										<content:encoded><![CDATA[<p><strong>7th Pay Commission proposes to visit Leh / Srinagar between 15th to 18th September 2014</strong></p>
<p style="text-align: center;"><span style="text-decoration: underline;"><strong>Visit of the 7th CPC to Leh/Srinagar</strong></span></p>
<p>The Commission has, in its first phase of interaction, been seeking the views of various stakeholders on its terms of reference. To this end, meetings have been held in Delhi with various organisations and heads of various agencies.</p>
<p>In its second phase of interaction, the Commission plans to hold meetings in different parts of the country to facilitate stakeholders staying in various areas to present their views personally before the Commission and ensure larger representation. This exercise is being undertaken to enable the Commission to get a firsthand impression about the functioning and the condition of service prevailing in different parts of the country.</p>
<p>Accordingly, the Commission, headed by its Chairman, Justice Shri A. K. Mathur, proposes to visit <strong>Leh/Srinagar between 15th September to 18th September, 2014.</strong> The Commission would like to invite various entities/associations/federations representing any/all categories of employees covered by the terms of Reference of the Commission to present their views.</p>
<p>Your request for a meeting with the Commission may be sent through e-mail to the Secretary, 7th Central Pay Commission at secy-7cpc@nic.in The memorandum already submitted by the requesting entity may also be sent as an attachment with this e-mail.</p>
<p><strong>The last date for receiving request for meeting is 5th September, 2014 (1700 hours).</strong></p>

										<content:encoded><![CDATA[<p><strong>State Government employees are not covered within the terms of reference of the 7th central Pay Commission</strong></p>
<p>While answering to a question in Parliament on 12th August 2014 regarding the employees working in State Government, Ministry of State for Finance Smt.Nirmala Sitharaman said that the State Government employees are not covered within the terms of reference of the 7th central Pay Commission.</p>
<p>She replied in written form to a question asked by a member that service conditions of State Government employees fall within the exclusive domain of respective State Governments. Therefore, State Government employees are not covered within the terms of reference of the 7th central Pay Commission.</p>
<p>Thus, the recommendations of Commission will not directly apply to State Government employees. Accordingly, it is not possible for the Central Government to indicate the financial burden on State Governments, if they decide to adopt the recommendation of the 7th Central Pay Commission in respect of their employees with or without modification.</p>
<p>She also added, the Central Government had sought the views of the State Governments and till the date of the constitution of the 7th Central Pay Commission on 28.2.2014, only 14 States had responded. These State Governments generally mentioned, inter-alia, that adoption of the recommendations of a Central Pay Commission by them in case of State Government employees adds to substantial financial burden</p>
<p>Since the decision to adopt the recommendations of the 7th Central Pay Commission in case of the State Government employees will exclusively concern respective State Government, the question of any assistance by the Central Government will not arise. However, the Terms of Reference of the 7th Central Pay Commission provide, inter-alia, that while making its recommendations, the Commission will also keep in view the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications.</p>

<p>10. Secretary (Expenditure) expressed his condolences at the demise of Sh Purohit. He then mentioned that the issue of the Terms of Reference (TOR) of the 7th CPC was handled with great sensitivity and it was not correct to say that the views of the Staff Side have not been taken into account. Almost 90% of what Staff Side had suggested for the TOR for the 7th CPC was taken very seriously and only in the case of Grameen Dak Sevak (GDS) and Interim Relief there were certain issues due to which these could not be included in the TOR.<br />
In regard to the date of effect of the recommendations, this is also one of the ToR of the 7th CPC. The date of effect of the recommendations of a Pay Commission is suggested by the Commission itself. This was the practice followed in respect of the previous central pay commissions. Therefore, the date of effect of the recommendations of the 7th CPC cannot be suggested upfront, since this would be recommended by the 7th CPC itself having regard to various factors that they may take into account.</p>
<p>In regard to the Interim Relief, he mentioned that this is normally given when there is delay in constitution of the Central Pay Commission. Since the 7th CPC has been set up well on time, question of interim relief was not considered necessary.</p>
<p>11. On the issue of merger of DA with pay he pointed out that the 6th CPC in its Report had specifically recommended against it.</p>
<p>As to the inclusion of a representative of labour in the composition of the 7th CPC is concerned, the composition of the 7th CPC was broadly in line with the composition of the previous three Central Pay Commissions and Government did not want to make it unwieldy.<br />
So far as the issue relating to Pensioners is concerned, the same has been amply included in para (f) of the ToR. As regards the pay anomalies, the same would be considered by the 7th Central Pay Commission as part of its overall ToR. Since the terms of reference enable the CPC to send interim report, Secretary (Expenditure) suggested that the Staff Side might approach the 7th CPC for a report on Interim Relief and Merger of Dearness Allowance.</p>

<div><strong>GOVERNMENT</strong> of India vide its Resolution No. 1/1/2013-E.III(A) dated the 28th February, 2014 have constituted the Seventh Central Pay Commission with the following terms of reference:</div>
<div></div>
<div>a) To examine, review, evolve and recommend changes that are desirable and feasible regarding the principles that should govern the emoluments structure including pay, allowances and other facilities/benefits, in cash or kind, having regard to rationalization and simplification therein as well as the specialized needs of various Departments, agencies and services, in respect of the following categories of employees:</div>

<blockquote>
<div>(i) Central Government employees — industrial and non-industrial;</div>
<div>(ii) Personnel belonging to the All India Services;</div>
<div>(iii) Personnel of the Union Territories;</div>
<div>(iv) Officers and employees of the Indian Audit and Accounts Department;</div>
<div>(v) Members of the regulatory bodies (excluding the RBI) set up under the Acts of Parliament; and</div>
<div>(vi) Officers and employees of the Supreme Court</div>
</blockquote>
<div></div>
<div>b) To examine, review, evolve and recommend changes that are desirable and feasible regarding the principles that should govern the emoluments structure, concessions and facilities/benefits, in cash or kind, as well as the retirement benefits of the personnel belonging to the Defence Forces, having regard to the historical and traditional parities, with due emphasis on the aspects unique to these personnel,</div>
<div></div>
<div>c) To work out the framework for an emoluments structure linked with the need to attract the most suitable talent to Government service, promote efficiency, accountability and responsibility in the work culture, and foster excellence in the public governance system to respond to the complex challenges of modern administration and the rapid political, social, economic and technological changes, with due regard to expectations of stakeholders, and to recommend appropriate training and capacity building through a competency based framework,</div>
<div></div>
<div>d) To examine the existing schemes of payment of bonus, keeping in view, inter-alia, its bearing upon performance and productivity and make recommendations on the general principles, financial parameters and conditions for an appropriate Incentive Scheme to reward excellence in productivity, performance and integrity,</div>
<div></div>
<div>e) To review the variety of existing allowances presently available to employees in addition to pay and suggest their rationalization and simplification with a view to ensuring that the pay structure is so designed as to take these into account,</div>
<div></div>
<div>f) To examine the principles which should govern the structure of pension and other retirement benefits, including revision of pension in the case of employees who have retired prior to the date of effect of these recommendations, keeping in view that retirement benefits of all Central Government employees appointed on and after 01.01.2004 are covered by the New Pension Scheme (NPS),</div>
<div></div>
<div>g) To make recommendations on the above, keeping in view:</div>
<div></div>
<blockquote>
<div>i. the economic conditions in the country and the need for fiscal prudence;</div>
<div></div>
<div>ii. the need to ensure that adequate resources are available for developmental expenditures and welfare measures;</div>
<div></div>
<div>iii. the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications;</div>
<div></div>
<div>iv. the prevailing emolument structure and retirement benefits available to employees of Central Public Sector Undertakings; and</div>
<div></div>
<div>v. the best global practices and their adaptability and relevance in Indian conditions.</div>

<div>h) To recommend the date of effect of its recommendations on all the above,</div>
<div></div>
<div>2. <p>In Parliament the Minister of Finance Shri.Chidambaram informed in a written reply to a question on 2nd Febrauary 2014 that the date of effect of the recommendations of the 7th Central Pay Commission will be decided once the Report is submitted.<br />
And he also said, the composition of the 7th Central Pay Commission is broadly in line with the composition of the previous Central Pay Commissions.</p>
<p>The scope of the task before the Central Pay Commission is framed in such a fashion as to enable the Commission to examine holistically all aspects of emoluments structure of various categories of Central Government employees, including personnel of Defence Forces, having regard, inter-alia, to the issues specific to them and make recommendations thereon.</p>

<div>Dear Comrades,</div>
<div></div>
<div>The Union Cabinet approved the Finance Ministry’s proposal on terms of reference of the 7th CPC.  We have placed the full text of the same on our website.  None of the suggestions made by the Staff Side was accepted by the Government.</div>
<div></div>
<div>However, our concern over the date of effect seems to have been taken note of.  The terms of reference has left the effective date of its recommendations to be decided by the Commission itself.  A united stand backed up by struggles will enable us to clinch this demand in our favour.  Undoubtedly it has been our endeavours and the two days strike action that has compelled the Government to have a rethinking on their earlier stand of Decennial (Ten years} wage revision for Central Government employees and the date of effect as 1/1/2016</div>
<div></div>
<div>Unlike on the earlier occasion, the Government has not decided to grant Interim Relief and merger of Dearness allowance.  Nor has it asked the Commission to consider and make appropriate recommendation in this regard specifically.  As pointed out in our earlier communication, inclusion of a labour representative in the Commission being not an idea the UPA Government cherishes, for it is diametrically opposite to its economic policies and ideology, they have stuck to the position of sandwiching the Honourable Judge with bureaucrats.  In the light of the agreement penned by Com. Mahadeviah, the General Secretary of the recognised GDS union with the Postal Board to the effect that a separate one man committee will look into the service conditions of the Grameen Dak Sewaks, it is not surprising that the Government chose to ignore our demand to cover them within the ambit of the 7th CPC.   Our demands for parity between the past and present pensioners and scrapping of the new pension scheme also stand rejected.</div>
<div></div>
<div>As you are aware, the 6th CPC (and the earlier Commissions also) had refused to entertain the demand for removal of anomalies despite Government referring the same to the Commission specifically.  Therefore, the omnibus clause in the terms of reference requiring the Commission to submit interim reports may not be of any help to us to raise the anomalies before the 7th CPC.</div>
<div></div>
<div>At the conclusion of the meeting held on 24/10/2013 by Secretary, DoPT, with the staff side on terms of reference of the 7th CPC, it was agreed that the Government will consider our suggestion in the matter and will convene another meeting with the presence of Secretary (Expenditure) to iron out the differences, if any, and explore the possibilities of an agreement in the matter. But no such meeting was convened and no attempt was made by the official side to arrive at an agreed Terms of Reference.</div>
<div></div>
<div>We must now react to the arbitrary and unilateral decision of the Government.  We appeal all the State Secretaries, District Secretaries and Branch Secretaries of the affiliated organisations and the State/District COCs to immediately send the following Savingram to the Prime Minister.</div>
<div></div>

<div>While the National Convention scheduled to be held at Nagpur will chalk out detailed and phased programmes of action, we call upon our State Committees and Affiliated Unions to organise massive demonstration in front of all offices and important centres on 7th  March, 2014 (Friday) or any other immediate convenient date. Kindly instruct all the Branches to mobilise their members so that the demonstration has the participation of cent per cent of the membership of the concerned branch.  The State Units and affiliated Unions may issue pamphlets and posters and ensure its wide circulation throughout the country.</div>

<div>As already declared by the National Secretariat of the Confederation, we shall have to go for an indefinite strike action immediately after the General Election if our demands are to be settled.</div>
