<p><strong>Compulsory retirement under railway rules equivalent to fr 56 (j) &amp; pension rules 48 of ccs (pension) rules 1972</strong></p>

<p>WHEREAS the Senior Divisional Operating Manager, Pa<strong>l</strong>ghot, of the opinion that it is in the public interest to do so:</p>



<p>NOW,
 THEREFORE, in exercise of the powers conferred by clauses Sub Clause 
(ii) and b (i) of Rule 1802 (a) read with pars 620 (It) of Manual of 
Pension Rules 1950 of IREC, Vol. II Senior Divisional Operating 
Manager/Palghat hereby retires Shri. R.K. Unnikrishnan, Station 
Superintendent/MJS with immediate effect, he having already attained the
 age of fifty-five years on the date of acceptance (29.07.19) of Review 
Committee’s recommendation by the ADRM. R.K.Unnikrishnan, SS/MJS, will 
be paid a sum equivalent to the amount of his pay plus allowances for a 
period of three months, calculated at the same rate at which he was 
drawing them immediately before his retirement. If he so desires, he may
 represent in writing to DRM/PGT within three weeks from the date this 
notice is served on him.</p>

<p>Subject: <strong>Sanction for holding an elective office under Rule 15(1)(c) ofCCS(Conduct) Rules, 1964 &#8211; reg.</strong></p>



<p>The  undersigned is directed to say that as per Rule 15 (1) (c) of the  CCS(Conduct) Rules, 1964, no Government servant shall except with the  previous sanction of the Government, hold an elective office, or canvass  for a candidate or candidates for an elective office, in any body,  whether incorporated or not DoPT&#8217;s O.M. No. 1l0l3/9/93-Estt.(A) dated  22.04.1994 had also stipulated that no Government servant should be  allowed to hold elective office in any sports association/federation for  a term of more than 4 years, or for one term whichever is less.  Further, according to Department of Personnel &amp; Training OM No.  11013/ ll /2007-Estt (A) dated the 13th November, 2007, the entire time  of the Government servant should be available to the Government and that  no activities unconnected with his or her official duties should be  allowed to interfere with the efficient discharge of such duties. All  Ministries were requested to ensure that the participation of the  Government servants in the activities of the cooperative societies  conform to the above provisions and does not interfere with the  discharge of their official duties.</p>



<p>2. Instances have 
come to notice where Government servants continue to hold elective 
offices in various capacities for unduly long periods. In some 
cases,where bye-laws of these bodies place restrictions on the number of
 consecutive terms a person may hold an office, Government servants are 
reported to have either got themselves re-elected after a gap or have 
got a family member/ close relative elected as a surrogate in order to 
keep control of such bodies. In such cases, Government servants may not 
be bestowing adequate attention upon their official duties and, as a 
result, an apprehension may arise that such Government servants also 
develop vested interests, particularly if the body is involved in 
commercial activities, directly or indirectly.</p>



<p>3. The 
policy on fixing an upper limit of the number of years for which 
Government servants can hold elective office in any body in their entire
 career has been reviewed and it has been decided that a Government 
servant may be allowed to hold elective office in any body, whether 
incorporated or not, for period of two terms or for a period of 4 
]rears. whichever is earlier, for which prior sanction would be required
 when a Government servant contests an election in such body, as per 
existing rules.</p>



<p>4. It is, therefore, necessary for the 
Competent Authority to keep in mind all the relevant factors while 
granting permission under Rule 15(1)(c) of CCS(Conduct) Rules, L964. It 
may also be necessary that cases of such sanctions are reviewed from 
time to time and permissions earlier granted revoked where Government 
servants have been holding office in any body,whether incorporated or 
not, for more than four years or in cases there are charges of 
corruption, adverse audit paras etc. In such cases, the Government 
servant concerned may be directed to resign from his office in such body
 immediately. He will cease to discharge any function from the date such
 direction is conveyed to him, irrespective of the fact whether his 
resignation from the body is accepted or not. This action may be taken 
immediately in those cases where information is already available with 
the Ministries and Departments. In addition, all the Ministries and 
Departments are also requested to obtain information from their 
employees in the proforma attached to this Office Memorandum for 
reviewing the position as well as while considering the request for 
sanction under Rule 15(1)(c) of CCS(Conduct) Rules, L964 in future.</p>



<p>5. This O.M. issues in supersession of DoPT&#8217;s ll0l3/9/93-Estt.(A) dated 22.O4.1994.</p>



<p>6.
 In so far as the employees of Indian Audit and Accounts Departments are
 concerned, this O.M. issues after consultation with Comptroller &amp; 
Auditor General of India.</p>



<p>7. All 
Ministries/Departments/Offices are requested to bring the above 
instructions to the notice of all administrative authorities under their
 control.</p>

<p>Sir,<br /> Subject: <strong>CCS (RP) Rules, 2016 &#8211; Opportunity for revision of option to come over to revised pay structure &#8211; Clarifications.</strong></p>



<p>Ref: This office Lr. No.669/ PM·II/IFA/Genl./ 7thCPC Pay fixation dated 23.07.2018 .</p>



<p>Following the O.M.No.4-13/17/IC/E-IIA  dated 12th December, 2018 issued by the Department of Expenditure, Ministry of Anance on the opportunity for revision of option to come over to reyised pay structure, this office has received references seeking clarification on the eligibility of the officials for exercising revised option from some of the units namely; O/o CPMG &#8211; Vijayawada, HRO &#8211; &#8216;V&#8217; Division and Waltair RS HO in Visakhapatnam Division in A.P. Circle. The matter has been perused with reference to the OM dated 12.12.2018 and the CCS (RP) Rules, 2016 and the point of doubts are clarified as under:-</p>



<p>1. <strong>Point of doubt</strong> : In view of M.F., O.M. No.4-13/17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial upgradation In Feb./ March/ August/ September, 2017 and December 2018 are eligible to exercise revised option to come over to revised pay structure on the date of their financial up-gradation under <strong>MACPS</strong>.</p>



<p><strong>Clarification</strong>:- The Central Govt. employees have been permitted another opportunity to revise their Initial option to come into revised pay structure in <strong>terms of Rules 5 &amp; 6 thereof of CCS (RP) Rules, 2016</strong> vide M.F., OM No.<br /> 4-13/ 17-IC/E-IIIA dated 12-12-2018. Wherein, it has been also repeated to make the meaning dear that <strong>all other terms and conditions as laid down in the said Rules 5 &amp; 6 shall continue to be applicable for the revised options. </strong>As per the second provision of the Rule 5, in cases where a Government servant has been placed in a higher grade pay or scale between 1st January 2016 and the date of notification of these rules on account of promotion or up-gradation, the Government servant may switch over to the revised pay structure from the date of such promotion or up-gradation, as the case may be. <strong>Hence it is clarified that the officials who ace awarded promotion/ financial upgradation after the date of notification of the CCS (RP) Rules, 2016 (j,e. 25.07.2016) are not entitled to exercise option/revised option -to come over to the revised pay structure on the date of their promotion/ financial upgradation.</strong></p>



<p>2. <strong>Point of doubt</strong>:  In view of M.F., O.M. No.4-13/ 17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial upgradation In Feb./ March, 2017 under MACPS are eligible to exercise revised option to come over to revised pay structure on the date of their subsequent increment in pre revised pay structure (i.e. on 01.07.2017).</p>



<p><strong>Clarification</strong>:- As furnished In the clarification on point of doubt &#8211; 1 above, <span style="text-decoration: underline;">all other terms and conditions as laid down In the Rules 5 &amp;. 6 thereof shall continue to be applicable</span> for exercising revised option. As per the first provision of the Rule 5, a Government servant may elect to Continue to draw  pay in the existing pay structure until the date on which he earns his next or any subsequent increment In the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure. As per explanation-1 under the Rule 5, <span style="text-decoration: underline;"><strong>the option to retain the existing pay structure under the provisions to this rule shall be admissible only in respect of one existing pay Band and Grade pay or Scale.</strong></span></p>



<p>Further, switching over to the revised pay structure either on 01-01-2016 or<br />
from a later date than 01-01-2016 i.e. on the date of promotion/ upgradation<br />
or the date next/ any subsequent increment, are applicable under Rule 5 in case of post/ Pay Band or Grade Pay held on 01-01-2016. Thus, if the date of next or any subsequent increment (i.e. on 01-07-2016 or any subsequent date of increment) for a post/Pay Band or Grade Pay held on 01-01-2016 falls after the date of promotion, then the date of next/ any  subsequent increment for the post/ Pay Band or Grade Pay held on 01-01-2016 has no relevance for option, as this post/ Pay Band or Grade Pay on 01.01.2016 is no longer held on the date of next/ any subsequent date of Increment.</p>



<p><strong>Hence. it is clarified that the officials who are awarded promotion/ financial up gradation under MACPS prior to the next or any subsequent date of increment in the pre revised Day structure are not entitled to exercise option/revised option to come over to revised Day structure on the date of next or any subsequent date of increment i e 01.07.2016 or 01.07.2017 etc. (With regards to the said clarifications this officer. No. 69/ PM-II/IFA/ Genl./ 7thCPC Pay fixation Visakhapanam  by endorsing copies to all the Regional Offices and the Divisional Heads may also be referred to.)</strong></p>



<p><strong>Point of doubt on Method of fixation of pay:</strong> As per the representations, the officials are seem to be on the opinion that fixation of their pay on promotion/ up-gradation on or after 01 -01-2016 will be done first in pre  revised pay structure (6th CPC) and then (after placement to the promotional grade in pre revised pay structure), the revision of pay in the revised pay structure will be done as per Rule 7 of CCS (RP) Rules, 2016.</p>



<p><strong>Clarification </strong>: In case of an admissible option is exercised to come over to revised pay structure on the date of promotion/ up-gradation or on the date of next/ any subsequent increment in pre revised pay structure; <strong>revision of pay will be made first as prescribed in clause A of sub rule 1 under Rule 7 of the CCS (RP) Rules, 2016 w.r.t. the existing basic pay in pre revised pay structure-e i.e. in the prescribed existing Pay Band and Grade Pay, and after switching over to the r-evised pay structure, the fixation of pay on promotion (after 01.01.2016) shall be made as prescribed in rule 13 of the CCS-(RP) Rules, 2016.</strong></p>



<p>This has the approval of the General Manager (Finance).,</p>

<p>Dear Colleagues,<br />
After 6th CPC,the employees who are granted<strong> Rs.4200/-</strong> Grade Pay have been classified as Group &#8216;B&#8217; Industrial and Non-Gazetted by DOP&amp;T. Though these categories of employees have been appointed by the Sr. General Managers/General Managers of Heads of the establishments but disciplinary powers in respect of Group &#8216;B&#8217; and &#8216;C&#8217; Civil posts have been authorised to Chairman OFB.</p>
<p>The issue of delegation of powers to Sr.GM/GM of the respective factoris was discussed in JCM III and the same was taken up by OFB to MoD and DOP&amp;T. Now it has been approved by amending the Part V schedule to CCS(CCA) Rules 1995 delegating the powers to the appointing authority in respect of dealing the disciplinary cases of Group &#8216;B&#8217; Non-gazetted and Non-Industrial and Industrial employees drawing the Grade pay of <strong>Rs.4200/-</strong> and below. In respect of Group &#8216;B&#8217; Gazetted officials will be concerned by ADCOF.</p>

<p>Subject: <strong>Revision of disability pension and family pension under CCS (EOP) Rules to pre 1996 and pre-2006 disability pensioners and family pension under CCS(EOP)Rules &#8211; inclusion of Non-practicing Allowance (NPA) for revision or disability pension and family pension covered under CCS(FOP) Rules to retired medical Officers &#8211; regarding</strong></p>
<p>The undersigned is directed to say that orders were issued vide this Department’s OM No 45122/1997-P&amp;PW (C) dated 11.9.2001 for revision of disability pension/Family pension under CCS(E0P)Rules in respect of Pre-1996 pensioners. These orders inter-alia provided for revision of Pension of Pre-1996 Disability Pensioners and family pensioners under EO.P Rules on the basis of the minimum basic pay in the revised pay scale applicable w.e.f 1 1.1996.</p>
<p>2. Vide this Department&#8217;s OM No. 45/3/2008-P&amp;PW(F) dated 30.9.2010, as amended vide OMs dated 20.11.2014, 29 4.2016 and 8.8.2016, orders were issued for revision of pre-2006 Disability Pensioners and family pensioners under EOP Rules on the basis of the minimum of the pay in the pay band plus grade pay or minimum of pay in the revised scare of pay applicable from 1.1.1996 corresponding to the pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No. 1/1/2008-IC dated 30/8/2008.Revision of disability pension and family pension under CCS(EOP)Rules &#8211; inclusion of NPA</p>
<p>3, In implementation of the judgment dated 27.11.2013 of Hon&#8217;ble Supreme Court in CA No. 10640-36 of 2013 and other connected matters, orders were issued. vide this Department&#8217;s OM No. 38/31/2011-P&amp;PW (A) (Vol.IV) dated 14.10.2014 that in the case of Pre-1996 retired Medical Officers, NPA at the rate of 25% shall be added to the minimum of the revised scale of pay as on 1.1.1996 corresponding to pre-1996 pay scales from which the pensioner has retired in cases where consolidated pension/family pension was to stepped up based on minimum of revised pay scales.</p>
<p>4. Similarly, orders were issued vide OM NO.38/31/2011-P&amp;PW(A) (Vol-IV) dated the 18th February, 2015 that in the case of pre-2006 retired Medical Officers, NPA @ 25% would be added to the minimum of the pay in the revised pay band plus grade pay (or minimum of pay in the revised pay scale in the case of HAG and above ) as on 01.01.2006 corresponding to the pre-revised pay scales from which they retired in case where pension / family pension is to be stepped up to 50% / 30% of the minimum pay respectively</p>
<p>5. It is hereby clarified that for the purpose of revision of Disability Pension/family pension of the pre 1996 pensioners under CCS(EOP) Rules also, NPA at the rate of 25% shall be added .to the minimum of the pay in the revised scale of pay on 01,01.1996 corresponding to the Pre 1996 pay scales in respect of the retired Medical Officers. Similarly, for the purpose of revision of Disability pension/Family pension of pre-2006 pensioners under CCS(EOP)Rules, NPA @25% shall be added to the minimum of the pay in the pay band plus Grade pay or minimum of the pay in the revised pay scale applicable from 01.01.2006 corresponding to the pay scale from which the pensioner retired.</p>
<p>6. The emoluments (minimum pay + NPA) to be reckoned for calculation of the Disability Pension/Family pension in terms of the above provisions would not exceed Rs. 30,000/- w.e.f 1.1,1996 and Rs.85,000 w.e.f 1.1.2006.</p>
<p>7. The other terms and conditions stipulated in this Department’s OM No. OM No. 45/22/1997-P&amp;PW (C) dated 11.9.2001 and OM No 45/3/2008-P&amp;PW(F) dated 30,9.2010, 20.11.2014, 29.4.2016 and 8.8.2016 shall remain unchanged.</p>

<p>The undersigned is directed to forward herewith a copy of Department of Expenditure&#8217;s OM No.8-23/2017-E.III A dated 28.9.2018 for information and compliance to all cadre units of CSS in respect of Assistant Section Officers of CSS cadre, who got promoted on or after 1.1.2006 and whose pay, as fixed under Rule 13 of CCS (RP) Rules, 2008 happened to be lower than the entry pay of direct recruit Assistant Section Officers appointed on or after 1.1.2006.</p>
<p>2. This is also in compliance with the direction of Hon&#8217;ble Central Administrative Tribunal, Principal Bench&#8217;s Order dated 6.7.2018 (pronounced on 3.8.2018) in respect of OA No.1015/2013 (Shri Radhey Shyam Singh &amp; Others Vs. Union of India).</p>

<p>Subject:- <em><strong>Central Civil Services (Leave Travel Concession &#8211; LTC) Rules, 1988 &#8211; Relaxation to travel by air to visit North East Region, Jammu &amp; Kashmir and Andaman &amp; Nicobar &#8211; extension beyond 25.09.2018.</strong></em></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. No.31011/3/2014 – Estt.A-IV dated 19.09.2016 on the subject noted above and to say that in relaxation to CCS (LTC) Rules, 1988, the scheme allowing Government servants to travel by air to North East Region (NER), Jammu and Kashmir (J&amp;K) and Andaman &amp; Nicobar Islands (A&amp;N) is extended for a further period of two years, w.e.f. 26th September, 2018 till 25th September, 2020 as under:</p>
<blockquote><p><strong><em>(i) LTC for visiting NER, J&amp;K and A&amp;N in lieu of a Home Town LTC.</em></strong></p>
<p><strong><em>(ii) Facility of air journey to non-entitled Government servants for visiting NER, J&amp;K and A&amp;N.</em></strong></p>
<p><strong><em>(iii) Permission to undertake journey to J&amp;K, NER and A&amp;N by private airlines.</em></strong></p></blockquote>
<p>2. The above special dispensation is subject to the following terms &amp; conditions:</p>
<p>(i) All eligible Government servants may avail LTC to visit any place in NER / A&amp;N/ J&amp;K against the conversion of their one Home Town LTC in a four year block.</p>
<p>(ii) Government servants, whose Home Town and Headquarters/place of posting is the same, are not allowed the conversion .</p>
<p>(iii) Fresh Recruits are allowed conversion of one of the three Home Town LTCs in a block of four years, applicable to them.</p>
<p>(iv) Government servants entitled to travel by air may avail this concession from their Headquarters in their entitled class of air by any airlines subject to the maximum fare limit of LTC-80.</p>
<p>(v) Government servants not entitled to travel by air are allowed to travel by air in Economy class by any airlines subject to the maximum fare limit of <strong>LTC-80</strong> in the following sectors:</p>
<blockquote><p><strong><em>(a) Between Kolkata/Guwahati and any place in NER.</em></strong></p>
<p><strong><em>(b) Between Kolkata/ChennaiNisakhapatnam and Port Blair.</em></strong></p>
<p><strong><em>(c) Between Delhi/Amritsar and any place in J&amp;K.</em></strong></p></blockquote>
<p>Journey for these non-ntitled employees from their Headquarters up to Kolkata/ Guwahati/ Chennai/ Visakhapatnam/ Delhi/ Amritsar shall be undertaken as per their entitlement.</p>
<p>(vi) Air travel by Government employees to NER, J&amp;K and A&amp;N as mentioned in para</p>
<p>(iv) and (v) above is allowed whether they avail the concession against Anywhere in India <strong>LTC</strong> or in lieu of the Home Town <strong>LTC</strong> as permitted.</p>
<p>(vii) Air Tickets are to be purchased directly from the airlines (Booking counters, website of airlines) or by utilizing the service of Authorized Travel Agents viz. ‘M/s Balmer Lawrie &amp; Company&#8217;, &#8216;M/s Ashok Travels &amp; Tours&#8217; and &#8216;<strong>IRCTC</strong>&#8216; [to the extent IRCTC is authorized as per DoPT&#8217;s O.M. No. 31011/6/2002- Estt.(A) dated 02.12.2009] while undertaking <strong>LTC</strong> journey . Booking of tickets through other agencies is not permitted and no request for relaxation of rules for booking the tickets through such agencies shall be considered by this Department.</p>
<p>3. Efforts should be made by the Government servants to book air tickets at the cheapest fare possible. All the Ministries/ Departments are advised to bring it to the notice of all their employees that any misuse of <strong>LTC</strong> will be viewed seriously and the employees will be liable for appropriate action under the rules. In order to keep a check on any kind of misuse of <strong>LTC</strong>, Ministries/ Departments are advised to randomly get some of the air tickets submitted by the officials verified from the airlines concerned with regard to the actual cost of air travel vis-a-vis the cost indicated on the air tickets submitted by the officials .</p>
<p>4. In so far as the employees of Indian Audit and Accounts Department are concerned, this order issues after consultation with Comptroller &amp; Auditor General of India.</p>

<p>The below statement said in written reply to a question in Lok Sabha on 1st August, 2018 regarding steps taken to identify dull officers and action taken against such officers…</p>
<p>Review of performance of Government servants is an ongoing process under Fundamental Rule 56(j) and Rule 48 of Central Civil Services (Pension) Rules, 1972, which provide that the performance of a Government servant on attaining a specified age or qualifying years of service is to be reviewed and he/she can be retired in public interest.The instructions on the procedure to be adopted and various aspects to be kept in view while conducting periodical review under provisions of the said rules have been issued from time to time.</p>
<p>As per available information provided by cadre controlling authorities, performance of a total of 25,082 Group &#8216;A&#8217; and 54,873 Group &#8216;B&#8217; officers has been reviewed up to May 2018; and provisions of Fundamental Rule 56 (j)/ relevant rules were invoked/ recommended against 93 Group &#8216;A&#8217; and 132 Group &#8216;B&#8217; officers out of these.</p>
<p>Confidential Rolls (CRs) / Performance Appraisal Reports (PARs) of IAS officers are written for each financial year or as may be specified by the Government in the form and as per the schedule prescribed in the All India Services (Performance Appraisal Report) Rules, 2007. The appraisal form of IAS officers, inter alia, provides for comments on the overall quality of officers including areas of strength and his attitude towards weaker sections.</p>

<p>Subject: <strong>Leave to a Government servant who is unlikely to be fit to return to duty &#8211; Reg.</strong></p>
<p>The undersigned is directed to say that the CCS (Leave) Rules, 1972 have been amended vide Notification G.S.R. No. 438 (E) dated 03.04.2018 (copy enclosed) to bring them in conformity with the Rights of Persons with Disabilities Act, 2016. Accordingly, it has now been decided that leave applied under rule 20, shall not be refused or revoked without reference to the Medical Authority, whose advice shall be binding. Further, any leave debited for the period(s) granted after receipt of the certificate of disability of the Medical Authority, shall be remitted back into the leave account of the Government servant. The Certificate of Disability is required to be issued in Form &#8216;3A&#8217; which should be signed by a Government doctor of a Government medical board. Further, a Government servant who is granted leave in accordance with the provisions of clause (b) of sub rule (1) of rule 20 of CCS (Leave) Rules, 1972, the provisions of section 20 of the Rights of Persons with Disabilities Act, 2016(49 of 2016) shall, suo-motu, apply.</p>
<p>2. These orders are to be effective from 19.04.2017.</p>

<h3>Policy for Removal of Non-Performing Civil Servants</h3>
<p>The provisions under Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rule, 1972 and Rule, 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 have laid down the policy of periodic review and premature retirement of non-performing Government servants.</p>
<p>Up to January, 2018, a total of 21,195 Group &#8216;A&#8217; and 47,039 Group &#8216;B&#8217; officers have been reviewed, out of which provisions of FR 56(j) and relevant rules were invoked/recommended against 83 Group &#8216;A&#8217; and 128 Group ‘B’ officers, including 15 officers of All India Services.</p>
<p>This was stated by the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr. Jitendra Singh, in written reply to a question in the Rajya Sabha today.</p>
