<h3 class="wp-block-heading">Subject: Revision of timelines for preparation/ completion of Annual Performance Assessment Report (APAR) in respect of Central Civil Services</h3>



<p>The undersigned is directed to invite reference to this Department’s OM No.21011/01/2005-Estt.(A)(Pt.II) dated 23.07.2009 on the subject, “Preparation and maintenance of Annual Performance Assessment Reports (APAR)”.</p>



<p>2. In partial modification of Annexure III of the abovementioned DoP&amp;T OM dated 23.07.2009, the competent authority has approved revised time schedule for preparation / completion of Annual Performance Assessment Report (APAR). Accordingly, the revised time schedule, i.e., Annexure II is annexed herewith.</p>



<p>3, These instructions will come into force from the Reporting Year 2024-25 onwards.</p>

<h3 class="wp-block-heading">Subject: Central Civil Services (Leave Travel Concession) Rules, 1988 Clarifications/modifications in LTC instructions-regd.</h3>



<p>Sir/Madam,</p>



<p>Correspondences were being received from the field offices regarding CCS (LTC) Rules 1988 &#8211; wherein various queries were raised while regulating LTC claims pursuant to instructions issued vide Ministry of Finance, Department of Expenditure’s O.M. dated 31.12.2021, 16.06.2022 &amp; Ministry of Personnel, Public Grievances &amp; Pensions, Department of Personnel &amp; Training’s OM dated 29.08.2022.</p>



<p>2. The matter was referred to DoPT/MoF and accordingly response has now been received from DoPT as well as from MoF.</p>



<p>3. The consolidated clarifications received on the queries raised, from DoPT/MoF are as under:-</p>

When air journey has been performed on two different PNR numbers. Can this be taken as a through ticket?&nbsp;(b) If No, can the LTC claim be reimbursed when the air journey is performed on two different PNR Numbers?</td><td>In terms of prevailing instructions on LTC, no break journey is allowed in any case and the Government officer availing LTC has to reach their intended place of destination via shortest route.</td></tr><tr><td>4.</td><td>“Whether LTC-80 will continue post disinvestment of Air India? For any place that is not enlisted in the LTC-80 fare list, with what should the Air Fare to that place be limited to while reimbursing LTC claim?</td><td>The LTC-80 was a scheme offered by Air India for booking of air tickets when Central Government Officers availed LTC. However, Air India has now been dis-invested and is no longer a PSU of Government of India. LTC-80 scheme offered by erstwhile Air India thus has lost its relevance.Post disinvestment of Air India, DoPT has issued guidelines vide OM No.31011/ 12/ 2022-Estt.A-IV dated 29.08.2022 wherein revised instructions for availing LTC by the government employees have been issued.This OM has further been modified vide DoPT’s OM No.31011/ 11/ 2023- Pers.Policy A-IV dated 20.10.2023.The instructions/ guidelines contained in the above said OMs may kindly be perused for required clarification.</td></tr><tr><td></td><td>If any official(in pay level 9 to 11) made his LTC journey with different modes of transport through longer route of journey despite destination point being directly connected by Air and Rail, then how such case shall be reimbursed . For instance, one official claimed for LTC journey from Patna to Hyderabad and made his journey as Patna &#8211; to Ahmedabad by air, Ahmedabad to Mumbai by Rail and Mumbai to Hyderabad by Govt. Bus.</td><td>Rule 13 of LTC Rules, may be referred which states that “Reimbursement under the leave travel concession scheme shall not cover incidental expenses and expenditure incurred on local journeys. Reimbursement for expenses of journey shall be allowed only on the basis of point to point journey on a through ticket over the shortest direct route” and also refer to GJI.D.1) of Rule 13(0.M No.43/ 10/ 58-Estt.(A),dated 11.04.1958). In such cases, no break journey Is allowed and the Govt. officer availing LTC has to reach his intended place of destination via shortest route.</td></tr><tr><td></td><td>Whether reimbursement under Special cash package scheme is to be made in case a government servant produces voucher of a vendor registered under Composite Scheme.</td><td>It is informed that MoF, DoE vide para 2(e) of OM No. 12(2)/ 2020-E.II.A dated 12.10.2020, has clearly stated that items/ services should carry a GST rate of not less than 12% and purchased from GST registered vendor / service provider through digital mode and obtain a voucher indicating the GST number and the amount of GST paid. Further vide point 9 of OM of even number dated 20.10.2020 it was clarified that any goods and services with GST details should be submitted . In this case, action be taken strictly in accordance with the MoF, DoE OM No. 12(2)/ 2020-E.II.A dated 12.10.2020 and subsequent FAQs issued on 20.10.2020.</td></tr></tbody></table></figure>



<p>4. Accordingly, it is stated that LTC cases may be regulated as per above clarifications received from the Ministry.</p>



<p>5. The cases already settled pursuant to MoF, OM dated 31.12.2021/ 16.06.2022 &amp; DoPT’s OM dated 29.08.2022, while still a lack of clarity in the matter, may also be re-examined/ re-regulated in the light of the above.</p>



<p>6. It may be noted that copies of office orders etc, in this regard need not be sent to Headquarters.</p>

<h3 class="wp-block-heading">Subject: Options under rule 10 of the Central Civil Services (Implementation of National Pension System ) Rules, 2021 from Central Government employees&nbsp;covered under the National Pension System -reg.</h3>



<p>The undersigned is directed to say that Rule 10 of the Central Civil Services (Implementation of National Pension System) Rules, 2021 provides for option to be exercised by every Central Government employee covered under National Pension System for availing benefits under National Pension System or old pension scheme in the event of death of Government servant during service or his discharge on the ground of invalidation or disablement.</p>



<p>2. In accordance with rule 10 of the Central Civil Services (Implementation of National Pension System) Rules, 2021, every Government servant covered under the National Pension System shall, at the time of joining Government service, exercise an option in Form 1 for availing benefits under the National Pension System or under the Central Civil Service (Pension) Rules or the Central Civil Service (Extraordinary Pension) Rules in the event of his death or boarding out on account of disablement or retirement on invalidation. Government servants, who are already in Government service and are covered by the National Pension System, shall also exercise such option.</p>



<p>3. Every Government servant shall, along with the option in Form 1, also submit details of family in Form 2 to the Head of Office.</p>



<p>4. Further, this Department vide OM of even number dated 26.10.2022 had requested all Ministries / Departments to obtain above information from all Central Government employees covered under NPS.</p>



<p>5. Even though these statutory provisions are being repeatedly communicated to Ministries / Departments, it is noticed that the options Form-1 and details of family in Form &#8211; 2 of the CCS (Implementation of NPS ) Rules, 2021 have not been obtained from all Central Government employees covered under NPS.</p>



<p>6. All Ministries/ Departments are, therefore, again requested to bring these provisions to the notice of Head of Offices for strict compliance.</p>

<h3 class="wp-block-heading">Sub:- Settlement of Family Pension between two wives of a Government Servant or Pensioner under Central Civil Services (Pension) Rules, 2021 &#8211; reg.</h3>



<p>The undersigned is directed to say that Department of Pension,in supersession of the Central Civil Services (Pension) Rules, 1972 has notified the Central Civil Services (Pension) Rules, 2021 and Rule 50 of the Central Civil Services (Pension) Rules, 2021 deals with payment of family pension on death of a Government servant/pensioner.</p>



<p>2. In accordance with Rule 50 (6) of the CCS (Pension) Rules, 2021, the family pension shall be payable to the members of the family of the deceased Government servant or pensioners in the following order:</p>



<ol style="list-style-type:lower-roman" class="wp-block-list">
<li>Subject to provisions of sub-rule (8), widow or widower, (including a post-retiral spouse and judicially separated wife or husband)</li>



<li>Subject to provisions of sub-rule (9), children (including adopted children, step children and children born after retirement of the pensioner),</li>



<li>Subject to provisions of sub-rule (10), dependent parents (including adoptive parents) of the deceased Government servant or pensioner,</li>



<li>subject to provisions of sub-rule (11), dependent siblings (i.e. brother or sister) of the deceased Government servant or pensioner, suffering from a mental or physical disability</li>
</ol>



<p>Whereas the Explanation to Rule 50(6) (1) of the CCS (Pension) Rules, 2021 states that -For the purpose of this rule ‘widow’ and ‘widower’ shall mean a spouse, legally wedded to the deceased Government servant or the pensioners.</p>



<p>3. Whereas Rule 50(8)(c) of the CCS (Pension) Rules, 2021 states that :</p>



<ol class="wp-block-list">
<li><em>Where the deceased Government servant or pensioner is survived by more widow than one, the family pension shall be paid to the widows in equal shares and on the death or ineligibility of a widow, her share of the family pension shall become payable to her child or children who fulfil the eligibility conditions mentioned in sub-rule (9).</em></li>
</ol>



<p>4. In this regard, references have been received in this department regarding eligibility of family pension to the second wife when the first wife is alive. Having second wife when the first wife is alive is against the provisions of Hindu Marriage Act, 1955 and also contradictory to the provisions of CCS(Pension) Rules, 2021. The matter has been examined and it has been decided that such cases needs to be processed in accordance with the provisions of CCS (Pension) Rules, 2021 and the issue of second wife or second marriage being legal or otherwise, may be decided first in consultation with Department of Legal Affairs on case to case basis for deciding the eligibility for Family Pension.</p>



<p>5. All Ministries/ Departments are requested to follow the process of consultation with Department of Legal Affairs before arriving at decision regarding Settlement of Family Pension between two wives under Central Civil Services (Pension) Rules, 2021. Such cases must be brought to the notice of the officer dealing with the pensioners’ benefits in the respective Ministry/ Department by the attached/subordinate offices.</p>

<h3 class="wp-block-heading">Subject: Central Civil Services (Leave Travel Concession) Rules, 1988 &#8211; Relaxation to travel by air to visit North East Region, Jammu &amp; Kashmir, Ladakh and Andaman &amp; Nicobar &#8211; extension beyond 25.09.2024 -regarding.</h3>



<p>The undersigned is directed to refer to this Department’s OM No. 31011/15/2022 -Estt.A-IV dated 11.10.2022 regarding relaxation to travel by air to visit North East Region, Jammu &amp; Kashmir, Ladakh and Andaman &amp; Nicobar, and to say that in relaxation to CCS (LTC) Rules, 1988, the scheme allowing Government servants to travel by air to North East Region (NER), Union Territory of Jammu and Kashmir (J&amp;K), Union Territory of Ladakh and Union Territory of Andaman &amp; Nicobar Islands (A&amp;N) is extended for a further period of two years, w.e.f. 26th September, 2024 till 25th September, 2026.</p>



<p>2. The above Special Dispensation Concession is subject to the following terms &amp; conditions: –</p>



<p>i. All eligible Government servants may avail LTC to visit any place in NER/ A&amp;N/ J&amp;K/ Ladakh against the conversion of their one Home Town LTC in a four years’ block period.</p>



<p>ii, Government servants, whose Home Town and Headquarters / place of posting are same, they are not allowed the conversion of any Home Town LTC as they are not eligible for the Home Town LTC facility.</p>



<p>iii. The Government servant whose Home Town is situated in NER/A&amp;N/J&amp;K/Ladakh will also be allowed conversion of Home Town LTC for availing this Scheme to visit any place in any one of the three regions out of the above mentioned four regions except the region wherein his/her Hometown is situated.</p>



<p>iv. Fresh Recruits are also allowed conversion of one of the three Home Town LTCs in a block of four years, applicable to them to visit NER/A&amp;N/J&amp;K/Ladakh. In addition, they are allowed one additional conversion of Home Town LTC to visit UT of J&amp;K/UT of Ladakh in a block of four years.</p>



<p>v. Government servants entitled to travel by air may avail this concession from their Headquarters in their entitled class of air by any airlines subject to the terms and conditions as enumerated in DoPT’s OM. No. 31011/12/2022- Estt.A-IV dated 29.08.2022 read with DoPT’s OM No. 31011/11/2023 – Pers. Policy A-IV dated 20.10.2023 (copies enclosed).</p>



<p>vi. Government servants not entitled to travel by air are allowed to travel by air in Economy class by any airlines subject to the terms and conditions as enumerated in DoPT’s OM dated 29.08.2022 read with DoPT’s OM No. 31011/11/2023 &#8211; Pers. Policy A-IV dated 20.10.2023 in the following sectors:- :</p>



<ol class="wp-block-list">
<li>Between Kolkata/Guwahati and any place in NER.</li>



<li>Between Kolkata /Chennai/Visakhapatnam and Port Blair.</li>



<li>Between Delhi/Amritsar and any place in J&amp;K/Ladakh.</li>
</ol>



<p>Journey for these non-entitled employees from their Headquarters upto Kolkata/ Guwahati/ Chennai/ Visakhapatnam / Delhi/ Amritsar shall be undertaken as per their entitlement.</p>



<p>vii. Air travel by Government employees to NER, J&amp;K, Ladakh and A&amp;N as mentioned in para (v) and (vi) above is allowed whether they avail the concession against Anywhere in India LTC or in lieu of the Home Town LTC, as permitted.</p>



<p>viii. Government servants not entitled to travel by air are also allowed to travel by air in Economy class by any airlines to any place in NER/ A&amp;N/ J&amp;K/ Ladakh from their Headquarters directly, however, the reimbursement will be subject to the conditions as enumerated in DoPT’s OM No. 31011/12/ 2022-Estt.A-IV dated 29.08.2022.</p>



<p>ix. The instructions regarding booking of air tickets through authorized travel agents, best available fares, slots, booking time, advances, reimbursement, etc., as mentioned in DoPT’s OM No. 31011/12/2022- Estt.A-IV dated 29.08.2022 read with DoPT’s OM No. 31011/11/2023 &#8211; Pers. Policy A-IV dated 20.10.2023 will also be applicable for this Special Dispensation Scheme.</p>



<p>3. All the Ministries/ Departments are advised to bring it to the notice of all their employees that any misuse of LTC will be viewed seriously and the employees will be liable for appropriate action under the rules. In order to keep a check on any kind of misuse of LTC, Ministries/ Departments are advised to randomly get some of the air tickets submitted by the officials verified from the airlines concerned with regard to the actual cost of air travel vis-a-vis the cost indicated on the air tickets submitted by the officials.</p>



<p>4. In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued as mandated under Article 148(5) of the Constitution and after consultation with the Comptroller &amp; Auditor General of India.</p>

<h3 class="wp-block-heading">Sub : Processing of Pension Cases as per the time-line prescribed in CCS (Pension) Rules, 2021</h3>



<p>It has been observed that the finalization of pension cases is not as per the timelines prescribed in the CCS (Pension) Rules 2021, which is causing undue hardship for pensioners. As per the CCS (Pension) Rules 2021, it is mandatory to process pension cases within the stipulated timelines to ensure timely payment of pensions to retirees. The rules prescribe the following timelines:</p>



<ol class="wp-block-list">
<li>The process of verification of service and other preparatory work should be undertaken one year before a government servant is due to retire on superannuation</li>



<li>The government servant should submit the forms six months before retirement to the Head of the Office.</li>



<li>The Head of the Office should send the pension case to the PAO four months before retirement.</li>



<li>The PAO should issue the PPO (Pension Payment Order) and send it to the CPAO (Central Pension Accounting Office) one month before retirement.</li>
</ol>



<p>The rules also provide for the sanction of provisional pensions in cases where a government servant is likely to retire before the finalization of their pension and gratuity.</p>



<p>To ensure timely payment of retirement dues in all cases, all the PAOs are directed to circulate the timelines for processing pension cases of employees to the HOOs, as per the Annexure. It must be ensured that PAOs as well as HOO of department strictly adhere to the timeline and process pension cases expeditiously to mitigate undue hardship to retirees.</p>

<h3 class="wp-block-heading">Subject: Extension of timelines for recording of APARs for the year 2023-24 in respect of Central Civil Services &#8211; reg.</h3>



<p>The undersigned is directed to refer to this Department’s OM No. 21011/1/2005 -Estt.(A)(Pt.I]) dated 23.07.2009 and OM No. 21011/04/2023-Estt.(A.I]) dated 15.04.2024 &amp; 28.05.2024 regarding timelines for recording of APARs and extension of timelines for submission of self-appraisal, respectively.</p>



<p>2. It has been reported that difficulties are being faced by various officers in sticking to the timelines given in the OMs referred to above.</p>



<p>3. Accordingly, the matter has been re-considered in this Department and it has been decided, with the approval of the competent authority, to extend the existing timelines relating to APAR for the year 2023-24, in relaxation of OM No. 21011/ 1/2005-Lstt.(A)(Pt.II) dated 23.07.2009 and OM No. 2101 1/04/2023-Estt. (A.II) dated 15.04.2024 &amp; 28.05.2024, as follows:</p>

<h3 class="wp-block-heading"><strong>Subject: Central Civil Services (Leave Travel Concession) Rules, 1988 &#8211; Fulfilment of procedural requirements</strong></h3>



<p>The undersigned is directed to refer to the above mentioned subject and to state that Government employees are allowed to encash 10 days earned leave at the time of availing of LTC to the extent of 60 days during the entire service. However, certain queries have been raised about whether to allow reimbursement of leave encashment or not in cases where the Government employees undertake journeys on private vehicles in areas connected by public transport or the Government servant himself decides to forgo his claim resulting in ‘Nil’ claim on journeys performed.</p>



<p>2. The matter has been considered and decided that since the leave encashment is limited upto 60 days in the entire service, the denial of encashment of leave would not be appropriate in such cases where the Government employee decides to forgo his claim of reimbursement for travel undertaken on private/ hired vehicle or his claim is ‘Nil’, provided that:</p>



<ul class="wp-block-list">
<li>(i) A Government employee intimates to the Department his intention to avail of LTC in advance and gets the leave sanctioned as per the prescribed procedure before the journey is undertaken;</li>



<li>(ii) The Government employee has submitted a request for leave encashment before the commencement of the journey;</li>



<li>(iii) The Government employee gives a self-declaration that he has actually travelled to the declared place of visit and is not claiming the fare reimbursement for the entire LTC journey.</li>
</ul>



<p>3. It is further clarified that in the following cases, the Government employees are not required to forgo the fare-reimbursement for LTC Journey as per prevailing instructions:</p>



<ul class="wp-block-list">
<li>(i) The Journey on LTC is made by taxi, auto-rickshaw etc, only between places not connected by rail and these modes operate on a regular basis from point to point with the specific approval of the State Governments/transport authorities concerned and are authorized to ply ;</li>



<li>(ii) Where a Government servant travels on LTC upto the nearest airport/railway station/ bus terminal by authorized mode of transport and undertakes the rest of the journey to a declared place of visit by private transport/ own arrangement (such as personal vehicle or private taxi, etc.), limited upto 200 KMs to and fro ;</li>



<li>(iii) When the Head of Department allows the use of own/hired taxi for an LTC journey on account of the disability of the Government servant or dependent family member as per the extant instructions.</li>
</ul>



<p>4. It is also reiterated that, within the same block, when the LTC is being availed of by the Government servant and his family members separately, encashment of leave would be restricted to one occasion only.</p>

<p>Reference: 1. Department OM No. 04-21/2017-IC/E.IIIA dated 28 Nov 2019 &amp; subsequent relaxation in rules through letter of even no dated 15 April 2021</p>



<p>2. This federation letter of even no.dated 16.06.2022, 01.08.2022 &amp; 21.12.2022.</p>



<p>Respected Sir,</p>



<p>With due regards, your kind attention is invited to the letters cited under reference 1 whereby instructions/clarifications were issued regarding Pay Fixation (including fixation of DNI) under FR 22(1)(a)(1) on regular promotion or financial up-gradation on or after 01.01.2016. And, employees were allowed to exercise/ re-exercise of option for pay fixation for past cases if they had not availed the same on the occasion of their regular promotion/ financial up-gradation.</p>



<p>Through the OM dated 15 April 2021, a special condonation, on one more occasion, was granted with a three month time-limit to all employees by relaxing the condition in exercising of option.</p>



<p>It is worth to mention here that during the same period (aftermath of 15 April 2021) the sudden outbreak of corona pandemic derailed the life of all. Establishments were being run at least strength. Everyone was struggling to save the lives of his dear ones.</p>



<p>In such a catastrophic situation’ employees could not avail the above relaxation. But, with restoration of normalization, many employees started to approach this federation for a further extension/ relaxation in rules for one more and last time.</p>



<p><strong>As the situation was beyond their control and the OM dated 15 April 2021 could not be availed by the employees, you are again requested to condone the delay for one more time and give one more opportunity to all employees in this regard.</strong></p>

<p>Subject: <strong>Recognition of Central Secretariat Service Associations under the Central Civil Services &#8211; (Recognition of Service Associations) Rules, 1993 &#8211; regarding.</strong></p>



<p>The undersigned is directed to refer to this Department&#8217;s O.M. of even number dated 22nd November 2022 wherein this Department had invited fresh applications from Associations / Unions of employees belonging to the Central Secretariat Service, Central Secretariat Stenographers&#8217; Service, Central Secretariat Clerical Service, etc. (other than recognised Central Government Staff Car Drivers&#8217; Association and Central Secretariat MTS Association) who wish to seek recognition under the CCS (Recognition of Service Associations) Rules, 1993. The Association(s) were requested to submit their application for recognition by 15.12.2022 (copy enclosed).</p>



<ol class="wp-block-list" start="2">
<li>It has now been decided to extend the date of acceptance of applications till 20th January, 2023. Therefore, Central Secretariat Employees Associations / Unions who have not submitted application for recognition till date, are requested once again to submit their applications along-with the relevant documents by 20th January, 2023.</li>

<p>Subject: <strong>Recognition of Central Secretariat Service Employees Associations under the Central Civil Services- (Recognition of Service Associations) Rules, 1993 &#8211; regarding.</strong></p>



<p>The undersigned is directed to refer to this Department&#8217;s O.M. No.17/1/2017 &#8211; R&amp;R and DC dated 29.06.2017 vide which fresh applications for recognition were invited from the above mentioned employees&#8217; associations and subsequently two associations namely (i) Central Government Staff Car Drivers&#8217; Association, and (ii) Central Secretariat MTS Association, who fulfilled requisite criteria were recognized for a period of five years.</p>



<ol class="wp-block-list" start="2">
<li>Department has now decided to invite FRESH APPLICATIONS from other Associations/ Unions of employees belonging to the Central Secretariat Service, Central Secretariat Stenographers&#8217; Service, Central Secretariat Clerical Service, etc. who wish to seek recognition under the CCS (Recognition of Service Association) Rules, 1993. Association(s) may submit their application for recognition by 15.12.2022. Association, irrespective of their earlier application(s) submitted, if any, are required to submit applications afresh. The application should be sent to this Department along with the<br />following documents: &#8211;</li>
</ol>



<ul class="wp-block-list">
<li>i. Memorandum of Association (MOA).</li>



<li>ii. Constitution I Bye-laws of the Association,</li>



<li>iii. Names of the Office-bearers of the Association along with their designation, elected from the cadre(s) the Association represents, &amp;</li>



<li>iv Ministry / Department wise list of estimated membership of the Association.</li>
</ul>



<ol class="wp-block-list" start="3">
<li>The Constitution/ Bye-laws of the Association should be in conformity with the CCS (RSA) Rules, 1993. For the sake of convenience, the salient features of the constitution are reiterated in the Annexure to this O.M.</li>



<li>The membership of an Association/Union should be restricted to a distinct category of Govt. servants having common interest and eligible to be members vide rule 5(C) of the CCS(RSA) Rules, 1993. </li>



<li>Recognition will be accorderto an association on fulfilling the conditions prescribed in the CCS (RSA) Rules 1993 and orders instructions issued there under from time to time.</li>
</ol>



<ol class="wp-block-list" start="6">
<li>All the Cadre Controlling authorities of the Central Secretariat are requested to give wide publicity to the contents of this Office Memorandum so that the Service Associations / Unions of the Central Secretariat employees can submit their applications by 15th December, 2022.</li>



<li>This issues with the approval of the competent authority.</li>
