<p class="has-text-align-center"><strong><span style="text-decoration: underline;">CHARTER OF DEMANDS</span></strong></p>



<p>1) To implement the recommendation of Kamalesh Chandra Committee that GDS employees should be granted 2 annual additional increments on completion of 12, 24,36 years of service.</p>



<p>2) To implement one Lakh Rupees annual Health insurance scheme to GDS employees and family members.</p>



<p>3) To implement the recommendation of Kamalesh Chandra Committee to allow accumulation of 180 days leave and to pay cash equalent to the leave at credit at the time of discharge.</p>



<p>4) To permit GDS employees to engage substitutes in emergency leave. and to grant TRCA for such substitute by the Department.</p>



<p>5) To issue ID cards to all GDS employees as ordered vide Directorate No.17-31/2016-GDS Dtd 17.10.2018.</p>



<p>6) To bring to effect Order No.17-1/2017-GDS Dtd 30.05.2017 of DOP Item No. 3(d).ftem No.8(b.c), Item No. 13(b, d) regarding dependents engagement. correctly.</p>



<p>7) While notifying GDS vacancies, the posts is to be filled up on request transfer may be considered first and then only the other vaccancies notified.</p>



<p>8) Non considering rejected GDS compassionate appointment cases by many Circles even after instructions by Directorate. Consider all cases in time bound manner.</p>



<p>9) Severance amount should be paid minimum of Rupees 1,50,000.00 to all GDS who opted for SDBS and discharged or died.</p>



<p>Dear Collegues,</p>



<p>Kamalesh Chandra committee recommendations are brought to effect from 2018 July. Even on lapse of 32 months, the Department of Post has not come forward to settle the legitimate demands, by implementing very important recommendations.</p>



<p>Though several discussions were conducted with the Department by the NUGDS and the Federation, no progress is seen. Peaceful discussions did not give any fruitful result which has lead us to move with agitation programmes. It is decided to conduct one day’s opposition Dharna in front of all Circle offices all over India on 24.03.2021.</p>



<p>All Circles are requested to make the programme a grand success. Detailed instructions connected with the programme will be given shortly.</p>

<h3 class="has-text-align-center wp-block-heading"><strong>REVISED CHARTER OF DEMANDS</strong></h3>

<p>1. Scrap New Contributory Pension Scheme (NPS). Restore old defined benefit Pension Scheme (OPS) to all employees. Guarantee 50% of the last pay drawn as minimum pension.</p>



<p>2. (a) Scrap the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules 1972. Stop terrorizing and victimizing employees.</p>



<p>(b) Withdraw the attack against the recognised status of Associations and Federations.</p>



<p>(c) Withdraw the anti-worker Wage/Labour codes and other anti-labour reforms.</p>



<p>(d) Stop attack on trade union rights.</p>



<p>3. (a) <a href="https://centralgovernmentnews.com/freezing-of-dearness-allowance-to-central-government-employees-and-dearness-relief-to-central-government-pensioners-at-current-rates-till-july-2021/" target="_blank" rel="noreferrer noopener">Withdraw the orders freezing the DA and DR of employees and Pensioners</a> and impounding of arrears till 30.0-.2021.</p>



<p>(b) Implement five year wage revision and Pension revision to Central Government employees and Pensioners. Appoint 8th Central Pay Commission and revise the Pay, Allowances and Pensionary benefits of Central Government employees and Pensioners with effect from 01-01-2021.</p>



<p>(c) Honour the assurance given by Group of Ministers (GoM) to NJCA leaders on 30-06-2016. Increase minimum pay and fitment formula recommended by 7th CPC. Grant HRA arrears from 01-01-2016.</p>



<p>(d) Withdraw “Very Good” bench mark for MACP, grant promotional heirachy and date of effect of <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACP </a>from 01-01-2006.</p>

<p>4. Stop ban on creation of new posts. Fill up all seven lakhs vacant posts in Central Government departments in time bound manner. Scrap National Recruitment Agency and introduce Department wise recruitment and Regional recruitment for Group B and C posts. Stop re-engaging retire personnel in Central Govt. services.</p>



<p>5. Stop Corporatisation and privatisation of Railways, Defence and Postal Departments. Withdraw closure/ merger orders of Govt. of India Printing Presses and Postal Stores depots/ Postal Stamp depots. Stop proposed move to close down salt department. Stop outsourcing and closure of Govt. establishments.</p>

<p>6. (a) Regularisation of Gramin Dak Sevaks and grant of Civil Servants status. Implement remaining positive recommendations of Kamalesh Chandra Committee Report.</p>



<p>(b) Regularise all casual and contract workers including those joined service on or after 01-09-1993.</p>



<p>7. Settle all Covid-9 related issues pertaining to Central Govt. employees and Pensioners on top priority basis. Treat the period of absence during lock down as duty. Grant full wages to casual, part-time, contingent contract workers during the lockdown period.</p>



<p>8. Grant equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.</p>



<p>9. Implement 7th CPC wage revision and pension revision to remaining Autonomous body employees and pensioners. Ensure payment of full arrears without further delay. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.</p>



<p>10. Remove arbitrary 5% ceiling imposed on compassionate appointments. Grant appointment in all eligible cases.</p>



<p>11. Grant five time-bound promotions to Group B &amp; C employees. Complete cadre review in all departments in a time bound manner.</p>



<p>12. Ensure prompt functioning of various negotiating forums under the JCM Scheme at all levels.</p>

<h4 class="wp-block-heading">DECISION OF THE NATIONAL SECRETARIAT MEETING HELD ON 28.06.2020</h4>



<p>The National Secretariat Meeting of Confederation of Central Government Employees &amp; Workers was held on 28.06.2020 through Video Conference. Com. Ravindran B. Nair presided. About 21 office bearers attended. Senior leaders Com. K. K. N. Kutty and M. Krishnan were present.</p>



<p>Before Commencement of the meeting, one minutes silence was observed paying homage to the Jawans who were martyred on the India-China border and also to the departed leaders.</p>



<p>Com. R. N. Parashar, Secretary General, presented a brief report on the agenda items and also about the activities taken place during the period after the Nagpur national Conference. Thereafter the agenda items were taken for discussion. Detailed discussion took place on all agenda items. Many other issues faced by the Central Government Employees, especially COVID-19 related issues, were also discussed.</p>

<p>The following decisions are taken.</p>



<h4 class="wp-block-heading">Review of the 26th National Conference held at Nagpur</h4>



<p>The Conference was well organised and the arrangements made were excellent. About 36 affiliates and 13 state level COCs attended. 213 delegates and 13 visitors attended (Male &#8211; 238, Female-18). The Conference was jointly inaugurated by Com. Tapan Sen (General Secretary, CITU) and Com. Amarjeet Kaur (General Secretary, AITUC). The National Secretariat congratulated the COC, Vidarbha Region, Nagpur under the leadership of Com. Nilesh D. Nasare, for making best arrangements for the successful conducting of the meeting.</p>



<h4 class="wp-block-heading">Setting up of a committee for finalisation of Accounts for the period from 2016 to 2019.</h4>



<p>Secretary General reported that the Accounts for the period from 2016 April to 2019 March could not be presented in the national Conference, as the then Financial Secretary, Com. Vrigu Bhattacharjee, had not attended the Conference. Com. Vrigu Bhattacharjee has emailed the Receipt and Expenditute statements for the period from 2016 to 2019 to the then President. Com. K. K. N. Kutty on 7th February 2020. As it was not signed by the Financial Secretary nor it was audited, the Conference decided to appoint a committee of incoming office bearers and outgoing President and Secretary General. The Conference further decided that after finalisation of the accounts, it should be audited by the internal auditor of Confederation and presented before the National Council for adoption. Com. R. N. Parashar, Secretary General, reported that he had written to Com. Vrigu Bhattacharjee, Ex-Financial Secretary to hand over the accounts alongwith all connected documents to him. But no reply was received. He has also contacted Com Vrigu Bhattacharjee over phone and requested to hand over the accounts. But, Com. Vrigu Bhattachajee was reluctant to hand over the accounts to the newly elected Secretary General. The issue was discussed at length in the National Secretariat and following decisions are taken.</p>



<ul class="wp-block-list"><li>Secretary General, Confederation, shall write another letter to Com. Vrigu Bhattacharjee, Ex-Financial Secretary, to handover the accounts from the period from April 2016 to January 2020 along with all connected records, citing the decision of the national Secretariat held on 28.06.2020.</li><li>If Com. Vrigu Bhatacharjee, Ex-Financial Secretary, still refuse to handover the Accounts to the Secretary General, then the Secretary General Shall circulate the skeleton of Accounts sent by Com. Vrigu Bhattacharjee to Ex-President on 07.02.2020, which is not signed by the Financial Secretary nor it is audited, to all National Executive Committee members to verify whether there is any discrepancies in the accounts. After getting reply from national Executive Committee members, the accounts will be finalised by a Committee of following office bearers, for presentation in the next National Executive Committee meeting to be convened by Video Conference.</li></ul>

<h4 class="wp-block-heading">Financial review and strengthening of funds position</h4>



<p>After detailed discussion it is decided that the Secretary General and Financial Secretary shall issue notice to all affiliates and COCs directing them to remit up to date quota and to clear all arrears of quota and dues within one month. The Financial position will be further reviewed in the next national Executive meeting to be held before 15.08.2020.</p>



<h4 class="wp-block-heading">Freezing of DA and DR and other related issues.</h4>



<h4 class="wp-block-heading">Charter of demands of Confederation.</h4>



<p>Both the above agenda items were discussed together. It is decided that protest programmes should be organised, exclusively on Central Govt. Employees demands, by Confederation. In the revised Charter of demands adopted by the Nagpur National Conference, the following demands are to be added.</p>



<ul class="wp-block-list"><li>Withdraw the orders, freezing the DA and impounding of arrears of Central Govt. Employees &amp; Pensioners till June 30th 2021.</li><li>Stop the unjustified increasing of prices of Petrol and diesel. Reduce the price by reducing the excise duty by Central Government.</li><li>Settle all <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">COVID-19</a></strong> related issues pertaining to the Central Govt. Employees (detailed note will be attached). Treat the period of absence during lockdown as duty. Grant wages to casual, part-time, contingent and contract workers including daily-rated mazdoors, during the lock-down period. (It is reported that in Tamilandu Postal Circle no wages are paid during lockdown period to Casual/ Contract workers inspite of Finance Ministry &amp; DOP orders.)</li></ul>



<p>Secretary General and President is authorised to re-draft the Charter of demands and Circulate among all National Secretariat member for approval before publishing in website. The date of the protest programme is to be decided by President and Secretary General, preferably in the 3rd or 4th Week of July 2020. Next phase of programme will be decided by the National Executive Committee meeting to be held before 15.08.2020.</p>

<h4 class="wp-block-heading">Organizational Review</h4>



<p>The National Secretariat felt that the disruptive activities initiated by the Ex-Financial Secretary has not affected the overall functioning of Confederation. Efforts are to be made to sort out the issues and to bring back the misguided comrades and to further strengthen the functioning of all affiliated organisations and COCs. It is decided that indiscipline and anti-organisational activities from any corner should not be compromised or tolerated.</p>



<h4 class="wp-block-heading">Date of next National Executive Committee meeting</h4>



<p>The meeting authorised President and Secretary General to fix and notify the date of next National Executive meeting by not later than 15.08.2020.</p>



<h4 class="wp-block-heading">Central Trade Unions Programme on 03.07.2020</h4>



<p>The meeting decided to organise the protest programme against the anti-people and anti-worker policies of the Central Government at all important Centres on 03.07.2020. The Central TUs has included the DA freeze and impounding of arrears as one of the main demands. All affiliates and COCs are requested to ensure participation of Central Govt. Employees in the joint protest programmes of Central Trade Unions.</p>



<p>It is decided to prepare a detailed note on the present situation and the issues faced by the Central Govt. Employees for wide circulation among Central Govt. Employees through Websites and Social media. Com. K. K. N. Kutty, Vice President will prepare the draft.</p>

<h1 style="text-align: center;"><strong>CHARTER OF DEMANDS</strong></h1>
<p>1. Scrap New Contributory Pension Scheme (NPS). Restore old defined benefit pension scheme (OPS) to all employees.</p>
<p>2. Settle 7th CPC related issues including increase in Minimum Pay and Fitment formula, HRA arrears from 01-01-2016, MACP Bench Mark, promotional hierarchy and date of effect of MACP from 01-01-2006. Implement Option-1 for pensioners and settle all anomalies arising out of implementation of 7th CPC recommendations.</p>
<p>3. Fill up all vacant posts. Reintroduce Regional Recruitment for Group B &amp; C posts. Withdraw orders for abolishing posts lying vacant for more than five years. Revive all posts abolished during 2001 to 2008 under Annual Direct Recruitment Plan (ADR) as per May 2001 orders of the former NDA Government.</p>
<p>4. (a) Regularisation of Gramin Dak Sevaks and grant of Civil Servant Status. Implement remaining positive recommendations of Kamlesh Chandra Committee report.<br />
(b) Regularise all casual and contract workers including those appointed on or after 01-09-1993.</p>
<p>5. Ensure equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.</p>
<p>6. Stop closure of Government establishments and outsourcing of Government functions. Withdraw closure orders of Govt. of India Printing Presses. Stop proposed move to close down salt department. Stop Foreign Direct Investment (FDI) in Railways and Defence departments.</p>
<p>7. Implement 7th CPC Wage revision and pension revision of Autonomous body employees and pensioners. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.</p>
<p>8. Remove 5% condition imposed on compassionate appointments and grant appointment in all deserving cases. Rejected cases for want of 5% quota vacancies may be reviewed and appointment to dependents may be granted.</p>
<p>9. Grant five time bound promotions to all Group C &amp; B employees on completion of 8,7,6,5 and 4 years of service respectively. Complete Cadre Reviews in all departments within a time frame.</p>
<p>10. (a) Stop attack on trade union rights. Ensure prompt functioning of various negotiating forums under JCM scheme at all levels.<br />
(b) Withdraw the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972</p>

<p>Sir,</p>
<p>As you are aware non-implementation of positive and basic recommendations of Kamlesh Chandra committee on G.D.S Employees viz., implementation with effect from 01st of January 2016, gratuity Revision, SDBS/pension, 30 days paid leave, Enhancement of composite allowance, financial up gradation on completion of 12, 24 and 36 years of service etc. has generated resentment and discontentment among the G.D.S employees. It is pertinent to mention here that although discussions were held at Directorate, I am sorry to state that no progress is observed so far on any of the issues. Under the circumstances we are compelled to observe three phase fast Programme of agitation.</p>
<p>The above three GDS Unions, JCA decided the following countrywide agitational programme to settle the charter of demands.</p>
<p><strong>Agitational programmes:</strong></p>
<p>25-09-2018 : One day country wide hunger fast in front of Divisional Offices<br />
04-10-2018 : One day country wide hunger fast in front of Circle Offices.<br />
10-10-2018 : One day massive hunger fast in New Delhi.</p>
<p><strong>CHARTER OF DEMANDS</strong></p>
<p>1) GDS committee report as a whole be implemented with effect from 01st of January 2016.</p>
<p>2) Change the formula already adopted for calculation of arrears.</p>
<p>3) Change of upper limit of gratuity from Rs 1,50,000/- to Rs 5,00,000/-</p>
<p>(a) GIS limit should be enhanced to Rs.5,00,000 with the subscription of Rs.500/-</p>
<p>4) 10% of the TRCA of the GDS should be recovered towards SDBS contribution and the Government to contribute equal share.</p>
<p>(a) And also EPF Scheme to be introduced to GDS as recommended by the GDS Committee. This was also recommended by the previous GDS Committees.</p>
<p>5) GDS should be granted 30days paid leave in a year and the leave should be allowed to be carry forward subjected to the maximum of 180 days and provide encashment of the leave.</p>
<p>6) Grant Children Education allowance Rs.6000/- per child per Annum.</p>
<p>7) Enhance composite allowance to the BPMs from Rs500/- to Rs 1600/- Also grant composite allowance to ABPMs &amp; GDS working in classified cities and the GDS working in Departmental Offices etc., wherever applicable.</p>
<p>8) GDS employees should be granted financial up gradation on completion of 12, 24 and 36 years of service in the form of grant of additional increments.</p>
<p>(a) Point to point fixation to be ordered instead of bunching of TRCA scales.</p>
<p>9) Limited transfer facility to GDS on request should be relaxed. There shall not be any drop in wage scale on account of a request transfer. The transfer of GDS will be approved by Divisional head if the transfer is within the Division, by regional PMG if it is within the region by HOC if the transfer is within the Circle.</p>
<p>10) Voluntary discharge schemes for the GDSs: 3 types of voluntary discharge schemes as recommended by GDS committee for the GDSs’ who are willing to quit the post before the discharge at the age of 65 years should be implemented.</p>
<p>11) All discharge benefits (retirement benefits) should be implemented retrospectively, w.e.f 01 January 2016.</p>
<p>12) Put off duty may be averted by transferring the GDS to another place.</p>
<p>13) Incentive system should be abolished for India post payment bank (IPPB) work. Enhance the working hours of branch post office and GDS officials concerned after introducing the IPPB.</p>
<p>14) GDSs&#8217; should be allowed to get discharge from the service on the last day of the month in which He/She attains the 65 years of the age.</p>
<p>15) All single handed branch post offices should be provided with one more hand to upgrade to double handed office.</p>
<p>16) Employees&#8217; state Insurance ( ESI) facility to be extended to Grameen Dak Sevaks wherever E.S.I dispensaries and hospitals are available the country.</p>

<p>Today I met the Cabinet Secretary(Government of India) and shown oru anguish for inordinate delay in finalzation of demands of the Central Government Employees, particularly National Pension System (NPS), Minimum Wage and Fitment Formula.</p>
<p>The Cabinet Secretary said that, he is aware of the problems of the Staff Side(JCM) raised by them from time to time and particularly to this issue and will definitely try to resolve them</p>
<p>Particularly on the issue of National Pension System(NPS) he said that the issue active consideration of the Government of India and we are trying to find out some solution to the problems arisen because of the NPS.</p>
<p>I also persuaded him to fix-up date of the meeting of the National Council(JCM), to which he said that, the agenda came, and some queries have been raised, which are still to be compiled by the DoP&amp;T. He assured that, he will definitely fix-up the date of the meeting within a short period, and said that, before that, he will ask the Secretary(DoP&amp;T) to hold meeting with the Staff Side.</p>
<p>I told to the Cabinet Secretary that, Central Government Employees are agitated because they feel that VII CPC has not done and justice with them and government is also ready to remove the issues pending before them.</p>

										<content:encoded><![CDATA[<h3>7th CPC related issues &#8211; Review of agitational programmes organised by Confederation and the present position of the various demands raised in the charter of demands &#8211; Future course of action.</h3>
<p>The National Secretariat reviewed various agitational programmes independently organised by Confederation viz: Massive Parliament March on 15-12-2016, one day nationwide strike on 16-03-2017, Mass Dharna organised in front of Finance Minister’s Office on 23-05-2017, Human Chain of Central Govt. employees on 22-06-2017 and Burning of the HRA orders on 25-07-2017. It is reported by all National Secretariat members that the employees and pensioners had participated in large number in all the above programmes.</p>
<p>The Government has already implemented Revised Pay Scales, Revised Allowances and Revised Pension based on 5th CPC recommended parity formula for pre-2016 pensioners. The assurances given by Group of Ministers on 30-06-2016 regarding increase in Minimum Pay and Fitment formula still remains unimplemented. Govt. has not considered the demand to restore HRA rate to 30%, 20% and 10% and implement it from 01-01-2016. All revised allowances are implemented prospectively from 01-07-2017 thereby denying arrears from 01-01-2016. The Option-I parity for pensioners recommended by 7th CPC is rejected by the Government, instead 5th CPC recommended parity is extended to all pre-2016 pensioners. The &#8220;very good&#8221; bench mark condition imposed for grant of MACP is not yet modified. Even though NPS Committee constituted by Govt. for streamlining NPS has submitted its report to Government, its recommendations are still not made public. The demand for withdrawal of Contributory Pension Scheme and guaranteeing minimum pension (50% of the last pay drawn) is still pending. All other demands raised in the confederation and NJCA charter of demands are also remaining unsettled.</p>
<p>Unfortunately, inspite of the totally negative attitude and non-honouring of the assurance given to NJCA by the BJP-led NDA Government, the dominant leadership of NJCA is not in favour of reviving the deferred indefinite strike and no serious agitational programmes was organised after 6th July 2016 (i.e. after deferring the strike) under the united banner of NJCA, which compelled the Confederation to demarcate and organise independent struggle programmes as mentioned above including one day nation-wide strike.</p>
<p>The National Secretariat meeting took note of the above situation and decided to request once again the Railway Federations which are leading the NJCA as Chairman (NFIR) and Convenor (AIRF) to chalk out serious agitational programmes including strike under the banner of NJCA. Confederation National Secretariat strongly felt that to make the Govt. to honour its assurance on Minimum Pay and Fitment formula, to grant enhanced rate of HRA from 01-01-2016, to get Option-I parity implemented for pre-2016 pensioners, to modify the retrograde bench mark condition for MACP, to scrap NPS and ensure guaranteed minimum pension, to settle the justified demands of Gramin Dak Sevaks and Casual, Contract Workers, a united indefinite strike under the banner of NJCA (Railway, Defence &amp; Confederation) is the need of the hour.</p>
<p>In the absence of a united struggle under the banner of NJCA, the Confederation National Secretariat decided to organise the following agitational programmes in a phased manner.</p>
<p style="color: #339;"><strong>1. Mass dharna at all District headquarters demanding settlement of modified charter of demands of Confederation on 19th September 2017 (Tuesday).</strong></p>
<p><strong> 2. Mass dharna at all state capitals on 17th October, 2017 (Tuesday).</strong></p>
<p><strong> 3. Three days massive relay dharna in front of Parliament from 9th November to 11th November 2017 along with Central Trade Unions.</strong></p>
<p><strong> 4. Indefinite strike in 2018 jointly along with Central Trade Unions. (Date will be finalised by the Central Trade Unions and independent Federations including Confederation).</strong></p>
<p>All affiliated organisations and COCs are requested to make the above programmes a grand success. As the NDA Government is aggressively implementing the neo-liberal policies in all sectors, it is our responsibility to join hands with the entire trade unions and unitedly resist the onslaught. If the Govt. is not ready to change its destructive policies, the workers have no option but to embark upon a prolonged struggle jointly with the suffering common people of our country, to change the Government. It is in this background Confederation National Secretariat decided to join with the 3 days mass dharna at New Delhi and indefinite strike. In the meantime, if NJCA meets and take decisions for any agitational programmes, confederation shall implement the programmes of NJCA also. Modified charter of demands of the Confederation is also enclosed herewith.</p>
<p><strong>3.2017 June 10th National Convention of Central and State Govt. Employees (Confederation and All India State Government Employees Federation) on &#8220;NPS &amp; Outsourcing&#8221; &#8211; Review and implementation of the decisions taken by the National Convention.</strong></p>
<p>The National Secretariat decided to implement the following decisions of the 2017 June 10th National Convention on &#8220;NPS &amp; Out sourcing&#8221; jointly organised by Confederation and AISGEF. Confederation C-O-Cs should contact the AISGEF leaders of their respective states and chalk out detailed plan for implementing the decisions. Large scale participation of employees on behalf of Confederation should be ensured in all the programmes:</p>
<p>1.State level joint conventions by 31-08-2017 (date may be extended if required).</p>
<p>2.District /Taluk level joint conventions before 31-10-2017.</p>
<p>3.Mass Joint dharna at all important Centres including State Capitals on 21-11-2017 (21st November 2917 Tuesday).</p>
<p>4.Raj Bhavan March (Date will be finalised later).</p>
<p>5.Nationwide campaign Jatthas covering all states. (Dates to be finalised later)</p>
<p>6.Massive Parliament March (date to be finalised later).</p>
<p style="color: #f36;"><strong>4. (a) WFTU-TUI meeting at Kolkata on 2017 October 9th &amp; 10th and (b) Asia Pacific Regional meet and World Secretariat meeting of Trade Union International (TUI) Public Services at Thiruvananthapuram on 2017 September 11th &amp; 12th.</strong></p>
<blockquote><p>(a) Meeting of a team of WFTU Secretariat led by Com. George Mavrikos, General Secretary and all TUIs (Trade Union Internationals) Presidents/General Secretaries will be held at Kolkatta on 2017 October 9th &amp; 10th .</p>
<p>(b) Asia-Pacific Regional meet and World Secretariat meeting of TUI (Public Services) will be held at Thiruvananthapuram on 2017 September 11th (TUI meet) and September 12th (Secretariat meeting).</p></blockquote>
<p>The Total expenditure for the above two meet is to be borne by the organisations which are affiliated to WFTU- TUIs from India. Confederation’s share amount is fixed as Rs.300000/- (3 Lakhs). After detailed discussion the National Secretariat decided that each affiliates of the confederation shall donate share amount as shown below.</p>

<p style="color: #f36;"><strong>5. National Convention of workers held on 8th August 2017 at New Delhi-Implementation of decisions.</strong></p>
<p>All the Central Trade Unions and Independent Federations (other than BMS) had Organised a massive National convention of workers on 8th August 2017 at Talkatora Stadium New Delhi against the anti-Labour and anti-people polices of NDA Govt. Confederation being a part of this convention, National Secretariat meeting unanimously decided to implement the following programmes decided by the National convention of workers.</p>
<blockquote><p>(a) To Work for achieving and accelerating united struggles in all sectors of the economy on respective demands, which has already begun.</p>
<p>(b) To organise Block/District/Industrial Centres/States level massive campaign mobilisation and convention in preperation to Central mobilisation to be followed.</p>
<p>(c) Massive three days dharna at National Capital on 9th, 10th, &amp; 11th November 2017 to be attended by lakhs of workers from all over the country.</p>
<p>(d) To prepare for indefinite countrywide strike action against the anti-people, anti-worker and anti-national policies of the NDA Government.</p></blockquote>
<p>The following Central Trade Unions have participated in the Convention in addition to independent federations of various sectors including Confederation.</p>
<p>INTUC, AITUC, HMS, CITU, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF.</p>
<p>The National Secretariat decided that charter of demands adopted by the National convention of workers will be part-I charter of demands and confederation charter of demands will be part-II charter of demands for campaign and mobilisation of Central Government employees and also for the proposed indefinite strike.</p>
<p style="color: #f36;"><strong>6.All India Women’s Trade Union Workshop-2017</strong></p>
<p>The National Secretariat decided to organise &#8220;All India Women’s Trade Union Workshop-2017&#8221; in the month of November/December 2017. C-O-C Maharashtra (Mumbai) is requested to discuss and inform their readiness to hold the workshop at Mumbai as there is larger concentration of women employees in Mumbai. In order to reduce the financial burden of the Reception Committee it is decided that delegate fee will be Rs.1000/- (Rs. One thousand only) per head. As the train reservation commences four months before, the decision of the C-O-C Mumbai should be communicated to the CHQ before 21-08-2017. On confirming the place only quota to each organisation and C-O-Cs etc. are to be fixed. The C-O-C Mumbai is requested to communicate their decision immediately.</p>
<p style="color: #f36;"><strong>7. Holding of a special convention/meeting of Autonomous body employees organisations and Autonomous body pensioners organistions.</strong></p>
<p>The National Secretariat discussed the situation arising out of abnormal delay in revision of pay of Autonomous body employees and also non-issuing of orders for revision of pension of autonomous body pensioners by the concerned Autonomous bodies/Administrative Ministries. In the case of Autonomous body employees, eventhough the Finance Ministry has issued orders extending the 7th CPC pay scales to autonomous body employees on 13-01-2017, the orders are not implemented in 95% of the autonomous bodies due to the stringent conditions imposed by the Finance Ministry. In the case of Autonomous body pensioners, the stand taken by Finance Ministry and Pension Ministry is that they will not issue any orders for revision of pension or grant of Dearness Relief to Autonomous body pensioners. Earlier during 5th CPC and 6th also they have not issued any separate orders, Once Govt. issues orders for revision of pension and grant of dearness relief to Central Govt. Pensioners, it is upto the autonomous bodies to issue orders based on that orders, in consultation with their Administrative Ministries. But no Administrative Ministry has taken action for revision of pension and grant of dearness relief to Autonomous body pensioners. In short a serious crisis has developed regarding revision of pay scales of Autonomous body employees and Revision of Pension and grant of dearness relief to Autonomous body pensioners.</p>
<p>In the view of the above it is decided to convene a special meeting of all Autonomous body employees organisations and Autonomous body pensioners organisations to discuss and decide future course of action. Date and venue of the meeting will finalised shortly.</p>
<p style="color: #f36;"><strong>8. Problems of affiliated organisations of confederation.</strong></p>
<p>Issues relating to the following departments are discussed and suitable decisions taken.</p>

<h3 align="center">CHARTER OF DEMANDS</h3>
<p>1.Honour the assurance given by the Group of Ministers to NJCA on 30th June 2016 and 6th July 2016, especially increase in minimum wage and fitment factor. Grant revised HRA at the rate of 30%, 20% and 10% with effect from 01-01-2016. Settle all anomalies arising out of implementation of 7th CPC recommendations, in a time bound manner.</p>
<p>2.Implement option-I recommended by 7th CPC regarding parity in pension of pre-2016 pensioners.</p>
<p>3. Scrap PFRDA Act and Contributory Pension Scheme and grant pension and Family Pension to all Central Government employees recruited after 01.01.2004, under CCS (Pension) Rules 1972.</p>
<p>4.Treat GraminDakSewaks of Postal department as Civil Servants, and extend all benefits like pay, pension, allowances etc. of departmental employees to GDS.</p>
<p>5.Regularise all casual, contract, part-time, contingent and Daily rated mazdoors and grant equal pay and other benefits.</p>
<p>6.No Downsizing, Privatisation, outsourcing and contractorisation of Government functions.</p>
<p>7.Withdraw the arbitrary decision of the Government to enhance the bench mark for performance appraisal for promotion and financial upgradations under MACP from &#8220;GOOD&#8221; to VERY GOOD&#8221; and also decision to withhold annual increments in the case of those employees who are not able to meet the bench march either for MACP or for regular promotion within the first 20 years of service. Grant MACP pay fixation benefits on promotional hierarchy and not on pay-level hierarchy. Personnel promoted on the basis of examination should be treated as fresh entrants to the cadre for grant of MACP.</p>
<p>8. Withdraw the draconian FR 56 (J) and Rule 48 of CCs (Pension) Rules 1972 which is being misused as a short cut as purity measure to punish and victimize the employees.</p>
<p>9. Fill up all vacant posts including promotional posts in a time bound manner. Lift ban on creation of posts. Undertake cadre Review to assess the requirement of employees and their cadre prospects. Modify recruitment rules of Group-‘C’ cadre and make recruitment on Reginal basis.</p>
<p>10. Remove 5% ceiling on compassionate appointments and grant appointment in all deserving cases.</p>
<p>11. Grant five promotions in the service carreer to all Central Govt. employees.</p>
<p>12.Abolish and upgrade all Lower Division Clerks to Upper Division Clerks.</p>
<p>13.Ensure parity in pay for all stenographers, Assistants, Ministerial Staff in subordinate offices and in all organized Accounts cadres with Central Secretariat staff by upgrading their pay scales. Grant pay scale of Drivers in LokSabha Secretariat to Drivers working in all other Central Government Departments.</p>
<p>14.Reject the stipulation of 7th CPC to reduce the salary to 80% for the second year of Child Care leave and retain the existing provision.</p>
<p>15.Introduce Productivity Linked bonus in all department and continue the existing bi-lateral agreement on PLB wherever it exists.</p>
<p>16.Ensure cashless, hassle free medical treatment to all Central Government employees &amp; Pensioners in all recognized Government and Private hospitals.</p>
<p>17. Revision of Overtime Allowance (OTA) and Night Duty Allowance (NDA) w.e.f 01.01.2016 based on 7th CPC pay scale.</p>
<p>18.Revision of wages of Central Government employees in every five years.</p>
<p>19.Revive JCM functioning at all levels. Grant recognition to the unions/Associations under CCS (RSA) Rules 1993 within a time frame to facilitate effective JCM functioning.</p>
<p>20.Implementation of the Revised Pay structure in respect of employees and pensioners of autonomous bodies consequent on implementation of CCS (Revised Pay) Rules 2016 and Revised Pension Rules in respect of Central Government employees and pensioners.</p>
<p>21.Implementation of the &#8220;equal pay for equal work&#8221; judgment of the Supreme Court in all departments of the Central Government.</p>

<p><strong>Sub: NFIR&#8217;s Charter of Demands &#8211; SPAD Definition to be reviewed to prevent harassment and victimization of Running and Safety categories&#8217; Staff (Item No. 30 of Charter of Demands)-reg.</strong></p>
<p>Ref: (i) NFIR&#8217;s letter No. IV/NFIR/WCM/209 dated 01/06/2013.</p>

<li>Railway Board&#8217;s letter No. 2013/E(LR)-11/1/15 dated 02/09/2013 to
<p>GS/NFIR.</li>
<li>NFIR&#8217;s letter No. II/34/Part XIII dated 10/02/2016.</li>
</ul>
<p>While enclosing copy of its letter No. II/34/Part XIII dated 10/02/2016, on the subject, the Federation conveys its disappointment over non-responsive attitude of Railway Board on Federation&#8217;s communication.</p>
<ol start="2">
<li>In this connection, Federation desires to bring to the kind notice of the Board (CRB) that the subject matter has also been dealt by the High Power Committee (R&amp;S) constituted by the Railway Board to review the duty hours of Running and other safety related categories of staff and the HPC (R&amp;S) gave recommendations vide Para 9.12 of its report as under:-</li>
</ol>
<p><strong>&#8220;Existing instructions of minimum punishment to staff for SPAD cases should be reviewed to ensure that the decision takes into account the gravity of the offence </strong><strong>(repercussions of the SPAD) and also the Loco Pilot&#8217;s past record [Para 4.3.1.3 (1)]&#8221;.</strong></p>
<ol start="3">
<li>Federation however is surprised to note that the Railway Board had taken arbitrary decisions vide minutes of the meeting of the full Board held on 06/10/2015 &amp; 08/12/2015 which were circulated vide No. E(LL)/2015/HPC/2/Pt. MS dated 01/02/2016 without caring to consult</li>
<li>Further to above, Federation conveys following points in support of our contention that there is urgent need to define `SPAD&#8217; so as to ensure that conclusions are arrived yet judiciously.</li>
</ol>
<ul>
<li>SPAD (Signal Passing At Danger) is an unusual occurrence and can happen on account of human failure or the failure of machine/equipment.</li>
<li>Even the human failures could be due to the failure of brake or signalling system or incorrect operation of signal.</li>
</ul>
<p>To monitor the SPAD cases DATA LOGGERS have been provided. It is also an admitted fact that reduction in the distance of Relay after the stop signal from 13 mtrs to 03 mtrs has been contributing for increase in the number of SPAD cases.</p>
<p>Though there is a provision in General Rules (GRS) that if a train stops at main line, the speed should be reduced to 50 Kmph at outer most facing point to reduce SPAD, the Loco Pilots are however afraid of adhering to the speed limit to avoid loss of punctuality in trains.</p>
<ol start="5">
<li>To minimize/eliminate the incidents of SPAD, Federation therefore suggests following measures:-</li>
</ol>
<ul>
<li>The Home Signal of the station may be kept at an &#8216;adequate distance&#8217; to reduce unusual
<p>The adequate distance may be taken as the distance sufficient to ensure safety.</li>
<li>A Rectangular Safety Board be placed at about 100/150 mtrs before the Home Signal. The Board could be white with orange inclined alternative reflecting strips with printing thereon with the caption <strong>&#8220;Loco Pilot to stop at this board and draw ahead up to Home Signal if </strong><strong>Home Signal is at ON&#8221;.</strong></li>
</ul>
<p>Reports received by the Federation reveal that more than 80% of SPAD cases takes place when the Loco Pilot just passes the distance of 100 mtrs or below. These type of cases do not have financial or any other negative consequences whatsoever but the Loco Pilots are imposed with the penalty of removal from service which does not at all commensurate with the repercussion of such incidents. The authorities while imposing severe punishments do not care realize the truth as to how the Loco Pilot and family members would survive on account of loss of job. The quantum of punishment on alleged SPAD is also justifiably questionable, considering the fact that even a hard core criminal when sent to jail gets three times meal in the jail whereas the Loco Pilot and his family suffers without livelihood due to imposition of draconian penalty.</p>
<p>Keeping total position in view, Federation suggests that in place of &#8220;imposition of the penalty&#8221; of &#8216;removal from service&#8217; on the Loco Pilots, it would be appropriate that the Loco Pilot concerned be taken off from the running duties and placed under &#8220;grounding from running duties pending enquiry&#8221;. Thereafter, on completion of enquiry, opportunity be given for submitting appeal to the Branch Officer to consider the case whether the Loco Pilot be taken back on running duty. NFIR also reminds that the issue of SPAD cases was discussed with the Board (CRB, MS, FC, AMS) on 21/07/2016 informally, but however without any fruitful decision.</p>
<p>NFIR, therefore, requests the Railway Board to consider the above points and take a view to define SPAD to save the Running Staff from unnecessary victimization. Federation proposes separate meeting to discuss the issue threadbare. Federation hopes to get a reference in this matter soon.</p>

<p>Federation invites attention of the Railway Board to the minutes of the meeting held by Railway Board (CRB, MS &amp; FC) with <strong>NFIR </strong>on 23/08/2013 wherein NFIR&#8217;s 34 Point Charter of Demands was discussed. The Railway Board while conveying comments on the 34 Point Charter of Demands vide letter cited under reference had advised following position in respect of demand No. 30 on the subject:-</p>
<p><strong>&#8220;Definition of SPAD is not laid down as such. Any passing of &#8216;stop&#8217; signal (except permissible </strong><strong>signals and those permitted under certain rules such as Automatic signals) at danger by a </strong><strong>loco without authority is treated as SPAD irrespective of distance travelled by Loco after </strong><strong>passing a signal at danger. Safety Directorate is of the view that the same should continue.</strong></p>
<p><strong>However, Railways were asked to give their suggestions with regard to review of punishment </strong><strong>norms issue by Railway Board including those for SPAD.</strong></p>
<p><strong>Replies received from Railways are being compiled and changes proposed, if any, will be put up for perusal and approval of Board&#8221;.</strong></p>
<p>Thereafter, a period of more than two years has passed, the position relating to changes proposed and the decision of Railway Board thereon is yet to be communicated to the Federation.</p>
<p>NFIR, therefore, requests the Railway Board to apprise the Federation the proposed changes and the decision taken by the Board at an early date. The Federation also requests to make available the suggestions received from railway early.</p>
