<h3 class="wp-block-heading">Subject:- Board level and below Board level posts including Non-unionised supervisors in Central Public Sector Enterprises (CPSEs) &#8211; Revision of scales of pay w.e.f. 01.01.2007 &#8211; Payment of IDA at revised rates-regarding.</h3>



<p>The undersigned is directed to refer to the para 6 and Annexure-II (B) of DPE’s OM dated 26.11.2008 wherein the rates of DA payable to the Board level and below Board level executives and non-unionized supervisors of CPSEs have been indicated. The rate of DA payable to the executives and non-unionized supervisors of CPSEs w.e.f <strong>01.04.2022 for 2007 pay scales is 185.3%.</strong></p>



<p><a href="https://centralgovernmentnews.com/30-rate-of-da-payable-to-the-executives-and-non-unionized-supervisors-of-cpses-w-e-f-01-04-2022-for-2017-pay-scales/" target="_blank" rel="noreferrer noopener">30% rate of DA payable to the executives and non-unionized supervisors of CPSEs w.e.f. 01.04.2022 for 2017 Pay Scales</a></p>



<p>2. The above rate of DA i.e. 185.3% would be applicable in the case of IDA employees who have been allowed revised pay scales (2007) as per DPE O.Ms. dated 26.11.2008, 09.02.2009 &amp; 02.04.2009.</p>



<p>3. All administrative Ministries/Departments of the Government of India are requested to bring the foregoing to the notice of the CPSEs under their administrative control for necessary action at their end.</p>



<p>4. This issues with the approval of the Competent Authority.</p>

<p style="text-align: right;">New Delhi, the 9th June, 2016</p>
<p>No. W-08/0005/2016-DPE (WC).—Recognizing that in the prevailing business environment in the country and in the world, the Central Public Sector Enterprises (CPSEs) have to be commercially viable and competitive, and that the employees of the CPSEs have to be provided with suitable working conditions, emoluments and incentives to motivate them to strive for further growth, productivity and profitability of their enterprises, the Government of India has decided to review and revise the existing structure of salary and emoluments of the CPSE executives.</p>
<p>2.1 The competent authority has decided to appoint the 3rd Pay Revision Committee (3rd PRC) comprising of the following:</p>
<p><strong>Chairman : Justice Satish Chandra (Retd)</strong><br />
<strong> Members : (i) Shri Jugal Mohapatra, Ex-IAS Officer</strong><br />
<strong> (ii) Prof. Manoj Panda, Director, Institute for Economic Growth, Delhi</strong><br />
<strong> (iii) Shri Shailendra Pal Singh, Ex Director (HR), NTPC Ltd.</strong><br />
<strong> Ex-Officio Member : Secretary, DPE, Government of India</strong><br />
<strong> Member Secretary : Jt. Secretary/Additional Secretary, DPE, Government of India</strong></p>
<p>2.2 The terms of reference of the Committee are follows:</p>
<p>2.2.1 The Committee will review the structure of pay scales, allowances, perquisites, and other benefits for the following categories in CPSE taking into account the salary, emoluments, incentives and other benefits (including non-monetary benefits) available to them and suggest changes which may be desirable, feasible and affordable:</p>
<p>(i) Board level functionaries<br />
(ii) Below board level executives<br />
(iii) Non-unionized supervisory staff</p>
<p>2.2.2 The Committee will make recommendations to enable CPSEs to become modern, professional, consumer friendly, commercially successful and competitive entities committed to national development goals and dedicated to the service of the people.</p>
<p>2.2.3 The Committee will devise a comprehensive pay package for categories of employees of CPSEs mentioned at sub-para 2.2.1 above that is suitably linked to promoting efficiency, productivity and profitability of CPSEs through rationalization of structures, systems and processes in the CPSEs with a view to leverage latest technology, management skills, global best practices, while ensuring accountability, responsibility, discipline and transparency in the operations and processes of these organizations.</p>
<p>2.2.4 While devising a suitable pay and compensation structure for the executives and the non-unionized supervisors of the CPSEs, the Committee will take into account the existing pattern of scales based on Industrial Dearness Allowance (IDA) and Central Dearness Allowance (CDA) pattern, wherever applicable, the prevalent categorization of CPSEs into ‘A’, ‘B’, ‘C’ and ‘D’ Schedule, the status of Maharatna, Navratna, Miniratna bestowed on the CPSEs, the overall condition of the loss/ marginal profit making CPSEs, and those CPSEs, which by the very nature of their business, are not-for-profit companies (registered under Section 25 of the Companies Act, 1956, or under Section 8 of the Companies Act, 2013).</p>
<p>2.2.5 The committee will make recommendations as would equip the CPSEs to compete in the emerging domestic and global economic scenario taking into consideration the special role of public sector, the demands and expectations of the stakeholders including the Government, the need to observe financial prudence in the management of CPSEs due to resource constraints, economic conditions, and the requirements of social and economic development in the country.</p>
<p>2.2.6 The Committee will examine the concerns of the CPSEs including the general principles, financial parameters and conditions which should govern the desirability, feasibility and continuation/modification of the Productivity Linked Incentives Scheme and Performance Related Payments.</p>
<p>2.2.7 While finalizing its report, the Committee will also take into account the report of the 7th Central Pay Commission.</p>
<p>3. The Committee may devise its own procedures as may be considered necessary for fulfilling the task assigned to it. Ministries and Departments of the Government of India and the State Governments will furnish such relevant information and documents as may be required by the Committee and which they are in a position and at liberty to give, and extend the necessary cooperation and assistance to it.</p>
<p>4. The Committee will make its recommendations to the Government within a period of six months from the date of its constitution and have its headquarters in Delhi.</p>
<p>5. The decision of the Government on the recommendations of the Committee will take effect from 1.1.2017.</p>
<p>6. The Committee will be serviced by the Department of Public Enterprises.</p>

<p>Subject : <strong>Re-classification/Upgradation of Cities/Towns on the basis of Census – 2011 for the purpose of grant of House Rent Allowance (HRA) for CPSE employees</strong></p>
<p>The undersigned is directed to refer to para ‘7’ of DPE OM dated 26.11.2008, para ‘2’(iii) of OM dated 02.04.2009 and DPE OM dated 07/01/2013 on the subject cited above.</p>
<p>2. Department of Expenditure, vide OM No. 2/5/2014-E.II(B) dated 21/07/2015, has re- classified the cities/towns on the basis of Census-2011 as “X”, “Y” and “Z” for the purpose of HRA as enumerated in the Annexure to this OM.</p>
<p>3. It has been decided that the re-classification of cities/towns on the basis of census 2011 for the purpose of grant of HRA as contained in the Department of Expenditure OM dated 21/07/2015 would also be implemented in the Central Public Sector Enterprises with effect from 1st April 2015.</p>
<p>4. These guidelines would be applicable to the employees of CPSEs who are on 2007 IDA pay scale and also to the employees on 6th CPC recommendation based CDA pay scales.</p>
<p>5. All the administrative Ministries/Departments of the Government of India are requested to bring the foregoing to the notice of the public sector enterprises under their administrative control for their information and necessary action.</p>
<p>6. This issues with the approval of Minister (HI &amp; PE).</p>

<p>The undersigned is directed to refer to this Department’s OM of even number dated 22nd February, 2010 (copy enclosed) wherein Ministries/Departments were instructed to discontinue the utilization of the infrastructure of any Central Public Sector Enterprises (CPSEs) by the officers/staff in the Government Departments.</p>

<p>The Ministries/Departments are directed to issue instructions to all concerned for not utilizing the infrastructure of any CPSEs by the officers/staff in the Government Departments and that any such use shall attract suitable action against them. If, for any exceptional circumstances, any officer, for a bonafide purpose related with official duties connected with the CPSE entrusted to him, is required to utilize the facility from a CPSE, the Secretary in the Ministry/Department will authorize such usage for specific period after careful assessment of the situation. The above guidelines shall also to be applicable to use of facilities from autonomous organizations under the Government.</p>

<p>Subject: &#8211; <strong>Payment of DA to the CDA pattern employees of 69 CPSEs governed by HPPC recommendations.</strong></p>
<p>The undersigned is directed to refer to Para No. 2 and Annexure-III to this Department&#8217;s O.M. dated 14.10.2008 wherein the rates of DA payable to the employees who are following CDA pattern pay scales had been indicated.</p>
<p>2. The DA payable to the employees may be enhanced from existing rate 90% to 100% with effect from 01.01.2014.</p>
<p>3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>
<p>4. These rates are applicable in the case of CDA employees whose pay have been revised with effect from 01.01.2006 as per DPE O.M. dated 14.10.2008.</p>
<p>5. All administrative Ministries/Department of Government of India are requested to bring the foregoing to the notice of the Central Public Sector Enterprises under their administrative control for action at their end.</p>

<strong>DPE Orders on DA to CPSE employees as per CDA Pattern governed by HPPC recommendations</strong> : Department of Public Enterprises declared revised rate of DA to the employees working under the Ministry of Industries and Public Enterprises with effect from 1.1.2013. The rate of DA enhanced from 72% to 80% to all CDA Employees, whose  pay have been revised with effect from 01.01.2006 as per DPE O.M. dated 14.10.2008.</p>

<p>The undersigned is directed to refer to Para 2 and Annexure-III of this Department’s O.M. of even<br />
No. dated 24.10.1997 wherein the rates of DA payable to the employees of CPSEs following CDA pattern pay scales, who are governed by HPPC recommendations had been indicated.</p>
<p>2. In continuation of this Department’s O.M of even number dated 25.10.2012, the rates of Dearness Allowance w.e.f. 01.01.2013 payable to the employees of CPSEs governed by the recommendations of HPPC, which have not revised their pay scales in terms of DPE O.M. No. 2(54)/2008-DPE (WC) dated 14.10.2008 may be as follows:</p>
<p>a) In case of CPSEs who have not allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees, the DA payable may be enhanced from the existing rate of 201% to 216%%.</p>
<p>b) In case of <a href="http://centralgovernmentnews.com/category/cpse/">CPSEs</a> who have allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees, the DA payable may be enhanced front the existing rate of 151% to 166%.</p>
<p>3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupees and the fractions of less than 50 paise may be ignored.</p>
<p>4. All the Administrative Ministries &amp; Departments of the Government of India are requested to bring the foregoing to time notice of the Public Sector Enterprises under their administrative control for action at their end.</p>

Subject :- <strong>Board level and below Board level posts including non-unionised supervisors in Central Public Sector Enterprises (CPSEs) &#8211; Revision of scales of pay w.e.f. 01.01.2007 &#8211; Payment of IDA at revised rates-regarding</strong>.</p>
<p>In modification of this Department’s O.M. of even No. dated 08.04.2013, the rate of DA payable to the executives and non-unionized supervisors of CPSEs (2007 pay revision) may be as follows:</p>
<p>(a) Date from which payable: 01.07.2013</p>
<p>(b) AICPI (2001 = 100) for the quarter<br />
March, 2013 224<br />
April, 2013 226<br />
May, 2013 228<br />
Average of the quarter 226</p>
<p>(c) Increase over link point: 99.67 points (226 &#8211; 126.33)</p>
<p>(d) Revised DA Rate: 78.9% [(99.67 ÷ 126.33) x 100]</p>
<p>2. The above rates of DA would be applicable in the case of IDA employees who have been allowed revised pay scales (2007) as per DPE O.M. dated 26.11.2008, 09.02.2009 &amp; 02.04.2009.</p>
<p>3. All administrative Ministries / Departments of the Government of India are requested to bring the foregoing to the notice of thc <a href="http://centralgovernmentnews.com/category/cpse/">CPSEs</a> under their administrative control for action at their end.</p>

<p>Subject: <strong>Role &amp; Responsibilities of non-official Directors on the Boards of Central Public Sector Enterprises (CPSEs)</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. of even number dated 28th December, 2012 circulating therewith copy of Model Role &amp; Responsibilities for non-official Directors appointed on the Boards of CPSEs.</p>
<p>2. This Department has received a number of references regarding para 8 of the role and functions of non-official Directors which deals with separate meeting of non-official Directors. After due examination and taking into account the fact that Companies Bill in the present form is yet to be passed by the Parliament, it has been decided to amend the provisions of para 8 of the role and functions of non-official Directors as under.</p>

attendance of Functional and Government<br />
Director and members of management;<br />
(2) All the non-official directors of the company<br />
shall strive to be present at such meeting;<br />
(3) The meeting shall:<br />
(a) review the performance of Functional and<br />
Government directors and <strong>the </strong>Board as a<br />
whole;<br />
(b) review the performance of the Chairperson<br />
of the company, taking into account the<br />
views of all the Directors.<br />
(c) assess the quality, quantity and timeliness<br />
of flow of information between the<br />
company management and Board that is<br />
necessary for the Board to effectively and<br />
reasonably perform their <strong>duties.</strong></td>
