Subject: Revision of the rates of Central Secretariat (Deputation on Tenure) Allowance to officers of All India Services and Organized Group ‘A’ Central Services on their appointment as Under Secretary, Deputy Secretary and Director in the Central Secretariat under the Central Staffing Scheme.

The undersigned is directed to refer to this department’s Office Memorandum of even no dated 24.04.2018 conveying the revised rates of Central Secretariat (Deputation on Tenure) Allowance (CDTA) admissible to the officers of All India Services and Organized Group A’ Central Services on their appointment as Under Secretary, Deputy Secretary and Director in the Central Secretariat under the Central Staffing Scheme.

2. It was indicated in para 1 (c) of the OM that during their tenure as Under Secretary/ Deputy Secretary/ Director, the officers will be paid CDTA at the rate of 10% of their basic pay, subject to a ceiling of Rs. 9000;

3. In consideration of references received from various Ministries/Departments and after due consultation with Department of Expenditure it has been decided that the ceiling will further rise by 25 percent each time Dearness Allowance increases by 50 percent.

4. This issues with the concurrence of the Department of Expenditure conveyed vide their ID note no. 916/2024-E. 11(B) dated 29.04.2025. All others terms and conditions regulating the CDTA, as contained in this Department’s OM No. 2!10/2017-Estt. (Pay-Il) dated 24.04.2018 remain unchanged.

The undersigned is directed to refer to this Department’s O.M. of even number dated 22nd November 2022 wherein this Department had invited fresh applications from Associations / Unions of employees belonging to the Central Secretariat Service, Central Secretariat Stenographers’ Service, Central Secretariat Clerical Service, etc. (other than recognised Central Government Staff Car Drivers’ Association and Central Secretariat MTS Association) who wish to seek recognition under the CCS (Recognition of Service Associations) Rules, 1993. The Association(s) were requested to submit their application for recognition by 15.12.2022 (copy enclosed).

2. It has now been decided to extend the date of acceptance of applications till 20th January, 2023. Subject: Recognition of Central Secretariat Service Employees Associations under the Central Civil Services- (Recognition of Service Associations) Rules, 1993 – regarding.

The undersigned is directed to refer to this Department’s O.M. No.17/1/2017 – R&R and DC dated 29.06.2017 vide which fresh applications for recognition were invited from the above mentioned employees’ associations and subsequently two associations namely (i) Central Government Staff Car Drivers’ Association, and (ii) Central Secretariat MTS Association, who fulfilled requisite criteria were recognized for a period of five years.

2. Department has now decided to invite FRESH APPLICATIONS from other Associations/ Unions of employees belonging to the Central Secretariat Service, Central Secretariat Stenographers’ Service, Central Secretariat Clerical Service, etc. who wish to seek recognition under the CCS (Recognition of Service Association) Rules, 1993. Association(s) may submit their application for recognition by 15.12.2022. Association, irrespective of their earlier application(s) submitted, if any, are required to submit applications afresh. The application should be sent to this Department along with the
   following documents: –

• i. Memorandum of Association (MOA).
• ii. Constitution I Bye-laws of the Association,
• iii. Names of the Office-bearers of the Association along with their designation, elected from the cadre(s) the Association represents, &
• iv Ministry / Department wise list of estimated membership of the Association.

3. The Constitution/ Bye-laws of the Association should be in conformity with the CCS (RSA) Rules, 1993. For the sake of convenience, the salient features of the constitution are reiterated in the Annexure to this O.M.
4. The membership of an Association/Union should be restricted to a distinct category of Govt. servants having common interest and eligible to be members vide rule 5(C) of the CCS(RSA) Rules, 1993.
5. Recognition will be accorderto an association on fulfilling the conditions prescribed in the CCS (RSA) Rules 1993 and orders instructions issued there under from time to time.

6. All the Cadre Controlling authorities of the Central Secretariat are requested to give wide publicity to the contents of this Office Memorandum so that the Service Associations / Unions of the Central Secretariat employees can submit their applications by 15th December, 2022.

The undersigned is directed to refer to this Department’s O.M. of even number dated 31 October 2022 vide which all the cadre units were requested to provide the inputs as per the 15 columns’ prescribed proforma for review of US level officers of CSS who have crossed the age of 50 years on 01.07.2022, under FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972 and to say that the requisite information has so far been received from the D/o Expenditure and the D/o Revenue only.

2. In this regard, all the remaining concerned cadre units are once again requested to furnish the required information/complete inputs to this Department urgently and not later than 27th January 2023, failing which, it would be presumed that the concerned cadre unit has no officer(s) pending for review under FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972.

Sub: 4th Cadre Restructuring of the CSS – Inviting proposals from the Ministries / Departments – Regarding.

The undersigned is directed to refer to this Departments O.M. No. 19/02/2022-CS.I(P) dated November 2022 and subsequent OM dated 29.11.2022 on the subject mentioned above and to say that only a few Cadre units have submitted their proposals seeking additional requirement of CSS officers till date.

2. As the proposals of all the cadre units are urgently to be placed before the Cadre Restructuring Committee to examine the overall requirement of all the cadre units under Central Secretariat and firm up recommendations, all the cadre units are once again requested to submit their proposals on the additional requirement of posts with proper justification and financial implications etc. to this Department for consideration of the 4th CRC immediately by 30th December 2022.
3. It has also been observed that some of the proposals received from the Cadre units for providing additional posts of CSS have not been accompanied with proper justification for each additional post with its financial implications besides availability of funds for such additional posts. The cadre units, who have already submitted their proposals may kindly once again review and submit their revised proposals, if applicable, with full justification for each additional post with financial implications and funds availability etc. The proposals in this regard may be sent by 30th December, 2022 through email to gd.topponic.in, cc to sn.swain@nic.in and sanjeet.04@gov.in

Sub: Consolidated guidelines on Rotational Transfer Policy (RTP) for Central Secretariat Service – Regarding.

The Central Secretariat Service (CSS) is managed centrally in CS.I Division of Department of Personnel & Training (DoPT) for all matters relating to appointment, promotion, posting/transfer etc. CSS provides a permanent bureaucratic set up in the Central Secretariat and officers of the service provide continuity in the Central Secretariat. As a part of the cadre management , the officers of the Service can be posted to any Ministry/Department under Central Secretariat and other offices participating in CSS in Delhi and also located outside Delhi.

2. In order to manage transfer/ posting of the officers of the CSS in a definite framework, a Rotational Transfer Policy (RTP) has been in existence for quite some time. As various amendments in the policy have since been made at different times, it is felt to consolidate the same and accordingly , the consolidated guidelines with certain amendments on RTP in CSS have been drawn up and annexed herewith for information and compliance.

Consolidated Guidelines on Rotational Transfer Policy (RTP) for Officers of Central Secretariat Service (CSS)

1. Grouping of Ministries/ Departments

(i) Ministries/ Departments have been divided into two groups – Group ‘A’ and Group ‘B’ vide Annexure-I. If an officer has served his tenure in Group ‘A’, he/she will be eligible for transfer to Group ‘B’ and vice versa.

(ii) However, an officer posted in Group ‘A’ Ministry/ Department may also opt for posting to another Ministry/ Department in Group ‘A’ on promotion. On his posting in the new Ministry/ Department in Group ‘A’, tenure will be counted afresh for future transfer under RTP.

2. Tenure

The minimum tenure required in a particular Ministry/ Department to be eligible for transfer from one cadre to another is as under:

3. Transfer on promotion and exemption thereof

(i) On promotion, an officer at any level shall be posted out of the Ministry/ Department if he/she has served in the same Ministry/ Department in any capacity for a period exceeding the prescribed tenure for the promotion post.

(ii) If the officer is due for superannuation within two years, he/she will be retained in the same Ministry/ Department against an existing vacancy of the promotional post. In case of no vacancy of the promotional post, then the officer will be transferred to another Ministry/ Department.

(iii) If the officer is due for superannuation within six months on promotion, he/she will not be transferred as in such a short period one cannot be expected to contribute usefully in another Ministry/ Department. Further, such a transfer may result in delay in finalisation of pension papers. Such an officer will be retained in the same Ministry/ Department against an available vacancy of the promotional post. In the absence of a vacancy, the post held by him/her will be upgraded on personal basis by keeping one post in another Ministry/ Department vacant so as not to exceed the cadre strength. On retirement, the post will revert to its original level.

4. Officers exempted from transfer under RTP

(i) Officers of all grades within two years of superannuation will be exempted from rotational transfers.

(ii) Officers likely to be promoted within one year shall be exempted from the RTP as on promotion officers are transferred if they have completed the prescribed tenure for the promotional post.

5. Offices exempted under RTP

Officers serving in PMO, Cabinet Secretariat, O/o Solicitor General & Attorney General, Addl. Solicitor General will be exempted under RTP. It is considered necessary that these offices may be allowed to retain officers of choice beyond the prescribed tenure under RTP. However, before issue of transfer orders under RTP, these offices will be notified about the officers matured for transfer and if the office concerned decides to retain any of the officers also keeping in view the willingness of the officers concerned, it will inform DoPT and such officers will be exempted from RTP. This exercise will be repeated every year.

6. Surrender of Officers

(i) Unilateral surrender or relieving of officers on any ground is not allowed as surrender or relieving of an officer poses several problems to the Cadre Controlling Authority. If an officer is not performing, Ministries/ Departments concerned are expected to initiate appropriate action either to penalize or to reform the officer. Moreover, the officer surrendered/ relieved has to be posted somewhere and it will be difficult for the Ministry/ Department, where he/she is posted to work with such an officer. If situation warrants that an officer has to be surrendered/ relieved, then a request should be made to DoPT with detailed reasons and DoPT will consider the request on merits, whether to transfer the officer or not.

(ii) If despite the instructions, any Ministry/ Department surrenders an officer unilaterally, then such surrender would be presumed to have been made along with the post and the sanctioned strength of the concerned Ministry/ Department would be reduced accordingly and no replacement would be provided to the cadre unit concerned for one year. After expiry of one year, the position will be reviewed for restoration of the post and posting of an officer.

7. Posting of Officers on return from Deputation/ Long Leave/ Long Term Training

(i) An officer of any grade is required to report to CS.I Division (DoPT) on his/her return from deputation/ long leave/ long term training and will be posted to any Ministry/ Department based on the administrative exigencies. In such cases, this posting will be treated as a fresh tenure. In case it is decided that an officer is to be posted back to the same Ministry/ Department he last served, then his tenure will be limited to the balance period of the tenure prescribed for the grade subject to the availability of the vacancy and subject to the condition that at least one year of balance tenure is left.

(ii) Period of leave/ training exceeding six months will be treated as long leave/ long term training for the purpose of posting under RTP.

(iii) Officers to be retained on promotion in the same Ministry/ Department in terms of the RTP would be adjusted first and only thereafter officers returning from deputation, long leave or training would be considered for retention, subject to availability of vacancy.

(iv) In all cases not covered under existing provisions like merger and winding up of Departments/ Ministries etc., the posting to Group ‘A’ and ‘B’ of the officer would be determined as follows:

(a) If balance term in a particular Group available is 2 years or more, then the officer would be posted to the Group in which the erstwhile Department/ Ministry was categorized.

(b) If balance term in a particular Group available is less than 2 years, then the officer would be posted to the Group where his/her entire service is less.

8. Posting to the Ministry/ Department earlier worked

An officer who is to be transferred out on promotion from the current Ministry/ Department on completion of prescribed tenure or for want of a vacancy of the promotional post as the case may be, and on rotational transfer may also be allowed option for posting in a Ministry/ Department where he earlier served subject to the condition that there is a gap of period which is equal to tenure prescribed for the post.

9. Preference for posting

(i) Promotion is made against available vacancies. Preferences for posting on promotion, if allowed, shall be accommodated as far as possible within the available vacancies and in the order of seniority.

(ii) The list of officers who are in the approved panel for promotion and to be promoted in the next order will be notified on the website of this Department along with the vacancy position. Officers concerned may furnish three preferences for posting within the available vacancies within 7 days of notification of vacancies.

(iii) Occasions arise that some vacancies are to be filled up immediately on functional needs, and on such occasions, it is not possible to wait for the next promotion order. As such vacancies are filled up by the next officer in the panel approved for promotion and in such cases the question of seeking preferences will not arise.

(iv) Posting on promotion/ transfer will be recommended by a Placement Committee, as per functional need and its recommendations will be approved by the Competent Authority.

(v) The Placement Committee will recommend posting of officers either on promotion or under rotational transfer keeping in view relevant factors viz. vacancies, seniority, preference for posting, past experience, specialized training done, etc. In case of isolated postings involving few officers returning from long leave, long term training, and repatriation from deputation etc., approval of the Competent Authority will be obtained without the Placement Committee procedure to avoid delay in posting of officers.

(vi) For posting of officers to PMO, Cabinet Secretariat and Central Vigilance Commission, as identified by these offices, no willingness will be sought and the officers will be posted to these offices even without their completion of tenure in the Cadre Unit/ Ministry/ Department.

(vii) CS.I Division (DoPT) will share the list of CSS Officers eligible/ covered under RTP with UPSC in each grade and to consider the request of the Commission for retention on case to case basis and in exceptional cases. Retention, so allowed, will be for a period not exceeding 50% of the normal tenure or till the promotion of the officer, whichever is earlier.

(viii) Any Officer who is not clear from vigilance angle and who may/ may not be due for transfer under RTP may be transferred out in case a report is received from the concerned Ministry/ Department. Such an officer will be posted to a non- sensitive post in any Ministry/ Department without seeking his option for posting irrespective of the tenure of his posting in that Ministry/ Department.

10. Outstation Posting

The offices of the Central Ministries/ Departments participating in the Central Secretariat Service (CSS) are mostly located in the National Capital Region (NCR). However, there are a few posts of CSS which are located outside NCR in the various regions of the country. The CSS being a transferable service, members of the CSS are liable to be posted to such posts located outside NCR also. Posts of CSS located outside NCR will be filled up as under:

(i) Section Officers’ Grade and Assistant Section Officers’ Grade:

(a) The cadre-unit will fill up the post from amongst the officers of the Ministry/ Department by circulating the post. In case of non-availability of officers within the Ministry/ Department, the cadre unit will approach DoPT. DoPT will circulate the post and invite applications from eligible CSS officers in all the Ministries/ Departments and post the selected officer to the outstation vacancy.

(b) Once posted to an outstation office, an officer in ASO/ SO grade will have tenure of seven years i.e. the maximum proposed up to this level, irrespective of the tenure rendered in the Ministry/ Department at Delhi.

Prescription of an assured tenure in such outstation posting is considered necessary as officers seek outstation posting generally on compelling family circumstances.

(c) If no application is received after circulation by DoPT, the present incumbent will be allowed to continue on the post for one more year after which the post will be re-circulated once a year till a new incumbent is selected.

(ii) Under Secretary and above level posts:

For US and above level vacancies in offices located outside NCR, CS.I Division will invite applications from the willing officers. On the basis of applications received, an officer will be posted with the approval of the competent authority keeping in view the posting profile of the officer/ his family circumstances requiring posting to the particular station etc. The tenure of the officer in the outstation posting will be five years.

(iii) On conclusion of outstation posting, officers of all grades will report to DoPT for further posting provided they had completed the prescribed tenure under RTP i.e. tenure in the Ministry/ Department at Delhi + outstation office of the same Ministry/ Department.

(iv) In the absence of willing officers, DoPT may at its discretion post officers to such outstation postings as CSS carries all India service liability.

11. Mutual Transfer

Request for mutual transfer of officers may be considered by the Department of Personnel & Training subject to the following conditions:

(i) Both of the officers applied for mutual transfer should have completed at least 50% of the tenure prescribed for the post.

(ii) The request has been recommended by the Secretary of the Departments concerned.

(iii) The officers concerned should be clear from vigilance angle.

(iv) Requests for mutual transfers will be considered on case-to-case basis keeping functional considerations in mind.

(v) Tenure on mutual transfer in the new Ministry/ Department will be counted afresh for further transfer under RTP.

12. Transfer on request

Section Officers and Assistant Section Officers on completion of five-year tenure in a Ministry/ Department may on their own volition request for transfer.

However, such transfers will be restricted to the Ministries/ Departments in Group ‘A’
i.e. the transfer will be allowed within Group ‘A’ or from Group ‘B’ to Group ‘A’ and shall further be subject to availability of vacancies. On such transfer their tenure in the new Ministry/ Department will be counted afresh and they will be required to serve the prescribed full tenure for the post before they are considered for transfer.

13. Transfer and posting requests from differently-abled officers

Physically handicapped persons suffer from a range of problems on account of mobility. There may be many peculiar issues viz., the location of bus stop/ metro station near their office, the area where they reside and the conveyance they are using to reach office etc., which may have a bearing on the performance of their official duties. Although these are minor issues for persons without disability, these can have a very huge effect on the day to day activities of a disabled person. Requests from such officers will, therefore, be considered for posting on case-to-case basis.

14. Cut-off date and tentative schedule of transfer

(i) The cut-off date for calculating the period of residency in a Ministry/ Department will be 1st July of the year in which rotational transfer is carried out. An officer for being covered under RTP should have completed prescribed tenure as on 1st July of the year. The cut-off date for calculating two years/ six months (in case of promotion/ superannuation) will be calculated as on the last date of the month in which rotational transfer order is issued.

(ii) The rotation under RTP in each grade will be undertaken once in a year.

(iii) To ensure smooth transition from outgoing to incoming staff, rotation will be done phase-wise and grade wise once in a year as under (indicative schedule):

15th May – Deputy Secretaries and above
15th July – Under Secretaries
15th October – Section Officers
15th December – Assistant Section Officers

(iv) Equal number of officers will be transferred and posted to ensure relievers are available for the officers transferred out. This is possible only if the number of officers covered under rotational transfer in both the groups is equal to ensure provision of relievers in place of transferred officers. If there is a mismatch between the number of officers covered under rotational transfer between the Groups, only equal number of officers will be transferred on the basis of higher length of service and the remaining left out officers will be covered in the next round of rotational transfer in the subsequent year.

15. Posting/ transfer of Joint Secretary (in-situ)

(i) The posts of JS in Central Secretariat are entirely filled up under the Central Staffing Scheme (C.St.S). However, CSS Directors empanelled for appointment as JS under Central Staffing Scheme are given in-situ promotion as JS in SAG Grade at their current place of posting till they are placed under C.St.S. with such in-situ promotion restricted to 40 in number.

(ii) If a Ministry/ Department is desirous of utilizing the services of a JS (in-situ) by giving the officer independent charge as JS or otherwise, it may identify an officer from among JSs (in-situ) and inform DoPT. Such an identified officer will be transferred to that Ministry/ Department against an available vacancy in DS/Dir./JS(in-situ) Grade provided he/she is willing for such transfer. In case of such transfer, the tenure prescribed for DS/Dir./JS(in-situ) Grade in a Ministry/ Department and condition of Group will not be attracted.

16. Non-compliance of orders issued by DoPT

In terms of Rule 19 of CSS Rules, 2009, the Department of Personnel and Training shall be the competent authority to transfer a cadre officer of any Grade from one cadre unit to another cadre unit and it shall be the duty of the concerned cadre unit to relieve the officer concerned within 45 days of the transfer order. If not relieved within 45 days, the officer concerned shall be deemed to have been relieved and thereafter the officer shall not be entitled to draw any salary and allowances from the Ministry/ Department from which transferred.

17. Timing of promotion/ transfer orders

DoPT will issue promotion/ transfer orders as far as possible on the last working day of the week (generally Friday) and the officer concerned stands relieved immediately and he/she will be required to join the allocated Ministry/ Department on the first working day of the next week (generally Monday). This will be equally applicable to officers posted in attached offices of the Ministries/ Departments. The onus to join the allocated Ministry/ Department on the basis of order issued by DoPT will be on the officer concerned and it will also be incumbent upon the Ministry/ Department not to release the salary to the officer beyond the stipulated date. Failure to adhere to these guidelines may attract administrative action by the DoPT.

18. Saving clause

Modification/ relaxation in implementation of the provisions of RTP will be considered by the Competent Authority in DoPT.

A Committee for cadre restructuring of the Central Secretariat Service (CSS) with the following composition and terms of reference is constituted:

Composition:

• (i) Establishment Officer & Additional Secretary, DoPT – Chairman
• (ii) Joint Secretary (CS), DoPT – Member
• (iii) Joint Secretary (Pers), D/o Expenditure – Member
• (iv) Deputy Secretary (CS.I), DoPT – Member Secretary

Terms of Reference:

• (i) To review the existing cadre structure of CSS cadre along with the feeder cadre and project the manpower requirement for next 10 years taking into account the encadrements already made after the 3rd Cadre Restructuring (CRC) of CSS & proposals for encadrement pending and also the functional needs of the cadre units.
• (ii) To assess the present and future career progression of the members of the service and suggest remedial measures both short term and long term so as to reduce promotion blocks and at the same time prevent gaps from building up.
• (iii) To suggest measures to enhance the effectiveness of the service and capacity building of its members.
• (iv) To study the effect of encadrement of posts of autonomous bodies and statutory organizations in CSS Cadre.
• (v) To study the relevance of the recommendations of the 3rd CRC not implemented so far.
• (vi) To review the present training needs of the members of the CSS Cadre.
• (vii) To take into view the suggestions of stake holders.
• (viii) To examine any issue as referred to it by the Cadre Controlling Authority (CCA) of CSS and Central Secretariat Clerical Service (CSCS)

ORDER

The Central Secretariat Service Section Officers’ Grade (Limited Departmental Competitive Examination) Regulations, 2010 provide that for being eligible to appear in the Section Officers Grade (Limited Departmental Competitive Examination), an officer of the Assistant Grade of the Central Secretariat Service (CSS) or of Personal Assistants’ Grade (Stenographer Grade ‘C’) of the Central Secretariat Stenographers Service (CSSS) possessing a Bachelor’s Degree of a recognised university or equivalent shall inter-alia, satisfy the following condition on the crucial date;

“He shall have rendered not less than five years’ approved service and shall also have, earned at least four Annual Performance Appraisal Reports in the Assistants’ Grade of the Central Secretariat Service or Personal Assistants’ Grade of Central Secretariat Stenographers Service.”

2. As per the above Regulations, the DR ASOs upto select list 2012 and Seniority quota ASO upto 2013, who have 5 years approved service and possess atleast 4 APARs are eligible to appear the SO LDCE 2018. However, due to the inter-se seniority litigations in the SSA SL of 2003 pending before the Hon’ble Delhi High Court in W.P.(C)No.8616/2019 (UoI Vs Sugam Arora & Ors) and W.P. No.8454/2019 (UoI Vs Uttam Dey Sarkar and Ors)} the SL of ASOs for 2013 under seniority quota has not been finalised. Some of these SSAs of 2003 (extended list) shall be included in the ASO SL for 2013 under seniority quota after the outcome of the above WPs.

3. As a result, the SO LDCE for 2018 is on hold and the Department is unable to fill up the vacancies in Section Officer grade earmarked under LDCE quota and this is affecting the Govt. functioning. Delay in conducting the examination is also affecting the morale of the eligible DR ASOs of 2012 batch and ASOs (SO) of 2013.

4. The WPs in the matter of inter-se seniority of SSA of 2003 (extended list) are likely to be taken up in the Delhi High Court for their final decision soon. In order to expedite the process of filling up the vacancies of SO under LDCE quota, it has been decided in consultation with the UPSC to relax the following provisions stipulated in CSS SO’s Grade (LDCE) Regulations, 2010 under the powers conferred in Rule 23 of the Central Secretariat Service Rules, 2009 and the Central Secretariat Service (Amendment) Rules, 2022 to alt the SSAs of 2003 (extended list) as a onetime relaxation not to be treated as a precedent to appear in SO/PS LDCE, 2018, subject to submission of an undertaking as per the Annexure to this Order:

• (a) The provision of 5 years’ of approved service in the ASO grade.
• (b) The provision of availability of minimum 4 APARs/ACRs in the grade of ASO. From the required 4 APARs/ACRs, available APARs/ACRs in the grade of ASO and remaining APARs/ACRs from SSA Grade (the APARs upto the year 2017-18) shall be considered for the SO/PS LDCE,2018.

5. The aforesaid relaxation shall further be subject to the following conditions-

• (i) That appearing in the examination shall not confer any right on the candidate to consider his / her eligibility / selection in the examination till finalization of Common Seniority List of SSA Grade for SL-2003 (Extended) and subsequently the Select List of ASO Grade for 2013 onwards based on the final decision on the pending WPs and also on any other court case filed subsequently after final disposal of the WP by Delhi High Court.
• (ii) That final results of the examination(s) conducted by UPSC shall be declared subject to determination of final eligibility to appear in the examination after finalization of the Select List of ASOs for 2013, which will be finalized after the outcome of the decision on the pending WPs.
• (iii) That after the final outcome on the pending WPs, the Select List of ASO Grade for 2013 under seniority quota will be prepared and accordingly the officials who would have figured in the ASO SL-2013 and qualified SO/PS LDCE for 2018, their selection would be considered as valid.
• (iv) That the declaration of the results of the SO/PS LDCE for 2018 are also subject to final outcome of the SLP No. 30621/2011 and 31288/ 2017 pending before the Hon’ble Supreme Court of India regarding ‘reservation in promotion’ and ‘own merit case’.

6. This has the approval of competent authority in DoPT and concurrence of the UPSC.

UNDERTAKING

This is to Certify that I, Shri/Mrs/Ms. working In Ministry/ Department of and my name figures in the SSA Grade at S. No. of the Select List Year 2003 and 2003 [Extended] notified by Dept. of Personnel and Training vide O.M. No. 20/53/2008 CS.II(B) Vol.11 dated 16.12.2011 and O.M. No. 12/5/2015-CS.ll dated 02.11.2015. 1 understand that the issue of seniority of SSAs of 2003 (extended) is under challenge in WP Nos. 8616/2019 and 8454/2019 in the Hon’ble High Court of Delhi, where the Hon’ble Delhi High Court has directed to maintain status quo as granted by the Ld. CAT regarding non-alteration of the position of the petitioners as on date (23.12.2015). As per the above direction, the position of the SSAs belonging to SL- 2003 (Extended) notified on 02.11.2015 is required to be maintained as on 23.12.2015. As the Hon’ble High Court of Delhi has not yet delivered its final judgement on the issue raised by the applicants in OA No. 4700/2015 and 639/2016, preparation of Select List of ASO Grade for 2013 onwards are pending.

2. I do understand that pending finalisation of Select List of ASOs for 2013 onwards, the SO/Steno Limited Departmental Competition Examination for 2018 onwards has been held up. I do further understand that consequent upon representation from a large number of ASOs including those working as ad-hoc ASOs after promotion from SSA grade, the Government despite the above-mentioned litigations, has decided to conduct the LDCE for SO for 2018 by allowing all the SSAs belonging to Select List 2003 and Select List 2003 (Extended) to appear the SO/PS LDCE for 2018 purely on provisional basis subject to the following conditions:

• (i) That appearing in the examination shall not confer any right on the candidate to consider his/her eligibility/ selection in the examination till finalisation of Common Seniority List of SSA Grade for SL-2003 (Extended) and subsequently the Select Lists of ASO Grade for 2013 onwards based on the final decision on the WPs mentioned on para-1 above and also on any other court case filed subsequently after final disposal of the WP by Delhi High Court
• (ii) That final results of the examination(s) conducted by UPSC shall be declared subject to determination of final eligibility to appear in the examination after finalisation of the Select List of ASOs for 2013, which will be finalised after the outcome of the decision on the above WPs.
• (iii) That after the final outcome on the above-mentioned WPs, the Select List of ASO Grade for 2013 under seniority quota will be prepared and accordingly the officials who would have figured in the ASO SL-2013 and qualified SO/PS LDCE for 2018, their selection would be considered as valid.

Information Document on Grant of Non-functional Scale to Section Officers of CSS

Department of Personnel & Training has issued instructions from time to time regarding Grant of Non-functional Scale to Section Officers of Central Secretariat Service (CSS). The essence of these instructions has been summarized in the following paras for guidance and better understanding.

1. Introduction of Non Functional Scale of Rs. 8000- 275- 13500 (pre-revised) in Section Officers’ Grade of Central Secretariat Service (CSS):

On the basis of the recommendations of the Committee on Cadre Restructuring of Central Secretariat Service (CSS) set up in February, 2001 and acceptance of the same by the Government, the Section Officers of CSS were granted Non-Functional Scale in accordance with the following parameters:

• i. The Non Functional Scale of Rs.8000- 275- 13500 (pre-revised as per V CPC) is admissible to the Section Officers of CSS on completion of 4 years of approved service in the grade, subject to their vigilance clearance.
• ii. Though the notional pay fixation of the eligible officers will be done w.e.f. 01.01.1996, actual benefits will accrue to them w.e.f. 03.10.2003;
• iii. On account of such pay fixation, the officers would be entitled to draw arrears of pay w.e.f. 03.10.2003.
• iv. Section Officers of CSS, who are granted this Non Functional Scale of Rs.8000- 275 -13500 will continue to remain in Group ‘B’ (Gazetted) and their eligibility for promotion to Grade-I (Under Secretary) of CSS in the pay scale of Rs.10000- 15200 will be reckoned on the basis of total period of service spent in both the pay scales, viz. Rs.6500- 10500 and Rs.8000- 13500, counted together.
  v. Such officers who are placed in the above Non Functional Scale will be entitled to the benefit of pay fixation under F.R.22(I)(a)(2).

2. Applicability to Section Officers of CSS who have already completed 4 years of approved service in the grade as on 01.01.1996 or prior to this date:
The Section Officers of CSS who had completed approved service of 4 years or more in the grade on 01.01.1996 were eligible for being placed directly in the scale of Rs.8000-13500 in accordance with CCS (RP) Rules, 1997 notionally w.e.f. 01.01.1996. However, the actual financial benefits were to be paid only w.e.f 03.10.2003.

3. Fixation of pension of Officers retired during the period 01.01.1996 to 02.10.2003:
The matter was considered in consultation with the Department of Pension & Pensioners’ Welfare and Ministry of Finance (Department of Expenditure) and it was decided that:

• i. The pension of the pensioners (Section Officers/ Private Secretaries (Group ‘A’ & ‘B’ merged)/ Under Secretaries/ Principal Private Secretaries of CSS/CSSS) who had retired from CSS/CSSS during 01.01.1996 to 02.10.2003 and entitled for NFS would be fixed as per the upgraded scale notionally extended with effect from 01.01.1996. However, no arrears shall be paid for the period from 01.01.1996 to 02.10.2003 and the pension with reference to the higher revised pay scale shall actually be paid only with effect from 03.10.2003.
• ii. The average emoluments notionally drawn by a pensioner consequent on the above revision of pay scales of Section Officers/ Private Secretaries (Group ‘A’ & ‘B’ merged)/ Under Secretaries/ Principal Private Secretaries of CSS/CSSS will also be taken into account for the purpose of computation of pension subject, of course, to the condition that no arrears shall be paid for the period from 01.01.1996 to 02.10.2003 and the pension with reference to the higher average emoluments. shall actually be paid only with effect from 03.10.2003.
• iii. The benefits of gratuity, commutation of pension and leave encashment becoming payable during 01.01.1996 to 2.10.2003 will be based on the actual pay/pension drawn by the retired employee during that period.

4. Provisions in Central Secretariat Service (CSS) Rules, 2009.

With the notification of Central Civil Service (Revised Pay) Rules 2008 and Central Secretariat Service (CSS) Rules 2009, the grant of NFS to Section Officers of CSS is now governed by Rule 17 of CSS Rules 2009 read with Part-B, Section II of CCS (Revised Pay) Rules 2008.

5. Pay fixation on grant of non-functional scale to Section Officers of CSS subsequent to implementation of CCS (Revised Pay) Rules, 2008:

Earlier, the pay fixation upon grant of NFS to Section Officers of CSS was done under FR 22(I)(a)(2). After implementation of CCS (Revised Pay) Rules 2008, the pay of the Section Officers on grant of NFS shall be fixed w.e.f. 01.01.2006 under Rule 13 of CCS (Revised Pay) Rules, 2008 i.e. they should be granted one increment @ 3% of their basic pay plus the difference in grade pay (Rs.5400-Rs.4800=Rs.600).

5. Manner of fixation of pay upon grant of Non-Functional Scale to Section Officers of CSS:
Regular Section Officers who have completed 4 years approved service in the grade are granted NFS and their pay shall be fixed notionally w.e.f. the 1st July of the year in which they have completed the prescribed 4 years approved service with actual financial benefits w.e.f. the date of assumption of duty in the post of Section Officer, whether on ad-hoc or regular basis subject to Vigilance Clearance.

6. Fixation of pay upon grant of NFS to Section Officers of CSS under CCS (Revised Pay) Rules 2016 With the notification of CCS (Revised Pay) Rules 2016, the pay upon grant of NFS to Section Officers of CSS is being fixed currently under Rule 13 of CCS (Revised Pay) Rules 2016.

OFFICE MEMORANDUM

Subject: Grant of Non-Functional Scale to Section Officers of CSS – Clarification on fixation of pay – regarding.

The undersigned is directed to draw attention to this Department’s OMs of even number dated 01.04.2014 and 21.04.2014 governing grant of NFS to Section Officers of CSS and fixation of pay thereon.

2. It has been brought to the notice of this Department that in a few cases, actual benefit of pay on grant of NFS to Section Officers, who were appointed against SO SL 2015 from CSSS on the basis of the results of Section Officers/ Stenos (Gr.B/Gr.I) LDCE 2015 have allegedly been allowed w.e.f. 01.07.2019. The matter has been examined in consultation with Estt.(Pay) Division, DoPT. It is reiterated that in terms of FR 17(1), Section Officers of CSS cadre appointed to the aforesaid grade from CSSS cadre i.e. PS (Adhoc/regular), were not holding the post of Section Officer as on the date of grant of NFS i.e. 01.07.2019, but were officers of CSSS holding post of PA/PS (Adhoc). Hence, the actual financial benefit is not admissible to them from 01.07 2019 but is admissible only from the date of their assumption of the charge of the post of Section Officer on regular basis.

3. Ministries/ Departments/ offices concerned are requested to review all such cases where actual pay benefits upon grant of NFS to Section Officers appointed against SO SL 2015 from CSSS on the basis of the results of Section Officers/ Stenos (Gr.B/Gr.I) LOGE 2015 have been granted from 01.07.2019 and take immediate corrective action, if they are not in consonance with the existing instructions dated 01.04.2014 and 21.04.2014, under intimation to this Department.

Union Minister Dr Jitendra Singh hails DoPT for granting mass promotion to over 8,000 government employees in one go, the promotees belong to three key secretariat services

Dr Jitendra Singh thanked Prime Minister Shri Narendra Modi for this kind decision and said the secretariat services are an essential tool of governance

Union Minister of State (Independent Charge) Science & Technology; Minister of State (Independent Charge) Earth Sciences; MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh today announced the DoPT (Department of Personnel & Training) decision of granting mass promotion to over 8,000 government employees in one go. The promotees belong to three key secretariat services.

Dr Jitendra Singh said the orders for mass promotion of these employees belonging to the Central Secretariat Service (CSS), Central Secretariat Stenographers’ Service (CSSS) and Central Secretariat Clerical Service (CSCS) have been issued after several rounds of high-level meetings in DoPT chaired by him in the last two-months. The Minister said, even legal experts were consulted widely as some of the orders were subject to the outcome of pending writ petitions.

Dr Jitendra Singh said, it was disheartening to see government employees attaining retirement from service without getting one’s due promotion and thanked Prime Minister Shri Narendra Modi for this kind decision. Of the total of 8,089 promoted employees, 4,734 are from CSS, 2,966 from CSSS and 389 from CSCS.

Dr Jitendra Singh also met delegations of Central Secretariat officials on several occasions to thrash out the issue, as he considered that these three services – CSS, CSSS and CSCS form the backbone of the central secretariat administrative functioning.

Dr Jitendra Singh also recalled that over three years back, DoPT had carried out mass promotions of nearly 4,000 officials in different departments at different levels, which had been widely hailed. Many of these promotion orders were also issued, subject to the outcome of pending writ petitions, he recalled.

Dr Jitendra Singh said that the secretariat services are an essential tool of governance, since the notes and drafts prepared by them form the bedrock of Government policies as the proposals pass through various stages in the government hierarchy.
