<p align="center">MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS<br />
(Department of Personnel and Training)</p>
<p align="center"><strong>NOTIFICATION</strong></p>
<p align="right">New Delhi, the 15th June, 2017</p>
<p><strong>G.S.R. 596(E).</strong>-In exercise of the powers conferred by sub-section (I) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government. after consultation with the State Governments, hereby makes the following rules further to amend the All India Services (Performance Appraisal Report) Rules, 2007, namely:-</p>
<p>1. (1) These rules may be called the All India Services (Performance Appraisal Report) Amendment Rules, 2017.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the All India Services (Performance Appraisal Report) Rules, 2007 (hereinafter referred to as the said rules), in rule 2, after clause (b). the following clause shall be inserted, namely:-</p>
<p>&#8220;(ba) &#8220;competent authority&#8221; means the authority as mentioned in sub-rules (7A) and (7B) of rule 9 to decide the representation of the officer reported upon against performance appraisal report disclosed to the member of Service&#8221;.</p>
<p>3. In the said rules, after rule 4, the following rule shall be inserted, namely:-</p>
<p>&#8220;4A (I) The performance appraisal report shall be generated and written by the officer reported upon electronically in the form as specified in Schedule 2.</p>
<p>(2) The comments of the reporting, reviewing and accepting authority shall be recorded electronically in case he is a government servant.</p>
<p>(3) The political executives may record their comments manually and the performance appraisal report so recorded shall be uploaded electronically as per time frame specified in Schedule 2:</p>
<p>Provided that in certain cases, with the approval of the Government and for reasons to be recorded in writing, performance appraisal report may be generated and written manually by the officer reported upon and any of the reporting authorities, that is, reporting or reviewing or accepting authority as per the guidelines specified by the Central Government from time to time</p>
<p>Provided further that prior approval of the Central Government in consultation with Department of Personnel and Training shall be taken in cases where permanent exemption from electronic filing of performance appraisal report is sought on the grounds of national security, etc. for a particular class of posts&#8221;.</p>
<p>4. In the said rules, in rule 5,-</p>
<p>(i) for sub-rule (2). the following sub-rule shall be substituted, namely</p>
<p>&#8220;(2) Subject to the provisions of sub-rule (4). a performance appraisal report shall also be written when either the reporting or reviewing or accepting authority who is a government servant or the member of the Service reported upon relinquishes charge (other than retirement) of the post, and, in such a case, the report shall be written within the time frame as specified in Schedule 2 for completion of performance appraisal report in paragraph 9 of general guidelines for filling of the performance appraisal report form.&#8221;</p>
<p>(ii) for the first and second provisos to sub rule (3). the following provisos shall be substituted. namely</p>
<p>&#8220;Provided that only one report shall be written on a member of the Service for a particular period during the course of the financial year:</p>
<p>Provided further that if the member of Service occupies more than one post, the Government shall identify <strong>the post (substantive or additional charge) to report or review, well in advance</strong> of the relevant assessment year.&#8221;</p>
<p>(iii) after sub-rule (3), the following sub-rule shall be inserted, namely:-</p>
<p>&#8220;(3A) In general one person shall write the performance appraisal reports in the capacity of reporting, reviewing or accepting authority for a given period of time</p>
<p>Provided that if more than one person supervises the performance of the member of Service for a given period of time. the Government shall identify <strong>the persons to report or review well in advance </strong>of the relevant assessment year.&#8221;</p>
<p>(iv) sub-rule (7) shall be omitted.</p>
<p>5. In the said rules, in rule 6, sub-rule (4) shall be omitted.</p>
<p>6. In the said rules, in rule 7, sub-rule (2) shall be omitted.</p>
<p>7. In the said rules, after rule 7, the following rules shall be inserted, namely:</p>
<p>&#8220;<strong>7A. Restriction on reporting authority, etc. in certain cases.</strong> &#8211; Notwithstanding anything contained in rules 5, 6 and 7, it shall not be competent for the reporting authority, reviewing authority or accepting authority to write a performance appraisal report where the authority reporting the performance appraisal report is a government servant, after one month of his retirement from service; and in other cases, after one month of the date on which he demits office.</p>
<p>Explanation.- For the purposes of this rule,-</p>
<p>(a) a Minister shall not be deemed to have demitted the office if he continues to be a Minister in the Council of Ministers with a different portfolio or in the Council of Ministers immediately reconstituted after the previous Council of Ministers of which he was a Minister with the same or a different portfolio provided the Prime Minister or the Chief Minister, as the case may be, continues in office.</p>
<p>(b) a Minister shall be deemed to have demitted the office where pursuant to fresh elections, a new Council of Ministers has been reconstituted, even if the Minister who was in the earlier Council of Ministers finds a place in the new Council of Ministers with the same or different portfolio.</p>
<p><strong>7B. Treating performance appraisal report as non-est</strong>. &#8211; The performance appraisal report, not recorded in terms of the provisions of these rules and instructions issued thereunder. shall be treated as non-est:</p>
<p>Provided that all the performance appraisal reports filed manually without approval of the Government to do so shall be treated as non-est&#8221;.</p>
<p>8. In the said rules, in rule 9,</p>
<p>(i) for sub-rule (1), the following sub-rule shall be substituted, namely:-</p>
<p>&#8220;(l) The full annual performance appraisal report, including the overall grade and assessment of integrity, shall be disclosed electronically to the officer reported upon, after finalisation by the accepting authority except in the cases where it is generated manually, to enable the officer reported upon to represent his case.&#8221;</p>
<p>(ii) for sub-rule (4), the following sub-rule shall be substituted, namely:</p>
<p>&#8220;(4) The accepting authority shall within fifteen days from the date of receipt of comments from the officer reported upon forward the same to the reviewing and the reporting authority and call for their views on the comments and the comments of reporting and reviewing authority are required to be sought even if they have retired or demitted or relinquished office, and in case the comments of reporting and reviewing authority are not received within fifteen days from the date of receipt, it shall be presumed that reporting and reviewing authority have no comments to offer.&#8221;</p>
<p>(iii) for sub-rule (7), the following sub-rules shall be substituted, namely:</p>
<p>&#8220;(7) If the accepting authority is of a level below the Minister in the State or in the Central Government, then the competent authority to decide the representation shall be one level higher than the accepting authority and in such cases the accepting authority shall forward the comments of the officer reported upon along with the views of the reporting authority, reviewing authority and his own views to the competent authority within fifteen days of receipt of the views of the reviewing authority, and the comments of the accepting authority are required to be sought even if he has retired or demitted or relinquished office.</p>
<p>(7A) The competent authority shall consider the comments of the officer reported upon, the views of the reporting authority, reviewing authority and accepting authority and after due consideration, the competent authority may accept them and modify the performance appraisal report with a speaking order and the final grading shall be communicated to the officer reported upon within fifteen days of receipt of the views of the accepting authority.</p>
<p>(7B) If the accepting authority is the Minister in the State (including the Chief Minister) or the Minister in the Centre, then the competent authority to decide the representation will be the accepting authority himself and in such cases the accepting authority shall consider the comments of the officer reported upon, the views of the reporting authority and the reviewing authority and after due consideration may accept them and modify the performance appraisal report accordingly and the decision and final grading shall be communicated to the officer reported upon within fifteen days of receipt of the views of the reviewing authority, and the comments of the reporting and the reviewing authority are required to be sought even if he has retired or demitted or relinquished office.</p>
<p>(7C) If the competent authority has not seen the work for the reporting period, the representation shall be referred to the Referral Board.&#8221;</p>
<p>(iv) in sub-rule (9). in clause (a), for the words &#8220;and the accepting authority&#8221;. the words the accepting authority and the competent authority&#8221; shall be substituted;</p>
<p>(v) after clause (b) ofsub-rule (9), the following proviso shall inserted, namely:</p>
<p>&#8220;Provided that where the representation has been sent to the Referral Board when the competent authority has not seen the work of the officer reported upon, the Referral Board shall consider the representation of the officer reported upon in the light of the comments of the reporting authority, the reviewing authority and the accepting authority and confirm or modify the performance appraisal report. including the overall grade and the decision of the Referral Board shall be in respect of both factual observations and errors of facts and the decision of the Referral Board shall be final and the final grading shall be communicated to the officer reported upon within fifteen days of receipt of the decision of the Referral Board&#8221;.</p>
<p>9. In the said rules. for rule 10, the following rule shall be substituted. namely:-</p>
<p>&#8220;<strong>10. Memorial against assessment.</strong> &#8211; Nothing in these rules shall be deemed to preclude an officer from making a memorial within the period of ninety days to the President on the performance appraisal report. as provided under rule 25 ofthe All India Services (Discipline and Appeal) Rules, 1969:</p>
<p>Provided that in cases where due to unavoidable circumstances it is not possible to make a memorial under these rules within the said period of ninety days, the competent authority may relax the timeline for submission of the memorial.&#8221;.</p>

<p>In compliance with the provisions of Section 8 of the Information Technology Act, 2000, it has been decided in consultation with Department of Legal Affairs to switch over to exclusive e-publishing of the Government of India Gazette Notification on its official website with effect from 01 .10.2015 and to do away with the physical printing of Gazette Notification. The date of publishing shall be the date of e-publication on official website by way of electronic gazette in respect of Gazette Notifications. The Gazette Notification can be accessed and downloaded/printed from the official e-Gazette website i.e. www.egazette.nic.in free of cost.</p>

<p>Subject: <strong>Reassessment of CVO positions in CPSEs and the pay, incentives, allowances etc. related issues.</strong></p>
<p>The undersigned is directed to refer to the minutes of the meeting of the Selection Committee held on 24 th June, 2015 and to say that a Committee has been formed under the chairmanship of Additional Secretary(S&amp;V) to consider the issues related to reassessment of CVO positions in CPSEs and review of the extra pay, incentives, pay structure and allowances etc. of CVOs in CPSEs.</p>
<p>2. All Ministries/Departments are requested to furnish the following information about the CPSEs under their control within 15 days of receipt of this O.M.:-</p>
<blockquote><p>i. Whether full time CVO is required in particular organization.<br />
ii. Whether the post of CVOs of two or more organizations can be clubbed together.<br />
iii. Whether the post of CVOs is required to continue with the current</p></blockquote>
<p>posts or wishes to upgrade/downgrade or to abolish the posts in view of the workload and requirement of vigilance related matters.<br />
iv. Staff strength and volume of vigilance work involved in the CPSEs, turnover of organizations in last 5 years etc.</p>

<p><strong>Central Civil Services (Joining Time) (Amendment) Rules, 2015.</strong></p>
<p style="text-align: center;"><em>G.I., Dept. of Per. &amp; Trg., Notification F.No.19011/03/2013-Estt.(AL), dated 27th March, 2015</em></p>
<p>G.S.R. 229(E) – In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department the President hereby makes the following rules further to amend the Central Civil Services (Joining Time) Rules, 1979, namely :—</p>
<p>1. (1) These rules may be called the Central Civil Services (Joining Time) (Amendment) Rules, 2015.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Central Civil Services (Joining Time) Rules, 1979,-</p>
<p>(i) In rule 4, for sub-rule (4), the following sub-rule shall be substituted, namely:—</p>
<p>“(4) For appointment to posts under the Central Government on the results of a competitive examination or interview or both open to Government servants and others, the Central Government employees and permanent or provisionally permanent State Government employees shall be entitled to joining time under these rules, if such Government servants opt for having their past service m the Central Government or State Government counted for all purposes in the Central Government”;</p>
<p>(ii) In rule 5, in sub-rule (4), for the existing Note, the following Notes shall be substituted, namely:—</p>
<p>“Note 1: Distance means actual distance travelled and not weighted mileage for which fare is charged by the Railways in certain ghat or hill regions.</p>
<p>Note 2: In case of transfer of a Government servant to or from Eastern Region, including Sikkim, Andaman and Nicobar Islands, Lakshadweep and Ladakh, two days additional time shall be admissible over and above the normal joining time reckoned on the basis of actual distance between their old and new place of posting”;</p>
<p>(iii) In rule 6, for sub-rule (1), the following sub-rule shall be substituted, namely:—</p>
<p>“(1) The period of unutilized joining time shall be regulated in terms of the provisions of sub-clause (ii) of clause (a) of sub-rule (1) of rule 26 of the Central Civil Service (Leave) Rules, 1972″;</p>
<p>(iv) after rule 7, the following Notes shall be inserted, namely:—</p>
<p>Note I: The sanction of the admissible joining time shall be accorded by the competent authority exercising the administrative control over the Government servant proceeding on transfer.</p>
<p>Note 2: The joining time pay shall be paid for by the new administrative authority where such Government servant joins on transfer”.</p>

<p>Subject:: <strong>Reintroduction of direct recruitment in LDC in Central Secretariat &#8211; meeting to discuss to elicit views </strong><b>regarding</b></p>
<p>The undersigned is directed to say that on the recommendations of the Committee on the Cadre Restructuring of CSS (3rd ), a proposal is under consideration of this Department for re-introduction of direct recruitment in the grade of LDC in the Central Secretariat.</p>
<p>2. In this regard, it has been desired to elicit views of the stakeholders in the matter. Accordingly, all  Ministries/Departments, Service Associations and individual officers are requested to submit their views on the issue urgently, latest by 10 March 2015. The views may be furnished via e-mail at uscs1-dopt@nic.in</p>

<p style="text-align: center;"><span style="text-decoration: underline;"><strong>REINTRODUCTION OF DIRECT RECRUITMENT IN THE GRADE OF LDC</strong></span></p>
<p>As a part of first cadre review of CSS in the year 2003, direct recruitment to the Lower Division Grade (LDC) of CSCS was stopped. Eighty Five percent of the posts of LDCs were then filled up through direct recruitment quota and accordingly, after implementation of the first cadre review, 85% of the posts of<br />
LDCs falling vacant every year are being abolished. The remaining posts are filled up by promotion from the erstwhile Group D employees (now MTS). Over the years, strength of LDCs in the Ministries/ Departments has come down substantially from the original level of about 5300.</p>
<p>2. The Second Administrative Reforms Commission endorsed the<br />
decision of phasing out of direct recruitment in LDCs. The Core Group on Administrative Reforms (CGAR) also agreed with the recommendations of ARC. However, the Group of Ministers did not agree phasing out of LDCs and directed that the matter be reconsidered.</p>
<p>3. As the issue of reintroduction of direct recruitment in the LDC has multifarious dimensions / implications like change in work culture in the Govt. of India, E-governance, impact on Multi-Tasking Staff, UDC, Assistant cadre etc. it was referred to the 3rd cadre restructuring committee of CSS.</p>
<p>4. The pros and cons of reintroduction of direct recruitment in LDCs may be as under:</p>
<p><span style="text-decoration: underline;"><strong>Pros</strong></span></p>
<blockquote><p>(i) More availability of manpower in the Sections. Presently, Central Secretariat is heavily top loaded with only 6700 Assistants feeding to 3200 SOs, 1600 USs and 1200 DS/Dirs;</p>
<p>(ii) Salary of a LDC is much less comparing that of an Assistant;</p>
<p>(iii) More continuity and institutional memory as compared to outsourced staff;</p>
<p>(iv) If manpower is to be increased at lower level it could be either at Assistant level or at LDC level. Direct recruitment at LDC level with Promotion to UDC and Assistant would create less problem of stagnation than increased direct recruitment at Assistant level;</p>
<p>(v) Quality of direct recruit LDCs is reasonable.</p></blockquote>
<p><span style="text-decoration: underline;"><strong>Cons:</strong></span></p>
<blockquote><p>(i) We would be going back from the principles of officer oriented system in the Gentral Secretariat;</p>
<p>(ii) In the era of e-governance, paperless office and multi skilling, maintaining a large cadre of LDCs to carry out routing office jobs manually may be regressive;</p>
<p>(iii) The savings shown in the first cadre restructuring of CSS would disappear;</p>
<p>(iv) LDCs in terms of salary, pension contribution and other benefits would cost much more than outsourced staff;</p>
<p>(iv) There could be conflict of promotional opportunities between direct recruit LDCs and Assistants</p></blockquote>
<p>5. However, in the absence of LDCs, a number of Ministries/Departments have resorted to engaging out-sourced staff to manage basic activities like diary/dispatch, movement of files/papers, typing etc. and there is a functional need to strengthen the institutional memory and level of commitment cannot be expected from outsourced staff.</p>
<p>6. The 3rd CRC has recommended re-introduction DR in LDC in limited manner with simultaneous reduction in DR in Assistant grade.</p>
<p>7. However, in view of increased use of information technology tools and progressively more officer oriented system there is a much less requirement of ministerial staff than previously and therefore if direct recruitment in LDC is reintroduced it should be limited in number they should mostly be utilised in regulatory ministries where the volume of correspondence/ dak/ diarizing work<br />
is higher.</p>
<p>8. In the changed IT environment, the intake of 200-250 may be adequate  to arrive at the sustainable number of about 2000 LDCs and equal number of UDCs over the years with the combined strength of 4000.</p>
<p>9. To provide adequate promotional avenues to the newly recruited LDCs, the percentage of intake of DR Assistant may be reduced to 60% (from the existing 75%) leaving 40% of the vacancies in the Assistant grade to be filled up by seniority/LDCE quota from the UDC grade. Reduction in direct recruitment in Assistant would in the long run reduce stagnation in senior grades of CSS.<br />

<p>The undersigned is directed to refer to this Department&#8217;s O.M of even number dated 27.01.2015 along with a list of 1552 officials. A further list containing 380 officials is circulated herewith. The cadre units are requested to conduct the DPC in respect of these officials for inclusion in the Select List 2003 (extended) and subject to fitness promote them as such. The orders of promotion with regard to officials who have already retired need not be issued since they are not physically available to avail of the promotion. The cadre units are also requested to furnish a compliance report by 16.02.2015 in the enclosed proforma.</p>

<p>Sub:- <strong>Annual Medical Examination for the Group ‘A’ officers of Central Civil Services/posts of age 40 years and above.</strong></p>
<p>The undersigned is directed to refer to this Department’s OM of even number dated 1st February, 2012 and 20th March, 2013 on the above subject whereby the scheme of Annual Medical Examination in respect of Group ‘A’ officers of Central Civil Services/posts of age 40 years and above had been circulated in consultation with Ministry of Health &amp; Family Welfare. In this OM, the regime of medical tests to be conducted, the package rates applicable and the list of 26 Hospitals which had agreed to conduct the Annual Medical Examination under the Scheme were prescribed. Subsequently, vide OM of even number dated 20th March, 2013, full address of the 26 Hospitals in Delhi/NCR circulated with OM dated 1s t February, 2012, was notified. ( Available and downloadable from the website of this Department – http://persmin. nic.in =&gt; OMs &amp; Orders =&gt; Establishment).</p>
<p>2. In OM No.21011/1/2009-Estt (A) Part dated 2e March, 2013, the list of empanelled Hospitals in the areas other than Delhi NCR as provided by the Ministry of Health &amp; Family Welfare vide their OM No.A.17020/1/2010-MS dated 28th December, 2012, was attached.</p>
<p>3. The matter regarding empanelment of hospitals for the required Medical Examination was again taken up by this Department with Ministry of Health &amp; Family Welfare.</p>
<p>4. Ministry of Health &amp; Family Welfare vide O.M No.S.11045/36/2012-CGHS(HEC) dated 1st October, 2014 have conyed the details of fresh empanelment of private Health Care Organisations (HCO) and revision of package rates applicable under CGHS Delhi &amp; NCR which are valid for two years. This OM dated 1st October, 2014 can be downloaded from their website www.mohfw.nic.in\eghsnew\index.asp. With this OM dated 1st October, 2014, a list of approved Private Health Care Organisation (HC0s), which are empanelled under CGHS in Delhi/NCR area, has also been enclosed.</p>
<p>5. In accordance with Para 3(M) of the agreement entered into by the Ministry of Health &amp; FW with these Hospitals (copy enclosed with their above mentioned O.M No.S.11045/36/2012- CGHS(HEC) dated 1st October, 2014), it has been made obligatory for these Hospitals to conduct Annual Medical Examination as per the prescribed format and approved rates .The agreement has provided that these empanelled Hospitals shall agree for conducting all investigations/diagnostic tests/consultation etc. of the Central Civil Service Group “A” officer of above 40 years of age<br />
and other categories of CGHS beneficiaries as specified by Government from time to time as per the prescribed protocol, subject to the condition that the hospital shall not charge more than Rs.2000/- for conducting the prescribed medical examination of the male officers and Rs.2200/- for female officers of Central Government who come to the hospital/institution with the requisite permission letter from their Department/Ministry/ Competent Authority. Accordingly, Group “A” officers of Central Civil Services/Posts of age of 40 years and above can have the required Annual Medical Examination conducted by the Hospitals listed with the Ministry of Health &amp; Family Welfare’s above referred No.S.11045/36/2012-CGHS(HEC) dated 1sst October, 2014 referred in para 4 above.</p>
<p>6. In non-CGHS areas, the number of hospitals empanelled under CS (MA) Rules, 1944 being relatively lower ,the different departments/offices may identify one or more hospital locally and refer their Group ‘A’ officers to such hospital for annual medical examination as per the prescribed schedule and rate i.e. Rs. 2000/- for men and Rs. 2200/- for women officers. State Government hospitals or semi-Govt./Public Sector Undertaking’s(PSU) hospitals may also be contacted for the purpose accordingly.</p>

<p>The Finance Ministry has issued some important orders today on its portal, the same is reproduced and given below for your kind information…</p>

<p>Subject: <strong>Foreign tours/travels as part of Training Programmes — approval of Screening Committee of Secretaries (SCOS).</strong></p>
<p>Instructions have been issued by this Department from time to time on the need to curtail expenditure on foreign travel. In recent months it has been observed that Ministries/Departments have been proposing Foreign Study Tours (FSTs) of large delegations of officers as a part of training programmes. In keeping with the Government’s drive on economy and rationalization of expenditure and to have an objective assessment of such FSTs, it has been decided that prior approval of the Screening Committee of Secretaries would be required for all FSTs of delegations exceeding 5 members (irrespective of level/rank of officers), where Government of India is funding such tours and which are part of career training programme(s)<br />
or stand alone tours or otherwise.</p>
<p>2. This has the approval of Cabinet Secretary.</p>

<p>Subject: <strong>Direct Benefit Transfer / Direct Benefit Transfer of LPG (DBTL) — payment of Commission to Banks.</strong></p>
<p>The issues relating to the payment of appropriate commission with respect to payments made under the Direct Benefit Transfer (DBT)/Direct Benefit Transfer in LPG (DBTL) schemes of the Government have been under active consideration of the Government for some time. The matter has been examined in detail, and in supersession of earlier OMs issued in this regard, it has been decided that:</p>
<p>(i) For urban based DBT schemes like DBTL, the transaction cost may be paid at the NEFT rate as per the extant RBI circular or the APB rate as per the extant NPCI circular (as applicable). The ‘on us and “off-us distinction, wherever it exists, should be maintained on the basis of actuals.</p>
<p>(ii) For rural based DBT schemes like pensions, NREGA, pre-matric scholarship, maternity benefits etc. where a large number of transactions are likely to be through the Banking Correspondents, the transaction charges may be paid @ 1% subject to an upper limit of Rs.10 per transaction, in addition to what is required to be paid vide (I) above.</p>
<p>(iii) The transaction cost may be paid at the time of credit of benefit transfer into the accounts of beneficiaries from the same budget line from which the respective scheme funds / benefits are being transferred.</p>
<p>(iv) This OM will come into immediate effect and may be reviewed from time to time.</p>
<p>2. This issues with the approval of the Finance Minister.</p>

<p>In compliance of announcement by Finance Minister in his Budget Speech 2014-15 the Government of India has introduced a new scheme named “Sukanya Samriddhi Account” vide Notification No.GSR No.863 (E) dated 2nd December, 2014. It has been decided to allow 9.1% rate of interest on investments in the scheme during the financial year 2014-15.</p>
<p>This has the approval of Union Finance Minister.</p>
