<h3 class="wp-block-heading">Subject: Entitlement for family on death of a Central Government servant covered under National Pension System -reg.</h3>



<p>The undersigned is directed to say that Department of Pension and Pensioners’ Welfare has notified the Central Civil Services (Implementation of National Pension System) Rules, 2021 and Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021 which are applicable from the date of its publication in the Official Gazette, to govern service related matters and for grant of gratuity respectively to Central Government civil employees covered under National Pension System.</p>



<p>2. Rule 20 of the Central Civil Services (Implementation of NPS) Rules, 2021 provides for the entitlement of family members on death of a Central Government covered under National Pension System. As per rule 20, on death of a Subscriber, who had exercised option or in whose case the default option under rule 10 of the CCS(Implementation of NPS) Rules, 2021 is for availing benefits under the Central Civil Services (Pension) Rules, 1972 or Central Civil Services (Extraordinary Pension) Rules , further action will be taken by the Head of Office for disbursement of benefits in accordance with the Central Civil Services (Pension) Rules. However, if the death is attributable to Government service, further action will be taken by the Head of Office for disbursement of benefits in accordance with the Central Civil Services (Extraordinary Pension) Rules subject to fulfillment of all the conditions for grant of benefits under those rules.</p>



<p>3. If on death of the Subscriber, benefits are payable to the family under the Central Civil Services (Extraordinary Pension) Rules or the Central Civil Services (Pension) Rules, the Government contribution and returns thereon in the accumulated pension corpus of the Subscriber shall be transferred to Government account. The remaining accumulated pension corpus shall be paid in lump sum to the person(s) in whose favour a nomination has been made under the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under National Pension System) Regulations, 2015. If there is no such nomination or if the nomination made does not subsist, the amount of remaining accumulated pension corpus shall be paid to the legal heir(s).</p>



<p>4. In the case of death of a Subscriber who had exercised option or in whose case the default option under rule 10 of the CCS(Implementation of NPS) Rules, 2021 is for availing benefits under the National Pension System, such benefits may be granted in accordance with the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under National Pension System) Regulations, 2015.</p>



<p>5. In the event of death of Government employees covered under NPS during service, and in whose case benefits from accumulated pension corpus under NPS have been availed, family member of such deceased Government employee would also be eligible for death gratuity in accordance with rule 22 of the Central Civil Services (Payment of Gratuity under NPS) Rules, 2021. The rates provided in the rules for death gratuity is as under:</p>

<p>The maximum amount of death gratuity payable under this rule shall in no case exceed twenty lakh rupees.</p>



<p>6. All Ministries/ Departments are requested that the above provisions regarding entitlement in respect to Central Government employees covered under National Pension System may be brought to the notice of the Government servants covered under NPS and personnel dealing with the pensionary benefits in the Ministry/ Department and attached/ subordinate offices thereunder, for strict implementation.</p>

<p><strong>Death of a railway employee &#8211; Payment of a family pension, death gratuity, and other dues to a Railway servant&#8217;s family when he or she dies while on duty.</strong></p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Railway servant who dies in service after having rendered not less than 7 years continuous service, <strong>enhanced family pension will be payable to the family from the date of death of the Railway Servant for a period of ten years without any upper age limit</strong>.</p></blockquote>

<p>Please refer to the Board’s letter of even number dated 04.06.2021 circulating DOP&amp;PW’s O.M. No. 1/11/2021-P&amp;PW/(E) dated 03.06.2021 vide which order was issued providing for instructions regarding payment of family pension, death gratuity and other dues to the family on death of a Railway Servant during service.</p>



<ol class="wp-block-list" start="2"><li>One of the Zonal Railways had sought clarification regarding the applicability of the Board’s instructions dated 04.06.2021 on the past cases.</li><li>The issue has been examined in consultation with Department of Pension &amp; Pensioners’ Welfare (DOP&amp;PW) and it is clarified that Board’s instructions of even number dated 04.06.2021 are also applicable in respect of employees who expired before the date of issue of the said order irrespective of deceased employee covered under Old Pension scheme or under NPS.</li></ol>



<p>This also disposes of North Eastern Railway’s letter No. पेंशन/मु./एनपीएस /समापक/2019 dated 25.02.2022.</p>

<h3 class="wp-block-heading">Subject: Determination of Pay/Emolument for calculation of family pension and death gratuity where a Government servant dies during currency of a penalty &#8211; regarding</h3>



<p>The undersigned is directed to say that 1n accordance with Rule 54(14)(c) of CCS Pension Rules, 1972, the pay for the purpose of family pension means the emoluments as specified in Rule 33 of the CCS (Pension) Rules, 1972 or the average emoluments as referred to in Rule 34 of the CCS (Pension) Rules, 1972, if the emoluments of the deceased Government servant have been reduced during the last ten months of his service otherwise than as penalty. Similar provision exists in Rule 50(5) for calculation of retirement/death gratuity.</p>



<p>2. As per Rule 33, the expression ‘emoluments’ means basic pay as defined in Rule 9(21)(a)(1) of the Fundamental Rules which a Government servant was receiving immediately before his retirement or on the date of his death. As per Rule 34, average emoluments are determined with reference to the emoluments drawn by a Government servant during the last ten months of his service.</p>



<p>3. References have been received in this Department seeking advice as to how family pension and death gratuity in respect of a Government servant are to be calculated if a Government servant dies during the currency of a penalty, which reduces the pay of the Government servant for a specified period only, as in such cases the impact of the penalty is limited to the period specified in the order of penalty and the Government servant regains his pay and increments after the period of penalty is over. Clarifications have been sought whether, in such cases, family pension and gratuity would be calculated based on the reduced pay, which the Government servant was actually drawing on the date of death or on the pay which the he would have drawn if such a penalty had not been imposed on him.</p>



<p>4. The matter has been examined in consultation with Department of Expenditure. The manner in which the pay of a Government servant is to be regulated on imposition of penalties of reduction to a lower stage, withholding of increment and reduction to a lower time scale, has been explained in Department of Personnel &amp; Training’s OM No. 11012/15/2016-Estt A-III dated 18th June, 2019. These instructions also bring out the penalties on imposition of which there is no impact on the pay after the expiry of the period of penalty and also the manner in which notional pay of a Government servant is to be fixed during the currency of such penalties.</p>



<p>5. It is observed that determination of family pension and death gratuity based on actual pay drawn in case of death during the currency of a penalty referred to in para 3 above would result in reduced amount of death gratuity and also reduced family pension to the widow/family. This may not be the intention of the disciplinary authority while imposing that penalty. Therefore, in cases where the intention of the disciplinary authority was to restrict the impact of the penalty on the Government servant for a specified period only, determination of family pension and death gratuity on the basis of the reduced pay during the currency of such penalty would result in an unintended hardship to the family of the Government servant, who dies during the currency of such penalty.</p>



<p>6. It has, accordingly, been decided that in cases where a Government servant dies during the currency of a penalty on expiry of which he would have regained the same pay which he would have drawn if the penalty had not been imposed on him, the family pension and death gratuity in respect of such Government servant shall be determined based on the notional pay which he would have been entitled to on the date of death and such notional pay may be treated as emoluments for this purpose.</p>



<p>7. These instructions shall be applicable with immediate effect and the past cases shall not be re-opened. However, the cases where the death of a Government servant has occurred before the issue of these instructions but family pension and death gratuity has not been determined so far may also be decided in accordance with these instructions.</p>



<p>8. Necessary amendment in the CCS (Pension) Rules, 1972 shall be made separately.</p>



<p>9. This OM is issued with the concurrence of Ministry of Finance, Department of Expenditure vide their ID No. 1(13)//EV/2021 dated 12.08.2021.</p>



<p>10. In its application to persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller and Auditor General of India vide their यू.ओ.संख्‍या-216-स्‍टाफ हक.(नियम)/ए.आर./09-2019 दिनांक 23.09.2021.</p>



<p>11. The Administrative Divisions of all Ministries/Departments and attached/subordinate offices are requested to bring the contents of these instructions to the notice of all concerned for compliance.</p>

<h3 class="wp-block-heading">विषय:- Payment of family pension, death gratuity and other dues to the family on the death of a Government servant during service &#8211; Regarding.</h3>



<p>The undersigned is directed to say that the Covid-19 pandemic has claimed lives of several Government employees during the recent surge. In many cases, the deceased employees were the sole bread-winners of their family and the casualties have left families devastated and in an urgent need for funds for livelihood. It is, therefore, incumbent on the Government to ensure that the family pension and other entitlements in respect of the deceased employees are released to their families expeditiously.</p>



<p>2. The completion of the process for sanction of family pension and its disbursement through the Bank may take some time, as it involves reference to PAO and CPAO. To deal with such situations, Rule 80-A of the CCS (Pension) Rules, 1972 provides for payment of provisional family pension and also provisional death gratuity, pending issue of the Pension Payment Order (PPO).</p>



<p>3. Department of Pension &amp; Pensioners’ Welfare has issued instructions vide OM No. 1/11/2020-P&amp;PW (E) dated 29th July, 2020 for sanction of provisional family pension by the Head of Office immediately on receipt of a claim for family pension and death certificate from the eligible family member, without waiting for forwarding of the family pension case to Pay &amp; Accounts Office (PAO). Rule 80-A provides for payment of provisional death gratuity by the Head of Office once the family pension/death gratuity case has been forwarded to the PAO.</p>



<p>4. In view of the above, all Ministries/Departments and their attached and subordinate offices are requested to strictly comply with the rules/instructions as brought out above and to ensure that payment of provisional family pension is commenced by the Head of Office immediately on receipt of the claim (with death certificate) from the eligible family member and payment of provisional death gratuity is made to the nominees/family members immediately after forwarding the case to the PAO.</p>



<p>5. Simultaneously, the action may be taken on priority basis for disbursement of regular family pension through the Bank and for payment of other entitlements of the family on death of the Government servant.&nbsp;<em><strong>It may be ensured that the PPO for family pension is issued and disbursement of regular family pension is commenced by the Bank not later than one month of the&nbsp;receipt of the claim for family pension</strong></em>.</p>



<p>6. For facilitating expeditious disbursement of all the entitlements of the family on death of a Government servant, two separate notes- one in respect of the employees under Old Pension Scheme and the other in respect of the employees under National Pension System &#8211; are also enclosed as Annexure-I and Annexure-II, respectively.</p>



<p>7. All Ministries/Departments and their attached and subordinate offices will submit a monthly statement on 5th of every month to the Secretary of the Administrative Department in the following format:</p>

<h2 class="wp-block-heading"><strong>ENTITLEMENTS OF FAMILY ON DEATH OF A GOVERNMENT SERVANT DURING SERVICE</strong></h2>



<h3 class="wp-block-heading"><strong>(1) Entitlements of family on death of a Government servant under Old Pension Scheme</strong></h3>



<h4 class="wp-block-heading"><strong>A.&nbsp;Family Pension&nbsp;:</strong></h4>



<p><strong>Amount</strong>&nbsp;: 50% of last pay for a period of 10 years from the date following the date of death. Thereafter @ 30% of last pay.</p>



<p>(Enhanced family pension @50% of pay is payable for 10 years in all cases without reference to the length of service of the deceased employee, as per amended Rule 54(3))</p>



<p><strong>Eligibility of family members</strong>&nbsp;: : Family pension will be paid to members of family in the following order:;-</p>

<p><strong>*&nbsp;</strong>A child (other than a child suffering from a mental or physical disability) and parents shall be eligible, if their income from other sources is less than the minimum family pension (i.e. Rs. 9000/- p.m.) plus dearness relief thereon.</p>



<p><strong>**</strong>&nbsp;A child or sibling suffering from a mental or physical disability shall be eligible if their overall income from other sources is less than the entitled family pension admissible on death of Government servant plus dearness relief thereon.</p>



<p><strong>Documents required to be submitted by the claimant for family pension</strong>&nbsp;: (i) Application in Form 14, (ii) a copy of death certificate, (iii) proof of relationship, (iv) proof of date of birth, (v) copy of first page of the Pass Book, (vi) copy of PAN card. (vii) Specimen signature and (viii) PP size photographs</p>



<p><strong>Action to be taken By HOO:</strong></p>



<ul class="wp-block-list"><li>Sanction provisional family pension to eligible family member immediately on receipt of claim, without waiting for forwarding of case to PAO or authorisation by PAO. (Department of Pension &amp; Pensioners’ Welfare’s OM No. 1/11/2020-P&amp;PW (E) dated 29th July, 2020)</li><li>Separately, process the case for family pension and death gratuity in Bhavishya and forward the case to PAO in Form 18 along with other documents for further processing/authorisation. (Rule 80)</li><li>Government dues such as HBA, licence fee, etc. are to be recovered from death gratuity.</li></ul>



<h4 class="wp-block-heading"><strong>B. Death Gratuity:</strong></h4>

<p><strong>Maximum amount of death gratuity</strong>&nbsp;: Rs. 20 lakh.</p>



<p><strong>Eligibility:</strong></p>



<ul class="wp-block-list"><li>Gratuity is to be paid to the family member(s)/person(s) in whose favour a valid nomination exists. If there are more than one nominee, amount of gratuity shall be shared by all nominees as specified in the nomination.</li><li>If a nominee has pre-deceased the Government servant, then the gratuity is to be paid to the alternate nominee(s), if any, mentioned in the nomination form.</li><li>If there is no nomination or the nomination made does not subsist, the amount of gratuity is to be equally shared among spouse, son(s), unmarried daughter(s) and widowed daughter(s).</li><li>If none of these family members is available, the amount of gratuity is to be equally divided among other family members, i.e. father, mother, married daughters, brothers below 18 years, unmarried/widowed sisters and children of a pre-deceased son.</li><li>Succession certificate is not to be asked for unless there is no valid nomination and also none of the family members mentioned above is available.</li></ul>



<p><strong>Documents required to be submitted by the claimant for gratuity</strong>&nbsp;: (i) Application in Form 12, (ii) Death certificate, (iii) copy of PAN card, (iv)copy of first page of bank pass book and (v) proof of relationship.</p>



<p><strong>Action By HOO:</strong></p>



<ul class="wp-block-list"><li>Process the case for death gratuity (along with family pension) in Bhavishya and forward the case to PAO in Form 18 along with other documents for further processing/authorisation.</li><li>Sanction provisional death gratuity in accordance with Rule 80-A, after forwarding the case to PAO</li></ul>



<h4 class="wp-block-heading"><strong>C. Cash equivalent of leave salary (Leave Encashment)</strong></h4>



<p>As per Rule 39-A of CCS (Leave) Rules, 1972, cash equivalent of leave salary for earned leave not exceeding 300 days is payable to the family. If the earned leave in the credit of the deceased Government servant is less than 300 days, half pay leave is encashed to the extent the earned leave is short of 300 days.</p>



<p><strong>Eligibility</strong>&nbsp;: One of the available family members in this order -&gt; Spouse, eldest surviving son, eldest surviving unmarried daughter, eldest surviving widowed daughter, father/mother, eldest surviving married daughter, eldest surviving brother below the age of eighteen years, eldest surviving unmarried sister, eldest surviving widowed sister; eldest child of the eldest predeceased son.</p>



<p>Leave encashment is processed/sanctioned by HOO on receipt of death certificate without seeking any application for this purpose.</p>



<h4 class="wp-block-heading"><strong>D.&nbsp;Central Government Employees Group Insurance Scheme (CGEGIS)</strong></h4>



<p><strong>Amount</strong>&nbsp;: In addition to the amount standing in the Savings Fund of CGEGIS, an amount of Rs. 1,20,000, Rs. 60,000/- and Rs. 30000/- is paid to the family of the deceased employee belonging to Group A, Group B and Group C, respectively.</p>



<p><strong>Eligibility of family members :</strong></p>



<ul class="wp-block-list"><li>CGEGIS amount is payable to family member(s)/person(s) in whose favour a valid nomination exists.</li><li>In the absence of a nomination, the amount is paid to the family members eligible as per the rules applicable for payment of death gratuity.</li><li>The claim for CGEGIS is processed/sanctioned on receipt of death certificate without seeking any application for this purpose.</li></ul>



<h4 class="wp-block-heading"><strong>E.&nbsp;General Provident Fund (GPF)</strong></h4>



<ul class="wp-block-list"><li>On receipt of the death certificate, the balance in the GPF account of the deceased Government is sanctioned to the family member(s)/person(s) in whose favour a valid nomination exists. In the absence of a nomination, GPF balance is paid to the family members eligible as per GPF Rules.</li><li>As per the Deposit Linked Insurance Scheme under Rule 33-B of the GPF Rules, in addition to the GPF balance, an additional amount equal to the average balance in the GPF account during the 3 years immediately preceding the death of the Government is also paid, subject to the conditions that the balance at the credit did not, at any time during the three years preceding the month of death, fall below the limits mentioned in Rule 33-B.</li><li>The additional amount to be paid shall not exceed Rs. 60,000/-.</li><li>The claims for GPF/DLIS are to be processed/sanctioned by the office on receipt of death certificate.</li></ul>

<p class="has-text-align-right"><strong>Annexure-2</strong></p>



<h3 class="wp-block-heading"><strong>(1)&nbsp;Entitlements of family on death of a Government servant under National Pension&nbsp;</strong><strong>System who had opted for benefits under Old Pension Scheme or in whose case, no&nbsp;</strong><strong>option was exercised and the default option is Old Pension Scheme</strong></h3>



<ul class="wp-block-list"><li><strong>Family Pension</strong>&nbsp;: Same as under Old Pension Scheme.In addition, employee’s contributions and returns thereon in the NPS pension Corpus shall also be paid to the family member. HOO will start process to sanction family pension and simultaneously close PRAN under NPS and Government contribution (and returns thereon) would be transferred into the Government account. Remaining amount would be paid in lump sum to the nominee or legal heir as per PFRDA regulations.</li><li><strong>Death Gratuity</strong>&nbsp;: Same as under Old Pension Scheme</li><li><strong>Cash equivalent of leave salary (Leave Encashment)</strong>&nbsp;: Same as under Old Pension Scheme</li><li><strong>Central Government Employees Group Insurance Scheme (CGEGIS) :</strong>&nbsp;Same as under Old Pension Scheme</li></ul>



<p><strong>(2)</strong>&nbsp;<strong>Entitlements of family on death of a Government servant under National Pension System:</strong></p>



<p><strong>(i)&nbsp;who had specifically opted for benefits under NPS based on accumulated pension corpus or</strong></p>



<p><strong>(ii)&nbsp;who had opted for Old Pension Scheme or in whose case default option is Old Pension Scheme but there is no family member eligible for family pension under Old Pension Scheme</strong></p>



<ul class="wp-block-list"><li><strong>Benefits based on NPS Corpus</strong>: Concerned office would take action to close PRAN under NPS of the deceased Government servant and grant benefits of lump sum (maximum 20% of accumulated pension wealth) and annuity from the remaining pension wealth to the eligible family member from annuity service provider registered with PFRDA, in accordance with PFRDA (Exits and Withdrawals under NPS) Regulations, 2015</li><li>Death Gratuity: Same as under Old Pension Scheme</li><li>Cash equivalent of leave salary (Leave Encashment )<strong>:</strong>&nbsp;Same as under Old Pension Scheme</li><li><strong>Central Government Employees Group Insurance Scheme (CGEGIS)</strong>: Same as under Old Pension Scheme.</li></ul>

<p>I am to inform you that Ministry of HRD, vide letter dated 22.04.2019, has directed KVS for stoppage of retirement and death gratuity to the NPS subscribers forthwith. Therefore, death &amp; retirement gratuity and provisional family pension, in terms of CCS (Pension) Rules, 1972, will not be payable to NPS subscriber with effect from 30.04.2019 till further order.</p>

<p>Information regarding the number of Central Government employees in the country is not maintained centrally in this Ministry. As per information provided by Department of Expenditure, the total number of Central Government civilian employees, as on 01.03.2016, was 32, 21,183</p>
<p>Total number of Central Government civil pensioners, as on 31.03.2018, is 37, 02,882.</p>
<p>Central Government employees (except Armed Forces personnel) appointed on or after 01.01.2004 are covered under the National Pension System (NPS) notified vide Ministry of Finance (Department of Economic Affair&#8217;s) Notification No. 5/7/2003-ECB &amp; PR dated 22.12.2003 and Section 20 of PFRDA Act, 2013. Such employees are, therefore, not covered by the Central Civil Services (Pension) Rule, 1972, which are allocable to Central Government civil employees appointed on or before 31.12.2003.</p>
<p>Under NPS a monthly contribution of 10 percent of basic pay plus dearness allowance is required to be made by the employees and a matching contribution is made by the Government. It has since been decided to increase the Government contribution to 14 percent of basic pay and dearness allowance.</p>
<p>On superannuation/retirement, at least 40% of the accumulated pension wealth of such subscriber is mandatorily utilized for purchase of annuity providing for a monthly or any other periodical pension and the balance of the accumulated pension wealth after such utilization is paid to the subscriber in lump sum.</p>
<p>In the event of death of a Government servant of his discharge from service on account of disability or invalidation on medical grounds, the benefit of Central Civil Services (Pension) Rules, 1972 are available to the Government employees of his family members.</p>
<p>Central Government employees covered under NPS are eligible for the benefit of retirement gratuity and death gratuity on the same terms and conditions as are applicable under Central Civil Services (Pension) Rules, 1972.</p>
<p>NPS employees are also eligible for other post-retirement benefits such as leave encashment, group insurance, medical facility, etc., as are applicable to employees appointed before 01.01.2014.</p>
<p>This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Rajya Sabha today.</p>

<p>Sub: <strong>NPS: Extension of benefits of Retirement Gratuity and Death Gratuity to the Central Government employees covered by New Defined Contribution Pension System (National Pension System) -regarding. </strong></p>
<p>Ref:- This office Circular No. 79 dated 29/10/2010 and No. 110 dated 12/08/2013</p>
<p>Benefits of Retirement Gratuity and Death Gratuity to the Central Government employees covered by New Defined Contribution Pension System (National Pension System) has been extended vide Govt. of India, Ministry of PPG &amp; P, Deptt. of P&amp;PW in their O.M. No. 7/5/2012-P&amp;PW (F)/B dated 26.08.2016 (copy enclosed)on the same terms and conditions as are applicable to employees covered by Central Civil Service (Pension) Rules, 1972. The Ministry has further clarified vide O.M.No.28/03/2017-P&amp;PW(B) dt. 18/05/2017, that CCS (Pension) Rules, 1972 are otherwise not applicable to the Central Government employees covered under NPS. Hence, they would obviously not be eligible for Service Gratuity or Pension under the CCS (Pension) Rules.</p>
<p>2. The phrase &#8216;terms and condition&#8217; in the ibid O.M. dated 26.08.2016 refers to the requirement of qualifying service, the rates on which retirement gratuity is to be paid, the limit of amount of gratuity, nominations, disciplinary provisions, etc. in the CCS(Pension) Rules. All these condition would be equally applicable for grant of gratuity to employees covered under NPS. The decision to extend retirement gratuity and death gratuity vide the O.M. dated 26.08.2016 is absolute and not provisional. Separate rules on gratuity for Central Government employees under NPS would be framed in due course.</p>
<p>3. Now, it has been decided that to submit the claims of above beneficiaries for Retirment Gratuity and Death Gratuity, the following procedures shall be adopted by HOO and Pay Audit Controllers:-</p>
<blockquote><p>i. H.O.O. will prepare a claim in case of NPS beneficiaries going to retire in accordance with the procedure as prescribed for Defence Civilian Personnel appointed before 01.01.2004 and will submit the same along with service boom and all the relevant documents (Which is required in case of pre 01.01.2004 Cases) to PAO concerned i.e.LAO/RAO. The Permanent Retirement account No. (PRAN) of the concerned Government Servant Allotted by National Security Depository limited (NSDL) will also be indicated. In cases where PRAN has not been allotted by NSDL to a NPS subscriber being non-effecting account as on 0104.2008, permanent pension account No.(PPAN) allotted to subscriber will be indicated.</p>
<p>ii. PAO will carry all necessary checks with reference to the entries in service book and as admissible under the OM No.38/41/06 P&amp;PW (A) dated 05.05.2009 (already circulated under this office circular no.79 dt. 29-10-2010) to ensure that entries made in claim are in as per records in the service book of the individual. After signing and affixing the seal, the PAO concerned i.e.LAO/RAO will pass on the claim to the PCDA(P) Allahabad. The service book will be returned by PAO to HOO concerned.</p>
<p>iii.HOO will also maintain a separate register for recording entries for PRAN /PPAN No., Name of Government Servant, PPO No. and awards notified.</p>
<p>iv. On receipt of PPO from PCDA(P) Allahabad, HOO will check the same and after recording the entries in the register retransmit PDA&#8217;s copy to PDA, Pensioner copy to Pensioner and retain</p>
<p>HOO copy for their own record.</p>
<p>v. Other procedures prescribed for pre 01-01-2004 pensioner will also be followed by the HOO in case of NPS beneficiaries.</p></blockquote>
<p>4. In view of the foregoing, you also are requested to issue suitable instructions (along with copy of this circular) to all the Head of Offices under your administrative control to ensure that claim on the subject matter henceforth are floated in accordance with instructions given in above Para.</p>

<p>Subject : <strong>Extension of benefits of ‘Retirement Gratuity and Death Gratuity’ to the Central Government employees covered by new Defined Contribution Pension System (National Pension System) — regarding.</strong></p>
<p>The undersigned is directed to say that the pension of the Government servants appointed on or after 1.1.2004 is regulated by the new Defined Contribution Pension System (known as National Pension System), notified by the Ministry of Finance (Department of Economic Affairs) vide their OM No.5/7/2003-ECB &amp; PR dated 22.12.2003. Orders were issued for payment of gratuity on provisional basis in respect of employees covered under National Pension System on their retirement from Government service on invalidation or death in service, vide this Department’s OM No.38/41/2006-P&amp;PW(A) dated 5.5.2009.</p>
<p>2. The issue of grant of gratuity in respect government employees covered by the National Pension System has been under consideration of the Government.<strong> It has been decided that the government employees covered by National Pension System shall eligible for benefit of ‘Retirement gratuity and Death gratuity’ on the same terms and conditions, as are applicable to employees covered by Central Civil Service (Pension) Rule,1972.</strong></p>
<p>3. These orders issue with the concurrence of Ministry of Finance, Department of Expenditure, vide their I.D. Note No.1(4)/EV/2006-II dated 29.07.2016.</p>
<p>4. In their application to the persons belonging to the Indian Audit and Accounts Department, these orders issue after consultation with Comptroller and Auditor General of India.</p>
<p>5. These orders will be applicable to those Central Civil Government employees who joined Government service on or after 1.1.2004 and are covered by National Pension System and will take effect from the same date i.e. 1.1_2004.</p>

<p><strong><em>Enhancement in the Gratuity Ceiling and its Indexation</em></strong></p>
<p>A number of representations have been received by the Commission stating that there is a need to revise the existing ceiling of Rs.10.00 lakh with regard to payment of service gratuity.</p>
<p><strong><em>Analysis and Recommendations</em></strong></p>
<p>Rule 49 and 50 of the CCS (Pension) Rules provides that a government servant is entitled to get retirement gratuity equal to one-fourth of his emoluments for each completed six monthly period of qualifying service subject to a maximum of 16.5 times of the last emoluments subject to a maximum of Rs.10 lakh.</p>
<p>The Commission sought the views of the government in this regard. The Department of Pension and Pensioners Welfare stated that the VI CPC has increased the amount of gratuity from Rs.3.5 lakh to Rs.10 lakh w.e.f. 01.01.2006. This amount, in the view of the department, is not commensurate with emoluments that are available to senior officers at the time of retirement. The department has suggested to the Commission that a view could be taken to index gratuity with amount of DA admissible at the time of retirement.</p>
<p>The Commission notes that there is merit in the argument advanced to index the ceiling on gratuity so that the benefits of the enhanced ceiling are available to personnel in a manner which is more even over a time frame. <strong>The Commission recommends enhancement in the</strong> <strong>ce</strong><strong>iling of gratuity from the existing Rs.</strong><strong>10 lakh to Rs.</strong><strong>20 lakh from 01.01.2016. The Commission further recommends, as has been done in the case of allowances that are partially indexed to Dearness Allowance, the ceiling on gratuity may increase by 25 percent whenever DA rises by 50 percent.</strong></p>
<p><strong><em>Rationalisation of Death Gratuity</em></strong></p>
<p>The Commission has received representations pointing to a need for rationalization of current slabs for death gratuity, especially for the slab of 5 to 20 years of qualifying service in which family pensioners are stated to be placed at a disadvantageous position.</p>
<p><strong><em>Analysis and Recommendations</em></strong></p>
<p>As per Rule 50 of Pension Rules, the death gratuity admissible will be as follows, subject to the maximum limit prescribed for the gratuity:</p>

<p>The Commission sought the views of the government in this regard. Department of Pension and Pensioners Welfare stated that it had received similar demands from pensioners’ association and it feels a need for a review of the existing slabs for death gratuity.</p>
<p><strong>The Commission, after examination of the matter, recommends the following revised rates for payment of death gratuity:</strong></p>

<p><strong><em>Reduction in the time period for Restoration of Basic Pension</em></strong></p>
<p>The Commission has received a number of representations requesting reduction of restoration period of commuted portion of pension from the existing 15 years.</p>
