<h3 class="wp-block-heading">Sub:- Comprehensive Transfer Policy guidelines for tenure posting in Railway Board, RDSO, etc. &#8211; simplification req.</h3>



<p>Transfer/posting of Railway officers is presently governed by the Comprehensive Transfer Policy for Railway Officers, issued vide Board’s letters No. E(O)III/2014/PL/05 dated 31.08.2015 and 12.12.2018 r/w letters of even number dated 25.10.2018, 30.11.2018 &amp; 17.12.2018.</p>



<p>2. After considering the issue to start the online Portal for inviting the applications for posting in Railway Board, RDSO and CTIs on tenure basis, it has been decided with the approval of the Competent Authority, to adopt the following procedure henceforth in this regard:-</p>



<ul class="wp-block-list">
<li>Applications for postings in Railway Board, RDSO and CTIs, will be submitted on HRMS portal through the link, named&nbsp;<strong>“</strong><em><strong>Willingness for Posting (Railway Board, RDSO, CTIs)”</strong></em>.</li>



<li>Willing officers will need to apply through his/her individual HRMS account.</li>



<li>As per the data available in HRMS regarding service/department and present grade of the officer, he/she will be considered for posts, he/she is eligible for.</li>



<li>The officer can apply at any time during the year and these applications will be valid for one year.</li>



<li>For filling up a post in Railway Board, RDSO and CTls, the process of selection will be initiated from amongst the list of willing officers available on HRMS, who have applied for transfer/posting through HRMS Portal. Further selection procedure will remain the same as existing on date.</li>



<li>Facility to withdraw applications is also available</li>
</ul>



<p>3. All other instructions, as contained in Board’s aforesaid letters dated 31.08.2015, 12.12.2018, 25.10.2018, 30.11.2018 and 17.12.2018, will remain unaltered.</p>



<p>4. These instructions will be applicable with immediate effect. All proposals for transfer/ posting, for which vacancy notices are yet to be issued, may be processed as per the revised procedure as mentioned above.</p>



<p>5. All Zonal Railways/ PUs are advised to circulate above instructions to all officers posted under their administrative control for information.</p>

<p> In terms of instructions issued by Department of Personnel &amp; Training (<strong><a href="https://centralgovernmentnews.com/latest-dopt-orders-2020/" target="_blank" rel="noreferrer noopener">DoPT</a></strong>) on transfer /posting of Government employees, all Ministries / Departments of Government of India are required to have their own guidelines for transfer/ posting of their employees providing for the following –</p>



<ol class="wp-block-list"><li><strong>minimum tenure;</strong></li><li><strong>have a mechanism akin to Civil Services Board for recommending transfer; and</strong></li></ol>



<p>Respective Ministries/ Departments are also required to place the transfer policy in public domain.</p>



<p> There is no proposal to formulate a single transfer policy for the Government employees, as guidelines for transfer/ posting of employees depend on the specific requirement of individual Ministries/ Departments. Moreover, the State Public Services are under State List for which the State Governments are competent to make rules and policies. Accordingly, there is no proposal to constitute any Commission for single transfer policy for both Central &amp; State Government employees.</p>

<p>Reference above, in para (a) of Railway Board’s letter No.E(Rep.) I-2006/Transfer/ Misc./1 dated 25.08.2008, it has been clearly mentioned that, “<strong>minimum service condition will not be applied in case of Request Transfers of <a href="https://centralgovernmentnews.com/tag/compassionate-appointment/" target="_blank" rel="noreferrer noopener">Compassionate Appointees</a></strong>”.</p>



<p>Regrettably, the said condition was not included in Railway Board supra dated 10.02.2017.</p>



<p>Board are, therefore, requested to circulate afresh Comprehensive Transfer Policy, duly including above cited condition.</p>

<p>Federation brings to the kind notice of the Railway Board (CRB) that NFIR&#8217;s PNM Agenda Item No. 18/2016 relating to relaxation of service condition of minimum five years service in the case of re-employed Defence Forces Personnel seeking inter Railway transfer on request has been pending since the last three years. During NFIR&#8217;s PNM meeting held with the Railway Board on 25/26-04-2019, the Official Side conveyed through Action Taken Statement as under:-</p>

<p>&#8220;The matter is presently under consideration. Feedback has been called for, from all the Zonal Railways. Responses from some of them are still awaited.&#8221;</p>



<p>Federation feels sad to state that though a period of over six months passed, progress made into the matter is yet to be conveyed.</p>



<p>In this connection, Federation also brings to the notice of the Board (CRB) that the NFIR General Secretary held discussions at the level of CRB more than once (last discussions held on 22/11/2018), when the CRB gave assurance that the relaxation has been processed and the final orders would be issued very shortly, but unfortunately relaxation decision has not been issued so far.</p>



<p>May I once again seek the intervention of CRB to kindly see that order issued granted relaxation to five years service condition in favour of former Defence Personnel re-employed in Railways, facilitating their inter Railway transfer requests soon.</p>

<p>Sub: <strong>Comprehensive transfer policy &#8211; exemption from 5 years service condition &#8211; reg.</strong></p>
<p>Ref: (i) NFIR&#8217;s PNM Item No. 18/2016 and ATS given to Federation on 13th November, 2017.</p>
<p>(ii) Railway Board&#8217;s letter No. E(NG)I-2005/TR/20 dated 10/02/2017.</p>
<p>(iii) NFIR&#8217;s letter No. II/14/Part VII dated 21′ Feb, 2017, 23/02/2017 and 12/04/2017.</p>
<p>(iv) NFIR&#8217;s letter No. II/14/Part VIII dated 15/05/2017.</p>
<p>Kind attention of the Railway Board is invited to NFIR&#8217;s PNM Item No. 18/2016 on the subject and Board&#8217;s letter dated 10/02/2017 wherein relaxation in five years service condition has been granted in certain situations.</p>
<p>Consequent to receipt of representations from the Defence Forces Personnel re-employed in Railways and the widows/widowers appointed on compassionate ground seeking relaxation of five years minimum service condition, Federation vide letters cited under reference had approached the Hon&#8217;ble MR and sought approval for exemption from 5 years service condition to enable those re-employed ex-servicemen and widows/widowers to seek inter railway transfer to join their families and look after children. Thereafter a period of more than six months has passed this genuine demand has not been favourably considered. It is also sad to note that negative stand has been taken by Board while conveying &#8220;ATS&#8221; to the Federation without discussing the PNM Item. Attention is also invited to the General Manager (E), Western Railway&#8217;s letter No. EP/1140/0 Vol. IV dated 02/08/2017 to Railway Board on the subject.</p>
<p>NFIR once again urges upon the Railway Board to kindly review extant instructions and issue revised instructions for exempting 5 years minimum service condition for entertaining inter railway transfer requests of ex-servicemen re-employed in Railways and also the widows/widowers/wards of Railway employees appointed on compassionate ground. Federation also proposes that a separate meeting be convened at the level of &#8220;Member Staff&#8221; to discuss this PNM Item.</p>

<p>At the outset, NFIR thanks the Railway Ministry for granting exemption from 5 years minimum service condition to consider the request transfers in the following situations vide Railway Board&#8217;s letter dated 10/02/2016.</p>
<p>(a) Transfers sought on mutual exchange basis,</p>
<p>(b) Transfers sought on spouse ground,</p>
<p>(c) Railway servants who are care-givers to a disabled child and</p>
<p>(d) Physically handicapped Railway servants.</p>
<p>The Federation brings to your kind notice that the Defence Forces Personnel after having served for safeguarding the Nation&#8217;s Borders for decades, have retired and thereafter they are being recruited through Railway Recruitment Boards/Railway Recruitment Cells in the Railways. These Personnel during their service in the Defence Forces were far away from their families for decades. After recruitment in Railwals also, they are away from their family members and children due to their postings at different places. Consequently, they are facing lot of hardships in managing two establishments. Their case therefore, deserves to be considered by<br />
relaxing 5 years minimum service condition, so that they can seek transfer nearer to their place of residence and can peacefully perform their duties while leading family life.</p>
<p>NFIR, therefore, requests the Hon&#8217;ble MR to kindly accord approval for relaxing minimum 5 years service condition in the case of former Defence Forces Personnel re-employed in Railways also to enable them to go on transfer nearer to their places and join their families. A copy of Federation&#8217;s letter dated 21st Feb 2017 on the subject, already sent to Railway Board is also enclosed.</p>
