<p>Sub:- <strong>Reimbursement of medical claims to pensioners under CS (MA) Rules, 1944 as directed by various CATS/Courts &#8211; Regarding</strong>.</p>
<p>The undersigned is directed to state that various references are being received in Ministry of Health and Family Welfare on the above mentioned subject. it is hereby clarified that CS (MA) Rules, 1944 are not applicable to pensioners till date.</p>
<p>2. It is further informed that the following options to avail medical facilities are available to Central Government pensioners:</p>
<p><strong>a) Pensioners residing in CGHS covered areas:</strong></p>
<p>1) They can get themselves registered in CGHS dispensary after making requisite contribution and can avail both OPD and IPD facilities.</p>
<p>2). Pensioners residing in CGHS areas cannot optout cf CGHS and avail anyother medical facility {i.e. Fixed Medical Allowance). Such pensioners, if they do not choose to avail CGHS facility by depositing the required contributions, cannot be granted Fixed Medical allowance in lieu of CGHS.</p>
<p><strong>b) Pensioners residing in non &#8211; CGHS areas:</strong></p>
<p>1). They can avail Fixed Medical Allowance (FMA) @ Rs.500/- per month</p>
<p>2) They can also avail benefits of CGHS- [OPD and IPD] by registering themselves in the nearest CGHS &#8220;city after&#8221; making the required subscription.</p>
<p>3) They also have the option to avail FMA, for OPD treatment and CG HS for IPD treatments after making the required subscriptions as per CGHS guidelines.</p>
<p>3. In view. of the above, reimbursement of medical claims to pensioners under CS (MA) Rules, 1944 as directed by various CATS/Courts, need not be referred to the Ministry of Health and Family Welfare. The respective Administrative Department/Ministry may take their own decision in this regard.</p>
<p>4. Further, all Departments/Ministries are requested to intimate their employees proceeding for retirement regarding the above options for medical facilities available to the Central Government pensioners.</p>
<p>5. This issues with the approval of competent authority.</p>

<p style="text-align: center;">Medical Facilities to Government employees</p>
</blockquote>
<p><em>Central Government Health Scheme</em> provides medical care to its beneficiaries which include serving as well as retired Central Government employees. The CGHS provides its services through a network of CGHS Wellness Centers which are in operation presently in 25 major cities of the country. Expenditure on medical reimbursement in respect of pensioners is borne by CGHS and in respect of serving employees it is borne by concerned Ministry/ department/office. The pensioner beneficiaries are eligible for credit facility for treatment in CGHS empanelled hospitals.</p>
<p>Central Services (Medical Attendance) Rules, 1944 are applicable to serving Central Government employees only who are residing in non-CGHS covered areas. Medical attendance is provided by the Authorized Medical Attendant appointed by concerned department. The CS(MA) Rules 1944 are not applicable to pensioners. As per these Rules, there is no provision for issue of medicines and medical reimbursement claims are to be settled by the concerned department/ Ministry.</p>
<p>The Health Minister stated this in a written reply in the LokSabha here today.</p>

<div><strong>Criteria fixed for setting up a Central Government Health Scheme (CGHS) dispensary</strong></div>

<div>The below information is tabled to a question in Lok Sabha on 11th July 2014 by the Minister of Helath and Family Welfare Shri Harsh Vardhan as follows&#8230;</div>
<div></div>
<div>The criteria fixed for setting up a Central Government Health Scheme (CGHS) dispensary in a particular area are as under:-</div>
<div></div>

<div>(i) In an existing CGHS city:- For opening of a new Allopathic CGHS dispensary in an existing CGHS city, there has to be a minimum of 2000 Card holders (serving employees of Central Government and Central Civil pensioners).</div>
<div></div>
<div>(ii) Extension of CGHS to a new City:- For extension of CGHS to a new city, there has to be a minimum of 6,000 Card holders. However, due to financial and other resource constraints it is not always possible to adhere to the above criteria.</div>

<div></div>
<div>(b): The details about number of CGHS allopathic/AYUSH dispensaries and Hospitals in the country, State/UT-wise are at Annexure.</div>
<div></div>
<div>Keeping in view the financial and other resource constraints, a decision has been taken not to expand CGHS to cover new cities/ areas. There are some States and UTs which do not have the presence of CGHS as yet. Accordingly, the Ministry has mooted a proposal to open at least one CGHS dispensary in the capital city of such States/UT’s namely, Himachal Pradesh, Chhattisgarh, Goa, Arunachal Pradesh, Tripura, Manipur, Mizoram, Sikkim, Nagaland, Gujarat and Pudduchery.</div>

<div>In addition, there is also a proposal to open one CGHS dispensary in Indore in compliance of the High Court’s directions.</div>

										<content:encoded><![CDATA[<p><strong> Extension of CGHS facility to State Govt Employees..?</strong></p>
<p>While answering to a question in Parliament, Minister Shri.Ghulam Nabi Azad said that the Central Government Health Scheme is primarily meant for the <a href="http://centralgovernmentnews.com/" target="_blank">Central Government employees</a> and pensioners receiving salary / pension from Central Civil Estimates of Government of India.</p>
<p>The State Government employees and other members of public are not eligible to join CGHS. However, no requests from State Governments including Kerala have been received for improvement in CGHS.</p>
<p>CGHS is basically providing the dispensary services through its Wellness Centres manned by the General Duty Medical Officers. However, CGHS also provides the services of medical specialists through the Polyclinics and Central Government hospitals. In addition, the CGHS medical specialists also visit designated dispensaries on stipulated days in each week to provide medical consultation to the beneficiaries. Due to shortage of specialists in CGHS it is practically not feasible and financially viable to provide Specialist facilities in each CGHS Wellness Centre. Moreover, CGHS is also engaging contractual specialists against the vacant posts of specialists to provide the medical consultation services to its beneficiaries.</p>
<p>CGHS has a dedicated wing of specialists at the Safdarjung Hospital, New Delhi for its beneficiaries. The CGHS beneficiaries are also allowed to consult specialists at Dr. RML Hospital and other Government hospitals in NCR in respective specialties. In addition, CGHS has empanelled a large number of private hospitals to provide inpatient medical care to its beneficiaries on the advice of Government specialists.</p>
<p>As per the Terms &amp; Conditions for empanelment under CGHS, all empanelled private hospitals are required to provide credit facilities to the <a href="http://centralgovernmentnews.com/category/cghs/" target="_blank">CGHS</a> beneficiaries in case of emergency. Pensioners and other specified category of beneficiaries are entitled for credit facilities under normal circumstances also. Non-compliance of the said provision attracts penalty as per the Memorandum of Agreement signed by them.</p>

<strong>OFFICE MEMORANDUM</strong></p>
<p>Sub:<strong> Revision of guidelines for allotment of accommodation to former President(s), former Vice President(s) and former Prime Minister(s) or in case of death to their spouses.</strong></p>
<p>The guidelines for allotment of residential accommodation to former President(s), former Vice President(s) and former Prime Minister(s) or in case of their death, to their spouses were issued vide this Directorate O.M. No.12029(2)/87-Pol.II dated 6.12.1991. These guidelines have been reviewed in the Ministry of Urban Development in the light of the similar provisions contained in the President’s Pension Rules, 1962 and the Vice President’s Pension, Housing and Other Facilities Rules, 1999.</p>
<p>2. On review, it has been decided that allotment of residential accommodation to former President(s) and former Vice President(s) or in case of death, to their surviving spouses shall be regulated as per the provisions relating to residential accommodation contained in the President’s Pension Rules, 1962 and the Vice President’s Pension, Housing and Other Facilities Rules, 1999, as amended from time to time, respectively.</p>
<p>3. In view of the above, the provisions of this Directorate OM.No.12029(2)/87-Pol.II dated 6.12.1991 relating to allotment of government accommodation to former President(s) and former Vice President(s) or their spouses may be treated as withdrawn with immediate effect.</p>
<p>4. This issues with the approval of Hon’ble Minister of Urban Development.</p>

<p>Sub: <strong>Approval for Photo selective Vaporization of Prostate (PVP) Surgery using Green Light HPS Fibre (Angled Delivery Device) to be used with HPS Laser System 120 watt (AMS) under CGHS/CS(MA) Rules regarding;</strong></p>
<p>With reference to the above mentioned subject the undersigned is directed to state that this Ministry has been receiving requests for grant of permission for Green light HPS laser fibre for Laser Prostactomy. The matter has been examined in consultation with specialists in the field and it was now been decided to permit Photo selective &#8216;Vaporization of Prostate (PVP) Surgery using Green Light HPS Fibre (Angled Delivery Device) to be used with HPS Laser System 120 watt (AMS) under CGHS/CS(MA) Rules on the recommendations of a Government Specialist in the following conditions:</p>
<blockquote><p>a. Patients or anti-coagulants, which cannot be withdrawn even for a short duration</p>
<p>b. Patients suffering from bleeding diathesis.</p>
<p>c. Patients with Iarge prostate gland, weighing more tnan 60-80 gm.</p>
<p>d. Patients wth CCF anc renal failure, were fluid overload is to be avoided. In other BHP cases the standard line of treatment shall be TURP.</p></blockquote>
<p>2. The ceiling rate of Green Light HPS Fibre (Angled Delivery Device to be used with HPS Laser System 120 watt (AMS) for reimbursement / approval under CGHS / CS(MA) patients shall be Rs.6.000/- (incl. of all taxes) or actual, whichever is lower. The ceiling rate shall be effective for one year or till further order whichever is earlier.</p>
<p>3. CGHS &#8211; Package rate for surgery shall be the same as for Holmium Laser prostatectomy and the cost of Green Light HPS Fibre (Angled Delivery Device) shall be permitted in addition, as per the above prescribed ceiling rate or actual, whichever is lower.</p>
<p>4. This issues with the concurrence of Integrated Finance Division, Ministry of Health &amp; Family Welfare vide CD No. 837 dated 06/08/2013.</p>

<p>The dental services in CGHS Delhi have been outsourced in 13 Wellness centres (5 under Central Zone and 8 under South Zone) for 22 dental procedures. The location wise details are at Annexure-A.</p>
<p>The details of payments made to the service provider in respect of these clinics from the starting of the services till July, 2013 are at Annexure-B.</p>
<p>No specific complaint has been reported about irregularities committed by the dental clinics in connivance of CGHS officials. However, deficiency in services has been reported from the beneficiaries. An Inspection Committee has been constituted for regular inspection of the dental units to ensure proper delivery of services as per the terms and conditions of the agreement.</p>
<p>This information was given by the Union Minister of Health &amp; Family Welfare ShriGhulamNabi Azadin written reply to a question in the LokSabha yesterday.<br />

Treatment from CGHS Empanelled Hospitals</p>
<p>As per the existing guidelines, a CGHS beneficiary is required to obtain permission from his administrative Department / Office or CMO in charge (in case of pensioner beneficiary) to avail medical treatment in a CGHS empanelled private hospital. However, in case of emergency he can go to any hospital whether empanelled or not, to avail medical treatment. This provision is necessary to ensure proper medical treatment of a CGHS beneficiary in consultation with the Government specialists. This is also a measure of ‘checks and balances’ to ensure financial propriety and optimum utilization of public money.</p>
<p>This Ministry has been receiving representations from the individuals; Pensioners Associations etc. to allow the CGHS beneficiaries to take treatment from the CGHS empanelled private hospitals without obtaining the requisite permission. However, their requests have not been acceded to as the present referral system is considered necessary in the interest of the beneficiaries and it is also necessary as a check and balance measure to ensure financial propriety.</p>
<p>CGHS is already providing comprehensive and hassle free healthcare services to its beneficiaries through its large network of Wellness Centres and empanelled private hospitals and diagnostic /imaging centres. With a view to further simplify and liberalize the procedures in CGHS to make its services more hassle free, the requirement of mandatory permission for undertaking diagnostic tests and investigations has been done away with w.e.f. 1st January, 2013. In addition, ‘Continuous Empanelment Scheme’ has also been revived at all CGHS locations to empanel more number of eligible private hospitals to enhance accessibility and availability of medical services to the beneficiaries in a hassle free manner.</p>

<div align="justify">In continuation of this Ministry’s Office Memorandum of even no. dated 30.4.2013 on the above mentioned subject, the undersigned is directed to convey that in addition to the list of the hospitals (including dental clinics), diagnostic laboratories and Imaging Centres already empanelled, the hospitals (including dental clinics), diagnostic laboratories and Imaging Centres as per the list attached have also been empanelled under the continuous empanelment scheme under CGHS in Delhi &amp; NCR. The newly empanelled hospitals (including dental clinics), diagnostic laboratories and Imaging Centres may be treated as included in the existing list with same terms and conditions as has been Indicated in the Office Memorandum dated 30.4.2013.</div>

<p>As per the 5th Central Pay Commission’s recommendation, career progression had been granted to the ISM&amp;H (Indian Systems of Medicine &amp; Homeopathy) Physicians possessing the medical qualifications approved by the Central Council for Indian Medicines/Central Council of Homoeopathy on the pattern available to the Allopathic doctors//General Duty Medical Officers of Central Health Service (CHS).</p>
<p>According to the Recruitment Rules for Chief Medical Officer (Non Functional Selection Grade), Union Public Service Commission has to conduct the Departmental Promotion Committee (DPC) process for promotion to this grade. In respect of the Unani Doctors, the CMO (NFSG) grade has already been granted to 8 eligible Unani doctors. In respect of Homoeopathic doctors, UPSC has asked for certain information / documents in respect of the officers under consideration.</p>
<p>This information was given by the Minister for Health &amp; Family Welfare Shri Ghulam Nabi Azad in written reply to a question in the Rajya Sabha today.</p>
