<p class="has-text-align-right">New Delhi, 22nd September, 2022</p>



<p>G.S.R. 721(E). &#8211; In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Secretariat Service Rules, 2009 namely:-</p>



<ol class="wp-block-list"><li>Short title and commencement<br />(1) These rules may be called the Central Secretariat Service (Amendment) Rules, 2022.<br />(2) They shall come into force on the date of their publication in the Official Gazette.</li><li>In the Central Secretariat Service Rules, 2009, &#8211;<br />(i) in rule 21, after the word &#8211; regulation, the words in consultation with the Commission,<br />shall be inserted;<br />(ii) for rule 23, the following rule shall be substituted, namely:- <br /><br />&#8220;<em>23. <strong>Power to Relax.</strong>&#8211; Where the Central Government is satisfied that the operation of any of these rules and the regulations made thereunder causes undue hardship in any class or category of persons or posts, it may dispense with or relax, in consultation with the Commission, the requirement of the rules and the regulations made thereunder to such extent and subject to such conditions, as it may consider necessary</em>&#8220;.</li></ol>



<p>Note: The principal rules were published in the Gazette of India, Extraordinary, Part (II) Section 3 Subsection (i) vide notification number G.S.R.140 (E), dated the 27th February, 2009.</p>

<p>Subject: <strong>Exercise of Split Option under Saving Clause of FR-22(1)(a)(1) by officers of all grades of Central Secretariat Service (CSS) cadre</strong></p>



<p>The undersigned is directed to say that the matter relating to extending the benefit of “split-option’ available under Saving Clause of FR-22(1)(a)(1) to the serving officers of all grades of Central Secretariat Service (<a href="https://centralgovernmentnews.com/category/css/" target="_blank" rel="noreferrer noopener">CSS</a>) cadre promoted on adhoc basis was examined in this Department in consultation with Department of Expenditure.</p>



<ol class="wp-block-list" start="2"><li>According to above clause to FR-22(I)(a)(1), save in cases of appointment on deputation to an ex-cadre post, or to a post on an ‘adhoc basis’, the Government servant shall have the option, to be exercised within one month from the date of promotion or appointment, as the case may be, to have the pay fixed under the said rule from the date of such promotion or appointment or to have the pay fixed initially at the stage of the time scale of the new post above the pay in the lower grade or post from which he is promoted on ‘regular’ basis, which may be refixed in accordance with the said rule on the date of accrual of next increment in the scale of pay of the lower grade or post.</li><li>After giving due consideration to the special circumstances in which regular appointments could not be made in various grades of CSS Cadre for a long time and in the meanwhile many of the officers of CSS cadre were promoted on adhoc basis and are continuing as such without being reverted, it has been decided to relax one-time the condition of promotion/ appointment on regular’ basis and allow the option as laid down in saving clause below FR-22(I)(a)(1) in case of officers of CSS cadre promoted on adhoc basis subject to the following conditions:</li></ol>



<ul class="wp-block-list"><li>An undertaking may be obtained from each officer, who exercises option in terms of Saving Clause below FR-22(I)(a)(1) to the effect that in case, his name is not approved for regular appointment, he would be liable to refund the over payment, if any, on this account. No recovery will, however, be made in case of a person continuing on an adhoc basis, who retires before his case is considered for regular appointment; and</li><li>The relaxation will apply to those cases where an officer has continued on adhoc basis for more than a year without break.</li></ul>



<ol class="wp-block-list" start="4"><li>All Ministries/ Departments may decide the issue of allowing the benefit of ‘split-option’ as a one-time measure, to the eligible and willing officers of CSS cadre who were promoted on adhoc basis and are still in service as on the date of issue of this O.M. on a case to case to basis, in consultation with their Financial Advisers and subject to fulfillment of above conditions and other conditions prescribed under the Rules.</li><li>This issues with the concurrence of the Department of Expenditure vide their I.D Note No.03-10/ 2020-E-III(A) dated 23.07.2020.</li></ol>

<p>The undersigned is directed to say that 10(ten) posts of Assistant(Excluded) in Level-7 of  the  <strong>Pay  Matrix (Rs. 44,900- 1,42,400/-)</strong> is proposed to  be filled up on deputation basis in the Ministry of Defence (Secretariat) initially for a minimum period of  three years, from amongst the following:- </p>



<ul class="wp-block-list"><li>Assistant Section Officers (erstwhile Assistant) of the Central Secretariat Service (CSS) in  Level-7 of  the Pay Matrix (Rs. 44,900- 1,42,400/-), or</li><li>Senior Secretariat Assistants (erstwhile Upper Division Clerk) of the Central Secretariat Clerical Service in  Level-4 of  the Pay Matrix (Rs. 25,500-81,100/-) with ten years of regular service in the grade and who have undergone training in Cash and Accounts in the  Institute of Secretariat Training and Management (ISTM) or equivalent training course conducted by  any   other training institution and  possesses three years of  experience in cash, accounts and budget work; </li><li>Senior Auditors of Defence Accounts Department in Level-6 of the Pay   Matrix (Rs. 35,400-1,12,400/-);</li><li>Auditors of  the  Defence Accounts Department in Level-5 of  the   Pay Matrix (Rs. 29,200- 92,300/-) with six  years regular service in the  grade;</li></ul>



<p>2. In addition to  the  above, it may be  noted that   the  period of  deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/ Department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by  deputation shall not exceed fifty six years as on the closing date of receipt of applications.</p>



<p>3. Applications in the attached proforma (Annexure-I) from willing and eligible officials and whose services can be  spared, may be forwarded by  the Employer/ Cadre Controlling Authority with duly filled-in certificate (Annexure-II) to this office within 45 days from the date of publication of the advertisement in  Employment News along with attested photocopies of up-to-date APAR dossiers for the last five years. Application received after the due date or found incomplete will not be considered.</p>

<p>Subject: <strong>3rd Cadre Restructuring of Central Secretariat Service (CSS) &#8211; reg.</strong></p>
<p>The undersigned is directed to say that the Government had set up a Committee on Cadre Restructuring of Central Secretariat Service (CSS) in April 2013. The Committee submitted its Report in December 2013. The report of the Committee has been approved by Government.</p>
<p>2. Following decisions have been taken:</p>
<blockquote><p>i) Creation of posts as under:</p>
<p><strong>(a) 150 posts in the grade of Deputy Secretary in the Central Secretariat-75 posts each for Central Secretariat Service (CSS) and Central Staffing Scheme (CSt.S); As a one-time measure, 75 posts recommended for Central Staffing Scheme may also be filled by CSS officers and these posts would revert to CStS in tranches &#8211; 35 and 40 each in consecutive select list period i.e. from, 01.07.2017 to 30.06.2018 and from 01.07.2018 to 30.06.2019.</strong></p>
<p><strong>(b) 232 posts in the grade of Under Secretary in CSS on Desk pattern;</strong></p>
<p><strong>(c) 463 posts in the grade of Section Officer in CSS on Desk pattern.</strong></p>
<p>(ii) These posts recommended to be created represent only a ceiling which is considered sufficient for the next 10 years and would actually be operationalized on receipt of proposals from Departments and on their examination by a Committee of Joint Secretaries of DoPT and Department of Expenditure.</p>
<p>(iii) The posts created at Section Officer and Under Secretary levels are to be operated on Desk Pattern. Operating the posts on Desk Pattern does not require conventional sections and much supporting staff.</p></blockquote>
<p>3. All Ministries/ Departments viz., the cadre units of CSS are requested to send their requirements of the posts in the above mentioned grades with full justification and with the approval of the concerned Minister- in- Charge to this Department positively by <strong>3rd October, 2017</strong>.</p>
<p>4. On receipt of the proposal from the Ministries/ Departments, the matter will be examined by the Committee comprising of Joint Secretaries of DoPT and Department of Expenditure. Based on the recommendation of the Committee, further action will be taken by this Department for the opertionalization / allocation of the posts amongst the Cadre Units.</p>
<p>5. To ensure timely action, the Cadre Units are requested to furnish the requisite information expeditiously and within the stipulated time frame.</p>

<p>Approval of the President is hereby conveyed for promotion of 12 Section Officers of Central Secretariat Service (CSS) to Grade-I (Under Secretary) of CSS in PB-3 (Rs.15600-391 00) with Grade Pay of RS.6600/- purely on &#8216;ad-hoc&#8217; basis for a period up to 31.12.2015 or till the posts are filled up on regular basis, or until further orders whichever is earlier. The &#8216;ad-hoc&#8217; promotion is subject to the following conditions:</p>
<blockquote><p>
(i) The ad-hoc promotion shall not confer any right to continue in the grade indefinitely or for inclusion in the Select List for regular appointment or to claim seniority in the Grade I of the CSS.<br />
(ii) Ad-hoc appointments may be terminated at any point of time without giving any reason there for.<br />
(iii) The appointment on ad-hoc basis will take effect from the date of assuming the charge of the post of Under Secretary in the Ministry/Department to which the officer has been allocated.<br />
(iv) The service rendered on ad-hoc basis in the Under Secretary grade would not count for the purpose of seniority in that grade or for promotion to the next higher grade.<br />
(v) The appointment is subject to vigilance clearance in terms of DoPT&#8217;s OM No.22034/4/2012-Estt.(D) dated 02.11.2012 and other relevant instructions on the subject. The Ministry/ Department where the officer is working should relieve him/her or promote him/her only after verifying that no disciplinary proceedings are pending or contemplated against the officer.<br />
(vi) The Officers, who have not undergone mandatory Level &#8216;0&#8217; Training as enjoined in Cadre Training Plan for the CSS, will have to undergo the aforesaid training as per nominations made by this Department.<br />
(vii) No request for retention of the Officers who are transferred on promotion would be entertained.</p>
<p>(viii) The officers who fail to avail ad-hoc promotion would not be considered for ad-hoc promotion for a period of one year from the date of issue of this promotion order.<br />
(ix) Officers undergoing any training other than mandatory training under CSS (CTP) will not be allowed proforma promotion and the officer has to join the post to avail promotion. In this regard attention is invited to this Department&#8217;s O.M. No. 21/3/2015-CS.I(P) dated 19.3.2015.</p></blockquote>
<p>2. The posting of officers on their promotion is as shown against their names in the Annexure to this OM. Allocation has been made in terms of the revised Rotational Transfer Policy for CSS Officers.<br />
3. The Officers promoted vide this order will be required to join the allocated Ministries/ Departments by 30.11.2015 and failure to do so may attract punitive action by DoPT. It will also be incumbent upon the Ministry/ Department and the officer concerned not to draw salary beyond the stipulated date. If any Officer fails to join by the stipulated date, the promotion order is liable to be cancelled.</p>
<p>Officers covered in this order and presently on deputation should repatriate to the cadre immediately to avail promotion, failing which promotion order will be cancelled.<br />
4. Notification appointing the officers will be issued by the Ministry/Department and a copy of the notification issued should be endorsed to this Department.<br />
5. Web Based Cadre Management System: Promotion of officers have been reflected in the Web Based Cadre Management System. Accordingly, relieving/ joining of officers should be immediately updated in the Transfer module of the Web Based Cadre Management System hosted at cscms.nic.in. This is the responsibility of the nodal officers concerned.<br />
6. This issues with the approval of the Competent Authority.</p>

The competent authority has approved the recommendations of the DPC which met on 30.09.2015 to consider Officers of the Grade I of CSS for inclusion in the Select List of Selection Grade (Deputy Secretary) of CSS for the year 2011.<br />
2. The Select List of Selection Grade (Deputy Secretary) of CSS for the year 2011 is at Annexure. The panel size for DSSL 2011 is 131. However, Officers in excess of the panel size have been placed in DSSL 2011 to fill up retirement vacancies that had arisen during the panel year 2011.<br />
3. Two vacancies have been kept in respect of Sh. Niraj Kumar (CSL No. 4649-A) and Sh. S. Shankar (CSL No.4784) for further follow-up action.</p>
<p>3. The inclusion Of Officers in DSSL 2011 is subject to final outcome of Writ Petitions No. 6597/2012 and 3003/2013 pending before the Honourable High Court of Delhi and also subject to any Orders of any other competent Court in any connected matter.</p>

<p style="text-align: center;"><strong>ORDER</strong></p>
<p>Approval of the President is hereby conveyed for promotion of 48 Section Officers of Central Secretariat Service (CSS) to Grade-I (Under Secretary) of CSS in PB-3 (Rs.15600-391 00) with Grade Pay of RS.6600/- purely on &#8216;ad-hoc&#8217; basis for a period up to 31.12.2015 or till the posts are filled up on regular basis, or until further orders whichever is earlier. The &#8216;ad-hoc&#8217; promotion is subject to the following conditions:</p>
<blockquote><p>
(i) The ad-hoc promotion shall not confer any right to continue in the grade indefinitely or for inclusion in the Select List for regular appointment or to claim seniority in the Grade I of the CSS.</p>
<p>(ii) Ad-hoc appointments may be terminated at any point of time without giving any reason there for.</p>
<p>(iii) The appointment on ad-hoc basis will take effect from the date of assuming the charge of the post of Under Secretary in the Ministry/<br />
Department to which the officer has been allocated.</p>
<p>(iv) The service rendered on ad-hoc basis in the Under Secretary grade would not count for the purpose of seniority in that grade or for promotion to the next higher grade.</p>
<p>(v) The appointment is subject to vigilance clearance in terms of DoPT&#8217;s OM No.22034/4/2012-Estt.(D) dated 02.11.2012 and other relevant instructions on the subject. The Ministry/ Department where the officer is working should relieve him/her or promote him/her only after verifying that no disciplinary proceedings are pending or contemplated against the officer.<br />
(vi) The Officers, who have not undergone mandatory Level &#8216;O&#8217; Training as enjoined in Cadre Training Plan for the CSS, will have to undergo the aforesaid training as per nominations made by this Department.</p>
<p>(vii) No request for retention of the Officers who are transferred on promotion would be entertained.</p>
<p>(viii) The officers who fail to avail ad-hoc promotion would not be considered for ad-hoc promotion for a period of one year from the date of issue of this promotion order.</p>
<p>(ix) Officers undergoing any training other than mandatory training under CSS (CTP) will not be allowed proforma promotion and the officer has to join the post to avail promotion. In this regard attention is invited to this Department&#8217;s O.M. No. 21/3/2015-CS.I(P) dated 19.3.2015.</p></blockquote>
<p>2. The posting of, officers on their promotion is as shown against their names in the Annexure to this OM. Allocation has been made in terms of the proposed revised Rotational Transfer Policy for CSS Officers.</p>
<p>3. The Officers promoted vide this order will be required to join the allocated Ministries/Departments by 27.07.2015 and failure to do so may attract punitive action by DoPT. It will also be incumbent upon the Ministry/Department and the officer concerned not to draw salary beyond the stipulated date. If any Officer fails to join by the stipulated date, the promotion order is liable to be cancelled. Officers covered in this order and presently on deputation should repatriate to the cadre immediately to avail promotion, failing which promotion order will be cancelled.</p>
<p>4. Notification appointing the officers will be issued by the Ministry/Department and a copy of the notification issued should be endorsed to this Department.<br />
5. Web Based Cadre Management System: Promotion of officers have been reflected in the Web Based Cadre Management System. Accordingly, relieving / joining of officers should be immediately updated in the Transfer module of the Web Based Cadre Management System hosted at cscms.nic.in. This is the responsibility of the nodal officers concerned.</p>
<p>6. This issues with the approval of the Competent Authority.</p>

<p><b>Officers thank MoS DoPT for speedy promotions</b></p>
<p>A delegation of officers belonging to Central Secretariat Service (CSS) called on the Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh, here today, to thank him and convey their gratitude for speedy disposal of their promotion cases leading to empanelment of as many 37 officers in one go to the post of Joint Secretary to the Government of India and consequent promotion of 27 officers to the level of Joint Secretary on in-situ basis.</p>
<p>Acknowledging their gratitude, Dr. Jitendra Singh congratulated them and reiterated Shri Narendra Modi Government’s resolve to make governance easy and at the same time make the environment work-friendly for the officers. The government is in favour of doing away with avoidable delays in promotions and empanelments so that the officers can work with enthusiasm and a positive frame of mind.</p>
<p>With the passage of time, Dr. Jitendra Singh said, the pressure on officers has increased because of the increased expectations on one hand and on the other hand increased scrutiny by public as well as media. But, instead of grudging this changing scenario we would have to learn to adapt to it and do our best because transparency and accountability are prime areas of emphasis of Shri Narendra Modi Government.</p>
<p>Meanwhile, in order to deal with the stress of the officers, Department of Personnel &amp; Training (DoPT) has, of late, started a number of new measures including regular daily ‘Yoga’ for officers across the country from 1st of April. Similarly, the DoPT will also contemplate various steps to improve the facilities and privileges available to IAS Officers coming on deputation to union capital so that they need not find themselves at a disadvantage on account of issues related to transport facility, admission of their children in schools, etc.</p>
<p>Dr. Jitendra Singh said, the launch of “Digital India Week” by the Prime Minister on 1st July is also a step towards making the governance easy and reducing the file work pressure on the officers, besides also avoiding unnecessary delays or harassment to the common citizen.</p>
