<p><strong>Minutes of the 32nd Meeting of Standing Committee of Voluntary Agencies (SCOVA) held on 12.04.2022 under the Chairmanship of Hon’ble MOS(PP) at Sardar Patel Bhawan, New Delhi.</strong></p>



<h2 class="wp-block-heading">(32.6) Payments of DA/DR arrears freezon for 18 months from 1.1.2020 to 30.06.2021</h2>



<p>The Central Government Pensioners Welfare Association, Jaipur and Ex-Defence Employees Welfare Association, Balasore mentioned that although the Central Government has granted the DA/DR rise of 11% from 01.07.2021, the arrears for 18 months have not been released. The Association requested for releasing the DA/DR for 18 months to Central Government employees and pensioners / family pensioners.</p>



<h4 class="wp-block-heading"><strong>Discussion/Decision on the agenda item</strong></h4>



<p>Joint Secretary, Department of Expenditure stated that this issue was raised in the last meeting of JCM chaired by Cabinet Secretary also and the JCM was informed that</p>



<p>The decision to freeze DA and DR due from 01.01.2020, 01.07.2020 &amp; 01.01.2021 was taken in the context of Covid-19 pandemic, so as to ease pressure on Government finances. The rates of DA/DR have been restored prospectively and subsumed in the cumulative revised rates effective from 01.07.2021 vide OM dated 20.07.2021.</p>



<p><strong>In view of the above, item was closed.</strong></p>



<h2 class="wp-block-heading">Minutes of the 32nd Meeting of Standing Committee of Voluntary Agencies (SCOVA) held on 12.04.2022 under the Chairmanship of Hon’ble MOS(PP) at Sardar Patel Bhawan, New Delhi.</h2>



<p>The Departments concerned were requested to take a final decision, at the earliest, on the following agenda items of 31st meeting of SCOVA, which are remained unresolved:</p>



<p>i. Extension of benefit of Composite Hospitals to CAPF personnel</p>



<ul class="wp-block-list"><li><strong>(Action: Ministry of Home Affairs/ Ministry of Health &amp; Family Welfare)</strong></li></ul>



<p>ii. Booking of Holiday Homes for Central Government Pensioners-enhancement of time limit from 30 days to 60 days.</p>



<ul class="wp-block-list"><li><strong>(Action: Ministry of Housing &amp; Urban Affairs/Directorate of Estates)</strong></li></ul>



<p>iii. Formal approval to Chandigarh Administration for allotment of plot to CGHS, Chandigarh.</p>



<ul class="wp-block-list"><li><strong>(Action: Ministry of Health &amp; Family Welfare /Ministry of Home Affairs)</strong></li></ul>



<p>The agenda items for 32nd meeting were discussed. The gist of the discussion held and decisions taken on these items are as under:</p>



<ul class="wp-block-list"><li>(32.1) Shortage of Doctors, Specialists and Para-Medical Staff in CGHS posts due to increase in number of patients consequent on merger of Postal Dispensaries and need for creation / sanction of new posts to maintain patient and Doctor/ Para- medical staff ratio</li><li>(32.2) Periodical Health check-up of pensioners</li><li>(32.3) Issues relating to CGHS Wellness Centre Jammu, J&amp;K</li><li>(32.4) Non-acceptance of Nominations of pensioners for Life-Time Arrears by the Banks</li><li>(32.5) Holding of Pension Adalat meetings by Departments at national level</li><li>(32.6) Payments of DA/DR arrears freezon for 18 months from 1.1.2020 to 30.06.2021</li><li>(32.7) Enhancement of Additional Pension</li><li>(32.8) Enhancement of Fixed Medical Allowance (FMA)</li><li>(32.9) Difficulties in online submission of Accounts for grants.</li><li>(32.10) Enhancement of amount of Grants in aid to Pensioners’ Associations</li><li>(32.11) Providing a laptop to identified Pensioners Associations</li></ul>

<p>Dearness Allowance and Dearness Relief for Central Government Workers as per the 7th Pay Commission Latest News &#8211; 3 Pending DA and DR Installments to be restored from July 2021.</p>

<p>In a written response to a question in Parliament, Minister of State for Finance Anurag Thakur stated that the Central Government saved more than Rs. 37530.08 crore by freezing three installments of Dearness Allowance and Dearness Relief. He also mentioned that beginning in July 2021, the three additional DA and DR installments would be restored.</p>

<p>a) whether freezing of Dearness Allowance (DA) to Central Government employees/pensioners till July, 2021 has subjected them to undue hardship;</p>



<p>b) if so, the reasons for not restoring DA to Central Government Employees and pensioners before July, 2021; and</p>



<p>c) whether Central Government employees and pensioners are not entitled to three installments of DA and, if so, whether Government would also release these installments and, if not, reasons therefor?</p>

<p>(a,&amp; b) In view of the crisis arising out of COVID-19 pandemic, the Government has decided to freeze three installments of Dearness Allowance and Dearness Relief to Central Government employees and pensioners due from 01.01.2020, 01.07.2020 &amp; 01.01.2021. The amount Rs.37530.08 crores saved on this account will help to tide over the economic impact of COVID-19 pandemic</p>



<p>(c) As and when the decision to release the future installments of Dearness Allowance due from 01.07.2021 is taken, the rates of DA as effective from 01.01.2020, 01.07.2020, and 01.01.2021 will be restored prospectively and will be subsumed in the cumulative revised rates effective from 01.07.2021.</p>

<p>The Cabinet Committee already approved to increase 4% additional DA from January 2020 on the basis of the Consumer Price Index (CPI). The next installment from July 2020 is already decided to increase by 4% additionally (However, after the approval of the Cabinet Committee only the percentage of DA will decide!).</p>



<p>And another installment will also be expected to hike by 3% with effect from 1st January 2021. The below expected<strong> DA list</strong>, which is used in our software tool for your information:</p>



<ul class="wp-block-list"><li>1st January 2020 = Additional DA 4% (17% + 4% = 21%)</li><li>1st July 2020 = Additional DA 4% (21% + 3% = 24%)</li><li>1st January 2021 = Additional DA 4% (24% + 4% = 28%)</li><li>1st July 2021 = Additional DA 4% (Expected) (28% + 4% = 32%)</li></ul>

<p>Dear Comrades,</p>



<p>As already informed to you the meeting of the <strong>Standing Committee of the NC–JCM was held today (i.e 26/02/2021) under the Chairmanship of Secretary (Personnel) DOPT</strong>. Apart from Additional Secretary <a href="https://centralgovernmentnews.com/latest-dopt-orders-2021/" target="_blank" rel="noreferrer noopener">DOPT</a> and Additional Secretary Expenditure senior Officials from DOPT, Ministry of Railways, Ministry of Defence, Ministry of Health, and Department of Pension were present in the meeting. The Staff Side was represented by Comrades, M. Raghaviah, Shiva Gopal Mishra, N.Kanniah, Guman Singh, C.Srikumar, R.Srinivasan, R.P.Bhatnaga, K.S.Murty, R.N.Parasar. Comrades K K N Kutty and Ch. Sankara Rao, attended the meeting through Video Conference. On behalf of the Staff Side, the following important demands were raised by us in the meeting during the introductory remarks.</p>



<ol class="wp-block-list"><li>The Government of India without holding any discussion with the Staff Side has arbitrarily decided to <a href="https://centralgovernmentnews.com/freezing-of-dearness-allowance-to-central-government-employees-and-dearness-relief-to-central-government-pensioners-at-current-rates-till-july-2021/" target="_blank" rel="noreferrer noopener">Freeze the three Instalment of DA</a> due to the Central Government Employees and three Instalment of DR due to the pensioners for 18 months and that this 18 months increased DA / DR will not be given back to the employees / pensioners. Such type of a decision is taken by the Government for the 1st time. Dearness Allowance is a part of the salary and DR is a part of the pension. This cannot be stopped arbitrarily. We protest against this decision of the Government and demand the DA /DR due from 1/1/2020, 1/7/2020, and 1/1/2021 may please be given in cash to the Central Government Employees and Pensioners immediately since the government is claiming that the economy of the country has considerably increased. Moreover, attention is drawn to the recent Judgment of the Hon’ble Supreme Court dated 08/02/2021 wherein Supreme Court has observed that salaries and pension are the rightful entitlement of the Government employees and Government which has delayed the payment of Salaries and Pension should be directed to pay interest at an appropriate rate. Therefore there is no justification on the part of the government to freeze the DA of the employees and DR of the Pensioners.</li></ol>



<ol class="wp-block-list" start="2"><li>The National Joint Council of Action of Central Government Employees consisting of all the Constituent Organization of NC-JCM have issued a Notice on 20/01/2021 to the Cabinet Secretary with Copy to the Secretary DOPT for observing an Action Programme Call Attention Day on 01/02/2021. This programme was observed successfully by all the C G E through of the Country. However it is unfortunate that neither the Government has convened any meeting with the Staff Side to discuss the demands nor responded to our letter. We protest against this unhelpful attitude. A meeting may be held with the Staff Side to discuss all the 13 Charter of Demands submitted by us.</li><li>Once again we are forced to mention here that inspite of the letters being written by the DOPT to the various Ministry and Departments the Departmental Council – JCM Meetings is not taking place. Holding of the JCM meetings at all level should be made statutory. The Secretaries of the Departments being the Chairman of the Departmental Council – JCM, it is a part of their duty to hold the meetings regularly as mandated in the JCM Scheme therefore this matter may be viewed seriously and appropriate remedial action may be taken to ensure regular holding of the Departmental Council JCM meetings</li><li>Demands raised by the Staff Side in the meetings and after discussion wherever the official side has agreed to examine the case are being rejected without holding any discussion with the Staff side. A recent example is the case of Grant of 3rd MACP in GP Rs.4600 to the MCM of Defence Ministry holding the post as on 31/12/2005 has been rejected by the DOPT in violation of its own clarification and instructions on the subject the Staff side is not convents with the decision of the DOPT. We are once again submitting a detailed note in this regard giving all justification. The matter may be reconsidered by the DOPT. The Staff Side is ready to discuss the matter with DOPT. (a letter dated 25/02/2021 addressed to Additional Secretary DOPT is handed over to the Secretary DOPT and copy on the subject matter was handed over to JS (E) of MOD)</li><li>The Demand of the Staff Side for the restoration of Festival Advance was agreed to be restored in the last meeting. However, no decision has been taken yet in the matter we once again demand that one-month basic pay of the employee may be granted as festival Advance to be recovered in ten Easy installments.</li><li>The request made by the staff side for extending the time limit for availing the LTC of the Block year of 2018-20 up to 31/12/2021 so that the employees who have booked their flight tickets and who were not able to travel due to cancellation of flight because of <a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVI</a>D-19 pandemic is not yet considered by the DOPT / Department of Expenditure. The same may be considered favorably.</li><li>Two recovery action initiated at the various C.G. Establishments including Railway and Defence has subjected the employees to undue financial hardship. The Night Duty Allowance paid in 6th CPC rates from 01/07/2017 is being recovered from the employees. Similarly, the Transport Allowance paid to the employees during the LockDown period is also being recovered. Both these recoveries action should be stopped and as already demanded by the Staff Side the NDA should be paid to all the employees whoever is deployed on Night Shift duty without any basic pay ceiling.</li><li>There are certain issues to be addressed by DOPT and Department of Expenditure with regard to LTC Special Package<ul><li>a. The LTC special package benefit is not being extended to the employees recruited from 2012 onwards. The benefit may please be extended to them also</li><li>b. The condition that the employees should purchase such items avail such facilities which carry a GST rate of not less than 12% should be withdrawn</li><li>c. The additional burden of expenditure imposed on the employee may be withdrawn</li><li>d. The time limit for availing this facility may be extended up to 31/12/2021</li></ul></li><li>Full reimbursement of the Medical Treatment incurred for COVID-19 treatment availed in the recognized / empanelled hospital may be ensured. The accounts /Audit Authorities are disallowing a major portion of the Expenditure. This may be looked into</li><li>The Demand of the Staff Side for payment of compensation to the employees who died out of COVID_19 infection and immediate grant of Compassionate Appointment to the dependent is not yet considered by the Govt. This request may be considered favorably by the Government</li><li>In violation of the DOPT instructions under FR 17 (a), the employees who participated in a legal strike in the industrial Establishments under the Ministry of Defence are being imposed with dies-non. Dies-non can be imposed only if the strike is declared illegal by the Labour Court. In a similar case, the CGHS employees approached Delhi High Court and the High Court has ruled that dies-non cannot be imposed. Only the principle of no work no pay can be imposed. The Ministry of Health has implemented the Judgment to the CGHS employees the same benefit may be extended to the Defence Employees who participated in a legal strike. A reference of the MOD in this regard is pending with the Ministry of Health. This issue needs to be settled since the employees are subjected to unnecessary hardship.</li></ol>



<p>Responding to the above points raised by the Staff Side Secretary DOPT assured that the points would be considered by the concerned Departments and if required separate meetings would be held with the Staff Side thereafter a discussion took place on the Action Taken Report of the 28 Agenda Points discussed in the Standing Committee meeting held on 07/03/2019. </p>

<p>The Staff side reiterated the following demands:-</p>

Employees who were not able to attend duty due to non availability of public transport including State Transport Buses and suburban trains – in their cases the authorities have asked them to apply for their own leave instead of Special Casual Leave. These employees may be sanctioned Special Casual Leave to regularise their absence due to non availability of Public Transport.</li><li>b. Employees who were in different stations/ home town prior to the declaration of lockdown by the Government, were not able to report back to their office/ establishment due to total stoppage of public transport, and movement in private vehicles inter-state and inter-district were completely stopped by the State and Central Governments. Their absence from duty due to the above-mentioned situation may be regularised as Special Casual Leave.</li></ul>



<ul class="wp-block-list"><li>c. Employees who were affected by COVID-19 positive and were under medical treatment and subsequent home quarantine etc. may be granted quarantine leave for the entire period of Medical Treatment and Home quarantine period as recommended by the Medical Authorities.</li></ul>

<p><strong>19. Implementation of Govt. decision on 7th CPC recommendations on Risk Allowance to the Central Govt. Employees including Defence Civilian Employees</strong></p>



<p class="has-text-align-center"><strong><span class="has-inline-color has-vivid-red-color">DECISION</span></strong></p>



<ul class="wp-block-list"><li>1) The Risk Allowance may be given effect from 01/07/2017.</li><li>2) The employees who are involved in various Risk and Hazardous operations may be brought under the coverage of Risk &amp; Hardship Matrix as recommended by the 7th CPC at least at par with the Fire Fighting Personnel.</li><li>3) Ministry of Defence in the past has recommended for inclusion of various left out operations, left out organizations, and left out categories to be included for payment of Risk Allowance. However, the DOP&amp;T has advised MoD to wait for the recommendations of the 7th CPC. Since the recommendations of the 7th CPC are already implemented the proposals of MoD may also be approved.</li></ul>



<p>After discussion it was decided that the issue would be separately discussed by DOPT with the Staff Side</p>

<h3 class="wp-block-heading"><em>Sub: Computation of gratuity and leave encashment in the case of persons retired/ to be retired after 1.1.2020 Consequent upon the denial of DA/DR</em></h3>



<p>We invite your kind attention to the orders in F. No. 1/1/2020-E II (B) dated 23.04.2020 wherein the decision of the Government to deny the <strong><a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener">dearness allowance</a></strong> <strong><a href="https://centralgovernmentnews.com/category/dearness-relief/" target="_blank" rel="noreferrer noopener">dearness relief</a></strong> to the employees and pensioners respectively has been conveyed. We had written two letters in the matter on 23rd April 2020 and on 26th May 2020. The undersigned had taken up the issue also with the Cabinet Secretary. when he assured of an informal discussion in the matter with the Staff Side. However. no talks have taken place thereafter. It is not for the first time that the Government is by pausing the National Council. Staff Side. On the last occasion. when the National Council met. we had pointed out the inordinate delay in convening the meetings. We are constrained to believe that the Government wanted the negotiating body to have a burial. I am however duty bound to convey the growing resentment of the employees over this unprecedented decision. As the Government has decided to deny the dearness relief to the pensioners. the pensioner community is in great financial stress as many of them are compelled to spend exorbitant amount for the treatment of <a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">Covid</a>.</p>



<p>It has been brought to our notice that the <a href="https://centralgovernmentnews.com/freezing-of-dearness-allowance-to-central-government-employees-and-dearness-relief-to-central-government-pensioners-at-current-rates-till-july-2021/" target="_blank" rel="noreferrer noopener">denial of DA and freezing</a> the same forced 18 months from 1.01.2020 to 1.07.2021 has created a piquant situation for the lower level administrative functionaries to correctly compute the retirement benefits in the case of those civil servants who are retiring after the date of issue of the above cited O.M. The definition of “emoluments” for the purpose of computing the gratuity as also the leave salary (of the accumulated leave) includes Dearness allowance as admissible and not as paid or payable to the Government servant. Without exception. every administrative Department has computed the entitlement on this account only with reference to the Basic pay Dearness allowance paid or received by the concerned individual i.e 17%, Either 21% w.e.f 1-1-2020 or figure increase in percentage are not taken into account while calculating gratuity and leave salary. Since the order of the Finance Ministry clearly stipulates that the Dearness Allowance admissible to the Government servants would be restored on 1.07.2021. the computation of Gratuity and leave salary without taking into account the DA as admissible to the individual Government servant is incorrect. Annexed to this letter is an example as to how the individual loses out if the present faulty, computation procedure is followed It could be seen from the given example, the concerned Government servant will lose a staggering sum of <strong>Rs. 57116</strong> because of this faulty computation.</p>



<p>The Government is required to pass the orders as and when the DA has become due, Freezing it for certain period of time or denying it altogether for a specified duration are altogether different issues. Our objection to the adopted policy has already been conveyed to the Government. The faulty computation of Gratuity and Leave salary is not even intended by the order issued by the Government on 23rd April, 2020.</p>

<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(i) Orders are issued as and when the Dearness allowance has to be revised on the basis of the cost of living index;<br />(ii) Direct the administering Ministries to compute the emoluments of persons who are to retire during the period of freezing, taking the correct amount of DA as admissible to receive and not what has been paid to him for computing gratuity and leave salary<br />(iii) The orders revising the rate of DA DR are to be issued in April, 2020, before September, 2020 and again in April, 2021.</p></blockquote>

<h3 class="wp-block-heading">Urging upon the Government of India to withdraw the decision of DA/ DR freeze</h3>



<p>This online Federal Executive meeting of the National Federation of Civil Accounts Associations (NFCAA), which represents the All India Civil Accounts Employees Association and the All India Civil Accounts Employees Association Category &#8211; II held today the 4th September 2020 deliberated on the decision of Government to freeze the Dearness Allowance to Central Government Employees and Dearness Relief to the Central Government Pensioners due with effect from January 2020 for next eighteen months i.e. upto June, 2021.</p>



<p>The Government of India has taken the drastic decision to stop the normal increase in salary and pension in the form of Dearness Allowance and Dearness Relief for the next one and half years to its employees and pensioners which is the compensation for them against the price hike. Even the declared decision of the Government to pay the DA/DR to employees and pensioners retrospectively with effect from 1st January 2020 and payable in the month of March 2020 has been withdrawn vide an order dated 23rd April, 2020. The employees retiring during these eighteen months shall loose a huge amount in respect of Retirement benefits viz: Gratuity, Leave Encashment apart from recurring loss of DR in pension. This decision was also a bolt from the blue for low paid Central Government Employees who are in the forefront for fighting the <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> pandemic at the cost of their lives. They have been made to suffer for the rest of their life financially while they have already contributed at least one day’s salary/ wage to the PM Relief Fund or PM CARE fund as financial support to the Government of India. Moreover, the families of those persons who have expired recently due to corona infection or in any other form would be the worst sufferers. Considerably reduced pensionary benefits would be available to them and the conditions of the families of NPS holders shall be miserable as nothing substantial shall reach to them as compensation to their sacrifice in fighting the Coronavirus.</p>



<p>Therefore, the wage and pension freeze of the 48 lakhs Serving Central Government Employees and about 60 lakhs Central Government Pensioners have adversely affected the serving employees as well as pensioners who are particularly low paid or retired from lower level posts. They are the worst hit sections as it has become extremely difficult for them to survive with such a condition as they are deprived from routine compensation against the persistent rising prices of essential items and would rise further during the next one year.</p>



<p>The National Federation of Central Government &amp; Allied employees National Federation Of Central Government &amp; Allied Employees &amp; Workers Organisations (NFCGA-EWO) which is an Organisation of the central government, allied department, casual, contingent, outsourced and contract employees and workers and to which the All India Civil Accounts Employees Association and All India Civil Accounts Employees Association Category -II vide letter dated 25-04-2020 and dated 13-05-2020 have requested Hon’ble Finance Minister and the Hon’ble Prime Minister vide our letter respectively to kindly re-consider the decision of DA and DP freeze. Similarly, Staff side, JCM (National Council) has also requested the Government of India to kindly restore the payment of DA and DR to the central Government Employees and Central Government Pensioners.</p>



<p>This meeting therefore, in pursuance of the requests of NFCGA-EWO and the Staff side JCM (NC) urges upon the Government of India to kindly withdraw the decision of DA/ DR freeze and release the payment of DA Central Government Employees and Central Government Pensioners urgently.</p>



<p>The meeting resolves to forward the resolution to the Cabinet, Secretary to the Government of India, Secretary, Department of Expenditure, Ministry of Finance, and the Controller General of Accounts, Department of Expenditure, Ministry of Finance, with endorsement of its copies to the Secretary, Staff side, JCM (NC) and the Secretary General, NFCGA-EWO.</p>

<p>The matter has been reviewed and on account of <strong>no orders on freezing of IDA/ IDR</strong>, it has been decided that in partial modification of previous order under reference all pension related benefits be released as per rate of Dearness Relief as per latest extant order from DPE i.e. @ 160.7%.</p>

<p>The decision to freeze dearness relief for central government pensioners at current rates (prior to 1.1.2020) vide OM dated 23.4.202 has been taken. Instruction on similar lines has not been issued by DPE which shall be applicable to <strong>BSNL and MTNL pensioners</strong> drawing pensioner from Govt of India. In view of the current status it has been decided that:</p>

<ul class="wp-block-list"><li>Pension for the month of April 2020 be disbursed at dearness relief @ 160.7% till further guidelines from DPL for pensioners retiring prior to 1.4.2020.</li><li>For those retiring in April 2020, retirement benefits (paid by CCAs) be paid at old Dearness relief as on 1.4.2020 till further guidelines from DPE.</li></ul>

<p>As already explained, the COVID-19 Pandemic has created an unprecedented for situation, not only in our country, but also across the globe. The Central Government Employees, including Railwaymen, are, however, exerting a lot to combat the situation, and the Railwaymen are working hard 24X7 with full devotion and dedication to maintain uninterrupted supply chain of all the essential commodities and goods, viz. Foodgrains, Sugar, Petroleum, Vegetables, Milk, Medical Items etc. throughout the country, by running large-number of timetabled Goods and Parcel Trains.</p>

<p>You may appreciate that, Hon’ble Prime Minister of India as well as Hon’ble Minister for Railways have repeatedly applauded and praised the contribution of the Railwaymen in this <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> crisis, facing the risk of Coronavirus threat.</p>



<p>While addressing the Nation on 12th May, 2020, Hon’ble Prime Minister has announced a Mega Package for all the sections of the society to combat the COVID-19 Pandemic Crisis to boost the economy as well as morale of the country.</p>



<p>Since Railwaymen are performing their duties to transport aforementioned goods as well as Migrant Workers and have further started operating “Special Trains” for common rail users w.e.f. 12.04.2020, they can in no way be treated less than “COVID-19 Warriors”. As already submitted vide our letter dated 27.04.2020, freezing of Dearness Allowance and Dearness Relief, has proved to be extremely de-motivational rather than boosting their morale by sanctioning some Additional Incentive to them.</p>

<p>I would, therefore, request your goodself that, in the wake of Hon’ble Prime Minister’s announcement of Mega Package of Rupees Twenty Lakh Crore, the orders of freezing Dearness Allowance and Dearness Relief be withdrawn to boost the morale of the Railway Employees and other Central Government Employees who are fighting day-and-night against the COVID-19 Pandemic.</p>
