<h3 class="wp-block-heading">Subject: Sharing/pooling of vehicles by Central Government employees regarding.</h3>



<p>In view of the prevailing pollution levels in the National Capital Region (<strong>NCR</strong>) all Central Government employees posted in the Central Government offices located in NCR while attending offices, are advised to use public transport, as far as possible in the case where the employees are using their private vehicles/ Government vehicles, it is advisable that the vehicles are pooled in order to reduce the number of vehicles on roads. It is also reiterated that all employees shall continue to strictly follow the COVID-appropriate behavior and wear masks at all times and avoid non-essential travel. This advisory will be in force with immediate effect.</p>

<p>Subject:- <strong>Clarification on regularization of absence during COVID-19 pandemic lockdown period &#8211; regarding.</strong></p>



<p>This Department has been receiving several references requesting for clarification relating to the regularization of absence during the COVID-19 epidemic lockdown period.</p>



<ol class="wp-block-list" start="2"><li>In this regard, it is stated that this Department has already issued a clarification on regularization of absence during <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19 </a></strong>lockdown period vide DoPT&#8217;s OM no. 14029/5/2020-Estt.(L)(pt.) dated 28.07.2020 (copy enclosed).</li><li>It is further clarified that this Department&#8217;s OM dated 28.07.2020 has been issued in view of the circumstances that the country is going through due to COVID-19 situations and the unavoidable problems faced by the Government employees in different sectors under the Government of India. A general terminology has been adopted to cover all kinds of problems faced by the employees due to the COVID-19 situation. The said OM may not touch all specific circumstantial problems faced by all employees under the Government of India; however, an interpretation of such circumstances in congruence with the clarification made in the above OM is adaptable.</li><li>Therefore, all Ministries / Departments may examine cases relating to regularization of absence during the COVID-19 lockdown period in the light of this Department&#8217;s <strong><a href="https://centralgovernmentnews.com/regularization-of-absence-during-covid-19-epidemic-lockdown-period-latest-dopt-order/" target="_blank" rel="noreferrer noopener">OM dated 28.07.2020</a></strong> referred to above and the guidelines issued by the Ministry of Health and Family Welfare and Ministry of Home Affairs from time to time.</li></ol>

<figure class="wp-block-table"><table><tbody><tr><td><strong>S.No</strong></td><td><strong>Situation</strong></td><td><strong>Clarification</strong></td></tr><tr><td>1</td><td>Government Servants who were on official tour and were unable to return to their Headquarters (HQs) due to non-availability of Public Transport</td><td>Deemed to have joined duty on the date of expiry of official tour, if intimation in any form, indicating difficulty in joining duty due to non-availability of public transport/ flights, has been given by the Government servant to the office.</td></tr><tr><td>2</td><td>Government servants who were on leave prior to issue of lockdown orders with effect from 25.03.2020 and the leave ended during lockdown period</td><td>Deemed to have joined duty from the date of expiry of leave, if intimation in any form, indicating difficulty in joining duty due to non-availability of public transport /flights has been given by the Government servant to the office. In case of leave on medical grounds, this is subject to production of medical/fitness certificate</td></tr><tr><td>3</td><td>Government servants who left HQ on the week-end prior to lockdown, i.e. 20.03.2020 (Friday), but could not return to HQ on 23.03.2020 (Monday) due to non-availability of transport.</td><td>Deemed to have joined on 23.03.2020, if intimation, in any form indicating difficulty in joining duty due to nonavailability of public transport/ flights has been given by the Government servant to the office.</td></tr><tr><td>4</td><td>Government servants who were on leave prior to issue of orders on lockdown with effect from 25.03.2020 and the leave expired during the lock down but who wish to curtail the leave before expirty and join duty</td><td>Curtailment of sanctioned leave may not be agreed to, unless allowed by the leave sanctioning authority only in rare cases based on official exigency. From the date following the date of expiry of leave during the period of lockdown, the employee may be deemed to have joined duty.</td></tr></tbody></table></figure>

<p>We are the first to introduce a calculator for converting the basic salary from 6th CPC to 7th CPC. The 7th pay commission recommendations had been accepted by the Government of India in the middle of 2016 and implemented the same with effect from 1.1.2016 with minor modifications.</p>

<p>A reimbursement system on travelling expenses while on duty (official duty or temporary duty). And any kind of travelling expenses is permissible as per entitlements of TA/DA Rules. <p>This Department has been receiving several references/ queries from Central Government employees who proceeded on leave, with station leave permission, but could not report for duty due to non-availability of public transport / flights and restrictions on inter/ intra state movement of persons as per Ministry of Home Affairs’ Orders from time to time, to contain the spread of <strong><a aria-label="undefined (opens in a new tab)" href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong> pandemic in the country. <p>Kind attention is invited to the Order No. 40-3/2020-DM-I (A) dated 15th April, 2020 whereby the Ministry of Home Affairs have issued consolidated revised guidelines on the measures to be taken by the Ministries / Departments of Government of India, State/UT Governments and State / UT Authorities for containment of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> in the country.</p>



<p>2. Vide para 3 read of the said order, the Ministry of Home Affairs have, inter-alia, allowed select additional permitted activities as enumerated in para 5 to 20 of the said order. As per para 18 (ii), all Ministries / Departments under Government of India to function with effect from 20th April, 2020. The para 18 is reproduced below &#8211;</p>



<p>18. Offices of the Government of India, its Autonomous / Subordinate offices will remain open, as mentioned below: </p>



<ul class="wp-block-list"><li>Defence, Central Armed Police Forces, Health and Family Welfare, Disaster management and Early Warning Agencies (IMD, INCOIS, SASE and National Centre of Seismology, CWC), National Infomatics Centre (NIC), Food Corporation of India (FCI), NCC, Nehru Yuva Kendras (NYKs) and Customs to function without any restriction.</li><li>Other Ministries and Departments, and offices under their control, are to function with <strong>100%</strong> attendance of Deputy Secretary and levels above that. Remaining officers and staff to attend upto <strong>33%</strong> as per requirement.</li></ul>



<p>4. The undersigned has been directed to convey that the above guidelines of the Ministry of Home Affairs, Government of India be scrupulously followed.</p>

<p>It has been brought to the notice of the Government that the Central Trade Union (CTUs), except Bhartiya Mazdoor Sangh and their affiliates in different sectors are mobilizing workers employees for their proposed nationwide general strike on January 8. 2020. The strike is mainly to protest against Union Government&#8217;s labour reforms, FDI, disinvestment, corporation and privatization polices and to press for <strong>12 &#8211; point common demands </strong>of the working class relating to minimum wage and social security, among others.</p>

<p>2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave go slow etc. or any action that abet any form of strike / protest in violation of Rule 7 of the CCS (Conduct) Rules. 1964. Besides in accordance with the proviso to Rule 17(1) of the Fundamental Rules. pay and allowances is not admissible to an employee for his absence from duty without any authority.  As to the concomitant rights of an Association after it is formed they cannot be different form the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike /protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department&#8221;s O.M. No.33012/1/(s)/2008- Estt.(8) dated 12.9.2008 on the subject for strict compliance (enclosed as Annexure-A).</p>



<p>3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees. if applied for during the period of proposed strike, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>



<p><strong>4. In case employees go on strike all Divisional Heads are requested to forward a report indicating the number and details of employees. who are absent from duty on the day of strike. i.e. 08 .01.2020.</strong></p>

<h2 class="wp-block-heading">General Terms &amp; Conditions</h2>



<p><em>Note 1 </em>&#8211; The total monthly remuneration and the pension drawn by the consultant  shall not  be more than the Last Pay Drawn by him calculated at the current rates of Dearness Allowance.</p>



<p><em>Note 2</em> &#8211; Enhanced remuneration may be paid to deserving officials on case to  case basis with the approval of Secretary, Department of Posts  on account of special expertise/ experience in the concerned field.</p>



<p>3.2 <strong>Allowances</strong>: Consultants shall not be entitled accommodation to any kind of allowance or Accommodation facility e.g. Dearness Allowance, Transport Facility, Residential Personal Staff, CGHS and Medical Reimbursement etc. However, Conveyance Allowance shall be paid at the rates mentioned in the table above [Para 3,1 1.</p>



<p>3.3 <strong>TA/DA</strong>: No TA/DA shall be admissible for joining completion the assignment or on its completion, Foreign travel of consultants is not permitted at all. However, should they require to travel inside the country in connection with the official work of the competent TA/DA as admissible to a regular employee of the same grade, he/she retired from, will be paid to him/her after obtaining approval of the authority.</p>



<p>3.4 <strong>Drawal of pension</strong>: A retired Government officer/official appointed as consultant shall continue to draw pension and the dearness relief on pension during the period of his engagement as consultant, His/her engagement as consultant shall not be considered as a case of re-employment.</p>



<p>3.5 <strong>Leave</strong>: consultants shall be eligible for Eight (08) Days leave in a calendar  year on pro rata basis. No remuneration for the period of absence admissible in excess of the leave will be paid to consultants. Also, un-availed leave shall neither be carried forward to next year nor encashed.</p>



<p>3.6 <strong>Tax Deduction at source [TDS</strong>]: TDS as admissible shall be deducted from the monthly remuneration of consultants. A TDS certificate shall be issued by the concerned DDO on demand.</p>



<p>3.7 <strong>Working Hours</strong>: Consultants may follow the normal working hours as prescribed [i,e. 09:00 AM to 05:30 PM), However, as per the exigency one has to sit late to complete the time bound work. Attendance would be made through Biometric Attendance System.</p>



<p>4. <strong>QUALIFICATION AND EXPERIENCE OF CONSULTANTS</strong></p>



<p>4.1 He/ She should be a Retired Employee of central Government/ state  Government / PSU / Autonomous Body having considerable experience of functioning of Central Government Ministries/ Departments.</p>



<p>4.2  He / she should have effective communication and interpersonal skills with a strong flair for in-depth examination relating to Policy Matters/ Administration / Finance / Any other requisite Field.</p>



<p>5. <strong>AGE LIMIT</strong></p>



<p>Normally the maximum age limit for all categories of consultants will be 65 years. However, engagement beyond 65 years and upto 70 years may be resorted to in deserving cases with the approval of secretary (posts) keeping view his/ her good in health &amp; level of expertise.</p>



<p>8. <strong>PERIOD OF ENGAGEMENT AND EXTENSION OF TENURE</strong></p>



<p>8.1 The initial engagement of a person as consultant shall.be for the period as given in the Terms of Reference (ToR) or one year, whichever is less. After expiry of initial term, engagement  may be extended, based on requirement of the Division and performance  of consultant(s) concerned, with the concurrence of  AS&amp;FA &amp; approval of Secretary (posts) for a maximum period of one year at a time and not more than 3 terms including initial engagement. Relaxation may be given in deserving cases.</p>



<p>8.2 Such extension proposals should not be sent to Establishment Division. The concerned Divisions may directly submit  such proposals to AS&amp;FA for concurrence and approval of secretary (Posts) or Minister-in-charge in case of Joint secretary and above. The final outcome of such proposals may be intimated to Establishment Division.</p>



<p>8.3 The appointment of Consultants is of a  temporary (non-official) nature  against the specific jobs. </p>



<p>8.4 The engagement of consultants can be terminated by the Department at any time without at assigning any reason thereof by giving them 15 Days notice. However, in  case a consultant wishes to resign, he will, have to give 15 days advance notice or remuneration in lieu thereof before resigning from the engagement.</p>



<p>10. <strong>CONFIDENTIALITY OF DATA AND DOCUMENTS</strong></p>



<p>10.1 The<strong> Intellectual Property Rights</strong> (IPR) of the data collected as well as deliverables produced  for the Department shall remain with the Department.</p>



<p>10.2 No one shall utilize or publish or disclose or part with, to a third party, any-part of the data or statistics or proceedings or information collected purpose for the of his assignment or during the course of, assignment without for the Department the express written consent of the Department.</p>



<p>10.3 The consultant shall be bound to hand-over the entire set of assignment to the Department  before the expiry of the contract and before the final payment is released the by the Department.</p>



<p><strong>11 CONFLICT OF INTEREST</strong></p>



<p>11.1 The consultant appointed by the Department shall in no case represent or give opinion or advice to others in any matter which is adverse to the interest of the Department nor will  be indulge in any activity outside the terms of the contractual assignment.</p>



<p>11.2 The Consultant will not be entitled for any benefit/compensation / absorption / regurarization of service with this Department.</p>



<p>12. <strong>TERMINATION OF ENGAGEMENT</strong></p>



<p>Department may terminate the engagement in following conditions: <br />i.  The consultant is unable to address the assigned work; <br />ii. Quality of the work is not to the satisfaction of the Department; <br />iii. The consultant fails in timely achievement  of the milestones as finally decided by the Department<br /> iv. The consultant is found racking in honesty and integrity.</p>



<p><em>Note</em>: The Department reserves the right to terminate the engagement, fifteen (15) days&#8217;written by serving notice on the consultant, Termination<br /> on the day right shall be effected after the completion of fifteen (15) days of delivery of such notice.</p>



<p>13. <strong>COMPETENT AUTHORITY FOR TERMINATION OF ENGAGEMENT.</strong></p>



<p>The Head of concerned Division, in case of consultant upto level-13.<br /> Secretary (posts), in case of Consultant at Joint Secretary Level or above.</p>



<p>14. <strong>REVIEW OF GUIDELINES</strong><br /> These guidelines may be reviewed as and when the circumstances so warrant with the approval of the Secretary (Posts).</p>



<p>15. <strong>RIGHTS OF THE DEPARTMENT</strong><br /> The Department has the right to cancel the advertisement, and not go for engagement of Consultant, at any stage. It may accept or reject any or all applications, without giving any reasons therefor, whatsoever. </p>

<p>The applicant joined the service under the respondents as Inspector of Central Excise. He was granted 1st and 2nd financial upgradations w.e.f. 9.8.1999 and 22.6.2008. Later he was promoted to the post of Superintendent of Central Excise w.e.f. 24.9.2002 and as the upgradation &#8211; benefits were already given under ACP scheme he was not eligible for any benefits at the time of promotion. The applicant was granted the Grade Pay of Rs. 5,400/- in PB-2 of Rs. 9,300-34,800/- w.e.f. 24.9.2006 on completion of four years of service as Superintendent. Since the applicant was not granted any further promotion he is eligible for 3rd financial upgradation under the MACP scheme. Applicant submitted a representation to the respondents in this regard. However, the respondents in reply to the above representation given him a copy of the letter dated 18.2.2015 (Annexure A10) stating that since the Pay and Accounts Officer has raised objection in granting financial upgradation under the MACP scheme in the Grade Pay of Rs. 6,600/- to those Superintendents who had been granted the Grade Pay of Rs. 5,400/- in PB-2 on completion of four years service had sought a clarification from the Ministry and further the Hon’ble High Court of Madras has remitted the matter to the Department of Personal, Public Grievances and Pension for fresh consideration with directions to consider the issue in extension. Respondent No. 1 examined the matter and issued Annexure A8 clarification. However, the respondents have denied the benefit of 3rd financial upgradation under the MACP scheme to the applicant on the wrong interpretation of paragraph 81 of Annexure Al OM dated 19.5.2009 (Annexure A3). Being aggrieved the applicant has filed the present OA with the following relief:</p>

<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>8.I This Honourable Tribunal may be pleased to declare that the provisions of para 8.1 of Annexure I to the OM No.35034/3/2008-Estt(D) dated 19.5.2009 is not applicable in the case of the applicant and he is eligible for the 3rd financial upgradation in Grade Pay of Rs. 6,600/- in PB- 3 as per the MACP scheme and direct the respondents to grant and disburse to the applicant the financial benefits within a reasonable period as decided by the Hon’ble Tribunal.8.2 This Honourable Tribunal may be pleased to declare that the Grade pay of Rs. 5,400/- in PB-2 granted under the CCS (RP) Rules to the Superintendents of Central Excise on completion of four year service is not a financial upgradation falling under the purview of the MACP scheme.</p></blockquote>



<p>2. Notices were issued to the respondents. They entered appearance through Shri P.R. Sreejith, ACGSC who filed a detailed reply statement contending that the applicant joined the Department as Inspector of Central Excise on 22.6.1984. He was granted 1st and 2nd financial upgradation under the ACP scheme w.e.f. 9.8.1999 and 22.6.2008 respectively. He was promoted as Superintendent of Central Excise w.e.f. 24.9.2002 and further was granted Grade Pay of Rs. 5,400/- in PB-II in the scale of Rs. 9,300-34,800/- w.e.f. 24.9.2006 on completion of four years service as Superintendent. Respondent No.1 vide letter dated 21.7.2010 has clarified that the benefit of non-functional upgradation granted to the Superintendent (Group-B) officers on completion of 4 years of service would be treated/viewed as an upgradation in terms of paragraph 8.1 of Annexure to OM dated 19.5.2009 (Annexure A3) and the same would be offset against one financial upgradation under MACP scheme. The applicant was granted Grade Pay of Rs. 5,400/- in PB-II as non-functional upgradation w.e.f. 24.9.2006 and was afforded the benefit of fixation of pay under FR 22. The respondents would submit that the post/grade at S-15 has been placed at PB- II with Grade Pay of Rs. 5,400/- and next higher grade pay in the hierarchy of the recommended revised pay band and grade pay is PB-III with Grade Pay of Rs. 5,400/-. Paragraph 8.1. of Annexure of MACP scheme provides that consequent upon the implementation of the 6th CPC’s recommendations, grade pay of Rs. 5,400/- is now in two pay bands viz., PB-2 and PB-3. The grade pay of Rs. 5,400/- in PB-2 and Rs.5,400/- in PB-3 shall be treated as separate grade pays for the purpose of grant of upgradation under MACP scheme. The non-functional Grade Pay of Rs. 5,400/- granted to the applicant in PB-II after completion of 4 years regular service as Superintendent is to be treated/viewed as an upgradation in terms of respondent No. 1 clarifications. The respondents further contended that the judgments/orders relied on by the applicant is not applicable to the facts and circumstances of the present case. Respondents pray for dismissing the OA.</p>



<p>3. We have heard the applicant who appeared in person and the learned Central Government counsel appearing for the respondents in the matter. We have also perused the argument notes submitted by the applicant. Perused the records.</p>



<p>4. It is also undisputed that the Superintendents of Customs and Central Excise are having two Grade Pays in PB-2 i.e. one with Grade Pay of Rs.4800/- and another with Grade Pay of Rs 5400/-. The officials become entitled to Pay Band 2 with Grade Pay of Rs.5400/- only after they complete 4 years of service as Superintendents in the Grade Pay of Rs.4800/-.</p>



<p>5. MACP Scheme has brought systemic changes to the then existed ACP Scheme. Both the Schemes were to alleviate the drudgery of lack of promotional avenues of the government servants for a long time. Under the ACP Scheme, financial upgradation in the promotional scale were given on completion of 12 years and 24 years respectively without promotion whereas in the MACP scheme three financial upgradations counting from a direct entry grade on completion of 10, 20 and 30 years respectively whenever a person has spent 10 years continuously in the same Grade Pay. The MACP Scheme envisages merely placement in the immediate next higher Grade Pay in the hierarchy of recommended revised Pay Bands under the CCS (Revised Pay) Rules, 2008. It is also to be noted that the Grade Pay at the time of financial upgradation under the MACP Scheme can, in certain cases where regular promotion is not between two successive grades, be different than what is available at the time of regular promotion and in such cases the higher Grade Pay attached to the next promotion post in the hierarchy of the concerned cadre will be given only at the time of regular promotion. It is further to be noted that the Grade Pay of Rs.5400/- is now in two Pay Bands viz; PB2 and PB3. Para 8.1 of the MACP Scheme states:</p>

The grade pay of Rs.5400 in PB-2 and Rs.5400 in PB-3 shall be treated as separate grade pays for the purpose of grant of upgradations under MACP Scheme.</p></blockquote>



<p>6. Grade Pay of Rs.5400/- is given to Superintendents of Central Excise, on completion ·of their 4 years’ service in PB-2 with Grade Pay of Rs.4800/-. Applicant joined the service as Inspector 22·06.1984 and he was granted 1st ACP benefits in the grade of Superintendent i.e. PB-2 Rs. 9,300-34,800/-­ plus Grade Pay of Rs. 4,800/-. Later he was promoted as Superintendent of Central Excise w.e.f. 24.9.2002. Since the applicant was already granted 1st financial upgradation under ACP scheme he was not eligible for any benefits at the time of promotion. However, on completion of four years service as Superintendent applicant was granted non-functional upgradation in PB-2 Rs. 9,300-34,800/- plus Grade Pay of Rs. 5,400/- w.e.f. 24.09.2006. The applicant was granted 2nd financial upgradation under the ACP scheme w.e.f. 22.06.2008 on completion of 24 years of service in PB-3 Rs. 15600-39100/-­ with Grade Pay of Rs. 5,400/-. Therefore, the applicant has been granted three financial upgradations as stated above. The respondents contend that the placement of the applicant in the Grade Pay of Rs.5400/- in Pay Band 2 under NFG (non-functional upgradation) has to be treated as a separate Grade Pay for the purpose of grant of upgradation under the MACP Scheme.</p>



<p>7. Financial upgradations under the schemes of ACP and MACP are policy decisions of the Government of India and they are to be implemented strictly in terms of the schemes. Any interpretation inconsistent with the scheme cannot be acceded to Paragraph 8.1 of the MACP scheme as quoted above which in unambiguous terms state that Grade Pay of Rs.5400/- in PB- 2 and the Grade Pay of Rs.5400 in PB-3 are to be treated as separate Grade Pays for the purpose of grant of financial upgradation under the MACP Scheme. In the 6th CPC revised pay structure after completion of 4 years of service in the PB-2 with Grade Pay of Rs. 4,800/- a higher Grade Pay of Rs.5400/- is granted in Pay Band-2 itself. As per para 8.1 of the MACP scheme such placement in higher Grade Pay has to be treated as a separate Grade Pay for the purpose of MACP Scheme. Therefore, the applicant had already undergone 3 financial upgradations. Hence now the applicant cannot be considered for the 3rd financial upgradation as it would be contrary to the MACP Scheme. Ignoring the granting of non-functional Grade Pay of Rs.5400/- in PB-2 for the purpose of MACP is not in accordance with the government policy and hence is not correct.</p>



<p>8. In the light of the above discussion, we hold that there is no merit in the above Original Applications. The Original Application is dismissed. Parties shall suffer their own costs.</p>
