Subject: One Rank One Pension to the Defence Forces Pensioners.

The undersigned is directed to refer to this Ministry’s letter No. 1(1)/2019/D(Pen/Pol) dated 04.01.2023 notifying revision of pension under One Rank One Pension Scheme (OROP) with effect from 01.07.2019 to all Pre 01.07.2019 Defence Forces Pensioners/Family Pensioners. Para 3 of the letter provides that detailed instructions relating to implementation of OROP along with tables indicating revised pension for each rank and each category shall be issued separately.

2. The undersigned is now directed to say that in order to quicken the process of revision of pension/family pension, total 121 tables indicating rates of pension/family pension under OROP scheme are appended to this order. The appended tables indicate revised rates of Retiring/ Service/ Special/ Disability/ Invalid/ Liberalized Disability/ War Injury Pension including Disability/ War Injury Element and Ordinary/ Special / Liberalized Family Pension of Commissioned Officers, Honorary Commissioned Officers, JCOs/ORs and Non-Combatants (Enrolled) of Army, Navy, Air Force, Defence Speciality Corps & Territorial Army Retired / Discharged / Invalided. Out from Service/died in service or after retirement. The existing pension of all Pre- 01 .07.2019 (except pensioners entered on or after 01 .07.2014 pre-matrix retirement/own request as provided in para 4 of MoD letter No. 1 2(1)/2014/D (Pen/Pol)Part.II dated 07.11.2015 as amended vide Ministry of Defence, Department of Ex-Servicemen letter No. 12(1)/2014/D (Pen/Pol) Pan-II dated 06.06.2017) pensioners/ family pensioners shall be enhanced with reference to applicable table for the rank (and group in case of JCOs/ORs) in which pensioned with reference to the actual qualifying service as shown in Column-1 of the tables subject to maximum term of engagement front time to time. The rate of pension of pensioners/ family pensioners drawing more than the revised rate of pension/ family pension indicated in annexed tables, shall remain unchanged.

APPLICABILITY

3. The provisions of this letter shall be applicable to all pensioners/ family pensioners who had been retired/ discharged/ invalided out from service/ died in service or after retirement in the rank of Commissioned Officers, Honorary Commissioned Officers, JCOs/ORs and Non- Combatants (Enrolled) of Army, Navy, Air Force, Defence Security Corps, Teritorial Army & Ex-State Forces and are in receipt of pension/ family pension as on 01.07.2019 (except pensioners retired after previous OROP revision on pre mature retirement/own request).

3.1 The provisions of this letter, however, do not apply to UK/ HKSRA/ KCIO pensioners, Pakistan & Burma Army pensioners, Reservist pensioners and pensioners in receipt of Ex-gratia payments and pensioners retired after previous OROP revision on pre-mature retirement/own request (as provided in para 4 of MoD letter dated 07.11.2015).

METHODOLOGY FOR IMPLEMENTATION

4. It is provided in para-2.6 of MoD letter dated 04.01.2023 that the pensioners retired on or after 01.07.2014 on premature retirement/own request are not eligible for benefits of OROP. The information regarding premature retirement/own request is not available in the Pension Payment Order (PPO). Hence, table-based revision by PDA in such cases is not feasible.

4.1 Therefore, it is decided that the pension of all pensioners retired/discharged on or after 01.07.2014 and before 01.0.7.2019) will be 7fy/6f/fC/f/6 High corrigendum PPO. Since most of the data of pensioners/family pensioners have been migrated in SPARSH application, therefore, revision of pension of migrated pensioners/family pensioners wil1 be done through SPARSH application only. The corrigendum PPO in the case of remaining pensioners retired/discharged on or after 01.07.2014 and before 01.07.2019 will be issued by Pension Sanctioning Authorities in affected cases, so-moto (where rates of pension under these orders are beneficial than the rates of their pension as on 01.07.2019).

4.2 In all other cases i.e pensioners retired/discharged rip to 10.06.2014, invalided out prior to 01.07.2019 and family pensioners, this revision will be implemented based on the pension tables as appended with this order. All Pension Disbursing Agencies (PDAs) hand high disbursement of pension to Defence pensioners are hereby authorized to carry out revision of Retiring/ Service/ Special/ Disability/ invalid/ Liberalized Disability/ War Injury Pension including Disability/ War Injury Element and Ordinary/ Special/ Liberalized Family Pension of all, such pre-01.07.2019 pensioners/family pensioners drawing pension as on 01.07.2019 in terms of this order with applicable rates of dearness relief without calling for any applications from the pensioners and without any further authorization from the Pension Sanctioning Authorities concerned.

4.3 The revised rates of pension under this letter are average of in minimum & maximum rate of pension for a rank and a qualifying service of live data of 2018 retirees. Wherever, the rates of higher qualifying service of a rank are lower than rates of lower qualifying service in sane rank or data is/are blank for higher qualifying service then the same have been protected by higher rate of lower qualifying service, due to this, many rates in same column appears equal. Similarly, wherever the revised rate of pension under this order are lower in higher rank than rate in lower rank in same qualifying service then the same have been protected with higher rates of pension in lower rank in same qualifying service resulting similar rate in some qualifying service in two adjacent columns.

5. Where the revised pension as on 01.07.2019 worked out in terms of this letter, happens to be less than the existing pension/ family pension as on 01.07.2019, the pension shall not be revised to the disadvantage of the pensioner/ family pensioner.

6. Arrears on account of revision of pension front 01.07.2019 till date of its implementation shall be paid by the Pension Disbursing Agencies in four half yearly installments. However, all the family pensioners including those in receipt of Special/Liberalized family pension and all Gallantry award winners shall be paid arrears in one installment.

7. The initial Pension Payment Order (PPO) or its Corrigendum PPO (Corr PPO) indicates rank, group and qualifying service for which the individual has been pensioned. This information is available with Pension Disbursing Agencies as they have revised pension of all such pensioners in the recent past in terms of Government orders issued for implementation of recommendations of 7th CPC. Hence, however, any information regarding qualifying service, rank, group etc., is not available with Pension Disbursing Agencies, such cases may be referred to Pension Sanctioning Authority concerned on the Piofollra enclosed as Annexure A. The Pension Sanctioning Authorities concerned will provide the requisite information from the available records within 15 days of the receipt of request from the Pension Disbursing Agencies.

8. In case of any doubt relating to revision of pension in terms of this letter, Pension Disbursing Agencies way immediately take tip the matter with Nodal Officers of respective PSAs, details of which shall be notified by Pr. CDA (P), Prayagraj in their implementation instructions.

9. The revised rates of pension under this letter shall be basic pension from 01.07.2019 and therefore, additional pension as applicable to the old age pensioners/family pensioners on attaining the relevant age (80 years and above) shall also be enhanced by the PDAs from 01.07.2019 or the date from which the pensioner attains the age of 80 years or more, whichever is later.

PAYMENT OF LIFE TIME ARREARS (LTA)

10. If a pensioner to whom the benefit accrues under the provisions of this letter has died/dies before receiving the payment of arrears, the Life Time Arrears of pension (LTA) shall be paid in the following manner .-

• a) If the claimant is already in receipt of Family Pension or happens to be the pensioner in whose favour Family Pension already stands notified and the awardees has hot become ineligible for any reason, the LTA under the provisions of this letter should be paid to such a claimant by the PDA on their own.
• b) If the claimant has already received LTA in the past in respect of the deceased to whom the benefit would have accrued, the LTA under the provisions of this letter should also be paid to such a claimant by the PDA on their own.
• c) If the claimant is a person other than the one mentioned at 10(a) & 10(b) above, payment of LTA shall be made to the legal his /hers as per extant Government orders.

11. The following elements shall continue to be paid as separate elements in addition to the pension revised under this order .-

• i) Monetary allowance attached to gallantry awards viz. Param Vir Chakra, Ashok Chakra etc.
• ii) Constant Attendance Allowance, where admissible.
• iii) Dearness relief as sanctioned by the Government from time to time.

MISCELLANEOUS INSTRUCTIONS

12. No arrears on account of revision of pension/family pension shall be admissible for the period prior to 01.07.2019.

13. No commutation of pension Small be admissible on revised/additional amount of pension accruing as a result of revision of pension under this letter. However, the existing amount of pension, if any, that has been commuted will continue to be deducted from the revised pension.

14. As a result of this letter, there will be no change in the amount of gratuity already determined and paid with reference to the rules in force at the time of retire/discharge/invalidment/death.

15. Any overpayment of pension coming to the notice or under process of recovery shall be adjusted in full by the Pension Disbursing Agencies against arrears becoming due on revision of pension on the basis of this order.

METHODOLOGY FOR REPORTING

16. An intimation regarding disbursement of revised pension shall be furnished by the Pension Disbursing Agencies to the office of the Pr. CDA(P), Prayagraj in the format prescribed as Annexure-B to this letter in the following month in which revision takes place. PDAs shall also ensure that an intimation regarding revision of pension is invariably conveyed to the pensioners concerned for their information ii respective of the fact that the same is beneficial to them or not. The Public Sector Banks disbursing defence pensions through Central Pension Processing Centers (CPPC), the progress report shall be furnished by the CPPC of the bank directly to the office of Pr. CDA (Pensions) Prayagraj through electronic sections.

17. All other terms and conditions which are not affected by this order shall remain unchanged.

Five years of historic decision to implement OROP; Over Rs. 42740 Crore disbursed to 20,60,220 Defence Forces Pensioners / Family Pensioners

Government of India took the historic decision to implement One Rank One Pension, OROP by issuing an order on 7.11.2015, benefit effective from 01.07.2014, despite huge financial burden demonstrating its commitment to the welfare of ex-servicemen. Armed Forces Personnel retired upto 30.06.2014 were covered under this Order.  Keeping in view the magnitude and complexity of Defence pension, extensive consultations were held with experts and ex-Servicemen before issue of Government order on implementation of OROP.

Ex-Servicemen had been agitating for implementation of OROP nearly for the 45 years, but the same was not implemented before 2015.

OROP implies that uniform pension be paid to the Armed Forces Personnel retiring in the same rank with the same length of service regardless of their date of retirement.  Thus, OROP implies bridging the gap between the rate of pension of current and past retirees at periodic intervals.

A sum of Rs. 10795.4 crore has been disbursed to 20,60,220 Defence Forces Pensioners/ Family Pensioners as arrears on account of implementation of OROP.  The yearly recurring expenditure on account of OROP is about Rs.7123.38 crores and for about six years starting from 01.07.2014, the total recurring expenditure worked out to approximately Rs. 42740.28 crore.

Demands of Defence Ex-servicemen on OROP requiring immediate action

OROP beneficiaries also got the benefit of fixation of pension under 7^th CPC while calculating the pension by multiplication factor of 2.57.

State-wise figures of amount released on account of OROP arrears as on 11.10.2019 are as under.

• Above mentioned nation-wide payment details did not include the details of Nepali pensioners.

2. As per ibid Govt. letter, it has been decided that following minimum ceiling shall be applied to the under mentioned casualty pensionary awards:

• The Disability/Liberalized Disability/War Injury pension (i.e. total of service element plus disability/liberalized disability/war injury element as the case may be), shall be subject to minimum of Rs.18,000/- per month irrespective of degree of disability of the personnel.
• The amount of special family pension,admissible to the families of Armed Forces personnel, shall be subject to a minimum of Rs.18,000/- per month.
• The amount of liberalized family pension, admissible to the Child/Children of Armed Forces Personnel, shall be subject to a minimum of Rs.18,000/- per month.

3. All other provisions stipulated in above mentioned circulars which are not affected by the provisions of this letter, shall remain unchanged.

4. the provisions of this letter shall take effect from 01.01.2016

Copy of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 on the above subject, which is self-explanatory, is forwarded herewith for further necessary action at your end.

2. In terms of Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September,2017, Disability Element of Disability Pension to Armed Forces Pensioners has to be revised by multiplying the existing rate of Disability Element as had been drawn on 31.12.2015 by factor of 2.57 to arrive at revised rate of Disability Element as on 01.01.2016. Further, in terms of Para-5.2 & 5.3 of GOI, MOD letter No. 17(01)/2017(02)/D(Pension/Policy) dated 05th September’ 2017, Disability Pensionary awards has to be revised on notional pay fixation method and benefits of broad banding will be given to discharge cases also as in invalided out cases and these will be done by issuing Corrigendum Pension Payment Order (PPO).

3. Now, consequent upon the issue of GOI, MOD letter dated 23rd January, 2018, the cases where Armed Forces Pensioners who were retired/ discharged voluntary or otherwise with disability and they were in receipt of Disability/ War Injury Element as on 31.12.2015, their extent of disability/ War Injury Element shall be re-computed in the following manner given below, before applying the multiplication factor of 2.57 on existing disability/ war injury element as on 31.12.2015 for getting the revised disability/ war injury element as on 01.01.2016 in accordance to Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September’ 2017.

4. The Note below Para-12 of GOI, MOD letter No. 17(01)/2016-D(Pen/Pol) dated 29th October, 2016 (circulated vide Circular No. 570 dated 31.10.2016) stands deleted. In other words, quantum of additional pension available to old age pensioners after attaining the age of 80 years and above shall also be admissible on revised disability/ war injury element.

5. It is also stated that PDAs may take utmost care during revision of Disability/War Injury Element as per this order in those cases where the pensioners who are in receipt of 50% of Disability/ War Injury Element of Disability/ War Injury Pension. If the individual has already been given rounding of benefit through PPO (in invalided out cases) then rounding of benefit in such cases should not be given. However, where his disability was assessed as 50% in discharge cases then it will be rounded to 75% as mentioned in Para-3 above. If the PDAs found any problem regarding identification of such cases the same may please be forwarded to Audit Section of this office.

6. All Pension Disbursing Agencies handling disbursement of pension to the Defence Pensioner are hereby authorized to pay benefit of rounding off disability/ war injury and additional pension as per Para 3 & 5 above without any further authorization from the concerned Pension Sanctioning Authorities.

7. Provisions of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 shall take effect from 01.01.2016.

Subject: Implementation of Government decision on the recommendations of the 7th Central Pay Commission (CPC) – Revision of Disability/ War Injury pension for pre-1.1.2016 Defence Forces pensioners reg.

The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2016-D(Pen/Pol) dated 29th October 2016 modified vide letter No 17(01)/2017(01)/ D(Pension/Policy) dated 4th September, 2017 for revision of pension of pre-2016 Defence Forces pensioners/ family pensioners in implementation of the Government decisions on the recommendations of the 7th CPC. As per the same, disability element/ liberalized disability element/ war injury element of Defence Forces pensioners have been revised by the pension disbursing agencies by multiplying the existing rate of disability element as on 31.12.2015, by factor of 2.57 to arrive at revised rate of disability element as on 1.1.2016. The Ministry vide letter No 17(01)/2017(02)/D(Pension/Policy) dated 5th September, 2017 have also issued orders for revision of pension including disability element by issue of corrigendum PPO based on notional pay fixed as on 1.1.2016 in the 7th CPC pay matrix corresponding to the pay in the pay scale/ pay band 86 grade pay in which the pensioner had retired. The later order of 5th September, 2017 allows the benefit of broad banding of disability in cases of retirement/ discharge voluntary or otherwise with disability/war injury and additional pension on disability/war injury element to be authorized by issue of corrigendum PPO

2. In partial modification of Ministry’s said order dated 29th October, 2016 as modified, the President is now pleased to decide that in cases where Armed Forces pensioners who were retired/discharged voluntary or otherwise with disability and were in receipt of disability/war injury element as on 31.12.2015, their extent of disability shall be re-computed in the following manner before applying the multiplication factor of 2.57 on existing disability/war injury element to arrive at the revised disability element/war injury element as on 1.1.2016.

3. Rates for calculation of disability where composite assessment has been made due to existence of disability as well as war injury, shall be determined in terms of provision contained in Para 3(b) of Ministry’s letter No.16(02)/2015-D(Pen/Pol) dated 8th August 2016. The amount of revised disability element finally arrived shall be rounded off to next higher rupee.

4. The president is also pleased to decide that quantum of additional pension available to old age pensioners after attaining the age of 80 years and above, shall also be admissible on revised disability/war injury element. The Note below para 12 of this Ministry’s above mentioned letter dated 29th October,2016 stands deleted.

5. The provisions of this Ministry’s above -mentioned letter dated 29th October 2016 as modified vide letter dated 4th September,2017 and dated 5th September,2017 which are not affected by the provisions of this letter, shall remain unchanged.

6. PCDA (Pensions) Allahabad shall issue necessary implementation instructions for implementation of provisions of these orders directly by the pension disbursing agencies.

Subject : Implementation of Government’s decision on the recommendations of the 7th Central Pay Commission (CPC) – Revision of pension of pro-1.1.2016 Defence Forces pensioners/ family pensioners etc.

Sir,

The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2016 D(Pen/Pol) dated 29th October 2016 for revision of pension of pre-2016 Defence Forces pensioners/ family pensioners in implementation of the Government decisions on the recommendations of the 7th CPC. As per para 9 of this Ministry’s said order dated 29th October 2016 the revision of disability element of disability pension was held in abeyance pending decision of National Anomaly Committee to whom matter was referred by MoD to decide methodology for calculation of disability element of disability pension under 7th CPC. The National Anomaly Committee has recommended that parity with Civilians for grant of Disability element which was granted to Defence Forces under 6th CPC, shall be maintained.

2. The recommendations of the National Anomaly Committee have been considered by the Government. In partial modification of Ministry’s order dated 29th October 2016, the President is now pleased to decide that Disability element of disability pension for Defence Forces Pensioners shall also be revised by multiplying the existing rate of disability element as had been drawn on 31.12.2015 by factor of 2.57 to arrive at revised rate of disability element as on 1.1.2016. The amount of revised disability element so arrived shall be round-ed off to next higher rupee.

3. Para 13 of this Ministry’s above quoted letter dated 29.10.2016 regarding “Ex-gratia awards to Cadets in cases of disablement” shall be replaced with the following:

13. EX-GRATIA AWARDS TO CADET (DIRECT) The ex-gratia award payable to Cadet (Direct)/ NoKs in cases of disablement / death shall be payable subject to the same conditions as hitherto in force in the event of invalidment on medical ground / death of a Cadet (Direct) due to causes attributable to or aggravated by military training

(i) Monthly Ex-gratia amount of Rs 9,000/- per month

(ii) In cases of disablement, Ex-gratia disability award @ Rs 16,200/- per month shall be payable in addition for 100% of disability during period of disablement subject to prorata reduction in case the degree of disablement is less than 100%. “No ex-gratia disability award shall be payable in cases where the degree of disablement is less than 20%.”

4. The dearness relief sanctioned by the Government from 1.1.2016 and thereafter, shall also be paid on rates of disability element and monthly ex-gratia award to Cadet(Direct), revised in accordance with the provision of this letter.

5. Vide para 10(ii) of MOD order dated 29.10.2016, it was ordered to pay the Constant Attendance Allowance(CAA) at the existing rate since matter regarding grant of Allowances was under examination by the Committee on Allowances (CoA). in this regard, Ministry of Finance vide Resolution dated 6th July 2017 (Appendix II item 37 has accepted the recommendation of 7th CPC to enhance the existing Constant Attendance Allowance @ 4500/ p.m. by 50%. DoP&PW vide O.M No. 1/4/2017-P&PW(F) dated 2.8.2017 has issued orders in this-regard for civilian pensioners. Accordingly, for Armed Forces personnel the Constant Attendant Allowance shall continue to be admissible under the condition as hitherto fore at the existing rate from 1.1.2016 to 30.06.2017. However, it shall now be admissible at the enhanced uniform rate of Rs. 6750/- per month, irrespective of the rank with effect from 1.7.2017.

6. With reference to the provisions contained in Para 5.4 of this Ministry’s letter dated 29th October, 2016, it is further clarified that the maximum ceiling shall be applicable only in the case of Service/Retiring Pension, Service element of Disability/ liberalized disability /War Injury Pension and Ordinary family Pension. The said ceiling is not applicable in the cases of Disability/ Liberalised Disability/ War injury element. Special Family/ Liberalized Family Pension etc. applicable under casualty pensionary awards.

7. The provisions of this Ministry’s letter dated 29th October 2016, which are not affected by the provisions of this letter, shall remain unchanged.

8. The provisions of this letter shall take effect from 1.1.2016

New Delhi: The government on Saturday has notified revised pension of pre-2016 Defence Forces Pensioners on the recommendations of the 7th Pay Commission.

As per the order, for the pre January 1 pensioners, the revised pension w.e.f. January 1 shall be determined by multiplying the basic pension/basic family pension as had been drawn as on December 31 by 2.57 to arrive at revised pension under the seventh CPC.

The implementation of the 7th Pay Commission recommendation relating to methodology for calculation of disability element has been referred to the Anomaly Committee.

The disability element which was being paid to pre-2016 Defence Forces Pensioners as on December 31 will continue to be paid pending decision on the recommendations of the Anomaly Committee.
