<p>A meeting of NJCA along with constituent organizations of National Council JCM and other organizations of Central/State Government Employees, Autonomus bodies and Teachers Organization was held at AIRF Office, New Delhi on 07.01.2023 to discuss and decide a serious agitational programme for scrapping of NPS and restoration of OPS.</p>



<p>After a detailed discussion it was decided to hold One National Convention at New Delhi on 21.01.2023 at Pyare Lal Auditorium, ITO New Delhi in which the final programme of action and resolution will be passed.</p>



<p>Before that on 12th January 2023, it was decided to organize public awareness programme by holding Gate Meeting at all offices and wide publicity through Main Media and Social Media.</p>



<p>All Confederation Office Bearers, Chief Executives of Constituent Organizations and General Secretaries of State COCs are requested to organize 12th January 2023 programme and take part in National Convention alongwith some office bearers.</p>

<h3 class="wp-block-heading"><strong>Subject: Payment of amount of Ex-Gratia lump sum compensation to the families of Central Government servants who die in the performance of bona fide official duty- Provision for nominations regarding.</strong></h3>



<p>The undersigned is directed to say that the families of Central Civil Government servants, who die in harness in the performance of their bona fide official duties under various circumstances, are entitled to payment of ex-gratia lump sum compensation in accordance with this Department’s OM No. 45/55/97- P&amp;PW(C) dated 11th September, 1998. The amount of ex-gratia lump sum compensation has been revised from time to time. The existing rates of ex-gratia lump sum payment are specified in this Department’s OM No. 38/37/2016-P&amp;PW (A) dated 04.08.2016.</p>



<p>2. The existing instruction, however, do not specify the member of the family to whom such ex- gratia lump sum compensation is payable in the event of death of the Government servant in the performance of bona fide duty. Therefore, in terms of para 13 of the guiding principles mentioned in the Annexure to the OM No. 45/55/97-P&amp;PW(C) dated 11th September 1998, payment of ex-Gratia lump sum compensation is presently being made to the member of the family who is eligible for extraordinary family pension under the CCS (Extraordinary Pension) Rules, 1939.</p>



<p>3. The matter has been examined in consultation with Ministry of Finance (Department of Expenditure). On death of a Government servant, payment of other lump sum amounts, such as death gratuity, GPF balance and CGEGIS amount, is made in accordance with the nominations made by the Government servant during service. Accordingly, it has been decided that, on death of a Government servant in the performance of bona fide duty also, payment of ex-gratia lump sum compensation may be made to a member or members of the family in whose favour a nomination is made by the Government servant during service. Family for this purpose shall have the same meaning as in the case of gratuity and it shall include the members of family as mentioned in sub-rule (6) of Rule 50 of the CCS (Pension) Rules, 1972.</p>



<p>4. The Common Nomination Form in Form 1 appended to the CCS (Pension) Rules, 1972 has been amended to include the nomination in respect of the ex-gratia lump sum payment and the same is enclosed. Accordingly, nomination in respect of ex-gratia lump sum payment shall also be made in this Common Nomination Form. The nomination for ex-gratia lump sum payment shall be subject to the provisions as applicable in the case of gratuity under Rule 53 of the CCS (Pension) Rules, 1972. Since the ex-gratia lump sum payment is payable to the family only, no nomination shall be made in favour of a person who is not a member of the family, even where the Government servant has no family. If no nomination has been made or the nomination made by the Government servant does not subsist, the ex- gratia lump sum compensation will be shared equally by all eligible family members, as in the case of Gratuity, in accordance with Rule 51 of the CCS (Pension) Rules.</p>



<p>5. These instructions shall be applicable in the case of the death of a Government servant on or after the date of issue of this OM. Cases of payment of ex-gratia lump sum compensation on death of Government servants before the date of issue of this OM shall continue to be dealt with in accordance with the instructions applicable before the issue of this OM.</p>



<p>6. This OM is issued with the concurrence of Ministry of Finance, Department of Expenditure vide their ID Note No. 27(1)/E-V/2020, dated 22.07.2021.</p>



<p>7. In its application to persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller and Auditor General of India vide their U.O. No. 211-Staff -Hak (Rule)-A.R/09-2019 dated 13.09.2021.</p>



<p>8. The Administrative Divisions of all Ministries/ Departments and attached/ subordinate offices are requested to bring the contents of these instructions to the notice of all concerned for compliance.</p>



<p>9. Formal amendment to CCS (Pension) Rules, 1972 for amending Form 1 appended to those rules shall be notified separately.</p>

<p>Subject: <strong>Introduction of short duration protocol Yoga break (Y-Break) for people at work place-regarding</strong></p>



<p>Ministry of AYUSH informed that they have designed &amp; developed Five Minutes duration Yoga Protocol, named Y-Break for work place by an Expert Committee in the year 2019 and the module was launched in January, 2020 on Pilot Project basis in 6 major Metro cities (Delhi, Mumbai, Chennai, Bangaluru, Hyderabad and Kolkata) with the help of various stakeholders. Feedback of the same was very encouraging.</p>



<ol class="wp-block-list" start="2"><li>Consequent to above success, Ministry of Ayush developed an android based application Y Break and the same was made available recently in Google Play Store for access by public. A campaign was launched to spread awareness of the same to provide access &amp; usage of Y-Break Protocol/App among people at work places with a view to refresh, de-stress and refocuses them with enhanced efficiency and productivity at workplaces.</li><li>In order to spread awareness about access &amp; usage of Y-Break Protocol/App among workforce for all sectors (Public/Private), all Ministries/ Departments of Government of India are requested to promote the usage of Y-Break Protocol among the employees and accordingly issue necessary directions/ guidelines for all employees including employees of attached and subordinate offices to download the android based application namely Y-Break from Google Play Store.</li></ol>

<p>MoD vide Para 2 of the <a href="https://centralgovernmentnews.com/date-of-next-increment-rule-10-of-army-air-force-navy-officers-and-military-nursing-service-pay-rules-2017/">OM No.1(20)/2017/ D(Pay/Services) – Part–I dated 02.11.2020</a> has stated that the provisions contained in Para 6 of MoF OM No.4- 21/2017-IC/E/IIIA dated 28.11.2019 will be mutatis – mutandis applicable to the Defence Service Officers also provided all the conditions and stipulations laid down therein are strictly fulfilled.</p>



<p>2. As per the provisions laid down in Para 6 of MoF letter dated 28/11/2019, “The opportunity to exercise of an option for pay fixation under FR 22(I)(a)(1) is available to employees in case of promotional/ financial upgradation. Therefore, the Central Govt Employee promoted on a regular basis/granted financial upgradation on any date other than the date of his/her annual increment in a lower grade and exercises the option under FR 22(I)(a)(1) read with <a href="http://documents.doptcirculars.nic.in/D2/D02est/13_02_2017-Estt.Pay-I-27072017.pdf" target="_blank" rel="noreferrer noopener">DOPT’s OM No.13/02/2017-Estt.(Pay-I) dated 27/07/2017</a> for fixation of pay from the date of accrual of next increment in the scale of pay in a lower grade, he may be allowed the 1st increment in promotional grade on 1st January /1st July as the case may be after completion of 6 months qualifying service after such fixation on 1st July/1st January (i.e. the date of increment in lower grade) on the analogy of Deptt of Expenditure’s OM dated 31/07/2018. The next increment, thereafter, shall, however, accrue only after completion of one year”.</p>



<p>3. In light of the above provisions contained in Govt orders, this office is taking action to grant the first increment on completion of six months qualifying service in promotional grade, after fixation of pay on promotion from DNI, in respect of officers who have already exercised their option on promotion and also those who have re- exercised their option by 01/12/2020 as per ibid MoD letter. This work is being carried out in a phased manner.</p>



<p>4. This is put up for the kind information of the Army Officers, so that raising of queries on the above issue by the officers, may please be minimized/ avoided.</p>

<p>This year’s Bonus to Central Government Employees is not yet declared by the Central Government. Normally, every year Bonus is declared before the second week of October. We suspect some hidden agenda behind the deliberate delay on the part of the Government. From 1978 onwards Central Government Employees are paid Bonus without any interruption. Bonus is a product of historic strike of Railway employees under the banner of Railway Federations and other Central Government Employees under the banner of Confederation of Central Government Employees and Workers. Any attempt to deny Bonus under any pretext cannot be tolerated.</p>



<p>Confederation of Central Govt. Employees and Workers calls upon the entirety of Central Government Employees including Gramin Dak Sevaks <strong><a href="https://centralgovernmentnews.com/tag/GDS/" target="_blank" rel="noreferrer noopener">GDS </a></strong>to hold protest demonstrations all over India at all centres and also in front of all offices (observing Covid protocol) on 20th October 2020, Tuesday. Railway Federations have also given a similar call for protest demonstrations on 20.10.2020. Let us be ready for strike with short notice if circumstances demand.</p>

<p>The undersigned is directed to refer to the subject cited above and to say that a number of requests have been received from the officers who have returned India after completing the foreign training programs under Domestic Funding of Foreign Training (DFFT) Scheme regarding reimbursement of the quarantine charges incurred by the officers on being quarantined /isolated due to <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID -19</a> pandemic.</p>



<p>2. The matter has been examined in this Division in consultation with IFD (Home) and it has been decided with the approval of the competent authority that the reimbursement of the lodging and boarding charges, if any, incurred as quarantine charges by the officer in respect of himself /herself may be considered for reimbursement by the concerned sponsoring organization viz. Central Ministries /Departments/ State Governments/ UTs /concerned Organizations on production of the invoices and payment receipts etc. subject to ceiling limit of quarantine charges Irate of Government (Centre or State Government owned) quarantine centers and fulfillment of prevailing Rules/Guidelines etc. on this subject.</p>

<p><strong>DOP&amp;T vide their O.M.No.12/02/2017- Estt (Pay-I), dated 5th August, 2020</strong> have issued certain guidelines on Protection of pay to the <a href="https://centralgovernmentnews.com/" target="_blank" rel="noreferrer noopener">Central Government Servant</a> consequent to appointment to a new post in different service or cadre in Central Government, through direct recruitment where either higher duties and responsibilities are involved or not, as the case may be, under FR 22- B(1) (Rule 1315 of IREC Vol.II), in the 7th CPC Scenario. A copy of the same is sent herewith for information/guidance. These orders will apply <a href="https://centralgovernmentnews.com/tag/mutatis-mutandis/" target="_blank" rel="noreferrer noopener">mutatis-mutandis</a> to Railway employees also.</p>

<p><strong>HOLD PROTEST DEMONSTRATIONS IN FRONT OF ALL CENTRAL GOVERNMENT OFFICES.</strong></p>



<p>The Central Government has announced deregulation and privatisation of core and strategic sectors like Defence production, Space Research, Power, Civil aviation, Coal and mineral sectors. It is also declared by the Finance Minister that non – strategic public sector undertakings will also be privatised. Govt is implementing its political agenda by going ahead with the naked and unbridled pro – corporate reforms in all sectors of the economy utilizing the <strong><a rel="noreferrer noopener" href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank">COVID -19</a></strong> crisis. It is wholesale privatisation. Combined with these reforms , serious attempt is made for amending all labour laws in favour of employers. Already some state Governments had promulgated ordinances in this direction suspending all labour laws and increased the working hours from eight to twelve hours per day. The Government has cleverly linked these reforms with the 20 lakhs crore economic package announced by the Prime Minister , eventhough these reforms have nothing to do with the stimulus packages and relief measures to be provided to the agricultural and industrial sectors and common people of our country. Needless to say that these pro – corporate reform measures and labour law amendments will severely affect the life and livelihood of crores of workers and common people of our country. Central Government employees are no exception.</p>

<p>Regarding Defence sector , the Defence employees federations were already opposing the move of the Government to corporatise and privatise the Ordnance factories. They have conducted month &#8211; long relay dharma at Parliament street, New Delhi and five days all India strike . Government had earlier deferred the Corporatisation move due to stiff resistance from five lakhs defence employees. Knowing the present limitations of the unions to organise serious agitational programmes like strike during Covid &#8211; 19 restrictions , the Government has unilaterally declared the corporatisation of Ordnance Factory Board ( OFB). Raising the Foreign Direct Investment (FDI) in <a rel="noreferrer noopener" href="https://centralgovernmentnews.com/category/defence/" target="_blank">defence</a> sector from 49 to 74% will pave way for entry of multinational foreign Corporations in defence production sector , which , in the long run will jeopardise the national security of our country and job security of the employees.</p>



<p>In the coming days , more attacks are to come in almost all sectors including Central Government Employees sector. Already many departments have initiated action in this regard as per the advice of NITI Ayog. Closure of Government of India printing presses, outsourcing of Government functions in many departments , large scale contractorisation , casual labour engagement and downsizing has become the order of the day. Central Government Employees, especially Confederation of Central Govt Employees and Workers had organised series of struggle programmes against these onslaughts , including strike.</p>

<p>The Central Trade Unions have unanimously decided to combat these onslaughts of the Government by all possible means. As a first phase , it is decided to organise NATIONWIDE PROTEST DAY ON 22nd MAY 2020. Confederation being an integral part of the mainstream of the working class of .India, has endorsed the call of the Central Trade Unions.</p>



<p>Accordingly , the National Secretariat of Confederation of Central Govt. Employees and Workers calls upon all affiliated organisations and state /District level Coordinating Committees (COCs) to hold protest demonstrations in front of all Central Government offices , strictly observing the Covid – 19 restrictions imposed by Central and State Governments. Minimum permitted number of employees and leaders may sit in front of offices holding placards with demands , with all precautionary measures like masks , social distancing etc. Wide publicity may be given to the programme through print / electronic media and social media.</p>

<p><strong>Subject: Clarification on regularization of absence during COVID-19 lockdown period- reg.</strong></p>



<p>Please refer ISRO HQ Note/ letter No. HQ: ADMN: COVID:20 dated 20.04.2020 seeking clarification with regard to regularization of absence during <strong><a href="https://centralgovernmentnews.com/tag/covid-19/">COVID-19</a></strong> lockdown period imposed by the Government to contain the spread of Corona virus.</p>

<p>2. ISRO HQ proposal has been examined in the Department and following clarifications are issued:</p>

However, no DA to be paid.</td></tr><tr><td>2</td><td>Employees who were on leave prior to issue of lockdown orders (25.03.2020) and the leave ended during lockdown period. Employees available in Headquarters or not.</td><td>Deemed to have joined duty from the Date of expiry of leave.In case of leave on medical grounds, subject to production of fitness Certificate.</td></tr><tr><td>3</td><td>Employees who were on leave prior to issue of lockdown orders (25.03.2020) and the leave ended on 20.03.2020, but could not join duty on 23.03.2020 (Monday}, due to Stoppage of train/bus/flights.</td><td>Deemed to have joined on 25.03.2020, treating the period from 21.03.2020 to 24.03.2020 as leave. Employees shall submit leave application for this period to the concerned leave sanction authority.The absence during the lockdown period i.e. from 25/03/2020 to till lift-off of&nbsp; lockdown period, due to non-availability of public transport facility, shall be treated as Special Casual Leave as stipulated vide Cabinet Secretariat (Department of Personnel), O.M. No. 27/6/71-Estt. (B), dated 01.11.1971.</td></tr><tr><td>4</td><td>Employees who left HQ on week-end, i.e. 20.03.2020, but could not return to HQ on 23.03.2020 due to stoppage of Train/ buses/flights.</td><td>&#8211;</td></tr><tr><td>5</td><td>Employees who were on leave prior to issue of orders on lockdown (25.03.2020) and the leave expiring during the lock down period, but wish to curtail the leave before expiry and join duty.</td><td>Curtailment of sanctioned leave requires approval based on official exigency, which is not normally Envisaged during lock-down period. In some cases, officiating promotion may also have been given to the senior in the lower grade. Further, the offices remain closed, except for essential services. Hence, curtailment of leave may not be agreed to. From the date following the date of expiry of leave, the employee may be deemed to have joined duty, subject to fulfilment of other requirements based on the type of leave availed.</td></tr><tr><td>6</td><td>If an employee is unable to report for duty on lifting of lockdown, due to non-availability of public transport, restrictions on inter-zone/district movement etc.</td><td>May be allowed to work from home till such time public transport facility is restored subject to Government orders on movement of public transport.</td></tr></tbody></table></figure>



<p>3. The DOS/ ISRO Centres/ Units are requested to note the above clarifications for taking appropriate action, if any. <strong>Further, it is to inform that the above clarifications are subject to the clarifications issued by the Nodal Ministry, if any later. In case, the Nodal Ministry advice /clarifications differs from the clarifications issued by DOS, then clarifications issued by Nodal Ministry will prevail over the DOS clarifications.</strong></p>

<p>As already explained, the COVID-19 Pandemic has created an unprecedented for situation, not only in our country, but also across the globe. The Central Government Employees, including Railwaymen, are, however, exerting a lot to combat the situation, and the Railwaymen are working hard 24X7 with full devotion and dedication to maintain uninterrupted supply chain of all the essential commodities and goods, viz. Foodgrains, Sugar, Petroleum, Vegetables, Milk, Medical Items etc. throughout the country, by running large-number of timetabled Goods and Parcel Trains.</p>

<p>You may appreciate that, Hon’ble Prime Minister of India as well as Hon’ble Minister for Railways have repeatedly applauded and praised the contribution of the Railwaymen in this <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> crisis, facing the risk of Coronavirus threat.</p>



<p>While addressing the Nation on 12th May, 2020, Hon’ble Prime Minister has announced a Mega Package for all the sections of the society to combat the COVID-19 Pandemic Crisis to boost the economy as well as morale of the country.</p>



<p>Since Railwaymen are performing their duties to transport aforementioned goods as well as Migrant Workers and have further started operating “Special Trains” for common rail users w.e.f. 12.04.2020, they can in no way be treated less than “COVID-19 Warriors”. As already submitted vide our letter dated 27.04.2020, freezing of Dearness Allowance and Dearness Relief, has proved to be extremely de-motivational rather than boosting their morale by sanctioning some Additional Incentive to them.</p>

<p>I would, therefore, request your goodself that, in the wake of Hon’ble Prime Minister’s announcement of Mega Package of Rupees Twenty Lakh Crore, the orders of freezing Dearness Allowance and Dearness Relief be withdrawn to boost the morale of the Railway Employees and other Central Government Employees who are fighting day-and-night against the COVID-19 Pandemic.</p>



<p>An early action in the matter shall be highly appreciated.</p>
