<p>Subject: <strong>Exercise of Split Option under Saving Clause of FR-22(1)(a)(1) by officers of all grades of Central Secretariat Service (CSS) cadre</strong></p>



<p>The undersigned is directed to say that the matter relating to extending the benefit of “split-option’ available under Saving Clause of FR-22(1)(a)(1) to the serving officers of all grades of Central Secretariat Service (<a href="https://centralgovernmentnews.com/category/css/" target="_blank" rel="noreferrer noopener">CSS</a>) cadre promoted on adhoc basis was examined in this Department in consultation with Department of Expenditure.</p>



<ol class="wp-block-list" start="2"><li>According to above clause to FR-22(I)(a)(1), save in cases of appointment on deputation to an ex-cadre post, or to a post on an ‘adhoc basis’, the Government servant shall have the option, to be exercised within one month from the date of promotion or appointment, as the case may be, to have the pay fixed under the said rule from the date of such promotion or appointment or to have the pay fixed initially at the stage of the time scale of the new post above the pay in the lower grade or post from which he is promoted on ‘regular’ basis, which may be refixed in accordance with the said rule on the date of accrual of next increment in the scale of pay of the lower grade or post.</li><li>After giving due consideration to the special circumstances in which regular appointments could not be made in various grades of CSS Cadre for a long time and in the meanwhile many of the officers of CSS cadre were promoted on adhoc basis and are continuing as such without being reverted, it has been decided to relax one-time the condition of promotion/ appointment on regular’ basis and allow the option as laid down in saving clause below FR-22(I)(a)(1) in case of officers of CSS cadre promoted on adhoc basis subject to the following conditions:</li></ol>



<ul class="wp-block-list"><li>An undertaking may be obtained from each officer, who exercises option in terms of Saving Clause below FR-22(I)(a)(1) to the effect that in case, his name is not approved for regular appointment, he would be liable to refund the over payment, if any, on this account. No recovery will, however, be made in case of a person continuing on an adhoc basis, who retires before his case is considered for regular appointment; and</li><li>The relaxation will apply to those cases where an officer has continued on adhoc basis for more than a year without break.</li></ul>



<ol class="wp-block-list" start="4"><li>All Ministries/ Departments may decide the issue of allowing the benefit of ‘split-option’ as a one-time measure, to the eligible and willing officers of CSS cadre who were promoted on adhoc basis and are still in service as on the date of issue of this O.M. on a case to case to basis, in consultation with their Financial Advisers and subject to fulfillment of above conditions and other conditions prescribed under the Rules.</li><li>This issues with the concurrence of the Department of Expenditure vide their I.D Note No.03-10/ 2020-E-III(A) dated 23.07.2020.</li></ol>

<p>It has been reported by a Cadre Unit of CSS that an officer of CSS cadre has indulged in forgery of documents relating to his family details, LPC claims for medical reimbursement and education qualifications etc. The matter is under investigation.</p>
<p>2. Meanwhile, this has been viewed seriously by the competent authority in this Department and it is hereby requested to exercise caution while examining/ forwarding the document of officers for deputation etc. Due diligence may be adopted for verification of documents furnished by officers in service matters/sanction of claims etc.</p>
<p>3. The forwarding officers / controlling officers are, in particular, requested to verify the details furnished by the officers concerned and also to countersign all pages of the representation of officers before sending the same to DoPT.</p>

<p>Subject: <b>Abolition of 85% post falling vacant meant for direct recruitment in the grade of JSA(erstwhile LDC)-reg.<br />
</b><br />
In pursuance of DoP&amp;T’s O.M. No. 9/2/2003-CS-ll dated 20th April, 2005, it was decided to abolish 85% of the posts falling vacant on or after 03-10-2003 meant for direct recruitment quota in the grade of JSA (erstwhile LDC) of CSCS. The said decision was taken by the Cabinet after considering the recommendations of the report of First Cadre Restructuring of CSS.</p>
<p>2. However, it is observed that though a number of the cadre units have achieved the target of abolition of 85% of the posts falling vacant on or after 03-10-2003 meant for direct recruitment in the grade of JSA(erstwhile LDC) of CSCS every year. Some cadre units as shown in Annexure still have to achieve the target.</p>
<p>3. The Ministries/Departments shown in the Annexure are requested to take necessary action to abolish the remaining posts immediately and furnish a compliance report to DoP&amp;T by 13th May, 2016 along-with a copy of the Office Order of the number of posts abolished. The deadline may please be strictly adhered to.</p>

<p>3. All the Cadre Units of CSSS are requested to place the cases of the eligible PAs of CSSS who are covered within the ‘zone’ prescribed and who have not yet been included in the Select List of PS Grade of CSSS, before the Departmental Promotion Committee, to assess their fitness or otherwise for promotion to the PS Grade of CSSS. The recommendations of the Departmental Promotion Committee, along with vigilance clearance in respect of the eligible officer(s) concerned who are working in their cadres, including those who have been transferred from other cadres to their cadre, on their ad-hoc promotion to PS Grade of CSSS1 be furnished by the Cadre Units to this Department in the prescribed proforma (Annexure-1, II &amp; III).</p>
<p>&nbsp;</p>
<p>4. Cadre Units are also requested to furnish a list of officers, if any, figuring in the ‘zone’ who have already been promoted/debarred through earlier Select List(s), as in Annexure-I to Annexure -IV.</p>
<p>&nbsp;</p>
<p>5.<span style="text-decoration: underline;"> It may be ensured that data in respect of the officers are duly filled/ updated In the Web based Cadre Management. System of this Department before sending the DPC recommendation to this Department.</span></p>
<p>&nbsp;</p>
<p>6. This Department vide OM No. 25/28/2014-CS.lf(A) dated 22.07.2015 have issued revised Rotational Transfer Policy in respect of CSSS officers. The revised policy stipulates the following parameters for transfer on promotion:-</p>
<p>&nbsp;</p>
<blockquote class="tr_bq"><p>(i) Ministries/Departments are categorized into category A and category B for posting/transfer <b>(Annexure-Vll </b>&amp; VIII).</p>
<p>&nbsp;</p>
<p>(ii) In Group ‘A’, certain Ministries/Departments qualify for a reduced tenure by <i>one </i>year <b>(Annexure-lX</b><b>.</b><b>)</b></p>
<p>&nbsp;</p>
<p>(iii) An officer on transfer shall ordinarily be posted from Group ‘A’ <i>-&gt; </i>Group ‘B’ and Group</p>
<p>‘B’ <i>-&gt; </i>Group ‘A’, if they have completed the prescribed tenure. However, the officers presently posted in Group ‘A’ Ministries/ Departments may opt for posting in the same Group. In that case on posting to Ministry/ Department in Group ‘A’ the tenure will be counted afresh. However, this option will not be available to officers currently posted in Group ‘B’ to remain in Group ‘B.</p>
<p>&nbsp;</p>
<p>(iv) An officer who is to be transferred out from the current Ministry/ Department on completion of prescribed tenure may also be allowed option for posting in a Ministry/ Department where he earlier served subject to the condition that there is a gap of period which is equal to tenure prescribed for the post.</p>
<p>&nbsp;</p>
<p>(v) Certain Ministries qualify for concession in tenure for posting by one year;</p>
<p>&nbsp;</p>
<p>(vi) The policy provides a tenure of Eight years for PS grade in a particular Ministry/Department, including continuous tenure rendered in any other designation in the same Ministry/ Department;</p>
<p>&nbsp;</p>
<p>(vii) On promotion, an officer at any level shall be posted out of the Ministry/Department if</p>
<p>he/she has served in the same Ministry/Department in any capacity for a period exceeding the prescribed tenure for the promotion post;</p>
<p>&nbsp;</p>
<p>(viii) Officers who are due for superannuation within two years will be retained in the same Ministry/Department against an existing vacancy of the promotional post. In case of there being no vacancy of the promotional post then the officer will be transferred to another Ministry/Department;</p>
<p>&nbsp;</p>
<p>(ix) Officers who are due for superannuation within six months will not be transferred as in</p>
<p>such a short period one cannot be expected to continue usefully in another Ministry/Department. Further, such a transfer may result in delay of finalizing pension papers. Such as officer will be retained in the same Ministry/Department against an available vacancy of the promotional post. In the absence of a vacancy, the post held by him/her will be upgraded on personal basis by keeping one post in another Ministry/Department vacant so as not to exceed the cadre strength. On retirement the post will be revert to its original level;</p>

<p>(x) The Placement Committee will decide posting of officers on the basis of vacancy, seniority, preference, past postings etc.</p></blockquote>
<p>7. Officials are requested to submit their option in the prescribed proforma (Annexure-Vl). Cadre wise updated vacancy position will be uploaded shortly,</p>
<p>8. The above information be furnished to this Department in the prescribed proforma latest by <b>31.08.2015</b>.</p>

<p>Subject: <strong>Draft CSS Civil List, 2014 – Finalization thereof</strong></p>
<p>Draft Civil List of CSS for the year 2014 has been prepared and has been uploaded on the Department’s website (www.persmin.nic.in). The Civil List provides details of Under Secretary and above level officers of CSS as on 31.12.2014.</p>
<p>2. All Officers concerned are requested to verify their particulars in the draft Civil List and inform this Department of corrections, if any, required to be carried out in the list urgently and in any case latest by 22nd May, 2015. It may not be possible to entertain any request for corrections beyond this date as it is proposed to publish the Civil List at the earliest. Corrections should be informed to this Department only through E-mail: uscsl-dopt@nic.in</p>
