<blockquote><p><strong>Central Pay Commissions and Central Government Employees…</strong></p></blockquote>
<p>Generally, Central Government Employees who works in different ministries and departments under the Central Government, play major roles in the smooth functioning of the country. Employees under different departments work so hard to maintain law and order, stabilizing the economy, security to the people and defending our nation from enemies. Even though they are not large in numbers, their work during major crisis like natural calamities, earthquake and floods, stands apart. They are even asked to work 24 hours a day on all working days during emergencies. Our Defence Forces have done breathtaking efforts and marvellous work to evacuate Indian citizens from foreign countries which are under civil wars. They are bold enough to cross the border of our neighbouring country to fight against terrorists who had earlier ambushed and killed our security forces. Everyone must be proud of our defence forces for their bravery and skills.</p>
<p>Students after completing their tough academic career in different streams, keeps their first preference to get a government job. Though the pay packages are lower than multinational companies, they think that government jobs give more security to them.</p>
<p>As everyone knows that the pay and allowances for the central government employees are fixed by the central government as per the recommendations of Central Pay Commissions (CPCs). The central government constitutes Pay Commissions by appointing highly placed personalities as Chairman and Members. The commission then studies the economic conditions, day today difficulties of employees, their ideas etc., and give its recommendations to revise pay packages for the employees in every ten years. The commission submits its recommendations to the central government and the government in turn, takes final decision to implement the Pay Commission. Usually, the commission is given 18 months time to submit its report on the recommendations on pay revision:</p>
<p><strong>PAY COMMISSIONS:</strong></p>
<p>The First Pay Commission was appointed on May 1946, and it submitted its report in May 1947.<br />
The Second CPC was appointed on August 1957, and it submitted its report in August 1959.<br />
The Third CPC was appointed on April 1970, and it submitted its report in March 1973.<br />
The Fourth CPC was appointed on June 1983, and three reports were submitted in June 1986, December 1986 and May 1987 respectively.<br />
The Fifth CPC was appointed on April 1994, and submitted its report in January 1997.<br />
The Sixth CPC was appointed on October 2004, and submitted its report in March 2008.</p>
<p><strong>SEVENTH PAY COMMISSION:</strong></p>
<p>The Seventh Central Pay Commission was constituted on the 28th of February 2014 under the Chairmanship of Justice Shri Ashok Kumar Mathur, Shri Vivek Rae as full time member and Smt. Meena Aggarwal as Secretary. The Commission has been given 18 months from the date of its constitution to make its recommendations.</p>
<p>From the date of its constitution, the commission travelled all over the country meeting different delegates, officers, trade union leaders, associations, employees etc., under different departments to take stock of the economic conditions faced by the employees and the impact of rising prices of essential commodities on them.</p>
<p>Finally, the Chairman of the 7th CPC in their final meeting with the National Council JCM, has said that Commission will submit its report to the central government in September 2015. Points regarding the implementation of the 7th CPC were discussed. The Chairman denied any proposal to implement the recommendations from 01.01.2014 and said that the revised pay structures and recommendations will be implemented from 01.01.2016.</p>

<p>Subject : <strong>Working in the establishments under the Ministry of Defence in implementation of Hon. C.A.T. Jodhpur Order dated 5 Nov 2009.</strong></p>
<p>Sir,</p>
<p>I am directed to say that the consolidated orders on the subject of Night Duty Allowance were issued by the Department of Personnel and Training vide their OM No.12012/4/86-Estt(Allowances) dated 4th Oct, 1989, in terms of sub para (2) of para(2) of Para 2 of this OM, Night Duty Allowance is to be computed taking into account the rates of pay including Dearness Allowance and CCA, in force on the basis of the recommendations of the 4th Central Pay Commission. However, these rates have not been revised on the basis of the pay structure that came into force after the report of 5th and 6th Central Pay Commissions.</p>
<p>2. Aggrieved by this non-revision of the rates of NDA, a number of applications have been filed by the Defence Civilian employees in various Courts/Tribunals. In OA No.34/2008, filed by Shri Ram Kumar &amp; Others Hon. Central Administrative Tribunal, Jodhpur Bench passed orders dated 5 Nov 2009 in favour of the applicants. The appeals filed by the Union of India in the Hon’ble High Court of Rajasthan (DB Civil WP No.9927/2010) and in the Supreme Court order (Sup No.8276/2012) against the above Order dated 5 Nov, 2009 of Hon Court Jodhpur Bench, were dismissed on 1 Aug 2011 on 1 Aug 2011 and 8 May 2012 respectively.</p>
<p>3. The issue of payment of NDA at revised rates to the eligible Defence Civilian Employees, has been examined in the MoD in consultation with Ministry of Finance (Deptt of Expenditure), Deptt of Personnel &amp; Training and Ministry of Law and justice in the light of the observations made by MoF(DoE), DoP&amp;T and Min L&amp;J, a conscious decisions has been taken with the approval of Competent Authority in Ministry of Defence to make payment of the Night Duty Allowance to the eligible Defence Civilian employees (Industrial and non-industrial employees), based on the revised pay and allowances drawn by them w.e.f. 1st Jan 2006 and payment of arrears from April, 2007 in terms of Hon.C.A.T., Jodhpur Bench order dated 5 Nov, 2009 in OA No.34/2008 filed by Shri Ram Kumar &amp; Others, as upheld by the Hon’ble Supreme Court of India.</p>
<p>4. All other terms and conditions as laid down in the MoD ID No.6(4)/88/D(Civ-I) dated 12 Oct 1989 and dated 15 March 1990, as amended from time to time shall remain unchanged.</p>
<p>5. This issues with the concurrence of Ministry of Defence (Fin) vide their ID BNo.89/AG/PB dated 8th May 2015.</p>

<p>Dear friends,</p>
<p>More than two dozen comments have been posted on the JCM Staff Side memorandum, recommending upgradation of Grade Pay of LDC, published in this web site. Most of the LDCs working in various Departments, posted comments are stated that they are doing duties of higher posts with Rs. 1900 Grade pay. A person who is working in the KVS has written that in his Organization LDCs are doing duties of UDC and LDC both because in maximum offices single LDCs are posted and they are compelled to complete the work by sitting extra time. (Our opinion is that the Staff Associations of the KVS should demand for increased sanction of Administrative Staff in accordance with the work load and also for an immediate cadre restructuring for the Administrative Staff. According to the recommendations of the Central Pay Commissions cadre restructuring should be done in every five years).</p>
<p>&nbsp;</p>
<p>It is no doubt that LDC &amp; UDC are the backbone of the Government Offices especially the subordinate offices and they should get a respectable pay scale. Since the 6th Pay Commission has raised the Educational and technical qualification for the post it has become an anomaly and that is why this Association has taken up the issue to the higher authorities and as such the issue gained popularity. Resultantly, Confederation and JCM Staff Side was forced to recommend upgraded grade pay for LDCs in their Memorandum to the 7th Pay Commission. Moreover, Department of Expenditure was compelled to issue a common circular for upgradation of Grade Pay of LDC &amp; UDC at Department level through restructuring. But the said order was not adequate to meet the demand and as such we have filed a case in CAT Jabalpur. Some of our friends proposed to take up the issue to the Prime Minister &amp; Finance Minister again. Several of our friends writing comments have proposed to call a strike on the issue of upgradation of the Grade Pay of LDC &amp; UDC. Both are not the demand of the time, I think. As regards to writing letter to Prime Minister, we had already written a letter to the then Prime Minister and same was forwarded to the DoPT and what action has been taken on it by the DoPT, JCA &amp; Ministry of Finance, all are before us. If we sent another letter to the present Prime Minister it will also go through the routs in which our previous letter was travelled. As regards the calling of strike it is only possible when there is a Federation of Ministerial Staff Association representing the entire Ministerial Staff persists and taking a decision unanimously. You all are aware that I had requested all our friends to come to Delhi in support of the Confederation Dharna on 9th January 2014 so that we may put up the issue effectively before the Confederation. But nobody except some leaders of Delhi State Government Administrative Staff Association has come to attend the Dharna. Thus conducting a strike, even a Department level strike, is not as easy as the comment writers think.</p>
<p>Some of our friends have written that large number of posts of LDC &amp; UDCs are lying vacant in their Department and is not filling up the vacancy by the authorities. This should be tackled at their Department level itself. Staff Associations of the respective Department should take initiative for the same.</p>
<p>As regards the case filed by us in the CAT Jabalpur, we have filed the same with an intention to send a message regarding the seriousness of the issue to the Government, 7th Pay Commission and the JCM Staff Side. As a result JCM Staff Side has discussed the matter and accordingly the recommendation for the upgradation of the Grade Pay of LDC has been sent to the Pay Commission. In order to defend the payment of Rs. 2400 Grade Pay to DEO, DoPT has recently issued a revised model recruitment rule for the DEO. And yet, I am sure, 7th Pay Commission will definitely consider the upgradation of Grade Pay of LDC in its report. The case filed in the CAT Jabalpur will go on for a favorable decision so as to get the upgraded Grade Pay to LDC w.e.f. 1.1.2006.</p>
<p>As regards granting of Rs. 4200 Grade Pay to UDCs, all Associations are requested to send the proposal in their memoranda to the 7th Pay Commission on the ground that UDCs are assigned with the duties of Assistants in most of the subordinate offices as the sanctioned posts of Assistants in these offices is far less than the actual requirement.</p>
<p><strong>Confederation’s Memorandum to 7th CPC:</strong><br />
Confederation has proposed to submit a separate Memorandum to 7th Pay Commission. Even though the LDC &amp; UDC issue, submitted by us have been incorporated in the JCM Staff Side Memorandum, any Association is willing to put up anything new regarding to the upgradation of the LDC/UDC and issues related to other administrative Staff and the cadres of common category including MTS may please send their proposal to the Confederation in the following e-mail id by 14th of this month.</p>
