<p>Sub: <strong>Payment of Night Duty Allowance at revised rates to Civilian Employees working in the establishments under the MoD.</strong></p>



<p>Several references have been received from sub-offices regarding whether NDA will be calculated on the basis of Pay of 6th CPC or on 7th CPC. The matter has been referred to HQrs office.</p>



<p>In this context, please find enclosed a copy of HQrs office letter No. AT/Army-BR/A/Civ /2366/NDA/Vol-1 dated 19.05.2020 regarding payment of Night Duty Allowance at revised rates to Civilian Employees working in the establishments under the MoD for guidance and further necessary action in the matter.</p>



<p>HQrs office cited under reference states that “in absence of revised order on the subject post-implementation of 7th CPC, it seems appropriate to admit NDA claims on the basis of extend orders on the subject until any revised orders received.”</p>



<p>Accordingly competent authority has decided that Night Duty Allowance claims should be admitted in audit on the basis of basic pay of the individual as per 6th CPC i.e pay of an individual as on 31.12.2015.</p>



<p>Further, it is requested to advice unit authorities to take up the matter with MoD through their administrative channel for obtaining clarification on this subject as instructed by the HQrs office.</p>

<p>Night Duty Allowance was recommended vide para 8.17.71-77 of 7th CPC report and accepted by Govt. of India vide Resolution No. 11-1/2016-IC dated 6th July, 2017. However, no orders, that might have been issued by Ministry of Finance for implementation of the same, have been received through MoD till date in this regard.</p>



<p>In the absence of revised order on the subject post-implementation of <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">7th CPC</a></strong>, it seems appropriate to admit NDA claims on the basis of extant orders on the subject until any revised orders are received. Also, unit authorities can be advised to take up the matter with MoD through their administrative channel for obtaining clarification on this subject.</p>

<p><strong>HOLD PROTEST DEMONSTRATIONS IN FRONT OF ALL CENTRAL GOVERNMENT OFFICES.</strong></p>



<p>The Central Government has announced deregulation and privatisation of core and strategic sectors like Defence production, Space Research, Power, Civil aviation, Coal and mineral sectors. It is also declared by the Finance Minister that non – strategic public sector undertakings will also be privatised. Govt is implementing its political agenda by going ahead with the naked and unbridled pro – corporate reforms in all sectors of the economy utilizing the <strong><a rel="noreferrer noopener" href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank">COVID -19</a></strong> crisis. It is wholesale privatisation. Combined with these reforms , serious attempt is made for amending all labour laws in favour of employers. Already some state Governments had promulgated ordinances in this direction suspending all labour laws and increased the working hours from eight to twelve hours per day. The Government has cleverly linked these reforms with the 20 lakhs crore economic package announced by the Prime Minister , eventhough these reforms have nothing to do with the stimulus packages and relief measures to be provided to the agricultural and industrial sectors and common people of our country. Needless to say that these pro – corporate reform measures and labour law amendments will severely affect the life and livelihood of crores of workers and common people of our country. Central Government employees are no exception.</p>

<p>Regarding Defence sector , the Defence employees federations were already opposing the move of the Government to corporatise and privatise the Ordnance factories. They have conducted month &#8211; long relay dharma at Parliament street, New Delhi and five days all India strike . Government had earlier deferred the Corporatisation move due to stiff resistance from five lakhs defence employees. Knowing the present limitations of the unions to organise serious agitational programmes like strike during Covid &#8211; 19 restrictions , the Government has unilaterally declared the corporatisation of Ordnance Factory Board ( OFB). Raising the Foreign Direct Investment (FDI) in <a rel="noreferrer noopener" href="https://centralgovernmentnews.com/category/defence/" target="_blank">defence</a> sector from 49 to 74% will pave way for entry of multinational foreign Corporations in defence production sector , which , in the long run will jeopardise the national security of our country and job security of the employees.</p>



<p>In the coming days , more attacks are to come in almost all sectors including Central Government Employees sector. Already many departments have initiated action in this regard as per the advice of NITI Ayog. Closure of Government of India printing presses, outsourcing of Government functions in many departments , large scale contractorisation , casual labour engagement and downsizing has become the order of the day. Central Government Employees, especially Confederation of Central Govt Employees and Workers had organised series of struggle programmes against these onslaughts , including strike.</p>

<p>The Central Trade Unions have unanimously decided to combat these onslaughts of the Government by all possible means. As a first phase , it is decided to organise NATIONWIDE PROTEST DAY ON 22nd MAY 2020. Confederation being an integral part of the mainstream of the working class of .India, has endorsed the call of the Central Trade Unions.</p>



<p>Accordingly , the National Secretariat of Confederation of Central Govt. Employees and Workers calls upon all affiliated organisations and state /District level Coordinating Committees (COCs) to hold protest demonstrations in front of all Central Government offices , strictly observing the Covid – 19 restrictions imposed by Central and State Governments. Minimum permitted number of employees and leaders may sit in front of offices holding placards with demands , with all precautionary measures like masks , social distancing etc. Wide publicity may be given to the programme through print / electronic media and social media.</p>

<p>Subject: <strong>Payment of Productivity Linked Bonus to Civilian Employees of Defence Production Establishments for the year 2017-18.</strong></p>
<p>Madam Sir,</p>
<p>I am directed to refer to this Ministry&#8217;s letter No.48(4)/98/D(B&amp;C) dated 27 July, 2000 on the above subject and to convey the sanction of the President to payment of Productivity Linked Bonus for the year 2017-18 equivalent to 40 days wages to the eligible employees in Defence Production Establishments as mentioned therein with an overall ceiling of wages of Rs.7000/- per month. PLB is to be calculated taking average number of days per month as 30.4 days.</p>
<p>02. The casual labour who has worked for at least 240 days, in each year, for 03 years or more, will be eligible for this PLB payment. The amount will be paid on a notional monthly wages or Rs.1200/-. In case where the actual emoluments fall below Rs.1200/- per month, the amount will be calculated on actual monthly emoluments. All payments under these orders will be rounded off to the nearest rupee.</p>
<p>03.The above sanction is subject to the following condition:-</p>
<p>(a) OFB will submit a monthly status report on the progress achieved to review the formula for calculation of PLB which otherwise would have been reviewed after three years from implementation ie from the accounting year 1999-2000.</p>
<p>(b) GMs of each of the respective factories should submit the Certificate regarding standard man-hour for jobs whenever there is a change in production processes or when new labour saving machines are introduced, incorporating the following details :-</p>
<blockquote><p>(i) Standard Man Hours before the installation of CNC Machines.</p>
<p>(ii) Standard Man Hours after the installation of CNC Machines.</p>
<p>(iii) Difference between the above two leading to savings in Standard Man Hours.</p></blockquote>
<p>In the event of more than one CNC Machine being installed on two different occasions each time figures are to be updated for additional subsequent addition of CNC Machine.</p>
<p>04. The expenditure will be debited to Major Head 2079 of the Defence Service Estimates (Ordnance Factories) and to the respective Heads to which the pay and allowances of employees of allied establishment: are debited.</p>
<p>05. This issues with the concurrence of Ministry of Finance and MoD (Finance Division) vide their Dy. No. 361 dated 15/10/2018.</p>

<p>Sir,</p>
<div>I am directed to refer to the Productivity Linked Bonus Scheme already circulated vide this Ministry’s letter No.F.24(8)/80/D(JCM) dated 28th September, 1983, as amended from time to time, and to convey the sanction of President to the payment of 28 days (Twenty Eight days) wages in cash as PLB for the year 2014-15 to the eligible civilian employees of the EME</div>

<div>2. The entitlement has been worked out on the basis of the working results for the year 2014-15 in accordance with the agreed formula.</div>
<div></div>
<div>3. The PLB shall be paid to all eligible Gp. &#8216;B&#8217; (Non-Gazetted), Gp. &#8216;C&#8217; and Gp. &#8216;D&#8217; civilian employees of the EME who are covered under PLB Scheme for the accounting year 2014-15. The calculation ceiling of Rs.3500/- (3500&#215;32/30.4) and other terms and conditions of the PLB Scheme will remain unchanged.</div>

<div>4. Productivity Linked Bonus to the casual labour will be paid at the assumed wages of Rs.1200/- p.m. (1200&#215;32/30.4) for the accounting year 2014-15. However, in cases where the actual wages fall below Rs.1200/- pm, the amount will be calculated on the actual monthly wages. The other conditions remain unchanged.</div>

<div>5. The expenditure on this account will be debitable to Defence Services Estimates under respective Heads to which the pay and allowances of these employees are debited. The entire expenditure on the payment of PLB is to be met out of the sanctioned budget grant for the year 2015-16.</div>

<div>6. This issues with the concurrence of the Ministry of Finance (Department of Expenditure) vide their ID. No. 176998/E.111.A dated 15.9.2015 and MoD (Fin/AG/PB) vide their Dy. No. 141/AG/PB dated 18.9.2015.</div>

<p><strong>UPLOADING OF COURT VERDICT REGARDING PAYMENT OF HRA TO CIVILIAN EMPLOYEES OF DGQA</strong></p>
<p>1. Payment of HRA to DGQA Civ employees is governed SRO 1 E as amended bySRO-31. Recently, some DGQA employees obtained order from Hon&#8217;ble CAT, Kolkata Bench in their favour for payment of HRA without requirement of NAC. However Hon&#8217;ble High Court of Karnataka and Hon&#8217;ble Madhya Pradesh High Court have given judgments on the similar issue in favour of the department.</p>
<p>2. In view of the above, it is felt that uploading of following High Court judgments on DGQAweb site would enable wider dissemination and necessary action, if required by all establishments of DGQA and avoid replying to individual enquiries of units:-</p>
