<p>Will the Minister of FINANCE be pleased to state:-</p>



<p>(a) the main objective of National Pension Scheme;</p>



<p>(b) the age prescribed for availing the benefit of said scheme;</p>



<p>(c) whether all citizens of the country can avail benefit of the scheme or limited retired employees can avail the benefit of the scheme and if so, the details thereof; and</p>



<p>(d) whether this scheme has also been implemented in States and if so, the details of the services provided in Gujarat State so far?</p>



<h3 class="has-text-align-center wp-block-heading"><strong>ANSWER</strong></h3>



<p>The Minister of State (Finance)</p>



<p>(a) The National Pension System (NPS) was introduced by the Government of India to replace the defined benefit pension system. NPS was made mandatory for all new recruits to the Central Government service from 1st January 2004, (except the armed forces in the first stage) and has also been rolled out for all citizens with effect from 1st May 2009, on a voluntary basis. The Government had made a conscious move to shift from the defined benefit, pay-as-you-go pension scheme to defined contribution pension scheme, NPS, due to rising and unsustainable pension bills. The transition aimed at freeing the limited resources of the Government for more productive and socio-economic sectoral development.</p>



<p>(b) NPS is open for subscription to all citizens of India, resident as well as non-resident, aged between 18- 65 years. A person after retiring at the age of 60 years can also join NPS and contribute till the age of 65 years.</p>



<p>(c) All citizens of the country, resident as well as non resident, aged between 18-65 years can subscribe to NPS, and can avail the following benefits under NPS:</p>



<ul class="wp-block-list"><li>i. Contribution up to Rs. 1.50 lakhs made to the NPS Tier-I account are eligible for tax deduction under Section 80CCD (1) and Section 80CCE of the Income Tax Act, 1961. An additional tax rebate of Rs.50000/- is also allowed for contributions made to NPS Tier-I under Section 80CCD (1B) of the Income Tax Act, 1961. The contribution made by an employer to the Tier 1 account of an employee (up to 14% of the salary for Central Government and up to 10% of the salary in case of other employers) is also tax-exempt under Section 80CCD (2) of the Income Tax Act, 1961 subject to a maximum of Rs. 7.50 lakhs under Section 17(2) (vii) of the Income Tax Act, 1961.</li><li>ii. Deduction under Section 80C for the contribution made to Tier II NPS account by Central Government employees for a fixed period of not less than three years, is allowed.</li><li>iii. In accordance with Section 10(12A) of the Income Tax Act, 1961, the entire 60% amount withdrawn as a lump sum is tax-free.</li><li>iv. Partial withdrawal of up to 25% of the subscriber’s own contributions before attaining the age of superannuation is allowed, subject to certain conditions.</li><li>v. Transparency and portability are ensured through online access of the pension account by the NPS subscribers, across all geographical locations, and portability of employments.</li></ul>



<p>(d) As of now all State Governments (except West Bengal) have notified NPS for their employees. Further, as reported by the Central Recordkeeping Agency (CRA), a total of 2,38,599 subscribers from the State Government of Gujarat have joined NPS as on 27.02.2021 and the total Assets Under Management (AUM) for the State Government of Gujarat are Rs.14,152.36 cr.</p>

<p>Subject: <strong>Protection of pay to the Central Government Servant consequent to appointment to a new post in different service or cadre in Central Government, through direct recruitment where either higher duties and responsibilities are involved or not, as the case may be, under FR 22-B(1), in the 7th CPC Scenario &#8211; Regarding.</strong></p>



<p>The undersigned is directed to say that consequent to various references<br />received from Ministries/ Departments on protection of pay under FR 22-B(1), a need has been felt to issue guidelines on the manner of fixation of pay in respect of the Central Government Servant who after technical resignation, is appointed to new post in the different service or cadre in Central Government through direct recruitment where either higher responsibilities are involved or not, as the case may be, in 7th Central Pay Commission scenario.</p>



<p>2. <strong>Provisions of FR 22-B(1) inter-alia provide as under :</strong></p>



<p>&#8220;<strong>P.R. 22-B.(1)</strong> Notwithstanding anything contained in these Rules, the<br />following provisions shall govern the pay of a Government servant who is<br />appointed as a probationer in another service or cadre, and subsequently<br />confirmed in that service or cadre &#8211;</p>



<ul class="wp-block-list"><li>(a) during the period of probation, he shall draw pay at the minimum of the time scale or at the probationary stages of the time scale of the service or post, as the case may be:</li></ul>



<p>Provided that if the presumptive pay of the permanent post on which he<br />holds a lien or would hold a lien had his lien not been suspended, should at<br />any time be greater than the pay fixed under the clause, he shall draw the<br />presumptive pay of the permanent;</p>



<ul class="wp-block-list"><li>(b) on confirmation in the sen/ice or post after the expiry of the period of probation, the pay of the Government servant shall be fixed in the time-scale of the service or post in accordance with the provisions of Rule 22 or Rule 22-C, as the case may be…&#8221;</li></ul>



<p>3. Consequent upon the implementation of 7th CPC Report and CCS (RP)<br />Rules, 2016, the President is pleased to allow protection of pay in the light of the provisions laid down under FR 22-B(1) to Central Government employee who is appointed as probationer in another service or cadre either carrying higher responsibilities or not, as the case may be and subsequently confirmed in that service or cadre, in the manner as illustrated below:</p>



<p><strong>(A) MANNER OF FIXATION OF PAY OF GOVERNMENT SERVANT UNDER<br />FR 22-B(1) CONSEQUENT TO HIS APPOINTMENT IN LOWER POST<br />THROUGH DIRECT RECRUITMENT, WHERE HIGHER DUTIES AND<br />RESPONSIBILITIES ARE NOT INVOLVED</strong></p>



<p>A Central Government Employee on his appointment to a post in lower<br />Level in different service or cadre in Central Government which does not carry duties and responsibilities of greater importance than those attached to the post held earlier by him on regular basis before such appointment and having a provision of probation period in new post, may during probation draw the presumptive pay of the post held earlier by him on regular basis, if it is higher than the minimum of the Time Scale of the new post. He would also draw annual increments on such presumptive pay. However, it is to be ensured that during probation, presumptive pay should always be greater than the pay of the new post after drawl of increment(s). Subsequently, on successful completion of his probation, his pay will be fixed under FR 22(l)(a)(2).</p>



<p>Protection of Pay in the above manner should not, at any of these stages,<br />exceed the maximum of the Level of the new post in Pay Matrix.</p>



<p><strong>Illustration</strong></p>



<p><strong>An officer was drawing pay of Rs.78,500 in Cell 6 in Level 11 (with DNI 01.07.2018) before his appointment to a post in Level 10 on 01.04.2018 which does not carry duties and responsibilities of greater importance than those attached to the post held earlier by him before such appointment. There is a provision of 2 years probation period in new post.</strong></p>



<p>Since the first Cell Value in Level 10 (Rs.56,100) is less than the Last Basic<br />Pay i.e. Rs. 78,500/- in Level 11. Hence during probation, he will draw the<br />presumptive pay i.e. Rs.78,500/- in Level 11 and would also draw annual<br />increments according to the pay drawn in his previous post in Level II.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>On 01 .04.2018- Rs. 78,500 (Level 11)<br />On 01 .07.2018- Rs. 80,900 (Level 11)<br />On 01.07.2019- Rs. 83,300 (Level 11)</strong></p></blockquote>



<p>On successful completion of his probation period and on confirmation w.e.f. 01.04.2020, the pay of the officer would be fixed under FR 22(l)(a)(2). Since no such Cell of Rs. 83,300/- is available in Level 10, his pay would be fixed at next higher cell i.e. Cell 15 in Level 10 at Rs. 84,900 with next date of increment 01.01.2021.</p>



<p><strong>(B) MANNER OF FIXATION OF PAY OF CENTRAL GOVERNMENT EMPLOYEE UNDER FR 22-B(1) CONSEQUENT TO HIS APPOINTMENT TO A POST IN HIGHER LEVEL THROUGH DIRECT RECRUITMENT, WHERE HIGHER DUTIES AND RESPONSIBILITIES ARE INVOLVED</strong></p>



<p>A Central Government Employee on his appointment to a post in higher level in different service or cadre in Central Government carrying duties and responsibilities of greater importance than those attached to the post held earlier by him on regular basis before such appointment and ha ing a provision of probation period in new post, may during probation draw the presumptive pay of the post held earlier by him on regular basis if it is higher than the minimum of the Time Scale of the new post. He would also draw annual increments on such presumptive pay. However, it is to be ensured that during probation presumptive pay should always be greater than the pay of the new post after drawl of increment(s). Subsequently, on successful completion of his probation, his pay will be fixed under FR 22(l)(a)(1).</p>



<p>Protection of Pay in the above manner should not, at any of these stages,<br />exceed the maximum of the Level of the new post in Pay Matrix.</p>

<p>An officer was drawing pay of Rs.58,600 in Cell 10 of Level 7 before<br />his appointment on 01.04.2018 in Level 10 (with DNI 01.07.2018) which<br />carries duties and responsibilities of greater importance than those<br />attached to the post held earlier by him on regular basis before such<br />appointment. There is a provision of 2 years probation period in new post.<br />Since the first Cell Value of Level 10 (Rs. 56,100) is less than the Last Basic<br />Pay drawn in Cell 10 of Level 7 i.e. Rs. 58,600/-, hence during probation, he will draw the presumptive pay of the post held earlier by him on regular basis and would also draw annual increments in the Level 7 of his previous post as shown below:-</p>

<p>On successful completion of his probation period and on confirmation w.e.f.<br />01 .04.2020, the pay of the officer would be fixed under FR 22(l)(a)(1) read with Rule 13 of CCS (RP) Rules, 2016. Accordingly, an increment will be added in his pay in Level 7 and his pay will reach at Rs. 64,100/-. Since, there is no cell value equal to Rs. 64,100 available in Level 10, his pay will be fixed in Level 10 in Cell 6 at Rs. 65,000/- with next date of increment 01.01.2021.</p>



<p><strong>(C) MANNER OF FIXATION OF PAY OF CENTRAL GOVERNMENT<br />EMPLOYEE UNDER FR 22-B(1) CONSEQUENT TO HIS APPOINTMENT TO A POST IN EQUIVALENT LEVEL POST THROUGH DIRECT RECRUITMENT,<br />WHERE HIGHER DUTIES AND RESPONSIBILITIES ARE NOT INVOLVED</strong></p>



<p>A Central Government Employee on his appointment to a post in Equivalent Level in different service or cadre in Central Government through direct recruitment where higher duties and responsibilities are not involved and<br />having a provision of probation period in new post, may during probation draw the presumptive pay of the post held earlier by him on regular basis. He would also get his increments on such presumptive pay. On successful completion of his probation, his pay will be fixed under FR 22(l)(a)(2). However, Protection of Pay in the above manner should not, at any of these stages, exceed the maximum of the Level of the new post in Pay Matrix.</p>

<p><strong>An officer was drawing pay of Rs. 58,600 in Cell 10 of Level 7 before<br />his appointment on 01.04.2018 in the same Level 7 (with DNI 01.07.2018). There is a provision of 2 years probation period in new post.</strong></p>



<p>Since the first Cell Value of Level 7 (Rs. 44,900) is less than the Last Basic<br />Pay i.e. Rs. 58,600/- in Level 7 drawn by Government Servant, hence during<br />probation, he will draw the presumptive pay and also get his increments in the same Level of his previous post as shown below:-</p>

<p>On successful completion of his probation period and on confirmation<br />w.e.f. 01.04.2020, the pay of the officer would be fixed under FR 22(I)(a)(2).<br />Since no increment would be admissible under FR 22(l)(a)(2), there will be no change in his pay on the date of confirmation i.e. 01.04.2020. Accordingly, his pay in Level 7 on 01 .04.2020 would be Rs. 62,200 (Level 7) with next date of increment on 01.07.2020, as Level remains same.</p>



<ol class="wp-block-list" start="4"><li>The above mentioned pay protection under FR 22-B(1) will.be available to the Government servant if he holds a lien on his previous permanent post.</li><li>No stepping up of pay of senior Government servant shall be allowed on the basis of the pay protection granted under FR 22-B(1) to junior Government servants of that particular service/ cadre.</li><li>This order takes effect from 01 .01 .2016.</li><li>In their application to the employees of Indian Audit and Accounts<br />Department, these orders are issued after consultation with the Comptroller &amp; Auditor General of India, as mandated under Article 148(5) of the Constitution.</li><li>Hindi version will follow.</li></ol>

Reversion to old pension scheme</p>
<p>In accordance with the scheme for National Pension System (NPS), as notified vide Ministry of Finance (Department of Economic Affairs)’s Notification No. 5/7/2003-ECB &amp; PR dated 22.12.2003, the System is mandatory for all new recruits to the Central Government service (except armed forces) from 01.01.2004.</p>
<p>Accordingly, as per Rule 2 of the Central Civil Services (Pension) Rules, 1972, as amended on 30.12.2003, these rules are applicable to Government servants appointed to civil posts on or before 31.12.2003. The date on which the vacancies arose or the date on which the examination was conducted for filling up the vacancies is not relevant for deciding the applicability of the Central Civil Services (Pension) rules, 1972.</p>
<p>Ministry of Home Affairs have not sought any advice from Department of Pension and Pensioners Welfare on the question of having a policy to cover the paramilitary personnel appointed after 01.01.2004 under the Old Pension Scheme on the ground that the vacancies arose, or the examination was conducted, in the year 2003. However, a reference was received from Ministry of Home Affairs in a specific case relating to appointments as Sub-Inspector in various Central Para Military Forces after selection in August, 2003 on the basis of an Examination conducted in 2002.</p>
<p>Appointments on the basis of these selections were made in Central Reserve Police Force in 2003 and the candidates appointed were covered by the pension scheme under Central Civil Service (Pension) Rules, 1972. However, in the Border Security Force, offers of appointment on the basis of the same examination/selection were issued in January, 2004.</p>
<p>On a petition filed by some personnel appointed in the Border Security Force on the basis of that examination, Hon’ble High Court of Delhi directed to cover the petitioners under the Central Civil Service (Pension) Rules, 1972 on the grounds of administrative delay on the part of Border Security Force in making appointments.</p>
<p>The order of Hon’ble High Court of Delhi was implemented by the Ministry of Home Affairs/Border Security Force in view of the peculiar circumstances of that case. The decision taken in that case is, however, not relevant for deciding applicability of Central Civil Service (Pension) Rules to all appointments made on or after 01.01.2004 in the Central Para Military Forces or in any other Department/organization on the basis of year of examination/selection.</p>
<p>This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, DrJitendra Singh in written reply to a question in Rajya Sabha today.</p>

<p>Sub: <b>Pay anomaly in the Supervisory Cadre of Accounts Department, Ministry of Railways and pay disparity with other Supervisory cadres of the Central Government services.</b></p>
<p>The All India Railway Accounts staff Association while deposing before the 7th CPC had brought to the notice of the Commission that subsequent to the acceptance of the VI CPC recommendations a peculiar anomaly arose where a junior drawing higher Grade Pay than the Senior in the cadre of Section Officer (Accounts). The Committee of the 7th Pay Commission observed that the above anomalous situation purely arose on circumstantial grounds and needs to be rectified. Thus in its report, the Commission found merit in the above contention and recommended that Seniors must be given the benefit of stepping up and further in line with their recommendations for organized Accounts cadres, it further recommended that Section Officer (Accounts) Railways in GP Rs. 4800 should be upgraded on completion of four years service, to the existing GP5400 (PB-2) viz., level 9 in the Pay Matrix, on non functional basis. ( Ref: Para No 11.40.83 of 7th CPC).</p>
<p>The 7th Central Pay Commission acknowledged that the skill sets of the Organized Accounts cadres are fairly higher and the Organized Accounts Cadre have to compulsorily pass various stringent examinations for promotions. Moreover, Sr. Section Officer ( Accounts) had been assigned complete parity with Section Officers (SO) of the Central Secretariat Service (CSS) and they had been granted the pay scale of Rs.6500-10500 (S-12) w.e.f.01-01-1996 in accordance with 6th CPC. Further, it was also noticed that parity between Organized Accounts and the cadre of Section Officers of CSS was disturbed by granting non functional up gradation to GP Rs. 5400 (PB-3) after four years of service to Section Officers of CSS only. The Commission also noted that , non-functional up-gradation from GP Rs. 4800 to GP. Rs. 5400 (PB-3) on completion of four years of service, has been accorded to a number of posts by the Govt. of India in 2008. The Commission also found no reason and justification to deprive the benefit of up gradation to GP Rs. 5400 to the officers of the Organized Accounts Cadres who are in GP RS. 4800.</p>
<p>Thus, the Pay Commission recommended that, all officers in the Organized Accounts Cadres ( in the Indian Audit and Accounts Department, Defence Accounts Department, Indian Civil Accounts Organization, Railways, Posts and Telecommunications) who are in GP Rs. 4800, should be upgraded on completion of four years of service to GP 5400 (PB-2) viz. pay level 9 in the Pay matrix ( Para 11.12.140 of 7th CPC.)</p>
<p>To utter dismay, the Government of India while accepting the recommendations of the Pay Commission on up-gradation of posts, left out the Ministry of Railways and Defense for non functional up-gradation GP 5400(PB-3) after four years of service for the categories of AAOs (Finance Division of Defense, Ministry of Defense) and Senior Section Officer (Accounts) Senior Traveling Inspector of Accounts and Senior Inspector of Stores Accounts, Ministry of Railways with the remarks that it will be examined by DOPT for taking a comprehensive view in the matter`. The DOPT took almost nine months and transferred the issue on 7th April 2017 to the Ministry of Finance(Expenditure). In other words benefit of Up gradation to GP 5400 after completion of four years of service has been granted to all other Organized Accounts Cadres of the Indian Audit and Accounts Department, Indian Civil Accounts Organization and Posts and Telecommunication.</p>
<p>The Ministry of Defense in their recent ID Note No 369/C/2017 dated 23-3-2017 also recommended that above benefit be extended to the Assistant Accounts Officer (AAO) of Defense Accounts Department, On the other hand, DOPT in their communication ID note No.1198678 /16 &#8211; Est (Pay-1) dated 2-2-2017 to the Executive Director Pay Commission 111, Ministry of Railways, advised the Ministry of Railways to consult Department of Expenditure in terms of Government of India (Allocation of Business Rules). It shows the indifferent approach of Government towards Railway Accounts Employee.</p>
<p>The Supervisory Cadre of the Accounts Department of the Railways is also entrusted with the responsibilities of presenting the Railway Accounts on widely accepted accrual based Accounting in addition to presenting the Government accounts as per requirements laid down in the Constitution of India , as announced by Hon&#8217;ble Minister of Railways, Shri Suresh Prabhu, in his budget speech.</p>
<p>It would be highly appreciated, if the benefit of grant of GPRs. 5400 is extended to Supervisory Cadre of the Accounts Department, Ministry of Railways on completion of four years of service in GP Rs. 4800 who are the only left in this case. This will also end pay parity between the organised accounts cadres of the Government of India.</p>
<p>An early action in the matter shall be highly appreciated.</p>

<p>Subject:- <strong>Instructions on exemption from passing the Typewriting Test on Computer in respect of LDCs, regarding.</strong></p>
<p>The undersigned is directed to say that instructions issued by this<br />
Department vide O.M.No.14020/2/91-Estt(D) dated 29th September, 1992 provide for grant of exemption from passing the typing test for drawal of increments and confirmation in respect of LDCs.</p>
<p>2(i) . The above mentioned instructions provide for exemptions as under:-</p>
<p>a) If above 45 years of age on the date of their appointment, such<br />
persons may be granted exemption from the date of their<br />
appointment.</p>
<p>b) If between the age of 35 years and 45 years at the time of their<br />
appointment, such persons may be granted exemption on<br />
attaining the age of 45 years.</p>
<p>c) If below 35 years of age on the date of appointment, such persons<br />
may be given exemption after 10 years of service as LDC provided<br />
they have made two genuine attempts to pass the typing test;<br />
otherwise they may be granted exemption after attaining the age of<br />
45 years.</p>
<p>d) Those LDCs who have made two genuine attempts for passing the<br />
typing test prior to issue of this 0 M but have not completed 8<br />
years service as LDC, may be granted exemption from passing the<br />
typing test after completion of 8 years of service or on attaining the<br />
age of 45 years, whichever is earlier.</p>
<p>(ii) For the Physically handicapped persons, these instructions provide for exemptions as under:-</p>
<p>a) Physically handicapped persons who are otherwise qualified to hold clerical post and who are certified as being unable to type by the Medical Board attached to Special Employment Exchanges for the Handicapped (or by a Civil Surgeon where there is no such Board) may be exempted from passing the typing test.<br />
b) The term ‘physically handicapped persons’ does not cover those who are visually handicapped or who are hearing handicapped but cover only those whose physical disability permanently prevents them from typing.</p>
<p>3. Model RRs for the post of Lower Division Clerk (LDC) were issued vide this Department’s O.M.No.AB-14017/32/2009-Estt(RR) dated 7th October, 2009. The entries pertaining to Skill Test Norms prescribed in the Col. 8 of the Model RRs for the post of LDC were modified to include the Skill Test Norms ‘only on computers’ vide this Department’s O.M.No.AB-14017/32/2009-Estt(RR) dated 17) 11May, 2010.</p>
<p>4. This Department has received references whether the instructions as contained in this Department’s OM dated 29.9.1992 are applicable for test on Computer or not. The matter has been examined and it has been decided that the criteria for grant of exemption from passing the typing test in respect of such LDCs including Physically Handicapped persons/Persons with Disabilities as stipulated in this Department’s O.M.No.14020/2/91-Estt(D) dated 29th September, 1992 would also be applicable to the test on Computers.</p>
<p>5. It has also been decided to extend the above instructions to<br />
Sportspersons recruited against Sports quota under the Scheme of<br />
appointment of meritorious Sportspersons.</p>

<p>Subject:- <strong>Retention of/continuation in General Pool Residential Accommodation(GPRA) to an allottee on Technical Resignation from Central Government Service.</strong></p>
<p>There have been requests from various quarters regarding guidelines in case of retention of/continuation in General Pool Residential Accommodation (GPRA) by an allottee on technical resignation from Central Government Service. The issue has been considered in this Ministry and it has been decided by the competent authority that an allottee, working in an eligible office of GPRA, when technically resigns, from Central Government Service on his appointment to ineligible Central Government or State Government office in the same station or outside station, technical resignation may be treated at par with transfer. Cancellation and retention of GPRA may be regulated as per existing rules governing transfer. Further, if the new office of the allottee, who technically resigns, is an eligible office for GPRA in the same station, his/her existing allotment shall be regularized after he/she applies for it by filling up DE-II form of this Directorate.</p>
