2. The matter has beep examined in this Ministry in consultation with Ministry of Defence and it has been decided to extend CGHS benefits to Defence Industrial Employees of Naval Dockyard, Central Ordinance Depot and AFMSD in Mumbai

Subject: Payment of Overtime Allowance (OTA) as per revised pay to the employees of Defence Industrial Establishments under Factories Act, 1948 consequent to implementation of the 7th CPC recommendations.
Respected Sir,
With due regards, your attention is invited to the Anomalies Committee meeting held on 26.12.2016 under the Chairmanship of AS(J) Shri J Rama Krishna Rao wherein we have reflected our concern over the delay in the revision of statutory nature allowance (Over Time Allowance under the Factories Act, 1948) in defence establishments.

In turn, the AS(J) pleased and instructed to resolve the matter of the payment of Over Time Allowance as per revised pay consequent to implementation of 7th CPC recommendations.

Meanwhile, OFB has already submitted its views on the subject matter which is contrary to the statutory provisions and the copy of the OFB’s letter is enclosed for your perusal.

Therefore, you are requested to take necessary action so that the issue of the payment of overtime allowance in defence establishments on the revised pay of 07th CPC may be resolved without further delay.

Various queries have been raised by factories in regard to trade test for Industrial Employees. The same have been complied and a consolidated clarification is being issued for the same in the table underneath

SRO 185/1994 only provides readency period norms. Reasonably, however, trade test may be conducted for all categories of Industrial Employees from Semi-skilled to HS-II, one month prior to the completion of the qualifying service / residency / probationary period after imparting the 15 days training mentioned above. Actual promotion/placement is qualifying, however to be accorded after completion of necessary qualifying service/residency period (satisfactory competition of probationary period in respect of Semi-skilled lEs), and getting necessary vigilance e clearance.

Whether for promotion to the post of MCM, a trade test is required.
No trade test is required for promotion to the post of MCM. PC of A (Fys) clarification No. Pay/Tech-II/04 dated 08-11-2013 circulated vide OFB Circular No. 20/15/GenI./A/IR dated 04th December 2013 refers.

How the movement of IEs has to be regulated from 14.06.2010 to 13.12.2010
From 01.01.2006 to 14.06.2010. IEs can have two movements.1. First movement against exemption provided vide MoD Circular No. 11(5)/2009-D(Civ.I) dated 14/06/2010 for the above period. 2. Second movement against a valid trade test as mentioned in para above, subject to fulfilment of residency period norms. Beyond 14.06.2010 1. No exemption as per MoD letter dated 14.06.2010 is to be given. All movements are to be regulated against a valid trade test as mentioned in para 2 above, subject to fulfilment of residency period norms.

An important clarification order on Child Care Leave to Defence Civilian Female Industrial Employees has been issued by the Department of Personnel and Training today. The order said that the benefit of Child Care Leave to civilian female industrial employees working in Defence Establishments with effect from September 2008. If earned leave availed by these employees between 1.9.2008 and 20.10.2011 may be converted into Child Care Leave.

Subject : Grant of Child Care Leave to Civilian Female Industrial Employees of Defence Establishments.
The undersigned is directed to refer to this Department OM of even number dated 20.10.2011 on the above subject and to state that it has been decided to extend the benefit of Child Care Leave to civilian female industrial employees working in Defence Establishments w.e.f. 01.09.2008 at par with the non industrial Central Government employees covered by the CCS (Leave) Rules, 1972. Earned Leave, if any availed by these employees between 01.09.2008 and 20.10.2011 specifically for the purpose of taking care of the needs of their eldest two minor children may be converted into Child Care Leave.

2. All conditions specified in Rule 43-C of the CCS (Leave) Rules, 1972 including the number of days and number of spells have to be fulfilled for conversion of Earned Leave into Child Care Leave.
