Subject :- Holiday to be observed in Central Government offices during the year 2014.

A copy of Government of India, Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, New Delhi F. No.12/5/2013-JCA-2 dated 11.07.2013 on the subject mentioned above is enclosed for information, guidance and necessary action.

2. The instructions contained in Para 2, 3.1 & 3.2 may be adhered to strictly while deciding the Holidays in respect of offices located outside Delhi/New Delhi. The list of Holidays shall be in consonance with the Notification of DOP&T and should not be deviated. As regards, offices located at Delhi/New Delhi, the holidays and Restricted Holidays as notified in Annexure I & II respectively to the above mentioned OM dated 11.07.2013 will be observed.

3. While endorsing a copy of the Part II Office Order notifying Holidays and Restricted Holidays, it is requested that a copy of Part II Office Order may please be sent to this HQrs Office separately.

Sub: Promotion of Asstt. Accounts Officers to Accounts Officer’s grade.

102 (One Hundred Two) AAOs as per enclosed Annexure-I, have been approved for promotion to the grade of Accounts Officer carrying Pay Band-2 Rs. 9300-34800 plus Grade Pay of Rs. 5400/- with immediate effect or from the assumption of charge whichever is later.

2. Before promoting the AAOs, it may please be ensured that none of the circumstances enumerated in para 2 of the DOP&T 0M No. 22011/4/91-Estt. (A) dated 14.09.1992 have arisen before promotion. If such circumstances have arisen the promotion shall not be released and instead considered as if, the case of the officer concerned has been placed in Sealed Cover by the Departmental Promotion Committee, in terms of para 7 of the said OM.

3. TA and joining time, is permissible under rules, as applicable in the case.

4. These AAOs may be relieved immediately but not later than 01-08-2013. The relief of the officer shall also not be deferred on the ground that a representation has been submitted for change of place of posting or on the ground that reliever has not reported/ been posted. It may be brought to the notice of the officer that no representation for change of posting etc will be entertained in any case as all efforts have been made to accommodate individuals at choice stations keeping in view the grounds mentioned in their respective representations to the extent possible. Controllers may also ensure that representations are not unduly forwarded.

5. After promoting the officer. Immovable Property Return (IPR) of the officer, as on date of promotion to the Accounts Officer’s grade, duly verified, may also be forwarded within 1 5 days from the date of reporting.

6. Par-11 Office Orders regarding relief / promotion of the officer may please be notified in the under mentioned format and copy endorsed to Admin-II Section of Hqrs office.

Sub: Admittance of Ex India claims in r/o Army officers and JCO/ ORs.

Ref: This office Important Circular even dated: 4th Jan’ 2013

In continuation to the HQrs office Important Circular of even No. dated: 4th Jan’2013, widespread discrepancy and ambiguity in dealing with the Ex-India claims in respect of Army officers, JCO/ORs and Defence Civilians have come to the notice to the HQrs office.

In order to resolve the above issues and ambiguity in the environment regarding the passage and Ex-India Claims and to streamline the claims pertaining to deputation, training courses, temporary duty and permanent postings involving drawal of advances or otherwise the following distribution has been approved by the competent authority.

Sl. No	Ex India claim in r/o	Course of action proposed
i)	Army officers claiming TA/DA while proceeding abroad.	PCDA (O) Pune may sanction the advance and watch the adjustment/recovery thereof.
ii)	PBOR’s claiming TA/ DA while proceeding abroad.	Respective PAO’s where the IRLA of the PBOR is being maintained, may sanction the advance and watch the adjustment/recovery thereof.
iii)	Defence Civilians claiming TA/DA while proceeding abroad	Respective PCsDA/CsDA from where the ndividual is drawing his Pay and Allowances.
vi)	All claims in r/o Army officers, JCOs/ORs and Defence Civilians where Ex-India posting is not involved, e.g deputation, long term course, Joint Exercise etc.	May be dealt by PCDA, New Delhi as per the HQrs office Circular dated: 4th Jan’ 2013. Supplementary claims received where the earlier claim was admitted by some other office may be forwarded to that particular office for linking and auditing of the same.
vii)	Para 242 and 243 of Defence Audit Code amply clarifies the term “Air Passage” as the Exchange Orders from the airlines for the Ex-India claims in rio Army Personnel/ Defence Civilians to be centrally dealt by PCDA, New Delhi and not the other incidental charges associated with the Ex India claims.	PCDA, New Delhi may continue to deal with Ex-India Air Passage claims in r/o Army personnel and defence Civilians as stipulated in Para 242 of Defence Audit Code.

This issues with the approval of the CGDA.

CGDA Orders : Home Town LTC to employees whose headquarter and home town and within the same district

CGDA Orders regarding the subject of ‘Home Town LTC to the employees whose headquarter and home town and within the same district’.

The below order said that Home Town LTC may be admitted to the employee whose headquarter and home town are within the same district provided they do not come within the purview of same station as has been defined under SR 116 of FRSR Part 11 TA Rules.

This department has already issued an order regarding the subject of ‘LTC entitlement of fresh recruits’ on 12.02.2013 vide AN/XIV/14162/TA/DA/LTC/VoI.II , In this order, ‘Fresh recruits would be entitled to All India LTC only in the fourth occasion i.e in the fourth year of a block irrespective of whether their home town and HQrs are same or different’.

2. With reference to your office letter under reference, it may be intimated that Ministry of Finance (Deptt. Of Expenditure) has informed that a petition has been filed by the IA&AD in the Jaipur Bench of the CAT seeking restoration of the benefit of fixation of pay under FR 22 (1) (a) (1) in case of promotion from SO (A) to AAO during 1.1.2006 to 29.8.2008 in the pre-revised scale of Rs. 7500 – 12,000/- .

Therefore, any decision in this regard can be taken only after hearing the outcome of the above case, since any ruling in favour of the petitioners my have a bearing on the principle of pay fixation allowed by the office of the C&AG.

According to MoD Letter No. 34(6)2012-D(Pay/Services) dated 27 December, 2012 in regard to implementation of Hon’ble Supreme Court Order dated 04th September, 2012, the pay of the officers of the Armed Forces holding the rank of Capt/Maj/Lt.CoI(TS)/Lt. CoI(Sel)/Col/Brig and equivalent ranks in Air Force and Navy serving as on 01/01/1986 is to be revised for payment of arrears of Pay.

2. Revision of pay of affected officers as per Hon’ble Supreme Court order is already in process. It has been noticed that in number of cases necessary information/documents like IRLAs/Bank details, required Undertakings of the affected officers are not available with their pay offices to enable them to release the payment of arrears of pay. Result of SAS Part-I Examination (New Syllabus) held in April 2013 has been declared and circulated to all PCsDS/CsDA under Circular No.AN/SAS/16101/SAS-I/April/2013/Result dated 08/05/2013.

As such, the PCsDS/CsDA are requested to convene a DPC and furnish adjudication Report along with DPC proceedings in the proforma enclosed in respect of those Clerks/Typists, who have passed SAS Part-I
examination held in April 2013, on the basis of ACRs for the year 2009-10, 2010-11, 2011-12 respectively, so as to reach this HQrs Office latest by 07/06/2013. While adjudicating the cases the criteria laid down in our circular letter Nos. 0636/AN/D-IV dated 22.08.73 and 0632/AN/F dated 04.12.73 may be kept in view.

All Review/left over cases/Unfit cases/sealed cover cases, if any, in respect of SAS Part-I passed clerks may also be furnished. NIL report is also required.

2. The proposal of the Ministry of Defence regarding stepping up of pay of AAOs of DAD at par with directly recruited SAS Apprentices has been examined in this Delartment. It is clarified that as SAS Apprentices are placed in the common seniority list of AAOs below them. The criteria set out in the Department of Expenditure U.O. Note dated 22.10.2010 (Page7/cor.) appear to be satisfied for stepping up of the pay of promotees with reference to DRs.

The proposal of MOD regarding stepping up of pay of Assistant Accounts Officers of Defence Accounts Department at par with directly recruited SAS Apprentices has been further examined in the Department of Expenditure. This Department agrees to the stepping up of pay of the promotee AAOs at par with the directly recruited SAS Apprentices subject to the following conditions : –

(a) Stepping up of the pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the pay of the directly recruited junior provided they belong to the same seniority list for all purposes.

(b) Govt. servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised structure for direct recruits appointed on or after 1.1.2006, as laid down in Section II of Part A of the First Schedule to the CCS(RP) Rules, 2008. if their cadre does not have an element of direct recruit br in cases where no junior is drawing basic pay higher than them.

(c) Stepping up of pay of the seniors shall not be applicable in cases where direct recruits have been granted advance increments at the time of recruitment.

3. Case of refusal on promotion may please be dealt with by the Controllers themselves as the appointing authorities in the light of provisions contained in DP&AR OM No.22034/3/81-Estt. (D) dated 01.10.81 and this HQrs may please be informed accordingly.

4. While issuing order of promotion, the attention of the individuals may pleasee be drawn to the provisions of Ministry of Personnel, Public Grieevances and Pension (DOP&T) OM No.011.12.97-Estt. (Pay) dated 23.4.99 and clarification No.2 of GOI, Ministry of Finance, Department of Expenditure No.01.01.2008-IC dated 13.09.08 regarding exercising of an opiton by them for fixation of their pay as Private Secretary.
