<p>Subject: <strong>Appointment of officers working in the Ministries/Departments under Central Staffing Scheme(CSS) to non-CSS posts in the Central Vigilance Commission(CVC) on shift basis</strong></p>
<p>It is proposed to fill up vacancies of Deputy Secretary/Director level in the Central Vigilance Commission(CVC) on shift basis. The posts are non-CSS posts to be filled through Civil Services Board procedure.</p>
<p>2. The officers who are working at DS/Director level in different Ministries/Departments under the Central Staffing Scheme will be eligible to apply for these posts. If the officer is selected for the post, it will be treated as a &#8216;shift&#8217; from a Central Staffing Scheme post to a non-Central Staffing Scheme post, which will entail additional tenure of two years as per the Consolidated Deputation Guidelines. The +2 option would be available only to those officers who were already working on a CSS post other than in the CVC. The additional tenure is subject to completion of two years on the present CSS post and availability of cadre clearance. In the absence of cadre clearance (for +2 tenure), the tenure will be restricted to the balance period of four/five years central deputation remaining to the officer. The maximum tenure admissible outside the cadre is seven years in both the stints CSS and nonCSS put together.</p>
<p>3. The posts may be circulated amongst the officers working at Deputy Secretary/Director or equivalent level under the Central Staffing Scheme in the Government&#8221; of India on priority basis. Names of the willing and eligible officers who can be spared by the Ministries/Departments may be forwarded to the Department alongwith the approval of the Minister-in-Charge, cadre clearance (for +2 tenure), vigilance clearance, detailed bio-data in the enclosed proforma and attested copies of ACR(s) for the period they have worked under CSS.</p>
<p>4. It is requested that the application(s) of the eligible officer(s) may please be forwarded so as to reach this Department upto 20.02.2019.</p>

<p>The Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh launched the online Software for Departmental Proceedings, here today.</p>
<p>Speaking on the occasion, Dr Jitendra Singh complemented the Department of Personnel and Training (DoPT), CVC and other departments for their collective efforts in this direction. He said that the Government under the leadership of Prime Minister Shri Narendra Modi has been working on the principles of &#8216;maximum governance, minimum government&#8217;, transparency with accountability &amp; citizen centricity and zero tolerance against corruption. The Minister said that the aim of the software is to see that the proceedings are done against corrupt officers and the honest officers are not put to harm due to inordinate delays. He said that the bureaucracy is the tool of governance and the aim of the government is to provide work-friendly environment to the officers. He said that the software will check that the honest officers are not intimidated and it will encourage the transparent functioning in the Government. It will ensure that the malpractices are not spared and the good practices are not punished, he added. He said that the efforts have been made to complete the disciplinary enquiry within 2 years. He said that reducing the timeline in completion of disciplinary proceedings will give faster relief to the honest officers.</p>
<p>The Secretary to Prime Minister, Shri Bhaskar Khulbe said that it is a big achievement accomplished by DoPT to bring departmental proceedings online. He said that delays are inordinate in the entire proceedings structure and this software will address that issue. He also emphasised upon the training of the disciplinary proceeding officials and also mentioned that a ready reckoner on rules and procedures should be available to the disciplinary proceeding officials.</p>
<p>The SS &amp; EO, DoPT, Shri Rajiv Kumar said that DoPT has taken various steps to streamline the process and make it more transparent. This software will help fast track the process of departmental proceedings and bring more transparency in the system, he added.</p>
<p>The Secretary, CVC, Smt. Nilam Sawhney said that the focus of the software is to reduce the pendency in the cases related to disciplinary proceedings.</p>
<p>The online software portal for Departmental Proceedings is as per provisions of All India Service (AIS )(D&amp;A) Rules, 1969, against All India Service officers. There had been serious concerns raised on the enormous time and delay encountered for completion of departmental proceedings instituted against government servants. As per a report of CVC, departmental proceedings which should ideally be completed within 2 years take anywhere from 2 to 7 years for completion. The delay is due to numerous factors which inter alia include delays in furnishing replies by the charged officer, finalisation/acquiring of documents required for proving the charges (listed documents), multiple adjournments during the inquiry process due to non-receipt or delayed receipt of information by the stakeholders and lack of accountability for completion of inquiry and in other stages during the departmental proceedings. To plug the delays and to complete inquiries expeditiously, specific timeframes were recently introduced through amendment to the AIS (D&amp;A) Rules, 1969 which were notified on 20.01.2017. The amendments have provided a timeframe of six months for completion of inquiry. Any further extension will require approval of the disciplinary authority with cogent arguments. Similarly, timeframes have also been introduced for reply of the charged officer on the charge sheet and advice of the UPSC. Amendments have also been made to the analogous provisions of CSS (CCA) Rules in respect of Central Government Employees vide notification dated 02.06.2017.</p>
<p>To augment the amendments made to the rules and to further expedite the inquiry process, the online system for departmental proceedings has been introduced. The online system envisages use of cloud based technology and provides interface to different stakeholders like the Administrative Ministry, which is initiating the inquiry, the Cadre Controlling Authority, Charged Officer, Inquiry Officer etc. through separate modules. All documents required for the conduct of the inquiry will be stored online and authenticated through digital signature/e-signature. Further, all communication between the different stakeholders will be through the system with provision for email and SMS alerts. The software also provides status of all pending cases on real time basis along with alerts for adhering to the timeframes indicated in the rule. It is expected that the online system will enable monitoring of the departmental cases more effectively to complete inquiries within stipulated timeframes and fix accountability at different stages. The online portal will initially be adopted in respect of IAS officers posted in the Central Government and will subsequently be extended to AIS officers in the Central Government as well as Central Group &#8216;A&#8217; employees. The State Government will also be involved in the subsequent phases for consideration of extension to AIS officers serving in the State Government.</p>

<p>Subject: <strong>Procedure for dealing with cases of disagreement between Disciplinary Authority and CVC &#8211; instructions regarding consultation with UPSC thereof.</strong></p>
<p>The undersigned is directed to refer to the OM No. 372/19/2011 &#8211; AVD-III (Pt. I) dated the 26th September, 2011 on the above subject which provided for dispensing with second stage consultation with the CVC in disciplinary matters. However, in those cases where consultation with UPSC is not required as per extant rules/instructions, the second stage consultation with CVC was to continue. Further, CVC issued a circular dated 7/12/2012 stipulating that wherein Disciplinary Authorities (DA) tentatively proposes not to impose any of the statutory penalties at the conclusion of the proceedings, the second stage consultation would continue to be made with the Central Vigilance Commission, involving Group &#8216;A&#8217; officers of the Central Government, members of All India Services and such other categories of officers of the Central Government involved in composite cases.</p>
<p>2. Despite clear instructions on the subject some instances have come to the notice where Ministries and Departments are not following the above guidelines leading to delay in disposal of the disciplinary cases.</p>
<p>3. The matter has been considered in consultation with UPSC and CVC and following are being reiterated:</p>
<blockquote><p>(i) All cases, where the Disciplinary Authority (DA) decides to impose a penalty after conclusion of the proceedings and where UPSC consultation is required as per existing rules/instructions, shall not be referred to the CVC for second stage consultation.</p>
<p>(ii) The CVC circular 8/12/14 of 3rd December, 2014 stipulates that all such cases where the DA proposes to take any action which is at variance with the Commission’s first stage advice would continue to be referred to the Commission for obtaining second stage advice. In this regard it has now been clarified by CVC that the aforementioned circular applies only to the disciplinary cases of non-Presidential appointees including officials of CPSEs, Public Sector Banks, and Autonomous Bodies etc. The above instructions, therefore, do not apply to the cases of the officers of Group A services of the Central government, All India Services (AIS) and such other categories of officers of the Central Government where consultation with UPSC is necessary before imposition of any of the prescribed penalties.</p></blockquote>
<p>4. In a situation where on conclusion of the departmental proceedings, DA is of the tentative view that no formal penalty needs to be imposed in respect of officers of Group &#8216;A&#8217; services of the Central Government, All India Services (AIS) &amp; such other categories of officers of the Central Government and refers the case for second stage consultation with CVC and if CVC advises imposition of a penalty which the DA on consideration decides not to accept, then this becomes a case of disagreement between DA and CVC which as per standing instructions require resolution by DoPT.</p>
<p>5. All Ministries/Departments are, therefore, advised to strictly adhere to these instructions.</p>

<p>Subject: <strong>Observance of Vigilance Awareness Week, 2016.</strong></p>
<p>Central Vigilance Commission had through its circular of even number dated. 19.09.2016 issued instructions for observance of Vigilance Awareness Week ,this year, from 31 st October to 5th November, 2016. The theme for the Week is Public participation in promoting Integrity and eradicating Corruption.</p>
<p>2. In addition to the activities suggested by the Commission to be conducted within the organisations as well as the outreach activities for public/citizens, in line with the theme this year, to create greater awareness and participation of the public at large, the Commission has envisaged a concept of &#8220;<strong>Integrity Pledge</strong>&#8220;. As such<br />
two Integrity Pledges have been envisaged enlisting support and commitment of the citizens and the other for corporates/entities/firms etc., especially in the private sector to prevent and combat corruption.<br />
3. Both, the &#8220;Integrity Pledges&#8221; to be taken by individual citizens as well as corporates, entities, firms etc., affirming their commitment to eradicate corruption (and to uphold highest standards of ethical conduct, transparency and good governance would be available as an e-pledge on the Commission&#8217;s website<br />
http://www.cvc.nic.in. All Ministries/Departments/Organisations may also provide a hyperlink to the Integrity Pledges on their respective websites/intranet to enable wider participation. Citizens and organisations taking the Integrity Pledge would be &#8220;provided a certificate acknowledging and appreciating their commitment to the cause of anti-corruption. Copies of both the Integrity Pledges&#8221; are enclosed.</p>
<p>4. The Commission requests all Ministries / Departments /Organisations to disseminate and publicise this initiative to elicit wider participation of all stakeholders and also to encourage their customers/public and corporates / entities/firms, etc., to take the Integrity Pledge.</p>

<p>The undersigned is directed to invite a reference to this office OM No.C-11021/63/15/CGA/CVO/Office Guidelines/ 1419 dated 15.12.2015 vide which it was advised to ensure strict compliance of the Central Vigilance Commission’s Circular No. 03/09/13 issued under file No. 004/VGL/090/225553 dated 11.09.2015 dated 11.09.2015 and a list of officials rotated/transferred out of sensitive posts may be furnished to this office latest by 31.01.2016.</p>
<p>2. Compliance/Action taken report from your office yet to be received.</p>
<p>3. You are once again requested to ensure strict compliance to the Central Vigilance Commission’s guidelines and implement the same in letter and spirit immediately and submit a list of officials rotated/transferred out of sensitive posts at the earliest. <p>Attention is invited to Central vigilance Commission’s Circular No. 03/09/2013 issued under file No 004/VGL/ 090/ 225553 dated 11.09.2015 on the subject mentioned above. As per Commission’s instructions issued vide letter Nos 98/VGL/60/dated l5/4/l999. 02/11/2001 and 004/VGL/90 dated 1/5/2008 on the issue. it is prescribed that Ministries/Departments and CVOs are to identify the sensitive poets and staff working in these posts and also ensure that they are strictly rotated alter every two/three years to avoid developing vested interests.</p>
<p>It has also been observed in the Circular that such rotational transfers are not effected in many organisations due to which officials continue to remain in the same posts for long periods. Such overstay and continuous postings afford scope for indulging in corrupt activities. developing vested interests etc. which may not be in the interest of the organisation. The Commission had therefore emphasised for periodical rotation of officials holding sensitive posts/jobs.</p>
<p>In order to implement the guidelines of CVC’s circular; the following sections in the various Pay and Account Office: under the administrative control of Pr. CCAs/CCAs/CAs have been identified as sensitive:</p>
<p><strong>l. Administration including Cash.</strong></p>
<p><strong>2. Pro Check.</strong></p>
<p><strong>3. Procurement/Paradise.</strong></p>
<p><strong>4. Sections dealing with banks.</strong></p>
<p><strong>5. Loans and Grants.</strong></p>
<p><strong>6. Any other section (as decided by respective Pr. CCAs/CCAs/CAs</strong>)</p>
<p>Further. the tenure of Sr. AOs/AOs/AAOs posted in these sections has been fixed as two years and the tenure for Sr. Accountants/Accounants has been fixed as three Years.</p>
<p>Rotation/transfers of all officers/officials who hove completed their tenures as per above cited guidelines they be considered. Also, while considering rotation/transfer of officials who have completed their tenures in the sensitive sections it may be ensured that they an posted to other sensitive sections only after a gap of minimum of two years. While considering rotation/transfer of officials posted in sensitive posts. officials working in non sensitive posts may also he considered for rotation/transfers after completion of six years on regular basis to improve overall efficiency of the organisation.</p>
<p>In cases. where AAOs are considered for promotion as AOs in the same office/Department due to administrative reasons. their services rendered in sensitive sections may be taken in to account while posting them as AOs.</p>
<p>All Pr. CCAs/CCAs/CAs are advised to amuse strict compliance of the Commission’s guidelines and implement me some in letter and spirit. A list of official rotated/transferred out of sensitive posts may be furnished to this office latest by 31/01/2016</p>

										<content:encoded><![CDATA[<p><strong>Over 62,000 corruption complaints received in Central Vigilance Commission last year</strong></p>
<p>New Delhi: Over 62,000 complaints of alleged corruption in various government departments were received by the Central Vigilance Commission last year, the government said today.</p>
<p>A total of 62,362 complaints were received in 2014.</p>
<p>Necessary action was taken on 24,047 of them and investigation reports were sought in 1,176 complaints, Union Minister Jitendra Singh told Lok Sabha in a written reply.</p>
<p>Of the total complaints, 36,876 were filed as no action was required by the Commission on them. A total of 2,311 complaints were pending, he said.</p>
<p>The Central Vigilance Commission has received a total of 4,309 complaints between January and February this year, said Singh, Minister of State for Personnel, Public Grievances and Pensions.</p>
<p>Of these, necessary action was taken in 3,085 complaints and investigation report was sought in 36 cases. A total of 2,107 complaints were filed by the probity watchdog, he said.</p>
<p>The Commission received 926 complaints exposing corruption under the Public Interest Disclosure and Protection of Informers (PIDPI), also known as whistleblowers resolution, in 2014 and necessary action was taken in 841 of them.</p>
<p>It has received 173 such complaints between January and February this year and necessary action has been taken in 98 of them, the Minister said.</p>

<blockquote class="tr_bq"><p><b>Subject: Policy guidelines for Extension of tenure of Board level Incumbents where vigilance clearance is not available.</b></p></blockquote>

<p>As per extant policy, in case the initial term of 05 years of a Board-level appointee come to an end prior to his/her date of superannuation, extension of his/her tenure upto the date of superannuation is considered with the approval of the ACC subject to his/her being free from vigilance angle and meeting the prescribed performance parameters. In terms of existing instructions, services of any Board-level appointee cannot be terminated on completion of his Initial term, if he/she is due for extension, without specific orders of the ACC. There are many cases, however, where vigilance clearance Is not given in time by CVC/concerned administrative Ministry/Department due to complaints/inquiries pending against the concerned officer.</p>

<p>2. The issue of extension of tenure of Board level incumbents has been examined and with the approval of the ACC, It has been decided to henceforth follow the following procedure In this regard :-</p>
</div>
<div>
<p>&nbsp;</p>
<p>(I) As in the case of fresh appointments, in line with CVC’s instructions dated 31.08.2004, no cognizance should be taken of any complaint which Is received within 06 months prior to the terminal date of the approved tenure of Board-level appointees. This is Imperative as it has been frequently observed that there is a spate of allegations and complaints against Board-level officials whose cases become due for extension of tenure.</p>
</div>
<div>
<p>&nbsp;</p>
<p>(II) The Department should take a conscious decision on whether to extend the term of a Board-level appointee at least one year In advance of the completion of his initial term so that adequate time Is available for the Department to obtain CVC clearance.</p>
</div>
<div>
<p>&nbsp;</p>
<p>(III) Taking into account the vigilance status as on the date six months before the terminal date of initial appointment, the CVC may give its clearance within two months of receiving the reference in this regard from the Administrative Ministry, This limit of two months will Include time taken for back references, CBI references/inquiries, etc.</p>
</div>
<div>
<p>&nbsp;</p>
<p>(IV) Even though complaints received after the cut-off date shall have no bearing upon the process of extension of tenure and would not prejudice the same, such complaints shall be dealt with as per the</p>
</div>
<div>
<p>normal procedure. Disregarding such complaints received after the cutoff date at the time of deciding upon extension of tenure may not be of any serious consequence as the appointment can always be terminated at a later date if the charges are substantiated on the basis of an inquiry.</p>
</div>
<div>
<p>&nbsp;</p>
<p>(V) (a) In respect of the cases where CVC clearance has been delayed beyond the prescribed timelines, merely on account of procedural reasons, and where there is no denial of vigilance clearance, the case of extension could be processed without waiting any further,</p>
</div>
<div>
<p>(b) In respect of the cases where CVC clearance is awaited, and there are cases/complaints pending against the officer, the Ministry shell submit to ACC, a proposal for extension of tenure, at least two months prior to the officer’s approved tenure with:</p>
</div>
<div>
<p>(i) all available information in respect of the complaint;</p>
</div>
<div>
<p>(ii) material received from/sent to CVC, including enquiry report, if any, of the CVO of the Ministry;</p>
</div>
<div>
<p>(iii) the comments of the Ministry thereon.</p>
</div>

<div>
<p> 3. All the Ministries/Departments are requested to strictly adhere to the time-line and procedural guidelines stipulated above for processing the proposals for extension of tenure of Board level appointees.</p>

<p>Subject:- <strong>Guidelines regarding handling of complaints in Ministries/Departments.</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. of even number dated 18.10.2013 on the above subject and to say that the Ministries/Departments of the Government of India have been seeking clarifications from this Department on operation of the aforesaid O.M. The matter has been considered and it is clarified as under:-</p>
<p>&nbsp;</p>
<p>(i) `Anonymous complaints&#8217; are such complaints which do not carry both, name and address of the complainant and need to be dealt with in terms of para 3 (i) of the DOP&amp;T O.M. dated 18.10.2013 referred to in para 1 above, irrespective of the nature of allegations.</p>
<p>(ii) The complaints other than anonymous complaints which contain vague allegations need to be dealt with in terms of para 3 (ii) of the DOP&amp;T O.M. dated 18.10.2013 referred to in sub- para (i) above.</p>
<p>(iii) The complaints which contain verifiable allegations and are not anonymous, need to be dealt with in terms of para 3 (iii) of the DOP&amp;T O.M. dated 18.0.2013 referred to in para 1 above</p>

<p>Subject: <strong>Amendment of Government of India&#8217;s Resolution No. 89 published in the Gazette of India Part I Section 1, Extraordinary dated 21 St April, 2004(read with corrigendum dated 29th April, 2004) commonly known as the Public Interest Disclosure and Protection of Informers (PIDPI) Resolution-regarding </strong><br />
In continuation of this Department&#8217;s OM of even No. dated 3rd September, 2013 on the above subject, the undersigned is directed to enclose herewith a copy of Procedure for handling of complaints under Public Interest Disclosure and Protection of Informers (PIDPI) Resolution to be followed by the Chief Vigilance Officers of the Ministries/Departments of the Government of India who have been authorized as the Designated Authority to receive written complaint or disclosure on any allegation of corruption or misuse of office by or under any Central Act, Government companies, societies or local authorities owned or controlled by the Central Government and falling under the jurisdiction of that Ministry or the Department.<br />
2. The CVOs in the Ministries or Department, either on the application of the complainant or on the basis of the information gathered, is of the opinion that either the complainant or the witnesses need protection, they shall take up the matter with the Central Vigilance Commission(CVC), of issuing appropriate directions to the authorities concerned.</p>
<p>3. It is requested to give wide publicity to the Procedure for handling of complaints under PIDPI Resolution by placing it along with the name and designation of the designated authorities on the website of Ministries as well as of the organizations under the Ministries. A copy of the PIDPI Resolution No. 89 dated 21st April, 2004 and Amendment Resolution No. 190 dated 29.8.2013 is also enclosed</p>
