<h3 class="wp-block-heading"><strong><u>Subject:- Reviewing of guidelines for timely disposal of departmental proceedings against the officers of All India Services posted on Central Deputation &#8211; reg</u></strong></h3>



<p>The undersigned is directed to refer to the subject cited above and to say that the timelines for departmental proceedings against the officers of All India Services posted on Central Deputation in respect of whom the proposals are received from concerned Ministries / Departments were last reviewed vide DoPT’s letter No. 106/7/2015-AVD.I (Part) dated 15/03/2017 in amendment of All India Services (Discipline and Appeal) Rules, 1969.</p>

<p>2. In this context, with a view to streamline the processing of disciplinary proceeding cases, the following timelines have further been decided with the approval of the competent authority:</p>

<h3 class="wp-block-heading">Subject:- Rationalizing the process of granting approval of Central Government for sanctioning ex-India Study Leave by the State Cadre in respect of IAS officers in terms of Regulation 3(3) of AIS (Study Leave) Regulations, 1960.</h3>

<p>The Chief Secretaries of all States Governments;</p>



<p>Sir / Madam,</p>



<p> I am directed to refer to the subject mentioned above and to state that the Central Government examines the proposal of ex-India Study Leave of IAS officers in terms of Regulation 3(3) of AIS (Study Leave) Regulations, 1960.</p>



<p>2. In this context, it is felt necessary that a holistic appreciation of impact of such long study leave on the overall cadre management both at the State as well as the Central Government level is needed before a well informed decision is taken both by the State while recommending and for DoPT to provide its approval.</p>



<p>3. With this objective, it is felt necessary that while recommending ex- India Study leave in respect of IAS officers, the requests of study leave/ex-India Leave/Extension to study leave may be considered in the light of availability of sufficient number of IAS officers in the Cadre and for Central Deputation against the prescribed norms of CDR (which is 40% of SDP). This would ensure that the functioning of the State Governments as well as Central Government is not affected due to shortage of officers.</p>



<p>4. Accordingly, it is requested that while recommending the proposals of ex-India Study Leave, the State Governments should submit the following&nbsp;<strong>along-with the Study Leave proposal:</strong></p>



<ul class="wp-block-list">
<li>(a) the details of officers sponsored for Central Deputation during the previous year and the current year against the prescribed norms of Central Deputation Reserve (CDR) @ 40% of Senior Duty Posts (SDPs);</li>



<li>(b) the details of IAS officers who are on Study leave within India and outside India vis-à-vis Leave Reserve;</li>



<li>(c) the details of IAS officers who have returned from the Study leave during the last two years and the posting(s) given to them according to the practical knowledge and experience acquired during Study Leave.</li>
</ul>

<p>Subject: <strong>Filling up the post of Financial Adviser in National Company Law Tribunal (NCLT) under the , Ministry of Corporate Affairs</strong>.</p>

<p>This is regarding filling up the post of Financial Adviser in NCLT under the Ministry of Corporate Affairs on deputation basis.</p>
<p>2. Officers of the rank of Deputy Secretary/Director level from any Organized Finance &amp; Accounts Service of the Government of India or equivalent level, eligible for appointment under Central Staffing Scheme are eligible for the post. The period of deputation is 4/5 years at Deputy Secretary/Director level respectively.</p>
<p>3. The post may be circulated amongst officers eligible to be appointed at Deputy Secretary/Director or equivalent levels in the Government of India on priority basis. Names of willing and eligible officers who can be spared by the Ministries/Departments may be forwarded to this Department along with cadre clearance, vigilance clearance, detailed bio-data in the enclosed proforma and CR Dossiers for the last five years. For officers working in the cadre, it may also be ensured that the &#8216;Cooling off, after a previous stint on deputation, if any, is completed and the officer is eligible for appointment on Central Deputation as per extant instructions.</p>
<p>4. The Post is a Non-Central Staffing Scheme post to be filled up through the Civil Services Board (CSB) procedure. It may be noted that no &#8216;Mandatory Posting Certificate&#8217; for allotment/retention of Government accommodation would be issued by this office to the officer appointed on the above referred post. However, those officers who have served and are currently serving on Central Staffing Scheme post in Delhi for at least four years and require to retain Government accommodation, would be issued a certificate to the effect that the officer concerned has served for at least four years in CSS post and he/she needs to retain Government accommodation for his/her tenure on non-CCS post.</p>
<p>5. It is requested that the application(s) of the eligible candidate(s) may please be forwarded so as to reach this Department within one month from the date of issue of this circular.</p>

<p>Sub: <strong>Retention of names on offer for Central Deputation under the Central Staffing Scheme for the year 2016 &#8211; reg.</strong></p>
<p>Sir/Madam,<br />
Please refer to this Department&#8217;s D.O. letters of even number and No. 33/2016-E0 (MM.II) both dated 17th December, 2015 regarding sponsoring of the names of eligible officers for appointment in the Government of India under the Central Staffing Scheme for the year 2016.<br />
2. As per directions of the ACC, the names of officers, for being placed on offer are to be obtained from the State Governments/Cadre Controlling Authorities in two tranches.<br />
3. It is, therefore, requested to kindly sponsor the names of officers to this office, for retention under the Central Staffing Scheme for the 2nd tranche. Kindly give this circular wide publicity amongst the eligible officers under your administrative control. As far as possible the applicatiorn may be forwarded by 31st, July, 2016.<br />
4. The applications of willing officers (including those pending from 1st tranche of 2016) may be forwarded to this Department after due scrutiny at the earliest. A copy of the D.O. letter dated 17th December, 2015 is enclosed with this letter.</p>

<p>Sub:- <strong>Extension in deputation tenure beyond the prescribed limit of seven years/premature repatriation from a Non &#8211; Central Staffing Scheme post – reg</strong></p>
<p>As per the ACC directions, an officer working on a Central Staffing Scheme (CSS) post is allowed an additional tenure of two years on his shift to a Non-Central Staffing Scheme post and vice-versa, subject to cadre clearance and further subject to the maximum limit of seven years outside the cadre at a stretch. While allowing the shift, the tenure of the officers is specified/fixed. Similarly as per extant policy, officers working on a CSS post on their premature repatriation on grounds other than promotion are required to undergo extended cooling off.</p>
<p>2. However, it has come to notice that officers have continued to stay beyond the stipulated tenure without the approval of the competent authority, sometimes even beyond the maximum stipulated limit of seven years outside the cadre. It has also come to notice that some of the officers who after their stint under the CSS had shifted to Non-CSS posts were allowed to go prematurely to their cadre without seeking the approval of the ACC.</p>
<p>3. The undersigned is directed to convey that any proposal for premature repatriation and extension in tenure beyond the approved tenure in respect of officers who have shifted from a CSS post and are now working on a Non-CSS post should be referred to DoP&amp;T for approval/orders of the competent authority.</p>
<p>4. All the Ministries/Departments are requested to ensure compliance of the above direction in future.</p>
