service would need to be adequately established in determining the entitlement to the ex gratia lumpsum payment. In deciding this Issue, all evidence (both direct and circumstantial) shall be taken into account and the benefit of reasonable doubt should be given to the claimant. The benefit of reasonable doubt will be extended more liberally in field service cases.</p>



<p>4 In cases of accidents to commercial aircraft resulting In the death of passengers, compensation |s payable to the next of kin by the national or private airline concerned in terms of international conventions. The ex-gratia in terms of these orders will, therefore, not be admissible in addition in the event of death due to accidents while travelling on duty by commercial aircraft and shall be restricted only to those cases where death occurs in an accident while travelling on duty by service aircraft. The payment of ex gratia in these cases will be without prejudice to the bond required to be executed by the Agniveer, if any, indemnifying the Government against any claims on account of death while travelling by service aircraft.</p>



<p>5. Railways also pay compensation to the next of kin of passengers killed in train accidents. Therefore, the ex gratia compensation admissible in terms of para 1 (a) &amp; (b) of these orders shall be reduced by the compensation, if any, received by the next of kin of an Agniveer killed in train accidents while travelling on duty.</p>



<p>6 Ex Gratia compensation under para 1 (a) &amp; {b) of these orders will be admissible to an Agniveer killed while employed in aid of the civil administration in quelling agitations. protest demonstrations. riots. etc.. regardless of whether such agitations. demonstrations. etc. are resorted to by members of the public, political parties. etc. or by other public servants. including police personnel. In addition. on the context of 4 perceptible increase in violence-related incidents over tie years, An Agniveer on duty could become unwitting victims of bomb basis in public places or vehicles, indiscriminate shooting incidents in public. etc, often resorted to by terrorists, anti-social elements, etc. The compensation under para 1 (a) &amp; (b) of these orders will also, therefore, be admissible in cases of death in such incidents, provided the Agniveer concerned were actually on duty at the elevant time.</p>



<p>7 Families of Agniveer killed after being kidnapped by militants. terrorists,&nbsp;extremists, eic because of their official position or with a view to Spreading terror will also be entitled to the compensation under these orders.</p>



<p>8 Cases of death resulting from acts of violence or assault by terrorists, anti-social elements, etc. against an Agniveer with the intention of deterring or preventing him from performing his duties: or because of any act done or attempted to be done by such Agniveer in the lawful discharge of his duties or because of his official position will also be covered under para 1 (a) &amp; (b).</p>



<p>9. In case of any doubt in regard to the applicability of the ex gratia compensation scheme, such cases will be referred to the Department of Military Affairs (CMA) and these matters be decided by DMA, not below the rank of Additional Secretary.</p>



<p>10. Ex-gratia shall be admissible in addition to other benefits like non-contributory insurance and Seva Nidhi.</p>



<p>11. In determining the admissibility of the ex-gratia payable from Central Government funds, ex-gratia payments, if any, made to families of the deceased Agniveer from State funds by the State Government concerned shall not be taken into account and shall be excluded.</p>



<p>12. In certain cases, relief is also provided to families of deceased Agniveers from sundry Government sources, such as the Prime Minister’s Relief Fund, Chief Minister’s Relief Fund etc. In such cases, it should be ensured that the aggregate of the relief/ ex-gratia paid from different sources does not exceed Rs.9 Lakhs in each individual case.</p>



<p>13. in view of the fact that the ex gratia in terms of these orders is payable to the families of the deceased Agniveer default or contributory negligence, if any, on the part of the Agniveer concerned shall not be taken into account in sanctioning the compensation.</p>



<p>14. Where any doubt arises as to the interpretation of the provisions of these orders. It shall be referred to the Department of Military Affairs (DMA) and these matters be decided by DMA. not below the rank of Additional Secretary.</p>



<p class="has-text-align-right"><strong>ANNEXURE-2</strong></p>



<p><strong>DEFINITION OF BONAFIDE OFFICIAL DUTY IN RESPECT OF CASES COVERED UNDER LETTER NO. 1(21)2022/D (PAY/SERVICES) DATED</strong></p>



<p>The definition of Bonafide official duties has been clarified for better interpretation of these orders regarding grant of Ex-gratia to the next of kin of the Agniveers who die in harness in the performance of their Bonafide official duties:</p>



<p>(a) An Agniveer subject to the disciplinary code of the Armed Forces shall be treated on ‘Bonafide Official duty’:</p>



<ul class="wp-block-list">
<li>a. When performing an official task or a task failure to do which would constitute an offence, triable under the disciplinary code applicable to him.</li>



<li>b. When moving from one place of duty to another place of duty irrespective of the mode of journey.</li>



<li>c. During the period of participation in recreation and other unit/sports activities organized or approved by service authorities and during the period of traveling in relation thereto.</li>
</ul>



<p>Note 1: An Agniveer participating in local/ national/ international sports tournaments as member of service teams or mountaineering expeditions/ gliding organized by service authorities, with the approval of Service HQs, shall be deemed to be ‘on Bonafide duty’ for the purpose of grant of ex-gratia.</p>



<p>Note 2: An Agniveer participating in sports tournaments or in privately organized mountaineering expeditions of indulging in gliding as a hobby in their individual capacity, shall not be deemed to be ‘on Bonafide duty’ for the purpose of grant of ex-gratia lump sum compensation, even though _ prior permission of the competent service authorities may have been obtained by them.</p>



<p>Note 3: An Injuries sustained by Agniveer in impromptu games and sports which are organized by or with the approval of the local service authority and death or disability arising from such injuries, will be regarded as having occurred ‘on Bonafide duty’ for the purpose of grant of ex-gratia.</p>



<p>Note 4: An Agniveer deputed for training at courses conducted by the Himalayan Mountaineering Institute, Darjeeling and other similar institutes shall be treated at par with personnel attending other authorized professional courses or exercise for the Defence Services for the purpose of grant of ex-gratia on account of death sustained during the courses.</p>



<p>d. When proceeding on leave/ valid out pass from his duty station to his leave station or returning to duty from his leave Station on leave/ valid out pass.</p>



<p>Note 1: An Agniveer while travelling between his place of duty to leave station and vice-versa is to be treated on duty irrespective of whether he has availed railway warrant/ concession vouchers/ cash TA etc or not for the journey. This would also include journey performed from leave Station to duty station in case the individual returns early.</p>



<p>Note 2: The occurrence of death should have taken place in reaching the leave station from duty station or vice versa using the commonly available/ adopted route and mode of transport.</p>



<p>e. When travelling by a reasonable route from one’s official residence to and back from the appointed place of duty, irrespective of the mode of conveyance (whether private or provides by the Government).</p>



<p>f. Death which occurs when an individual is not strictly ‘on duty’ e.g. on leave, including cases of death as a result of attack by or action against extremists or anti-social elements may also be considered attributable to service, provided that it involved risk which was due to his belonging to the Armed Forces and that the same was not a risk faced by a civilian. Death due to personal enmity is not admissible.</p>

<p><strong>Subject: Submission of Income Tax Savings Documents for the Financial Year 2022-2023: DAD</strong></p>



<p>For the purpose of assessment and regularization of Income Tax for the Financial Year 2022-2023 (Assessment Year 2023-2024) all the officers and staffs are requested to submit the following documents:-</p>



<ul class="wp-block-list"><li>I. Proof of savings documents insurance premium receipt, NSC, Infrastructure Bond, PPF Bank statement, Housing Loan Certificate from Bank, rent receipt, copy of House owner’s PAN card etc should be produce as per Annexure I and II (enclosed).</li><li>II. Any Officers and staffs claiming exemption of Income Tax under IT Act 1961 under section 197 who have not forwarded the Exemption Certificate for Fy. 2022-23 from Income Tax Department are advised to do so at the earliest; failing which total Tax payable will be deducted at source and Tax refund if any should be claimed only from IT Department. In this connection it is also stated that exemption allowed will be limited to the amount of salary and period of exemption mentioned in the Income Tax Department. Any amount exceeding the amount mentioned in the Certificate and any salary drawn prior or after the period mentioned will be liable for tax deduction. Moreover, the said certificate must pertain to TAN of CDA Guwahati, i.e. SHLC00100C.</li><li>III. employees who had produced &#8220;Self Declaration&#8221; earlier, should also submit proof of savings/documents along with Annexure I and Annexure II failing which the “Self Declaration” submitted earlier shall be considered null and void and Tax Deduction at source shall be done accordingly.</li></ul>



<p>It is therefore requested to submit the above documents (whichever applicable) duly completed in all respect such a way that should reached at this office on or before 31.10.2022 to enable the DDO to regulate the Income Tax deduction at source during the current financial year. In absence of receipt of the aforementioned documents from the official, the Income Tax will be deducted based on the available information at this end and any refund, if admissible may be claimed only from the Income Tax Department.</p>

<p><strong>Government appoints Lt General Anil Chauhan (Retired) as Chief of Defence Staff (CDS)</strong></p>

<p>The Government has decided to appoint Lt General Anil Chauhan (Retired) PVSM, UYSM, AVSM, SM, VSM as the next Chief of Defence Staff (CDS) who shall also function as Secretary to Government of India, Department of Military Affairs with effect from the date of his assumption of charge and until further orders. In a career spanning over nearly 40 years, Lt Gen Anil Chauhan had held several command, staff and instrumental appointments and had extensive experience in counter-insurgency operations in Jammu &amp; Kashmir and North-East India.</p>



<p>Born on 18th May 1961, Lt Gen Anil Chauhan was commissioned into the 11 Gorkha Rifles of the Indian Army in 1981. He is an alumnus of the National Defence Academy, Khadakwasla and Indian Military Academy, Dehradun. In the rank of Maj General, the officer had commanded an Infantry Division in the critical Baramula sector in the Northern Command. Later as Lt General, he commanded a corps in the North East and subsequently went to become the General Officer Commanding-in-Chief of the Eastern Command from September 2019 and held the charge until his retirement from the service in May 2021.</p>



<p>In addition to these command appointments, the officer also tenanted important staff appointments including the charge of Director General of Military Operations. Earlier, the officer had also served as a United Nations mission to Angola. The officer superannuated from the Indian Army on 31 May 2021. Even after his retirement from the Army, he continued to contribute to national security and strategic matters. For his distinguished and illustrious service in the Army, Lt General Anil Chauhan (Retired) was awarded the Param Vishisht Seva Medal, Uttam Yudh Seva Medal, Ati Vishisht Seva Medal, Sena Medal and Vishisht Seva Medal.</p>
