<p>Subject: <strong>Grant of vigilance clearance for obtaining passport.</strong></p>



<p>The undersigned is directed to refer to this Department’s O.M. of even no. dated 28.03.2018 prescribing the guidelines for grant of vigilance clearance for obtaining passport. The guidelines have been reviewed by this Department in consultation with Central Vigilance Commission and Ministry of External Affairs (MEA).</p>

<p>2. MEA has also issued the guidelines for issuance of ordinary Passport to the Government servants vide O.M. No. VI/401/01/05/2014 dated 26.05.2015, wherein procedures to be followed in this regard have been prescribed.</p>



<p>3. In view of the above, it is mandatory for the administrative Department /<br /> Controlling Authority to check as to whether any provision of the Section 6(2) of the Passport Act, 1967 is attracted in case of employees, who are working under them, while obtaining Indian Passport. As such, it is required to check the vigilance clearance of such Government servants.</p>



<p>4. Accordingly, it has been decided that vigilance clearance can be withheld<br /> only under the following circumstances:</p>



<ul class="wp-block-list"><li>The officer is under suspension;</li><li>Charge sheet has been filed in a Court by the Investigating Agency in a criminal case or after grant of sanction by the Competent Authority under PC Act or any other criminal matter and taken cognizance of by the Court of Law.</li></ul>



<p>5. All Ministries / Departments / Offices are requested to bring the above guidelines to the notice of all Disciplinary Authorities under their control.</p>

<p>Subject: <strong>Appointment of Central Vigilance Commissioner and Vigilance Commissioner in the Central Vigilance Commission.</strong></p>



<p>The Government of India has constituted a body under the Central Vigilance Commission Act, 2003 (the Act) known as the Central Vig ilance Commission to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located In New Deihi. The Commission consists of a Central Vigilance Commissioner and not more than two Vigilance Commissioners. The functions and powers of Central<br />
Vigilance Commission are as per chapter III of the Act.</p>



<ol class="wp-block-list"><li>It IS proposed to appoint a Central Vigilance Commissioner vice Shri KV Chowdary and a Vigilance Commissioner vice Shri T.M. Bhasin, who will demit office on completion of their tenure.</li><li>The Central Vigilance Commissioner and the Vigilance Commissioner shall hold office for a term of four years from the date on which he/she enters upon his/her office or till he/she attains the age of 65 years, whichever is earlier.</li><li>The Central Vigilance Commissioner, on ceasing to hold the office, shall be ineligible for reappointment in the Commission. The Vigilance Commissioner, however, on ceasing to hold the office, shall be eligible for appointment as the Central Vigilance Commissioner, provided that the term of the Vigilance Commissioner, if appointed as the Central Vigilance Commissioner, shall not be more than four years in aggregate as the Vigilance Commissioner and the Central Vigilance Commissioner.</li><li>The salary and allowances payable to and other conditions of service of the Central Vlgrlance Commissioner shall be the same as those of a Chairman of the Union Public Service Commission and that of the Vigilance Commissioner shall be the same as those of a Member of the Union Public Service Commission subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act.</li><li>For complete information and details interested applicants should refer to the Central Vigilance Commission Act, 2003. </li><li>Eligibility and other requirements:<br /> 7.1 Section 3(3} of the CVC Act, 2003, provides that the Central Vigilance Commissioner and the Vigilance Commissioners shall be appointed from amongst persons &#8211;</li><li><strong> Eligibility and other requirements: </strong> <ul><li>In case of persons falling under section 3(3)(a) of the Act as above, such persons, preferably have held or is holding the post of a Secretary to the Government of India or any equivalent post thereto under the Central Government.</li><li>In case of persons falling under the first part of section 3(3)(b) of the Act as above, the person must have held or is holding the position of Chairman / Managing Director / Chief Executive Officer of a Schedule &#8216;A&#8217; Central Public Sector Enterprise and has served as a whole time Director on the Board for a period of at least three years.</li><li>In respect of persons who have expertise and experience in finance , including insurance and banking, law, vigilance and investigations and falling under the second part of section 3(3)(b) of the Act as above, such persons must have acquired eminence and have outstanding achievement in the said field(s) provided that such persons who are in employment In a private company must have held or is holding the position of Managing Director / CEO, as Whole-Time Director on the Board of the Company for a period of at least three years.</li><li>All applicants should be of outstanding merit and impeccable integrity and should have knowledge and at least 25 years of experience in the relevant field(s) . </li></ul></li></ol>



<p>8. Persons fulfilling the criteria for appointment as Central Vigilance Commissioner / Vigilance Commissioner and interested in being considered for appointment to the post(s) may send their application in the enclosed  proforma to the Under Secretary (AVD-III ), Department of Personnel and Training, Room No. 268-B , North Block, New Delhi by 01st May, 2019.</p>

<p>Subject: <strong>Appointment of officers working in the Ministries/Departments under Central Staffing Scheme(CSS) to non-CSS posts in the Central Vigilance Commission(CVC) on shift basis</strong></p>
<p>It is proposed to fill up vacancies of Deputy Secretary/Director level in the Central Vigilance Commission(CVC) on shift basis. The posts are non-CSS posts to be filled through Civil Services Board procedure.</p>
<p>2. The officers who are working at DS/Director level in different Ministries/Departments under the Central Staffing Scheme will be eligible to apply for these posts. If the officer is selected for the post, it will be treated as a &#8216;shift&#8217; from a Central Staffing Scheme post to a non-Central Staffing Scheme post, which will entail additional tenure of two years as per the Consolidated Deputation Guidelines. The +2 option would be available only to those officers who were already working on a CSS post other than in the CVC. The additional tenure is subject to completion of two years on the present CSS post and availability of cadre clearance. In the absence of cadre clearance (for +2 tenure), the tenure will be restricted to the balance period of four/five years central deputation remaining to the officer. The maximum tenure admissible outside the cadre is seven years in both the stints CSS and nonCSS put together.</p>
<p>3. The posts may be circulated amongst the officers working at Deputy Secretary/Director or equivalent level under the Central Staffing Scheme in the Government&#8221; of India on priority basis. Names of the willing and eligible officers who can be spared by the Ministries/Departments may be forwarded to the Department alongwith the approval of the Minister-in-Charge, cadre clearance (for +2 tenure), vigilance clearance, detailed bio-data in the enclosed proforma and attested copies of ACR(s) for the period they have worked under CSS.</p>
<p>4. It is requested that the application(s) of the eligible officer(s) may please be forwarded so as to reach this Department upto 20.02.2019.</p>

<p>The Commission has been emphasizing from time to time on the need for expeditious completion of disciplinary proceedings. The model time limits for investigation of complaints and for different processes of disciplinary proceedings have been laid down in Commission’s letter of even number dated 23rd May 2000.</p>
<p>2. The Commission would like to invite the attention of the Administrative Authorities Disciplinary Authorities to the undue delays in finalizing vigilance cases especially the conduct of disciplinary proceedings despite having a built in time line for every activity. Further, such unexplained delays lead to Central Administrative Tribunals and the High Courts quashing the Charge-sheet(s) on the sole ground that the concerned Disciplinary Authorities had issued charge-sheets to the delinquents after very long periods of commission of alleged misconduct etc. and also for unexplained delays in conducting disciplinary inquiries.</p>
<p>3. Timely completion and finalization of disciplinary proceedings is the prime responsibility of the Disciplinary Authority/Administrative Authorities concerned in all Departments/ Organizations. More so, such long delays in finalizing disciplinary matters are not only unjust to officials who may be finally exonerated, but helps the guilty to evade punitive action. The Commission had earlier vide its circular no.02/01/2016 dated 18/01/2016 emphasized on the various steps needed to be taken by all concerned obviating delays at different stages of the process right from investigation to finalization of disciplinary proceedings by way of regular monitoring of these cases/matters.</p>
<p>4. The Commission while reiterating the above said instructions would impress upon all concerned that the time limits prescribed by the Commission/DoPT for processing disciplinary cases at various stages may be strictly adhered to. All disciplinary authorities in each Ministry/Department/Organization need to regularly monitor the progress of individual disciplinary cases and take necessary steps as deemed appropriate to ensure that the disciplinary proceedings are completed within prescribed time-limits and are not unduly delayed.</p>
<p>5. All CVOs are also therefore advised to apprise the concerned officers regarding the above guidelines for compliance in monitoring progress/ handling disciplinary proceedings.</p>

<p>Subject: <strong>Selection to the post of Vigilance Commissioner in the Central Vigilance Commission.</strong></p>
<p>The Government of India has constituted a body under the Central Vigilance Commission Act, 2003 (the Act) known as the Central Vigilance Commission (CVC) to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in New Delhi. The Commission consists of a Central Vigilance Commissioner and not more than two Vigilance Commissioners. The functions and powers of Central Vigilance Commission are as per chapter III of the Act.</p>
<p>2. It is proposed to appoint a Vigilance Commissioner vice Shri Rajiv, who is to demit office on completion of his tenure.</p>
<p>3. The Vigilance Commissioner shall hold office for a term of four years from the date on which he/she enters upon his/her office or till he/she attains the age of 65 years, whichever is earlier.</p>
<p>4. The Vigilance Commissioner, however, on ceasing to hold the office, shall be eligible for appointment as the Central Vigilance Commissioner, provided that the term of the Vigilance Commissioner, if appointed as the Central Vigilance Commissioner, shall not be more than four years in aggregate as the Vigilance Commissioner and the Central Vigilance Commissioner.</p>
<p>5. The salary and allowances payable to and other conditions of service of the Vigilance Commissioner shall be the same as those of a Member of the Union Public Service Commission subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act.</p>
<p>6. For complete information and details interested applicants should refer to the Central Vigilance Commission Act, 2003.</p>
<p>7. Eligibility and other requirements:</p>
<p>7.1 Section 3(3) of the CVC Act, 2003, provides that the Central Vigilance Commissioner and the Vigilance Commissioner shall be appointed from persons &#8211;</p>
<p>a) Who have been or are in All India Service or in any civil service of the Union or in a civil post under the Union having knowledge and experience in the<br />
matters relating to vigilance, policy making and administration including policy administration; or</p>
<p>b) Who have held office or are holding office in a corporation established by or under any Central Act or a Government company owned or controlled by the Central Government and persons who have expertise and experience in finance including insurance and banking, law, vigilance, and investigations; provided that, from amongst the Central Vigilance Commissioner and Vigilance Commissioners, not more than two persons shall belong to the category of persons referred to either in clause (a) or clause (b)</p>
<p>7.2 In case of persons falling under section 3(3)(a) of the Act as above, such persons, preferably have held or is holding the post of a Secretary to the Government of India or any equivalent post thereto under the Central Government.</p>
<p>7.3 In case of persons falling under the first part of section 3(3)(b) of the Act as above, the person must have held or is holding the position of Chairman / Managing Director / Chief Executive Officer (CEO) of a Schedule &#8216;A&#8217; Public Sector Enterprise and has served as a Whole Time Director on the Board for a period of at least 3 years.</p>
<p>7.4 In respect of persons who have expertise and experience in finance including insurance and banking, law, vigilance and investigations, and falling under the second part of section 3(3)(b) of the Act, such persons must have acquired eminence and have outstanding achievement in the said field(s) provided that such persons who are in employment in a private company must have held or is holding the position of Managing Director / CEO, as Whole Time Director on the Board of the Company for a period of at least three years.</p>
<p>7.5 All applicants should be of outstanding merit and impeccable integrity and should have knowledge and at least 25 years of experience in the relevant fields.</p>
<p>7.6 The applicants should not be more than 62 years of age as on 1st January, 2018 so that the persons to be considered for selection will get at least 3 years tenure as a Vigilance Commissioner.</p>
<p>8. Persons fulfilling the criteria for appointment as Vigilance Commissioner and interested in being considered for appointment to the post may send their application in the enclosed proforma to the Under Secretary (AVD-III), Department of Personnel and Training, North Block, New Delhi by 19th February, 2018.</p>
<p>9. Serving persons are required to send their applications through proper channel. They can send their applications as an advance copy directly to DoPT by the stipulated last date, but those applications will be considered only if they are finally received through proper channel.</p>
<p>10. The applications received after the due date will not be considered under any circumstances.</p>

<p>Central Vigilance Commission had through its circular of even number dated. 19.09.2016 issued instructions for observance of Vigilance Awareness Week ,this year, from 31 st October to 5th November, 2016. The theme for the Week is Public participation in promoting Integrity and eradicating Corruption.</p>
<p>2. In addition to the activities suggested by the Commission to be conducted within the organisations as well as the outreach activities for public/citizens, in line with the theme this year, to create greater awareness and participation of the public at large, the Commission has envisaged a concept of &#8220;<strong>Integrity Pledge</strong>&#8220;. As such<br />
two Integrity Pledges have been envisaged enlisting support and commitment of the citizens and the other for corporates/entities/firms etc., especially in the private sector to prevent and combat corruption.<br />
3. Both, the &#8220;Integrity Pledges&#8221; to be taken by individual citizens as well as corporates, entities, firms etc., affirming their commitment to eradicate corruption (and to uphold highest standards of ethical conduct, transparency and good governance would be available as an e-pledge on the Commission&#8217;s website<br />
http://www.cvc.nic.in. All Ministries/Departments/Organisations may also provide a hyperlink to the Integrity Pledges on their respective websites/intranet to enable wider participation. Citizens and organisations taking the Integrity Pledge would be &#8220;provided a certificate acknowledging and appreciating their commitment to the cause of anti-corruption. Copies of both the Integrity Pledges&#8221; are enclosed.</p>
<p>4. The Commission requests all Ministries / Departments /Organisations to disseminate and publicise this initiative to elicit wider participation of all stakeholders and also to encourage their customers/public and corporates / entities/firms, etc., to take the Integrity Pledge.</p>

										<content:encoded><![CDATA[<p><strong>Over 62,000 corruption complaints received in Central Vigilance Commission last year</strong></p>
<p>New Delhi: Over 62,000 complaints of alleged corruption in various government departments were received by the Central Vigilance Commission last year, the government said today.</p>
<p>A total of 62,362 complaints were received in 2014.</p>
<p>Necessary action was taken on 24,047 of them and investigation reports were sought in 1,176 complaints, Union Minister Jitendra Singh told Lok Sabha in a written reply.</p>
<p>Of the total complaints, 36,876 were filed as no action was required by the Commission on them. A total of 2,311 complaints were pending, he said.</p>
<p>The Central Vigilance Commission has received a total of 4,309 complaints between January and February this year, said Singh, Minister of State for Personnel, Public Grievances and Pensions.</p>
<p>Of these, necessary action was taken in 3,085 complaints and investigation report was sought in 36 cases. A total of 2,107 complaints were filed by the probity watchdog, he said.</p>
<p>The Commission received 926 complaints exposing corruption under the Public Interest Disclosure and Protection of Informers (PIDPI), also known as whistleblowers resolution, in 2014 and necessary action was taken in 841 of them.</p>
<p>It has received 173 such complaints between January and February this year and necessary action has been taken in 98 of them, the Minister said.</p>

<p>Sir/Madam,<br />
I am directed to refer to the subject mentioned above and to state that requirement of vigilance clearance is a pre-requisite for granting permission to the officers/officials on private foreign visit as advised by DOP&amp;T vide O.M. No. 11012/15/2013-Estt.A dated 2nd January, 2014(copy enclosed).</p>
<p>2. It is, therefore, necessary to send application for grant of ex-India leave to the Board at least one month in advance for enabling the Board to complete the requisite formality.</p>
<p>3. This issues with the approval of Member(P&amp;V), CBDT.</p>

<p>Subject: <strong>Requirement of vigilance clearance for officers going abroad on private visit.</strong></p>
<p>The undersigned is directed to refer to Central Board of Direct Taxes, Department of Revenue I.D. No 114847/Ad-VI(A) dated 16.08.2013 and a OM of even no dated 20.09.2013 on the subject mentioned above and to say that as per Rule 17 of the CCS(Leave) Rules, 1972, leave shall not to be granted to a Government Servant whom a competent punishing authority has decided to dismiss, remove or compulsorily retire from service. Leave sanctioning authority shall get prior approval before sanctioning leave for &#8220;going abroad&#8221; as per O.M. No. 11013/7/94-Esn.(A) dated 18.05.1994 and O.M. No.11013/7/2004-Estt.(A) dated 01.09.2008 (copy enclosed).</p>
<p>2. It is also stated that a blanket order exempting requirement of examination from vigilance angle as proposed in DGIT(Vig.) letter dated 13.05.2013 is not advisable.</p>

<p>Subject: <strong>Requirement of taking prior permission by Government servants for leaving station headquarters for going abroad while on leave.</strong></p>
<p>The undersigned is directed to refer to Department of Personnel and Training’s O.M. No. 11013/8/2000-Estt. (A) dated the 7th November, 2000 on the above mentioned subject and to say that in para 2 thereof, it was conveyed that while granting leave the sanctioning authority shall take prior approval , if required, for permitting the officer to go abroad as per the existing instructions.</p>
<p>2. References are being received regarding the competent authority whose permission is to be taken by the leave sanctioning authority before sanctioning leave to a Government servant to go abroad. It is clarified that the competent authority as per the aforesaid Office Memorandum dated the 7th November, 2000 is to the competent authority in terms of the instructions, if any, issued by the Cadre Authority or the administrative Ministries/Departments themselves. Department of Personnel and Training has not issued any instructions in this regard in respect of the Central Government servants. In the absence of any such instructions, the approval of the leave sanctioning authority would imply approval to the visit abroad also. It may be ensured that the leave applications in such cases invariably mention the purpose of going abroad.</p>

<p>Subject: <strong>Recommendations of the Committee of Experts on Disciplinary &amp; Vigilance Inquiries (Hota Committee) &#8211; Para 38 of the Committee&#8217;s Report regarding payment of TA/DA to retired government servants appearing as witnesses in proceedings before the CDI in CVC &#8211; Government&#8217;s decision thereon &#8211; reg .</strong></p>
<p>The undersigned is directed to say that the Govenunent had appointed a Committee of Experts to review the procedure for DisciplinaryNigilance Inquiries and recommend measures for their expeditious disposal.</p>
<p><em><strong>The Committee comprised the following:</strong></em></p>
<p>(i) Shri P.C. Hota, Former Chairman, UPSC &#8211; Chairman<br />
(ii) Shri Arvind Varma, Former Secretary, DoPT &#8211; Member<br />
(iii) Shri P. Shankar, former CVC &#8211; Member.</p>
<p>2. The Expert Committee has, in para 38 of its Report, inter alia, recommended that &#8220;In case the witness is a retired Government Servant and is appearing before the CDI in  a Departmental Inquiry, the expenses would be borne, in the first instance, by the CVC and subsequently be adjusted with the Department/Organisation concerned.&#8221;.</p>
<p>3. The aforesaid recommendation of the Hota Committee has been considered by a Committee of Secretaries (CoS) under the chairmanship of Cabinet Secretary and the CoS has recommended acceptance of this recommendation. Government has accepted the recommendation of the Hota Committee as endorsed by the CoS.</p>
<p>4. Accordingly, it has been decided that in cases where any of the witnesses in a departmental inquiry is a retired Government Servant and is appearing before the CDI in the Central Vigilance Commission in the Departmental Inquiry, the expenses on payment of admissible TA/DA to such witness would be borne, in the first instance, by the Central Vigilance Commission and subsequently be adjusted with the<br />
Department/Organisation concerned.</p>
<p>5. The above decision of the Government is brought to the notice of all Ministries/Departments for information and compliance.</p>
