<p>Subject: <strong>Modified Assured Career Progression Scheme in respect of Group &#8216;A&#8217; and &#8216;B&#8217; Officers having initial Grade Pay of Rs.4600/- (Level-7) and above at par with Central Government Civilian Employees &#8211; Regarding.</strong></p>



<p>Madam/Sir</p>



<p>Govt. of India, vide DOP&amp;T O.M. No. 35034/3/2008 -Estt (D) dated 19th May 2009, introduced Modified Assured Career Progression Scheme for granting three financial upgradation at intervals of 10, 20 and 30 years of continuous regular service for civilian Central Govt. Employees. KVS, Office Memorandum No. F. 11020- 16/2009 -KVS (HQ) (Admn.1) dated 09.92.2011, 15.02.2011 and 25.02.2011, has extended the benefits of MACP to all its employees except the teaching staff. The financial up-gradation under MACP in respect of all eligible Group &#8216;A&#8217; &amp; &#8216;B&#8217; Officers (Section Officer and above) (except teaching staff) is to be considered at KVS (HQ).</p>



<p>You are, therefore, requested to forward the fresh proposals in respect of eligible Group &#8216;A&#8217; &amp; &#8216;B&#8217; Officers (Nom-teaching staff) (Section Officer &amp; above) to whom MACP is due upto 31.03.2023 in the prescribed proforma (copy enclosed). The details may be duly verified. You are also requested to furnish the Vigilance Clearance Certificate in the latest proforma of eligible Group &#8216;A&#8217; &amp; &#8216;B&#8217; Officers along with the proposal.</p>

<p>Will the PRIME MINISTER be pleased to state:</p>



<p>(a) whether there is any difference in methodology for fixation of basic pay in cases of ACP and regular promotion under 6th Central Pay Commission between 01/01/2006 to 31/08/2008;</p>



<p>(b) if so, the details thereof;<br />(c) whether fixation of pay in cases of ACP is at par with regular promotion; and<br />(d) if so, the details thereof?</p>

<p>(b): In view of (a) above, the question does not arise.</p>



<p>(c) &amp; (d): As per the recommendations of the 5th Central Pay Commission (CPC), the scheme of Assured Career Progression (ACP) in respect of Central Government civilian employees, was introduced with effect from 09.08.1999. On implementation of revised pay structure/rules, as per the recommendations of the 6th CPC, w.e.f. 01.01.2006, the ACP scheme was continued upto 31.08.2008. The general principles governing fixation of pay at the time of regular promotion under</p>



<p>Central Civil Services (Revised Pay) Rules, 2008, were applicable in cases of grant of financial upgradation under ACP scheme upto 31.08.2008.</p>

<p>Central Civil Services Cultural &amp; Sports Board is organising the CCSCSB online Music and Dance competition 2020 for wards of Civilian Central Government Employees. The event shall be held online on Facebook Group – “<strong>CCSCSB Online Music &amp; Dance Competition-2020</strong>” on 28-29 November, 2020. Parents of the participants are required to join the group for live participation. All the parents of the wards must have their own Facebook profile and necessary equipment’s such as Mobile/Camera and internet connection for live performance. Details of the event are as under:</p>

<p>2. The entry for the competition should be sent in the prescribed <strong>entry form latest by 10 November, 2020</strong> through email at ccscsbcultural@gmail.com only. Proforma of the entry form is attached. No entry by physical mode (by hand or by post) will be accepted.</p>



<p>The Wards of the following Categories of employees are not eligible for participation in Competition:</p>



<ul class="wp-block-list"><li>Uniform personnel in Defence Services/ Para Military Organisations / Central Police Organisation/ Police/ RPF/ CISF/ BSF/ ITBP/ NSG etc.</li><li>Employees of Autonomous bodies/ undertaking/Public Sector Banks even<br />though administratively controlled by the Central Ministries.</li><li>Casual/ Daily wages workers.</li><li>Employees attached to offices on temporary duty.</li><li>A newly recruited employed who has put less than 6 months in regular<br />establishment/services.</li></ul>



<p>Decision of the judges shall be final and no appeal against their decision shall be entertained. </p>



<p>5. All the participants shall be given digital participation certificate. Besides this Winners (1st, 2nd &amp; 3rd) will also be given Winners’ Certificate. </p>

<p><strong>GRANT OF 2nd FIANANCIAL UPGRADATION UNDER ACP SCHEME WHO HAVE COMPLETED 24 YEARS REGULAR SERVICE DURING INTERVENING PERIOD BETWEEN 01.01.2006 TO 31.08.2008 AND THIRD FINANCIAL UPGRADATION UNDER MACP SCHEME AFTER COMPLETION OF 30 YEARS SERVICE IN R/O OF DRAUGHTSMAN/TOs OF MES</strong></p>



<p>1. Refer further to this office letter No.CC-3/85610/47/MACP/D’ Man/6th/CSCC dated 21 April 2017.</p>



<p>2. The undersigned is directed to inform that the approval of grant of 2nd Financial Upgradation after completing 24 yrs of service under ACP scheme of DoPT in respect of Draughtsman &amp; Tech Officers in the pay scale of <strong>Rs.15600 &#8211; 39100 plus Grade pay of Rs. 6600/-</strong> in MES for the intervening period between 01 Jan 2006 to 30 Aug 2008 was granted by MoD after thorough scrutiny of the proposal.</p>



<p>3. Some complaints &amp; grievances were filed against this grant of 2nd Financial Upgradation under ACP scheme by few individuals. In this connection the matter was again sent to MoD for further scrutiny and examinations. The decision of MoD in this regard is reproduced below :-</p>

<p><em>&nbsp;“It is stated that the case for grant based on the analogy of Draughtsman Cadre of MES and Assistant (Arch Department) of CPWD provided by E-in-C’s Branch and as per Financial Upgradation to the TOs of Draughtsman Cadre of MES was granted as per the extant rules and guidelines of DoP&amp;T.”</em></p>



<p>4. In view of the above, it is advised to take further necessary action as per the clarification of the MoD</p>

<p>The Central Civil Services (Conduct) Rules, 1964, which are applicable to the Central Government civilian employees, prohibit the employees from contesting elections to any Legislative or Local Authority.</p>



<p>The conduct of employees of autonomous bodies, statutory organizations, public sector enterprises, trusts, banks etc. is governed by the respective set of rules/ regulations applicable to them.</p>

<p>Subject: <strong>Clarification regarding the term &#8216;Non-Family Station&#8217; in respect of concessional retention given under Rule 43 of CGGPRA Rules, 2017.</strong></p>
<p>In continuation to the OM. of even Number dated 10.4.2018 vide which the concessional retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees, Centrally Armed Paramilitary Forces employees and officers of All India Services on their posting to a Non-family stations was extended up to 30.06.2021 on payment of normal rate of licence fee, it is further clarified that the term &#8216;Non Family station&#8217; includes:</p>
<blockquote><p>(i) North Eastern Region, Sikkim, Andaman &amp; Nicobar Islands and Lakshadweep, State of Jammu &amp; Kashmir</p>
<p>(ii) Left Wing Extremist (LWE) areas, as declared by Ministry of Home Affairs from time to time.</p></blockquote>
<p>2. All the other terms and conditions of OM dated 10.4.2018 will remain unchanged.</p>

<p>Sub: <strong>Grant of financial upgradation under ACP &amp; MACP schemes for the central Government Civilian Employees including Railway employees &#8211; reg.</strong></p>
<p>Ref: (i)  Dop&amp;T oM No.35034/1/97-Estt (D) dated 09/08/1999.<br />
(ii) Dop&amp;T oM No.35034/3/2008-Estt (D) dated 19/05/2009.</p>
<p>NFIR invites kind attention to the OM dated 09/08/1999 wherein the Government of India (DoP&amp;T) had introduced &#8216;<strong>Assured career Progression Scheme</strong>&#8216; (<strong>ACPs</strong>) for the central Government civilian Employees pursuant to the recommendation of 5th central pay commission. The ACP Scheme was made effective in the Central Government departments from 1999. The ACP Scheme remained functional until 31/08/2008 (as clarified by the DoP&amp;T vide para 9 its OM dated 19/05/2009) due to the fact that the &#8216;<strong>Modified Assured Carrer Progression Scheme</strong>&#8216; was introduced by the DoP&amp;T, replacing ACPS w.e.f. 01/09/2008, pursuant to the recommendations of 6th CPC.</p>
<p>The Federation has however been receiving representations from the Central Government civilian Employees, mainly railway employees from all corners of the country to make the MACP Scheme operational w.e.f. 01/01/2006<br />
01/01/2006 instead from 0l/09/2008, pursuant to the order dated 08th December, 2017 passed by the Hon&#8217;ble Supreme Court in Civil Appeal Diary No.3744 of 2016. In this connection, NFIR places following facts for consideration:-</p>
<ul>
<li>on perusal of the order of the Apex court, it is found that the Hon&#8217;ble Apex court has held that the MACP is a part of pay structure recommended by the 6th CPC, the same cannot be considerd as allowance which had been given effect from 01/09/2008. The said order has also cited the Resolution dated 30/08/2008 of the Government which was referred in the notification issued by the Ministry of Finance wherein <strong>MACP</strong> has been defined part of &#8216;<strong>Pay structure</strong>&#8216; and not as &#8216;<strong>Allowance</strong>&#8216; and therefore should be given effect from 01/01/2006.</li>
<li>The order dated 8th Dec 2017 passed by the Apex court has already been implemented by the Ministry of Defence, giving effect to the MACPs w.e.f.01/01/2006 through an OM dated 25/07/2018.</li>
<li>DoP&amp;T may kindly take note that in para 6.5.2 &amp; 6.5.4 of the report of 6th CPC, the Commission had recommended for implementation of the revised pay structure consisting of Pay Band and Grade Pay w.e.f. 01/01/2006 while the revised allowances were given effect from prospective date i.e. 01/09/2008.</li>
<li>Ministry of Finance vide Gazette of India, Extraordinary Notification of Resolution No. 1/1/2008-IC dated 29/08/2008 had implemented revised pay structure (Pay Band &amp; Grade Pay) w.e.f. 01/01/2006 whereas the implementation of MACPS was made effective from 0110912008, Accordingly, Ministry of Railways also implemented revised Pay structure w.e.f. 01/01/2006 vide its order dated 04/09/2008 while the rates of Non Practicing Allowance (NPA) were revised w.e.f. 01/01/2006 vide Board&#8217;s order dated 22/09/2008. Therefore, the MACPS which is part of Pay structure as decided by Apex Court should be given effect from 01/01/2006 in railways and all other Central Government departments.</li>
<li>Another important fact which cannot be ignored is, that the Apex Court had held that the benefit of ACP granted to an employee is part of the Pay structure which not only affects the pay but also pension of the employee, therefore, decided that the ACP is not allowance but a part of pay. At the same time, the Hon&#8217;ble Supreme Court further held that there can be no dispute that grant of ACP is part of pay structure and that the resolution dated 30/08/2008 relating to implementation of 6th CPC recommendations on pay structure, pay bands, grade pay etc have been given effect from 0110112006 and also added that this is the decision of the Cabinet which could not have been modified by issuing executive instructions.</li>
<li>NFIR suggests that while issuing modified instructions, in compliance with Apex Court order, the DoP&amp;T may allow option opportunity to all those beneficiaries of ACPS as well MACPS to exercise their option for financial upgradation from the dates advantageous to them so as to avoid further grievances.</li>
<li>Summing up, NFIR urges upon the DoP&amp;T to kindly consider the above points and issue modified instructions for granting financial upgradation under MACPS with effect from 01/01/2006 as was done by the Ministry of Defence. A copy of the instructions issued may be endorsed to this Federation.</li>

<p>The number of sanctioned posts and number in position in various Ministries/Departments as available in the Annual Report on Pay and Allowances of Central Government Civilian Employees 2016-17 as on 1.3.2016, published by Pay Research Unit, Department of Expenditure, Ministry of Finance, is at Annexure &#8216;A&#8217;.</p>
<p>The posts sanctioned in Ministries/ Departments are required to be filled as per the Recruitment Rules as and when vacancies arise. A number of steps have been taken for streamlining the procedure for conducting meeting of Departmental Promotion Committee (DPC) for promotions which includes issue of model calendar for conduct of DPCs, the reckoning of APARs for consideration of promotion etc. Steps have also been taken for streamlining direct recruitment process by doing away with interviews for lower level posts, introduction of computer based examinations and simplification of pre-appointment procedures.</p>
