<h3 class="wp-block-heading">Subject: CGHS facilities to the retired BSNL/MTNL employees (Combined Service Pensioners) who are in receipt of pension from Central Civil Estimates &#8211; Revised mapping for determining CGHS subscription and Ward entitlement.</h3>



<p>The undersigned is directed to refer to this Office Memorandum No. 4-12(12)/2018-PAT-Part(1) dated 01.07.2019 on above subject vide which the revised mapping of IDA and CDA pay scales was issued for deciding the rate of monthly CGHS contribution and entitlement of wards in private hospitals empanelled under CGHS in respect of retired BSNL /MTNL employees who receive pension from Central Civil Estimates and avail CGHS facilities.</p>



<p>2. The entitlement of wards in Private Hospitals empanelled under CGHS has been revised e.f. 28.10.2022 by Ministry of Health &amp; Family Welfare vide its O.M. No. S.11011/11/ 2016-CGHS(P) /EHS dated 28.10.2022. This has necessitated corresponding modification in Annexure-8 of the said O.M. dated 01.07.2019 .</p>



<p>3. Accordingly, Annexures to the said M. dated 01.07.2019 stands modified w.e.f . 28.10.2022, as enclosed.</p>



<p>4. This M. and mapping is applicable only for the Combined Service Optees who retired from BSNL/ MTNL with IDA pay scale.</p>



<p>5. This M. and mapping is not applicable for pro-rata pensioners who retired from DoT under CDA pay scale. Also, as per guidelines issued from Directorate of CGHS, MoH&amp;FW, ward entitlement is based on the last basic pay and CGHS subscription is based on the pay scale as mentioned in the Pension Payment Order (PPO) of a particular retiree. Accordingly, ward entitlement and CGHS subscription in case of pro-rata pensioners of BSNL/MTNL will continue to be decided based on last pay drawn in DoT before absorption, as mentioned in their respective PPO while retiring from DoT, Govt. of India as already conveyed vide this office O.M. No. 4-12(12)/2018- PAT dated 08.09.2021. Hence, no mapping of IDA/ CDA scale is required in case of pro-rata pensioners.</p>

<p>Your kind attention is invited towards the above referred to O.M. dated 28th March, 2017, wherein a condition of Minimum Qualifying Service of 10 years has been laid down for availing CGHS facilities for NPS covered pensioners.</p>

<p>In this connection, it would not be out of context to mention that, a substantial number of Gramin Dak Sewaks became regular employees of the Postal Department, crossing age of 50 years. All these CDSs, on having been regularised as Postal Employees after 50 years of age, are thus deprived of CGHS facilities on account of above-mentioned condition of minimum 10 years Qualifying Service, as such, the said condition is uncalled for an irrational.</p>



<p>It is, therefore, requested that, the matter may please be looked into in the foregoing, and the same be dispensed with, so that, any regular Government Employee on superannuation, may be NPS covered pensioners, should be allowed to avail CGHS facilities without any bar of Minimum Qualifying Service in the larger interest of justice.</p>

<p>The undersigned is directed to refer to this Office Memorandum No. 4-12(11)/2012- PAT(Part) dated 31.08.2016 vide which CGHS facilities were extended to retired BSNL / MTNL employees who receive pension from Central Civil Estimates.</p>



<p>The rates of monthly CGHS subscription and entitlement of Wards in Private hospitals empanelled under CGHS have been revised with effect from 01-01-2017 by Ministry of Health and Family Welfare vide OM No. S.11011/11/2016-CGHS(P)/EHS dated 09.01.2017. This has necessitated corresponding revision in mapping of Pay &amp; scales from IDA to CDA as circulated vide O.M. dated 31.08.2016.</p>



<p>Accordingly, Annexures to the said O.M. dated 31.8.2016 stand revised as enclosed w.e.f. 1.1.2017 to enable CGHS in deciding the rate of CGHS contribution and ward entitlement in respect of retired BSNL/MTNL employees who receive pension from Central Civil Estimates and avail CGHS facilities.</p>

<p>Subject:-<strong> Extension of CGHS facilities to the pensioners of post and  Telegraph Department</strong></p>
<p>With reference to the above mentioned subject the undersigned is directed to draw attention the Memorandum No.S-11011/46/95-CGHS D-II/CGHS(P) dated 1st August 1996 and state it has now been decided to revoke OM dated 1.8.1996, in  compliance of the Orders of Hon’ble Central Administrative Tribunal, Ernakulam Bench dated 12th  July 2005 in O.A.N0. 563/2004 and 590/2004 and dated 01.06.2017 in C.P/180/21/2017 arising aut of OA No.180/563/2004 between Central Government Pensioners’ Association (Kerala) and Ors. Vs UOI &amp; Others.</p>
<p>2. The retired employees of Post and Telegraph Department shall hereinafter, be entitled to  the CGHS facility, irrespective of whether they were members of CGHS prior to retirement or  not, subject to the payment Of prevalent subscription for availing themselves of this facility as  per rules as in the case of other Central Government pensioners.</p>
<p>3.  This issues with the approval of the Competent Authority.</p>

<p>Will the Minister of PERSONNEL,PUBLIC GRIEVANCES AND PENSIONS be pleased to state :-</p>
<p>(a) whether, a married woman employee can show her own parents as her dependents under the service rules applicable to Central Government employees;</p>
<p>(b) if so, under what conditions;</p>
<p>(c) if not, the rationale therefor;</p>
<p>(d) whether Government has taken any action to make the aforesaid service rules gender neutral both in letter and spirit; and</p>
<p>(e) if so, the details thereof and if not, the reasons therefor?</p>
<p><strong>ANSWER</strong></p>
<p>Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister&#8217;s Office. (DR. JITENDRA SINGH)</p>
<p>(a) to (e): The service rules of the Government employees have been framed keeping in view their contextual purpose and with a view to make them gender neutral.</p>
<p>As per Rule 50 of Central Civil Services (CCS)(Pension) Rules, 1972, father and mother of a Government employee (which includes a female Government employee) come within the definition of family. For the purpose of gratuity, there is no condition of dependency or inclusion in family.</p>
<p>In respect of General Provident Fund (GPF) Rule, female employees can nominate their parents for the benefits of GPF. There is no dependency criterion for nominating parents for the benefits of GPF.</p>
<p>Under Central Government Health Scheme (CGHS) Rules, married women employees have the option either to opt their dependent parents or dependent parents-in-law for CGHS facilities.</p>
<p>As per All India Services (AIS) {Medical Attendance (MA) Rules}, &#8216;family&#8217; definition includes the name of parents wholly dependent upon the member of service and normally residing with such member.</p>
<p>As per CCS {Leave Travel Concession (LTC)} Rules, &#8216;family&#8217; definition includes parents or step parents wholly dependent on the Government servant irrespective of whether they are residing with the Government servant or not.</p>
<p>As per CCS(Conduct Rules), &#8220;Members of family&#8221; in relation to a Government servant include the wife or husband, son or daughter, parents, brothers or sisters or any person related to any of them by blood or marriage, whether they are dependent on the Government servant or not.</p>
<p>As per AIS (Conduct) Rules, any person related, whether by blood or marriage, to such member or to his or her wife or husband, as the case may be, and wholly dependent on such member is treated as member of family.</p>

<p>(a) whether the Government issues CGHS cards to all Central Government employees including the persons working on contractual and or co-terminus basis and if so, the details thereof; (b) whether the Government is not giving CGHS pensioner facilities to the person or families at the end of contract and termination of employment therefor;</p>
<p>(c) if not, the reasons behind thereof;</p>
<p>(d) the total number of cards that have been issued to the contractual and the coterminous employees drawing salary from the central exchequer during the last three years therein; and</p>
<p>(e) the proposal of the Government to facilitate them with one time/whole life CGHS pensioner cards therefor?</p>

<p>(a): CGHS Cards are issued to Central Government employees and employees on co-terminus basis who are residing in CGHS covered areas. CGHS facilities are not provided to persons working on contractual basis.</p>
<p>(b) &amp; (c): CGHS facilities are not provided to the employees on the termination of employment on co-terminus basis since CGHS facilities are primarily meant for Central Government Employees/Pensioners drawing salary/pension from Central Civil Estimates.</p>
<p>(d): No separate category is maintained regarding co-terminus employees and therefore, this information cannot be provided.</p>
<p>(e): There is no such proposal.</p>

<p>29th SCOVA meeting under the chairmanship of Hon&#8217;ble MOS(PP) &#8211; Action Taken Report on the Minutes of the 28th SCOV A meeting held under the Chairmanship of Hon’ble MOS(PP) on 27.06.2016</p>

<p><strong>Para 4(iv) of the minutes: Extension CGHS facilities to P&amp;T pensioners</strong></p>
<p>The representatives of Ministry of Health and Family Welfare informed that the 7th CPC has recommended that all Postal Dispensaries should be covered with CGHS. It was decided to await the decision of the Government within a month.</p>
