<p>Subject: <strong>Payment of Dearness Relief on pension to the re-employed teachers of Delhi Administration</strong></p>



<p>References have been received from the re-employed teacher of Delhi Administration that the authorized banks are not making payment of dearness relief on pension to them.</p>



<p>Earlier, the banks have stopped the payment of DR on pension on the instruction of Govt. of NCT Delhi and now some authorized banks are not acting upon the instructions of the Govt. of NCT Delhi for payment of Dearness Relief on pension to the re-employed teachers of Delhi Administration.</p>



<p>In this connection, attention is drawn towards the guidelines mentioned in the OM No 45/73/97-P&amp;Pw (G) dated 02.07.1999, wherein it is mentioned that the pension Disbursing Authority (Banks) shall release Dearness Relief on pension to those re- employed pensioners who submit the certificate issued by the re-employing department as per Para + (II) (a) of the said OM.</p>



<p>All the authorized banks are advised to make payment of Dearness Relief on pension to the re-employed teachers on the basis of the instruction issued by the Govt. of NCT or Delhi.</p>

<p>In terms of Regulation 37 of Bank Employees&#8217; Pension Regulations, 1995 Dearness Relief is payable to pensioners at rates specified in Appendix II to the Regulations.</p>

<p>Pending amendments to Pension Regulations, Banks may pay on ad hoc basis, the Dearness Relief payable to pensioners for the period February 2018 to July 2018 as per Annexure.</p>

<p>Subject:<strong><em> Grant of Dearness Relief to Central Government pensioners/family pensioners &#8211; Revised rate effective from 1.7.2017.</em></strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s OM No. 42/15/2016-P&amp;PW(G) dated 07.04.2017 on the subject mentioned above and to state that the President is pleased to decide that the <strong>Dearness Relief admissible to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 4% to 5% w.e.f 01.07.2017.</strong></p>
<p>2. These rates of DR will be applicable to (i) Civilian Central Government Pensioners/Family Pensioners including Central Govt. absorbee pensioners in PSU/ Autonomous Bodies in respect of whom orders have been issued vide this Department&#8217;s OM No. 4/34/2002-P&amp;PW(D) Vol.II dated 23.06.2017 for restoration of full pension after expiry of commutation period of 15 years (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners/family pensioners (v) Pensioners who are in receipt of provisional pension (vi) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government Pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of adhoc ex-gratia allowance in respect of whom orders have been issued vide this Department&#8217;s OM No. 23/3/2008-P&amp;PW(B) datd 11.09.2017.</p>
<p>3. In partial modification of this Department OMs of even no. dated 16.12.2016 and 27.04.2017, Central Govt. absorbee pensioners in PSU/ Autonomous Bodies referred to in category (i) in para 2 and Burma Civilian pensioners/family pensioners referred to in category (vi) in para 2 above, will also be eligible for dearness relief @ 2% w.e.f 01.07.2016 and @ 4% w.e.f 01.01.2017, in terms of this Department OMs of even no dated 16.11.2016 and 07.04.2017 respectively. The dearness relief already drawn by the above pensioners in terms of OMs dated 16.11.2016 and 27.4.2017, will be adjusted from the revised dearness relief payable under these orders.</p>
<p>4. These orders shall not be applicable on CPF beneficiaries, their widows and eligible children who are in receipt of ex-gratia payment in terms of this Department&#8217;s OM No.45/52/97-P&amp;PW(E) dated 16.12.1997 and revised vide this Department&#8217;s OM 1110/2012-P&amp;PW(E) dtd 27.06.2013. Separate orders will be issued in respect of above category.</p>
<p>5. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>
<p>6. Other provisions governing grant of DR in respect of employed family pensioners and reemployed Central Government Pensioners will be regulated in accordance with the provisions contained</p>
<p>in this Department&#8217;s OM No.45173/97-P&amp;PW (G) dated 2.7.1999 as amended vide this Department&#8217;s OM No. F.No.38/88/2008-P&amp;PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.</p>
<p>7. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.</p>
<p>8. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>
<p>9. The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, II/34-80-II dated 23/0411981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.</p>
<p>10. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&amp;AG.</p>
<p>11. This issues in accordance with Ministry of Finance, Department of Expenditure&#8217;s OM No.1/9/2017-E.II(B) dated 20th Sept, 2017.</p>

<p>Subject : <strong>Grant of Dearness Relief to Central Government pensioners/family pensioners – Revised rate effective from 1.1.2016.</strong></p>
<p>The undersigned is directed to refer to this Department’s OM No. 42/10/2014-P&amp;PW(G) dated 28th September, 2015 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 119% to 125% w.e.f. 1st January, 2016.</p>
<p>2. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners and (v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 23/1/97- P&amp;PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008-P&amp;PW(B) dated 15.9.2008.</p>
<p>3. Central Government Employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and have become eligible to restoration of 1/3rd commuted portion of pension as well as revision of the restored amount in terms of this Department’s OM No. 4/59/97-P&amp;PW (D) dated 14.07.1998 will also be entitled to the payment of DR @ 125% w.e.f. 1.1.2016 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lump sum payment on absorption and Dearness Pension subject to fulfilment of the conditions laid down in pars 5 of the O.M. dated 14.07.98. In this connection, instructions contained in this Department’s OM No.4/29/99-P&amp;PW (D) dated. 12.7.2000 refer.</p>
<p>4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>
<p>5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97- P&amp;PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F. No. 38/88/2008-P&amp;PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.</p>
<p>6. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.</p>
<p>7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>
<p>8. The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, 11/34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.</p>
<p>9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&amp;AG.</p>
<p>10. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their OM No. 1/1/2016-E.II(B) dated 07th April, 2016.</p>

<p>In continuation of this Department’s OM No. 42/10/2014-P&amp;PW(G) dated 26th May, 2015, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f. 1.7.2015 to the following:</p>
<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ RS.600/-p.m. w.e.f. 01.11.1997 under this Department’s OM No.45/52/97-P&amp;PW(E) dated 16.12.1997 &amp; revised to Rs.3000, Rs.1000,Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&amp;PW(E) dtd.27th June, 2013 are entitled to Dearness Relief @ 234% w.e.f. 1.7.2015.</p>
<p>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 are entitled to DR @ 226% w.e.f. 1.7.2015.</p>
<blockquote class="tr_bq"><p>(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. &amp; revised to Rs 645 p.m w.e.f 04th June ,2013 vide OM No.1/10/2012-P&amp;PW(E) dated 27th June,2013.</p></blockquote>
<blockquote><p>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs.654/-, Rs.659/-, Rs. 703/- and Rs. 965/-.</p></blockquote>
<p>2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee. In their application to the Indian Audit and Accounts Department,these orders issue in consultation with the C&amp;AG.</p>
<p>3. This issues as per Ministry of Finance, Department of Expenditure vide their OM No 1(4)/EV/2004 dated 25.05.2015 and OM No.1(3)/2008-E.II{B) dated 01.10.2015.</p>

<p>The undersigned is directed to refer to this Department’s OM No. 42/10/2014- P&amp;PW(G) dated 27th April, 2015 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 113% to 119% w.e.f. 1st July, 2015.</p>
<p>&nbsp;</p>
<p>2. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensloners and (v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are lndian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 23/1/97-P&amp;PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008- P&amp;PW(B) dated 15.9.2008.</p>
<p>&nbsp;</p>
<p>3. Central Government Employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and have become eligible to restoration of 1/3rd commuted portion of pension as well as revision of the restored amount in terms of this Department’s OM No. 4/59/97- P&amp;PW (D) dated 14.07.1998 will also be entitled to the payment of DR @ 119% w.e.f. 1.7.2015 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lump sum payment on absorption and Dearness Pension subject to fulfillment of the conditions laid down in para 5 of the a.M. dated 14.07.98. In this connection, instructions contained in this Department’s OM No.4/29/99-P&amp;PW (D) dated. 12.7.2000 refer.</p>

<p>4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>

<p>5. Other provisions governing grant of DR in respect of employed family pensioners and reemployed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&amp;PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F. No. 38/88/2008-P&amp;PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.</p>

<p>Sub: <strong>Payment of Dearness Relief to re employed pensioner: Clarification thereof.</strong></p>
<p>As per para l(a) of MOD letter No. 7(1)/95/D(Pen/Services) dated 28.8.2000, entire pension admissible to ex-servicemen who held post below commissioned officers (PBOR) at the time of retirement, is ignored and their pay on re-employment is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to dearness relief on their pension.<br />
Deptt. of Pension and Pensioners Welfare, vide their UO No.41/42/2007/P&amp;PW(G) dt. 03.04.2008, reproduced under this office circular No. 386 dt. 19.06.2008, further clarified that if the pay is fixed at a higher stage because of advance increments and no protection of last pay drawn is given, the pay should be treated as fixed at a minimum only for the purpose of ignoring the entire pension and allowing dearness relief on pension. For availing this benefit the ex-servicemen would have retired at post below commissioned officers Rank (PBOR) before attaining the age of 55 years.</p>
<p>Now representations from the banks, where number of ex-clarify the elements to be taken into account for assessing the last pay drawn by the ex-servicemen for the purpose of last pay protection.</p>
<p>The dearness relief on re-employment should be regulated by the Pension Disbursing Agencies on the basis of certificate issued by re-employer, clearly stating whether benefit of last pay protection has been given or not. However, on examination of cases submitted by the banks it has been found that pay scale in banks are still on old pattern, whereas ex-servicemen have been retired with Pay in Pay Band, Grade Pay, MSP, Group Pay etc. In such cases it is clarified that for the purpose of assessing the last pay drawn for last pay protection, the elements to be taken into account should be last pay in pay band i.e. Band Pay plus Grade Pay, last drawn before retirement as envisaged vide MOP, PG &amp; P, DOPT OM NO. 3/19/2009 Estt. Pay II dt. 8th Nov 2010 and no other elements should be taken for this purpose.</p>
<p>In view of the above, it is advised that all the cases of dearness relief where pay of ex-servicemen has been fixed at a higher stage because of advance increments may be reviewed and regulated accordingly.</p>

<p>Subject : <strong>Grant of Dearness Relief to Central Government pensioners/family pensioners — Revised rate effective from 1.1.2015.</strong></p>
<p>The undersigned is directed to refer to this Department’s OM No. 42/10/2014- P&amp;PW(G) dated 29th September, 2014 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 107% to 113% w.e.f. 1st January, 2015.</p>
<p>2. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates,<br />
(iii) All India Service Pensioners (iv) Railway Pensioners and (v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 2311/97-P&amp;PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008- P&amp;PW(B) dated 15.9.2008.</p>
<p>3. Central Government Employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and have become eligible to restoration of 1/3rd commuted portion of pension as well as revision of the restored amount in terms of this Department’s OM No. 4/59/97-P&amp;PW (0) dated 14.07.1998 will also be entitled to the payment of DR @ 113% w.e.f. 1.1.2015 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lump sum payment on absorption and Dearness Pension subject to fulfillment of the conditions laid down in para 5 of the 0.M. dated 14.07.98. In this connection, instructions contained in this Department’s OM No.4/29/99-P&amp;PW (D) dated. 12.7.2000 refer.</p>
<p>4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>
<p>5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&amp;PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F. No. 38/88/2008-P&amp;PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.</p>
<p>6. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.</p>
<p>7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>
<p>8. The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, 11/34-80-11dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.</p>
<p>9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&amp;AG.</p>
<p>10. This issues with the concurrence of Ministry of Finance, Department of Expenditure conveyed vide their ID No. 1(4)/E.V/2004 dated 24thApril, 2015.</p>

<div>in continuation of this Department&#8217;s OM No. 42/13/2012-P&amp;PW(G) dated 17th Oct, 2013, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f.1.1.2014 to the following &#8230;</div>
<div></div>
<div>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/ p.m. w.e.f. 1.11.1997 under this Department&#8217;s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 &amp; revised to Rs.3000, Rs.1000,Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&amp;PW(E) dt. 27th June, 2013 are entitled to Dearness Relief @ 200% w.e.f. 1.1.2014.</div>

<div>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department&#8217;s OM No. 45/52/97-P&amp;PW{E) dated 16.12.1997 are entitled to DR @ 192 % w.e.f. 1.1.2014.</div>

<div>(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. &amp; revised to Rs 645 w.e.f 04th June ,2013 vide OM No. 1/10/2012-P&amp;PW(E) dated 27th June,2013.</div>

<div>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs.654/-, Rs.659/-, Rs.703/- and Rs.965/-.</div>
