Subject: Scheme for compassionate appointment – Other Policy Decisions.

The undersigned is directed to refer to the subject cited above and to state that the following decisions relating to appointment on compassionate appointment ground in Department of Telecommunications has been taken, which are mentioned below:-

i) The following offices of Department of Telecommunications are grouped for the purposes of processing of compassionate appointment applications/cases, as mentioned underneath:-

• In case of pending cases in Block 2 that are awaiting appointment only due to non-availability of vacancies (vacancy means 5% of Direct Recruitment in Group ‘C’ vacancies for the year), then Block 3 will be approached (through O/o CGCA Hqrs) and the case may be considered based on relative merit score and availability of vacancies in CCA units.
• In case of unfilled vacancy on compassionate ground in a particular year (ending on 31st December of the year) due to unavailability of eligible candidates, CGCA/WMO shall report such vacancy to DoT HQ.

ii). Cut-off date/validity period may be regulated as follows: –

• Applications to be considered: Application for compassionate appointment received upto 31st December for appointment cycle in respect of death-in-harness or retirement on medical grounds of Government servant upto 31st December for appointment cycle may be considered in the cycle beginning on 1st January of the subsequent year.
• Validity of application – DoPT instructions regarding the same may be followed; as on date the instructions of DoPT provides for considering the applications for compassionate appointments without any time limit.
• Calculation of vacancies – Cumulative unfilled vacancies upto 31st December for appointment cycle beginning on 1st January of the subsequent year may be included.

2. Relative Merit Point Scheme issued vide OM of even no. dated 01 July, 2022 shall be followed by all DoT units.

Subject: Scheme for compassionate appointment – Review of Relative Merit Points and Procedure for selection.

Madam/Sir,

Letter No.17-4/2018-SPG-II dated 28.09.2020 providing for Revised Relative Merit Points System (RMPS) and procedure for compassionate appointments in the Department of Posts may please be referred to. The matter has been reviewed keeping in view the references received from various stakeholders including Circles and instructions contained in DOP&T OM No.43019/9/2019-Estt.(D) dated 23.08.2021.

2. The Relative Merit Points for assigning weightage to various attributes of the applicants for compassionate appointment have been reviewed. The revised RMP is based on 100 points of 10 variables with provision of additional 15 maximum bonus points for the applicant if she is the widow of the deceased employee/wife of an employee who has retired on medical grounds. The new RMPS is given in Annexure.

3. Cutoff date for working out the indigency of the dependent family of the deceased employee: Date of death or date of retirement on medical grounds will be considered as cutoff date for the purpose of assessing the indigent condition of the applicant under RMPS for compassionate appointment.

4. Cases to be considered by CRC: All the cases of death/retirement on medical grounds which occur till 31st December will be considered alongwith cases ‘referred by previous CRC for consideration by next CRC’. For example. CRC scheduled in 2022 (for vacancy year 2021), will consider all cases of death/retirement on medical grounds till 31st Dec 2021 along with ‘referred cases of previous CRC of vacancy year 2020’.

The CRC for vacancies of different years will be conducted separately in a manner that CRC for earliest year is conducted first and CRC for latest year is conducted last.

5. Rejection of case: Each case should be considered three times continuously in a row and if a case is not recommended in third consideration depending upon RMPS of the case, the CRC which is considering the case third time, shall reject the case. Past applications which were not categorically rejected by previous CRCs and have not been considered 3 times by CRCs, shall be considered again (till completion of 3 times consideration) where CRC shall categorically recommend any of the remarks:

• (a) Recommended for appointment on compassionate grounds
• (b) Not recommended for appointment due to paucity of vacancies in current year. To be considered by next CRC
• (c) Rejected

Once an application has been recommended for rejection by the CRC and recommendation accepted by the competent authority which, after due consideration of all facts and circumstances of the case, did not find merit in the case, the candidature of the applicant shall not be considered again except under explicit direction of the court or discovery of new facts or material which was either not in the knowledge of the applicant or the applicant was prevented to produce the same on account of some sufficient cause

6. Recommendations as ‘Trainee’: The recommendations related to ‘Trainee’ should be restricted to Multi Tasking Staff cadre only.

7. Age of case: The time gap between date of death/retirement on medical grounds and date of application shall be taken as ‘age of the case’. In case, there is no dependent family members eligible to apply for compassionate appointment solely on the grounds of age (all dependents being minor), time gap between the date on which any dependent becomes major (irrespective of fact whether the same dependent is the applicant or not) and date of application shall be taken as ‘age of the case’. This will have no link with date of meeting of CRC or vacancy years against which the application is being considered. This formula shall be applied only for calculation of RMP for immediate relief.

8. Belated cases: Currently, cases which are more than 5 years old, are termed as belated case. The time gap of 5 years will be continued to categorize a case as belated case. This 5 year period will be counted strictly from the date of death/retirement on medical grounds upto the date of application irrespective of all dependents being minor at the time of death/retirement on medical grounds of the employee.

9. Missing person cases: In case of missing person, application will be accepted only after two years of date of report of missing of official as mentioned in FIR. All the condition related to compassionate appointment to dependent of missing official as prescribed by DOP&T should be ensured.

10. Circle specific vacancy: The vacancies to be utilized by a Circle for compassionate appointment in a year should not be more than 5% of the vacancies in Direct Recruitment Quota in Group C Posts in a year. The Circles will utilize 100% quota earmarked for appointment on compassionate grounds of a vacancy year. In case no eligible candidate is available, the left over vacancies will be added to DR vacancies of next year. The vacancies arising in PAOs, Civil/Electrical wing shall also be taken into consideration.

11. Crucial date of eligibility: Crucial date for age limit and educational qualification shall be the date of application. In case, any applicant upgrades his/her educational qualification, he/she will be free to continue with old educational qualification or to withdraw old application and submit application afresh with revised educational qualification. If the applicant withdraws old application and submit application afresh with revised educational qualification, the various parameters applicable with regard to date of application for considering compassionate appointment will be applied as on date of fresh application. If an applicant has crossed maximum age limit prescribed for a post to which he is being considered for appointment on compassionate grounds, as on the date of application, age relaxation will be required in the case. The lower age limit should, however, in no case be relaxed below 18 years of age as on the date of application.

12. Place of Posting: As far as administratively feasible, applicant appointed on compassionate grounds will be posted at a place as per preference indicated or near his/her home town or in same division in which the applicant is residing, subject to availability of vacancies.

13. CRC meeting schedule: In all cases of death/retirement on medical grounds upto 31st December, cutoff date for receipt of application shall be 31st January of the following year for consideration of application for the CRC meeting scheduled during April of the following year. For example, for deaths/retirements on medical grounds upto 31st December, 2021 and receipt of application upto 31st January 2022, CRC should consider such cases against vacancy year of 2021 in its meeting which shall be scheduled during April, 2022. In case no application is submitted by dependents of the deceased/retired on medical grounds employee, a letter from the dependent family members stating reasons for non-submission of application or report from Divisional Head (in case family refuse to give such letter) shall be placed before the CRC.

14. Date of effect of these guidelines: These revised guidelines will be applicable with immediate effect and all the CRC meets after issue of this OM shall follow the revised guidelines.

15. Instructions issued by DoPT from time to time related to compassionate appointment will continue to be guiding factor while deciding the cases.

16. This issues with the approval of Competent Authority.

Sub: Deaths due to COVID-19 : Request for relaxation in compassionate appointment – reg

My Federation repeatedly requesting the Department to follow Ministry of Health instructions while opening and operating the offices during COVID -19 pandemic. It is the most unfortunate that no circles are following the MOH advisories. This failure to follow advisories resulted in infection of a few Officials of the department. Out of which one is succumbed.

In the instant case one of our officials namely Abdul Haasan had attended duty at Kolkatta Foreign post on 30/3/2020 and 01/04/2020. He was admitted in RG Kar Medical College and Hospital Kolkatta on 14/04/2020 with high fever and breathing problem. In the course of treatment as inpatient, our official Abul Haasan expired on 18/04/2020. According to our information dead body of our staff, was not handed over to the family, it was buried by the State Government authorities. Subsequently, Abul Haasan family members have been sent to quarantine by the state government authorities. This is the most unfortunate, in this connection circle unions both FNPO & NFPE jointly met CPMG and submitted a detailed letter requesting protection to the staff from COVID-19 infection. It is also requested to observe MOH advisory on the subject during the course of employment during the period of this pandemic. The Circle unions have also requested the CPMG to cause compassionate appointments to the family member of the demised official by relaxing the prevailing rules.

Further to submit that the undersigned appraised off the details of the case to Member (P) on 20.04.2020 via whats app and the Member (P) has conveyed the deepest condolences.

This incident of death is in the course of the employment exposing to the deadly Virus. This death is most unfortunate and resulted due to extraordinary conditions. The official is succumbed while rendering the essential service in view of this my federation requests the Chairman Postal Services Board kindly take up the issue with DOP&T to cause relaxation to, in extending the benefit of Compassionate appointments to the deceased family members, wherein the death due to COVID-19. In other words the norms for compassionate appointments may not be observed for the cases of death due to the pandemic.

With high hope, my federation is suggesting this for kind consideration and speedy action.

Sub: Scheme for compassionate appointment – Relative merit points and revised procedure for selection.

The undersigned is directed to say that the Department of Personnel & Training under the Ministry of Personnel, Public Grievances and Pensions is the nodal department for Government of India’s Scheme for Compassionate Appointments. While considering requests for compassionate appointment, a balanced and objective assessment of financial condition of the families of the applicants has to be made taking into account the assets and liabilities and other relevant factors. The main object of the Scheme is to alleviate the family of the deceased government servant/member of the Armed Forces from indigence and help it get over the emergency. Accordingly, vide Ministry of Defence I.D. No.271/93/D(Lab) dated 2.11.93, Ministry of Defence had developed a 100-point weightage system containing various parameters/attributes to decide the most deserving cases amongst the large number of applicants. The weightage system was revised in 2001 vide Ministry of Defence ID No. 19(4)/824-99/1998-D(Lab) dated 9.3.2001. Consequent upon implementation of the 6th CPC Report, parameters of all these attributes were further revised in 2010 vide MoD note No.19(3)/2009/D(Lab) dated 22.1.2010 and 14.5.2010. Presently, the attributes on 100-point scale are – Quantum of Family Pension (20 points); Terminal Benefits (10 points); Monthly income of family from other sources (05 points); Movable/immovable property held by the family (10 points); No. of dependents (15 points), No. of unmarried daughters (15 points); No. of minor children (15 points) and Left over service (10 points). As per the practice, compassionate appointment is given to the highest score earner.

2. Now, consequent. upon implementation of the 7th CPC pay structure, the financial parameters are required to be revised again. Certain organisations/ formations under Ministry of Defence have been requesting for revision of relative merit points and procedure for selecting the most indigent applicant(s) for compassionate appointment after death/medically boarding- out of the Government servant/member of the Armed Forces on whose income the family was wholly dependent.

3. As per 7th CPC structure, the minimum pension stands revised from if 3,500 pm. (as per 6th CPC) to 1 9,000 p.m. which approximately comes out to be 2.57 times the old pension. The Govt. of India have also approved this factor of 2.57 for working oUt revised pay, based on which DCRG, Family Pension and Leave encashment are calculated. Accordingly, the monetary parameters/attributes such as Family Pension, Terminal Benefits, Monthly income of earning member(s) and income from property and latest market value of the Movable/Immovable property have been revised by the multiplying the fitment factor of 2.57 or so, for arriving at the present-day weightage points. However, other non-monetary parameters/attributes viz. No. of Dependents, No. of Unmarried Daughters, No. of Minor Children and Leftover Service have been kept unchanged.

4. Accordingly, with the approval of the competent authority, various parameters on the loo-point scale of weightage system stand revised as under with immediate effect:-

(a) Basic Family Pension 1 Monthly Amount received under National Pension System

(20 points)

(b) Lump sum amount received by the family on death of Govt. servant (i.e. DCR Gratuity, GPF/PPF A/c balance, Leave Encashment, CGEGIS, LIC/PLI etc.) Lump sum Amount received under NPS etc.

(10 points)

(c) Annual income from movable/immovable property as well as Annual income earned by other member(s) of the family

(05 points)

(d) Movable/immovable property of the family (Latest Market Value) including Fixed Deposit/Bank balance etc. but excluding the lump sum amount received as mentioned in (b) above

(10 points)

(e) No. of dependents

(15 points)

(f) No. of unmarried daughters

(15 points)

(g) No. of minor children

(15 points)

(h) Left over service

(10 points)

(Total 100 points)

5. The revised guidelines will take place with immediate effect. However, cases already considered by the Boards of Officers constituted for considering requests for compassionate appointment as per the previous guidelines need not be re-opened.

6. However, for considering belated requests for compassionate appointment where the death/disablement of Govt. servant/member of Armed Forces took place long ago, weightage points towards ‘Terminal Benefits’ may be awarded in the following manner:-

(a) For cases where death of the deceased Govt. servant occurred prior to 9.3.2001, parameters of ‘Terminal Benefits’ given in MoD ID note dated 2.11.1993 will be applicable;

(b) For cases where death of the deceased Govt. servant occurred on or after 9.3.2001 till 21.1.2010, parameters of ‘Terminal Benefits’ given in MoD ID note dated 9.3.2001 will be applicable; and

(c) For cases where death of the deceased Govt. servant occurred on or after 22.1.2010 till 31.12.2015, parameters of ‘Terminal Benefits’ given in MoD ID note dated 22.1.2010 will be applicable.

7. All the concerned are advised to strictly follow these weightage points and guidelines keeping in view the instructions issued by the DoP&T/MoD, from time to time for assessing comparative merit of the applicants for compassionate appointment.
